Texte intégralSome national studies and surveys conducted in hospitality facilities have brought to light the reality of psychiatric wards that often continue to employ practices that are deeply rooted in custodial instances typical of the manicomial model. The epidemiological spread of the containment reveals a strong contradiction between clinical practice and the principles that inspired the 1978 psychiatric legislation reform. The assumption on which the thesis object of the elaboration puts its bases is as follows: If the scientific evidence shows that restraint can be avoided, then it must be banned. The game, therefore, does not only play on the interpretation of legal norms, but involves psychiatry evidences, which must indicate the behaviors to be taken to address the issues that concern the patient's care. From the scientific evidence, the aim of this paper is to demonstrate that restraint, both in the form of mechanical and physical restraint, since it is unlawful, must be abolished. The originality of the research that lies in choosing to build the basis of legal reasoning on scientific evidence demonstrates that the containment has no validity as therapeutic act and that there are numerous tools to prevent or contain any violent behaviors and at the same time able to preserve its integrity and dignity and to strengthen its therapeutic alliance with healthcare professionals. This choice has the ambition to propose an alternative to the currently widespread trend of converting evidence-based medicine into a medicine of law-abiding. On the contrary, the lawyer must build an integrated model of legal science that takes due account of the evidence emerging in the scientific sphere and puts them in communication with the legal technique.

Texte intégralThis research work aims to study and analyze the theme of prevention and resolution of environmental conflicts both through spaces and tools for dialogue in the administrative process, and through tools to defuse the litigation before the court, so-called ADR, according to the acronym Alternative Dispute Resolutions. The question, to which we will try to give an answer, is whether it is possible to prevent or settle environmental conflicts through these tools, understanding what is their degree of effectiveness in our system whenever disputes concern the exercise of administrative power and checking what are the spaces of application, even in light of the new forms of participation recently introduced. The investigation conducted in this way will make it possible to show that, alongside the traditional forms of administrative participation, often unsuitable for adequately representing the various interests of society, new models are also identified in our legal system with the aim of strengthening the paradigm of participatory democracy through the involvement of citizens in public decisions, especially in the field of the localization and realization of infrastructures. Such an approach would allow to implement a composition of interests already in the procedural phase, so as to avoid a subsequent environmental conflict once the administrative decision has been taken.

Texte intégralThe purpose of this doctoral dissertation is to investigate the topic of the verification of powers in the European Parliament. Chapter I examines the models of verification of credentials offered by the comparative landscape. To this end, five systems are considered: England, France, Germany, Spain and the United States. Except for the latter case, an attempt has been made to follow a chronological order, starting with the oldest system and arriving at the most recent one. In particular, two elements are considered in the analysis: the verification of powers carried out in the upper chamber – where present – and the overall degree of protection of the subjective legal positions of candidates and elected officials. The choice of these profiles is justified for two reasons. Starting with the first, the scrutiny of the credentials of those elected in the chambers representing territorial autonomies provides an interesting point of comparison with the European Parliament, whose members – as is well known – are elected in the individual member states according to an only partially uniform electoral system. On the other hand, the examination of the degree of protection of the fundamental rights of elected members is related with second part of Chapter I, devoted to the Italian legal system and, in more detail, to the relations between the parliamentary, administrative and civil jurisdictions. Particular attention had been paid to domestic constitutional jurisprudence, whose relevance on the topic of electoral litigation has increased considerably over the years, as evidenced, most recently, by Judgment No. 48/2021 of the Italian Constitutional Court. Chapter II aims to reconstruct the legal framework for the verification of credentials, analyzing the discipline dictated by the founding treaties and the 1976 Act. The second part of the Chapter concentrates on the analysis of individual national regulations, examining four aspects: the bodies responsible for the proclamation of election results and, if necessary, their communication to the European Parliament, with particular reference to the possible assessment at the national level of the existence of grounds for incandidability or incompatibility; the nature of those bodies – with particular reference to their politicalness – and, finally, the system of remedies that can be brought against the proclamation of elected officials and, more generally, for challenging flaws in the electoral process. In light of the results obtained, it will be possible to classify the different jurisdictions into the patterns of verification of powers outlined in the previous Chapter. The last part of Chapter II focuses on the EDU Court's jurisprudence on the protection of the right to vote, including the recent Mugemangango v. Belgium case and its impact on the parliamentary model of verification of powers. Chapter III examines in chronological order the most relevant cases of electoral litigation for the European Parliament, both from the point of view of parliamentary practice and jurisprudence. The examination addresses the cases of Le Pen v. European Parliament and Donnici v. Occhetto, and then deals with the recent events concerning the Catalan independence MEPs, from which Judgments Nos. C-502/19 and C-646/19 originated. The last event to which space is devoted in the discussion is the disqualification of British MEPs and its impact on election results in the Italian legal system. Chapter IV deals with the evolution of the electoral legislation of the European Parliament, with a view to the adoption of a uniform electoral procedure or, reasoning in the short term, of a transnational electoral constituency, observing this affair from the point of view of the protection of the subjective legal positions of candidates and elected members, with particular reference to the possible identification of the competent body in matters of electoral litigation.

This work seeks to navigate the uncharted waters of the res judicata effects of “non-domestic decisions”, understood as decisions that are not rendered by the courts of the forum, and in particular of foreign judgments and international arbitral awards. In an attempt to overcome at least part of the uncertainties and problems of the current practice, as regards foreign judgments it is proposed that their res judicata effects be determined based on the theory of the absolute extension of effects, which ensures cross-border legal certainty and accords with the modern liberal evolution of recognition rules. As regards arbitral awards, it is suggested that arbitral institutions adopt, in their regulations, broad preclusive rules that reflect the nature and objectives of the arbitral process. The proposed solutions share the idea that the res judicata effects of a “non-domestic decision” should be in principle determined according to the “system” to which the decision belongs, although the adoption of a unitary approach is challenged when res judicata issues arise between state courts and arbitral tribunals so to jeopardize the autonomy of international arbitration.

Texte intégralTo what extent do the increasingly widespread, pervasive and dramatic impacts of climate change, jeopardise the resilience of the universally recognised human rights system? This research aims to discuss climate change challenges and what legal instruments are currently available to guarantee the full protection of fundamental rights in the new climate-altered context. The anthropogenic nature of climate change is a fundamental ground of this research: the relevance of the climate emergency in the current global scenario is in fact documented by decades of scientific evidence and series of accredited data, systematised and disseminated by research entities and international organisations. The review of the large number of available reports and the selection of the most relevant and accredited data constitute the skeleton of solid evidence on which this research is based. Since The Limits to Growth Report in 1972, countless publications have highlighted the dangers posed by the environmental incompatibility of the economic model with the full protection of human rights. Climate change emphasizes such incompatibility and increasingly threatens the enjoyment of most fundamental rights, including the right to life, health, a healthy environment, food, clean water and self-determination. International organisations, including the UN Human Rights Council, have affirmed and recognised that climate impacts have direct and indirect implications on the effective enjoyment of universal rights. For at least two decades, the United Nations, through its agencies, bodies and activities, have been trying to induce member states to coordinate and multiply their efforts to combat climate change to guarantee the protection of climate-related rights. Following the evolution of the human right to a healthy environment, the doctrinal discussion that arose around the emerging need for protection has been oriented towards the reinterpretation of existing cases in the light of current climate profiles. Alongside this effort of re-signification and specification, the push, coming from many sources, for the recognition of a specific "human right to a safe climate" appears very relevant. The theoretical register through which the analytical reading of the process of affirmation of the new demands is presented is that of Political Ecology, which provides an integrated approach to the reading of environmental issues, using elements of analysis borrowed from sociological and anthropological studies, political science, economics and legal science. Such perspective responds to the need to highlight the connections between political, social and economic factors and ecological challenges, paying particular attention to the effects of environmental threats in terms of justice, discrimination, socio-economic impoverishment and the role of social actors. This relationship is particularly relevant for the full understanding of the climate change phenomenon (both in terms of asymmetry of responsibilities and asymmetry of impacts) and for the identification of effective responses to counter the multiple social implications of global warming. The same kind of integrated perspective between environment, rights, vulnerability, social, political and economic factors, although with different origins and aims in principle, has led to the affirmation of the paradigm of first Environmental Justice and then Climate Justice. These notions are based on the observation of an unequal distribution of environmental and climate risks and impacts - which systematically penalises the most vulnerable sectors of the world's population with greater severity - and constitute the theoretical reference for this study. From a more strictly legal point of view, in addition to the reconstruction of the main stages of the international debate on the relationship between human beings and the environment, this research traces the path that led from the affirmation of the concept of sustainable development to the possibility of legally qualifying - and defend in court - the rights of future generations. The focal point of the excursus is the examination - with particular reference to the documents drawn up by UN bodies (Human Rights Council, General Assembly, Special Rapporteurs' Reports, etc.) - of the stratified links between climate change and the protection of human rights, as well as the existence and configurability of a human right to a stable and safe climate. The legal foundations, the contents and the potential in terms of effectiveness of the protection of such a right are widely argued in this study. The declination of the link between human rights and climate change through the recognition of a specific human right to a safe climate becomes stronger also in the light of the importance assumed by the judicial route to climate justice. In the last decade, legal actions in the climate field have become a tool for claiming and asserting the protection of individuals and communities from the impacts of climate change, used by civil society with increasing frequency and capillarity. The aforementioned scientific evidence shows that a drastic and rapid reduction in greenhouse gas (GHG) emissions is essential to avoid an irreversible imbalance in the climate system and to avert the consequences that ensue. Despite the international instruments in place and the existing national regulations, GHG emissions’ reduction has not yet taken place, a sign of the widespread inertia that is incompatible with a timely reversal of climate change. Consequently, this type of legal dispute aims to involve judicial bodies by calling on judges to play an active role in combating global warming. The examination of the theoretical orientations and the in-depth study of the different legal approaches and cultures from the vast and constantly evolving field of climate litigation, carried out by means of an extensive international cases study, traces a comprehensive overview of the new legal field, highlighting its relevance, trends, challenges, legal issues and perspectives. The rethinking of the role of law as a function of the containment of uncertainties about the future posed by climate change appears to be a central perspective to which this study aims to contribute; the basic question to be addressed is whether in a legal system capable of fully reflecting the scope of such urgency, climate inaction can be considered a violation of human rights and with what consequences. In a multi-dimensional climate governance system, climate litigation stands as a new and useful element and constitutes a valuable tool for the realisation of Climate Justice.
