El debate en torno a la impartición o administración de justicia en Colombia ha tomado diversos rumbos y ha sido abordado desde diversas posturas. Por una parte, entender que la ponderación o valoración de los derechos debe darse bajo el entendido de la administración para que se dé un orden ubicaría al juez como un administrador de justicia; por otra parte, entender al juez como intérprete de la norma más allá de su tenor literal y así aplicarla en un sentido más amplio pero racional dentro de la discrecionalidad lo ubicaría como impartidor de justicia. Así las cosas, este escrito retoma el debate clásico sobre el rol del juez impartidor o administrador de justicia, abordando el problema de la interpretación del derecho y su incidencia en la aplicación y materialización de la justicia más allá del frio papel a lo largo de la historia y en el marco de un Estado Social de Derecho para la resolución de problemas jurídicos.

English Abstract: In 2005, Colombia enacted the Justice and Peace Law, which was a transitional framework for addressing the legal status of demobilised members of the paramilitary group Autodefensas Unidas de Colombia [United Self-Defence of Colombia] and other armed groups. In exchange for providing intelligence on the whereabouts of the bodies of people these groups had kidnapped and killed, prison sentences could be reduced. Forensic experts from the Attorney General’s Office were in charge of exhuming and identifying the bodies, placing them centre-stage as a source of scientific evidence, testimony and authority based on their presumed objectivity and non-prejudicial approach. However, forensic knowledge, like all knowledge, is situated, partial and performative. Here, I attend to the effects of forensic knowledge on victims’ right to truth, memory practices and the administration of justice under the Justice and Peace Law. I argue that forensic knowledge co-produces conflict by producing victims and perpetrators whose identities and stories can be at odds with other accounts of the violence that occurred.French Abstract: En 2005, la loi sur la justice et la paix a été promulguée en Colombie. Il s’agissait d’un cadre transitoire permettant de régler le statut juridique des membres démobilisés du groupe paramilitaire Autodefensas Unidas de Colombia [Autodéfenses unies de Colombie] et d’autres groupes armés. Cette loi prévoyait la réduction des peines de prison en échange de renseignements sur l’emplacement des corps des personnes que ces groupes avaient enlevées et tuées. Des experts médico-légaux du bureau du procureur étaient chargés d’exhumer et d’identifier les corps. Cela les plaçait au centre de la scène en tant que source de preuves scientifiques, de témoignages et d’autorité, en raison de leur objectivité présumée et de leur approche non préjudiciable. Cependant, la connaissance médico-légale, comme toute connaissance, est située, partielle et performative. Je m’intéresse ici aux effets des connaissances médico-légales sur le droit des victimes à la vérité, les pratiques de mémoire et l’administration de la justice dans le cadre de la loi Justice et Paix en Colombie. Je soutiens que les connaissances médico-légales coproduisent des conflits en produisant des victimes et des auteurs dont les identités et les histoires peuvent être en contradiction avec d’autres récits de la violence qui s’est produite.

The administration of justice in Colombia has always raised concerns about the control of the acts of the authorities to proscribe and limit the abuse of power, as a consequence of structural, functional and organizational problems, despite attempts at profound reforms to the judicial system A certain degree of opinion persists in society that reflects dissatisfaction about the functioning that negatively affects the confidence of the Colombian people. This article is developed with a historical research method, which shows the legislative journey around studying and analyzing the scope of crime that, from legal persons, intervenes to the detriment of the land restitution process in Colombia.

The article analyzes the non-appearance before the International Court of Justice motivated by the turbulent reception by the Colombian Government of the 2012 and 2016 sentences of the I.C.J in the cases between Nicaragua and Colombia, with the objective of establishing the consequences of such conduct. Methodologically, the jurisprudence that has applied Article 53 of the Statute, and the different consequences of nonappearance in cases before the Court are studied. Through an analysis of jurisprudence the document discusses the nature of non-appearance, its effects on the sentence, the agents, the applicable law, the evidence and the procedure, to conclude that, although non-appearance is a behavior allowed to the State Parties, it is in general detrimental to its procedural interests, its defense of the case and the administration of international justice as a system, especially in such technical cases as those related to maritime delimitation and liability in relation to alleged violations of sovereign rights and maritime spaces.

El objetivo de este artículo es establecer la existencia de desigualdad entre empleados públicos y trabajadores oficiales en Colombia frente a los términos para acceder a la admi-nistración de justicia en materia laboral, puesto que existen tiempos diferenciados para acudir a reclamar derechos laborales ante las autoridades judiciales y administrativas: El método de investigación a partir del cual se desarrolló el trabajo es de carácter cualitati-vo, mediante el uso de técnicas como el análisis documental, de normatividad, jurispru-dencia y doctrina, así como de la técnica de estudio de caso, que permite ejemplificar y visualizar eventos puntuales de desequilibrio en el acceso a la administración de justicia. Entre las conclusiones o hallazgos de la investigación encontramos la existencia de la vulneración del derecho a la igualdad en empleados públicos, trabajadores oficiales y tra-bajadores del régimen ordinario, principalmente debido a que en eventos de reclamación laboral se han establecido términos distintos para acudir y buscar la reparación, lo cual se constituye como un obstáculo para acceder a la garantía del acceso a la administración de justicia en Colombia.

Controlling entities ignored the evidence submitted in the year 2008 by the auditing firm PWC in the case Odebrecht, generating a lack of transparency in the bidding process being involved economic monopolies, political influence and the highest authority in the country. It is testimony to poor control and vigilance on the part of the administration motivated by economic corruption causing a lack of political and budget deficit . Through the events of the case of Odebrecht in Colombia, several crimes against the public administration, violation of human rights, money laundering, distrust in the road sector investment, convictions and sequelae such as violence, death of innocent people, poor road infrastructure, budget deficit and globalization of justice.

In the present paper the author continues the study of the challenges faced by Colombia in its struggle to overcome the internal armed conflict, as well as the role of the United States in this process. By 2010 the confrontation between the government forces and the armed rebels had reached a breaking point opening the way to a successful conclusion of the Government of Colombia–FARC peace negotiations and the beginning of the country’s post-conflict reconstruction. The paper thoroughly examines the negotiations process, identifies the key disputed issues and the measures outlined for their resolution, including mechanisms of transitional justice, agrarian reform, programmes for demobilization and reintegration of the former combatants. The results of these talks laid the foundation for the historic Peace Accord of September 26, 2016. However, against all hopes and expectations, the agreement failed to bring an end to the long-standing internal conflict in Colombia. The failure of the national referendum, which was designed to approve the agreement, not only revealed deep divisions in the society, but forced the government to make serious concessions to the opponents of the negotiations with FARC. The author emphasizes the growing erosion of the hard-won consensus in the Colombian society, accompanied by the consolidation of the right-wing conservative camp. In this context the role of external sponsors of the peaceful agreement in general and the United States in particular becomes crucial. The paper presents a comparative analysis of approaches to providing aid to Colombia demonstrated by the administrations of Barack Obama and Donald Trump. The author concludes that despite substantial differences, for both administrations the ultimate objective was national security of the United States. That was clearly demonstrated by the fact that the US foreign aid to Colombia focused primarily on the fight against the illegal production of and trafficking in drugs, while the issues of peacebuilding and post-conflict reconstruction received less attention. Assessing Colombia’s experience in overcoming the internal conflict and the role of the United States in that process, the author concludes that although prioritization of security issues may have a considerable organizing potential, at the same time it may be detrimental to the process of post-conflict reconstruction in general.

Este artículo busca determinar el impacto de los equipos caninos detectores de restos humanos de la Policía Nacional de Colombia durante 10 años, desde que en 2007 se inició un protocolo con binomios (guía-canino). Mediante el estudio de 5 binomios que han desarrollado búsquedas en varias regiones colombianas, se establecen los factores ambientales, el tipo de terreno, el posible grupo criminal implicado y la ubicación geográfica, entre otras muchas variables que participan en los registros realizados tanto en desastres naturales como en casos de desaparición y delitos asociados. Como resultado del análisis de estos escenarios, se hace un aporte a la estrategia para el abordaje de homicidios y desapariciones y el hallazgo de elementos materiales probatorios para la justicia.

Colombian law recognizes that traditional Indigenous and Black authorities can exercise legal jurisdiction and apply their laws and traditions in their ancestral territories. Despite this legal recognition, the legal system does not operate in a way that genuinely guarantees legal pluralism. In practice, higher courts repeatedly overturn or dismiss decisions by indigenous legal authorities. As a result of the 2016 Peace Agreement between the Colombian Government and the former guerilla of the Revolutionary Armed Forces of Colombia – The People’s Army (“FARC-EP” in Spanish), a transitional justice tribunal was established: the Special Jurisdiction for Peace (“SJP” or “the Special Jurisdiction”). The Special Jurisdiction’s main task is to investigate and try the most serious crimes committed during the armed conflict, a conflict that has disproportionately impacted racialized communities. The SJP, unlike other tribunals in Colombia, has sought to adapt its work to meet the reality of legal pluralism by: 1) negotiating protocols for inter-jurisdictional interaction between the SJP and ethnic authorities, 2) consulting with Indigenous and Black communities on the adoption of some legal instruments, and 3) having a dialogue between equals with ethnic authorities when potential jurisdictional conflicts arise. This paper seeks to analyze this interaction and how it has allowed the Special Jurisdiction, as transitional justice mechanism, to work in close cooperation with Indigenous and Black communities in Colombia. As will be discussed throughout this paper, through the lens of the legal pluralism framework, such interaction has strengthened the legitimacy and recognition of Indigenous and Black communities’ legal authorities as parallel legal orders that can operate side-by-side with the State judicial system. This, in turn, has created an important precedent that can be emulated by other court jurisdictions in Colombia and elsewhere.

The article analyzes the theoretical and practical problems that arise during the construction of the Colombian model of transitional justice. The latter is viewed as a combination of judicial and quasi-judicial means, with the help of which it becomes possible to achieve a peaceful settlement after the end of the civil war of 1964–2016. Particular attention is paid to the socio-political context and mass sentiments prevailing in Colombian society regarding the legitimacy of transferring the Anglo-American construction of Transitional Justice to Latin America. The so-called “Integrated System of Truth, Justice, Reparation and Non-Repetition”, which is a consolidated version of the four main elements of transitional justice: criminal prosecution, truth seeking, reparations to the innocent victims and “deal with the past”, is being studied in detail. In particular, the author dwells on the issue of amnesties for participants in an armed conflict, the activities of the “truth commission” and compensation payments to victims of mass violence. In addition, the article examines the activities of the Colombian Special Jurisdiction for Peace, the relevant statistical data are provided. The “Santrich case” is mentioned as a marker of negative trends that continue to grow in the activities of a new jurisdiction. The conclusion is that the legal means of resolving the conflict are secondary, albeit of absolute importance, in comparison with political agreements, to which all participants of the process of national reconciliation sometimes are not ready organizationally and psychologically.

Abstract— Public administration has, for some time now, been undergoing a digital transformation. Part of this change is the replacement of human public officials with automated decision-making systems. Beyond its immediate social and political significance, the EU Settlement Scheme—the mechanism established to allow EU citizens to remain resident in the UK after Brexit—represents the coming of age of a new template for automated administration. Understood in its context, this template raises foundational questions about the nature of administrative justice in the emerging digital state. This template, while it has various potential advantages, is essentially half-baked, contains significant risks without sufficient safeguards and requires revision before its suggested wider future application becomes a reality. Amendments to the template ought to be framed by reference to the precautionary principle, as this would continue to make for efficient implementation of policy while better protecting individuals in this experimental phase of automated administration.

Through the presentation of the history of social justice in global constitutional discourse, this article aims to demonstrate that, although in Colombia there is not a constitutionalized purpose or principle of social justice, as in other countries, the modern notion of distributive justice, also called social justice today, is implicit in the Constitution of 1991 because it enshrined as mandatory rules the three main elements of its meaning at the time of its promulgation: the principle of social rule of law, the principle of human dignity and the right to a material equality. Thus, in Colombia social justice must not be understood in the Aristotelian sense of distributive justice but in accordance with these three elements, and can only be achieved if they are fulfilled.

Constitutional courts in Latin America have used judicial review to enhance the relevance of international law in recent years. Some scholars even speak of a growing “constitutionalization of international law” in the region. But these domestic courts can also act as gatekeepers that blunt or entirely deflect the domestic impact of international law. This essay explores three recent episodes in which constitutional courts joined or led efforts to escape treaty obligations: the Venezuelan Supreme Court's judgment urging the Chávez Administration to denounce the American Convention of Human Rights on constitutional grounds, which Chavez then did in 2012 (a court-inspired treaty exit); the Colombian executive's 2013 petition to have Colombia's acceptance of the International Court of Justice's (ICJ's) jurisdiction under the Pact of Bogotá declared unconstitutional (a court-legitimated treaty exit); and the Dominican Republic (DR) Constitutional Tribunal's 2014 judgment holding that the DR's acceptance of the jurisdiction of the Inter-American Court of Human Rights (IACtHR) had been unconstitutional (a court-led treaty exit).

This article draws on original survey data of 10,951 Colombian ex-paramilitaries to study the determinants of victimizers’ support for transitional justice. Understanding ex-combatants’ attitudes toward victims of the conflict and measures of justice is critical to gaining leverage on when transitional justice is likely to prove effective. The data suggest that former fighters’ views of transitional justice are shaped by the intimacy with which they experience transitional justice: whether they are known to, in close proximity, and accepted by the communities they victimized. Their attitudes are also constrained by the norms of justice in which they have been socialized, and by the extent of the risks to them personally: in judicial terms given their own culpability and in security terms given their vulnerability to retribution. The study has important implications for the prospects of successful transitional justice with the FARC rebels and for the consolidation of peace in Colombia.

In this article armed conflict in Colombia and the post-agreement period, which is still very recent, are evaluated. The armed conflict between the armed forces of the State and the FARC-EP has terminated in Colombia by making The La Havana-Bogota Peace Agreement. By the virtue of this agreement, the post-agreement period in Colombia is started. With this agreement, some other various steps have been taken to increase the political participation of the Colombian people and the democratization in Colombia. The Integrated System, containing the Commission for the Clarification of Truth, Coexistence and Non-Repetition, the Unit for the Search of Missing People Due to and in the Context of the Armed Conflict and the Special Jurisdiction for Peace, was established. Colombia is a current issue for international community in the context of transitional justice period.

How could Colombia deal with the overwhelming cruelty of mass atrocities committed during its ongoing conflict? This article intends to thoroughly explain the strategies implemented in Colombia to deal with the issues of transitional justice in an ongoing conflict and to illustrate the state of the art of the approaches to justice. In order to do so, we will show the limits of the retributive justice approach at both the national and the international level and propose the applicability of the restorative justice approach in dealing with mass victimisation. This debate becomes even more complex due to the shadow of the International Criminal Court (ICC), which has exerted great influence in implementing a dominant retributive oriented approach to the expenses of other ways of doing justice.

Purpose The purpose of this paper is to discuss the concept of Administration of Justice as a research field and set out an agenda for future studies that could promote the production of scientific knowledge in this area. Design/methodology/approach This paper explores the idiosyncratic features, dimensions of analysis upon the Administration of Justice, states a research agenda and discusses the main challenges on this theme. This paper conceptualizes Administration of Justice as a research field and discusses related phenomena from institutional and economic perspectives on innovation, performance, governance and legitimacy. Findings As a research field, Administration of Justice is defined as a set of theoretical concepts, research methods and techniques, aiming to investigate the management processes associated with the use and articulation of resources, knowledge and institutions, at different levels of the justice system, and their influence on the provision of justice in a given social context. As social phenomena, four levels of analysis are proper to investigate the justice system: societal, inter-organizational, organizational and operational. Innovation, performance, governance and legitimacy are central themes of the Administration of Justice and present various gaps and research opportunities. Research limitations/implications The main implications is the proposal of an agenda for future studies on the Administration of Justice field, which is an important step in raising awareness of the issue. Originality/value Administration of Justice encompasses a growing interest among academics, justice practitioners and public managers regarding managerial and political practices carried out in the justice system. Although relevant, this subject has been scarcely studied by the management community. This paper invites community to adopt an organizational and institutional perspective to Administration of Justice, setting an agenda for future research.

This article raises the question of whether recently implemented legislation in Colombia and Brazil (1) provides the necessary tools to prevent the harms of wildlife trafficking (WLT) and (2) influences humans’ practices concerning the use of nonhuman animals. These questions are investigated from the dual perspectives of green criminology and public policy. The analysis is based on a qualitative empirical study undertaken in Colombia and Brazil whereby we discuss the function of the legislation in Colombia and Brazil in preventing illegal WLT. We consider the legitimacy of different practices of WLT and evaluate them with respect to species justice and environmental justice.
