AbstractIn Khurts Bat, the English High Court held that Mr Bat, a Mongolian State official charged with committing municipal crimes on German territory, was not immune from the jurisdiction of German courts and could therefore be extradited to Germany. This article examines the three theories of immunity put forward in that case: (1) special missions immunity, (2) high-ranking official immunity, and (3) State immunity. It focuses on the question of whether State officials charged with municipal crimes may plead immunity ratione materiae from the criminal jurisdiction of a foreign State by examining key examples of State practice.

Cost comparison in the field of wastewater treatment is a difficult task, particularly concerning sewages charges in different countries. German wastewater management is, for one thing, known to be very efficient, yet, for another, comparatively costly on an international scale. In this context, the marginal conditions typically prevailing in the field of sewage treatment in Germany should be mentioned: dense population and industrialization with high export-oriented production rates, high-profile purification requirements enforced by law. To establish a valid cost comparison, it is necessary to include both the investment and the operating expenses within the scope of the overall annual costs. The major factors impacting the different cost types are represented. Only if these factors are taken into account and quantified, will cost comparison be fair and lead to useful results. Ten hints for cost minimization are given to serve as a guideline for successful and responsable cost reduction. Cost transparency is the prerequisite for the possibility to develop saving potentials while simultaneously securing the social and political acceptance of the charges levied, and to compare the different plants with one another. Experience from Ruhrverband, a water management association for an entire catchment area, being responsible for planning, building and operation of 94 wastewater treatment plants and other plants for water quantity and water quality management, is reported.

This article investigates the role of deservingness conceptions in the implementation of labour market access policies for migrants with precarious legal status. It explores how immigration officials frame the deservingness of work permit applicants, considering also the political, legal and societal context in which they work. The analysis takes account of the Control, Attitude, Reciprocity, Identity and Need (CARIN) criteria, and uses primary data of semi-structured interviews with senior officials in German municipal immigration offices. It finds that officials frequently employ deservingness frames inbuilt into the relevant parts of the law, but also behavioural norms that go beyond legal requirements. The article makes two main contributions. Providing empirical insight into the migration bureaucracy’s part in the implementation of labour market policy, it seeks to help advance understanding of the complex processes of differential in- and exclusion in countries of immigration. Furthermore, the research design allows putting the CARIN criteria to an empirical test.

The article analyzes the structure of the legal responsibility institute of the state. The article reveals the peculiarities of legal regulation of constitutional, civil and international legal responsibility of the state. The features of the subinstitute of constitutional responsibility of the State, which aims to ensure the inviolability of the principles of democracy and supremacy of the Constitution, as well as to protect the rights and freedoms of man and citizen are being shown. The author analyzed foreign experience of legal regulation of the legal responsibility of the state. The history of the formation and functioning of the procedure for impeachment of the Institute in the following countries: United States, United Kingdom, Denmark, Norway and the Federal Republic of Germany are expounded. Also considered are the basics of civil responsibility of the state. According to para. 2, Art. 8 of the Constitution of the Russian Federation in the Russian Federation it is recognized and protected equally private, state, municipal and other forms of property. Equal protection of all forms of property means, in particular, establishing the inadmissibility of any exception regarding the property responsibility for individual subjects, including the state. On this basis, we analyzed the concept of functional and absolute immunity of foreign states. The main provisions of both international law and the Federal Law of 11.03.2015, № 297-FZ "On the jurisdictional immunities of foreign States and property of a foreign state in the Russian Federation." are reviewed. The features of subinstitute of international legal responsibility of the state are investigated. It is generally known that one of the fundamental principles of contemporary international law is sovereignty. However, this principle does not indicate a lack of interaction and interdependence of the state, since no state can exist and develop in isolation from the world community. The article was supported by the Russian Foundation for Humanities, the project № 16-33-00017 «A comprehensive, interdisciplinary institute of legal responsibility: the concept, structure, relationships and place in the legal system".

The demographic development in most German rural areas raises major questions for the future of public service provision, especially with regard to the performance of different organisational arrangements and their joint action and governance for achieving publicly-desired outcomes. The international literature on collaborative approaches to public service provision is flourishing. However, little attention has been paid to the contribution of public economy and non-state stakeholders to solve these problems. Facing this gap, the exploratory study aims to analyse and discuss the role that civil society, municipally-owned housing companies and public savings banks play in delivering public services and implementing public policies in shrinking rural areas in Germany. By focusing on the scope, drivers, benefits but also limitations of these arrangements, the study helps us in understanding cautious patterns in this field of research and addresses some lessons and perspectives.

Nature Conservation and Constitutional Law in Germany Germany's federal structure is mirrored in its constitutional law consisting of the federation's Basic Law and the constitutions of the federal states subject to conformity with the former. "Nature conservation" in the constitutional context means the "protection of the natural basis of existence" comprising all natural values such as flora, fauna, soil, water, air, climate, landscape and their interdependencies. The process of incorporating provisions on nature conservation in the constitutions of both state levels intensified in the 1970's and 1980's leading to the amendment of the constitutions in several federal states (adopting for example state aim definitions, locus standi for nature conservation NGO's, individual rights to enjoy nature, municipal responsibilities and so forth), revived with the unification of Germany and came to a first halt with the amendment of the Basic Law in 1994, introducing Article 20a. Nature conservation directly or indirectly is subject of different categories of constitutional provisions - competences, state aims, fundamental rights and through disputed fundamental duties.As to legislative powers the federation itself enjoys only a framework competence (see Federal Nature Conservation Act), which is unfavourable especially to the implementation of international commitments. This framework is complemented by the nature conservation legislation of the federal states to which also the executive powers in this field are allocated.Article 20a of the Basic Law provides that "The state protects […] the natural basis of existence …". As a state aim ("Staatszielbestimmung") it addresses the state bodies which thus are legally bound to always respect and perform to the end of the constitu-tionally prescribed objective. As a provision of mere objective law, the individual has no locus standi to enforce its implementation. Its role therefore must be seen as a means of interpretation of enacted law to ensure conformity with the constitution, as a guideline for discretionary decisions and as a support in planning processes for weighing up interests. Under the latter aspect Article 20a can be understood as a principle of non-deterioration regarding the environmental situation, as a "guideline for integrity" and as a decision in favour of raising the standards of protection and implementing them.Academic discussion on a fundamental right related to nature conservation calls for abondonment of the anthropocentric approach inherent in the constitution (human dignity). A first promising step would be to adopt an "ecological minimum standard" vested as fundamental right. However, in practice a right of nature itself is denied. Instead nature's interests are represented by the state (for example protection of certain sites and biotopes by law) and by NGO's (with locus standi in German administrative courts in most states (Länder)). Claims of individuals against the state to avert a destruction of nature are also denied. Nature conservation as fundamental duty is materialized in the principle of social commitment of property. To this extent nature conservation also amounts to an "ecological" limit for the excercise of individual freedoms guaranteed under the constitution. A respective limitation of nature conservation by these freedoms as well as the scope of any limit to nature conservation are disputed issues.

The purpose of this dissertation is to assess whether or not there is a universal human right to water. The problem of water scarcity and high death rates due to a lack of access to clean water is still prevalent across the globe today, making it hard to believe that a human right to water is still not codified in international law. This dissertation analyses international as well as national law to assess whether a human right to water is universally acknowledged by the international community despite not being codified. It is argued, that there is still no explicit universal human right to water in international law. However, this dissertation acknowledges that a human right to water does exist as a derivate right, which is almost universally acknowledged. As a derivative right, it is, however, not as equally strong as explicitly acknowledged rights in the core international human rights instruments. This dissertation also provides a brief overview of corporate involvement under the human right to water. An assessment is made as to whether or not international law imposes direct obligations and responsibilities on companies. It is argued in this dissertation that companies have a particular responsibility for the implementation of the human right to water despite states remaining the primary subjects responsible.

ENGLISH ABSTRACT: According to Rumpf£ CJ in the Nduli decision, Roman-Dutch law is the fons et origo of the statement that customary international law is part of South African law. His sources, Fran~ois and Huber, are open to criticism because they are not Roman-Dutch authorities on this specific question, but the decisions in Ncumata v Matwa (1881-2), Du Toit v Kruger (1905), and Rex v Lionda (1944) emphasise that the reception of customary international law in South African law has taken place through Roman law. Various court decisions emphasise that the term Roman-Dutch law should not be interpreted narrowly, as it includes the common law of the whole of Western Europe and not only of the province Holland. If this quotation is interpreted in an ius commune context, it is clear why Rumpf£ CJ did not cite specific sources to prove his point: he accepted it as a given fact- as the jurists did in the middle ages. Roman-Dutch law serves only as a frame of reference out of which international law has developed. The courts therefore apply international law as international law and not as, for example, common law. Two important implications follow: firstly it means that customary international law need not to be transformed before the courts can apply the relevant rule and secondly that new rules of customary international law automatically form part of the law of South Africa. From the eighty South African court decisions discussed, it is clear that the courts do take judicial notice of customary international law. This justifies the statement that the judiciary regards customary international law as part of the law of South Africa since 1879. The influence of English law on this section of South African law must, according to Rumpf£ CJ, also be taken into account. The reason is that English law is the common law of the South African constitutional law which influences the application of international law by the courts. This can extend the courts' frame of reference. Only a fifth of the cases discussed refer to Roman-Dutch writers, and then only in a comparative sense. The South African courts rely mainly on Anglo-American decisions and tendencies. The South African courts follow their English counterparts by accepting the same qualifications on the general rule that customary international law forms part of the law of the land. The willingness of the courts to apply customary international law has diminished over the years especially in cases where state security features. It seems that politically contentious questions play an inhibiting role on the readiness of the courts to apply customary international law where conflict, real or imaginary, between customary international law and municipal law appears. Acts of state constitute the most important obstacle in the application of customary international law, because they could lead to the court abandoning its independent judicial function in favour of the executive. Because the South African courts follow the English law in this area also, it is assumed that safety measures developed there would be adopted by the South African courts to prevent their jurisdiction from being limited too easily. It is recommended that more attention should be given to the existence and application of customary international law principles and that a conscious effort must be made by the judiciary to resolve conflict between customary international law and municipal law and to do it in such a manner that due account is taken of the fact that in South Africa customary international law is part of the law of the land.

Verskeie hofbeslissings beklemtoon verder dat die term Romeins-Hollandse reg nie eng gei"nterpreteer moet word nie, aangesien dit die gemenereg van die hele Wes-Europa omvat, en nie net die van die provinsie Holland nie. Uit die tagtig Suid-Afrikaanse hofbeslissings wat bespreek is, is dit duidelik dat die howe wei geregtelik kennis neem van volkeregtelike gewoontereg. Dit regverdig dus die stelling dat die reg bank volkeregtelike gewoontereg reeds sedert 1879 as dee! van die Suid-Afrikaanse reg beskou. Die invloed van die Engelse reg op hierdie dee! van die Suid-Afrikaanse reg behoort volgens Rumpff HR ook in ag geneem te word. Die rede hiervoor is dat die Engelse reg die gemenereg van die Suid-Afrikaanse staatsreg vorm. Dit bei"nvloed die toepassing van die volkereg deur die howe- gevolglik kan dit die howe se verwysingsraamwerk uitbrei. Slegs 'n vyfde van die beslissings verwys na Romeins-Hollandse skrywers, en dan slegs in 'n vergelykende sin. Die Suid-Afrikaanse howe steun hoofsaaklik op Anglo-Amerikaanse beslissings en tendense. Die Suid-Afrikaanse howe volg hulle Engelse ewekniee deur dieselfde beperkinge op die algemene reel dat volkeregtelike gewoontereg dee! vorm van die reg van die land, te aanvaar. Die bereidwilligheid van die howe om volkeregtelike gewoontereg toe te pas het deur die jare afgeneerri, vera) waar staatsveiligheid ter sprake is. Dit blyk dat polities-kontensieuse vrae 'n striemende faktor is by die toepassing van volkeregtelike gewoontereg deur die howe, vera) waar daar 'n botsing tussen volkeregtelike gewoontereg en munisipale reg voorkom. Staatshandelinge is die verna.amste struikelblok by die toepassing van vol-keregtelike gewoontereg, aangesien dit daartoe kan lei dat die howe afstand kan doen van hul onafhanklike regsfunksie ten gunste van die uitvoerende gesag. Omdat die Suid-Afrikaanse howe die Engelse reg ook in hierdie gebied navolg, kan dit aanvaar word dat die veiligheidsma.atreels wat reeds daar ontstaan bet, deur die Suid-Afrikaanse howe gevolg sal word om te verhoed dat hul jurisdiksie ligtelik beperk sou kon word. Enhanced cooperation is the EU’s most general, multi-purpose, and thus differentiation-friendly possibility to legislate without binding all Member States. After years of initial reluc-tance, it has been put into practice in a number of cases in the last years. In light of these developments, many perspectives on enhanced cooperation are worth revisiting. At the same time, the EU has recently been facing numerous fundamental challenges, and enhanced co-operation could be one of the tools for policy makers to consider when searching for solutions. It does so by analysing two crucial legal aspects of the enhanced cooperation mechanism in depth: the last resort principle and the principle of openness. Both principles stand out among the law governing enhanced cooperation as particularly important, defining notions – indeed, cornerstones of enhanced cooperation.

In Germany and beyond there is a widespread social and political discussion on a “mobility turnaround”, which refers to the technological and behavioural change of the entire transport sector towards sustainability goals. Within that approach of a “mobility turnaround” the concept of car-sharing is universally seen as a central component. This attribution is mainly based on the presumed combination of the advantages of rationally using a car on one hand without baring the negative social effects of a private-car ownership. Until recently, however, it has not been legally possible in Germany to reserve exclusive parking spaces for carsharing vehicles in public spaces. Carsharing stations could therefore only be located in private spaces, which in turn was a strong limiting factor in the expansion of the service. With the introduction of the German “Carsharing Law” in 2017, municipalities were given the possibility to identify and assign exclusive parking spaces in public areas, which now serves as an instrument for targeted planning of carsharing services. The following contribution presents an overview of the typical organizational and operational forms, use-cases and user groups of casharing services. The positive and negative effects are identified, classified and discussed. Further, the paper proposes how an ideal carsharing service should be designed from a municipal and transport planning perspective. Based on this general findings, the contribution presents the exemplary approach of the city of Wiesbaden. The municipality allocates public spaces to private-sector providers based on a defined comprehensive network concept. Within that concept public spaces are only tendered to providers in accordance with clearly defined targets and operational standards. With that approach Wiesbaden is proactively fostering a city-wide carsharing network as an integrated mobility service.

Until the end of 20th century new big office buildings in Germany – even in the central business district CBD – didn’t provide any or much too less facilities for bicycle parking. Since then the already existing state and municipal regulations have been enforced and new ones exist which define the mandatory number of bicycle parking lots for new office buildings. But now it can be seen that too many lots are required, the real demand is in many cases – and will be in the foreseeable future – much lower. With data from EU and German sources the situation in the Frankfurt am Main CBD is described: political goals for sustainable traffic by enforcing bicycle usage; municipal regulations for the number of bicycle parking facilities; comparison between (politically defined) requirements and the expected real demand. Today’s and future modal-split data for bike usage at office buildings from empirical traffic surveys and assumptions in Frankfurt are presented. Examples of bicycle parking facilities for already existing and planned office buildings in Frankfurt are provided, showing as result a compromise between city’s regulation and the expected demand for bicycle lots.

When the legislative has delimited rights and freedoms illegally, Constitutional Court should step in as an efficient assurance and this forcefulness is undoubtedly related to the structure of the Constitutional Court. The Constitutional Court's organization and election of the members of the Constitutional Court and status have a great importance for freedom of the Court. As a matter of fact, the only way to protect people’s fundamental rights and freedoms is possible with independent verdict. Judiciary which fulfills the function of judgment behalf of the nation and the judges who hold the judicial power, have an indispensable importance. The assurance of people’s right and freedoms could be provided only, when the court has accomplished their mission away from all kinds of pressure and influence. The freedom of judges also means their appointments, employee rights and working condition therefore; in first place, the organization of the Turkish Constitutional Court (General Assembly, Department, Division, Commission), then the election of members of the Turkish Constitutional Court and the status are compared with the regulation of Macedonia, Germany, Austria, France, Italy and Spain.

On 4 February 2022, the Polish Journal of Laws published a new ordinance of the Minister of Education and Science, implementing cuts in the funding of education of German as a minority language. Consequently, the hourly length of such lessons will be significantly reduced. This regulation applies exclusively to the German minority, and the official motive for introducing discriminatory measures is to improve the situation of Polish diaspora in Germany. This is the first time after 1989 when the Polish state authorities introduce a law limiting the rights of Poland’s citizens belonging to a national minority (in this situation children), as a retaliation for the alleged situation of a kin-community elsewhere. Importantly, the adopted regulations are not only discriminatory towards one of the minorities; their implementation may in fact contribute to the dysfunctionality of the entire minority education system in Poland. This is also an obvious violation of the constitutional principle of equality before the law, the right of minorities to ‘maintain and develop their own language’, international standards of minority rights protection, as well as a threat to the very functioning of human rights protection mechanisms in the country.
