Over the past twenty years, International Labour Standards have been cited increasingly as the authoritative, worldwide body of jurisprudence on workers' rights as human rights. Continuing the debate on what constitutes labor rights, the author contrasts the definition of workers' rights under international human rights standards with U.S. labor history's notion of “pure and simple unionism,” examining the boundaries of rights defined by international standards in a comparative historical context. The standards examined include workers' right to organize; coercive employer speech; access to employer premises; nonmajority representation; the right to strike, picket, and boycott; union security clauses; the scope of bargaining; government enforcement; and the legal doctrine of employer association rights. Aligning U.S. labor relations law with international human rights standards would in part be a social advancement, but significant aspects of the standards advocate pure and simple unionism more than the original National Labor Relations Act, raising questions about how labor movements should use international standards as advocacy tools and public policy goals.

The article presents an overview of the materials of the annual scientific conference «Lomonosov readings-2019», reflecting the reports made at the section «Individual and work in the digital economy», dedicated to the significant date - the 100th anniversary of the International labour organization (ILO). The speakers actively discussed the development of social and labor sphere of modern Russia, its future in the conditions of digitalization and humanization, the problems of formation and development of human potential and transformation of labor relations in the digital economy, as well as prospects and risks in the regional, sectoral and corporate labour markets in connection with digitalization. The discussions identified and justified the need to consolidate efforts to establish an Association of labor economists, to continue the tradition of holding annual international inter-University scientific conferences for the exchange of scientific ideas and consistently project the position of the ILO in science, practice and in the teaching process.

This note reviews and analyzes the impacts of Mexico’s September 2018 ratification of International Labour Organization (ILO) Convention 98 on the right to organize and collective bargaining. Specifically, it focuses on what Mexico’s ratification of the instrument means for the future of the pro-tection contract system in terms of international law. Mexico’s ratification of Convention 98 closes the doctrinal gap on protection contracts which was left by Convention 87, on freedom of association. Although Convention 98 does not cover the armed forces, the police, and public servants employed in state administration, according to international law, its ratification should invalidate much of the Mexican protection contract regime. Convention 98 is not self-enforcing, but ratification of the instrument subjects Mexico to the full scrutiny of the ILO’s supervisory system regarding compliance with norms. Moreover, Mexico’s domestic jurisprudence governing compliance with ratified international human rights treaties bodes well for effective judicial enforcement of the convention. With the ratification of Conventions 87 and 98, international law mandates the implementation of an authentically democratic labor relations system in Mexico. With the additional ratifications of Convention 29 on forced labor, Convention 100 on equal remuneration, Convention 105 on the abolition of forced labor, Convention 111 on discrimination in employment and occupation, Convention 138 on the minimum age for work, and Convention 182 on the worst forms of child labor, Mexico is bound by international law to comply with all globally recognized core labor standards.

The 1980s and 1990s were decades of great creativity in Indian labor history. The study of labor moved from a long-standing institutional focus on trade unions to a study of workers themselves, as well as from the economism and determinism that had characterized many previous writings. A growing interest in labor led to the first conference devoted to Indian labor history at the International Institute of Social History in Amsterdam in 1995 and the founding of the Association of Indian Labour Historians the following year. The dynamism and the new intellectual horizons of Indian labor history in that period are captured in the work of three major historians: Dipesh Chakrabarty, Rajnarayan Chandavarkar, and Chitra Joshi. For the purposes of this essay, there is no need to review their contributions in detail (not least because such overviews may be found elsewhere), but it is nevertheless essential to provide a quick sketch of the arguments of each.

The International Ergonomics Association (IEA) plays a pivotal role in developing ergonomics at a global level. Through the federated societies in 49 countries, IEA brings together knowledge and resources to share and develop ergonomics education, research, and practice internationally. IEA also recognizes the relatively small size of this domain in the global community and is working to develop collaborations with larger and more influential organizations to integrate and expand exposure to ergonomics, such as with the International Organization for Standardization, the International Labor Organization, and the World Health Organization. Collaborations with other professional associations at an international level also assist in developing and integrating connections for mutual recognition of ergonomics research and practice. This article briefly describes some of IEA’s goals and activities.

Incoming foreign direct investments (FDI) may enhance the productivity level of the host country by bringing new advanced technologies. On the other hand, the nexus of FDI and productivity, rather than being linear, might be nonlinear because the effect of increases and decreases in FDI on productivity may not be symmetric. In this sense, this study investigates the asymmetric relationship between FDI and productivity in Turkey by using two different productivity indicators (i.e., PROD1 and PROD2) and employing a Nonlinear ARDL approach. Our hypothesis claims there is an asymmetric association between FDI and productivity in the long run in Turkey. Nonlinear cointegration test findings indicate that selected variables are cointegrated. Hence, they move together in the long run. Our study uses aggregated data at the macro level to analyze the long-term asymmetric relationship between foreign direct investment and labor productivity in Turkey using the NARDL estimation technique. Concerning the estimation results, a long-run nonlinear relationship between incoming FDI and labor productivity was detected, and this finding remained valid across two models constructed by using two distinct labor productivity indicators. As a whole, our results are consistent with the ones found in the literature. Besides, for the first time in the literature, this study addresses the long-run asymmetric nexus between FDI and labor productivity by using macro-level data specific to Turkey and makes various policy recommendations.

AbstractThis keynote address, delivered in December 2015 at the International Federation of Workers’ Education Association General Conference in Lima, Peru, refutes the standard trope of labor movement decline and provides evidence for the global rise and feminization of labor movements worldwide. Trade union women’s commitment to emancipatory, democratic worker education helped spur these changes. The origins and effects of two historical examples are detailed: the Bryn Mawr Summer School for Women Workers held in the United States annually from 1921 to 1938 and the first International Women’s Summer School of the International Confederation of Free Trade Unions (ICFTU) held in France in 1953. The latter experiment, attended by women labor leaders from 25 countries, energized the Women’s Committee of the ICFTU. It led to the adoption of “The Charter of Rights of Working Women” by the ICFTU in 1965 and helped make possible the election of Sharan Burrow and other women to top office in the International Trade Union Confederation. The address concludes with a discussion of what the history of trade union women’s education teaches about strengthening future labor movements.

The author, in the paper, points out the importance of the practice of the Committee of Association of the International Labour Organization, which is the cornerstone of modern collective labor law. The recommendations of the Committee regarding the realization and protection of trade union freedoms greatly influenced the adoption and amendment of legal regulations in a large number of countries, which were not in accordance with the ratified Conventions no. 87 on freedom of association and protection of the right to organize, as well as Convention no. 98 on the right to organize and collective bargaining, and where in practice there were restrictions and impediments to the enjoyment of trade union freedoms. In the first part of the paper, the author deals with the right to union association and its guarantees in the legal instruments of the International Labour Organization. Furthermore, the paper analyzes the establishment, composition and jurisdiction of the Committee of Association of the International Labour Organization, while special attention is paid to the procedure before the Committee itself. The central part of the paper refers to the practice and opinions of the Committee, while in the last part of the paper, the author deals with protection against anti-union discrimination.

The position between workers and workers in labor law always places an unbalanced position, where the position of workers will always be in a weak position. In the dispute over industrial relations disputes regulated in Law Number 2 of 2004 the basis for evidence is based on Article 163 HIR (Herzien Indonesis Reglement)/ 283 RBg (Rechtsreglement Buitengewesten) / 1865 BW (burgerlijk wetboek voor Indonesie). The provisions of this Article give rise to injustice about the reverse evidence that has been established by the International Labor Organization (ILO) through international labor standards and other ILO legal instruments regarding reverse proof in cases of dismissal, Freedom of Association, and Equality in Employment and Occupation. This research utilizes a juridical normative, descriptive approach and is supported by case studies as data support, and an analysis is carried out based on qualitative methods and legal comparisons.

On June 8, 2007, the Supreme Court of Canada [SCC] overruled its jurisprudence of the past twenty years on freedom of association. The majority of the judges agreed that section 2d) of the Canadian Charter of Rights and Freedoms protects the right to the process to collective bargaining. In doing so, the SCC rejected the ratio of the majority enunciated in the 1987 trilogy and, at last, gave place to international labour law, in particular to freedom of association principles elaborated by the International Labour Organization's supervisory bodies. The analysis of these principles, focused on three related rights, i.e. the right to collective bargaining, the right to strike and the right not to associate, allows the author to conclude that for the first time, Canada is showing greater respect for its international obligations. What the SCC will decide for the right to strike remains to be seen.

This Dissertation evaluates the potential opportunities, challenges and outcomes attendant on Vietnam’s modernisation effort through the incorporation of International Labour Organisation (ILO) Core International Labour Standards (CILS) on freedom of association and collective bargaining into Vietnam law. The Dissertation shows that although Vietnam is likely to benefit from incorporating the CILS on freedom of association and collective bargaining into its legal system, its constitutional value system is not currently consistent with those of particular ILO CILS. It offers recommendations on pre- substantive and procedural measures necessary to ensure the successful reception of ILO CILS on freedom of association and collective bargaining into Vietnam legal practice.

Among the different rights that workers are entitled to, the right to vacations has currently become one of the most relevant. However, many questions could be made regarding thesaid  entitlement:  What do we mean when we refer to vacations? Which are its mainelements? What is its purpose?In the present article, the author answers those questions in the light of several doctrinal studies, international legislation and constitutional jurisprudence. He also stresses the role the International Labor Organization Convention 132 plays on the matter, as well as the importance of the respect of freedom of association.

This thesis concentrates on a local union of the International Association of Machinists (IAM), District Lodge 776, of Fort Worth, Texas, during the war years. The main argument of the thesis runs along three basic lines. First, it demonstrates that the experiences of the Fort Worth Machinists clearly fit into the national labor movement during the war years. Second, it argues that the existence, survival, and strength of the union depended greatly on outside forcesan expanding national economy, a powerful national union, and a generally labor-friendly government. Third, it shows that union officers and rank-and-file members used their bases of strengththe national economy, the national IAM, and the federal governmentto build an effective local labor organization.

La tesi studia l’impatto degli standard internazionali sulla libertà di associazione sindacale negli ordinamenti nazionali e a livello europeo, al fine di verificare se essi favoriscano un innalzamento del livello di tutela dei diritti sociali collettivi. La ricerca parte dallo studio delle fonti Oil sulla libertà di associazione, considerata diritto fondamentale da promuovere universalmente, e dalla qualificazione dello sciopero come suo “corollario intrinseco” operata dagli organi di controllo dell’organizzazione. Si sofferma poi sull’utilizzo degli international labour standards da parte dei giudici di diversi ordinamenti e sul fenomeno della cooperazione tra autorità giurisdizionali e organismi non giudiziari specializzati. In particolare, la ricerca prende in esame alcune pronunce della Corte europea per i diritti dell’uomo, come Demir e Enerji Yapi, in cui gli strumenti Oil, insieme alla Carta sociale europea e alle decisioni del Comitato per i diritti sociali, sono stati impiegati per ampliare il contenuto dell’art.11 Cedu, includendovi il diritto di contrattazione e azione collettiva. Alla luce delle modifiche introdotte dal Trattato di Lisbona, successive alle sentenze Viking e Laval, si considera se e in che modo gli standard Oil e la giurisprudenza di Strasburgo possano avere un impatto positivo sull’Ue, stimolando un bilanciamento più equilibrato tra diritti sociali e libertà economiche.
The thesis analyses the impact of international labour standards about freedom of association on national legal systems and on the European level, to verify if they can reinforce the protection of collective social rights. The research starts from a survey of ILO sources on freedom of association, considered as a fundamental right to be promoted universally, and from the definition, provided by the supervisory bodies, conceiving strike as an “intrinsic corollary” of the right to organize. The thesis focuses on the use of international labour standards by judges in the context of the cooperation among judiciary authorities and quasi-judicial specialized bodies. In particular, the research considers some judgments of the European Court of Human Rights, as Demir and Enerji Yapi, where ILO instruments, together with the European Social Charter and the decisions of the European Committee of Social Rights, were used to extend the scope of art. 11 ECHR so as to cover the right to collective bargaining and collective action. In the light of the Lisbon Treaty modifications, the thesis considers, after the ECJ rulings in the Viking and Laval cases, if and how ILO standards and the recent ECHR case-law may have a positive impact on EU, stimulating a fairer balancing between economic freedoms and social rights.

This thesis consists of three separate essays related to international economics and labor markets. The first essay, with Francisco Gallego, looks at sudden stops, a main feature of developing countries in the last decades, and their effects on these countries. Using sector-level data on job flows for four Latin American countries, we find that sudden stops are associated with lower job creation and increased job destruction. Sectoral effects are related to financial indicators: sectors with higher dependence on external financing experience lower creation and sectors with high indicators of liquidity needs experience larger destruction. These results provide evidence of financial conditions being an important transmission channel of sudden stops within a country. The second essay, with Patricia Cortés, studies whether low-skilled immigration has led high-skilled American women to change their time use decisions. We find evidence that low-skilled immigration has increased hours worked by women with a graduate degree, especially those with a professional degree or a PhD and those with children. Our estimates suggest that the low-skilled immigration flow of the 1990s increased by 7 and 33 minutes a week the average time of market work of women with a Master's and a professional degree or a PhD, respectively. Low-skilled immigration increases the fraction of high-skilled women working more than 50 (and 60) hours a week, but decreases their labor force participation. Consistently, for these women, a decrease in the time spent in household work and an increase in reported expenditures on housekeeping services. Low-skilled immigration does not affect other education groups, except for a negative effect on labor supply.
(cont.) The third essay focuses on the effects of trade in services, modeled as formation of international production teams, in a diversity and trade model a la Grossman and Maggi (2000). For the two country case it is shown that when the tails of the countries' talent distributions satisfy a "similarity" condition, then free trade in goods replicates the integrated equilibrium. However, this condition is strong and it implies that generally international teams will change the allocation of agents, when trade in goods is already possible.

AbstractThis chapter compares how three International and two regional Organizations, namely the ILO, the WTO, and the World Bank, as well as ASEAN and Mercosur, approach the global governance of labor standards. Defining ‘labor standards’ is notoriously difficult. We therefore use Freedom of Association and Collective Bargaining (FACB) rights as a benchmark to assess the positions taken by the five regional organizations. We argue that two main discourses have been pursued in the global debate, a ‘social’ discourse, and a ‘neoliberal’ discourse. We find that organizations whose intrinsic features allow for an institutionalized representation of workers’ interests pursue variations of the social discourse, whereas a neoliberal position predominates in organizations where this representation is lacking. This is true both at the international and regional level. Moreover, we show that the coexistence of these two conflicting discourses has led to contestation, but also to exchange and cooperation. We furthermore outline to what extent the two discourses have changed over time. We conclude the chapter with a discussion of future challenges for the global governance of labor standards.

Abstract The social rules of a universal market economy, created by globalization, are based on the standards adopted by the ILO since 1919. Among them a special role belongs to fundamental principles and rights at work, comprised in an ILO Declaration in 1998. They provide for freedom of association, collective bargaining and the elimination of child and forced labour and discrimination. There is a growing debate on how other standards should be linked to fundamental rights and not seen as less important instruments. Technical cooperation has demonstrated that, in any case, implementing fundamental rights leads to strengthening of law and practice on wages, social security and occupational safety and health. All international labour standards (Conventions, Recommendations and Protocols) are derived from the labour principles of the ILO Constitution, and they are closely connected with one another. While the role of the state remains crucial—especially in times of crisis—much of the implementation of labour standards should be achieved through collective bargaining and other negotiations, while voluntary agreements between the social partners are generally legally binding.

In this pilot study, 11 international students studying in the Capital District region of upstate New York completed the <em>Parental Authority Questionnaire</em> (Sensese, Bornstein, Haynes, Rossi, and Venuti, 2012) and two also completed the <em>Parenting Style Questionnaire</em> (Robinson, Mandleeco, Olsen, & Hart, 1995) in an attempt to validate these instruments for diverse cultures. All participants contributed to focus group discussions of parenting attitudes and practices in their home countries to refine the focus group methodology. Two participants from Uzbekistan were interviewed individually to explore parental attitudes and practices that may relate to that country’s ongoing reliance on forced child labor during the annual cotton harvest. Results indicated that the questionnaires did not appear to be valid for international participants. The focus groups, however, provided rich and detailed responses about cultural differences in parenting practices and attitudes, although better recording procedures were needed. Interviews of the two Uzbek nationals provided tentative confirmation of the Eriksonian (1950) assertion that economic and cultural imperatives drive (and are reciprocally shaped by) parenting practices and attitudes, as evidenced by changing Uzbek attitudes toward the use of child labor during the annual cotton harvest as modernization occurs.

Albania, as a signatory of the Stabilization and Association Agreement, is legally obligated to meet European standards, even for pub­lic administration. This modest work attempts to provide a regulatory over­view of the status of public administration employees, the impact of politi­cal forces on sustainability, and the continuity of employment relationships of civilian servants. The primary goal of the entire regulatory system governing the status of civil servants is to establish uniform regulation for all positions related to the ex­ercise of public authority and responsibility for safeguarding the overall in­terests of the state. Simultaneously, it aims to strengthen legal protection, impartiality of civil servants, political independence, job stability, profes­sionalism, efficiency, and the optimal protection of individual rights and le­gitimate expectations of citizens from public administration. This work seeks to highlight these elements as reflected in Law No. 152/2013, as amended, also bringing to light the shortcomings or issues related to the implementation of this law. In the paper, an evolution of public administration has been reflected up to the present day, highlighting the issues related to recruitment, and move­ments within and outside public institutions. Efforts to establish sustainabil­ity in administrative positions through career progression, and staff moti­vation based on job performance, which should be objective and serve the purpose for which such a system has been established, are discussed. We have also endeavored to address these elements related to the status of civ­il servants in this work.

The World Health Organisation (WHO, 2017) stressed the importance of support during labour and childbirth to the women. Indonesia’s Ministry of Health in cooperation with the WHO, Indonesian Obstetrics and Gynaecology Association, and Indonesian Midwives Association recommended a support person (family member) to accompany women during labour and childbirth (Kementrian Kesehatan Republik Indonesia, 2013). However, in most parts of Indonesia, this recommendation has not been applied properly. With support from the management of the maternity centre, this study offered the women to have the husband’s support during labour and childbirth in order to understand the women’s and husband’s perspective of support during labour and childbirth. This study used a qualitative method, which was very rare, particularly in Indonesia. A quantitative method was included to investigate the couples’ perception of support during labour and childbirth. Eighteen couples were interviewed at three different times: before, during, and after childbirth. This study found similar themes between the women and husbands’ perception about support during labour and childbirth except one woman who felt negatively because her husband agreed with the midwife’s recommendation to do caesarean while the woman expected the normal childbirth. In addition, cross tabulation was added to understand the couples’ perception. This study contributed a new perspective of couples’ perception about support during labour and childbirth. Based on the finding, this study recommended maternity centres or local health care centres to provide information about the importance of support during labour and childbirth via posters, pamphlets, and leaflets. In addition, this study recommended to the Indonesian Ministry of Health to use newspapers, television, radio, and social media to inform all Indonesians about the importance of support during labour and childbirth via programs, community service announcements, and advertisements.

In recent years, software development in the Kyrgyz Republic demonstrated 60-70% growth rate. Kyrgyz software products are exported to Central Asian neighbors and to the Western countries such as Italy, Australia and Holland. With the highest Internet penetration in the region and pool of qualified staff Kyrgyzstan has real chances to sustain the growth rate of the industry. Moreover, the cheap labor creates comparative advantage for local software producers. The break-up the Soviet Union lead to bankruptcies of traditional industries in the Kyrgyz Republic and thousands of highly qualified engineers were left unemployed. Simultaneously since independence Kyrgyz government implemented number of reforms to encourage development of Information and Communication Technologies which lead to the establishment of ICT infrastructure in the region. The paper analyzes the development trend of the software production industry in the Kyrgyz Republic. We will also overview international experience as in the leading software producers as well as in neighboring countries. The study also builds projections for the next decade and draw on certain policy implications. In addition the paper will provide policy recommendations. The data used is from by the Association on IT companies, questionnaires, National Statistics Committee, Word Bank and Asian Development Bank.

Exporting fresh flowers is one of very few successful efforts by producers in low-income countries to compete in international markets of high-value agricultural goods. While this success results from producers' ability to take advantage of their geographic location and access to low labor costs, it may not be sustainable in the long run due to unreliable supply chains and high transportation costs. Using a case study approach of Ecuador's supply chain, complemented by an empirical analysis of microdata on exports from major fresh flower exporting countries to the United States, this study confirms producers' claims that time and transportation costs vary widely across countries. This paper was presented at the Latin America/Caribbean and Asia/Pacific Economics and Business Association (LAEBA)'s 4th Annual Meeting held at Lima, Peru on June 17th, 2008.
