The exploration and use of outer space, which began in the mid-twentieth century, led to the formation of international space law, designed to regulate the relations of States in this relatively new sphere of human activity. The undulating nature of the development of this branch of international law, for objective reasons, has led to the complication of international legal regulation of space activities. The dynamics of scientific and technological progress and the development of technologies in the space sphere exacerbates competition between space powers and international organizations, creates new challenges for international cooperation in space exploration and requires innovative legal solutions. The doctrine of international law is faced with the task of generalizing new problems and processes and developing conceptual models for the further development of international space law. The dynamics of the conceptual perception of international space law is traced, new theoretical approaches to the concept of the international legal status of outer space and individual regimes and concepts of its use in modern conditions are proposed. Taking into account the trends in the institutionalization of international space activities and the impact of economic integration processes on international cooperation in space, primarily in the Euro-Asian region, the role of international organizations in the international legal regulation of space activities and the harmonization of national legislation is analyzed. In addition, certain aspects of future space exploration are considered as a legal forecast. For researchers, teachers, postgraduates and students, civil servants and practicing lawyers, as well as for anyone interested in the problems of modern international law.

Key nosological questions facing the DSM-5 and ICD-11 work groups on obsessive-compulsive and related disorders (OCRDs) included whether putative OCRDs should be classified together, and whether obsessive-compulsive disorder (OCD) should retain its classification as an anxiety disorder. Given that some of the putative OCRDs were new to the official nosologies, the work groups also had to grapple with the perennial questions of how to decide whether any condition is a mental disorder, and how to draw boundaries between disorder and normality. This chapter reviews some of the conceptual questions that emerged and some of the practical solutions that were suggested. The emphasis on both diagnostic validity and clinical utility is consistent with an integrative approach which holds that nosology should be both evidence-based and values-based.

“Interdisciplinary Cases and Disciplinary Knowledge: Epistemic Challenges of Interdisciplinary Research” provides a conceptual framework of interdisciplinarity in the context of contemporary philosophy of science and social epistemology. It describes a widespread tension between the interdisciplinary commitment to complex real-world problems and the disciplinary strategies to build simplified models. While real-world problems call for highly specific and context-sensitive solutions, disciplinary problems serve as exemplars of more a general type. The epistemological challenge of interdisciplinarity is to relate knowledge about complex and singular cases with knowledge about generalized concepts and causalities. This relationship calls for a combination between the “humanistic” ideal of understanding the individual case, and the “scientific” search for common features of different cases. In practice interdisciplinary projects find ways to bridge causal explanation and the concern for the case. An epistemological attempt is made to conceptually integrate the search for universally applicable knowledge and idiographic richness.

This chapter examines the problem of evaluating policies with either risky or uncertain consequences. Under risk, the probabilities are known and agreed, whereas under uncertainty, probabilities are subjective and subject to disagreement. In the case of risk, Harsanyi’s Social Aggregation Theorem derives a representation of social utility as a weighted sum of individual utilities. But when there is uncertainty, two different and conflicting evaluation criteria, that is, ex ante and ex post, become available. The chapter explores this problem and sketches solutions. Similarly, when equality becomes the guiding question, there is a tension between ex ante and ex post evaluations, each leading to a conceptual loss, and the chapter explores solutions given to this further problem. It also covers Harsanyi’s Impartial Observer Theorem and its recent developments, and discusses the question raised by Sen of whether the weighted sum of individual utilities obtained by Harsanyi makes genuine utilitarian sense.

Abstract We live in a pluralist world of transnational law and governance. More than ever before, multiple legal systems and governing authorities at different levels—state, supranational, international—are recognized as applying to, and claiming authority over, the affairs of the same sets of individuals and institutions. Yet our constitutional theories in terms of our conceptual toolkit of law and legitimate authority fail to adequately capture this pluralist state of affairs. This book examines some of the key conceptual and theoretical puzzles which the contemporary state of transnational pluralism poses for our constitutional theories. It offers fresh perspectives on these questions by addressing the plurality of norms and authorities from the viewpoint of legality and legitimacy respectively, proposing novel solutions to how constitutional theory can be pluralized in the light of these perspectives. Our turbulent times are on a steady trajectory of ever-more pluralism of transnational law and governance to tackle the defining social and political problems of our age involving populism, pandemic, and climate change, and this book provides an essential intervention in debates on how to pluralize constitutional theory to understand and, perhaps more importantly, legitimize the tools to address these shared global problems.

Recent attempts to include and assess public heritage in the accounts of governments and charities are controversial. There are many kinds of value, not merely financial, and various measurement bases. This chapter examines why and how we account (if at all) for heritage assets bringing out the surrounding controversy. Is public heritage an asset that should be included in the reported wealth of public bodies and nations? The economic valuation methods, revealed preferences and stated preferences are the economic valuation methods investigated and considered in relation to the decisions to be made on public heritage. Although the conceptual and practical problems surrounding valuation and reporting of public heritage are immense, pragmatic solutions should be sought. Multidisciplinary approaches are necessary to make informed decisions on management, financing, and the allocation of resources for public heritage.

Given that recovery of people with mental health challenges is often a personal experience inclusive of autonomy, the development and provision of recovery-oriented services may benefit from identification and discussion of potential ethical conflicts and challenges. This chapter includes a conceptual and theoretical analysis of ethics in relation to recovery from mental illness, and a literature review to identify known ethical conflicts or challenges. Proposed solutions include shared decision-making, community treatment orders, and psychiatric advance directives; however, there is a dearth of evidence on their effectiveness. Mental health agencies, as well as self-regulated professional colleges, may be a potential designate for the development of clinical practice guidelines to help identify and address common ethical conflicts in this area. Doing so may help both service users and service providers successfully navigate ethical challenges in a way that best promotes recovery.

This chapter explores scholarship on work, family, and community, suggesting ways to move it forward in new and exciting directions. Different ways of conceptualizing community are described, along with issues surrounding the lack of conceptual clarity in the treatment of community in the work–family literature. The main theories that are used to guide the study of community, work, and family are outlined, including ecological theory, life-course theory, and the demands and resources perspective. The existing work–family and community scholarship is described, with a focus on how community is related to family, work–family, and individual outcomes. Emerging scholarship on family supportive communities is explored, along with scholarship on the impact of contemporary work–family trends on community involvement. Lastly, promising areas for future research are proposed, with an eye toward identifying solutions at the community level for working families.

This chapter reviews the research on marketing and reputation relevant to Professional Service Firms (PSFs). Although there has been relatively little research to date which explores both fields concurrently, the authors organize the material by problematizing the issue of marketing within PSFs. They introduce and provide a conceptual model of reputation that explores its antecedents, such as service quality, social networks, and rankings as well as consequences such as sales effectiveness, premium pricing, and client loyalty within PSFs. Reputation has often been conflated with other related terms such as identity and image and the authors provide some clarification on defining and measuring reputation. The chapter explores this and other problems inherent within the application of reputation to marketing principles and practice to PSFs as well as hints at solutions. Finally, the authors identify a future research agenda for both marketing and reputation.

Chapter 2 studies the relationship between historicism and Romanticism. It locates the two between Enlightenment materialism, on one side, and Marxian historical and dialectical materialism, on the other. In so doing, it isolates a paradox of materialism—namely, its production of the very concepts that undo it. These include the ideas of knowing as dissociated conceptual activity, and consciousness as absolute negativity. Romanticism and historicism, it is argued, represent solutions to a common problem—a claim defended through a reading of Wordsworth’s sonnet “The world is too much with us.” In considering how we position ourselves in relation to past literature, the chapter evaluates the choices between contemplation and empathy, knowledge and power, blame and defense. As such, it represents the first move in a self-critical turn on the new historicist method that had shaped the author’s—and part of the field’s—work in the previous decade.

This chapter begins with an introduction to the basic ideas behind clinical mathematical and computational modeling. In general, models of normal cognitive-behavioral functioning are titrated to accommodate performance deviations accompanying psychopathology; model features remaining intact indicate functions that are spared; those that are perturbed are triaged as signifying functions that are disorder affected. Distinctions and interrelations among forms of modeling in clinical science and assessment are stipulated, with an emphasis on analytical, mathematical modeling. Preliminary conceptual and methodological considerations are presented. Concrete examples illustrate the benefits of modeling as applied to specific disorders. Emphasis in each case is on clinically significant information uniquely yielded by the modeling enterprise. Implications for the functional side of clinical functional neuro-imaging are detailed. Challenges to modeling in the domain of clinical science and assessment are described, as are tendered solutions. The chapter ends with a description of continuing challenges and future opportunities.

This chapter discusses the Norwegian governance regime for public megaprojects and the lessons learned. Governance regimes for major public investment projects comprise the processes and systems which the financing party must implement to ensure a successful investment. Such regimes typically include a regulatory framework, compliance with agreed objectives, and sound management and resolution of issues that may arise. The challenges in securing quality at entry include identification of a conceptual solution that is economically viable and relevant with respect to the needs and often conflicting priorities in society, avoiding underestimating costs, overestimating utility and making unrealistic and inconsistent assumptions, and securing essential planning data and adequate contract regimes. The Norwegian regime involves external quality assurance of key decision documents, and has given the government greater control over the total cost of its investment project portfolio. It also ensures that decisions regarding the choice of conceptual solution are based on a broad assessment of overall needs and goals, as well as alternative ways of achieving these goals.

We start with the observation that most of the current innovation policies are not holistic because they only focus on a few determinants of innovation processes.
