The Article is divided into two parts. Part One discusses the Natural Gas Horizontal Well Control Act, which was enacted by the West Virginia Legislature on December 14, 2011. Part Two discusses developments in West Virginia's case law regarding oil and gas. In this Part, the Authors will discuss and analyze major decisions issued by the West Virginia Supreme Court of Appeals, as well as decisions by the United States District Courts for the Northern and Southern Districts of West Virginia.

This Article summarizes and discusses important cases, legislation, and regulations issued or enacted pertaining to the oil and gas jurisprudence of West Virginia between September 1, 2010, and August 31, 2011. The Authors acknowledge that the term "important" is subjec- tive; nevertheless, they endeavor to discuss the most germane cases and regulations affecting the oil and gas industry. This Article is divided into two parts. Part One discusses a very important regulation promulgated by the Office of Oil and Gas, a division of the West Virginia Department of Environmental Protection, regarding water use by the oil and gas industry when drilling horizontal wells. Noticeably absent from this Part is any discussion of major legislation affecting the oil and gas industry. During the requisite period, no significant legislation was enacted, which the Authors subjectively deemed worthy of discussion. Nevertheless, the legislature introduced numerous bills, which if enacted, would have substantially impacted the oil and gas industry. Part Two of this Article discusses developments in West Virginia's case law regarding oil and gas. In this Part, the Authors will discuss and analyze major decisions issued by the West Virginia Supreme Court of Appeals ("Supreme Court of Appeals"), one important case litigated in the Circuit Court of Monongalia County, West Virginia, and the United States District Courts for the Northern and Southern Districts of West Virginia.

The strikes were remarkable because, in an American industry known for violent labor relations and intensive union organizing since the appearance of the Molly Maguires in Pennsylvania before 1880, this was the first major strike in southern West Virginia. We might attempt to understand the role of law and public authority in these strikes in terms of legal repression by means of the labor injunction, labor conspiracy laws, and strikebreaking by the police and military. But none of these occurred in Fayette in 1895, though the later history of labor conflict in West Virginia is replete with all of them. In another way, however, the legal events accompanying these strikes are far more remarkable and challenge us to examine more subtle connections between class conflict and law.

A comparative analysis of the early 2018 statewide educators’ strikes in West Virginia, Arizona, and Oklahoma illustrates the viability of a relatively neglected prescription for revitalizing organized labor: illegal strike action. Whereas the West Virginia and Arizona walkouts successfully ignored legal prohibitions on striking and won major concessions from the state, Oklahoma’s action was less successful in part because it remained on the terrain of legality. The experience of these three actions indicates that rank-and-file workers, union officials, and labor scholars should reconsider the labor movement’s prevailing strategy of working within the law.

West Virginia became the 29th state in the country to legalize cannabis for medicinal purposes in 2017. Two years later, the state's medicinal marijuana program is scheduled to start enrolling patients; however, state legislators acknowledge that the program is still years behind actual implementation due to obstacles that have become seemingly insurmountable via existing channels. This paper undertakes a holistic evaluation of the value of blockchain to the nascent medicinal marijuana industry in West Virginia. Three use cases are presented to address the difficulties the state has experienced during the program's first two years of rollout efforts. Specifically, a blockchain use case is developed to address the issue of traceability to prove provenance, managing the vertically integrated supply chain and because of federal tax law the particularly cumbersome issue of collecting and storing payments.

The study of crime, law, and social control is now much less urban-biased than it was at the start of this millennium, and there is an ongoing significant increase in international qualitative and quantitative rural criminological research. Nonetheless, a conspicuous absence of reliable estimates of crime victimization in rural parts of the United States continues to exist. This article helps fill a major research gap by presenting the results of the first phase of the West Virginia Community Quality of Life Survey.

Three recent opinions issued by the United States (US) Supreme Court suggest the possibility of a new interpretation of key drug enforcement provisions in the Controlled Substances Act of 19701 (CSA) affecting prescribers of controlled substances. Applying the Court's holdings in Xiulu Ruan v. US,2 Dobbs v. Jackson Women's Health Organization,3 and West Virginia v. Environmental Protection Agency4 to the Department of Justice's and the Drug Enforcement Administration's overreaching enforcement of the CSA, this paper contends that Congress should amend the CSA and rectify the broad misapplication of the law to the practice of medicine.

We present a comparison of movements of adult female white-tailed deer (Odocoileus virginianus) in response to seasonal bait sites in the central Appalachians of West Virginia, USA. Our objectives were to compare bait-site use among seasons, evaluate home-range and core-area sizes between baiting and non-baiting periods, and compare distance from the geographic centres of activity to nearest bait site between baiting and non-baiting periods. From June 2000 to May 2001, we radio-monitored 52 deer and determined their use of 29 seasonal bait sites with automated camera systems. We collected 6461 locations and 1333 photographic observations of radio-collared deer. Bait-site use did not differ among four seasonal baiting periods. Additionally, home-range and core-area sizes did not differ between baiting and non-baiting periods. However, deer shifted their centres of activity closer to bait sites during baiting periods. High variability in deer behaviour should be considered when implementing deer-management activities that require all deer to use bait sites, such as infrared-triggered camera surveys.

The community of Huntington, an Appalachian city in West Virginia with the highest overdose rate in the nation, participated as an Innovation Community in a grant funded Community Assessment and Education to Promote Behavioral Health Planning and Evaluation (CAPE II) project. Activities entailed designing and implementing an innovative, replicable, and sustainable early warning protocol that addressed a locally determined set of community behavioral health issues. Using 192 publicly available indicators tracked for a year throughout 12 geographic neighborhoods, the authors developed an early warning system and analyzed relationships between key indicators and substance overdose and arrests. Community interventions were designed to address these relationships from the perspective of social workers, law enforcement officers, and community members.

Paul Mullen passed away at his home in Savannah, Georgia, on December 24, 2009. Paul had been our graduate student and remained our friend. His sense of humor was legendary: mordant, witty, and always to the point. His untimely death brought to an end a life filled with accomplishment. Paul Mullen had managed to fill his life with several careers. His first career had been as an attorney. As well as working in private practice for several years, he also was Assistant Attorney General for the state of West Virginia. He specialized in labor law and was head of the section in the Attorney General's Office responsible for litigation in that field.

In this paper the determinants of the adoption of new technology are explored by using data obtained from a 1993 survey of 299 manufacturing establishments in the state of West Virginia. The authors examine the use of twenty hardware-based and organizational new manufacturing technologies, aggregate use of technology, and plans for future use of technology. Multivariate regression analyses indicate that larger, export-oriented, branch plants that manufacture products in long production runs, and plants that are located in counties with a sizeable manufacturing sector adopt more new technologies than do other types of plants. The results also suggest that there is a role for further government policy in encouraging plant modernization. Although participation in a state technology-assistance program is not yet associated with higher aggregate levels of use of new technology, it is found to be associated with the adoption of specific technologies and receptivity to investment in new technology. The results of the study also confirm the value of training and suggest that a strategy of targeting smaller and medium-sized plants with services focused on multiple clustered locations may be effective in stimulating the use of new technology among these manufacturers.

In September 2022, the Federal Communications Commission adopted a new rule changing the deorbiting timeframe for satellites ending their missions in low Earth orbit from a twenty-five-year recommendation to a five-year legal requirement. The adoption of this rule, which seeks to cultivate a sustainable orbital environment for satellites, followed the United States’ July 2022 National Orbital Debris Implementation Plan, which tasked federal agencies with reviewing the effectiveness of their orbital debris-related rules. In the wake of the Supreme Court’s June 2022 West Virginia v. EPA decision, however, federal rulemaking in the area of orbital debris may not survive judicial scrutiny in the absence of explicit congressional authorization to do so. The purpose of this Article is to provide arguments for why Earth’s orbital environment should be protected under the National Environmental Policy Act and to provide draft legislation that is responsive to both the Orbital Debris Plan and the Supreme Court’s recent EPA ruling, which will enable FCC rulemaking in the area of orbital debris.

AbstractAs the opioid epidemic continues in the United States and ongoing litigation seeks to hold contributors responsible, state governments have initiated lawsuits against retail pharmacies for their role in contributing to the crisis. This article summarizes an action the State of West Virginia brought against CVS, which the parties recently settled in the fall of 2022. This article examines the unique position of retail pharmacies like CVS, which often serve as both distributors and dispensers, in contributing to the oversaturation and illicit diversion of opioid prescriptions. The article concludes by assessing the viability of potential causes of action against retail pharmacies in opioid litigation.

This article presents crime survey data from the state of West Virginia in the United States showing that, controlling for structural conditions, community atmosphere is significantly related to crime, violence and many other social problems in rural places. These results help identify measurable and achievable progressive desired ends in rural policing, replacing law enforcement outputs (for example, arrests, gun and drug seizures) with safe, strong community outcomes as the summum bonum (i.e, ultimate outcome) of policing. Findings show that interdependent communities where police are partners with residents are the safest, while conflict communities where the police are viewed as adversaries are least safe. These results suggest a left realist consequentialist approach to police ethics to dismantle the hegemony of draconian policies and practices.
