Um bom regulamento de arbitragem não deve ter a pretensão de disciplinar cada pequeno detalhe do procedimento arbitral, mas sim valorizar as garantias fundamentais de uma arbitragem administrada, quais sejam: garantia de independência e imparcialidade dos árbitros e da própria instituição; garantia de liberdade processual (liberdade dos árbitros para decidirem quais instrumentos processuais são mais adequados para cada caso); garantia de tempos curtos; garantia de custos previsíveis e razoáveis. O Regulamento da Câmara de Arbitragem de Milão prevê, ainda, um código deontológico que o árbitro deve respeitar enquanto atuar junto à instituição arbitral.

AbstractWe propose a novel multi-view camera model for line-scan cameras with telecentric lenses. The camera model supports an arbitrary number of cameras and assumes a linear relative motion with constant velocity between the cameras and the object. We distinguish two motion configurations. In the first configuration, all cameras move with independent motion vectors. In the second configuration, the cameras are mounted rigidly with respect to each other and therefore share a common motion vector. The camera model can model arbitrary lens distortions by supporting arbitrary positions of the line sensor with respect to the optical axis. We propose an algorithm to calibrate a multi-view telecentric line-scan camera setup. To facilitate a 3D reconstruction, we prove that an image pair acquired with two telecentric line-scan cameras can always be rectified to the epipolar standard configuration, in contrast to line-scan cameras with entocentric lenses, for which this is possible only under very restricted conditions. The rectification allows an arbitrary stereo algorithm to be used to calculate disparity images. We propose an efficient algorithm to compute 3D coordinates from these disparities. Experiments on real images show the validity of the proposed multi-view telecentric line-scan camera model.

A new camera calibration technique based on serious distortion is proposed, which only requires the camera to observe the plane pattern in an arbitrary azimuth. It uses the geometrical imaging principle and radial distortion model to acquire radial lens distortion coefficient and the image coordinate (u0, v0), and then solves the linear equation aiming at the other parameters of the camera. This method has the following characteristics: Firstly, the position of the camera and the plane is arbitrary, and the technique needs only a single observation for plane pattern. Secondly, it is suitable for camera calibration with serious distortion. Thirdly, it does not need expensive ancillary equipment, accurate movement, or lots of photos observed from different orientations. Having been authenticated by computer emulation and actual experiment, the results of the proposed technique have proved to be satisfactory. The research has also paved a new way in camera calibration for further studies.

A cluster-approach-based three-camera digital image correlation (DIC) system is introduced for full-field 3D shape and motion measurement. In this system, three cameras are employed to measure the same specimen area at different viewing angles. Data points within the region of interest can be evaluated by arbitrary camera pairs as a stereo DIC system so that data points with the smallest 3D residuum are selected and mapped into one common coordinate system. Two stationary shape measurements and one out-of-plane motion measurement were carried out with the three-camera DIC system. Test results were analyzed based on the same image series, projection calibration, and correlation parameters, but compared using different camera combinations (i.e., three-camera and two-camera data). Three-camera test results show not only an improved surface coverage due to the additional camera viewing angle for uneven specimen surfaces, but also a smaller and more homogenous distributed measurement uncertainty compared to the two-camera test results. The selection of data points with the smallest 3D residuum evaluated from any arbitrary camera pairs enables a better tolerance of the three-camera DIC system against various measurement error sources such as limited depth of field, lens distortion, and speckle pattern distortion due to tilted camera viewing angles.

Abstract Axisymmetric tomography is used to extract quantitative information from line-of-sight measurements of gas flow and combustion fields. For instance, background-oriented schlieren (BOS) measurements are typically inverted by tomographic reconstruction to estimate the density field of a high-speed or high-temperature flow. Conventional reconstruction algorithms are based on the inverse Abel transform, which assumes that rays are parallel throughout the target object. However, camera rays are not parallel, and this discrepancy can result in significant errors in many practical imaging scenarios. We present a generalization of the Abel transform for use in tomographic reconstruction of light-ray deflections through an axisymmetric target. The new transform models the exact path of camera rays instead of assuming parallel paths, thereby improving the accuracy of estimates. We demonstrate our approach with a simulated BOS scenario in which we reconstruct noisy synthetic deflection data across a range of camera positions. Results are compared to state-of-the-art Abel-based algorithms. Reconstructions computed using the new transform are consistently more stable and accurate than conventional reconstructions.

This is a thesis on outdoor monocular visual SLAM in natural environments. The techniques proposed herein aim at estimating camera pose and 3D geometrical structure of the surrounding environment. This problem statement was motivated by the GPS-denied scenario for a sea-surface vehicle developed at Plymouth University named Springer. The algorithms proposed in this thesis are mainly adapted for the Springer’s environmental conditions, so that the vehicle can navigate on a vision based localization system when GPS is not available; such environments include estuarine areas, forests and the occasional semi-urban territories. The research objectives are constrained versions of the ever-abiding problems in the fields of multiple view geometry and mobile robotics. The research is proposing new techniques or improving existing ones for problems such as scene reconstruction, relative camera pose recovery and filtering, always in the context of the aforementioned landscapes (i.e., rivers, forests, etc.). Although visual tracking is paramount for the generation of data point correspondences, this thesis focuses primarily on the geometric aspect of the problem as well as with the probabilistic framework in which the optimization of pose and structure estimates takes place. Besides algorithms, the deliverables of this research should include the respective implementations and test data for these algorithms in the form of a software library and a dataset containing footage of estuarine regions taken from a boat, along with synchronized sensor logs. This thesis is not the final analysis on vision based navigation. It merely proposes various solutions for the localization problem of a vehicle navigating in natural environments either on land or on the surface of the water. Although these solutions can be used to provide position and orientation estimates when GPS is not available, they have limitations and there is still a vast new world of ideas to be explored.

This thesis studies how the mechanical design of a surveillance camera affects the acoustic performance, mainly in terms of the frequency response within the human hearing range. During the project, the mechanical characteristics that affect frequency response were investigated by measuring the camera’s audio behavior in an anechoic chamber. A theoretical and adaptable acoustic model was built in COMSOL to simulate the frequency response of the sound path. Measurement and simulation results were compared to identify critical aspects of the mechanical design and adjust accordingly for better acoustic performance.

Generating in-between images from multiple views of a scene is a crucial task for both computer vision and computer graphics fields. Photorealistic rendering, 3DTV and robot navigation are some of many applications which benefit from arbitrary view synthesis, if it is achieved in real-time. Most modern commodity computer architectures include programmable processing chips, called Graphics Processing Units (GPU), which are specialized in rendering computer generated images. These devices excel in achieving high computation power by processing arrays of data in parallel, which make them ideal for real-time computer vision applications. This thesis focuses on an arbitrary view rendering algorithm by using two high resolution color cameras along with a single low resolution time-of-flight depth camera and matching the programming paradigms of the GPUs to achieve real-time processing rates. Proposed method is divided into two stages. Depth estimation through fusion of stereo vision and time-of-flight measurements forms the data acquisition stage and second stage is intermediate view rendering from 3D representations of scenes. Ideas presented are examined in a common experimental framework and practical results attained are put forward. Based on the experimental results, it could be concluded that it is possible to realize content production and display stages of a free-viewpoint system in real-time by using only low cost commodity computing devices.

Mortgage loans are the major assets securitised by South African banks. Arguments from the literature indicate that the use of securitisation as an instrument for regulatory arbitrage weakened banks’ soundness and caused, at least partially, the 2007-2008 Global Financial Crisis. In this regard, financial institutions continually took advantage of the loopholes in the Basel regulation, principally that of Basel I. Undertaken from both the empirical and theoretical angles, this thesis investigated whether regulatory capital arbitrage under Basel II and III regulations, was a driver of mortgage loans securitisation by South African banks. Additionally, the effect of mortgage loans securitisation on the South African banks’ stability was analysed. Furthermore, the project built upon the case of mortgage loans securitisation to deepen the insight on banks’ behaviour towards risk, by considering a rare contractual relationship where banks are regarded as agents acting on behalf of regulators. The theoretical examination was carried out by means of perspectives from Agency and Institutional Theories. The South African banking system is essentially monopolistic with five banks holding more than 90% of total assets, out of which four, with 70% of the assets, consistently report outstanding volume of mortgage loans securitised. Based on the data collected from these four major banks, this research project is the first in many regards. It involves an emerging economy, considers the influence of both Basel II and III regulations, covers the period 2008 to 2015, and focuses on well-capitalised banks exclusively. Moreover, it extends regulatory capital arbitrage analysis to the evidence of loans expansion, includes CAMELS as bank stability proxy and brings in Agency Theory and Institutional Theory to explain banks’ behaviour with regards to risk in this particular context. In contrast, other studies were concentrated on Europe and America, mostly under Basel I, limited to one or two baseline models for regulatory capital arbitrage and often only the Z-score measure was used for bank stability. In three major steps, this study first employed the Ordinary Least Squares statistical methodology to test the capital arbitrage theory of securitisation and other of its features whereby it causes the decrease of capital with little or no reduction of risk. The estimation results indicated that securitisation of mortgage loans lessened South African banks’ regulatory capital, increased their overall risk level and moreover, suggested that the proceeds from securitisation were used to expand their loans portfolios. These outcomes tentatively imply that South African banks securitise mortgage loans for regulatory capital arbitrage. The second step explored the impact of securitisation of mortgage loans on South African banks’ stability. Two different measures of bank stability were involved: the CAMELS and the Z-score. CAMELS stands for C: capital (leverage ratio and not the regulatory capital); A: assets quality; M: management efficiency; E: earning; L: liquidity; and S: sensitivity to market risk (interest risk). The Two Stage Least Squares and the Ordinary Least Squares statistical methods were used respectively for the analysis of the relationship between the two bank stability indicators and the outstanding volume of mortgage securitised. The empirical results from CAMELS showed that mortgage loans securitised negatively affected the level of capital proxied by the leverage ratio, eroded assets quality and increased South African banks’ overall costs. However, they had a positive effect on South African banks’ profit, they seemed to be an additional source of liquidity and represented a useful tool to curtail market risk sensitivity, especially the interest risk as they increased net interest income. With regards to the analysis with the Z-score, the results indicated a negative impact of mortgage securitised on South African banks’ stability. The outcome remained unchanged when retained interests in the form of subordinated loans were included in the analysis, but retained interest had a positive influence on the Z-score. The last step of this study pertained to the theoretical analysis based on the concepts of Agency Theory and Institutional Theory. Acting as regulators’ agents in an agency relationship, the simple model of Agency Theory in its extended form explained that South African banks were first and foremost risk-taking players. They were more interested in the risk/reward trade-off in their decision-making attitude towards risk than pursuing the regulators’ goal of the stability of the banking system. In that sense, it was not a surprise that they engaged in regulatory capital arbitrage despite knowing that it was risky but could provide gains in liquidity and profit. In addition to goals conflict, Agency Theory indicated asymmetry of information between banks and regulators as the indirect origin of regulatory capital arbitrage, where the opacity of banks’ activities, such as securitisation, rendered regulations ineffective and thus easy to shirk. Furthermore, it was found that the essentials of the behaviour-oriented contract suggested by the theory as the optimal contract, were already included in the formulation of the latest Basel Accords. However, the researcher believes that one key element, which is the reward or compensation that should benefit the banks (the agent) when they abide by the terms of the contract, is missing. Regulators should therefore include incentives in the regulations and combine the behaviour and outcome-oriented contracts to optimize their relationship with banks even though, as explained by the theory, the outcome of bank stability will remain partially uncertain due to uncontrollable factors such as the economic conditions. The concept of legitimacy, from Institutional Theory, explicated that banks’ legitimacy came from their ability to comply with the regulations. From this stance, the results suggested that regulatory capital arbitrage seemed instead to undermine the legitimacy of South Africa banks well-capitalised position.

This book provides a detailed commentary on the Hong Kong International Arbitration Centre (HKIAC) Administered Arbitration Rules providing practitioners with an insider’s perspective on how the HKIAC Secretariat administers arbitrations under these rules. HKIAC is one of the world’s most sophisticated arbitration institutions, which established a set of Administered Arbitration Rules in 2008. Since then, HKIAC has enjoyed a continued yearly growth in cases. In 2015, HKIAC saw a record number of arbitration cases in 2012. This guide makes reference to the Hong Kong Arbitration Ordinance as well as drawing comparisons with other institutional rules and the UNCITRAL Model Rules to emphasize key issues to consider when drafting an arbitral clause or strategizing over the conduct of an arbitration. As well as offering an insider’s perspective it provides examples of anonymous cases handled at the HKIAC, and a discussion on various issues arising from arbitrations involving mainland parties or enforcing arbitration awards in mainland China. The book not only draws from seven years’ experience administering arbitrations under the HKIAC Administered Arbitration Rules (2008) but highlights the various changes made in the revised Rules that came into effect in November 2013 benefiting from privileged access. In the 1890s, the Pasteur Institute established a network of laboratories that stretched across France’s empire, from Indochina to West Africa. Quickly, researchers at these laboratories became central to France’s colonial project, helping officials monopolize industries, develop public health codes, establish disease containment measures, and arbitrate political conflicts around questions of labor rights, public works, and free association. Pasteur’s Empire shows how the scientific prestige of the Pasteur Institute came to depend on its colonial laboratories and how, conversely, the institutes themselves became central to colonial politics. This book argues that decisions as small as the isolation of a particular yeast or the choice of a laboratory animal could have tremendous consequences on the lives of Vietnamese and African subjects, who became the consumers of new vaccines or industrially fermented intoxicants. Chapters follow not just Alexandre Yersin’s studies of the plague, Charles Nicolle’s public health work in Tunisia, and Constant Mathis’s work on yellow fever in Dakar, but also the activities of Vietnamese doctors, African students and politicians, Syrian traders, and Chinese warlords. It argues that a specifically Pastorian understanding of microbiology shaped French colonial politics across the world, allowing French officials to promise hygienic modernity while actually committing to minimal development.

AbstractEvery imaging sensor introduces a certain amount of noise to the images it captures—slight fluctuations in the intensity of individual pixels even when the sensor plane was lit absolutely homogeneously. One of the breakthrough discoveries in multimedia forensics is that photo-response non-uniformity (PRNU), a multiplicative noise component caused by inevitable variations in the manufacturing process of sensor elements, is essentially a sensor fingerprint that can be estimated from and detected in arbitrary images. This chapter reviews the rich body of literature on camera identification from sensor noise fingerprints with an emphasis on still images from digital cameras and the evolving challenges in this domain.

Until 2020, arbitration hearings usually presumed a physical presence of all participants in one room. Although hearings conducted by way of remote communication, i.e., virtual hearings, have been technically possible for several years, their use was limited at best. Due to travel restrictions imposed by the COVID-19 pandemic, the situation changed rapidly and virtual hearings came into the focus of the arbitral community. Mindful of the changing attitudes, this paper firstly discusses attributes of the virtual hearings, their advantages and challenges. Furthermore, with the benefit of the hindsight, the second part looks at how the arbitral institutions handled the “new normal” imposed by COVID-19 in terms of the guidance provided to the tribunals and parties.
