Importance. The relevance of the chosen research topic is due to the scientific study of the effectiveness of the ongoing penitentiary policy at the beginning of the 20th century in Tsarist Russia and Russia during the Civil War. Materials and methods. The historical and systemic approach made it possible to consider the penitentiary policy of the “two Russias” at the beginning of the 20th century and to trace the effectiveness in the fight against escapes from detention facility. The statistical method showed the number of escapes from detention facility in Tsarist Russia and in forced labor camps during the Civil War. The use of the comparative historical method showed the level of organization of places of detention of different historical eras. Results and Discussion. The statistics and scale of escapes from detention facility in the Tambov governorate at the beginning of the 20th century are studied. The level of organization of detention facility is studied, taking into account the factor of revolutionary events, the Civil War and the peasant uprising in the Tambov governorate. A comparative analysis of the number of prisoner escapes from detention facility in Tsarist Russia and detention facility in Soviet Russia is carried out on the example of the Tambov governorate. Conclusion. The practical significance of the study is expressed in the local history study of the penitentiary systems of two eras in Russia with the aim of further compiling a generalized work on a given topic.

The impact of incarceration on the migrants in the federal immigration facility in El Centro, California, which operated from 1945 to 2014, is obscured by limited-access government records that emphasize the efficiency of the non-punitive immigration holding center. Direct observation revealed a restrictive environment, an authoritarian regime, and dehumanizing protocols. These discrepancies led to a search for information on the emotional impact of the facility on migrants incarcerated there. This required the collection of data from alternative sources, including interviews, private collections, photographs, activists’ correspondence, journalists’ investigations, and Mexican officials’ inquiries—an emotive archive.

The urban detention center is an abhorrent facility, but it is also a necessary facility for running the country. In order to achieve the speed and efficiency of judicial procedures, it is desirable that the facility be located together with the administrative town or legal town within the city. The purpose of this study is to determine the characteristics of the court-connected landscape among the landscape characteristics of the urban detention center that is essential in the city. Through this study, the urban complex detention center, which is an essential facility in the city, will be able to derive the landscape characteristics that are essential for performing its functions smoothly and efficiently while minimizing the sense of incongruity in the surrounding urban context, and will be smoothly reflected in future architectural plans. The urban detention center is a hated facility in the city, but it is a facility that is essential for the speed and efficiency of judicial procedures and requires appropriate access and control at the same time. In order to perform its function smoothly while minimizing the sense of incongruity with the surrounding context in an urban legal town, special solutions and architectural methodologies are needed in the landscape sector.

The law of mental health authorizes involuntary detention in a psychiatric facility, in the absence of wrongdoing, of competent persons suffering from mental disorder likely to result in harm. Some jurisdictions are said to justify detention exclusively on the basis of danger prevention alone, thus predicating any ensuing treatment on the detainee’s categorical dignitary right to refuse treatment even while detained. Other jurisdictions are said to justify detention also on the basis of the detainee’s need of treatment, thus rendering the authorization to detain as a concomitant authorization to apply compulsory treatment. This article argues that ‘dangerousness’ is conceptually insufficient to justify detention in a psychiatric facility. If danger prevention per se were the only purpose of detention, then a psychiatric facility could perhaps be viewed as a permissible, but certainly not as the necessary, locus of authorized detention. Two propositions follow from this observation. The first is that need of treatment, in addition to danger prevention, must be a criterion of mental health law detention. The article formulates this proposition through a detailed reading of the detention provision in the Ontario (widely regarded as a ‘dangerousness’ jurisdiction) Mental Health Act and relevant case law. The second proposition is that, as much as the right to refuse treatment, regular and ongoing access to treatment is, therefore, a necessary condition of the justifiability, if any, of mental health law detention. The article develops this proposition through analysis of recent Ontario case law on the constitutionality of mental health law detention. The upshot is that failure to offer treatment is as inconsistent with constitutionally recognized liberty interests as the imposition of treatment in the absence of consent. By way of conclusion, the article focuses on what might be called the turn to criminal law to elaborate and affirm, by analogy, the rights of mental health law detainees. The article suggests that, while helpful, the turn to criminal law, because it brings into relief the dimension of danger to others, may also obscure the specific conceptual core of mental health law addressing danger to self.

Juvenile delinquency is related to several biological factors, yet very few vulnerability biomarkers have been identified. Previous data suggest that the enzyme monoamine oxidase B (MAO-B) influences several personality traits linked to the propensity to engage in delinquent behavior. Building on this evidence, we assessed whether conduct disorder (CD), juvenile delinquency adjudications, or detention in a correctional facility were associated with either platelet MAO-B activity or the MAOB rs1799836 polymorphism. The study enrolled 289 medication-free male youths, including 182 individuals detained in a correctional facility (with or without a diagnosis of CD). Of the remaining 107 participants, 26 subjects had a diagnosis of CD, and 81 were mentally healthy controls. Platelet MAO-B activity was determined by spectrophotofluorometry, while MAOB rs1799836 was genotyped using qPCR. Platelet MAO-B activity, corrected for age and smoking, was significantly higher in juvenile detainees (p < 0.001), irrespective of CD diagnosis. MAOB rs1799836 was not associated with platelet MAO-B activity or with detention in a correctional facility, CD diagnosis, or delinquent behavior. These data suggest that detention in a juvenile correctional facility increases platelet MAO-B activity in male adolescents. Future studies are needed to determine the mechanisms and functional significance of MAO-B peripheral elevation in juvenile male detainees.

Nursing response to medical emergencies has been an ongoing issue in immigration detention centers. Lack of teamwork and poor communication with medical and security staff have resulted in detainees sustaining injuries during medical emergencies. This project was developed to persuade Immigration and Customs Enforcement Health Service Corps (IHSC) leaders to consider piloting the TeamSTEPPS emergency response curriculum for nurses working in the immigration detention center. Tuckman and Jensen's model of group development will provide guidance to IHSC leaders in understanding the transformational stages of forming a successful team. TeamSTEPPS will address gaps in emergency health care competency by improving collaboration, communication, and detainee outcomes. Evaluation questionnaires will be offered after each training module and several months after the conclusion of the program. Questionnaires will be distributed, analyzed, and interpreted by IHSC leadership or their designee. Implementation of the Team STEPPS curriculum may result in increased staff morale, decreased staff turnover, and improved detainee outcomes.

Over the last 30 years, the juvenile justice system and juvenile correctional ideology shifted to become more punitive in nature. However, studies examining this shift are lacking in the literature. The present study will attempt to assess what correctional ideology, rehabilitative or punitive, is dominant within juvenile corrections by conducting a national survey to juvenile facility directors. This study will be based on prior literature, most of which has focused upon line staff in an adult correctional setting. From this prior literature, more specifically from the work of Cullen et al. (1989), scales will be created to determine the correctional orientation of the key administrators in juvenile facilities. This will allow us to assess whether the correctional ideology driving the juvenile system has in fact become punitive. The findings from this study have the opportunity to alter the current status quo in juvenile corrections.

Continuing development of the Virginia Tech campus is increasing downstream flooding and water quality problems. To address these problems, the University has proposed the construction of a stormwater management facility to control the quantity and quality of stormwater releases to Strouble Creek, a tributary of the New River. The overall goal of this project is to design a stormwater management facility proposed for the Virginia-Maryland College of Veterinary Medicine at Virginia Tech in Blacksburg, Virginia that will reduce present and anticipated downstream flooding and water quality problems. Specific objectives of the project are: * control of flooding in lower areas by reducing the peak discharge while disturbing existing wetlands as little as possible, * address removal of major NPS pollutants such as total phosphorus (TP), total nitrogen (TN), metals, organic compounds related to petroleum and gasoline, and suspended sediment (SS) from stormwater runoff, and * design of a dam system that is able to withstand all driving forces and constructed in accordance with governing regulations. The design requirement to limit wetland disturbance below one acre was maintained. The requirement set by officials of Virginia Tech is based on the Nationwide Permit 26 of the Wetland Regulations. An individual permit process is thus avoided. Considering this demand, however, the freedom of the stormwater management facility design was significantly restricted. Resulting from the previous restrictions mentioned, the facility will include two ponds in series - a lower, dry pond and an upper, wet pond. The stormwater management system is designed to reduce the peak discharge. The dry pond is designed to detain water only for a short period of time, as opposed to the wet pond which is designed to retain water, thereby maintaining a permanent pool of water, and to change the characteristics of runoff. The wet pond was chosen to be of an Extended Detention wetland type. Aspects such as the availability of suitable area and detention volume governed the decision to make use of this type of stormwater wetland. The constraint on a maximum possible water surface elevation due to the Veterinary School1s road embankment, which crest elevation is at 2023 ft, was considered in the design. The stormwater management facility was designed to meet water quantity control requirements and to address water quality benefits. Storm water management regulations intending to mitigate the adverse effects of land development to streams and waterways were met. Requirements to limit peak discharges from 2-year and 10-year events to existing discharge levels were achieved. Several outlet structures for each of the ponds were investigated. The structures proposed are a perforated riser/broad-crested weir for the wet pond and a proportional weir for the dry pond. They were chosen as a result of analyses on hydraulic performance, maximum water surface elevations, drawdown times, peak discharge rates, and pollutant removal capabilities. The average pollutant removal capability of 75% of TSS, 45% TP, and 25% TN for an extended stormwater wetland, as found in the literature, is expected to be lower for the proposed facility, since the wetland-to-watershed-area ratio is considerably smaller (0.22%) than the required minimum ratio of 1%. However, other suggested desirable parameter for extended detention wetland systems such as required treatment volume, effective flow path length, and dry weather water balance will be maintained. The structural design of the dams was based on experience and research data. The dams are designed to consist of two zones, shell and core. The core extends as a cutoff trench 4 feet below the ground surface. Additionally, toe drain trenches and anti-seep collars along the pipe where penetrating the dam will be placed to collect and reduce seepage, respectively. Special considerations toward seepage problems were taken into account for both dams by placing a cutoff trench and a toe drain trench. Note: The appendix of this project report contains four AutoCAD files, that can only be viewed using AutoCAD.

This study utilizes a national survey to measure the job satisfaction of juvenile facility directors. The prior literature has focused on the experiences of line personnel within the adult correctional system, and this research serves to provide new information regarding this specific population. The current study will address the predictors and correlates of a director's job satisfaction. It is hypothesized that specific characteristics within the organization will predict job satisfaction. Issues regarding staff within an institution and their effect on a director's job satisfaction are the focus. Results indicate that staff issues significantly contribute to the job satisfaction of a director. Specifically, this research can be used to understand facility director retention, staff and juvenile related issues, and the effect of job satisfaction on criminal justice policy issues.

This national study, focusing on job satisfaction within juvenile facility directors, was conducted by the means of a survey. The study is longitudinal in nature; the survey was conducted in 1995 and 2000. Other past studies have focused on line level employees, guards, and the juveniles, but few have concentrated on juvenile facility directors. Literature on directors is currently lacking, this continuous study will give a better ongoing perspective of their attitudes and beliefs. Findings from this particular study will help to address current concerns inside of the system, starting at the apex. The survey's goal is to correlate factors that have a direct impact on their job satisfaction. Results indicate that staff issues have a dramatic impact on a director's job satisfaction.

Abstract The book’s Postscript explores the legacies of Reagan-era immigration detention policymaking by detailing how the subsequent Clinton, Bush Jr., Obama, and Trump administrations embraced policies of “crimmigration” to expand immigration detention and surveillance practices, militarized border enforcement, and prison privatization. It recounts events surrounding an uprising at a private contract immigration detention facility in Elizabeth, New Jersey in the 1990s that led to a class-action lawsuit seeking redress, and community-led efforts over subsequent decades to challenge abusive detention conditions and practices by supporting and visiting people inside. It reflects upon personal and collective storytelling as effective modes of resistance to detention and introduces the concept of “abolitionist imaginaries” as a collective vision of a world without immigration detention, police, prisons, and/or borders.

This chapter illustrates the predominance of narratives about individual self-improvement in prisons, through an ethnography of a meditation class in an incarceration facility. It describes how the researcher becomes participant-observer in this class, shadowing the chaplain who conducts the class, practicing along with the students, and immersing themselves in the prison environment. This ethnographic immersion reveals the power of the prison’s messaging, when replicated by volunteers: that incarcerated individuals must take ownership of their situation, their choices, their attitudes, retooling their reality and reframing it as more “workable” since it is a product of their own choices. It shows the resonance that this idea has for incarcerated persons, many of whom seem to endorse it despite their strong systemic critiques.

Chapter 3 examines how central Louisiana became the unlikely site for the Immigration and Naturalization Service’s first new long-term detention facility and hub for deportation. Faced with high unemployment following the collapse of the local lumber industry, the enterprising mayor of Oakdale spearheaded a campaign to secure the new federal facility. Simultaneously, the Department of Justice debated which agency was best suited to carry out the new mandate of long-term detention of noncitizens. The INS did not have the carceral experience of the Bureau of Prisons, but because migrant detention was not a criminal justice punishment, this imprisonment threatened to create legal liabilities for the government. These legal questions also informed jurisdictional conflict over where this new facility would be sited. Oakdale’s efforts were jeopardized as Associate Attorney General Rudolph Giuliani backed the proposal of the Bureau of Prisons to run migrant detention near one of its prisons in Oklahoma. The forceful backing of Louisiana politicians eventually won the facility for Oakdale.

In the implementation of children’s rights standards into the practice of child-centred care in detention there were two key elements. First, the existing Children Detention Schools had to be merged to create a single, specialist service and second, a modern new facility, consistent with children’s rights, had to be designed and built to cater. The overarching objective was to develop a single, national facility providing child-centre care for all children on detention and remand orders in line with their rights to provision, protection, participation, preparation and partnership. A series of inter-connected measures were required to effect such change, including the completion of the new building in line with children’s rights standards; the creation of a new model of care for child detention (the ‘CEHOP’ model) and the development of a supportive environment for staff, through clarity of purpose and direction. This chapter documents the complex and significant process of change and development in creating a unified and specialist model of child detention, using the annual reports of the national inspection process to track the progress achieved. It seeks to reflect the scale and complexity of reforming child detention in line with children’s rights standards.

This chapter examines the experiences of incarcerated girls who participated in a service learning course that paired them with college mentors in a juvenile detention facility. The course defined the girls as agents in social contexts of inequality, rather than as poor girls of color, and honored their voices as they discussed the issues that were most important to their lives in the community. It also provided the opportunity to examine the girls’ experiences of detention in light of their life stories, and to understand girls’ involvement with the justice system and incarceration as a form of abandonment by society, institutions, and families. This chapter highlights the paucity of treatment programs specifically designed for incarcerated girls and describes how practitioners can create moments of healing in a system designed to punish and dehumanize.

Ireland has undergone significant reform of child detention, adopting a child-centred and rights-based model of detention which is increasingly in line with international children’s rights standards. Reform of law and policy and its implementation, including through the development of the national child detention facility - Oberstown Children Detention Campus – has supported the introduction of a rights based approach to children in detention. Drawing from this experience of applying rights based approaches in practice, this book presents a model to advance the rights of children in detention based on a child-centred model, informed by children’s rights to Provision, Protection, Participation, Preparation and Partnership. The challenges of implementing this model in practice are explained. This chapter sets the context, establishes the aims of the book, details the methodology employed, and outlines the structure of the book.

Abstract Chapter 6 ends Part I of the book and reveals the little-known episode of how a Trump-appointed director of the Office of Refugee Resettlement changed its mission and operations by insisting that all decisions about the release of children from detention be made personally by him. The chapter details how an unlikely lawyer, known only for his anti-abortion crusade and shallow legal acumen, subverted standards for child welfare. The chapter is based on a lawsuit brought by the New York Civil Liberties Union to end practices that kept young boys in detention in a therapeutic facility in New York State for extraordinarily lengthy periods without any justification. Through an examination of numerous mental health records compiled on the boys, this chapter shows the impact on their preexisting mental health conditions and the behavioral changes created by detention. Several cases are highlighted demonstrating the negative impact of “therapeutic detention.”
