In both conventional and electronic buying and selling agreements, the protection of consumer rights should be the main concern of business actors. Although there are already regulations governing consumer protection, until now there are still frequent violations of consumer rights, especially in e-commerce transactions. This article is juridical-normative research that compares the laws and regulations concerning consumer protection law in e-commerce transactions between Indonesia, India, and the United States. Through comparative studies and analysis using data sources from the literature, this study explores how the legal certainty of consumer protection in e-commerce transactions in Indonesia is being achieved. In addition, this research also describes the comparison regarding the legal certainty of consumer protection in e-commerce transactions in Indonesia between India and the United States based on the United Nations Guidelines for Consumer Protection. Furthermore, this study provides a prescription for how the legal certainty of consumer protection in e-commerce transactions in Indonesia should be when viewed from a comparison of consumer protection laws in e-commerce transactions in India and the United States.

Nowadays, online shopping has become a very common form of shopping in China. The sales of shopping carnivals such as 618 and single day also allow people to intuitively see the continuous development of e-commerce platforms. But in fact, the Internet only entered China in early 2000, and e-commerce has developed so rapidly in just a dozen years. However, looking back at the United States, a country where the Internet was first used and developed, why do U.S. e-commerce platforms not gain such a large market share as China's e-commerce platforms? This paper takes this as a premise, compares the e-commerce brands of Amazon, the most important e-commerce industry in the United States, and Alibaba, the famous e-commerce company in China, to explore the differences between Chinese and American e-commerce, and analyzes the possible reasons for these differences.

AbstractThe United States wine industry has experienced tremendous growth in the past twenty-five years. The number of wineries in the United States has grown to almost 5000, located in all fifty states, and creating over a million full time jobs. Alcohol distribution laws that hinge on the Supreme Court's reconciliation of the Twenty-first Amendment and the Commerce Clause have significantly hindered the industry's ability to expand. Current interpretations of the 21st Amendment give states unprecedented freedom to regulate interstate commerce in alcoholic beverages. The resulting regulatory diversity presents problems both domestically and internationally. (JEL Classification: K2, L5, N4)

In 1993, the US Department of Commerce began to levy countervailing duties on imports of certain leaded bars from the United Kingdom. The United States applied tariffs to goods imported from British Steel Engineering Steels, a subsidiary of British Steel plc. Following investigations by the US Department of Commerce and the United States International Trade Commission, the US authorities held that the imposition of duties was both required by Section 701 of the Tariff Act of 1930 (as amended) and not in violation of any of the country’s obligations as a member of the World Trade Organization.

This article deals with the protection of consumers when they enter e-commerce transactions with foreign companies. Most states reacted to the growing importance of e-commerce by enacting data protection and consumer protection legislation and by requiring registration of e-businesses. Companies have found a way to circumvent the consumer legislation by offering the consumers to agree to a choice of foreign courts and laws which are included in their terms and conditions. Consumers give away the protection of their home state simply by clicking to accept the general terms and conditions on the company’s website. The purpose of this article is to examine if the solutions and the experience from the United States and the European Union could serve as a model for transnational protection of consumers in e-commerce. The authors discuss the different levels of protection offered in the United States and the European Union and consider unification of the standards by a multilateral convention.

Résumé :
Trade in similar products or intra-industry trade results from scale economies and consumer preferences, rather than from conventional forces of comparative advantage. This paper attempts to quantify the importance of intra-industry exchange between Canada and the United States. The analysis deals primarily with measurement, but an attempt to identify the determinants of the phenomenon is also made.
The results suggest that intra-industry trade represents a significant and increasing share of Canada's trade with the United States. Although part of this can be explained by idiosyncratic causes, the importance of two-way trade within manufacturing requires additional explanation.

This thesis begins with a review of the elite debate over free trade with the United States. It then uses a three-fold theoretical framework to formulate predictions of how mass opinion should line up. It then analyzes public opinion data on free trade through the use of crosstabulations. Using a theory of changing exposure to international trade upon domestic political cleavages formulated by Ronald Rogowski, it predicts that labour will oppose free trade because it is a scarce factor of production, and capital will support it because it is an abundant factor of production. It next uses work by, among others, W.A. Mackintosh to predict that respondents in the "industrial heartland" regions of Canada--Quebec and Ontario--will oppose free trade because it threatens to remove the protective tariff that rewards import replacement industries concentrated in those two regions. In contrast, residents of the "resource extracting and processing hinterland" regions—British Columbia, the Prairies and the Atlantic—will, on balance, support free trade because it promises to improve their export performance. The thesis then predicts that women and lower income Canadians will oppose free trade. Women because many of the services that they consume—health and day care, for example—will become more difficult to obtain under a free trade regime. Women will also oppose free trade because it may be threaten the service sector jobs that many women now hold. Lower income Canadians should oppose free trade because of the possible deleterious effects greater reliance on the market to allocate social services could have on poorer Canadians. Finally, the thesis predicts that better-educated Canadians will oppose free trade because it threatens one of the "core-values" of Canadian society: independence from the United States. Data analysis reveals, however, that opinion is remarkably balanced. For example, the difference between union and non-union respondents is only five percent. Regionally, the largest differences in support for free trade is between British Columbia and Ontario, but it amounts to little more than a twenty percent difference. Women are slightly more likely to oppose free trade than men; income appears to play little role in the formation of opinion on free trade. Last, differences in opinion between articulate and less well educated Canadians also appears to be insignificant.

Somewhat behind in the mobile telephony adoption than leading European and Asian markets, the U.S. market caught up in the 2000s. While simple types of mobile data services — such as messaging and downloads — had made some headway, the preexisting popularity of PC-based Internet made the U.S. users somewhat resistant to m-commerce offerings that did not match the richness of PC e-commerce. By the mid-2000s, however, network and technological capabilities were in place to usher in rich, new m-commerce offerings in U.S. markets. By taking advantage of new technologies, the U.S. mobile industry had the opportunity to become an innovator in m-commerce offerings.

This article examines the relationship between electronic commerce and the U.S. state sales and use tax system. A framework is used in this study of a high-quality tax system and it is applied to taxing electronic commerce sales. The first part of this article analyzed nine principles of an effective tax system, and divided these principles into the categories of adequacy of revenue, fairness of revenue, and management of revenue. In the second part of this article, these principles are tested to determine what impact electronic commerce taxation has on an effective revenue system. The results of these initial tests suggest that taxation of electronic commerce was associated with fairness in the tax system. In particular, the results suggested that states that had fairer tax systems were more likely to rely less on a sales tax and more on taxing Internet access. Management and adequacy of the revenue systems of states were not found to have a significant bearing on taxing electronic commerce. These results reinforce the existing public finance and legal theories which argue that the sales tax is not a fair revenue stream, and it should be re-evaluated especially in light of the contentious issue of taxing electronic commerce.

The revolutionary advancements of electrical fuel cell power within the past decade has drawn public awareness and criticism to the hazardous nature of hydrogen and other fuels used in fuel cell powered devices and systems. Although these fuels are regulated, their fuel storage devices (cartridges) are not, hence, requiring various governmental agencies approval such as the Department of Transportation, which typically applies its regulations for transportation of hazardous materials. As the development of these devices grow, issues regarding transportation of hazardous materials, components in mass transportation systems: e.g. passenger aircrafts, ships, trains, and buses, USPS, will come under intense legal scrutiny. The United States and other nations, including international bodies such as the United Nations have national and international laws regulating transit of hazardous/toxic materials across state/national and international boundaries. These different regulations often conflict and are serious barriers to the transportation of fuel cell powered consumer electronic devices such as laptop computers, cell phones, camcorders, calculators and even portable CD Players in commerce. This report addresses the regulatory framework regarding transportation of fuel cell hazardous-material – containing devices by aircrafts and suggests solutions to obtaining approval from various governmental agencies.

Failures of machinery and systems aboard towing vessels can have devastating consequences to the vessel, its crew, other vessels and their crews, shoreside populations and facilities, cargoes, marine transportation systems, commerce, and the environment. This paper presents a comprehensive methodology for implementing Risk-Based Maintenance and Inspections of towing vessel machinery and systems. Utilizing incident data from the United States Coast Guard (USCG) and other relevant industry information, the authors apply the principles set forth in ANSI/API Recommended Practice 580, Risk-based Inspection [1], as a guideline. Relatively straightforward to implement, the methodology presented in this paper is expected to improve towing vessel safety, reduce potential dangers associated with towing operations, and provide favorable risk/benefit reward to vessel owners. When local governments evaluate the environmental benefits and costs of alternatives for managing non-recyclable municipal solid waste, the relative costs of modern waste-to-energy (WTE) technology can be a significant stumbling block despite WTE technology’s environmental benefits. Although the preceding point is an important economic reality that has constrained WTE development in the United States, fortunately there is a highly effective means — the use of municipal solid waste “flow control” (or “facility designation”) authority — to overcome WTE’s perceived cost disadvantage. The relationship between flow control and WTE development, including significant encouragement for use of flow control as a result of the U.S. Supreme Court’s recent decision in United Haulers Association v. Oneida-Herkimer Solid Waste Management Authority, 127 S.Ct. 1786 (2007), is the focus of this paper, which will address the following topics: Policy Basis for Flow Control — Absent government intervention, management of municipal solid waste will seek the lowest cost (i.e., short-term cost) and frequently less environmentally protective alternatives. Flow control can counter the tendency to choose alternatives with lower short-term costs and at the same time facilitate implementation of the environmentally-preferable waste management alternatives a local government selects, such as WTE technology and other aspects of “integrated waste management.” Flow Control and the Courts — While the authority of a given local government to use flow control is grounded in state law, flow control also implicates matters that arise under federal law, such as Commerce Clause issues, given the possibility that solid waste regulation in one state can affect commercial interests in solid waste management in another state. Although concerns regarding claims of impact on interstate commerce prompted a negative Supreme Court response to flow control in C&A Carbone, Inc. v. Town of Clarkstown, 511 U.S. 383 (1994), the Court’s decision 13 years later in the Oneida-Herkimer case was in many ways just the opposite. WTE’s Correlation with Flow Control and Practical Guideposts — WTE development can be significantly advanced by the use of flow control. That conclusion is borne out by empirical data. The concluding portion of this paper addresses that topic as well as corollary issues, such as public-private collaboration for WTE development and other practical guideposts for implementing flow control ordinances.

The USDA, Economic Research Service's (ERS) Food Expenditure Series (FES) is a comprehensive measure of the total value of food acquired in the United States over time. FES provides users with data to evaluate changes in food spending and its composition; however, FES is limited to the national level. This report presents the methodology and data used to generate food expenditure estimates at the State level. The State-level FES follows a similar methodology used in the national level but with a different underlying dataset and benchmarked to the national-level estimates. The national-level estimates are based primarily on food sales reported in the U.S. Department of Commerce, Bureau of the Census' Economic Census, which is published every 5 years, and uses three annual surveys to interpolate between years and extrapolate lagged data forward. The State-level FES estimates are based primarily on sales reported in the National Establishment Time Series Database. The database provides time-series data at the establishment level across all sectors, including grocery stores and food service outlets. The State-level FES can be used by government agencies, academics, the public, and other stakeholders to understand differences in consumer food acquisitions and spending behavior at a more granular level.

Health, United States, 2019 is the 43rd report on the health status of the nation and is submitted by the Secretary of the Department of Health and Human Services to the President and the Congress of the United States in compliance with Section 308 of the Public Health Service Act. This report was compiled by the National Center for Health Statistics (NCHS) of the Centers for Disease Control and Prevention (CDC). The Health, United States series presents an annual overview of national trends in key health indicators. The 2019 report presents trends and current information on selected measures of morbidity, mortality, health care utilization and access, health risk factors, prevention, health insurance, and personal health care expenditures in a 20-figure chartbook. The Health, United States, 2019 Chartbook is supplemented by several other products including Trend Tables, an At-a-Glance table, and Appendixes available for download on the Health, United States website at: https://www.cdc.gov/nchs/hus/ index.htm. The Health, United States, 2019 Chartbook contains 20 figures and 20 tables on health and health care in the United States. Examining trends in health informs the development, implementation, and evaluation of health policies and programs. The first section (Figures 1–13) focuses on health status and determinants: life expectancy, infant mortality, selected causes of death, overdose deaths, suicide, maternal mortality, teen births, preterm births, use of tobacco products, asthma, hypertension, heart disease and cancer, and functional limitations. The second section (Figures 14–15) presents trends in health care utilization: use of mammography and colorectal tests and unmet medical needs. The third section (Figures 16–17) focuses on health care resources: availability of physicians and dentists.
