This book aims to deepen the relationship between classical Spanish theater and cinema through the analysis of a corpus which has been only partially studied and recently rescued by critics. The chapters first deal with theoretical questions about the cinematographic adaptation of a dramatic text, followed by specific studies of significant periods in the political and cultural history of Spain in the 20th century, such as the artistic production of exile and that of the Franco regime, also taking into account the creative contribution of the most recent films based on the theme and their impact on contemporary society.

This chapter deals with the way in which French social scientists study their fellow citizens’ national identity. Following Billig, national identity refers here to the way people feel “emotionally situated” within nations, whatever these emotions are; how and to what extent they believe that being French is part of their personal identity. Over recent decades, social scientists all over the world have investigated the complex feelings citizens have about their nations. In France, however, this issue has been somewhat overlooked. This disparity is a consequence of the political context and the role of social scientists in French public debates, as well as a legacy of Bourdieu’s work which has made them well aware of the power of categorization. As a conclusion, the chapter outlines a research agenda in order to overcome this sociological blind spot.

This chapter discusses the law on creditor claims in France. French insolvency law has traditionally been unfriendly to creditors benefitting from contractual security interests. Unlike most other legal systems, insolvency claims secured by contractual security interests over certain assets of the debtor do not enjoy the right to be satisfied from the secured assets in priority to all other claims. The treatment of creditor claims is also similar among various insolvency proceedings. In reorganization proceedings (sauvegarde or redressement judiciaire), post-commencement claims are more common and substantial, whereas in liquidation proceedings (liquidation judiciaire), such claims are often non-existent. The remainder of the chapter deals with insolvency claims, administration claims, and non-enforceable claims in turn. Each section covers: the definition and scope of the claim; rules for submission, verification, and satisfaction or admission of claims; ranking of claims; and voting and other participation rights in insolvency proceedings.

This chapter deals with the emergence of social movement studies in the French social sciences in the 1990s and its development since then. We show how the exponential growth of this field largely relied on knowledge accumulated from the North American literature, but always with a critical appraisal of its concepts, methods, and results. We stress some theoretical and methodological specificities of the French contribution to the field: the greater recourse to qualitative and in-depth methodologies and the focus on the micro-level of individual activism and micro-level processes; the dissemination of its issues and concepts into a great number of academic domains, hence its trans-disciplinary framework; and finally its long-standing reluctance to engage in comparative studies. We conclude with some reflections on a possible agenda for future research.

The interactions between law and culture in addressing the legal problems at the end of a life are currently being discussed in many countries. The discourse on this issue should be multidisciplinary, taking into account its legal, medical, ethical, philosophical and anthropological aspects. This chapter’s purpose is to investigate the status of the Ryukyu Kingdom in early-modern and modern times, from the perspectives of specific periods rather than a contemporary viewpoint. The goal is to compare the traditional status of the Kingdom, peculiar to the region at that time, namely “shioki” or “fuyo,” to the idea of “sovereignty” or “independence” in modern European international law. Section I deals with the period from 1609 to the 1830s, before Western people rushed suddenly toward Ryukyu, whereas Section II discusses the status of the Ryukyu Kingdom in the 1840s and 1850s, in particular the nature of the Conventions concluded by the Kingdom with the United States (1854), France (1855), and the Netherlands (1859). Section III deals with a series of administrative regulations from 1872 to 1879 by the New Meiji government bearing on the status of Ryukyu, which is known as the “Ryukyu shobun (Ryukyu Disposition).”

Ballard, author of the 1984 novel Empire of the Sun, was born in the Shanghai International Settlement in China in 1930, into a privileged colonial milieu with a chauffeur, a nanny, and servants. Ballard witnessed at first hand the collapse of the British Empire in Asia. The year 1945 was not a moment of imperial defeat, but of imperial reassertion for Belgium, France, the Netherlands, and Britain, each of which saw their futures as global, colonial entities. This article, which deals with the end of empires, focusing on the loss of colonies such as Palestine, Lebanon, Syria, and South-East Asia, also discusses blueprints for a liberal policy in Africa, the 1956 Suez Crisis, developmental colonialism and decolonisation, and the empires of Portugal and Spain.

Emigration during the French Revolution has many different layers of historical reality, but the most defining of these was the legislation that condemned émigrés to death in 1793, and that was not altered until after Napoleon came to power. This legislation was not without its critics from its inception, and it is important to challenge the very inflexible notion that all émigrés were automatically traitors. The problems of getting émigré protests heard, and the imaginary aspect of their ideal France—usually a constitutional monarchy—was harder to convey while the legislation was in place. Furthermore the issue of justice for a significant minority group tests the principles of the revolutionaries inside France, and has a context that concerns not only the émigrés, but what the Republicans imagined as well. This chapter deals with the elaboration of the legislation and the difficulties of overcoming a very uncompromising stance on the guilt of the émigrés as a collective. These émigrés were in fact genuine refugees, and like any refugees their plight was the worse for the length of time the conflict lasted.

This article deals with rabbinic literature, considering what rabbis wrote in the context of performing their rabbinic functions: halachic literature in all its aspects — talmudic commentary, books of legal decisions, responsa, halachic monographs, works on prayer and liturgy, the holidays, and customs. The corpus of medieval rabbinic texts, which is today witnessing a renaissance, constitutes the basis of what is called mishpat ivri (Jewish law). It is possible to describe this literature according to four different categories: geography, chronology, content, and literary genre. The description here is related to content and literary genre, while taking note of geographical and chronological divisions. The books were mostly from European countries — Germany, France, Spain, Italy, and Provence. Rabbinic literature began to be produced in all the European regions more or less at the beginning of the eleventh century.

The forces of aristocracy, which in some countries in the 1780s prevailed over democratic movements, prevailed in others over monarchy itself. This chapter takes up a thread left hanging at the close of Chapter IV. It was shown there that, by the middle 1770s, or just before the American Revolution, the kings of France and of Sweden, and the Queen of Hungary and Bohemia, had asserted royal authority and put the constituted bodies of their several realms under restraint. The following fifteen years made clear the limits beyond which enlightened despotism could not go. However held down, the constituted bodies—estates, diets, parlements, and the like—had strong powers of survival and resurgence. This chapter deals mainly with the Hapsburg monarchy under Joseph II and Leopold II, with observations, since not everything can be told, on Prussia, Sweden, and Russia.

This chapter deals with fundamental issues of corporate insolvency (bankruptcy) law. Particular attention is paid to the agency problems related to “insolvency (bankruptcy) governance” of corporations and how these problems are addressed in various jurisdictions. Methodologically, the chapter is based on a functional approach that compares different legal regimes against the yardstick of economic efficiency. The structure of the chapter follows the issues as they arise in time in a corporate insolvency proceeding: objectives of insolvency laws, opening and governance of proceedings, ranking of claims and the position of secured creditors and shareholders, and rescue proceedings. The chapter also covers the contractual resolution of financial distress. It concludes with thoughts on the reasons for the identified jurisdictional divergences and an outlook on the worldwide efforts toward harmonization of (corporate) insolvency laws. In terms of jurisdictions, the chapter mainly draws on the corporate insolvency laws in the US, England, France, and Germany.

This anthology is dedicated as a commemorative book for Antonin Rychtecky on behalf of his 75th birthday in 2020. It compiles the proceedings of the 4th Willbald Gebhardt Olympic Symposium held at Charles University of Prague (Czech Republic). In five sections, ten papers of the symposium are published. Section One deals with the history of Olympic education development in Europe and North America (Binder and Naul). Section Two documents the support of the IOC Olympic Study Centre and Lausanne Olympic Museum for Olympic education (Puig, Chevalley). The Third section reflects the development of Olympic education in the Czech Republic (Skoda, Rychtecky). Section Four gives two examples of how Olympic education developed and became supported in accordance with preparation of Olympic Games in Japan (Tokyo, Obayashi) and France (Paris, Monnin). Finally, section Five includes two national studies regarding how Olympic ideals helped to change culture and society in Africa and South America (Zimbabwe and Colombia) written by Clemencia Anaya Maya and Mayamba Sitali.

The answer to legal questions related to the end of life is subject to strong cultural and religious influences. Medical, philosophical and historical aspects must also be taken into account. Because of the close connection between law and culture, countries with different cultural and religious backgrounds were selected for a comparative study on end-of-life issues. In France, Germany and Switzerland with a continental legal system, in Great Britain with a common law system, in India and Japan, the different religions and cultures exert an important influence on the modernisation of the relevant legislation. The book deals with recent changes in the law and developments in the countries included in the study. With contributions by Florence Bellivier, Kartina A. Over the last twenty years attempts have been made to determine the nature of Upper Palaeolithic hunting specialization. This chapter traces assemblage structural ‘specialization’, where faunal assemblages are dominated by a single species, vs ‘diversity’, in which all recorded species are well represented, between 45,000 and 10,000 bp (Châtelperronian to Azilian), and demonstrates regularity in the archaeozoological record. It moves away from the assumption that assemblages with at least 90% of bones attributable to a single species result from specialized hunting strategies, and seeks explanations for patterns of diversification. The study also deals with the Late Glacial Maximum with its narrowing resource base and the Magdalenian of southwest France, when specialized reindeer hunting is traditionally considered of paramount importance. The chapter uses measures of diversity and evenness to quantify variation observed through time, highlighting a peak in single-species exploitation during the Middle Upper Palaeolithic. Finally, interpretations are offered for future consideration.
