Résumé Les rapports femmes-hommes : une expression particulière d'une économie sexuée La répartition inéquitable du travail rémunéré et non rémunéré entre les femmes et les hommes demeure toujours un obstacle majeur à l'amélioration du statut des femmes en société occidentale. On a analysé certaines formes du travail impayé, telle la production domestique, mais il y en a d'autres où les femmes se distinguent par leur productivité. L'échange informel de biens de consommation et de services entre unités domestiques constitue un secteur de l'économie parallèle où les femmes se démarquent par leur dynamisme, au bénéfice de l'unité domestique et de l'économie nationale.

In this article, the author studies the reasons that led the legislator to amend, in 1861, a law adopted in 1859 in order to specify that the claim of the holder of a bill of lading or of a warehouse receitpt has priority over the claim of any unpaid vendor. The study is particularly relevant due to the fact that section 179 of the actual Bank Act is directly derivated from the 1861 amendment without any significant modification. The study of the rights held by the pledger and the unpaid vendor at the time when the legislator adopted the above mentioned amendmend leads the author to conclusions as to the reasons that made this amendment necessary, as well as to the significance of section 179 in the Bank Act.

In 1984, the U.S. Armed Forces amended its capital punishment system for death eligible murder to bring it into compliance with Furman v. Georgia. Those amendments were modeled after death penalty legislation prevailing in over thirty states. After a brief period between 1986 and 1990, the charging decisions of commanders and the conviction and sentencing decisions of court martial members (jurors) transformed the military death penalty system into a dual system that treats two classes of death eligible murder quite differently. Since 1990, a member of the armed forces accused of a killing a commissioned officer or murder with a direct impact on the ability of military commanders to run an effective and disciplined military is significantly more likely to face a capital court martial and be sentenced to death than a similarly situated member accused of a murder connected to the military only fry the identity of the accused. This empirical study of charging and sentencing decisions in 104 death eligible military murders from 1984-2005 documents contemporary resistance to the civilianization of the military death penalty as manifest in charging and sentencing decisions. We conclude that a limitation of death eligible murder to those directly impacting military command and control could reduce the risk of arbitrariness in the administration of the military death penalty.

Big Tech today faces unprecedented levels of antitrust scrutiny. Yet antitrust enforcement against Big Tech still faces a major obstacle: the Supreme Court’s 2018 decision in Ohio v. American Express. Popularly called Amex, the case imposed a higher initial burden on antitrust plaintiffs in cases involving two-sided markets. Two-sided markets connect two distinct, noncompeting groups of customers on a shared platform. These platforms have indirect network effects, meaning that one group of customers benefits when more of the second group of customers joins the platform. Two-sided markets are ubiquitous in the technology sector, encompassing social media, search engines, and online marketplaces. Many have observed that the Amex Court’s reasoning drew on questionable economic principles, contrary to the typical approach in antitrust law. This Note examines and adds to these critiques through a novel analysis of lower-court cases post-Amex. This analysis reveals that Amex has resulted in inconsistencies and confusion in the lower courts, opening the door for technology defendants to manipulate Amex’s definition of two-sided markets for their own benefit. To resolve these inconsistencies, this Note proposes a two-part legislative solution to curb Amex’s reach.

In June 2022, the Supreme Court revoked Americans’ fundamental right to abortion in Dobbs v. Jackson Women’s Health Organization. However, the Court said nothing about how its decision would impact tort claims related to reproductive care. Many states have since adopted near-total or early-gestational- age abortion bans, which has not only diminished access to reproductive care, but has also incidentally impaired the ability of plaintiffs to bring long-recognized prenatal tort claims. Prenatal tort claims—wrongful pregnancy, birth, and life—allow victims to recover when a medical professional negligently performs reproductive or prenatal care. This Note identifies the impact that post-Dobbs abortion bans and restrictions will have on each type of prenatal tort claim. This Note explains the purposes of prenatal tort claims and supplies an up-to-date, nationwide survey of the recognition of these claims. It then provides empirical evidence demonstrating the politicized nature of prenatal tort claims and analyzes the ways that abortion bans will impact them. Finally, it outlines potential constitutional, tort law, and nonlegal solutions to Dobbs’s impact on prenatal tort claims.

Abstract Discussions on political impact broaden our understanding of the impact of academic research and deepen our awareness of underlying and socially constructed dynamics that determine the very meaning of what will be collectively understood as impact. Three major types of impact can be considered when discussing how researchers can fully observe the political impact of their research: (a) promotion of emancipation and critical thinking, (b) promotion of debates on the public interest and (c) contribution of the study results to the process of denaturalizing knowledge considered as neutral. The political impacts of academic research represent the future development of societies and organizations, as they make life viable in a collective, social and democratic context. If so, why are we still unable to substantiate, enable and operationalize such consideration into our scientific research metrics and guidelines?

All research must be concerned with its power to affect educational vision and practice, directly or indirectly. How can this concern become perennial and central to the practice of academic research?

OBJECTIVE: To compare the impact of a pharmacist's presence for the detection of drug-related problems (DRP) in an interdisciplinary geriatric-ambulatory clinic with a control group without a pharmacist.<br/> DESIGN: Retrospective quasi-experimental study.<br/> SETTING: A geriatric ambulatory-care clinic of a 772-bed tertiary-care teaching hospital in Montreal, Canada.<br/> PARTICIPANTS: A total of 227 ambulatory patients 65 years of age and older presenting to their appointment at the geriatric ambulatory clinic between May 1, 2018, and April 30, 2019.<br/> MAIN OUTCOME MEASURE(S): DRP detected by the interdisciplinary team during the patient evaluation process. Data were collected from clinical notes written by the health care professionals in the electronic medical chart.<br/> RESULTS: The mean age was 80.8 years, and 60.8% of the population were female. Patients were prescribed a mean of 11.3 medications at home. Overall, 636 DRP were detected in the study population. In the adjusted analysis, the difference between the two groups was 2.7 (95% confidence interval 2.0-3.3) DRP detected favoring the group with a pharmacist.<br/> CONCLUSION: The inclusion of a pharmacist in an interdisciplinary team in an ambulatory geriatric-care clinic was associated to a positive impact on care by substantially increasing the number of DRP detected in older patients.

Coadministration of oral divalent or trivalent cation-containing compounds with oral fluoroquinolones may impair fluoroquinolone absorption. Among 3,134 patients who received a course of oral levofloxacin, coadministration was significantly associated with subsequent identification of a levofloxacin-resistant isolate. Strategies to curb the emergence of fluoroquinolone resistance should include avoiding the coadministration of divalent or trivalent cation-containing compounds and fluoroquinolone.

Abstract:Research has increasingly established that mesoherbivores influence the regeneration of woody plants. However the relationship between mesoherbivore density and degree of impact, and the spatial component of this impact, has not been well established. Using a novel sampling design, we assessed in iMfolozi Park, South Africa, the impact of impala (Aepyceros melampus) across the full complement of woody species within the home range, evaluating its spatial component and relationship to impala density. We used four GPS collars, in separate breeding herds, and a GIS to detect zones of different density of impala in the landscape, thus defining a fine-grain browsing gradient. We assessed impact on woody recruits (≤ 0.5 m height) across this gradient by means of 1600 random 1 × 1-m quadrats. Densities of woody seedlings, and mean percentage of remaining canopy, were significantly less in areas of high impala density versus low-density areas. There was a significant correlation between increasing impala density and decreasing density of favoured woody recruits. We propose a hypothesis of impala-induced patch dynamics. It seems likely that the ubiquitous impala may create and sustain a shifting mosaic of patches, and thus function as a key determinant of landscape heterogeneity.

Therefore, socio-environmental impact shall become a universal and inevitable concern of researchers, educational institutions and scientific research regulatory agencies. Social and environmental impacts, in all senses, must be considered into any production of knowledge. Some questions help incorporate this conduct in academic research: How can research ensure effective socio-environmental impacts on society? What is the best way to conduct research so that it has positive social and environmental impacts from the beginning? How can research be fully dedicated to generating positive socio-environmental impacts in every step? We concluded that socio-environmental impacts must be considered just as much or even more important than those of socioeconomic and technological nature.

This study was conducted in order to clarify whether photocatalyst flocculation – as observed in biologically pretreated greywater – contributes to photocatalytic oxidation (PCO) efficiency impairment. Aqueous solutions of tetraethyleneglycol dimethylether spiked with different inorganic salts in concentrations as found in biologically treated greywater were investigated with respect to TiO2 flocculation and PCO mineralisation kinetics. Flocculation of the photocatalyst primarily depended on pH (which was affected by the salts) and how close pH was to the point of zero charge (PZC). Photocatalyst agglomeration was maximum at pH 5.5. With salt concentrations &gt;7 mmol L−1, flocculation was strong even at pH far above PZC due to electric double layer compression. PCO rate constants were not unequivocally related to flocculation. Increasing pH was observed as the clearest factor deteriorating PCO efficiency. This was interpreted to result from impaired adsorbability of negatively charged oxidation intermediates as well as from enhanced CO2 absorption with increasing pH and subsequent formation of HCO3− anions which are OH radical scavengers.
