This chapter is devoted to cross-border principles. It begins with an examination of two sets of opposing principles: unity of proceedings versus plurality and universality or territoriality in the administration of the debtor's assets in insolvency. This is followed by an examination of two major instruments: the widely adopted 1997 UNCITRAL Model Law on Cross-Border Insolvency and the EU Insolvency Regulation (recast), approved in 2015 and incorporating numerous significant changes to the former EC Regulation. The Model Law is concerned with recognition of foreign insolvency proceedings, carrying with it an automatic stay of local proceedings, and the status of foreign administrators and duties of co-operation with foreign courts and foreign administrators. The EU Insolvency Regulation (recast) is primarily a conflict of laws regulation governing jurisdiction and the law applicable to insolvency matters.

This book provides a critical examination of modern English corporate insolvency law, in particular the procedures under the Insolvency Act 1986, from both conceptual and functional points of view. It focuses throughout on identifying a rational explanation for the form that the rules and institutions of the modern law take or, where there is no such rational explanation, the history which has resulted in the present position. A central theme of the book is that the nature and fundamental purpose of insolvency proceedings themselves dictate many of the features of English insolvency proceedings. For example, collective execution on behalf of creditors necessitates definition of the insolvent estate and the provision of rules concerning provable debts and transaction avoidance. Many key features of the insolvency procedures are therefore essentially matters of practicality rather than principle, albeit practicalities applied justly and fairly. The book covers the nature and purpose of insolvency law; the procedures; the administration, supervision and regulation of insolvency proceedings; the insolvent estate and transaction avoidance; investigation and wrongdoing by directors; phoenixism and pre-packing; distribution of the insolvent estate; and, lastly, cross-border insolvency. It examines the various principles of insolvency law in the context of practice, drawing upon historical perspectives where appropriate. By explaining how the law takes the form that it does, the book promotes an understanding of the present law and institutions as a whole, and shows how this understanding might inform future developments.

Epidemiological studies are unified by their common goals and by their basis in defined populations. The case series (or register-based study) includes examination of trends in deaths, cancers, notifiable diseases, and hospitalizations. Case–control studies are analysed by comparing the exposure to risk factors in cases to those in controls. In a population studied at a specific time and place (a cross-sectional study), measurements can be made of disease, the factors which may cause disease, or both simultaneously. Cohort studies produce data on disease incidence and are especially good on associations between risk factors and disease outcomes. Trials compare treated and untreated populations and are used, primarily, for information on effectiveness of health interventions. Natural experiments, including Mendelian randomization studies, may provide causal evidence. The principles for the analysis of all studies are similar. The design and interpretation should be in the context of traditional, systematic, and meta-analytic reviews.

This chapter surveys some specific ways in which virtue can be, and can fail to be, embodied by human beings. Much of the discussion of ethics in modern Western philosophy has focused on applying abstract principles of right and wrong to outward actions. Adopting a cross-cultural and empirically-based approach to ethics opens up a range of less obvious and perhaps philosophically more interesting ways in which virtue depends on, and can be supported by, our human embodiment. I survey three areas where drawing on sources such as early Confucian and Buddhist texts may prove particularly useful in pushing our investigation of virtue beyond its current confines. These include the training of behavioral dispositions in social contexts; the training of habits of attention in relation to embodied emotion; and finally an examination of internal ethical conflict as embodied emotional motivations.

Victory has historically been regarded as the ‘telos’ or ‘very object’ of war. As one well-placed commentator has noted, war is all about winning. It is baffling to note, then, that contemporary just war theory, the predominant framework for addressing the moral and legal questions that war raises, does not engage the discourse of victory. Today’s just war theorists shun the language of victory, preferring instead to speak about the ‘endings’ of warfare. This book investigates why just war theorists have been so reluctant to speak about victory. It identifies seven principal objections to invoking victory in just war theory and subjects them to cross-examination. It concludes that while there are good reasons for regarding victory as a problematic concept, these same reasons could (and arguably should) be taken as an argument for embracing rather than ignoring victory within the just war framework. Such a move would not only spare just war theory of the charge of irrelevance by ensuring that it remains connected to the pointy end of warfare, it would also illuminate the tragic character of just war itself, revealing both its necessity and limitations.
