Abstract In questo scritto il problema del «free rider» viene presentato in relazione al concetto di beni pubblici, nell’ambito di una prospettiva di economia costituzionale.Si dimostra che il fenomeno del free rider non richiede la non escludibilità dal consume Il free riding è possibile, quindi, anche quando vige il principio di esclusione. Esso si ha, infatti, in tutti i casi in cui il comportamento non cooperativo non può essere oggetto di immediata sanzione.Il tema trattato costituisce un aspetto di una più ampia indagine su problemi di comportamenti cooperativi e non cooperativi all’interno di un’impostazione costituzionale. La tappa successiva dovrebbe approfondire la relazione tra l’ipotesi di free rider ed il cosiddetto problema «principale-agente».Infine, dopo aver esaminato il problema della cooperazione all’interno di una struttura di efficienza, l’analisi sarà estesa nella ancor più ampia area della cooperazione collettiva e della scelta tra criteri di equità e giustizia, affrontati nelle opere di scienza delle finanze e di etica.

La rianimazione moderna è una disciplina dalle prestazioni estremamente dispendiose ma poco “produttiva” in termini meramente economici: essa infatti offre benefici ad alto costo a pochi “utenti”. In un contesto generale di riduzione delle risorse destinabili alla sanità diviene cruciale, in un settore così particolare come quello dell’area critica, la riflessione etica in merito ai criteri per la microallocazione di risorse limitate.
In questo articolo, dopo aver affrontato natura e finalità dell’attività rianimatoria, vengono inizialmente prese in considerazione le possibili cause di una riduzione della disponibilità di posti letto in rianimazione, le modalità con cui abitualmente i medici affrontano le condizioni di ridotta disponibilità di risorse, e le linee guida per affrontare situazioni di triage.
Il processo decisionale nell’impiego delle risorse sanitarie deve partire da un rigoroso “criterio clinico” (necessità e idoneità alle cure rianimatorie, urgenza, ecc.), unitamene al criterio della proporzionalità dei mezzi terapeutici. Di fronte a situazioni di pari necessità possono essere seguiti il cosiddetto criterio di temporalità (offrire cure a chi è giunto per primo all’osservazione del medico) o il criterio prognostico (utilizzare le risorse disponibili per chi ha maggiori chance di trarne beneficio). I sistemi a punteggio impiegati in campo rianimatorio per predire l’outcome non sono attualmente utilizzabili nel processo decisionale per il singolo paziente e nelle procedure di triage.
Ribadendo che l’azione del medico, in tutti i suoi ambiti, deve essere eticamente pensata, si sottolinea come esista un dovere morale ad amministrare in modo corretto le risorse sanitarie, a limitare gli sprechi e a prevenire le situazioni di triage.

Scopo del presente contributo è delineare il perimetro entro il quale articolare una riflessione critica relativa alla questione della responsabilità giuridica connessa all’attività di Consulenza Etica in Ambito Sanitario (CEAS). Innanzitutto, saranno illustrate le ragioni per le quali ritenere che, al momento attuale, in Italia, la CEAS resa da un Consulente Etico singolo rappresenti il modello che meglio risponde all’esigenza di garantire un servizio di qualità ai pazienti e agli operatori sanitari. In secondo luogo, saranno analizzati gli elementi in base ai quali possa considerarsi ascrivibile in capo al Consulente Etico una responsabilità giuridica per violazione di una norma civile o penale. Infine, a partire dall’analisi dell’evoluzione giurisprudenziale e degli interventi legislativi di riforma in ambito sanitario, verrà avanzata una proposta in ordine alla disciplina applicabile all’operato del Consulente Etico in caso di danno procurato al paziente. Alla luce di quanto esposto, si tenterà di sostenere come il formale riconoscimento, anche giuridico, della figura del Consulente Etico possa risultare funzionale sia a dare contenuto all’effettivo ruolo svolto dal consulente nel processo di cura, sia a incentivare la stessa diffusione della cultura della CEAS, intesa come processo dialogico che ha lo scopo di contribuire al miglioramento dell’assistenza sanitaria mediante l’individuazione, l’analisi e la risoluzione dei dilemmi etici riconducibili alla pratica clinica.

This study aims to examine 1) The effect of education level on ethical dilemmas in accounting students at Padang State University, 2) The effect of cumulative achievement index on ethical dilemmas in accounting students at Padang State University, and 3) The influence of gender on ethical dilemmas in accounting students at Padang State University. This research is a type of causative research. This research uses a research instrument in the form of an ethical dilemma scenario with 213 respondents of accounting students. Data analysis techniques using the chi square test. The results of the study found that 1) The level of education was proven to have a significant positive effect on ethical dilemmas with the sig value of questions 1, questions 2, questions 3, and questions 4 in the ethical dilemma scenario of 0.028; 0.026; 0.003; 0.004 which is smaller than 0.05. 2) The cumulative achievement index is proven to have a significant positive effect on ethical dilemmas with a sig in question 1, question 2, question 3, and question 4 of 0.001; 0,001; 0,000; 0,000 <0.05. 3) Gender was not proven to have a significant positive effect on ethical dilemmas with the value of question 1, question 2, question 3, and question 4 in the ethical dilemma scenario of 0.234; 0.288; 0.510; 0.444> 0.05.

Internal factors play an important role in decision making, especially under conditions of a dilemma. Therefore, we examined the internal factors of individuals consisting of gender, age, and level of education in the deliberations and decision-making when faced with ethical dilemmas. This study used a survey by Aluchna & Mikolajczyk (2013) and Eweje & Brunon (2010) to collect data. 106 students who were respondents in this study were divided into 87 undergraduate students and 19 postgraduate students. Hypothesis testing used was nonparametric chi-square test to see the differences in the perception of respondents. As a result, women were more often indicate or face the ethical dilemma rather than in men. Age did not affect the attitude when it was faced with moral dilemmas for the development of the higher age of respondents, where it is not necessarily better than the moral development of the respondents with a younger age. There was no different in perception between age and level of education to ethical dilemmas. Practical contribution of this research was taken into consideration by the personnel manager when recruiting human resources and become knowledgeable in instilling ethics education from an early age, so that the moral development of the individual can arrive at the highest stage.

Abstract Mostly overtime, ethical-theological discussion is also influenced by dilemmatic situations that cause doubts in making choices. In fact, the starting point of ethics is to consider an issue and take a stand on it without compromise with any situation in between. In this situation, questions arise about whether ethics has carried out its implementative function appropriately? With the growing firmness to making a choice, ethical-theological responsibility now requires its implementation under direction. Christian theologians notices their respective perspectives on highlighting the context of the times that creates moral dilemmas. This research seeks to offer ethical decision concepts and models when dealing with a dilemma problem in order to reawaken the firmness in ethically responding to the challenges of the times. Abstrak Dekade ini, diskusi etika teologis turut dipengaruhi oleh situasi dilematis yang menyebabkan keraguan dalam menentukan pilihan. Padahal, titik tolak etika adalah mempertimbangkan sebuah persoalan dan mengambil sikap atasnya tanpa kompromi dengan situasi apa pun. Di dalam keadaan ini, muncullah pertanyaan-pertanyaan tentang apakah etika telah menjalankan fungsi implementatifnya dengan tepat? Dengan berkembangnya ketegasan untuk menentukan pilihan, tanggung jawab etis-teologis kini memerlukan arah implementatifnya. Para teolog etika Kristen memiliki perspektifnya masing-masing menyoroti konteks zaman yang menciptakan dilema moral. Penelitian ini berupaya menawarkan konsep dan model pilihan etis ketika berhadapan dengan sebuah persoalan dilematis guna menyadarkan kembali ketegasan dalam beretika merespons tantangan zaman.

Cedera Otak Traumatik (COT) merupakan penyebab utama kematian dan kesakitan pada anak-anak dan dewasa muda di seluruh dunia. Dilaporkan sebuah kasus COT pada seorang pasien anak laki-laki berusia 5 tahun yang jatuh dari lantai 2. Pasien didiagnosis dengan cedera kepala berat dengan perdarahan epidural dan subdural dengan level ASA 3–4. Dilema etis yang dihadapi ahli anestesi adalah tindakan anestesi berisiko tinggi tetapi kemungkinan penyelamatan nyawa tidak berhasil, sehingga apakah masih tetap dilakukan operasi atau hanya diberikan terapi suportif?. Laporan ini membahas tentang pemecahan dilema etik dan medikolegal berdasarkan teori etika klinik. Hasil pertimbangan etika dan medikolegal pada kasus ini dilakukan secara komprehensif dengan menghasilkan keputusan bersama antara tim dokter dengan keluarga pasien. Dengan pemberian informasi yang adekuat mengenai indikasi medik dengan tetap memperhatikan sudut pandang permintaan (keinginan) pasien, kualitas hidup maupun fitur kontekstual maka meskipun pada akhirnya pasien ini tidak berhasil diselamatkan, paling tidak keluarga pasien puas atas pelayanan yang telah diberikan. Clinical Ethics and Medicolegal Considerations for Anesthesia Management in Cases of Traumatic Brain InjuryAbstractTraumatic Brain Injury (COT) is a leading cause of death and illness in children and young adults throughout the world. A case of COT was reported in a 5-year-old boy who fell from the 2nd floor. The patient was diagnosed with a severe head injury with epidural and subdural bleeding with ASA levels 3-4. The ethical dilemma faced by the anesthesiologist is the high-risk anesthetic procedure but the possibility of life saving is unsuccessful, so whether the surgery is still being performed or only given supportive therapy?. This report discusses solving ethics and medicolegal dilemmas based on clinical ethics theory. The results of ethical and medicolegal considerations in this case were carried out comprehensively by producing a joint decision between the team of doctors and the patient's family. By providing adequate information regarding medical indications while still giving attention to the patients' preferences, quality of life and contextual features, even though these patients were ultimately unsuccessful, at least the patient's family was satisfied with the services provided.

Abstract—COVID-19 has induced a global health problem with the impact to different aspects of human life. If numbers of patients are increasing beyond the healthcare capacity, the constraint of resources will stimulate ethical dilemma. In hospitals, the availability of drug, hospital beds, trained health professionals, and personal protective equipment are not enough to response patients’ needs. To face this condition, health professionals and hospitals need ethical guidance to allocate resources. This article aims to discuss the guides that are available in the international literature and to recommend Advanced Care Planning as an additional measure to manage the scarcity or resources. The communal culture or Indonesia may contribute to the ethical challenges through the ‘in-group’ and ‘out-group’ phenomenon.

Abstrak—Pandemi COVID-19 telah menyebabkan masalah kesehatan global yang berdampak ke berbagai aspek kehidupan manusia. Jika angka penderita melebihi kapasitas sistem layanan kesehatan, terjadi keterbatasan sumber daya yang akan menimbulkan dilema etik. Di rumah sakit, ketersediaan obat, tempat tidur, tenaga kesehatan terlatih, alat pelindung diri tidak cukup untuk merespons kebutuhan pasien. Untuk menghadapi kondisi ini, tenaga kesehatan dan rumah sakit membutuhkan panduan etika untuk mengalokasikan sumber daya. Artikel ini bertujuan untuk mendiskusikan panduan-panduan yang ada di internasional serta mengusulkan Advanced Care Planning sebagai pendekatan tambahan dalam mengelola keterbatasan sumber daya. Budaya komunal di Indonesia dapat menambah tantangan etika di Indonesia melalui fenomena ‘dalam’ dan ‘luar’ kelompok.

L’etica in ambito infermieristico riveste da sempre grande importanza per la peculiare natura disciplinare dell’infermieristica. Proprio per questo l’etica viene variamente interpretata e trattata all’interno del sapere infermeiristico in relazione ai diversi approcci disciplinari ed interpretazioni da parte dei docenti. In questo lavoro non si intende disquisire sulle diverse correnti etiche oggi variamente presenti nella comunità scientifica, bensì fare una panoramica sulle diverse concezioni con le quali si interpreta l’etica in campo infermieristico. Fondamentalmente esse si possono ricondurre a tre filoni principali: l’etica come filosofia, l’etica come norma e l’etica come assistenza, quest’ultima a sua volta articolata in due oreintamenti, l’etica in relazione a “teorie e modelli infermiersitici” e l’etica del “prendersi cura”.
In realtà si evince che tutti gli orientamenti proposti hanno in sé dei limiti poiché sviluppare l’etica infermieristica secondo un orientamento significa tendere a sviluppare un atteggiamento categoriale, interpretato, con il rischio di non andare alla radice della questione etica nell’intento di riconoscere la peculiarità di ogni essere umano.
Si conclude affermando la ricchezza e l’importanza delle diverse concezioni etiche per la professione infermieristica ma non senza aver sviluppato gli elementi che costituiscono la base della fenomenologia etica e cioè la Legge Morale Naturale, la Coscienza e la Moralità.
Perché un infermiere possa esercitare con competenza la sua professione deve sviluppare gli elementi della moralità, in particolare la coscienza etica. Soltanto a queste condizioni egli potrà essere in grado di vivere pienamente la dimensione etica del suo servizio riconoscendo i problemi e dilemmi etici nella quotidianità del suo lavoro nel tentativo di rispondere secondo gli orientamenti che riterrà più conformi alla sua natura etica ma sempre nel rispetto della intrinseca “valorialità” della persona umana.

Oggetto della tesi è la dottrina morale elaborata dal filosofo canadese David Gauthier. La prima parte di essa ricostruisce in modo diacronico le due proposte normative avanzate dall'autore a partire dagli anni sessanta del novecento, afferenti l'una all'idea di mutuo rispetto, l'altra all'idea di mutuo vantaggio. La seconda parte sviluppa in modo critico ed analitico i temi centrali attorno a cui si focalizza l'attenzione dell'autore: la concezione della razionalità e delle preferenze; l'idea di giustizia e di reciprocità ; la concezione della persona e dei diritti individuali; il modello procedurale di riferimento. La terza ed ultima parte ha carattere comparativo: in primo luogo, si analizza la posizione meta-etica sostenuta da D. Gauthier alla luce dello scetticismo morale di J. L. Mackie; in secondo luogo, si discutono i rapporti di continuità e discontinuità della dottrina morale dell'autore in relazione alle tesi di J. Rawls e di J. Harsanyi.

La tesi affronta il delicato tema della fecondazione eterologa, il cui divieto è stato abrogato dalla Corte Costituzionale il 9 aprile 2014, attraverso un'analisi preliminare del percorso che ha portato alla sua legalizzazione e, soprattutto, delle problematiche etiche che l'introduzione di tale pratica ha sollevato. Nel corso dei capitoli si esamina la questione della liceità dell'eterologa, attraverso l'analisi critica dei possibili approcci alla questione, valutandone gli aspetti positivi e negativi attraverso uno studio delle dimensioni umane coinvolte. Il tema si inserisce in un orizzonte complesso che l'elaborato cerca di restituire in modo esaustivo, affrontando criticamente la questione a più livelli, che spaziano dall'ambito giuridico a quello etico e sociale, filtrati attraverso una costante indagine filosofica.

Ingeniero Civil QuímicoLa ingeniería es una profesión que busca el bienestar social por medio de la utilización de medios técnicos. Esta tarea supone exigencias morales que van más allá de lo puramente técnico y económico. El alto impacto del desarrollo tecnológico y los cuestionamientos desde la sociedad civil a la validez de las decisiones tomadas obligan a una reflexión sobre la ética, especialmente sobre los criterios para la toma de decisiones y los principios que la sustentan. De modo de atender a tales reflexiones, se generó una Base Ética Propuesta (BEP). Esta base es un conjunto de principios valóricos que buscan orientar el ejercicio ingenieril. Estos principios son Conciencia Social, Reflexión Crítica, Integración, Creatividad, Desarrollo y Bien Común. Estos principios se fundamentan en la Misión de la Universidad de Chile y en principios propuestos por autores como Carl Mitcham y Hans Jonas. La BEP define el objetivo de la ingeniería como búsqueda del bienestar social y también orienta y responsabiliza el ejercicio de la ingeniería y el uso de la técnica. Dado que la Evaluación de Proyectos, actual criterio usado para la toma de decisiones ingenieriles no es coherente en sus principios con la BEP, es que se propuso complementar el criterio técnico-económico con una reflexión cualitativa. Este criterio adicional, denominado Herramienta de Análisis Integral (HAIN) analiza las propuestas de la Evaluación de Proyectos por medio de la reflexión en torno a una serie de preguntas correspondiente a cada uno de los puntos de la BEP. Así, además de establecer la rentabilidad y factibilidad de los proyectos, se propone que se consideren variables cualitativas de importancia que el criterio técnico-económico no incluye. La HAIN fue puesta en práctica en el caso de la planta Valdivia de Celco, demostrándose la incapacidad de los tomadores de decisiones para incluir a la comunidad y a las partes interesadas en el desarrollo del proyecto. Con esto se posee un insumo para la inclusión de estos principios en cursos destinados a la formación de criterios ingenieriles, especialmente aquellos referidos al análisis económico.

L'analisi sarà incentrata in primo luogo in luce delle regolamentazioni vigenti, quali tipi e come tutelano i dati in ambito privacy; seguirà un approfondimento delle informative sui dati (privacy policy) di alcuni importanti Social dal quale verranno estrapolati e riconosciuti concetti come la profilazione. Lo studio di che cosa è la profilazione avrà come scopo l'introduzioni di questioni molto importanti riguardo i sistemi utilizzati per profilare - sistemi che sono nel modo più assoluto automatizzati, composti da algoritmi sviluppati sulla base di "deep learning" e "machine learning" in modo da non richiedere l'intervento umano - le conseguenze sul piano etico-sociale e i problemi di sicurezza informatica che me derivano. Nella parte finale, in particolare, verrà fatto notare come l'atto dell'invio di contenuti personalizzati non sia stato seriamente considerato e come il GDPR tratta questa situazione.

The thesis investigate the impact of macro changes on the decision-making process and the dilemmas faced by the social workers involved in child and family services. It explore if and how the criteria used by social workers in order to decide “what is good” and “what is right” have changed and how they managed dilemmas typical of social work. The study analyses the ethical dilemmas that arouses from the field work and how has changed the reference to values. It consider the impact of changes in the Welfare system (with the shortage of resources and managerialism) and the changes in the legal system (with the different role of Justice in relation to the right of the parents and the right of the child).
The research is a descriptive study based on in-depth interviews with 32 social workers, carried in 2009 – 2010 in Lombardia region (Italy), selected following three different dimensions: seniority of the social worker, urban or rural context, level of specialization. The results show that the dilemmas can be grouped in two main categories: one is concerning the relationship between social workers and the organization. Here, we argue that managerial contexts cause a ‘divorce’ in the values held by professionals and the institutional mandate. The second category is related to the ‘dilemmatic structure’ of child protection work, which is characterized by the task of constantly balancing the need for protection of the child and the need to help parents, and is related to the efficacy of intervention.

The thesis deals with financial accounting and taxation; i.e. areas with increased risk of unethical behaviour. It presents and critically evaluates the measures introduced by the European Union, the Organisation for Economic Co-operation and Development (OECD) and the authors of Taxparency project - the nongovernmental organisation Transparency International Česká republika and Lexperanto association. The introductory chapters of the thesis offer a brief excursion into the realms of philosophy, law and psychology. Their purpose is to provide a comprehensive summary of the most important findings from these disciplines for better understanding of the meaning and fundamentals of ethics. Subsequently, three key areas of financial accounting and taxation are discussed - non-transparent ownership structures, virtual offices and transfer prices - with the objective to determine the motives of entrepreneurs to use these practices. LuxLeaks case is mentioned as a practical example of unethical behaviour of entrepreneurs, tax advisers as well as of civil servants. The conclusion outlines the Taxparency project. The aim of the thesis is not only to introduce but also critically evaluate the project. Based on the results of a questionnaire survey, the possibilities of the project implementation in the conditions of the Czech Republic are analysed. Trata-se de estudo sobre experiências e práticas dos profissionais que atuam no Serviço de Atendimento Móvel de Urgência (SAMU), de Bauru, no atendimento às vítimas de violência com autonomia reduzida. O objetivo da pesquisa foi identificar dificuldades e dilemas éticos vivenciados por profissionais durante o atendimento. A abordagem metodológica para a ordenação e análise dos dados obtidos por meio de entrevistas semi-estruturadas foi a do Discurso do Sujeito Coletivo (DSC). Neste processo metodológico utilizou-se o programa eletrônico “QualiQuantSoft”. Os sujeitos da pesquisa foram enfermeiros e médicos com mais de dois anos de atuação no referido serviço. Com relação às experiências, destacaram-se a presença cotidiana da violência e a atitude dos profissionais frente à violência. Apontaram muitas dificuldades para o socorro das vítimas ligadas à necessidade de administrar conflitos no local do atendimento, prestação de cuidados em ambientes precários, falta de vagas nas instituições para receber as vítimas, salas de emergência lotadas, dentre outras. Os principais dilemas evidenciados foram: denunciar ou não a agressão sofrida pela vítima, questionar ou não o familiar da vítima sobre a causa da lesão, envolver-se ou não com a situação, atuar ou não segundo as normas estabelecidas em determinadas circunstâncias. Essa realidade do dia a dia foi citada como estressante e, também, como grave problema que afeta toda a sociedade. Sugerem estratégias para melhorar suas condições de trabalho e qualidade de vida
This is a study on the experiences and practices of professionals working in the Urgency Mobile Care Service (SAMU) in Bauru, assisting individuals who have been victims of violence and have reduced autonomy. It aimed at identifying the difficulties and ethical dilemmas experienced by professional during care provision. The methodological approach used for organizing and analyzing the data obtained by means of semi-structured interviews was the Collective Subject Discourse (CSD). In this methodological process, the QualiQuantSoft software was used. The research subjects were nurses and doctors who had been working in the abovementioned service for longer than two years. As regards experiences, the everyday presence of violence and professionals’ attitude in face of it were noteworthy. They reported caregiving difficulties related to dealing with conflicts on the site of care provision, care provision in precarious environments, lack of beds in health care establishments, crowded emergency rooms, among others. The main reported dilemmas were: reporting or not the aggression suffered by victims, questioning or not victims’ relatives about lesion cause, becoming involved or not with the situation, acting or not according to established norms in certain circumstances. This day-to-day reality was reported as stressful as well as a serious problem that affects the whole society. Strategies to improve their work conditions and quality of life are suggested

The chapter focuses on the assessment of personality in an international context. Starting from the definition of personality, the chapter discusses the way culture and personality are mixed and sets then out to explain the emic (indigenous) versus etic (universal) debate in personality assessment. The combined emic-etic approach is outlined as an interesting evolution in cross-cultural personality assessment, and two measures based on this approach are discussed, the Cross-Cultural Personality Assessment Inventory (CPAI) and the South African Personality Inventory (SAPI). Finally, the chapter discusses the currently dominant model of personality used in assessment internationally, the five-factor model, outlining some of the dilemmas still being debated related to this model, such as the broad versus narrow debate, the cross-cultural replicability issue, and the bandwidth-fidelity dilemma.
