Assuming that the passing of time is reflected in each individual, preventing its stagnation, and that all interpretations must be temporally and spatially contextualized, the contract is studied here according to its changes in the last two centuries, changes that were propelled, at first, by the transition from the Liberal state to the Welfare state and, later on, by its replacement for the Democratic state of Law.

ENGLISH ABSTRACT: Ownership, and especially the ownership of land, consists of rights as well as duties. The social responsibilities of the owner depend on the prevailing needs of the public (as expressed in legislation) and are subject to change. Section 25(1) of the Constitution impliedly recognises the social obligations of the property owner insofar as it confirms that ownership can be regulated by the state in the public interest. Section 25(1) also sets requirements for the interference with property rights and, in so doing, recognises that the social obligations of the property owner are not without boundaries. In its landmark FNB decision the Constitutional Court gave content and structure to a section 25(1) challenge. The Constitutional Court held that deprivations will be arbitrary for purposes of section 25(1) if the law of general application does not provide sufficient reason for the deprivation or is procedurally unfair. The Constitutional Court elaborated that ‘sufficient reason’ had to be determined with reference to eight contextual factors which reflect the complexity of the relationships involved in the dispute. With reference to section 25(1) and FNB this dissertation considers the constitutional implications of two types of statutory interference with the owner’s right to use, enjoy and exploit his property. Firstly, the dissertation considers the owner’s statutory duty in terms of the National Building Regulations and Building Standards Act 103 of 1977 to demolish unlawful and illegal building works in certain instances. Secondly, the dissertation considers the limitations imposed by the National Heritage Resources Act of 25 of 1999 and the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998 (PIE) on the owner’s right to demolish historic or unlawfully occupied structures. This dissertation argues that building and development controls, historic preservation laws and anti-eviction legislation are legitimate exercises of the state’s police power. Generally, these statutory interferences with ownership will not amount to unconstitutional deprivation of property. Nevertheless, there are instances where regulatory laws cannot be applied inflexibly if doing so results in excessive interferences with property rights. The FNB substantive arbitrariness test indicates when the law imposes disproportionate burdens on land owners. Furthermore, the non-arbitrariness tests shows when it might be necessary to mitigate disproportionate burdens, imposed in terms of otherwise legitimate regulatory laws, by way of German-style equalisation measures, which are comparable to the constitutional damages granted by South African courts. This dissertation concludes that in the past century the South African legal system has progressed from the apartheid regime, which protected the rights and interests of the white minority, to a constitutional regime which safeguards the rights of all South Africans. There are two legal developments that may lead to positive change in the next century, namely active pursuance of the notion that ownership consists of rights and duties and the development of equalisation-style measures, incorporated into legislation, to alleviate excessive burdens imposed on property owners in the public interest.
AFRIKAANSE OPSOMMING: Eiendomsreg, veral eiendomsreg op grond, bestaan uit regte sowel as pligte. Die sosiale verantwoordelikhede van die eienaar word bepaal deur die heersende behoeftes van die publiek (soos in wetgewing beliggaam) en is onderhewig aan verandering. Artikel 25(1) van die Grondwet erken implisiet die sosiale verpligtinge van die eienaar in soverre dit bevestig dat eiendomsreg nie ʼn absolute reg is nie en dat dit deur die staat in die openbare belang gereguleer kan word. Artikel 25(1) koppel vereistes aan statutêre beperkings wat op die eienaar se regte geplaas kan word en erken daardeur dat die sosiale pligte van die eienaar nie onbegrens is nie. In die invloedryke FNB-beslissing het die Grondwethof inhoud en struktuur aan grondwetlike analise ingevolge artikel 25(1) gegee. Met verwysing na artikel 25(1) en FNB oorweeg hierdie proefskrif die grondwetlike implikasies van twee tipes statutêre beperkinge wat deur wetgewing op eienaars se regte geplaas word. Die proefskrif betoog dat bou- en ontwikkelingsbeheermaatreëls, historiese bewaringswette en uitsettingsvoorkomingswetgewing legitieme uitoefening van die staat se polisiëringsmag is. In die algemeen sal hierdie statutêre inmenging nie uitloop op ongrondwetlike ontneming van eiendom nie. Nietemin is daar gevalle waar die regulerende wette nie onbuigsaam toegepas kan word nie indien dit tot uitermatige inmenging met die eienaar se regte lei. Die FNB-toets vir substantiewe arbitrêre ontneming dui aan wanneer ‘n wet ʼn disproporsionele las op grondeienaars plaas. Verder wys die FNB-toets wanneer dit nodig mag wees om oneweredige laste, wat deur andersins regmatige regulerende wette opgelê is, te versag. Dit kan gedoen word deur middel van ʼn statutêre maatreël, geskoei op Duitse voorbeeld, wat vergelykbaar is met grondwetlike skadevergoeding wat deur Suid-Afrikaanse howe toegeken is. Hierdie proefskrif kom tot die gevolgtrekking dat die Suid-Afrikaanse regstelsel oor die afgelope eeu ontwikkel het van die apartheidsbestel, wat die regte en belange van die wit minderheid beskerm het, tot die huidige grondwetlike bestel wat die regte van alle Suid-Afrikaners beskerm. The Luther College Concert Band has enjoyed nearly 150 years of success. International tours, regional tours, concerts, service to the college and recording projects aided the success of this small college band that retained its Lutheran, liberal arts identity. Published documents exist about the Luther College band before 1948 but no comprehensive published documents are available after that time. This essay provides a more complete history of the band since 1948 based upon archival research and interviews with Weston Noble, Fredrick Nyline and Joan deAlbuquerque. The Concert Band started as a student led activity, which set it apart from other university bands of the late nineteenth century that had military connections. The Luther band eventually became an academic area of study and performed solely for campus concerts and on tours. The band took tours to Norway and Europe long before most college bands had touring programs. Later the band toured to Japan, China and Europe and continued regional tours throughout the United States. The Concert Band conductors, particularly the tenures of Carlo Sperati, Weston Noble, Frederick Nyline and Joan deAlbuquerque, helped shape the band program and music department at Luther College. This is a study of their educational philosophies that shaped the band, and the support the program received from the college administration, students and alumni. Also included is information about the Dorian Band Festival hosted by Luther College, works commissioned by the band, a review of works programed by conductors, a listing of recordings by the Luther College Concert Band and biographical information about each conductor.

The current study seeks not only to place into focus the general patterns of social and economic organization prevalent in Colombia in the late nineteenth century and the early twentieth (such political and economic organization has been ably illustrated by several authors), but also strives to elucidate the systems of thought or 'ideologies' to which such socio-economic and political structures gave rise. It is concerned with the thought-systems that influenced the development of the Colombian labor movement, those of actors external to organized labor and indigenous systems of thought of labor activists themselves. The hypothesis is that class and party-based interests channelled the early development of organized labor toward a path that would further, or failing that, not conflict with dominant elite interests. Artisans, proudly independent, exerted inordinate influence over the movement, hindering the development of working class consciousness. As the result of dominance by élites external to the labor movement itself, workers were never able to forge an independent voice that would allow them to define their own interests in society.

O estilo literário que ficou conhecido internacionalmente como Realismo Mágico tem na laureada obra de Gabriel García Márquez, Cem Anos de Solidão, uma de suas maiores inspirações. O Boom latino-americano, movimento que impulsionou o reconhecimento original da produção literária na América Latina nas décadas de 1960 e 1970 terminou por acender um debate em escala planetária em torno da existência de uma realidade mítica e mágica que ultrapassa as estreitas concepções de realidade do Ocidente. Junto a este reconhecimento, a visão em torno de Cem Anos de Solidão passou a ser associada a uma representação metafórica da cultura e história da Colômbia e América Latina. Esta dissertação pretende problematizar o vínculo imediatamente assumido entre o nacional e o inter-nacional através deste símbolo literário do século XX. Assim, buscar-se-á uma intercessão teórica entre literatura, modernidade e póscolonialidade. Através da enunciação de Gabriel García Márquez o objetivo será interpelar os valores normativos de autoridade e de significação que são ao mesmo tempo assumidas e produzidas pelas teorias de modernização e de resquícios eurocêntricos, mormente a epistemologia das Relações Internacionais. Para esta finalidade, a compreensão de uma espaçotemporalidade disjuntiva e de uma poética da solidão pretendem deslocar as fronteiras que separam a mágica do real.
The international literary genre better known as Magical Realism had on Gabriel García Márquez’s laureate book One Hundred Years of Solitude one of its major inspirations. The movement of Boom boosted the original recognition of Latin American’s authors during the 1960s and 1970s sparking a world-scale debate about the existence of whether or not a mythical or legendary reality goes beyond the strict reality of West. Aside this acknowledgment, the view around One Hundred Years of Solitude became affiliated to a metaphorical representation of Colombia and Latin American culture and history. This dissertation intends to question the link between nation and inter-national through this literary symbol of twentieth century. Therefore, an intersection will be made between literature, modernity and post-coloniality. With Gabriel García Márquez’s local utterances my aim is to question the normalized values of authority and signification easily assumed and simultaneously produced by modernization theory and Eurocentric remnants, mainly International Relations epistemology. To this purpose I take an out of joint account of time and space allied with a poetics of solitude to enable a displacement of the boundaries that split the magical and the real.

The realities of the built past and the palimpsest-ic nature of activities on the African mining landscape is under critique. On a site where nature gives way to the man-made activity of platinum ore excavation and mineral extraction, the activity of mining essentially creates infrastructures of dust and filthy landscapes. Inserting a new architecture within this obliterated savannah landscape allows for a process of reclamation to take place. This project uses an abandoned mine site in Southern Africa and focuses on the environmental mitigation and civic development of the site adjacent to the existing mining town of 40,000 inhabitants. The derelict mineshafts serve as infrastructure for a new civic space of scenic agrarian routes and programmed enclosures: auction floors, warehouses, residential short-stay rooms, water purification systems, mineral baths, crop rotational schemes, research labs and a museum space.

The purpose of this thesis is to examine the coexistence of time in Gabriel Garcfa Marquez's One Hundred Years of Solitude as a cause of the supernatural events, the hereditary memory, and the solitude and to examine the effects of this mythical time frame on character development, plot, narrative structure, and theme. The thesis is divided into five chapters. The first chapter introduces the parchments as creators of mythical time. The second, third, and fourth chapters investigate the effects of this unconventional time. Supernatural events, clairvoyance, and solitude are all examined as effects. The final chapter correlates the writing of the parchments with the writing of the novel and explains the effects of unconventional time on the reader. Thus, this thesis illustrates how the coexistence of time functions of two levels: the level of the parchments and the level of the novel.

The study of employer associations in Australia has focused on the activities of state employers’ federations and peak employer organisations in the federal sphere and on the effect on those organisations of Australia’s compulsory conciliation and arbitration system. The majority of literature has continued to mainly focus on national employer associations and on their difficulties in achieving national unity due to the differing views of their State branches. Despite their historic relevance, state employer associations that were established during the colonial era have been virtually ignored. Whilst single industry associations at the state level have also had to come to terms with the demands of Australia’s dual industrial relations systems, the role of the state systems and of the state-based employer associations appear to have attracted comparatively little academic interest. The effect on employer associations of the character and status of those who direct and influence their operations has received little, if any, analysis. Leading builders who were the major contractors of their time established the Master Builders Association of NSW (MBA/NSW) during the colonial era, and those that led the association throughout the turmoil of the 1890s, a major depression and two world wars continued to be the leading builders in the State of New South Wales. Following the Second World War, the character of the MBA/NSW changed with the absorption of suburban associations that comprised small to medium-sized builders. That development was compounded by the changes in the size, height and complexity of buildings within the Central Business District of Sydney and in other centres throughout the metropolitan area. Enormous capital was required to fund construction works and large corporations were formed and the bench-mark of what constituted a major contractor was raised considerably. Those events had an enormous impact on the character and operations of the MBA/NSW. This historical thesis seeks to explain why the MBA/NSW was successfully established in 1873 after two previous attempts; and, what accounts for its subsequent survival and growth. It analyses the various challenges that faced the MBA/NSW during its first one hundred years and the effect on that association of the policies and practices of iii architects, governments, trade unions and other employer associations. It traces the 1890 establishment of the Master Builders Federation of Australia (MBFA), the oldest federal industry association in Australia, by the MBA/NSW and its sister associations from other areas of Australia and analyses the manner in which the State-based Master Builders Associations each fought to retain their individual independence and reject any attempts to cede their powers so as to convert their federation into a national centralised body. The need for quick national responses of major building companies during the 1970s was addressed through a composite organization created by the Master Builder movement and the Australian Federation of Construction Contractors due to the continued refusal of the Master Builders associations to cede their powers to MBFA. The development of the trade union movement in the building industry in New South Wales is also analysed together with reference to the history of building industry awards in this State. The study also outlines the history of MBA/NSW initiatives and policies related to tendering and industrial relations which came under increasing pressure due to legal challenges from disciplined members and to changes arising from industrial and trade practices legislation. The practice of convening tender meetings, the introduction of Builders Licensing in New South Wales and, the origins of the MBA/NSW Group Apprenticeship Scheme are each described.

In 1815 the Blue Mountains were first identified as a unique landscape when Governor Macquarie took a tour over them and located the nineteenth century principles of the Sublime and Picturesque within its' landscape. Until this time the Blue Mountains were considered to be a hostile impenetrable barrier to the West. This paper examines some of the ways the Blue Mountains has been represented in the past, and has been identified as a tourist destination through interpretations imposed on the landscape by the tourist industry since that time. The areas covered deal with the heritage of British Colonialism as a way of forming opinions about the Australian landscape. Then, the theories of the Picturesque and Sublime are examined when applied to the Blue Mountains landscape. The final chapters in this paper deal with contemporary issues that have shaped the way the tourist industry is encouraged to encounter the Blue Mountains landscape

This thesis explores the textualizing of the South Atlantic island of St Helena (a British Overseas Territory) through an analysis of the relationship between colonizing practices and the changing representations of the island and its inhabitants in a range of colonial 'texts', including historiography, travel writing, government papers, creative writing, and the fine arts. Part I situates this thesis within a critical engagement with post-colonial theory and colonial discourse analysis primarily, as well as with the recent 'linguistic turn' in anthropology and history. In place of post-colonialism's rather monolithic approach to colonial experiences, I argue for a localised approach to colonisation, which takes greater account of colonial praxis and of the continuous re-negotiation and re-constitution of particular colonial situations. Part II focuses on a number of literary issues by reviewing St Helena's historiography and literature, and by investigating the range of narrative tropes employed (largely by travellers) in the textualizing of St Helena, in particular with respect to recurrent imaginings of the island in terms of an earthly Eden. Part III examines the nature of colonial 'possession' by tracing the island's gradual appropriation by the Portuguese, Dutch and English in the sixteenth and early seventeenth century and the settlement policies pursued by the English East India Company in the late seventeenth and early eighteenth century. Part IV provides an account of the changing perceptions, by visitors and colonial officials alike, of the character of the island's inhabitants (from the late eighteenth to the early twentieth century) and assesses the influence that these perceptions have had on the administration of the island and the political status of its inhabitants (in the mid- to late twentieth century). Part V, the conclusion, reviews the principal arguments of my thesis by addressing the political implications of post-colonial theory and of my own research, while also indicating avenues for further research. A localised and detailed exploration of colonial discourse over a period of nearly five hundred years, and a close analysis of a consequently wide range of colonial 'texts', has confirmed that although colonising practices and representations are far from monolithic, in the case of St Helena their continuities are of as much significance as their discontinuities.

If the issue of prisoners of war has given rise to numerous studies in recent years, nevertheless, this topic is far from exhausted. Built on a large corpus of archival sources, this study fuels the debate on ransoms and prisoners with new material. Its originality lies in its broad chronological framework, i.e. the duration of the Hundred Years War, as well as its perspective – that of lower ranking as well as higher-ranking prisoners on both side of the Channel. What does it mean for those men to live in the once coined ‘golden age of private ransoms’? My investigations hinge around three different themes: the status of prisoners of war, the ransoming process and the networks of assistance. I argue that the widespread practice of ransoming becomes increasingly systematic in the late Middle Ages. More importantly, I show how this evolution comes ‘from below’; from the individual masters and prisoners who faced the multiple obstacles raised by the lack of official structure. Indeed, the ransoming of prisoners remained the preserve of private individuals throughout the war and no sovereign could afford that this became otherwise. It is specifically the non-interventionism of the crown and the large freedom of action of individuals which shaped the ransom system.

The geographical landscape has always been attractive to everyone because there you can express the human curiosity to know the surrounding world. The ways to present or to describe these landscapes fill the literature books and, in the Peruvian case, there are the works of all writers to a major or minor degree. Thus, at the beginning of the 20th century it is notable the figure of the historian José de la Riva-Agüero y Osma, himself an aristocrat from Lima who made an heroic travel from Cusco to Ocopa, Huancayo, at a time when there were not roads, making the trip on mule back. Here we present a brief description of an experience made in October, 2012, where we look to capture some of Riva-Agüero’s impressions that could have marked his vision about the life conditions of the high mountain people of the Andes, which may have changed his political view of them.
El paisaje geográfico ha sido siempre el atractivo de todo ser humano porque allí se expresa la curiosidad de conocer el mundo que nos rodea. Las formas de presentar o describir estos paisajes llenan los libros de literatura y en el caso peruano están los trabajos de todos los escritores en mayor o menor grado. Así, a comienzos del siglo XX destaca la figura del historiador José de la Riva-Agüero y Osma, un aristócrata limeño que realizó un viaje heroico para la época en que no habían carreteras y cubrió a lomo de bestia el trecho entre Cusco y Ocopa, en el valle del Mantaro. In 1815 the Blue Mountains were first identified as a unique landscape when Governor Macquarie took a tour over them and located the nineteenth century principles of the Sublime and Picturesque within its' landscape. Until this time the Blue Mountains were considered to be a hostile impenetrable barrier to the West. This paper examines some of the ways the Blue Mountains has been represented in the past, and has been identified as a tourist destination through interpretations imposed on the landscape by the tourist industry since that time. The areas covered deal with the heritage of British Colonialism as a way of forming opinions about the Australian landscape. Then, the theories of the Picturesque and Sublime are examined when applied to the Blue Mountains landscape. The final chapters in this paper deal with contemporary issues that have shaped the way the tourist industry is encouraged to encounter the Blue Mountains landscape

As part of a public archaeological project in the Chancay district, archaeological excavations were carried out in an area of four hectares on the slopes of the Cerro Trinidad site. e preliminary results showed that under the modern harbor of Chancay there is a thick archaeological occupation which could have been a ceremonial urban center between the Formative Period (White on Red style) until the Period I of the Regional Developments (Playa Grande style). Based on an aerial photograph analysis it was possible to determine the total extend of the Cerro Trinidad site as well as the previous excavations done by Max Uhle and Gordon R. Willey. Similarly, it was posible to locate an un-known archaeological site located on the Chancay Bay.
Con motivo de un trabajo de evaluación arqueológica en el distrito Chancay, se realizaron excavaciones arqueológicas de sondeo en un área aproximada de cuatro hectáreas en las faldas del cerro Trinidad, valle de Chancay. Estas excavaciones hallaron que debajo del actual puerto de Chancay se conservan evidencias arqueológicas de importancia, que muestran la verdadera dimensión y magnitud del sitio arqueológico de Cerro Trinidad constituyéndose en un centro urbano ceremonial de regulares dimensiones e importancia desde el Periodo Formativo Superior (estilo Blanco sobre Rojo), hasta el I Periodo de los Desarrollos Regionales (estilo Playa Grande). Esta información se contrastó con una fotografía aérea de 1943, cuando el asentamiento prehispánico no estaba cubierto por la ocupación actual. Con esto se obtuvo información importante como la localización de las excavaciones previamente efectuadas por Max Uhle y Gordon Willey, así como los contextos que ellos registraron. Del mismo modo, se ha registrado un tipo de asentamiento no denido hasta el momento, localizado en la misma bahía de Chancay.

The subject of this dissertation is the negotiation of gender relations and ideologies in the matrilineal communities of Mgeta Division in the Uluguru Mountains of Tanzania. The dissertation revisits social theories that emphasize the importance of hierarchical binaries such as public/private, and production/reproduction in understanding social inequities. The analysis reworks these theories by focusing on the active construction (and dismantling) of these separate spheres. Through an understanding of the multiple, conflicting and intersecting relations of space, work and gender, the research will describe the active negotiations over the division of labor. Of particular interest is the construction of a "rational masculinity," expressed in development discourse as the wisdom, organization and planning necessary to success in "modern," capitalist agriculture. The study highlights the interconnections between this discourse and rural social histories and conflicts, including the creation of a local elite of farming and business leaders, the organization of state power and relations of rule, and shifts in the meanings and relations of kinship. This dissertation also describes a counter-hegemonic gender discourse in Mgeta that is based in the symbolic and material interdependence between husbands and wives. Ideals of reciprocity and interdependence are invoked through the spatial organization of work and other daily activities, challenging, but at the same time circumscribed by, class and gender hierarchies. In this dialogue between the global and the local, gender ideologies are analyzed not as just an effect or by-product of capitalism, but as a central aspect of the meaningful context in which action takes place (Roseberry 1991:42). In Mgeta there is no single gender ideology following from the single determining force of capitalist agriculture. Instead there are multiple and shifting ideologies that express and shape a whole range of social processes. Here I try to examine some of the intersections and conflicts and the different ways in which the farmers of Mgeta create common sensibilities about self, place and history.

This thesis takes a new approach to the study of the genesis of the lexically-French based Cayenne Creole, which emerged in French Guiana around the beginning of the eighteenth century. The study begins with an an overview of theories of creole genesis that describes the various schools of thought, notably the diffusionist, superstratist, substratist and universalist positions. Part 2 of the thesis examines the social history of Cayenne from 1650 to 1750. It provides information about the various early settlements of Cayenne Island, particularly the Dutch and Portugese Jewish establishment from 1654 to 1664 that saw the beginning of large-scale African enslavement in the colony. The development of the slave community in the context of the French colony is examined in detail, particularly with respect to the conditions of the slaves and their origins. Part 3 deals with the demography of Cayenne from 1650 to 1750. It features a detailed analysis of colonial censuses during this time, and looks at the 1690 slave list of Goupy des Marets in great detail. The origin of the slave ships to Cayenne is also discussed. Finally, Part 4 draws on the information provided in the social history and demography to suggest a model for the genesis of Cayenne Creole. The validity of this model will be tested in future linguistic studies of Cayenne Creole.

Motivated by the lack of scholarship surrounding female characters in Gabriel Garcia Marquez's One Hundred Years of Solitude, I sought to examine the distinct identities of four female characters. The collapse of dualities and embodiment of hybridity in Ursula, Pilar Ternera, Amaranta, and the Remedios women reveals the hegemonic power structures that are disrupted by these empowered women. The exploration of these women and their relationships to gendered dichotomies points to the potential of their identities in enacting colonial resistance and reclaiming traditional cultural heritage.

This thesis analyses the meaning of unity and unification in post-war Italian life through a transnational study of the two great events staged for the celebration of one hundred years of Italian unification: Italia '61 and the Festival of Italy. Held in Turin, Italia '61 was the Italian national celebration and the overall purpose was to put on display the 'progress made in Italy in 100 years of national life' and to make a statement about Italy's place in the Cold War world order. To do so it comprised three major components: a Historical Exhibition, which traced a history of unification focused on the Risorgimento and the Resistance; a Regional Exhibition; and the International Labour Exhibition, which contained displays on work practices and conditions from twenty-one nations and international organisations. Across the Atlantic in Philadelphia, the Festival of Italy was the largest Italian centennial commemoration held outside Italy and it had been planned in conjunction with the Italia '61 organisers and collaboratively with the Italian American community in Philadelphia. The Festival's theme was 'lOO years of Progress' and the corresponding exhibitions and events emphasised the cultural richness of Italy, the high culture of Italy, the contribution of Italy and Italian culture and people to contemporary civilisation and in particular to the U.5., and the modernity of contemporary Italy. This thesis presents the argument that 1961 represents a change or turning point in the way identity was celebrated and so conceived in both Italy and among Italian American communities. The effects of the reconfiguration are identified through analysis of the national, international, intergovernmental, ethnic and transnational relationships in operation at Italia '61 and the Festival of Italy.

Environmental histories are multi-dimensional accounts of human interaction with the environment over time. They observe how and when the environment changes (material environmental histories), and the effects of human activities upon the environment (political environmental histories). Environmental histories also consider the thoughts and feelings that humans have had towards the environment (cultural/ intellectual environmental histories). Using the methodological framework of environmental history this research, located in sub-tropical northern Belize, brings together palaeoecological records (pollen and charcoal) with archival documentary sources. This has created an interdisciplinary account which considers how the vegetation of northern Belize has changed over the last 3,500 years and, in particular, how forest resources have been used during the British Colonial period (c. AD 1800 – 1950). The palaeoecological records are derived from lake sediment cores extracted from the New River Lagoon, adjacent to the archaeological site of Lamanai. For over 3,000 years Lamanai was a Maya settlement, and then, more recently, the site of two 16th century Spanish churches and a 19th century British sugar mill. The British archival records emanate from a wide variety of sources including: 19th century import and export records, 19th century missionary letters and 19th and 20th century meteorological records and newspaper articles. The integration of these two types of record has established a temporal range of 1500 BC to the present. The palaeoecological proxies provide a low resolution record over a period of 3,500 years (c. 1500 BC – AD 2010) whereas the archival record provides annual resolution over a period of approximately 150 years (c. AD 1800 – 1950). This research also uses documentary sources to reconstruct temperature and precipitation for Belize City during the period 1865 – 2010, which is the first of its kind from Belize, and the oldest continuous record from Central America. It also provides the meteorological context for further exploration into British colonial interaction with ‘tropical’ climates. Perhaps because of its status as Britain’s only Central American colonial outpost, Belize has remained on the periphery of research concerning European interactions with tropical climates. This environmental history draws together a new account of health, place and space in the 19th century colonial tropics, drawing out how different understandings of the aetiologies and transmission of disease developed, in particular yellow fever. These different research strands are brought together to create an account that considers material, political and cultural aspects of environmental history. This has enabled the identification of eight phases of human interaction with the landscape at Lamanai, which are broadly indicative of general trends across northern Belize. These include the establishment of Maya field-based agriculture c. 1600 BC and a later phase of substantial Maya construction and site development c. 170 BC – AD 150. A period of active Maya management of forest, field, savanna and palm resources is also observed c. AD 500 – 1000. Polarised imaginings of the Maya as both destroyers and protectors of the tropical forest are challenged. Spanish interaction with the landscape is evident during c. AD 1500 – 1700 and this is followed by a period of substantial British colonial exploitation of timber resources, with logwood extracted c. AD 1660 – 1910 and mahogany extracted c. AD 1750 – 1945. These periods of extraction were only identifiable in the pollen record by combing the chronology from the documentary record with observed changes in the vegetation record and this demonstrates how these two contrasting methodologies can be usefully integrated. This environmental history rejects the binary opposition of benign, passive Maya landscapes and the violent, devastated European colonial landscape (Denevan, 1992). Analysis of the pollen and documentary records reveal that biodiversity is at the highest levels post AD 1950, which suggests that the forest can regrow even after multiple, diverse and prolonged periods of anthropogenic use in a matter of decades.

This dissertation offers a study of the fifteenth century French polemical treatises written by authors such as Jean de Montreuil, Jean Juvénal des Ursins, Noël de Fribois and Robert Blondel, together with an edition of perhaps the most important of these works, Pour ce que plusieurs (1464). This treatise may have been written by Guillaume Cousinot II, who had been personally involved in the events surrounding the attack upon Fougères in 1449, a subject addressed in highly partial terms by this text; moreover, Cousinot had visited the Lancastrians in exile in Scotland, which might explain how Sir John Fortescue was able to learn of Jean Juvénal's Tres crestien, tres hault, tres puissant roy (1446), and how Pource que plusieurs in turn drew upon the pamphlets of Fortescue. The polemical texts went beyond moral and chivalric discussion of the war, to address the complex legal and historical issues underpinning the conflict. In response to the English claim to the French throne, Jean de Montreuil adopted the Salic Law, a highly dubious and problematic authority, but one that achieved great fame particularly through the influence of Pour ce que plusieurs. Similarly, the polemical writers rejected English demands for Aquitaine and Normandy in full sovereignty by arguing that no French king could alienate the sovereign rights of the crown. In the sixteenth century, both of these principles were elevated to the status of Fundamental Laws. These texts were not intended to serve as propaganda, but were generally produced by royal officials to serve as manuals for their fellow administrators and diplomats, and perhaps also for the king and other members of the court involved in negotiations with the English. Only in exceptional circumstances were such works disseminated beyond the narrow circles of the government and court, though royal officials did draw upon them when speaking at public assemblies.
