Sport is a useful area of study to test assumptions of international law. International law has traditionally focused on states and on international organizations that oversee specialized areas of human activity. International sport is overseen by an NGO—the International Olympic Committee (IOC). Yet sport is of great interest to states, serving as a testing ground of national superiority by providing a simple narrative of “winners” and “losers” in competition. Meanwhile, entities that are not yet states have historically been able to participate in international sport more readily than in other areas of international relations. This essay will examine the connection between participation in the Olympic Games and claims to statehood. In doing so, this essay will outline the modern approach to statehood, consider sport's role in that approach, and examine two case studies: the German Democratic Republic, and Kosovo.

AbstractNon-state entities that aspire to statehood are increasingly developing democratic norms and practices, in part to enhance their claims for independence. However, the prospects for democracy in cases of ‘problematic sovereignty’ are little understood. This article seeks to explore the important but under-explored relationship between sovereignty and democracy, and in particular to assess the extent to which sovereignty is, or is not, a prerequisite for democracy. The article advances two arguments. First, it argues that there is no clear-cut relationship between sovereignty and democracy, as sovereignty is a complex concept that is comprised of several important, and distinct, constituent elements. Second, the article argues that the legal recognition of statehood (international legal sovereignty) is of marginal importance in this area, and should not be seen as a necessary condition for democratic rule. The article examines the process of democratic transition in the non-state entity of Somaliland to provide empirical support.

The purpose of this article is to study doctrinal approaches to the formation and development of municipal legal policy in Ukrainein the context of the further development of democratic legal statehood.It has been proved that objectification and actualization of the development of municipal legal policy is an integral part of statelegal policy and carries out a purposeful and institutional-constitutive influence on the formation and development of local self-governmentin the conditions of which territorial communities exist and function, – are associated with the improvement of democraticlegal statehood.It is indicated that the actualization of the problems of municipal legal policy of the state is directly related to the conditions forthe existence and functioning of statehood and the international community of states in crisis conditions, in fact contributes to its objectification,contextualization, requires its qualitatively new understanding, filling, as well as new mechanisms of regulatory, legislativeand administrative technological support and support.In the context of understanding the semantic and etymological load of the terminological system “democratic legal statehood”,where the categorical concept of “statehood” acts as a reference, significant self-governing attitudes are highlighted that can be reflectedand consolidated in municipal legal policy in the context of the collectivist foundations of the exercise of public power, human accessto the implementation of such power at different levels of society, the legalization of human and civil rights and freedoms, humanitarianand humanistic parameters for the implementation of state activities in many areas of social life.

It has become a standard critique of European integration that the upward transfer of sovereignty in market-related matters leads to the fragmentation of statehood between the supranational, European level and the largely incapacitated nation-states that retain jurisdiction over social and distributive policies. My article takes up this critique in the elaborate version of one of Germany's leading post-war constitutional theorists, Ernst-Wolfgang Böckenförde, whose approach has been influential in how German constitutionalism relates to the project of European unification. In this account, vertical integration uses law to sever economics from democratic politics, fragments the concern for the common good of citizens and undermines the unity of statehood. I contrast this account to instances of horizontal fragmentation of statehood, such as those underway in member-states such as Hungary or Poland where the nation state's constitutional structures are coming undone at the hands of authoritarian populists. The European Union's role of defending the rule of law within its constitutive states seeks to restore their normative integrity and, as such, is best understood as a role of verticalde-fragmentationof political and constitutional transformations at the domestic level. The question if statehood can be established at the European level gains greater urgency and complexity in light of these developments.

AbstractThe emergence of strong authorities beyond the nation state has raised questions about the absence of democratic legitimacy at the supranational level. The usual response to this dilemma has been an attempt to uncouple the strict link between national statehood and democracy, and in the process, to confer a degree of legitimacy on supranational authorities. This article argues that such an uncoupling is unconvincing, and that within the legitimacy-democracy-statehood triangle, the uncoupling of legitimacy and democracy is a more promising strategy. The legitimacy of supranational authorities is grounded in their appeal to ‘public reason’ – a legitimacy-conferring device well-suited to supranational authorities, as illustrated in this article by the examples of the European Court of Human Rights and the WTO dispute settlement system. On this basis, the article argues that we should not see the relationship between statehood legitimacy (based optimally on electoral democracy) and supranational legitimacy (based on public reason) as mutually antagonistic and engaged in zero-sum competition. Rather, this relationship allows scope for synergy, with supranational authorities often playing an important role in supporting democracy at the nation-state level.

Purpose: The article is devoted to the study of egalitarian principles of medieval Czech statehood and the legal system. Methods: The authors pay special attention to the peculiarities of family self-government of the Czech communities, the institution of hazing in land law and the mechanism of reconciliation as an alternative to the death penalty. Findings: The paper proves that tribal remnants of the customary law of the ancient Czech people in the medieval era contributed to the preservation of egalitarian democratic principles of public administration and justice.

This thesis challenges common political science assumptions about regions, nations, and societies in contexts of state weakness, with a special focus on de facto, rather than de jure, statehood in sub-Saharan Africa. I argue that theories of statehood must reach deeper into the empirical workings of state-society relations. Instead of positing abstract models or normative ideal types of modern states, I conceive of statehood as a set of daily practices that govern, regulate and generate effects on those experiencing and “performing the state”. I look at public good provision and consumption as a way to study these practices of statehood. The arguments advanced in this thesis are based on interpretive and relational methods. Interpretivism focuses on meanings and beliefs, as opposed to strict laws and statistical correlations. Relational methods demonstrate how interactions between consumers and providers of public goods evolve and condition de facto statehood. Qualitative data, which includes semi-structured interviews, focus groups, and participant observations, are drawn from firsthand encounters with service providers and citizens in Bukavu, the capital of South Kivu province in the Democratic Republic of Congo. Empirical observation and analysis shed light on governance patterns, citizen-subject relations, and provide a heuristic approach to statehood dimensions. Approaching the concept of statehood through dimensions is useful in light of the multiple meanings that it holds. Statehood, I argue, is never fixed and does not reach a teleological end point, but rather, embodies different dimensions that can be analyzed through patterns of public goods provision. I argue that the state, often imagined as a coherent entity, is comprised of different practices found in a variety of spaces and social relations. This approach to statehood decreases discrepancies between the literature and empirical realties and engages with “real” experiences of statehood in non-Western spaces.

The thesis focuses on the historical-diachronic analysis of the development of the Democratic Republic of Congo’s educational sector, with particular reference to the context of Nord Kivu and its capital Goma. The thesis aim is to understand and investigate how the DRC's educational sector has managed to be resilient over time (especially with regard to its funding), taking into account the interaction of different actors involved. Through the application of Tobias Hagmann and Didier Péclard's negotiated statehood approach to the Congolese educational sector and to a specific school in Goma, Bemba Gombo / Saint Franҫois Xavier Insitute, it is possible to understand who are the principal actors in the educational field, and which actors are excluded from the negotiating tables of the Congolese educational sector.

The following comparative case study of Iraqi Kurdistan and Democratic Federation of Northern Syria-Rojava seeks to fill a gap in literature on the viability of democracy in cases of de facto statehood. There is yet to be an assessment of the potential influence of support from patron states on the degree to which democratization in de facto states is possible. This research expands upon on the argument that the decision to recognize de facto states is at least partially dependent upon the national interests of influential third party states. Syria Rojava has relied heavily on the strength of its internal sovereignty for survival where Iraqi Kurdistan received significant external support in vital phases of the state building process and was not reliant entirely on the strength of its internal unity. Where Kurdistan received essential major power support from permanent UN Security Council members early in the state-building process, as well as afterwards in constructing a divided system of governance, Syria Rojava has received little external support and faces an international community that denies its existence. It is estimated that in the following research the support of Major Powers early in the state-building process fundamentally changes the nature of internal sovereignty. More specifically the strength and weakness of conditions of internal sovereignty influence the type of governance that is practiced in the cases under analysis. Where the conditions of internal sovereignty are strong, the viability for democratization decreases; where the conditions of internal sovereignty are weak, the viability for democratization increases. In the case of Iraqi Kurdistan, the relatively weak conditions of internal sovereignty, while resulting in conditions that are more conducive to democratization, subjects the region to increased dependence on external powers for survival. Whereas in Syria Rojava, the relatively strong conditions of internal sovereignty while resulting in conditions that are less conducive to democratization, subjects the region to less dependence on external powers for survival. Theories that seek to affirm the possibility of democratization in de facto states have so far eschewed consideration of the military and diplomatic support of patron states in the early de facto state building process. There is a need for research that takes into consideration the specific events that lead to the creation of de facto states so as not to overlook the possibility that external actors play a role in shaping conditions of internal sovereignty.

Quelles sont les pratiques de la responsabilité politique et comment permettent-elles de comprendre la nature et les modalités de négociation du pouvoir de l’État au Mozambique ? Ce questionnement s’insère dans les débats des trente dernières années sur les phénomènes d’institutionnalisation démocratique au cours de la troisième vague de démocratisation. Dans ce débat, la responsabilité politique est vue comme l’instrument capable et nécessaire pour changer les régimes autoritaires, c’est-à-dire capable d’en finir avec les « résidus » autoritaires dans les nouvelles démocraties. À partir du dialogue avec la littérature, cette recherche appréhende la mise en place de la responsabilité politique comme un processus qui met en relief la dynamique transformative, comme espace de rencontres et de négociations entre plusieurs arènes et autorités qui composent la maille des régimes politiques. L’idée démocratique au Mozambique a permis et permet de mettre en articulation diverses expériences qui ont été capables de reformuler ou d’accélérer le processus d’institutionnalisation démocratique. Ces expériences doivent être analysées dans leur historicité mais incorporent des éléments de la modernité motivés par la compétition politique entre le pouvoir du Frelimo, la Renamo et aujourd’hui le MDM. La contribution de cette thèse est de penser l’institutionnalisation démocratique comme un processus transformatif et la responsabilité politique comme intrinsèquement soudée aux rapports de pouvoir dominants. Il s’agit de partir des expériences des acteurs dans le processus d’institutionnalisation démocratique au travers des rapports qu’ils établissent entre eux. En d’autres termes, il s’agit de ne pas en rester à une analyse macro-politique, mais de conjuguer tous les niveaux de pouvoir, en les regardant principalement à partir du bas. What are the concrete practices of political accountability and how do they make it possible to understand the nature and methods of negotiations of power within the State in Mozambique? This study makes a contribution to the debates over the last thirty years over the phenomena of democratic institutionalization during the third wave of democratization. Within this framework, political accountability is seen as the necessary instrument capable of provoking change in authoritarian regimes, by removing the authoritarian “residue” from the newly established democracies. Through a careful reading of the literature, this research has highlighted that the founding of political accountability is a process that reveals transformative dynamics as a place of confluences and negotiations between various political arenas and authorities that make up the structure of political regimes. The idea of democracy in Mozambique has facilitated the linking of various experiences, which have aided in reformulating or accelerating the process of democratic institutionalization. These experiences should be analyzed in their historicity, while also incorporating modern elements motivated by political competition by the balance of power between Frelimo, and Renamo and Democratic Movement of Mozambique (MDM). The contribution of this study is to think of democratic institutionalization as a transformative process and political accountability as being intrinsically sown into the links between the dominant powers, based on the experiences of the actors involved in the process of democratic institutionalization and the connections they establish amongst themselves. In other words, this project is not merely macro-political, but rather combines all the levels of power, most notably from the bottom. This research is founded on fieldwork done in two districts: Chibuto (South) where Frelimo is largely favored and Gondola (Center) where Renamo has gained political support

PhD Thesis in Iternational Law. The aim of the present research is to focus on current developments on territorial changes in international law. The study inquiries about whether according to international law, the referendum is a sufficient or a necessary condition for secession, or both. For this purpose, an empirical approach is adopted, focusing on the cases of, inter alia, Quebec, Montenegro, Crimea, Scotland and Catalonia. The thesis is divided into four main parts: firstly (1) it examines the relationship between self-determination and secession, then, (2) it discusses the approach of international law towards secession and develops a proposal for disentangling secession from self-determination. In the third part, (3) the research focuses on the role of territorial referendum in international law on territorial changes. The study finds that there is no sufficient practice and opinio juris to support the existence of an international rule according to which the referendum is a sufficient element to legitimize the birth of a new entity through secession. Neither there is an international obligation to hold a referendum to secede. Nevertheless, for the latter, the thesis finds at least some elements to support the view that more and more the referendum is becoming a necessary element in the process for secession, provided that it takes place in combination with the fulfillment of other conditions. Among these conditions, on the one side the study suggests that the referendum might trigger an obligation upon the parties to negotiate a new territorial assessment. On the other side, the referendum has to comply with certain procedural standards derived from international documents; case law and practice of the Council of Europe. Hence, the study is concluded with a (4) focus on the international procedural requirements for territorial referenda and on international reactions to the conduct of referenda in compliance with, or in violation of, the procedural standards above mentioned.

This anthology discusses Jacques Rancière’s political thinking from the perspective of political theory. It particularly focuses on the relationship between democracy, governance and statehood.
