Trispiotis, Ilias, et Craig Purshouse, dir. Banning ‘Conversion Therapy’. Hart Publishing, 2023. http://dx.doi.org/10.5040/9781509961184.

Texte intégral
Résumé :
This book looks at why and how states should legally ban LGBTQ+ ‘conversion therapy’. Few states have legislated against the practice, with many currently considering its legal ban. Banning ‘Conversion Therapy’ brings together leading academics, legal and medical practitioners, policymakers and activists to illuminate the legislative and non-legislative steps that are required to protect individuals from the harms of ‘conversion therapy’ in different contexts. The book considers how best to address this complex and interdisciplinary legal problem which cuts across human rights law, criminal law, family law and sociolegal studies, and which represents one of the key contemporary problems of LGBTQ+ equality and national and international human rights activism.

Texte intégral
Résumé :
This final short chapter sums up the topics of the book, showing how Galileo’s simple parabolic trajectory has matured into an overarching and grand concept that encompasses modern dynamics. Galileo achieved immortality despite his house arrest and despite the banning of his books that he feared had erased his legacy. Ironically, his house arrest gave him time to assemble and record his lifelong investigation into the science of motion—and banning his books made them immensely popular.

Foerstel, Herbert N. Banned in the U.S.A. 2e éd. Greenwood, 2002. http://dx.doi.org/10.5040/9798400616396.

Texte intégral
Résumé :
Since the first edition was published to acclaim and awards in 1994, librarians have relied on the work of noted intellectual freedom authority Herbert N. Foerstel. This expanded edition presents a thorough analysis of the current state of book banning in schools and public libraries, offering ready reference material on major incidents, legal cases, and annotated entries on the most frequently challenged books. Every section of this work has been significantly rewritten, updated, or expanded to reflect those developments. In-depth accounts of three new landmark book banning incidents are featured, along with a discussion of recent Supreme Court decisions involving censorship on the Internet and in book publishing, and a consideration of their implications for book banning in schools and public libraries. Two new interviews with authors of banned books—David Guterson and Leslea Newman—join the interviews with authors profiled in the first edition, many of which have been updated. The heart of the book is a Survey of Banned Books, revised with annotated entries on the 50 most frequently challenged books for 1996 through 2000; the Harry Potter series tops the list. Finally, all new appendixes feature an updated ALA list of Most Frequently Challenged Books and Authors Through 2000 and graphs that help to clarify key information.

Texte intégral
Résumé :
At its debut in 1866, La Source already had it all: dagger-wielding Muslims dominating veiled women, a magic flower in a green ecology, and a full-blown environmental crisis at the end. When the Paris Opera ballet restaged this Orientalist and colonial drama in 2011, and again in 2014, the contemporary context of homegrown jihad, climate politics, and a law banning the dissimulation of the face in public spaces, kept it relevant. At four historic performances, over 150 years, this book explores the resonance of La Source’s double narrative in its contemporary contexts: the biopolitics of bodily hybridity and regeneration and the cosmopolitics of the exploitation of human and natural resources.

Giroux, Henry A., et Anthony R. DiMaggio. Fascism on Trial. Bloomsbury Publishing Plc, 2024. http://dx.doi.org/10.5040/9781350421721.

Texte intégral
Résumé :
This book interrogates rising fascism in America. It spotlights the major facets of fascism that increasingly characterize contemporary U.S. politics, in relation to political authoritarianism, the rise of anti-intellectualism, the mainstreaming of conspiracy theories, the glorification of political street violence and state violence, rising white supremacy, and the militarization of U.S. political discourse. Alongside this, Giroux and DiMaggio show how the assault on critical education and pedagogy is central to the fascist program. They stress the importance of reprioritizing education as a public good to combating fascist politics and ideology and draw links between fascism and the banning of books in schools, whitewashing history, and punishing policies aimed at Black, Brown, and transgender youth. They challenge the commonly embraced notion that Trumpism is primarily a function of economic insecurity within his support base, documenting how support for the former president primarily centered on reactionary socio-cultural values and white supremacy. They also show how white supremacist values are central to the Trump base defending the January 6th insurrection, despite academics, journalists, and political officials in both major parties ignoring the threat of rising white nationalism.

Résumé :
This book is a popular-level study of the conflict thesis: the notion that science and religion have been at war with each other throughout history, and that humanity must ultimately make its choice between the two. The origins of the conflict thesis are usually given as two works by nineteenth-century Americans, John William Draper and Andrew Dickson White, who wrote History of the Conflict Between Religion and Science (1876) and A History of the Warfare Between Science and Theology in Christendom (1896), respectively. In these volumes, Draper and White relate stories such as the Church’s suppression of the sphericity of the Earth and of heliocentrism; its banning of dissection, anesthetic, and inoculation; its persecution of scientists; its dedication to irrationality in the face of reason; and much more. Yet their thesis has been thoroughly debunked in the literature, and their tales largely found to be myths. Despite this, they still circulate today, and many still believe that we must pick a side: God or science. This book uses accessible stories and anecdotes to analyze Draper, White, their true motivations, their books, their thorough debunking, the modern persistence of their flawed views, and the possibility of moving beyond them—toward true reconciliation. It is a history of science and religion, and of how, despite the common acceptance of the contrary, the latter has actually been of great benefit to the former. Rumors of a centuries-old war between God and science, it turns out, have been greatly exaggerated.

Anderson, James M. Daily Life during the French Revolution. Greenwood, 2007. http://dx.doi.org/10.5040/9798400636745.

Texte intégral
Résumé :
The French Revolution sought to change daily life itself. This book looks at the thirteen years between 1789-1802 that experienced the Terror, banning of the aristocracy, and the rearrangement of the calendar. No part of French life was left untouched during this incredible period of turmoil and warfare, from women's role in the family to men's role in the state. Art and theater were invigorated and harnessed for political purposes. Subtleties in one's dress could mean the difference between life and death. The first modern mass army was created. Chapters include the physical make-up of France; the social and political background of the revolution; the First Republic; religion, church and state; urban life; rural life; family life; the fringe society; clothes and fashion; food and drink; the role of women; military life; education; health and medicine; and writers, artists, musicians and entertainment. Anderson breathes life into the day-to-day lives of those living during the French Revolution. Greenwood'sDaily Life through Historyseries looks at the everyday lives of common people. This book will illuminate the lives of those living during the French Revolution and provide a basis for further research. Black and white photographs, maps, and charts are interspersed throughout the text to assist readers. Reference features include a timeline of historic events, glossaries of terms and names, an annotated bibliography of print and electronic resources suitable for high school and college student research, and an index.

Kramer, Matthew H. Freedom of Expression as Self-Restraint. Oxford University Press, 2021. http://dx.doi.org/10.1093/oso/9780198868651.001.0001.

Texte intégral
Résumé :
Freedom of Expression as Self-Restraint rigorously expounds the principle of freedom of expression, and provides a novel justificatory foundation for it. Under that principle, a system of governance in any society can legitimately prohibit various modes of communication but cannot ever legitimately prohibit them qua modes of communication. As the book argues, such a principle is absolute in that it is exceptionless; it imposes general duties that are binding always and everywhere on every system of governance. In addition to injecting a new level of philosophical sophistication into the debates over these matters, the book supplies a novel justification for the principle of freedom of expression. It ties that principle to an ideal of governmental self-restraint, and it shows how that ideal connects to the paramount moral responsibility of every system of governance: the responsibility to bring about the political and social and economic conditions under which every member of a society can be warranted in harboring an ample sense of self-respect. In short, compliance by a system of governance with the principle of freedom of expression is integral to the fulfillment of that paramount responsibility. Kramer lengthily engages with arguments by feminists in favor of legal restrictions on pornography, and with prominent arguments in favor of banning the advocacy of hateful creeds. While accepting that some types or instances of pornography and hatemongering can properly be proscribed, he maintains that most types and instances of those modes of communication are morally protected by the principle of freedom of expression.

Bisbort, Alan. Media Scandals. www.greenwood.com, 2008. http://dx.doi.org/10.5040/9798400684210.

Texte intégral
Résumé :
This fascinating volume offers an overview of the most influential and notorious media scandals, from newspaper publisher John Peter Zenger's groundbreaking 1735 trial for printing and publishing false, scandalous, malicious and seditious statements to Dr. Phil McGraw's 2008 thwarted attempt to force his television cameras inside Britney Spears' hospital room, from the attempts to ban literature by the likes of D.H. Lawrence, James Joyce, Henry Miller, and Allen Ginsberg to the excesses of gossip mongers like Walter Winchell, Hedda Hopper, Geraldo Rivera, and Matt Drudge. It delves into the tabloid press and walks through the minefields of political opinion shapers, the shouters, the muckrakers and whistleblowers. America's obsession with scandal-and the media's boundless capacity to report and sometimes even create it-did not start with O.J. Simpson, Rush Limbaugh, or Britney Spears. It was ingrained in the fabric of our nation even before Paul Revere made his famous ride. Indeed, our media's cherished right to free expression was hard-won and is now protected by the First Amendment to the U.S. Constitution, but it comes with responsibilities and is fraught with peril. The tension between the two forces of free expression and permissible subject matter has, throughout American history, caused media scandals-public outcries, legal proceedings, denunciations, violence and, in the case of Salman Rushdie's 1988 novel IThe Satanic Verses deaths. The early battles by the print media-newspapers, magazines, books-over censorship, book banning, book burning, obscenity, blasphemy and libel set the groundwork for even greater battles as the media expanded into radio, television and the Internet. Media Scandals examines this fascinating, troubled and sometimes inspiring subject from two different perspectives. First, through its recurrent themes, which reach across all media: politics; censorship; race and religion; sex and morals. The second half of the volume then examines each industry in more detail: book publishing; newspapers and magazines; radio and television, and the Internet. Augmenting this invaluable resource is a detailed timeline to help students put the wide-ranging scandals into historical perspective, and a thorough bibliography to encourage further research.

Smith, Ian, Aaron Baker et Owen Warnock. Smith & ; Wood's Employment Law. Oxford University Press, 2019. http://dx.doi.org/10.1093/he/9780198824893.001.0001.

Texte intégral
Résumé :
Smith & Wood’s Employment Law draws on the extensive teaching and practical experience of its authors to provide students with a clear explanation of essential legislation and case detail while also offering incisive academic commentary and critical detail to help with essay preparation and class work. Throughout the book, topics are carefully explained in their social and historical context, providing readers with an insight into the fast-paced development of employment law and offering perceptive analysis of its future direction. This fourteenth edition has been produced against the background of the 2015 and 2017 elections and of course with the largest elephant in the room of the result of the referendum on membership of the EU. The meaning of the latter remains a matter of almost complete uncertainty even t the time of writing two years later, and indeed is likely to remain so for much of the currency of this edition, but where appropriate it contains speculation as to possible effects. At the opposite end of the spectrum, this edition also contains the up-to-date case law on detailed employment law developments such as ACAS early conciliation, whistleblowing, discrimination law across all the forms of protected characteristics, and the whole question of the effect of modern phenomena such as social media use on traditional areas of employment law. On the collective level, this edition includes a consideration of the impact of the Trade Union Act 2016 on the calling of industrial action, picketing and time off for union activites and the latest decisions of the European Court of Human Rights, the EFTA Court and the UK courts on the impact of human rights law and of EU economic freedoms on collective labour law, in particular in relation to union recognition for bargaining and in relation to the banning of industrial action. It also considers whether the 2018 amendments to the Posted Workers Directive have any impact on the legality of any industrial action which affects the EU freedom to provide services across the boundaries of member states. More generally, it examines the extent to which workers and unions have legal protection for collective action relating to members of the gig economy Finally, the changes to the style and layout of the book adopted in the last edition have been maintained, in order to aid accessibility for the reader, given the ever-increasing complexity of the law itself here.

Phillips, Kendall R. Controversial Cinema. Greenwood Publishing Group, Inc., 2008. http://dx.doi.org/10.5040/9798400631719.

Texte intégral
Résumé :
At the heart of any history of controversial films is a strange paradox: while films, especially popular and mainstream films, are often portrayed as meaningless products of popular culture, those popular films involved in public controversies become the focal point of enormous cultural energy, political attention, and profoundly conflicting sets of principles. The ongoing culture wars continue to shape the American political landscape, and controversial films continue to be a major point of conflict. Controversial Cinema: The Films that Outraged America traces the history of controversial films and offers insights into why it is that certain films spark controversies, and how Americans typically react to controversial moviemaking. Since the widespread banning of DW Griffith's The Birth of a Nation, the American film industry has found itself embroiled in one political controversy after another. These controversies have centered on everything from the portrayal of the past, as in Griffith's film, to depictions of sex and sexuality, to the use of graphic violence, and issues of race, religion, and politics. In turn, segments of the American public have been driven to boycott, picket, and even censor those films they felt challenged their sense of decency. At the heart of this history of controversial films is a strange paradox: while films, especially popular and mainstream films, are often portrayed as meaningless products of popular culture, popular films involved in public controversies become the focal point of enormous cultural energy and political attention. The ongoing culture wars thus continue to shape the American political landscape, and controversial films continue to be a major point of conflict. In the course of this wide-ranging work, Kendall Phillips offers insights into the kinds of films that spark controversies, and the ways that Americans typically react to them. Organized around broad controversial themes and with particular attention to mainstream films since the dissolution of the Motion Picture Production Code in the mid-1960s, Controversial Cinema explores why films spark broad cultural controversies, how these controversies play out, and the long-term results. The four broad areas of controversy examined in the work are: Sex and Sexuality, Violence, Race, and Religion. Each chapter offers a broad overview of the history of these topics in controversial American films as well as more in-depth examinations of recent examples, including The Silence of the Lambs, Natural Born Killers, Do the Right Thing, and The Passion of the Christ. A final section of the book considers the broader issues of cultural politics in light of the long history of controversial cinema.

Bannink, Fredrike, et Nicole Geschwind. , Positive CBT : Individual and Group Treatment Protocols for Positive Cognitive Behavioral Therapy. Hogrefe Publishing, 2021. http://dx.doi.org/10.1027/00578-000.

Texte intégral
Résumé :
Positive CBT integrates positive psychology and solution-focused brief therapy within a cognitive-behavioral framework. It focuses not on reducing what is wrong, but on building what's right. This fourth wave CBT, developed by Fredrike Bannink, is now being applied worldwide for various psychological disorders. An introductory chapter explores the three approaches incorporated in positive CBT. Next, the book presents research into the individual treatment protocol for use with clients with major depressive disorder by Nicole Geschwind and colleagues at Maastricht University. The last chapters describe two 8-session treatment protocols for positive CBT, one for use with individuals and one for use with groups. The treatment protocols provide therapists with a step-by-step guide on how to apply positive CBT with individual clients and in group therapy. This approach goes beyond symptom reduction and instead focuses on the client’s preferred future, on finding exceptions to problems and identifying competencies. Topics such as self-compassion, optimism, gratitude, and behavior maintenance are explored. In addition to the protocols, two workbooks for clients are available online for download by therapists.
