This chapter discusses the key concepts within the EU legal order: supremacy, direct effect, indirect effect, and state liability. The doctrine of supremacy dictates that EU law takes precedence over conflicting provisions of national law. If a provision of EU law is directly effective, it gives rise to rights upon which individuals can rely directly in the national court. If an EU measure is not directly effective, a claimant may be able to rely on it through the application of indirect effect, which requires national law to be interpreted in accordance with relevant EU law. State liability gives rise to a right to damages where an individual has suffered loss because a Member State has failed to implement a directive or has committed other breaches of EU law.

This chapter describes the methods and critically reviews the alternatives to generic preference-based measures (GPBMs) of health. Although there is considerable evidence for the validity and responsiveness of GPBMs in many conditions, but despite this, in these conditions they are often not used in clinical trials. Furthermore, GPBMs have been shown to be insensitive for some conditions. One alternative is to map from other health or clinical measures on to one of the GPBMs. Another is to devise a more relevant condition-specific preference-based measure, or use a bespoke vignette (scenario) describing the impact of the condition. A variant of this approach would be to add extra dimensions to GPBMs in order to improve their relevance to some conditions. Finally, there has been a growing interest in the measurement of well-being to help extend the descriptive component beyond health and the values to better reflect experience rather than preferences.

This chapter reviews the main features of multidimensional indices of inequality and poverty. For each of these cases, the discussion is divided into two approaches: a direct approach, where desirable properties are specified and a measure of inequality or poverty obtained; and the inclusive measure of well-being approach, where an index of individual well-being is defined in a first step, and the measure of inequality or poverty obtained in a second step. The emphasis will be on the properties that different measures satisfy and on the main justifications put forward when properties disagree. A systematic comparison between indices, whenever appropriate, is presented. Several policy applications of the indices are also discussed.

The efficiencies syndrome is a phenomenon that causes people or equipment to work more than necessary. This syndrome is fueled by managerial and cultural factors. The desire to show that the resource is busy is a result of either taking a local perspective or using inappropriate measures. This leads to enhancing this syndrome. Using the utilization of operating rooms as a measure of performance amplifies this syndrome and is counterproductive because it promotes increased utilization as a percentage. The correct measure should be throughput, and it should be measured directly. Because this is a more difficult metric to ascertain, resolving the efficiencies syndrome often requires a major change in performance measures as well as a change in organizational thinking.

This chapter begins by describing and assessing trends in foreign direct investment (FDI) in 2012. It then turns to an understudied but increasing area of concern in investment policy—home country measures (HCMs), which influence and often direct investment flows to certain destinations. These measures have an effect on “competitive neutrality” by affecting companies' decisions about where to invest and even about whether to invest; some measures effectively subsidize outward foreign direct investment so long as it is directed in particular ways. The chapter provides a detailed survey of HCMs in the top ten developed countries and the top ten emerging markets, and an analysis of the potential effects of those measures on investment decisions and the policies that home countries seek to effectuate with the establishment of measures that encourage and direct investment.

Around the world, governments are starting to directly measure the subjective wellbeing of their citizens and to use it for policy evaluation and appraisal. What would happen if a country were to move from using GDP to using subjective wellbeing as the primary metric for measuring economic and societal progress? Would policy priorities change? Would we continue to care about economic growth? What role would different government institutions play in such a scenario? And, most importantly, how could this be implemented in daily practice, for example in policy evaluations and appraisals of government analysts, or in political agenda-setting at the top level? This book provides answers to these questions from a conceptual to a technical level by showing how direct measures of subjective wellbeing can be used for policy evaluation and appraisal, either complementary in the short run or even entirely in the long run. It gives a brief history of the idea that governments should care about the happiness of their citizens, provides theories, makes suggestions for direct measurement, derives technical standards, shows how to conduct wellbeing cost-effectiveness and cost-benefit analyses, and gives examples of how real-world policy evaluations and appraisals would change if they were based on subjective wellbeing. In doing so, the book serves the growing interest of governments as well as non-governmental and international organizations in how to put subjective wellbeing metrics into policy practice.

This chapter describes the OSC measurement system. The OSC measure assesses culture, climate, and worker attitudes as the key components of OSC. Including multiple dimensions of culture and climate, the OSC measure provides a personality profile of organizations based on the responses of direct service providers within the work units that are assessed. Empirically derived, the dimensions and resulting measurement profiles allow users to assess the health of their organization’s social context using national norms for behavioral health and social service organizations. The authors explain the use of the OSC measure in their ARC organizational improvement process, and they integrate research and case examples to illustrate how the OSC measure can be applied for organizational assessment and change efforts. These efforts include using social context profiles to identify targets for change, action plans, and objectives to achieve within organizational development efforts.
