Texte intégralThe thesis explores the topic of consistent interpretation in a comparative perspective, comparing the legal systems of Italy, the United Kingdom and France. The legal systems have been selected in light of their similarities — they are mature democracies involved in the processes of European integration, the European Union and the Council of Europe — but also taking into account the differences among them, stemming from their belonging to the common law and civil law families, and, consequently, the diversity in the fields of the sources of law, constitutional justice and the role of the judiciary. In addition to the analysis of the whole spectrum of consistent interpretation (constitution-compatible, EU-compatible and rights-compatible, in accordance with the European Convention on Human Rights), other phenomena (such as the theory of constitutional statutes in the UK, and the doctrine of the general principles of law in France) are subject to scrutiny, as they seem to share with consistent interpretation the aim of piecing together the various sources of law of a multi-level legal system. The study shows a substantial convergence in the use of consistent interpretation techniques across the three legal systems considered, with regard both to their conditions, and to their limits, and argues that consistent interpretation should be considered a result rather than a process, whose foundation lies not on the hierarchical structure of the sources of law, but on the axiological value of certain principles.

Texte intégralThe research hereby provided proposes an analysis of the summary judgment procedure, introduced by the Italian legislator in 2009, in three different perspective: historical, constitutional and comparative. In particular, the first part of the work focuses on the evolution of this procedure in the Italian territory, starting from the codifications of the end of the 18th century and up to the current discipline. In this context, the prerogatives of every individual discipline are considered above all in search of profiles of novelty or aspects already present in previous codifications that can be found even in the current legislation. The second part of the analysis investigates some of the most important critics concerning the relationship between the principles of the Italian Constitution and some provisions of the summary judgment procedure provided in articles 702 bis and following of the Code of Civil Procedure. In particular, in this section, four apparent antinomies are identified as potentially suitable to compromise the constitutional legitimacy of this procedure and with regards to each of them, after an examination of the principle potentially violated, the research proposes, where effectively possible, a constitutionally oriented interpretation, pointing out, in default, the need for a reform of the discipline. In its final part, the research focuses on the discipline of the English legal system, identified as a privileged reference of the comparative analysis, both from the point of view of the regulatory principles of the matter and with regard to the specific provisions adopted in order to achieve a faster definition of the disputes in civil courts. The proposed analysis will allow the writer to carry out some comparative reflections with regards to the choices adopted in our legal system, that could possibly result in proposals for the adjustment of some of the provisions governing our civil procedure.

Texte intégralIn this dissertation I analyze the theme of Penelope from the point of view of comparative literature, in the light of a selection of recent criticism, and with the aim of writing a short series of critical essays that are shaped in various sizes and show a different composition. Starting from Homer's and then Ovid's text of this ancient female mythological character, I thus investigate a choice of poetic and narrative works which renew her figure, by also recreating her motives, within the domain of Western literature of the twentieth and twenty-first century – particularly English literature.

Texte intégralDespite it is a subject always "de lege ferenda", the degree of punishable negligence is still one of the issues of contemporary criminal law, even after the recent reforms of medical malpractice's responsibility. The theoretical embrace of criminal negligence with the civil one, makes it necessary to rethink our model based on "simple" negligence. This dissertation, then, starts from the recent italian reforms of medical malpractice's responsibility, which had promised a rethinking of the medical negligence. Then, the discourse moves to the comparison with "common law" legal systems, which have a different type of negligence: "Gross Negligence". This analysis of case law and theory (in particular British, American and New Zealand) is very intersting for the civil lawyer who wants to deal with the degree of punishable negligence.

Texte intégralThe research study is part of the present renewed interest in citizenship and aims at exploring the ways through which citizenship, intended as membership and belonging in a social and political community, is under pressure and subjected to powerful changes due to the increasing ethnic, religious, linguistic and cultural pluralism that characterizes contemporary Western societies. The research examines "citizenship as belonging" in its three main "dynamics": acquisition of citizenship – notably naturalization –, denationalization and dual citizenship. At the end of the comparative analysis – which takes Canada, UK and Australia as prototypical case studies – it could be argued that "citizenship as belonging" is undergone a restrictive and cultural turn that ends up excluding some classes of people. This restrictive and cultural turn results in the so-called culturalization of citizenship, in the worrying return to “citizenship as a privilege” rhetoric and in the promotion of the sole formal belonging to the community.

Texte intégralDi norma gli artropodi, nella loro vita postembrionale, affrontano periodicamente cicli di muta per potersi accrescere, essendo dotati di un esoscheletro rigido che racchiude il corpo dell’animale. Quando la muta coinvolge improvvisi e vistosi cambiamenti nella struttura dell’animale si parla di metamorfosi, un fenomeno caratterizzato da numerosi eventi di apoptosi e proliferazione cellulare. Proprio per questa ragione, lo studio dei processi coinvolti nella metamorfosi è diventato un tema ricorrente ed importante per la biologia evoluzionistica dello sviluppo (evo-devo) degli artropodi. Il principale limite di queste ricerche, tuttavia, riguarda il fatto che sono limitate ad un ristretto numero di specie e trarre conclusioni generali basandosi unicamente sui dati raccolti da pochi sistemi modello può rivelarsi rischioso. Gli studi più recenti sulla metamorfosi sono stati svolti su specie caratterizzate per la maggior parte da una metamorfosi di tipo sistemico. Si tratta principalmente di insetti olometaboli, nei quali il passaggio allo stadio adulto è costellato da cambiamenti che coinvolgono tutto il corpo dell’animale, eventualmente con gradi di intensità diversi. Tuttavia nella maggior parte degli altri artropodi i cambiamenti postembrionali sono notevolmente meno estesi, come avviene, ad esempio, negli insetti emimetaboli. Una situazione sicuramente meno frequente è quella in cui ad essere investite da un brusco cambiamento nello sviluppo siano uno o pochi segmenti non terminali, inizialmente uguali ai moduli che li precedono e che li seguono lungo l’asse principale del corpo. Questo tipo di trasformazione postembrionale, confinata in un distretto del corpo ben circoscritto, è definita, in questa tesi, metamorfosi non sistemica e si può trovare nello sviluppo postembrionale dei maschi dei millepiedi elmintomorfi. Nei maschi dei millepiedi elmintomorfi, durante il processo di crescita postembrionale, avviene un brusco cambiamento che coinvolge solo uno o due paia di appendici non terminali, inizialmente non diverse da tutte quelle che le precedono e le seguono, nel mezzo di una lunga serie omonoma. Negli adulti, infatti, queste appendici, localizzate nel settimo anello del tronco, sono modificate in gonopodi, i quali sono usati come organi di presa o veicoli per il trasferimento dello sperma durante la copula. Osservando nel dettaglio lo sviluppo del settimo anello possiamo notare che: durante i primi stadi di sviluppo è identico agli altri e porta due paia di zampe convenzionali; in un qualche stadio successivo le zampe vengono sostituite da strutture estremamente ridotte (appendici squamiformi) che, successivamente, diverranno gonopodi. Lo scopo di questa tesi è quello di indagare la metamorfosi dell’ottavo e del nono paio di zampe, corrispondenti al settimo anello del tronco (unità morfologica generalmente equivalente a due segmenti convenzionali) dei seguenti diplopodi: due blaniulidi Nopoiulus kochii (Gervais, 1847) e Blaniulus guttulatus (Bosc, 1792), uno julide nemasomatide Nemasoma varicorne C.L. Koch, 1847 ed un polidesmide Oxidus gracilis (C.L. Koch, 1847). In particolare, ho analizzato l’ultimo stadio in cui i maschi presentano l’ottavo (ed eventualmente il nono) paio di appendici locomotorie, gli stadi in cui queste sono sostituite da appendici squamiformi e il primo stadio che presenta i gonopodi. Gli studi effettuati hanno previsto principalmente indagini di morfologia esterna, basate sulla microscopia ottica e sulla microscopia elettronica a scansione, mentre l’anatomia interna è stata descritta principalmente attraverso l’utilizzo di protocolli istologici. Le strutture endoscheletriche associate ai gonopodi sono state studiate attraverso l’uso del microscopio confocale a scansione laser, sfruttando l’autofluorescenza della cuticola. Dai risultati ottenuti emerge che le modificazioni esterne dovute alla metamorfosi non sistemica nei diplopodi sono associate a un notevole riarrangiamento dell’anatomia interna, documentato per la prima volta con questa tesi. Il grado di intensità dei cambiamenti interni è diverso nelle quattro specie: i due blaniulidi risentono maggiormente dell’impatto che i gonopodi hanno nell’architettura generale del tronco, in particolare a causa delle voluminose strutture endoscheletriche. Al contrario in N. varicorne, ed in particolare in O. gracilis, l’anatomia del tronco viene modificata in modo meno significativo. Nel polidesmide è stato anche possibile effettuare alcune osservazioni durante l’ultimo periodo di muta, durante il quale avvengono le maggiori modificazioni trasformando le appendici squamiformi in gonopodi. Viene inoltre presentata un’ipotesi sui meccanismi di base che caratterizzano la formazione dei gonopodi nei millepiedi, secondo la quale i cambiamenti del settimo anello dipendono dalla presenza di un marcatore segmentale prodotto durante lo sviluppo embrionale, che viene attivato solo molto più tardi, quando iniziano i cambiamenti dovuti alla metamorfosi non sistemica.

Texte intégralThe aim of the PhD thesis is to compare, through the comparative methodology, some legal tools of the reduction of working hours, aimed at pursuing the safeguarding of job’s places, in Italy, France and Germany. The first chapter shows the Italian legal framework of the "defensive solidarity contracts", and "expansive solidarity contracts", by Law n. 863/1984 up to the D. Lgs. n. 148/2015. The second chapter focuses on the French social security system, on "French defensive solidarity contracts", called "accords de maintien dans l’emploi" and the "expansive solidarity contracts", called "accords de développement de l’emploi", as amended by Law n. 1.088 of 2016. The third chapter focuses on German anti-crisis instruments of working hours reduction, such as the "Kurzarbeit", the "Arbeitszeitkorridor" and the "Arbeitszeitkonto", and their legal framework related to the jurisprudence of the European Court of Justice. The PhD thesis ends with a reflection regarding the effectiveness of these anti-crisis measures of the reduction of working hours, thanks to the economic analysis of law.

Texte intégralThe thesis aims at analysing, from a comparative perspective, the role of medical ethics in Italy, France and Germany. The survey focuses on both the formal and substantive aspects of the relationships between law and medical ethics. As to the first issue, the thesis analyses the codification of medical ethics, the normative function of the medical councils, the binding value of the codes of medical ethics and their position in the hierarchy of norms. With regard to the second aspect, the role of medical ethics is studied from a more substantial perspective, analysing the concrete interrelations between law and medical ethics in the field of biolaw. The survey is then extended to the disciplinary procedure and to the European level. In the first part, the relationships between law and medical ethics are analysed from a linguistic perspective, aiming at underlining some specific features of the concepts referred to as “déontologie”, “deontologia” or “Standesrecht” and “Berufsordnung” in France, Italy and Germany. This part also deals with some “open questions” characterising the relationships between medical ethics and the law. The second part concerns the codification of medical ethics, while its role in the field of biolaw is analysed in the third part. The fourth part deals with deontological liability and disciplinary procedures. Lastly, the fifth part aims at elaborating a theoretical reconstruction of the results of the comparative analysis, at highlighting the main roles of medical ethics at the European level and at suggesting a different model for the relationships between law and medical ethics in the Italian system
L’obiettivo della tesi è un’analisi comparata del ruolo della deontologia medica nel sistema delle fonti del diritto in Italia, Francia e Germania. Per tenere conto della complessità del rapporto tra diritto e deontologia, sono stati analizzati sia gli aspetti formali di tale rapporto, sia i profili sostanziali del ruolo della deontologia medica nel biodiritto. Nella prima parte alcune considerazioni preliminari e l’analisi linguistica hanno permesso di definire l’ambito di indagine e i profili di maggiore complessità del rapporto tra dimensione deontologica e dimensione giuridica sui quali nelle parti successive si è concentrata l’indagine. La seconda parte, dedicata alla codificazione dell’etica medica, ha messo in luce la varietà di soluzioni e di modalità di ingresso della norma deontologica nell’ordinamento giuridico. Nella terza parte sono stati analizzati il ruolo della deontologia medica nell’ambito del biodiritto e l’influenza di alcuni fattori particolarmente rilevanti sull’evoluzione dei contenuti concreti dei codici deontologici e sulla loro portata pratica. La quarta parte è dedicata alla violazione della deontologia e ai procedimenti disciplinari. Infine la parte conclusiva contiene una ricostruzione teorica dei risultati emersi dall’analisi comparata, lo studio di alcuni profili legati alla dimensione europea della deontologia e la proposta di alcune ipotesi di riforma per un modello italiano più coerente, flessibile ed efficace dei rapporti tra diritto e deontologia

Texte intégralThe thesis concerns a comparative analysis between Europe and Latin America regarding the phenomenon of social dumping and its close relationship with the international employment contract and related working conditions. The research has required the study and analysis of "varied" and multidisciplinary reference sources, taking into account that it is a multifaceted phenomenon, which has become more common in relatively recent periods and has been the subject of very different interpretations, sometimes even antithetical. The aim of this research is multiple. Firstly, the thesis sought to define the perimeter of the phenomenon, extracting a possible legal definition, which is still absent in the existing regulatory framework. Secondly, through a comparative analysis between Europe and Latin America, the research analyzed the trend of social dumping in different contexts, in particular, in a developed and in a developing country. In its third and last objective, the thesis, by taking out the pros and cons of social dumping, tried to identify a future path in where it will be possible – through proactive behavior on behalf by all those involved – to make a positive contribution to counter the negative phenomena of dumping while increasingly protect social rights.

Texte intégralThe research approaches the problem of the relationship between the Divine Comedy and the Roman de la Rose. At the present time, the studies concerning this topic have adopted mainly a stylistic approach useful to the solution of the attribution of the “Fiore”, without getting permanent and shared solutions to the problem. The writer, in this work, proposes a different point of view about the methodological approach. The relationship between the two works is being addressed according to a circumstantial paradigm, in which intertextuality is evaluated in relation to the memory of the image. Thus, it was concluded that the contrastive analysis with the Roman de la Rose can give some hermeneutical contributions to the Dante criticism; contributions able to show a level of significance of the text that allows to appreciate the relationship of the Comedy not only with Provencal tradition and the thirteenth-century lyric poetry, on one side, and the allegory of medieval Latin, on the other side; but also with the experiences of speculative mysticism of that period. The theme of the feminine image of "otherness" and the semiotics of narcissistic mirroring are particularly important in this work.

Texte intégralIn the Italian legal framework, the question concerning the regulation of procedures and contents of collective bargaining represents one of the major labour law issues, which has not found a satisfying solution yet. The abovementioned topic is, in addition, strictly connected to the selection of criteria aimed to determine the actors of the bargaining process. The purpose of the present dissertation is then to examine, first of all, the historical development of the debate on the aforementioned issues in the Italian context, to focus attention, afterwards, on the most recent instances to enact a clearer regulation of the bargaining process, in reason of the crisis of trade unions’ cohesion and of the fragmentation of production originated by globalisation. Finally, the last part of the dissertation will be centred on a comparative analysis with the French regulative context that, in opposition to the Italian one, disciplined by law prerequisites and procedures to accede to collective bargaining process already at the beginning of XX Century. In particular, the first chapter starts from the matter of contention at the base of the whole national discussion referred to the regulative process of arrangements executed between employers’ and workers’ organizations: the incapability of the Italian legislator to enact a law concerning the collective bargaining proceeding respecting, in the meantime, the criteria set forth by Article 39 of the Constitution, that has been at the base of the consequential declaration of illegitimacy of all the legislative attempts to generalize the efficacy of the considered agreements, circumventing the provision of the Fundamental Chart. The analysis continues focusing on the evolution of collective agreements regulated by civil law in the national legal framework: highly centred during the Fifties, then organized on two ordered levels in the brief period of “contrattazione articolata” – introduced initially in public industries with the Protocol Intersind-Asap of 1962 and soon extended to the private field – until the total independence between company and sectorial bargaining level in the years between the end of the Sixties and the beginning of the Seventies, and to the particular characteristics assumed by the said agreements during the oil crisis and in the following years, when the practice of the three-side covenants executed between main trade unions, employers’ organizations and the government, with different outcomes, perdured until the middle of 2000’s. In this context, particular attention is devoted to the collective agreements executed at national level in July-December 1993 that, during the following twenty years, have been considered the fulcrum of the two-level collective bargaining system, and which attempted, in the meantime, with the introduction of Trade unions’ Unitary Representative bodies (in Italian, Rappresentanze Sindacali Unitarie, RSU) to contrast the deep crisis of representativeness of workers’ organizations, whose gravitas has been highlighted, several months after, by the national referendum held in 1995 on Article 19 of law no. 300 of 1970. The last section of the first chapter founds an ideal continuation in the second one. In this field, the main topic become the most recent issues concerning the Italian bargaining system, and significantly the one which moved social actors of the industrial sector – on the base of the crisis of the system of 1993, showed by the Fiat dispute of 2009-2011, followed by the connected judgment of Constitutional Court that in 2013 modified another time the interpretation of Article 19 of law no. 300 of 1970, expanding the criteria to admit workers’ organization to benefits provided by the law, and by the enactment of Article 8 of law-decree no. 138 of 2011 – to affirm that is come the time to set new rules to try to govern the bargaining system. On this point, the dissertation focuses attention on the three national collective agreements held on 28 June 2011, 31 May 2013 and 10 January 2014 and on the further arrangement of 28 February-9 March 2018 and on the respective debate centred, in a perspective of reform, on the opportunity to introduce a bill able to completely fulfil the requirements of Article 39 of the Italian Constitution. The third chapter, finally, follows the scheme of the precedent ones, from the point of view of the French legal framework. Therefore, firstly is described the evolution of the said juridical context, from the loi of 1919 concerning collective agreements regulated by civil law and the regulations of 1936 and of 1950 on the extension erga omnes, through an administrative decree, of collective agreements signed by representative trade unions, until the new model of “citizenship in the company” promoted by the laws Auroux enacted in 1982 and to the fragmentation of the labour law system occurred between the 80s and 2000s, characterised by measures without a systematic approach and, sometimes, in contrast between each other. The attention is focused, then, on the reforms that, recently, heavily redefined the structure of the French labour law framework consisting in the introduction, in 2008, of objective criteria to select representative trade unions, in the extension of this model to employers’ organizations in 2014-2016 and, with reference to the bargaining structure, in the disputed reform responding to the name of loi Travail, held in 2016, and in the ordonnances promoted by the new President Macron in the late 2017, towards the direction of a relevant and decisive expansion of company collective agreement, to the detriment of sectoral level. The arrival point of the path traced above regards the attempt to reply to the issue concerning the opportunity to provide or not, in the Italian context, for a law regulating collective bargaining and the related obligations and rights of social actors, to clarify and stabilize the arrangement system. Secondly, also on the base of the comparison with the French frame of reference, the dissertation is closed by a reflection on the possible legal institutes to be introduced in the Italian juridical framework, in order to assure a general extension of collective bargaining, in the light to allow an harmonious development also of the company level.

Texte intégralThe research analyzes through the comparative method, the answers that the law - as social science - is offering to the widespread problem throughout the Western world of a greater need for health care; (particularly) because of the insufficiency of public financial resources and of the lack of support from institutional bodies. In European countries, it is proved that it is not easy to satisfy the need to find the right balance between public and private, in the field of healthcare and the protection of fundamental rights. This requires complementarity and integration between operators. Starting from the analysis of the Italian system, the research compares some main systems and identifies legal solutions - always in the dichotomy between public and private - that can be usefully transplanted in Italy. The research unfolds through precise and fundamental guidelines. The first is devoted to a historical reconstruction of the welfare systems and to the various classification proposals that have been drafted over the years according to the existing macro-categories: (i) social sickness insurance, (ii) universal model and (iii) private insurance. This preliminary analysis leads to a first conclusion that there is no coherence between the classification of welfare systems and the concrete characteristics assumed by national health systems. In fact, welfare policies created differentiated systems, but they are not necessarily the expression of the political regimes within which they developed, so that the forms assumed are an expression of the complexity of the dynamics that influence the development of a single system. The second guideline is the analysis of some individual systems and the comparison among them. It is firstly considered the French model, which provides for the intervention of three main operators in the complementary assistance sector: mutual aid societies, social security institutions and insurance companies. From the analysis carried out, emerges a non-lucrative vocation of the system that reflects the solidarity approach to the themes of healthcare and protection, really rooted in France and characterized by an interventionist and guaranteeing State. The system is projected to the recognition of the rights of the patient, and the citizen is an active part of the system being involved in the economic aspects for a greater responsibility. Whereas the American system, the nature of which is completely opposite to the French universalist inspiration, represents a unique experience in the global context. Among the main stages of the US welfare, the following must be remembered: the Social Security Act of 1935 (a reform wanted by president Roosevelt through which the American system started experimenting with the idea of state subsidies); social protection programs (Medicare and Medicaid) mainly aimed at vulnerable people, and, lastly, the so-called Obamacare (made up of two provisions: the Patient Protection and Affordable Care Act, and the Healthcare and Education Reconciliation Act). The latter is a revolutionary reform, a constant source of attention in the US political landscape and the exceptions of constitutional illegitimacy raised have been verified, with particular attention to the balance between federal and state power. Balancing that is particularly expressed in the insurance sector which, in the narrowest field of health protection, sees the presence of various operators including insurance companies, mutual insurance companies, fraternal benefit societies and Health Care Sharing Ministries. Among these the last two are expressions of US particularism.

Texte intégralThis work focus on the study of co-development as a specific strategy through which the linkage migration&development is declined. Co-development foresees migrants associations to play a role as leading characters in undertaking development projects in the homeland co-operating with partners in both shores of migration. It represents a triple win strategy, and it can bring advantages in the country of origin, in the country of destination and for migrants themselves at the same time. In particular the research investigates the effects brought by co-development on the integration process in migrants resident context. Furthermore the research analyses how the resident context provides incentives for migrants association to act transnationally. With this aim the study compares two different arrival contexts analysing the different development initiatives realised by Ghanaian migrants associations back home. Using a qualitative approach, a multi-sited research has been carried out in three different fieldworks: Italy, the United Kingdom and Ghana. The research puts into light the different effects that co-development produces on the interaction between transnationalism and migrants integration in the context where they live, and how this produces, as a result, some effects on the process of development in the context of origin.
