Abstract: The general report highlights the replies given to nine questions, by scholars from different legal systems. The problem of the fragmentation of international sources of law has been widely considered in the literature. It affects also the private law field. Judges and practitioners dealing with cross-border cases have to districate themselves between local rules on conflict of laws, international treaties on the law applicable to transnational relationships, conventions providing uniform material rules, and collections of principles by non-governmental organizations. The enquiry showed that the concern about the difficulty of districating this complex network of rules is mainly shown by academics. The supporting role of the executive (providing information about international obligations) is not everywhere reliable. Judges sometimes receive special training to tackle the increasing complexity of transnational law, but mostly in connection with EU law. The benefit that might be attached to a courts' specialization (in international commercial matters) is not as higly valued as to be implemented everywhere; the attitude of administrative, commercial, criminal courts is not perceived as highly diversified. In some countries the courts do adopt strategies to elude the difficulty (by a presumption of identity of the foreign sources with the local ones, by attaching a waiver of their rights to the parties' omission to plead the foreign law immediately, etc.). No definite suggestions on how to increase the awareness about the problem and how to face it seem easily available. Résumé: Le rapport général commente les réponses données par les rapporteurs nationaux à neuf questions concernant la complexité des sources transnationales. Le problème de la fragmentation des sources internationales du droit est discutée depuis de nombreuses années dans la littérature juridique: elle concerne aussi le droit privé. Les juges, les avocats, les praticiens du droit confrontés à des questions qui dépassent les frontières nationales doivent se débattre parmi les règles nationales de droit international privé, les traités internationaux concernant les conflits de lois, les conventions qui règlent de façon uniforme les rapports transnationaux, les innombrables principes issus d'organisations non gouvernementales. Les études entreprises dans ce secteur indiquent que le souci concernant la difficulté à s'orienter parmi cet ensemble inextricable de règles est exprimé principalement par le monde académique, tandis que le pouvoir exécutif (chargé d'informer les juristes sur les obligations internationals de l'Etat) ne joue pas toujours efficacement son rôle de support; une formation spéciale est offerte aux juges, mais surtout pour le droit de l'Union Européenne; l'avantage qui pourrait dériver d'une spécialisation des cours (en droit du commerce international) n'est pas considéré partout comme une nécessité; le comportement des tribunaux administratifs, criminels, commerciaux n'est pas perçu comme très différencié selon le sujet des sources transnationales. Les juges de certains pays mettent en oeuvre des stratégies pour contourner ces difficultés (en faisant recours à une presumption d'identité entre le droit étranger et le droit national, en présumant une renonciation à l'application du droit extra-national si les parties n'ont pas soulevé la question dès le début du procès, etc.). Il n'est pas aisé de formuler des suggestions sur la façon dont on pourrait augmenter la perception du problème ni sur la manière par laquelle on pourrait faire face à cette complexité croissante.

The acoustic far-field prediction of high-fidelity aerodynamic simulation data is still not accurately possible when accounting for the surface reflections from an aircraft’s fuselage or wings. By presenting a general method for order-reduced equivalent source modeling of aeroacoustic sound sources, this work is bridging the gap between high-fidelity aerodynamic simulations and its integration to auralization frameworks. At the example of a numerically simulated jet, this study shows the computation of an equivalent source model with minimal complexity by means of spherical harmonic (SH) coefficients. The minimal source extension, in which all acoustic sources of a flow field are confined, is computed by using spherical Hankel extrapolation of sound pressure data from virtual concentric microphone arrays. The result of the SH transform shows that the dominant energy contribution can be associated to nine elementary sound sources. The resulting equivalent source model of jet noise provides a convenient date interface between large-scale computational fluid dynamics and acoustics simulations.

We introduce the problem of variable-length (VL) source resolvability, in which a given target probability distribution is approximated by encoding a VL uniform random number, and the asymptotically minimum average length rate of the uniform random number, called the VL resolvability, is investigated. We first analyze the VL resolvability with the variational distance as an approximation measure. Next, we investigate the case under the divergence as an approximation measure. When the asymptotically exact approximation is required, it is shown that the resolvability under two kinds of approximation measures coincides. We then extend the analysis to the case of channel resolvability, where the target distribution is the output distribution via a general channel due to a fixed general source as an input. The obtained characterization of channel resolvability is fully general in the sense that, when the channel is just an identity mapping, it reduces to general formulas for source resolvability. We also analyze the second-order VL resolvability.

Abstract Numerous studies have dealt with the coding of information sources within and across languages. These studies have shown that despite the significant differences in the number of formally distinct evidentiality categories, languages tend to have grammaticalized markers for certain information sources, but not for others; different kinds of sensory perception, inference, assumption and hearsay evidence are among those information sources that receive explicit coding. In this paper, another evidence type, namely general knowledge, will be examined. It will be shown that general knowledge differs from other information sources in its nature, but it also has features in common with them. In addition, a formal-functional typology of general knowledge coding will be proposed based on the nature of the element used for this purpose. Finally, the rationale behind the discussed types and the central theoretical implications of the paper will be discussed. The attested types either stress the peculiar nature of general knowledge providing evidence for its independent information source status, or they emphasize the common features shared by general knowledge and other information sources, most notably reliability of information.

This paper explores the primary causes or factors underlying cultural conflict in all its forms and seeks to answer the questions that follow. Why do people hate and wage wars against each other in the name of culture? Are cultural wars necessary or inherent in the very nature of culture as a phenomenon of human life? Can cultural differences be a justifiable cause of war? In my attempt to explicate and answer these questions, I shall first advance a concept of culture. What do we mean when we speak of culture? What is the essential structure or building blocks of culture as a human phenomenon? The proposition I shall defend is that the tendency of animosity, tension, and conflict among people is not and cannot be inherent in their cultures. Accordingly, any claim that cultural difference is directly or indirectly a cause of cultural violence is not tenable, even though such violence may take place in the name of culture or cultural allegiance. But, if the tendency towards animosity, tension, or conflict is not inherent in the essential structure of culture, what might be the roots of the so-called cultural wars? The thesis I advance and elucidate in detail is that an answer to this question should proceed from an analysis of Socrates’s dictum that ignorance is the source of human evil. A discussion of this dictum and its implications, in the process of examining the roots of cultural wars, will reveal that the real culprits behind cultural conflicts are a cluster of political, intellectual, economic, psychological, and educational factors.

Résumé :
В статье анализируется очередной сборник проекта «Музеи – библиотеки – архивы в информационном обеспечении исторической науки». Дается характеристика ключевых проблем выявления, сохранения и изучения изобразительных источников, которые отражены в статьях представителей научного сообщества, работников высшей школы, архивов, музеев, библиотек. Рассмотренное издание представляется очень актуальным и отвечает необходимости непрерывного обмена опытом между специалистами из разных регионов и научных институций. Материалы опубликованных статей показали, что изобразительные материалы несут важную источниковую нагрузку для развития ключевых направлений мировой историографии. Вместе с этим многие авторы определили новые направления применения этого важного исторического источника. Помимо внимания к традиционной иллюстративной ретроспективе, сборник содержит авторское видение современной ситуации, в которой идет ускоренное приращение источниковой базы. Делается вывод о необходимости продолжения диалога ученых и специалистов в теоретическом и прикладном дискурсе. Выход данного сборника продемонстрировал, что, в целом, проект стал авторитетной площадкой серьезных академических дискуссий, выявления перспективных тем для изучения, а также апробации новых научно-исследовательских приемов и методов. The article analyzes the next collection of the project "Museums-libraries-archives in the information support of historical science". The article describes the key problems of identifying, preserving and studying visual sources, which are reflected in the articles of representatives of the scientific community, employees of higher schools, archives, museums, libraries. The reviewed publication seems to be very relevant and meets the need for a continuous exchange of experience between specialists from different regions and scientific institutions. The materials of the published articles showed that visual materials carry an important source load for the development of key areas of world historiography. At the same time, many authors have identified new areas of application of this important historical source. In addition to paying attention to the traditional illustrative retrospective, the collection contains the author's vision of the current situation, in which there is an accelerated increment of the source base. It is concluded that it is necessary to continue the dialogue of scientists and specialists in theoretical and applied discourse. The publication of this collection demonstrated that, in general, the project has become an authoritative platform for serious academic discussions, identifying promising topics for study, as well as testing new research techniques and methods.

Most 2.5D controlled-source electromagnetic (CSEM) modeling algorithms presented to date explicitly consider only sources that are point dipoles oriented parallel or perpendicular to the direction of constant conductivity. This makes simulations of complex source geometries expensive, requiring separate evaluations of many point dipole fields, and thus limits the practical applicability of such schemes for simulating and interpreting field data. We present a novel 2.5D CSEM modeling scheme that overcomes this limitation and permits efficient simulations of sources with general shape and orientation by evaluating fields for the entire source at once. We accommodate general sources by using a secondary field approach, in which primary fields are computed for the general source and a 1D background conductivity model. To carry out the required Fourier transforms between space and wavenumber domain using the same fast cosine and sine transform filters as in conventional algorithms, we split the primary and secondary fields into their symmetric and antisymmetric parts. For complex 3D source geometries, this approach is significantly more efficient than previous 2.5D algorithms. Our finite-difference algorithm also includes novel approaches for divergence correction at low frequencies and EM field interpolation across conductivity discontinuities. We describe the modeling scheme and demonstrate its accuracy and efficiency by comparisons of 2.5D-simulated data with 1D and 3D results.
