The development of the articles on state responsibility of the International Law Commission (ILC) has been described elsewhere, in particular in the ILC’s Yearbook. The phases of development of the first (1955-1996) andsecond (1998-2001) readings are well enough known, and there is little point in repeating this material. Whatever the trials and longueurs of their production, the articles with their commentaries now exist and may be assessed as a whole.The first reading was the product of decades of work under successive special rapporteurs (Roberto Ago, Willem Riphagen, and Gaetano Arangio-Ruiz). The second readingwas equally a collective process and many members contributed to the final result. As I was formally responsible for shaping the work on second reading, I may not be the best person to comment on the outcome. Anything less than a full-scale defense of the text will be seen as an unauthorized retreat, and if the text cannot defend itself with the aid of the commentaries, it is too late for individuals to make up for any deficiencies.

Abstract The Papyrology Rooms of the Sackler Library, Oxford, preserve the correspondence of the two famous papyrologists, B.P. Grenfell and A.S. Hunt, conducted with numerous scholars from Britain and continental Europe. The main subject of this correspondence is the editing of the texts found in the Oxyrhynchus papyri. On some of the most important legal papyri, namely P.Oxy. 1814, 2089 and especially 2103 (the ‘Oxyrhynchus Gaius’), Hunt sought out the collaboration of Roman law scholars such as F. de Zulueta, W.W. Buckland and E. Levy, who all participated to a varying degree in the editorial process of these legal documents. These letters, some of them hitherto unknown, are here published for the first time. They reveal the extent of the collaboration especially between Hunt and de Zulueta, the Regius Professor of Civil Law in Oxford. In addition to this correspondence, another letter on the same theme was discovered in the University Library of Aberdeen, where de Zulueta’s personal library is now located. It was sent to de Zulueta by the Italian Roman law scholar V. Arangio-Ruiz, who was then editing the PSI 1182 (the ‘Florentine Gaius’), and shows the ongoing dialogue between the two scholars on this important legal papyrus. Taken together, these letters allow a reconstruction of the editorial process applied to some of the most significant witnesses of Roman law sources unearthed in the 20th century. This in turn provokes reflection on the desirability of submitting the standard editions of these sources to a new critical analysis.

Portrait of a not so common ‘Romanist’: Jean Acher (1880–1915) – Jean Acher, known to only a few specialists in Medieval Roman law, was an unusual scholar of Roman law. He was born in Lodz (Poland) in 1880. He studied first at St Petersburg, then in Berlin, where he attended B. Kübler’s teaching, and continued his studies at Montpellier, where he was awarded a law degree. He obtained a licence in law in 1904. At the same time, Acher also studied Romanic languages and literature. Legal and Romanic studies were the subjects of the many articles and reviews he then started publishing in several distinguished journals. In 1906, he settled in Paris. Acher became involved in the (at the time, highly controversial) issues around the methods of legal teaching, appearing as a harsh critic of the then prevailing approach to Roman law teaching. A great admirer of H.H. Fitting, he criticised specifically the exclusive focus on classical Roman law. In turn, Acher was the target of criticism by V. Arangio Ruiz and Ch.L. Appleton, which led to a confrontation with legal scholars. J. Bédier, professor at the Collège de France, supported him and, as a result, Acher devoted his work almost exclusively to the study of Romanic philology and literature. He obtained French citizenship in September 1914 and died the following year as a soldier on the frontline.

Sirih merah merupakan tanaman obat di Indonesia yang dibudidayakan secara stek. Untuk mengurangi tingkat kematian stek, dapat menambahkan zat pengatur tumbuh eksogen dengan metode perendaman dan penggunaan komposisi media tanam yang sesuai. Tujuan penelitian untuk mengetahui pengaruh lama perendaman ekstrak bawang merah terhadap pertumbuhan stek sirih merah dan komposisi media tanam yang paling baik. Penelitian menggunakan Rancangan Acak Kelompok Lengkap dua factor, yaitu lama perendaman ekstrak bawang merah (30 menit, 60 menit, 90 menit) dan komposisi media tanam ( tanah, tanah + arang sekam + pupuk kandang sapi (1:1:1), tanah + arang sekam + kompos daun bambu (1:1:1), tanah + arang sekam + vermikompos (1:1:1)). Hasil penelitian menunjukkan bahwa Interaksi antara perlakuan media tanah + arang sekam + pupuk kandang sapi dengan lama perendaman 30 menit dan 60 menit, media tanah + arang sekam + kompos daun bambu dengan lama perendaman 30, 60, dan 90 menit serta media tanah + arang sekam + vermikompos dengan lama perendaman 60 dan 90 menit menghasilkan persentase hidup stek yang tinggi dan tidak berbeda nyata. Lama perendaman ekstrak bawang merah 90 menit lebih baik dari perendaman 30 menit dalam mempengaruhi bobot kering akar. Komposisi media tanam tanah + arang sekam + kompos daun bambu merupakan komposisi media paling baik pada pertumbuhan stek batang sirih merah, yaitu pada parameter tinggi tunas 28 HST, tinggi tunas 56 HST, tinggi tunas 70 HST, bobot segar akar, dan bobot segar tunas. Mandatum incertum occurs when the terms of this consensual contract are left imprecise by the mandator. The article focuses on the essential determination of the object for the validity of the mandate, therefore the main question is whether mandatum incertum was not unknown to the classical jurists, as there is no doubt it was not void in the Byzantine era. The problem was broadly discussed by several authors, i.e., V. Arangino-Ruiz, G. Donatuti, G. Longo, A. Watson and N. Scapini, though no general agreement among modem jurists was achieved. It seems that terms of mandate are not the same as fines mandati. Fines mandati are not only the intrinsic restrictions given by the mandator, but the purpose to be achived as well. Yes, this purpose could be express or implied, then egressio mandati takes place only when the express boundaries are transgressed. The thorough analysis of relevant classical sources in the full context of the institution allows to state that there is no reason to allege that mandatum incertum was considered invalid in the classical period of Roman law. The strong evidence has been shown that classical jurists recognized mandates with terms left to the discretion of the mandatary. However, the mandatary should execute a commission in favour of the mandator’s interesse and this conduct is estimated according to the boni viri arbitratus.

Seguendo l’approccio metodologico della storia dei concetti (Begriffsgeschichte), l’elaborato mira a descrivere i cambiamenti dell’assetto politico-costituzionale italiano attraverso l’evoluzione semantica di sintagmi linguistici come ‘governo parlamentare’, ‘governo rappresentativo’, ‘governo costituzionale’, ‘parlamentarismo’. Tale analisi si concentra grossomodo in un periodo di tempo che va dalla seconda metà dell’Ottocento, fino alla prima metà del Novecento. Come fonti, accanto ai classici prodotti della dottrina politico-costituzionale, quali monografie accademiche, corsi universitari, prolusioni e discorsi parlamentari, si sono utilizzate voci di dizionari e enciclopedie, opuscoli, fonti giornalistiche, periodici e riviste di taglio più o meno specialistico e di orientamento politico diverso (liberale/moderato, cattolico, socialista, repubblicano, nazionalista, fascista). L’evoluzione concettuale di lemmi-cardine come ‘governo parlamentare’ e altri sintagmi ad esso finitimi permette di ricostruire i mutamenti della forma di governo italiana, evitando anche spiacevoli anacronismi a livello storiografico. Infatti la forma di governo non dovrebbero essere descritta attraverso quadri concettuali elaborati nella nostra contemporaneità e poi applicati retrospettivamente al passato, ma con sintagmi e concetti appartenenti alla realtà storica che si intende prendere in esame.

One of the greatest surprises that the papyri from Egypt brought to the founding fathers of Roman legal scholarship was the extent to which new citizens after 212 CE remained faithful to their own, non-Roman, legal traditions. This loyalty provided the main theme for Mitteis’ Reichsrecht und Volksrecht, and the field for the notorious dispute between Ernst Schönbauer and Vincenzo Arangio-Ruiz regarding the rationale behind this apparent continuity. Since then greater emphasis has been placed on the many aspects in which the local practice did in fact change in the decades after 212 CE. The almost universal assumption has been that in the absence of an ad hoc legal disposition or construction, the new situation would de iure have required the population to submit to the rules of Roman law in every aspect of their legal practice. This assumption, and the theories that it has fostered, will be reassessed together with some of the most notorious instances of adaptation, or rather the lack of it, to the demands of Roman law.
