The subject of this research is the general terms of three standard contracts set by International Federation of Consulting Engineers (FIDIC) in 2017 – conditions of contract for engineering, construction and installation works designed by the contractor; conditions of contract for engineering, construction and installation works designed by the employer; conditions of contract for “turnkey projects” and norms of the Federal Law “On contractual system in the sphere of procurement, works, and services for state and municipal needs; as well as bylaws in the area of public procurement and urban development, which regulate the establishment and change of conditions of construction contracts regarding the types and volume of works, their cost and deadline. The novelty of this research consists in the fact that the conditions of standard FIDIC contracts are analyzed in comparison with the current legislation of the Russian Federation on regulation of public procurement. The conducted comparison revealed discrepancies in the legal regimes of contractual relations emerging thereof. The law establishes rigid requirements to agreeing and setting conditions on the source, cost and completion time of works which impede differentiation of the level of their detailing in contract documentation, and thus the creation of a favorable environment for implementation of investment and construction projects. Excessively rigid rules of public procurement legislation pertaining to the changes of contract terms block the action of risk management procedures enshrined in the FIDIC standard contracts. As a result, the parties are not able to respond adequately and promptly to the impact of external and internal factors that affect project environment. A conclusion is made on impossibility of mutually agreed terms of application of FIDIC standard contracts and Russian legislation on public procurement without making substantial amendments to the content of standard contracts.

The article discusses the importance of the financial market in ensuring sustainable growth of the Russian economy and the problem of the formation of regional financial centers in the federal districts of Russia. The hypothesis is put forward that a regional financial center can be created in each of the federal districts of Russia. A system of indicators reflecting the potential of the financial market and its branches of specialization is formulated - financial services (assets of credit institutions registered in the region; number of broker clients in the subject of the federation; assets of broker clients in the subject of the federation) and insurance (number of insurance contracts concluded in the subject of the federation; insurance amounts under insurance contracts concluded in the subject of the federation). For each federal district, based on the Atlas of Economic Specialization of regions, a representative information array has been formed and a methodology for ranking the subjects of the Russian Federation by indicators characterizing the financial market has been developed. A rating of the subjects of the federation has been compiled in each federal district, if possible, to create a regional financial center on the basis of this subject of the federation.

This article is aimed at studying of theoretical issues of implementing network contracts (smart contracts) on the example of Russia and foreign countries, based on the fact that its knowledge allowed and allows to successfully solve current problems of legal regulation in our country. The starting point of the research is network communication as a non-market type of communication. The article analyzes the provisions of approaches to the legal regulation of network contracts (smart contracts) developed in the new technological reality, taking into account the experience of foreign countries and the Russian Federation that determine the acceptability of the use of blockchain in the field of legal regulation of such a type of interaction between the parties to the contract that is updated according to present technological era. The relevance, theoretical and practical significance of this research is due to the emergence of new tools for interaction between the parties to the contract in the context of using blockchain technology. The author's results, among other things, are presented in the idea that the ability to compile codes by software tools that ensure the fulfillment of obligations under contracts (smart contracts) that are used in the blockchain network not only expands the latter's utilities from simple information storage to participation in the system of economic transactions, but also is an excellent tool for automatic fulfillment of the obligations stated in them.

Résumé :
This article is devoted to the application of the marriage contract by persons entering or already married. The authors define the relevance of concluding marriage contracts and emphasize the positive trend of their application in Russia. As a rule, the question of the division of property is the most difficult and problematic both in theory and in practice. In scientific circles, there is a discussion about the legal nature of the marriage contract. The specifics of its conclusion and the scope of regulation of relations do not give an unambiguous answer about the branch affiliation of this legal institution. There are also a large number of gaps in the Family Code of the Russian Federation due to the lack of legislative consolidation of some aspects related to the contractual regime of spouses’ property. In addition, there is still an unresolved issue regarding the conditions and procedure for concluding a marriage contract by minor citizens entering into marriage. In the article, the authors come to the conclusion that the marriage contract as a legal phenomenon requires more legal regulation at the legislative level.

The article deals with the problem of fulfilling the terms of state contracts for the supply of food for the needs of the penal system of the Russian Federation, associated with the receipt of low-quality products by customers. The subject of the study was the materials of judicial practice, accompanying documents of territorial bodies of the FPS of Russia, Russian civil legislation, scientific literature on the topic under study. The purpose of the work is to reveal and analyze the gaps in the legal regulation of food procurement for the needs of the penal system of the Russian Federation based on the materials of judicial practice. The practical significance of the work lies in identifying the difficulties in planning the public procurement to ensure the activities of the penal system in the event of non-performance or improper performance of obligations by suppliers. The methodological basis of the work was formed by the structural and logical method, methods of analysis, synthesis, comparison, induction. As a result of the work carried out, a comparative table of the terms of settlement of civil disputes between customers and suppliers of low-quality food products is presented, the problems affecting the proper execution of state contracts in the field of food procurement are highlighted, specific recommendations of the terms that can be included in the state contract with the aim of preventing unscrupulous food suppliers from participating in procurement are formulated. The policy and implementation of geostrategy of the Russian Federation in relation to the countries of the Latin-Caribbean region are considered. Russia is increasingly trying to demonstrate the status of a strategic partner with respect to Latin American Caribbean countries through the conclusion of various partnership agreements. On this basis, since the 2000s, the Russian Federation has sought to regain its influence in those Latin American countries that were the traditional sphere of presence of the USSR during the Cold War. It has been established that Russia is trying to gain favour among Latin American countries by establishing economic relations, mainly of a commercial nature. The Russian Federation has significant contracts for the supply of weapons to Latin American countries and is involved in the implementation of a number of energy projects, including the construction of nuclear power plants. Russia is also trying to demonstrate its presence in the region through the manoeuvres of its long-range strategic aviation and naval forces. At the same time, Russia is resorting to the support of bankrupt Latin American regimes such as the government of N. Maduro in Venezuela. All this has only exacerbated the crisis in Venezuela and its autocratic rule and led to a double rule in the country. However, Russia risks being pushed out of the region by China and the United States, which consider Latin America as a proving ground for a strategy of geo-economic “conquest”. The key countries for implementing the strategy of restoring Russia’s presence in the region are: Cuba, Venezuela, Nicaragua and partly Brazil. The Russian Federation views these countries as strategic partners and a foothold for the further expansion of geopolitical and geo-economic influence in Latin America, as well as restrictions in the region of US influence. Against the backdrop of isolated manoeuvres by the Russian Air Force and the Navy, Moscow makes periodic statements about the rebuilding of former Soviet military bases in Latin American countries. However, such rhetoric of the Russian Federation can be regarded more as geopolitical PR in order to represent the virtual grandeur of Russia.

Multiple digital portals of government branches and commercial structures, as well as social networks give a new perspective on the topical issues of socioeconomic development. This trend also includes digital platforms of government branches and business structures that ensure state expenditure management. The subject of this research is the state expenditures reflected in the portal of the Accounts Chamber of the Russian Federation. The author generalizes the content of information featured on the aggregator portal of the Accounts Chamber of the Russian Federation pertaining to state finances. Analysis is conducted on the number of the completed state contracts in accordance with the level of governance and varied ranges of value of such contracts. The article considers the regions with highest rating by share of “internal” contracts and the dynamics of monthly allocation of state subsidies. Analysis is also conducted on the number of contracts, subsidies, controllers and recipients of budgetary funds, as well as national projects budgeting of the Russian Federation. The established system of structurization of state expenditures indicates the existing in Russia architecture of formation of budgetary and extrabudgetary financing system of state obligations and national development projects. Various digital platforms of government branches necessary for managing state resources and that allow analyzing their require a certain consolidation of methodological and processing bases for assessing the efficiency of allocation of budgetary and extrabudgetary expenditures of the country. Such platforms should contribute to finding optimal ways for centralization and decentralization of budget resources, develop the channels for transfer of state funds that allow budget savings, increase the effectiveness of state control, and prevent excessive use within the system of state administration. The conclusions are reduced to the need for consolidation of methodological and processing bases for effective assessment of the usage of budgetary and extrabudgetary expenditures of the country.

The level of transport infrastructure development is one of the key determinants of economic growth. In 2018, 67.1% of all transported goods in Russia were delivered via road transport. However, Russia’s motor transport system has yet to come close to fulfilling its full potential – 57.6% of public roads do not meet regulatory maintenance requirements. The prevailing statistics highlights the task of ensuring the safety of roads. This issue is especially relevant during winter months, when the roads experience maximum climatic and physico-chemical effects. This article analyzes the road safety system of the constituent entities of the Russian Federation, considers the main regulatory documents governing the activities of road work suppliers and executive authorities in the field of road maintenance. The authors analyzed the best foreign practices in road maintenance policy. The main result of the study is the proposal to introduce a mechanism for servicing roads using a performance based contract to replace to cost based road maintenance contracts, which are the most widely applied in Russia.

Cette thèse traite de l'évolution du cadre organisationnel et institutionnel de l'industrie pétrolière russe durant la période 1992-2012. Son objectif est de caractériser et d'interpréter l'accroissement du rôle des compagnies pétrolières à capitaux majoritairement publics, Rosneft et Gazpromneft, dans les opérations de l'amont pétrolier qui est observé depuis le milieu des années 2000. Dans ce cadre théorique de la Nouvelle économie institutionnelle, notre thèse soutient que le rôle accru des compagnies pétrolières publiques russes marque le passage d'une structure de gouvernance pétrolière libérale à une structure de gouvernance pétrolière hybride. Cela doit être interprété comme la réponse faisable, de la part des autorités fédérales, à l'incohérence existant entre la structure de gouvernance pétrolière libérale définie au début du processus de transition et l'environnement institutionnel prévalant en Russie.

The monograph presents the research questions of efficiency of functioning of national standardization system of the Russian Federation, which was conducted by the authors in the framework of the analytical work on the order of Minpromtorg of Russia in 2018 (the state contract from April 17, 2018 No. 18401.16Д0190019.10.002) taking into account the actual directions of development of national standardization system of the Russian Federation and additional generalizations. The assessment of the current scenario of the development of the national standardization system of the Russian Federation was carried out using comparable indicators of the national standardization systems of France, Germany, great Britain and the USA. The findings and proposals were based on the results of a survey of civil servants at the Federal and regional levels on approaches to strategic dimensions of standardization. The methodology of forecasting the development of the national standardization system of the Russian Federation includes a scenario approach and a method of constructing dispersion diagrams (bubble diagrams) and sufficiently illustrates the current state of Affairs in the field of standardization at the national level. The developed tools will require additional configuration when changing the current development scenario from "inertial" to "progressive". A number of author's proposals to change the current scenario of development of the national standardization system of the Russian Federation are presented. It is of interest to a wide range of readers and specialists in the field of public administration, standardization and can be used in the preparation of curricula and manuals for undergraduate, graduate and further education.

AbstractIn this chapter, we analyze nationwide measures taken in Russia to organize the education system during the pandemic. We show the opportunities and limitations for responses associated relative to the previous policy phase. Special attention is paid to the peculiarities of a system reaction to the situation of a pandemic in a federative country with heterogeneous regions. In contrast to several other countries that adopted a single national strategy, different scenarios were implemented in Russian regions. We investigate the factors that influenced the scenarios and management decisions at the national and regional levels of the country. We highlight differences in the nature and dynamics of measures taken to organize learning in the first (spring–summer 2020) and second (autumn–winter 2020) waves of the pandemic. We also analyze the subjective experience and wellbeing of students and teachers during a pandemic. As the empirical base, we use data from several large sociological studies conducted in the Russian Federation over the past six months on the issues of school closures, distance learning, and the “new normal.” This provides a new perspective for studying the increasing education gap between children with different socioeconomic status due to the pandemic.

AbstractThe OSCE, in its capacity as the largest regional security organization worldwide, has played a pivotal role in promoting security and cooperation in the Western Balkans. This research emphasizes the role of the main actors of the OSCE debate who try to securitize and de-securitize the concerns in the Western Balkan region in the light of the Regional Security Complex Theory. It draws attention to the role that the EU, US, and the Russian Federation have played in the politico-military dimension debate, starting from 1995 when the OSCE was established until 2001 when the turmoil in the region came to an end, as well as in the human dimension debate, beginning from 2015 when Serbia was the first Western Balkan country to chair the organization until 2020 and the Albanian OSCE Chairmanship. The research argues that the two most pressing concerns during the first timeframe, where securitization from regional actors can be addressed, were in the field of arms control and border management. In contrast, in the second timeframe, which is mainly characterized by de-securitization, the attention of the main actors concerning the region is centred on democratization and rule of law.

The article makes an attempt to analyze a new type of social assistance to low-income citizens, low-income families, as well as citizens in a difficult life situation in order to formulate proposals for its improvement. The President of the Russian Federation Vladimir Putin during the meeting with senators held on 23 September 2020 pointed out that "One of the key factors in war on poverty is the social contract" (https://ria.ru/20200923/bednost-1577654986.html). The social contract is a very effective type of social assistance, as it is aimed to activating the citizens themselves in increasing their level of material security. As a result of the contract, they get the opportunity to find a permanent income, including by opening their own business or running a personal subsidiary farm, solve their difficult life situation, retraining. Despite the positive dynamics of the increase in the number of signed social contracts, the mechanism of these contracts itself needs to be improved. In particular, the author suggests that social protection institutions move to proactive social work with poor citizens, informing them more fully about the features of the social contract. It is also proposed to transfer the distribution of quotas for the conclusion of a social contract in various areas of the activities carried out within its framework to the subjects of the Russian Federation, to revise the terms of the social contract in the direction of «job search».

The article presents a comparative analysis of the nature and content of the concepts of risk and business reputation of the organization. The factors that may affect the process of digitalization of the economy in Russia are identified. The relationship between digitalization of the economy and the business reputation of industrial companies is defined. The refined definition of risk suggests considering risk as an economic phenomenon, which is an integral element of all socio-economic processes that occur in the organization, and is able to lead the system out of balance and, consequently, either improve its performance, or lead to undesirable losses, or destroy. The complete concept of business reputation is that it defines it as a stable representation in the minds of contractors of the organization (consumers, government agencies, suppliers, commercial banks) about the good faith of the fulfillment of its obligations, a high level of quality of the products of the efficiency of the implementation of business contracts. The interrelation between increase in business reputation and growth of competitiveness of the industrial organizations is shown. The quantitative index for assessing the level of goodwill by the dynamics of the revealed violations of the organizations in the industry is proposed. The dynamics of this indicator of industrial organizations of the Russian Federation in 2011–2017 is investigated. Such directions of reducing the risk of business reputation of the industrial organization of the Russian Federation as the development of tools for motivating personnel, the intensification of the use of professional psychological assistance for employees and management of industrial companies, the movement of their business reputation in social networks, the improvement of PR-companies of industrial enterprises, the development of self-regulatory organizations of the industry and the intensification of their activities in the management of the process of ensuring business reputation are revealed. The necessity of formation of independent qualified ratings of business reputation of domestic industrial companies formed in the context of sub-sectors of a particular sector of the economy and regions of the Russian Federation is shown.

The chapter explores the present role and the future of the Russian language in Kazakhstan. It contrasts state language policies with the views of ordinary Kazakhstani citizens, recorded mainly in interviews and round-table discussions with students of national universities conducted between 2016 and 2019. Suggesting that the Russian linguistic-cultural space in Central Asia is largely a historically rooted phenomenon and has not been primarily dependent on Russia, the authors suggest that the Russian Federation should readjust its external language and culture promotion, which has so far been geared almost exclusively to the so-called ‘compatriots’, and should take the needs of non-Russian Russian-speakers into serious consideration.

According to the framework program of the Russian Federation released in 2010 it is planned to build up additional nuclear capacity of approximately 20 GWe. In addition, contracts were signed for several new-builds throughout the world. The related design efforts together with the restricted design capacities in Russia led Rosenergoatom (Client) and Atomstroyexport (Co-Client) to the set up of a so-called unified project “TOI”. “TOI” means translated “Technically Optimized reactor designed with Integrated databases”. NUKEM Technologies owned by Atomstroyexport was selected to develop the standardized technically optimized design for the treatment of the generated LLW and ILW. Special emphasis was made to reduce the waste volume for storage after treatment to below 50 m3 per year and unit. The selected treatment technologies compromise sorting, fragmentation, thermal treatment, compaction, evaporation, cementation etc. In 2010 NUKEM Technologies together with Atomenergoprojekt (Main Contractor) developed the technical concept for the treatment of liquid and solid LLW and ILW generated within the reactor as well as in the auxiliary buildings. In an iterative process the waste amounts generated and the respective treatment methods were discussed and agreed. The next step will be to further develop the design. The basic design (technical project) should be finalized until end of 2012.

An intergovernmental agreement on cooperation about chemical weapon destruction was signed between France and the Russian federation on 14th February 2006 in the context of a Global Partnership dedicated to preventing catastrophic terrorism and the proliferation of weapons of mass destruction. It came into effect on 25th April 2007 after ratification by both countries. The present demonstrated project was launched as part of this collaboration on the Shchuchye site (Russia – Kurgan Oblast). The project concerned the environmental surveillance system for the Shchuchye site required for the safe operation of the installation used to destroy chemical weapons. The aim was to implement equipments and methods of analysis for very low concentrations of pollutants in the three environmental compartments: air, water and soil. This has been achieved with the help of industry and other organizations in France (Environment/SA for supplies, INERIS and Antea Group) and Russia (ROST Association and EKROS Engineering). This system takes account of the normal operation of the installation as well as incident management. It includes 11 stationary atmospheric measuring stations constructed by Environment/SA and EKROS Engineering including ASTEK dedicated toxic gas detector: “Terminator FOV-1”, 3 mobile atmospheric measuring stations, 2 mobile soil & water measuring stations, 4 sampling cars constructed by Environment/SA and EKROS Engineering, a complete Chemical analysis laboratory which can handle ppb analysis of toxic gases, organics and minerals pollutants, an information collection center and a meteo station which can retrieve, display and archive all the datas or alarm from the stationary and mobile stations. Antea Group has provided a technical expertise and various negotiations during the negotiation phase, the project initiation files & contracts redaction, the project Monitoring and reporting to stakeholders, the REX. Up to 2009, No other site of the world uses such an innovative system. Antea Group worked on this project for 4 years. It successfully began operating in March 2009, before the start of destruction operations, after 15 months of work on the site.

Turkey and the Russian Federation (RF) have deep historical political and economic relations. The trade between the two countries have been growing since late 1980s when Turkey began to procure natural gas from Russia. The dissolution of USSR and the revival of Russian economy offered new opportunities for Turkish businessmen. During the last decade, Russia became one of the few major markets for Turkish construction and contractor companies whereas Turkey has been a favorable touristic destination for Russians. The agreements regarding Akkuyu nuclear power plant and natural gas pipelines have strengthened the ties between the two countries. In 2012, Russia became the 156th member of the WTO. Russia’s WTO accession, along with the country’s other economic cooperation and integration moves provide foreign companies interested in Russia with a better investment climate and business environment. Having competitive advantage in many goods and services categories needed by Russia, Turkish companies should benefit the new developments in RF and increase their business volumes in that country. This paper examines the current trade relations between RF and Turkey in detail considering the potential effects of RF’s WTO membership.

Basic Technical Details: Displacement: 5000 tonnes; Width: 23.2m; Height: 6.6m; Length: 65m; Draught: 3.5m; Processing Throughput: 7000m3/year. In October 1993, the Governments of Japan and the Russian Federation signed an Intergovernmental Agreement to reduce the threat of nuclear weapons in the Former Soviet Union. Towards achieving this goal, the Japanese Government had initially allotted $100 million towards, which was increased to $200 million in 1999. The main objective of the Suzuran project is to process low-level liquid radioactive waste, which has been in storage for some years, and prevent it from being dumped into the seas shared by Japan and Russia. The construction and completion of the Suzuran, in the Russian Far East, is the brainchild of the Japanese Government, and is the first successful international project of its kind in Russia. Suzuran neatly solves the problem of making safe the liquid radioactive waste being derived from general purpose and missile nuclear submarines of the Russian Pacific Fleet as they are decommissioned and dismantled. The project was administered by the Technical Secretariat of the Japan-Russia Committee for Co-operation on Reducing Nuclear Weapons, who appointed Crown Agents as their agent and RWE NUKEM as their Technical Consultants to manage the project on a day to day basis and oversee the tender, construction and commissioning. This project is unique and complex in that it is, in reality, two projects. Firstly, the construction of a sea-going barge and, secondly, the construction of a complex radioactive liquid waste processing facility. Changes in the Russian Radiation Regulations during the course of the project, required the design to be altered significantly; for example, the facility had to be mounted within the structure of the vessel. Numerous regulators, design and testing institutes were involved throughout the project, to ensure it complied with both Russian and International regulations. Suzuran is the only floating complex that can operate independently for up to 30 days away from base. It is also exceptional in having the greatest throughput capacity of any project of its type and in being fully actively commissioned and licensed to operate, as part of the original contract. Other similar projects, which have a lower throughput and are land-based, have been handed over prior to completion of active commissioning. The international project was particularly complex since it involved not only Japan and Russia but also a Japanese-American contractor, who subcontracted the construction work to Russian shipyards. The Amurski Shipyard at Komsomolsk-na-Amur constructed the Vessel and the processing Facility was constructed in America and shipped to Russia where it was installed on the Barge. The Barge was then towed down the Amur River and down the Russian East Coast to Bolshoi Kamen where it was inactively and actively commissioned. The completed Barge was completed and is now operating, following a one-year warranty period. The project required everyone’s close co-operation and understanding. Particularly onerous was the need to comply with comprehensive Russian regulations, both for sea-going vessels as well as for nuclear facilities. This is a success story in itself. The official Handover ceremony of Suzuran was held in November 2000 and is now operating at the Far Eastern Shipyard, Zvezda. This paper will describe the history and process involved in establishing the Barge project for the treatment of Low Level Liquid Radioactive Waste.

Résumé :
The article considers contractual designs aimed at transferring exclusive rights to industrial property. The problem of the contractual process was identified when concluding a contract on the transfer of a set of exclusive rights. Based on the study, a number of changes to Russian laws have been proposed. First of all, this applies to a commercial concession contract. The author proposes to amend the Civil Code of the Russian Federation by supplementing the article on commercial concession with the right of organizations that do not conduct commercial activities to conclude the same contracts on a general basis. The appropriateness of applying the classification of transactions into real and consensual ones in relation to this contract is justified. The peculiarities of transfer of the complex of exclusive rights to objects of industrial property with participation of social enterprises under the legislation of the Russian Federation are studied.
