Texte intégralIn the same way as the United States have tried to apply antitrust laws to Europe, the EC now wishes to apply this kind of legislation to companies outside the EC, using the criteria of jurisdictional competence in conformity with public international law.
Three successive theories have been put forward: The "Effect theory" which has been much debated on its concordance with international law. The theory of "Enterprise Unity" has the desadvantaye that it cannot be applied to all foreign undertakings. Finally, the Commission and the Court of Justice have recently relied on the theory of the "Location of Anticompetitive Conduct". This last theory stands as a compromise between the first two and has broader potential application.
As the competence of jurisdiction, the "enforcement jurisdiction over foreign undertakings is governed by international principles and is also constrained by blocking statutes. Nevertheless, the EC Commission knows how to make the most of its enforcement powers and most of the time, foreign companies submit to its decisions because the jurisdictional competence is well established.
International cooperation is developing progressively through formal and informal agreements but the diplomatic way to resolve international litigation remains predominant.

Texte intégralCette thèse se situe dans le cadre de ce programme de recherche. Parallèlement et plus largement, nous nous intéressons à la question de la reconstruction en sciences sociales. La reconstruction est un problème inverse comprenant deux volets complémentaires: (i) la déduction d'observations de haut-niveau à partir de phénomènes de bas-niveau; et (ii) la reproduction de l'évolution des observations de haut-niveau à partir de la dynamique des objets de bas-niveau.
Nous affirmons que plusieurs aspects significatifs de la structure d'une communauté de savoirs sont principalement produits par la dynamique d'un réseau épistémique où co-évoluent agents et concepts. En particulier, nous résolvons le premier volet du problème de la reconstruction en utilisant des treillis de Galois afin de recréer des taxonomies de communautés de savoirs à partir de simples relations entre agents et concepts; nous obtenons de fait une description historique se rapportant à la progression des champs, leur déclin, leur spécialisation ou leurs interactions (fusion ou scission). Nous micro-fondons ensuite la structure de ces communautés de savoirs en exhibant et en estimant empiriquement des processus d'interaction au niveau des agents, en co-évolution avec les concepts au sein du réseau épistémique, qui rendent compte de la morphogenèse et de l'émergence de plusieurs faits stylisés structurels de haut-niveau - il s'agit là du deuxième volet.
Nous défendons finalement un point de vue épistémologique concernant la méthodologique générale de reconstruction d'un système complexe qui appuie notre choix d'un cadre co-évolutionnaire.

Texte intégralThe science of evolution englobes two complementary scientific fields. First, there is the historical science that aims to reconstitute the history of life on earth. Then there is the ‘functional’ domain that aims to elucidate the mechanisms of evolution. The centrality of the concept of evolution in the life sciences makes it an indispensable subject in the school curriculum and its importance is underlined in all the official texts concerning the life sciences in French secondary education. Nevertheless, numerous studies in the didactics of the life sciences have highlighted different problems with the teaching of evolution. We propose the hypothesis that certain of these problems are due, on one hand, to the lack of clarity in the philosophy of evolution in the official school program and, on the other hand, to teachers’ limited engagement with the philosophical issues in evolution when they teach the subject. The first part of this thesis offers a detailed philosophical analysis of the field of evolution in which we pay close attention to the philosophical conceptions of the researchers in different areas of the field. The analytical grid that we develop based on this research is then used to classify the institutional choice of programs as well as the concepts of teachers and their approach to teaching evolution. The examination of our results leads to the conclusion that the historical science and the associated philosophical concepts exercise an implicit influence on the teaching of evolution. This result explains certain tensions that exist in the teaching of evolution and allows us to engage a wider reflection on the need to integrate this kind of philosophical analysis into studies in science education
