Abstract: For a long time, work has been in progress in the Czech Republic on a new draft of the Civil Code, which is meant to be a modern codification of private law. The current Civil Code is from 1964, and, despite its 1991 amendments that brought it into harmony with democratic legal principles (the original code was a product of a socialist legislature that, among other things, subdued such institutes as private ownership, autonomy of will, and so forth), it is not up to date. Not only does it still preserve its socialist past, but also, its frequent amendments also turned it into a non-systematic codification of highly disparate elements. In addition, numerous obligations are regulated by the Commercial Code, which causes serious problems with its legal interpretation and brings uncertainty into civil law relations. The drafters of the new Civil Code have reverted back to the original tradition Allgemeines Bürgerliches Gesetzbuch (ABGB), Code Civil, and the 1937 Civil Code draft), without, however, taking into consideration some modern trends in civil law, namely, consumer protection and tendencies towards the unification of law. The article focuses on the issue of consumer protection in the draft proposal of the Civil Code, reflecting on the most contested issues of the legal regulation of consumer protection. In particular, it reacts to the change in the concept of the consumer, the lowering of the standard of consumer protection in the case of the sale of goods in shops, and the insensitive appropriation of terminology from EC law into the Czech legal order, which often happens without regard to the institutes of Czech private law, mainly the law of obligations. Résumé: En République Tchèque, on travaille depuis un certain temps sur l’élaboration d’un nouveau Code civi,l qui devra être un code moderne de droit privé. Le Code civil actuellement en vigueur date de 1964 et bien qu’il ait été amendé en 1991 afin de répondre aux principes juridiques démocratiques (le code primitif était le fruit de la législation communiste qui par exemple supprimait la propriété privée ou l’autonomie de la volonté etc.), il n’a pas su se débarrasser de son passé totalitaire et vu le nombre élevé d’amendements partiels, l’ensemble est peu systématique et hétérogène. Beaucoup d’obligations sont en plus réglées par le Code du commerce ce qui engendre maints problèmes d’interprétation, tout en jetant une insécurité juridique dans les rapports de droit privé. Les auteurs du nouveau projet du Code civil renouent avec la tradition première (ABGB, Code civil et projet du Code civil de 1937), mais ils se montrent négligents vis-àvis des trendances modernes de la théorie actuelle de droit civil, surtout de la protection du consommateur et des tendances d’unification. Or le présent article étudie les droits des consommateurs dans le projet du Code civil et cherche à réagir aux questions les plus délicates concernant la législation liée à la protection du consommateur dans le code préparé. The issuance of law number 4 of 2009 concerning mineral and coal mining provides a new authority in the world of the act does not close the gap of illegal mining which is rife in Indonesia. Although the law already exists, the fact is that mining without permits continues. This study aims to determine the forms of non-criminal illegal mining and accountability. Forms of illegal mining are criinal acts of mining without permission either UIP, IPR or IUPK. Criminal offenses submit false report data, criminal offenses of exploration without rights, criminal offenses as holders of UIP exploration without carrying out production operations activities, criminal acts of laundering mining goods, criminal offenses related to abuse of authority of the official of the licensing authority, criminal acts which is a legal entity. The criminal liability against companies that carry aut mining activities without a permit is by imprisonment and with a criminal fine. The aim of this study is to analyze how using a digital pocketbook can enhance students' learning independence in civil law classes. Understanding the laws controlling the legal relationships between people/individuals and legal entities is possible through civil law courses offered by the Pancasila and Civic Education Departments. This study employed a descriptive quantitative methodology. Fifth-semester Universitas Negeri Medan civic education students served as the research subjects. Observation, interviews, and documentation were used to gather the data; data reduction involved choosing, focusing on, and simplifying the data; data display involved presenting the data in a table and figure; and conclusion involved providing meaning, confirming, and verifying the data. The outcomes demonstrated that utilizing the digital pocketbook effectively increased student learning independence. The average student questionnaire response rate for Digital Pocketbook in civil law courses is 84.58%. Thus, it could be concluded that learning independence is impacted by digital pocketbooks, using digital pocketbooks in civil law classes can help students become more independent learners.

In light of truths expressed by Thomas Aquinas and in lawyers’ oaths, lawyers sworn to uphold the civil law must work toward the goal of teaching and gradually encouraging citizens to have the inner virtues that would make civil law itself irrelevant. This follows from claims central to the civic and the Catholic intellectual traditions: the civil law is a teacher, its effect ought to be the promotion of virtue, and virtuous living is constitutive of the common good. Natural law undergirds and gives substance to the civil law, which nonetheless should only demand under fear of punishment what is followable for the majority of men, given the needs of good public order and the habits and customs of their country.

Renewed attention to equity in higher education is welcome because true equity helps us to reason together well. When administered correctly, the jurisprudence of equity models civil discourse and, therefore, can teach us how to carry out civic engagement reasonably. Equitable interpretation of the law teaches us how to understand each other charitably. And equity’s deference to law teaches us how to reason well together about our practical problems. Law is the practical reasoning that we do together. Equity serves the ends of justice by serving law, rather than undermining it. These functions of equity in adjudication point toward a model of equity in practical reasoning and civic discourse more broadly. Research method: jurisprudence.

Civil law science in civil law itself is cited as a secondary, "indirect", almost less important source of civil law. Some recent tendencies, however, say the opposite - that the science of civil law is the primary source of civil law because the judge makes judgments according to the knowledge of law acquired during his studies and in later professional career. That is why talking about the civil law science as a source of this science is also a conversation about the education of lawyers at law faculties and the extension of this process after graduation. In the Republic of Croatia at this time we see significant problems in both directions and even a lag that would be desirable to overcome as soon as possible.

In the article, the author explored ways to ensure the fulfillment of obligations in the historical aspect. The author came to the conclusion that the institution for ensuring the fulfillment of obligations owes its origin to the law of Ancient Rome, where a harmonious system of such methods was created. The first mention of securing compliance can be found in the Justinian Code of 529. The types of obligations that can be secured by a deposit are determined. The ratio of the deposit and advance is established. The legal consequences of the violation and the termination of the obligation secured by the deposit are analyzed. Attention is drawn to the presence of gaps in civil legislation regarding the regulation of deposits and ways to fill them by introducing appropriate changes to the Civil Code of Ukraine are suggested.

Civic knowledge in Indonesian context is the citizen knowledge about how they see themselves and their surroundings, emphasizing national and territorial unity in accordance with Pancasila, the 1945 Constitution, Bhinneka Tunggal Ika, and the Unitary State of the Republic of Indonesia. Civic knowledge is also critical for all civil servants in Indonesia to strengthen their sense of integrity as Indonesian citizens and in providing services to others in their workplaces. This civic knowledge is also critical for civil servants who live in Islamic sharia law with post-conflict area such Aceh. Therefore, this study investigates the attitudes of State Civil Servants (ASN) in Aceh Province on the importance of nationality understanding. The purpose of this study is to determine how ASN's opinion of the country they serve relates to civic knowledge. This study employed a qualitative approach with a contextual perspective. Questionnaires were distributed to 45 ASN in Aceh and 5 of the ASN were interviewed. The results showed that the majority of ASN have an in-depth understanding of the Indonesian civic knowledge. It means that the perception of the ASN reflects on what they know and understand about the meaning of Indonesia and the fundamentals of this nation to realize unity so that they are not easily provoked by radicalism and dogmas that undermine the national unity.

Baptism is a theological and religious sacrament by which individuals become Christians. This article shows that in medieval and renaissance law, baptism was also a civil legal event which could grant civilitas. From the Siete Partidas onwards, baptism was taken to be a legitimate origin of natural obligations within a community. As jurists like Lucas de Penna bridged the legal gap between spiritual matters (spiritualia) and temporal matters (temporalia), jurists and theorists alike could argue that baptism ought to change one’s legal origin (patria or origo) or liberate them from certain civic obligations while contracting them into others. Only by tracing how baptism came to have civil and legal significance can we then understand how participants in political communities leveraged the obligations created through baptismal oaths against tyrants, kings, bishops and their fellow civic-members.

While the growth in international legal disputes is spectacular, one should consider the nature of the phenomenon. Logically it reflects the needs of the States comprising the international society ; due process of law provides them with legal security and the guarantee of an impartial and definitive application of the law. The qualitative contribution it makes thus illustrates the link between the creation of jurisdictions applying international law and the concept of good governance. This transformation of law also reflects the decentralised nature of the international legal system. It creates competition between various controlling bodies with a clear risk of potential contradiction in case law. However, it also creates a highly stimulating situation and is a powerful factor in promoting an evolution in the law and in its application. The establishment of jurisdictions applying international law profoundly changes its very nature. It enhances the judicial function in that this becomes associated with the increasing rule of law in major political disputes and with fundamental questions that increasingly concern society on an international level. One cannot call it a revolution as neither has the international power structure been modified, in spite of the emergence of a world civil society, nor has the essential nature of international law been changed. However it confirms that a country under the Rule of Law is legalist in its approach to foreign policy.

Abstract This article discusses the role of nature in the theological system of New England minister Samuel Willard (1640-1707). I focus specifically on his account of theological anthropology, the relationship of nature and grace, and the moral (or natural) law, and show how each relates to his views on civil government and civil law. Willard affirmed the natural law, natural religion, and natural worship, and he acknowledged and respected pagan civic virtue and grounded civil order and social relations in nature. Willard’s theological articulations are substantively the same as those found among the ‘Reformed orthodox’ theologians of 17th century Europe, which provides evidence for the thesis that Reformed orthodoxy was a transatlantic movement. His reliance on nature also corrects scholarship on the New England Puritans, which often assumes that they rejected the Christian natural law tradition.

This article explores the role of the European Convention on Human Rights in addressing the issue of attacks on civic space, but also the potential effects of shrinking civic space on Strasbourg’s work. First, an overview of the notions of civil society and civic space is given, linking these concepts to democracy and human rights. Subsequently, the formal and informal roles for civil society in the judicial decision-making are discussed. Finally, the substantive protection offered to civil society and civic space under the ECHR and the case-law of the European Court of Human Rights is analysed. This article argues that the differentiations in theory on the varying contributions of civil society to democracy and human rights are to a large extent reflected in Strasbourg jurisprudence. Even more importantly, the ECHR system and civil society benefit from each other. This is why the current attacks on civic space are not just a problem for civil society itself, but also for the work of the European Court: it is submitted that a shrinking of civic space can also negatively affect the Strasbourg system, as the two are intertwined to a considerable extent.Received: 06 July 2019Accepted: 10 October 2019Published online: 20 December 2019

The advent of international criminal courts and the adoption of the Rome Statute aimed at creating a permanent international criminal court raise the question of whether the desire to punish the most odious crimes is leading inexorably to the creation of a supranational criminal law. Is the real intention to create an international legal system binding on States ? And if so, with what end in mind ? We know that international law is not limited to the regulation of relations between sovereign States. If the Westphalian view of international relations still has its followers, one notes increasing emphasis on the defence of humanity through humanitarian law, inciting international law to take a greater interest in protecting human beings. This trend in international law started over a hundred years ago in response to an increasing awareness of the problem. Today the world knows that by waging total war it is in danger of destroying itself. Its awareness of what happened in the past and its fears for the future have led, through international agreements called humanitarian, and in spite of the lack of any specific project, to the implementation of a number of measures intended to prevent any regression. But classic humanitarian law has proved inadequate ; it is not enough to prohibit certain acts, they also need to be sanctioned. This is why, since the end of the Cold War, international law has become steadily more repressive. It has dealt with emergency situations (ex-Yugoslavia, Rwanda) by making violations of international humanitarian law criminal offences and by creating special international jurisdictions to apply sanctions (I). The competence of these ad hoc institutions is limited however and does not enable them to sanction all internationally recognised crimes. Hence the idea of creating a universally competent international court in the future (The International Criminal Court). These new institutions will not completely replace national criminal courts. States and their agents will remain the main actors in the repression of international criminals. Given this situation, States will continue to play an essential role, taking part in prosecutions as they see fit, and retaining sovereignty in criminal matters (II). In fact States accept rather than suffer the application of humanitarian criminal law, not only for legal reasons (States' territorial and personal competence), but also for political reasons (maintaining diplomatic relations, respect for the need for national reconciliation). Clearly, the institutionalisation of the defence of human rights, through the prosecution of serious violations of humanitarian law, and the existence of specific repressive jurisdictions, does not call into question the relational nature of international law, nor the respect for the sovereign equality of all States. Under these conditions, the road to a supranational criminal law could well be long.

Résumé :
The most obvious difference between civil law and the common law system is that the civil law system is a codified system, followed by legislation covering this area, while common law is based mainly on case law. The basic principle that applies is that earlier court decisions, usually of higher courts, made in a similar case, should be followed in later cases, ie that precedents should be respected. The paper points out that in civil law the main principles and rules are contained in the text of the law, while case law is only a secondary source of law. On the other hand, common law is predominantly based on court decisions already made. Civil law is based on the application of the law, and common law on the creation of rights. Courts in the civil law system resolve specific cases by applying and interpreting legal norms, while in common law courts, while resolving disputes, and also provide guidance on how similar disputes should be resolved in the future, so that court decisions create legislation.

This article examines the problem of developing the idea of forming citizenship in domestic pedagogical thought. The need for the formation of citizenship is motivated, aimed at educating the individual, developing personal traits and qualities, world-view, feelings, actions and norms of behaviour, way of thinking aimed at self-development and development of democratic civil society in Ukraine. The categories “citizenship”, “civil position”, “rule of law” are specified in pedagogical and socio-pedagogical aspects.Today in Ukraine, we can observe both trends in the development of ideas of citizenship – on the one hand, the processes of state formation require unity based on the formation of civic qualities of the community, manifestations of citizenship and appropriate actions towards the idea of statehood. It is considered that these tendencies can develop in two ways – confrontation, intolerance or dialogue, a constructive approach to solving problems. The analysis of civic education development in the national pedagogical thought is provided by the author.Civic education is illustrated by changes in the goals, content and methods of organizing the activities of the subjects of the educational process. The essence of civic education is characterized by systematic, purposeful, social, planned and systematic motivation. As shown in the article, most of the existing educational systems and programs for the education of student youth are focused on the development of critical thinking, independent search for meaning in life and the development of skills of active behaviour. These changes make new demands on the implementation of the process of civic education of student youth in higher education, on the individual as a whole, able to understand and independently implement the basic ideas of competence-oriented education. Accordingly, the formation of citizenship aims at educating the individual, developing personality traits and qualities, world-view, feelings, actions and norms of behaviour, way of thinking aimed at self-development and development of democratic civil society in Ukraine. The purpose of this article was to scientifically analyze the current trends in the development of civil law in the modern reality, on which follow the authors' proposals to improve its evolution and adaptation. The methodological basis of the study included philosophical approaches, as well as general and special scientific methods of knowledge that meet the main objectives and tasks set in the research. According to the results of the study, civil law today is different not only in the application and protection of rights, compared to the original approaches established by the developers of the current Civil Code and, special sectoral legislation, but also in the change in the paradigm of normative and legal regulation. Everything allows to conclude that, in summary, the authors offer specific recommendations for updating the provisions of the Civil Code of Ukraine, which I include also proposals for changes in civil law. Definitely, civic reflection on all the issues raised in this study makes it possible to consider the problems from a new point of view and to offer, accordingly, comprehensive options for their solution, taking into account the prominent place of the Civil Code in these processes.

Civic Participation as a Constitutional Value in a Democratic State Governed by the Rule of Law The article presents the idea of civic participation as a value, which, due to its positive aspects, is widely desired by society in a democratic state governed by the rule of law. Participation as a value collectively forms an axiological system. In a constitutional state, the axiological system is normatively expressed in the content of the constitution, within which it takes the form of constitutional norms and principles. Civic participation has been adopted into the Constitution of the Republic of Poland in an indirect manner. A holistic interpretation of the Constitution’s provisions allows it to be interpreted from the overarching systemic principles: the principle of the common good (Article 1) the principle of the democratic state of law (Article 2), the principle of the sovereignty of the Nation (Article 4) and the principle of social dialogue (Article 20). Consequently, civic participation as a constitutional value determines how laws are made. The State has an obligation to introduce and strengthen institutions of civic participation. Civic participation based on civil, political and social rights as well as institutions of social solidarity is an element of a democratic state of law and can be a solution to the problems of contemporary democracy.

By dint of their disparate colonial groomings, Anglophone Cameroon had common law as its legal system at the dawn of reunification in 1961 while Francophone Cameroon had civil law. Things would stay that way until 1972 when the government began sanctifying civil Law over common law through an asymmetric and assimilatory harmonization scheme. That was the beginning of the systematic erosion of common law in Anglophone Cameroon and the contemporaneous transposition of civil law to the territory. Anglophone common law practitioners manifested their revulsion to this harmonization travesty through multidimentional protests. One of such protests was their 2016 sit-in that morphed into an armed conflict. Using survey and participant observation as research instruments, Anglophone common law practitioners as the target population and stratified purposive sampling as the sampling technique, this study exemplifies common law ethnocide in Anglophone Cameroon. The key finding of the study is that the Cameroon harmonization scheme is skewed towards the attainment of civic nationalism and not law reform as it ought to be. Accordingly, the Cameroon harmonization scheme is flawed in its conception, defective in its methodology, imperialistic in its application and boundless in its scope. Above all, its assimilatory properties and propensities have occasioned an ethnocidal paradigm-shift in the legal system of Anglophone Cameroon from its pre-1972 common law status quo to its present-day civil law inclination. The major recommendation of this study is for government to give Anglophone Cameroon such autonomy as will allow it set up its own legislative assembly to legislate on private law matters. Without this, the erosion of common law in Anglophone Cameroon will continue.

Civil society is non political sphere and individual made voluntary organization widely understood as the space outside the family, market and state. It is associated for welfare of state on the ground of civic knowledge, civic education and civic virtue. Civil society works and plays its role in the democratic regime. Democratic regime operates on the basis of democratic norms and values. Civil society plays roles in the democratic society relating to maintaining, promoting and strengthening good governance. It plays various roles like participating, mediating interest, mobilizing counter knowledge, influencing policy making, building commitment for public good, giving impetus to community building projects, motivating citizens, government towards co-operation, etc. It can play the communicative role, protective role, control role, socialization role, service delivery role and the global citizenship role in different cases. Major areas of good governance are democracy, rule of law, proprietary rights, corporate governance, human rights, welfare state and labor institution. And in these areas civil society can perform their respective roles. In the case of Nepal some roles have been managed under constitution and statutory law mainly in good governance operation and management act. But these provisions seem inadequate for showing their role visibly. Maintaining good governance through properly implementing fundamental rights, government has not made effective laws yet. Nepalese parliament has promulgated the act named good governance operation and management act 2008. Here some provisions relating to civil society's role in operating and managing process has been mentioned. In this article constitutional role as well as legal role has been taken in due consideration because civil society's constitutional and legal roles have not been duly recognised yet. Thus the study has given emphasis on description and analysis of content relating to civil society 's role managed under the constitution and statutory law act. To draw the conclusion in this study descriptive-analytical and content analysis methods has been used and information has been taken from secondary method. constitution of Nepal and good governance operation and management act 2008 have been taken as major contents for analysis of civil society's role in managing and operating good governance in Nepal.

The article sheds light on the regulations of Roman law appearing in the works of Pavle Šeroglić, the first reviewer of Serbian Civil Code (1844) (The Review of the Civil Code for the Serbian Principality, Promulgated on 25 March 1844 (Pregled Zakonika građanskog za Knjažestvo srbsko, 25. marta 1844. obnarodovanog, published in Bačka vila 4/1845, 114-187), Counterresponse to Response of Mister Miloš Svetić in the Third Linguistic Counterattack (Replika na odgovor gospodina Miloša Svetića u Utuku III. Jezikoslovnome, Novi Sad 1847) and Civil Law in Croatian-Slavonian and Serbian-Banat Military Border (Građansko parvo u c.k. Hrvatsko-slavonskoj i Srpsko-banatskoj Vojničkoj granici, Šeroglić's undated and unpublished commentary of Austrian General Civil Code, kept in the archival materials of Sremski Karlovci Grammar School in the Archives of Serbian Academy of Sciences and Arts in that town. The provisions of civil law cited by Šeroglić are sorted by similarity with necessary clarifications thereto. This paper, being the first of two sequels of the article related to Šeroglić's accounts on Roman law, shall shed light on the author's fragments on is Greek legal transplants in Rome, theory of law, property law and law of obligations, whereas the passages in relation with other branches of Roman law shall be scrutinized in the follow-up article.

The purpose of the article is to analyze the factors influencing the development of practical skills of civil-law competence of Russian youth. Much attention is given to research methods such as an interdisciplinary system approach, a sociological method and a factor analysis. The author emphasizes that the priority attention of Russian researchers is devoted to the improvement of the educational component of civil law competence of a new generation. It is stressed that the issue of practical skills developing of civil and political participation of young people is undeservedly overlooked. The author draws attention to the fact that a new generation of Russians needs to test the theoretical knowledge obtained in political practice. A number of factors that prevent Russian youth from testing democratic practices of civic participation are revealed. As a result of the research, the author draw conclusions that shortage of mechanisms of civic participation cannot be compensated by the state policy actively pursued today to improve the standard of living of young people, patriotic education, stimulating the development of traditional family values and improving the efficiency of social elevators. The necessity of developing an appropriate mechanism for the development of civil law competencies of young people in practice is argued. The active involvement of young people in the activities of public reception offices at state bodies and public organizations, human rights schools, intellectual analytical projects and competitions are recommended.

The UN Convention on the Rights of Persons with Disabilities represents an important innovation in international law. For the first time, states are legally obligated to seek the advice of civil society organizations representing rights-holders in the development of legislation and policies and the monitoring of their implementation. In Nicaragua, however, the civic history of the Sandinista Revolution and civil war has left the local disability movement divided. Disabled war veterans want laws guaranteeing special treatment; self-help groups would rather focus on providing their own services than advocating for new laws. This demonstrates that the success of the CRPD’s civil society provisions is as dependent on the local identities and experiences of disabled people as it is on states’ adherence to international law.

Hugo Grotius has always been viewed as a theorist of either international or natural law. However, these designations obscure the civic focus of his work, from his early republican treatises through to De iure belli ac pacis. From sixteenth-century humanist and legal-humanist Aristotelianism, Grotius constructed a framework of natural right which enabled him on the one hand to locate the origins of the civil community in natural man's juridical capabilities, but on the other to give this ‘city’ a large measure of juridical autonomy in respect of the moral norms of natural law. In this he diverged significantly from the contemporary scholastic handling of natural law. Grotius further developed his understanding of the civil community and its right through elaborating a theory of the unity of the city, based originally on the Aristotelian notion of reciprocity but ultimately using a range of neo-Stoic sources to conceive of the civil community as a unitary reality.

The idea of a law-governed state, which is referred to so commonly, exists as a synonym of the principle of the supreme meaning and standing of the constitution in the state system. The law-governed state in its pure form is one where the law provides not only the framework and barriers for the state and the actions of the authorities, but a state wherein its beginning and foundations are rooted in the law. The concept of the law-governed state has many highly detailed elements (the very existence of the constitution, the separation of powers, the independence of the courts, the legal character of administrative actions, legal protection against decisions made by the authorities, the right to appeal, etc.); its essence, however, is the recognition of the law as a particular means and a yardstick with which both the state’s system and the recognition of the legal standards vested with the power to shape social relationships, the regulatory power, are moulded. It is the prestige of the law – nomos basileus – which should be the source of state order. The supremacy of the law provides the premise on which the introduction of every detailed solution which turns the idea of the law-governed state into specifics, is based. If the rule of law, rather than that of the authorities is to exist, this must be a law wherein each citizen may contribute to its shape; ideally it will be one established directly by the citizens rather than by the established authorities, democratic in an indirect way. This must be a law binding upon everyone equally, observed by everyone, operating effectively and surely. It must also be a law made for society’s sake rather than for that of an idea, and it must be fitting to those realities, standards and common practices that exist in that society. It must also be a law not too rigorous and imposing neither excessive requirements nor strange measures.

The article aims at carrying out the following tasks: to analyze the meaning of the concept of all-Russian identity; to compare the concept of all-Russian identity and related concepts; to define the role of the all-Russian civil identity as an institution and as a value in the system of constitutional law; to formulate proposals for improving the legislation of the Russian Federation. The axiological approach has had considerable importance for assessing and analyzing the value system of all-Russian identity, the content of these values, as well as for considering the all-Russian identity as a constitutional legal value. The teleological approach has allowed taking into account the goal-setting of the Russian state in the process of constitutionalization of the all-Russian civil identity. The article analyzes the concept of the all-Russian civil identity and its connection with cultural and ethnic identity, the system of values that form the civil identity; determines the place of the civic identity in the system of constitutional law; correlates the civic identity with the concept of constitutional identity. The author suggests a possible way to differentiate the civic and cultural identities, options to supplement the system of values that form the civil identity. The author positively assesses the attempts of the Russian state to implement a state national policy on the basis of the concepts of the civil and cultural identities in the face of modern challenges. At the same time, the author identifies a number of issues. The system of values that constitute the all-Russian civil identity is not fully formalized. It is required to introduce mechanisms for the formation and preservation of the all-Russian civil identity and to correct the state policy in various areas, from the national state policy to the state policy in education, culture, and health care. Finally, the ethnic issue in the context of the all-Russian civil identity remains relevant.

Karakteristik sistem hukum common law adalah hukum yang berorientasi kepada kasus (case-law), sedangkan sistem civil law, hukum berorientasi kepada undang-undang (codified-law). Namun peraturan perundang-undangan sebagai basis legalitas hukum dalam tradisi Rechtstaats, memiliki keterbatasan tersendiri. Peraturan perundang-undangan tidak pernah mengatur secara lengkap dan detail bagaimana pemenuhan aturan hukum dalam setiap peristiwa hukum, oleh karenanya yurisprudensi lah yang akan melengkapinya. Selain untuk mengisi kekosongan hukum, yurisprudensi merupakan instrumen hukum dalam rangka menjaga kepastian hukum. Tulisan ini berusaha mengkaji kedudukan yurisprudensi dikaitkan dengan tugas dan fungsi MK sebagai pengawal konstitusi, bukan sebagai penegak undang-undang. Metode analisis yang digunakan adalah studi pustaka dengan pendekatan perbandingan. Kesimpulan yang didapat dalam penelitian ini adalah bahwa yurisprudensi merupakan salah satu sumber hukum yang penting dalam tradisi civil law. Setiap diskursus tentang yurisprudensi dalam tradisi civil law mengisyaratkan bahwa tradisi civil law mengakui hukum selain yang tertuang dalam bentuk undang-undang, juga terdapat hukum yang bersumber dari hukum hakim (judge made law) (rechtstersrecht) yang lebih dikenal dengan nama yurisprudensi (jurisprudentierecht).The characteristics of the common law legal system are case-law, whereas the civil law system, the law is codified-law. However, legislation as the basis of legal legality in the tradition of Rechtstaats, has its own limitations. Legislation never regulates in full and detail how compliance with the laws in every legal circumtances, therefore it is jurisprudence that will complement it. In addition to filling a legal vacuum, jurisprudence is a key legal instrument in order to maintain legal certainty. This paper seeks to examine the position of jurisprudence associated with the duties and functions of the Constitutional Court as a guardian of the constitution, not merely as statute enforcement. The analytical method used is a literature study with a comparative approach. The conclusion obtained in this study is that jurisprudence is an important source of law in the civil law tradition. Any discourse on jurisprudence in the civil law tradition implies that the civil law tradition recognizes law other than those contained in statutes, there is also a law that comes from judge made law (rechtstersrecht) better known as jurisprudence (jurisprudentierecht).
