Vocational programs have become an important part of the educational curriculum for students with moderate to severe handicapping conditions. Community-based instruction beginning at the elementary level and emphasis upon placement during the latter school years have created a need for school staff to better understand labor rules and regulations. This article reviews the rules and regulations of the U.S. Fair Labor Standards Act in relation to school-based vocational programs and emphasizes the payment of wages across different training and placement options.

On May 9, 2023, the U.S. Department of Commerce proposed amendments to the U.S. antidumping and countervailing/anti-subsidy (ADCV) duty regulations fundamentally altering the scope of economic activities captured within the scope of trade remedy laws. The proposed regulations expand ADCD actions to include a wide range of labor, human rights, environmental and intellectual property standards. Commerce’s new regulations make the failure to rigorously enforce national public policy standards directly and indirectly remediable by trade remedy laws by treating unenforced regulations as a subsidy. Antidumping regulations are similarly modified to increase production costs where public policy regulations are deemed weak or ineffective, thereby increasing antidumping duties. Commerce also proposes to eliminate the longtime transnational subsidies regulation which held that a subsidy did not exist if the program or project was funded by a government outside of the country where the recipient was located. A transnational subsidy is financial assistance or support provided by one country to producer in another country. We show how size-contingent laws can be used to identify the equilibrium and welfare effects of labor regulation. Our framework incorporates such regulations into the Lucas (1978) model and applies it to France where many labor laws start to bind on firms with 50 or more employees. Using population data on firms between 1995 and 2007, we structurally estimate the key parameters of our model to construct counterfactual size, productivity, and welfare distributions. We find that the cost of these regulations is equivalent to that of a 2.3 percent variable tax on labor. In our baseline case with French levels of partial real wage inflexibility, welfare costs of the regulations are 3.4 percent of GDP ( falling to 1.3 percent if real wages were perfectly flexible downward). The main losers from the regulation are workers—and to a lesser extent, large firms—and the main winners are small firms. (JEL L11, L51, J8)

AbstractWhat happens to a country's system of labor laws when its government embraces market-oriented reforms? In a twist on the prediction that labor regulations will be repealed, researchers find that laws remain in place but are not faithfully enforced, a phenomenon known as de facto flexibility. This article examines the case of Brazil to understand its near-opposite; namely, resilience and renewal in the enforcement of labor regulations. It finds that labor unions have combined the corporatist authority they gained under state control with the autonomy they acquired under democratization to devise new modes of action and to safeguard existing regulations. Meanwhile, labor inspectors and prosecutors rely on existing laws to combat precarious work conditions and promote formal employment relations, which strengthen the unions. This mutually supportive arrangement is neither perfect nor free of tension, but it shows how workers can be protected even when employers are subjected to global competition.

This research investigates the effects of the enactment of the Job Creation Law (Law Number 11 of 2020) in Indonesia on labor regulations, specifically focusing on wage regulation for outsourced workers and its implications for human rights. Employing a normative juridical approach, the study examines legal materials such as laws, regulations, court decisions, and expert opinions. Through qualitative analysis techniques, the pre- and post-Job Creation Law regulations concerning outsourced workers' wages are explored. The findings uncover significant changes in wage provisions, including the elimination of sectoral minimum wage regulations and the reduction in types of wages for outsourced workers. Moreover, the research reveals discrepancies between the Job Creation Law and international conventions' indicators of freedom, availability, accessibility, and suitability. Concerns are raised regarding the adequacy of workers' rights protection, accessibility to fair wages, and the inclusivity of vulnerable groups within the legal framework. This study contributes to understanding the Job Creation Law's implications for labor and human rights in Indonesia, highlighting areas where the law may fail to ensure equitable treatment and fair compensation for outsourced workers. Policy recommendations aimed at upholding human rights standards in labor regulations are proposed based on the study's findings.

The study examines the regulations and laws governing blockchain in the system of labor relations. Labor relations have always been governed and controlled, due to the significant opportunism of the participants and continuous modification. The accumulation of changes should lead to the adaptation of the labor relations regulations. In this regard, the purpose of the work is to investigate the impact of the use of blockchain in the system of labor relations from the point of view of labor law to highlight opportunities and threats, to propose options for normative regulation of the use of distributed ledgers in the world of work. As a result of the study, gaps in labor law have been highlighted that do not allow using the full potential of blockchain. It is proposed to supplement the Labor Code of the Russian Federation with a section that regulates the use of digital technologies in the regulation of labor relations. The key conclusion of the study is that the positive impact of blockchain on labor relations is minimized due to the lack of a legal foundation in this area.

AbstractIn the competition between American states for economic development, about half of American states offer lower levels of labor rights in the form of “right-to-work” (RTW) laws. RTW states often tout their advantages in competing for foreign investment, but do foreign companies really want weaker labor regulation? Many foreign firms locate production in the United States not to lower labor costs but for other reasons, such as proximity to consumers or to employ highly skilled workers, implying that differences across labor regulations within rich countries may be declining in importance. In this article, we investigate the relationship between RTW laws and greenfield foreign direct investments. In particular, we explore recent RTW changes across two states, Indiana and Michigan, controlling for national trends in foreign investment. Adopting RTW increases foreign investment in manufacturing in both states, but Michigan's RTW law is associated with gains in service-sector projects even while Indiana's is not. While RTW may attract more manufacturing, it is not enough to generate broad-based gains across the economy.

This dissertation analyzes the factors that lead to the transformation of labor regulations and institutions after the opening of previously closed economies, using the case of Argentina as a "crucial case". In the 1990s, almost every government in the Latin American region attempted to reform its labor code and systems of labor relations. However, despite these attempts at reform, the labor codes and their systems of labor relations appeared resilient to change. The bulk of the literature on the political economy of reforms had concluded that labor unions had managed to stall or derailed these attempts, although unions had been unsuccessful at stopping all other market-oriented reforms. I conceptualized the labor codes and the system of labor relations considering the way they work in practice, including informal arrangements, and I use the notion of "labor regimes". This conceptualization differs from the dominant approach on this issue, which focuses almost exclusively on changes in labor codes approved by Congress. Using this approach, I argue that a system of rigid labor laws and centralized bargaining institutions in a more competitive, pro-business environment tends to get relaxed and more decentralized.
(cont.) However, changes do not necessarily occur through modifications in the overall national legal framework. Changes occur through: 1) layers of regulations that overlap with the old system, and 2) new practices of the main stakeholders on the ground that may create new institutional arrangements. In order to understand the direction and scope of these changes, focusing exclusively on the interests of central unions, business associations and the state at federal level will only render a partial explanation at best. Instead, a more societal and micro political approach is required. I argue that how the balance of power between business and labor at the local level plays out, the extent to which the interests of unions and business align at the local level as opposed to the legislative arena, and the characteristics of the previous institutions of industrial relations play a larger role in explaining why and how changes occur.

The Internal Labor Regulations is a rule law that could be created by the employer. In that sense, its position in the system of sources is residual because it can not contravene the government rules nor the collective agreement content. However, case law has considered it many times to assess the validity of a dismissal or the existence of an employment relationship. This article seeks to review these issues and to assess the validity of the rule that regulates it (Supreme Decree 39-91-TR).

En ese sentido, su posición en el sistema de fuentes es residual dado que no puede contravenir el contenido de las normas heterónomas, ni tampoco al convenio colectivo. A central concern of this thesis is the expansion, distribution and control of 'non-standard' employment in Namibia since independence. The employment relationship has assumed various historical forms under capitalism, each of which corresponds to a specific mode of regulation with distinct structural dynamics. An attempt is made to extend the regulation approach 'downwards' to account for the problem of order in the workplace and to place the employment relationship within its own regulatory framework. The point of departure in this study of the dynamics of labour regulation is the contradictory nature of labour's incorporation, allocation, control and reproduction within the labour market. The employment relationship is never only an economic exchange, but is also mediated through an institutional framework that connects the processes of production and social reproduction, and regulates conflicting interests inside and outside the workplace. This relationship, as critical realists have pointed out, is a product of the indeterminate intersection of several generative structures. The roots of these generative structures can be traced to three sets of social processes: the processes of production and the structuring of labour demand; the processes of social reproduction and the structuring of labour supply; and the forces of regulation. Non-standard employment is viewed as a particular social and spatio-temporal 'fix' for the various regulatory dilemmas generated by the standard employment relationship. This conception underscores the fact that a national system of labour regulation decisively shapes the conditions under which employers are able to casualise a part of their workforce. The differential experience across national boundaries suggests that analytical space needs to be provided for systems of labour market regulation which may either accentuate or moderate pressures for casualisation. Segmentation on the demand side of the labour market is explored through an analysis of the types of non-standard jobs created in different economic sectors. The various forms of employment 'flexibility' tend to vary in importance according to the specific manner in which a firm chooses to compete. Consequently, non-standard employees are distributed in a complex and uneven manner across industrial sectors and the occupational hierarchy, and face a diverse range of possibilities and liabilities that shape their levels and forms of participation in the labour market. By counteracting the homogenisation effects of labour law and collective bargaining, the mobilisation of cheap and disposable labour through non-standard employment contracts allows employers much greater discretion in constructing the wage-effort bargain. With non-standard employment, social and statutory regulation is weak or underdeveloped and hence managerial control is autocratic, with a significant contractual component. Although the changing social composition of the workforce associated with employment 'flexibility' poses serious challenges to the modes of organisation that have long served the labour movement, trade unions in Namibia and elsewhere have been slow to respond to the threats of casualisation. Of concern here, is the extent to which attempts to promote the security of existing union members is compatible with attempts to organise non-standard employees. This thesis shows that the unions have developed a complex amalgam of strategies in their efforts to regulate non-standard employment relationships.

The Public Service is service delivery driven, and is dependent on the quality, skill and performance of the employees to carry through its business. It is therefore imperative that the policies and systems pertaining to human capital are effectively and efficiently managed. The Basic Conditions of Employment Act regulates the basic conditions of employment and states that employees’ may be absent from duty due to illness. The public sector uses the Determination on the Leave of Absence in the Public Service as a tool to regulate leave in the public sector. The Determination provides employees with 36 paid sick days to be utilised by an employee within a three-year cycle. In cases where an employee has exhausted the sick leave, the employer may grant Temporary Incapacity Leave, which is discretional. The Public Service Commission has a constitutional obligation to monitor the performance of the public sector and produce reports covering the human resources management practices. With regards to the management of leave in the public sector, the reports reveal the abuse of sick leave by employees, non-compliance and the in-effective management. The Department of Public Service and Administration then developed the PILIR as a guide to manage and administer sick and incapacity leave in the public sector. This treatise therefore, discusses the regulation of sick and incapacity leave in the public sector and investigates the extent to which the applicable legislative framework is effective. The discussion uses the Labour Court judgment in the matter between The Public Service Association & Others versus the PSCBC & Others as reference, and further evaluates the judicial jurisprudence to demonstrate the extent of contentions of the private sector employers by the employees. Furthermore, this treatise seeks to evaluate the extent of similarities or differences of the practices both the private sector and the municipalities. In conclusion, the treatise makes recommendations on the best practices that can be adopted by the public sector to turn the situation around.

Considering that there is no law in the Republic of Serbia that stipulates the rules on the establishment of employment through specialized agencies, the subject of the research will be directed to agency employment. The Ministry of Labor came up with a draft law on agency employment, whose adoption is expected this year. Based on the draft, it can be concluded that this form of employment is a novelty in labor law, which has "lived" in practice without legal regulation so far. So for the first time we have one law, which stipulates that all the employees who work through the agency (on "leasing") will have a labor contract and the same working conditions in the future as well as employees with the employer. By studying this topic, the rules will be analyzed, envisaging the future Law on Agency Employment, the rules contained in the Labor Law and other applicable regulations. At the same time, an analysis of the comparative law, establishment and operation of employment agencies, their importance, as well as proposals for further regulation of the issue of leasing of labor or transfer of employees will be carried out.

This paper analyzes recent changes in teacher assessment policies in higher education institutions in Mexico. Procedures for faculty assessment in a typical Mexican state University are analyzed with the purpose of generating insights helpful to construct a fair, pertinent and expedite assessment system. We review guidelines to assess teachers, specifically those with the purpose of keeping or firing the teacher even after tenure is achieved. These new regulations are seen as a key policy to improve quality in higher education. However, implications to faculty moral, organization climate and conflict with existing labor laws have not been fully considered. It is argued that excessive federal and local regulations are, in fact, unable to ponder the complexities of academic life. We conclude that instead of more regulations and complicated normative, focus on qualitative peer assessment should be considered as means of effective faculty assessment.

The paper analyzes the situation in the craft and craft ́s legal regulations, in the period from the beginning of the XIX century to the 30s of the XX century, i.e. until the adoption of the Yugoslav Law on Actions. At the beginning of the 19th century, the patriarchal spirit ruled in the craft; a quasi-family relationship was established between the masters and the students. Craftsmen provided themselves protection from competition through associations in guilds and its tradition rules. In the middle of the 19th century, the Decree on Guilds was passed, which regulated labor relations in crafts and trade. At the end of the 19th century, due to the increased import of goods, the situation in the craft has changed, patriarchal relations were disturbed, and there was general dissatisfaction among the workers. Therefore, a huge action was taken for the modern regulation of labor relations, which came in 1910, with the adoption of the Law on Actions. But, despite the modern legal regulation of labor relations, the factual situation in the craft has not changed. Therefore, the paper will point out the basic reasons for the decline of the craft, as well as the normative attempts to save it.

Labor law plays a crucial role in regulating labor relations in sugarcane mills, a sector of great economic importance in Brazil. In the current context, there is a growing concern about promoting sustainable development in this segment, considering the socio-environmental impacts of sugarcane production. This study aims to analyze the interaction between labor law, sugarcane mills and sustainable development. It only represents a starting point for further investigation. The aim is to investigate how labor laws can contribute to improving working conditions in plants, while promoting sustainable production practices. The research was conducted through bibliographic review and document analysis. Scientific articles, labor legislation and studies on sustainable development in the context of sugar cane mills were reviewed. In addition, reports from companies in the sector and government data related to working conditions and environmental impacts were analyzed. The results revealed that labor legislation plays a fundamental role in protecting the rights of workers in sugarcane mills, addressing issues such as working hours, safety and occupational health. However, there are still challenges to be faced, such as informality and precarious work in some regions. The discussion points to the need for public policies and business practices aimed at promoting sustainable development in the sugar and alcohol sector. This includes investments in clean technologies, responsible environmental management and corporate social responsibility programs. It is concluded that labor law plays an important role in promoting sustainable development in sugarcane mills, by guaranteeing decent working conditions and promoting social justice. However, a joint effort by governments, companies and civil society is needed to face socio-environmental challenges and guarantee a sustainable future for the sector.

The subject of the paper is human resource management during the pandemic. The authors highlighted two issues: the influence of human resource management on business results in tourism and the impact of COVID-19 on labor law, psychological and interpersonal relationships in organizations dealing with tourism. The scientific goal is to confirm the hypothetical assumption that the COVID-19 pandemic limited and modified activities related to human resources management in tourism in emergency conditions. The paper uses the general scientific statistical and comparative method and method of document content analysis. The end effect of the work is two results: one, that COVID-19 affects the quality and quantity of human resource management in tourism, and the other, that the COVID-19 pandemic significantly reduces the satisfaction of basic tourism needs and requires the involvement of more institutions to preserve the satisfaction and safety of tourism employees and users of tourist services. The ultimate purpose of the paper is to harmonize the Labor Law regulations in the conditions of mass pandemics.

Temporary agency work is an atypical form of employment that is becoming more frequently used as an alternative to standard labour relationship. It is a complex, ‘triangular’ legal relationship, which involves temporary-work agency, employee employed by the agency and a user firm, to which the agency assigns the employee. This is not a new legal institute, but it has become popular and somewhat legally regulated in the territory of the former SFRY in the last ten years. The Republic of Serbia does not have regulations that would regulate this specific issue, although these agencies exist in practice and in large numbers operate in the labor market of Serbia. However, Serbia has taken a step on the road to that. Namely, the Ministry of Labor has published the Draft Law on Agency Employment with the aim of providing legitimate employment and guaranteeing a working position of the transferred workers who are guaranteed to the employees with the employer. By introducing the legal framework for work through the temporary employment agency, the labor legislation of the Republic of Serbia is harmonized with the international standards of the ILO and the EU. By clearly defining the temporary employment agencies and specifying the conditions for their work, the rights and obligations of persons who conclude an employment contract with the temporary employment agency for the purpose of assigning temporary employment to the employer, and other mutual rights and obligations of the employees, agencies and employers of the users, This area and maximally protect the so-called. agency employees. Namely, agency employees will receive equal wages and other basic working conditions, safety and health at work and other working conditions applicable to employees directly employed by the employer-user (according to which the order and instructions of the agency employee work).

Nuclear accident and nuclear terrorism are of great threats to international security. The countermeasures against nuclear emergency situation should be deliberately considered before it happened. In accordance with experience from Fukushima Daiichi Accident, various kinds of complex situations must be considered at the phase of emergency preparedness. And all related schedules, including national laws and regulations, allocation of responsibility and authority, emergency plans and procedures, facilities, instruments, trainings and exercises must be examined. The appropriateness of the emergency preparedness and the emergency response capability need to be verified through emergency exercises. However, exercises are usually costly and labor-intensive. So, it is necessary to design a software system to help conduct emergency exercises simulation. A Nuclear Emergency Decision Deduction and Training Platform (NEDDTP) is designed in China Nuclear Security Center of Excellence, which aims at performing the simulation of nuclear emergency process and providing a training platform for emergency workers. 3D models, the environment of nuclear power plant (NPP), some physical numerical models for simulating and several typical nuclear emergency scenarios for training are included in the platform. NEDDTP realizes the function of digitization of scenario, emergency simulation, resource management, command and dispatch, process record and evaluation in exercise, and it also provide VR display for emergency workers.

Nevertheless, labor market regulations, institutions and labor supply can be improved upon, especially laws and regulations that are no longer appropriate for 21st century circumstances.

This document cannot assess whether the negotiation or implementation of labor chapters in free trade agreements were the cause for any changes made within a country; the document can only report the changes made with regard to the labor framework of a country during the process of negotiations and the subsequent periods during which the agreements have been in place.

This paper analyzes whether Free Trade Agreements (FTAs) signed between the United States and Latin American countries during the last decade produced higher enforcement of labor regulations. The paper computes before-after estimates of the effect of FTAs on labor inspections and exploits variation across countries using non-signers as a comparison group. The empirical strategy benefits from the fact that about half of Latin American countries have signed a trade agreement with the United States. Difference-in-differences estimates suggest that signing an FTA produced a 20 percent increase in the number of labor inspectors and a 60 percent increase in the number of inspections. The North American Free Trade Agreement (NAFTA), however, does not appear to have the same positive impacts on Mexico. The paper concludes with a discussion of these results.
