Research on the effects of concealing a stigmatized identity on health outcomes is remarkably mixed, with results showing both health costs and benefits to concealing. This chapter reviews the literature and presents a framework for conceptualizing the moderators and mediators of the concealment–health relationship. It is proposed that people who reveal their stigmatized identity within supportive environments reap health benefits, whereas those living in more hostile environments benefit by greater concealment. However, if concealment leads to greater cognitive burden, then negative health outcomes can occur. If people do disclose their stigmatized identity, the confidants they choose, the level of social support received, and the negativity of the reactions will all influence the relationship between disclosure and health outcomes. Future research is needed to clarify which variables are most important for health and to examine differences between identity types and environments.

This chapter discusses the issue of third-party funding in international investment arbitration. Third-party funding has become an established part of the investment arbitration landscape. Despite criticism in some quarters, tribunals and international arbitral bodies have tended to favour the view that third-party funding promotes access to justice rather than encouraging frivolous claims. Tribunals have consistently held that receipt of third-party funding is unlikely to affect a claimant’s position from a jurisdictional perspective and will not affect a claimant’s ability to recover legal costs in cases where tribunals make costs awards. The costs of third-party funding itself may be recoverable in some circumstances. There is a growing tendency among tribunals to require disclosure by funded claimants of the existence and identity of third-party funders. It is, however, unlikely that claimants will commonly be required to disclose the terms of any funding agreement except in rare cases when security for costs is being considered.

In matters of medical error and complications, patients and families overwhelmingly want to be informed. Most patients want providers to disclose if a complication or an error has occurred, and want to be informed of any possible adverse outcomes from the event. Most want to be informed immediately following an event and expect an investigation when the cause is not readily identified. When the event is due to an error, patients and families want honest disclosure and a sincere apology from those responsible. Afterward, they want continued emotional and psychological support, and they expect efforts to identify and correct the cause. Historically, physicians and institutions have been slow to fully disclose errors, especially if they were preventable. Patients have frequently not been provided with the support they require and often have felt frightened and alienated. The immediate effects of medical mistakes can be devastating, but the subsequent emotional, personal, and relational consequences can be very distressing. Silence, shame, guilt, and fractured trust disrupt the therapeutic relationship and leave patients, families, and caregivers to suffer alone.

The idea of privacy has played a role in constitutional thought, formulations of human rights, and both common and civil law. The US Supreme Court has recognized that five of the original Bill of Rights and the Fourteenth Amendment protect privacy interests. In US tort law, interests against intrusion upon seclusion, public disclosure of private fact, publications placing one in a false light, and misappropriation of a person's name, likeness, or identity are potentially protected through civil actions styled ‘invasions of privacy’. Federal and state statutes protect interests in the privacy of records relating to, inter alia, health, finances, consumer transactions, Internet use, and taxes.

This chapter considers in greater detail the personal disruption central to the New Testament accounts of Christian cognitive identity. It focuses on the authors’ conviction that they participate in a new eschatological reality that is centred on the revelation of God in Jesus Christ. This conviction acknowledges the necessary limits of the human potential to know God apart from his own deliberate and concrete self-disclosure in the person of Jesus. Such limits involve both earthly finitude and the distortive power of sin. The chapter involves a particularly close engagement with scholarship on the ‘apocalyptic Paul’, which has rightly identified these epistemic elements in the apostle’s thought, but has frequently failed to recognize the continuing importance of the Old Testament to Paul’s moral theology. The continuing significance of the Old Testament to Paul’s thought, particularly the wisdom literature, is important to Christian theologies of intellectual virtue.

This chapter examines whether a strong commitment to freedom of speech precludes regulation of lies. The strong condemnation of lies and the derivation of freedom of speech from similar argumentative foundations raise questions about the legal regulation of lies. Many commentators, as well as a majority of the Justices of the Supreme Court, insist that freedom of speech may pose a general and fundamental obstacle to the legal regulation of lies as such. The chapter rejects this position, arguing that legal regulation of lying poses no intrinsic threat to freedom of speech. It considers deliberately advanced misrepresentations of the speakers' beliefs, focusing on the Supreme Court ruling in United States v. Alvarez which invalidated the Stolen Valor Act. It also discusses issues relating to content-discrimination, compelled disclosure, self-definition and identity, sincerity and personal integrity, and how lying causes particularized harm to victims.

This chapter addresses a range of practical and legal matters relating to the conduct of a Bermuda Form arbitration up to and including the disclosure of documents, i.e. before the service of witness statements in the normal case. This timing distinction is an arbitrary but practical one, since there are sometimes issues on the disclosure of documents that continue after service of witness statements. The chapter addresses the authority of the arbitrators to establish rules and procedures; the fact that there are no pre-set procedures in ad hoc arbitrations under the English Arbitration Act 1996; and how in practice an arbitration in London can be expected to progress. It discusses points such as security for costs, the nature and content of the pleadings, other techniques used in litigation to identify the issues, problems that commonly arise on the disclosure of documents, and the thorny issue of privilege.

This chapter reviews research on the psychological impact and treatment of pregnancy loss for women, men, and families. The psychological sequelae of pregnancy loss can include mild to severe grief, complicated grief, depressive disorders, post-traumatic stress disorder (PTSD), and other anxiety disorders. Effects on couples, men, and other family members, including the impact on subsequent pregnancies, parental attachment to subsequent children, and gender differences in how men and women cope and grieve, are discussed. The authors present a conceptual framework for understanding pregnancy loss, positing that reactions largely depend on deeply personal and often unconscious meanings of pregnancy and on how parenthood fits into personal identity and the achievement of adult developmental tasks. The authors discuss unique aspects of pregnancy loss that may explain its broad impact and describe ways in which psychotherapy with pregnancy loss patients differs from psychotherapy with the general population, especially regarding countertransference and attitudes toward self-disclosure.
