Résumé :
There are many misconceptions about what is called “integral education”. We propose an integral approach to education based on the historical thinking of John Dewey and on the more recent AQAL concept by Ken Wilber. At the centre of integral education, there is a Subject. Subject equals his/her perspective. Integral education is a process of constructing/creating perspectives in the subject. We propose that four main perspectives can be applied to the educational process and the Integral Education Matrix includes these perspectives. The matrix can be a useful tool for planning actions and outcomes in the process of education.

Résumé :
Higher order thinking skills (HOTS) is an important agenda in the education system in Malaysia today in line with the Malaysian Education Development Plan (2013-2025). Practices that integrate HOTS implementation has been across the entire subject with by sourced from levels of Bloom's Taxonomy, Anderson and Krathwohl. However, for Islamic Studies which is based on the Qur'an and Sunnah, implementation HOTS elements need to be translated through Islamic education philosophy of education that puts perfection in mind the major thrust in promoting this culture of thinking skills. The emergence of figures such as Ibn Khaldun's talk about the overall education of the mind based on the concept of God has established in the perspective of understanding diversity in this HOTS. Therefore, this study used the analysis process for analyzing the literature by examining the contents of which have in common synonym or fell within the purpose of the performance-based element of teaching higher-order thinking (HOTS). The findings resulted in four major elements in need is an integrated HOTS namely through aql tamyizi, aql tajribi, aqal nazori dan hakikat insaniyah translated through the implementation process based on the concept, integration and impact. Overall, the implementation of the PdP Islamic education should emphasize integrating HOTS guidelines have been established by Ibn Khaldun to ensure value appreciation and practice by the student meets the requirements established by the reference-based Islamic Educational Philosophy. Kemahiran berfikir aras tinggi (KBAT) merupakan suatu agenda penting di dalam sistem pendidikan di Malaysia masa kini selaras dengan pelaksanaan Pelan Pembangunan Pendidikan Malaysia (PPPM) 2013-2025. Amalan pelaksanaan yang mengintergrasikan KBAT ini telah merentasi keseluruhan mata pelajaran bersumberkan kepada aras Taksonomi Bloom ubahan Anderson dan Krathwohl. Namun begitu, bagi mata pelajaran Pendidikan Islam yang berteraskan kepada Al-Quran dan As-Sunnah, pelaksanaan elemen KBAT perlu diterjemahkan melalui Falsafah Pendidikan Islam yang meletakkan kesempurnaan pendidikan akal sebagai teras utama di dalam memacu pembudayaan kemahiran berfikir ini. Kemunculan tokoh-tokoh seperti Ibn Khaldun yang membicarakan secara menyeluruh pendidikan akal berteraskan konsep ketuhanan telah mengwujudkan kepelbagaian di dalam perspektif kefahaman KBAT ini. Untuk itu, kajian ini menggunakan proses penganalisisan secara analisis kepustakaan dengan meneliti isi kandungan yang mempunyai kesamaan sinonim atau terangkum di dalam maksud pelaksanaan pengajaran guru berteraskan elemen pemikiran aras tinggi (KBAT). Dapatan kajian menghasilkan empat elemen utama di dalam keperluan untuk menginterasikan KBAT iaitu menerusi aql tamyizi, aql tajribi, aqal nazori dan hakikat insaniyah yang diterjemahkan melalui proses pelaksanaan berasaskan konsep, intergrasi dan kesan. Secara keseluruhannya, pelaksanaan PdP pendidikan Islam yang mengintergrasikan KBAT seharusnya menitikberatkan panduan yang telah dibentuk oleh Ibn Khaldun bagi memastikan nilaian penghayatan dan pengamalan oleh pelajar menepati kehendak yang ditetapkan berasaskan acuan Falsafah Pendidikan Islam.

This article aims to analyze the renewal of Islamic inheritance law in the Compilation of Islamic Law (KHI) regarding inheritance rights for fathers from the perspective of ijtihad, maslahah, and maqashid sharia. This study is a part of legal research using the library method. The approach used in this study is historical and juridical normative. The data obtained were then analyzed with the interactive qualitative analysis of the Miles and Huberman model, namely data reduction, data verification, and concluding. This study found that the provision of the father's inheritance was rejected as a valid product of ijtihad. Viewed from the perspective of maqashid al-syar'iyyah, this provision does not at all try to maintain the five basic principles above, both the maintenance of religion (din), soul (nafs), reason (aqal), offspring (nasab), property (mal). The high order thinking skills (HOTS) is a transformation in the education system in Malaysia this century in line with the implementation of the Malaysia Education Blueprint 2013-2025. The practice of implementing HOTS has outperformed the entire subject content concept by focusing on several HOTS theories in particular the Bloom and Taksnomi Marzano taxonomy. However, for the Islamic Education subjects based on the Quran and As-Sunnah, the implementation of this HOTS element needs to be translated through the basis of the Islamic Education Philosophy that puts the perfectional of the intellectual education as the main thrust in driving this thinking thinking culture. The emergence of figures such as Ibn Khaldun, which speaks thoroughly of the mind-based concept of Malakah, has sparked diversity in the perspective of the understanding of HOTS understanding. For this reason, this study uses the analysis process by analyzing the literature by examining the contents of a synonymity or summarized in the meaning of the poor concept of Ibn Khladun in the context of the teaching of Islamic education subjects. The results of this study resulted in four basic concepts in the application of HOTS through the use of Malakah combined with the use of aql tamyizi, aql tajribi, aqal nazori and insaniyah fact. In general, the implementation of Islamic Education PdP which implements HOTS should focus on the process and philosophy of teaching that Ibn Khaldun has established to ensure that students' understanding, appreciation and practice assesses the requirements set out on the basis of the Islamic Education Philosophy. Amalan pengajaran yang menerapkan KBAT ini telah melangkaui keseluruhan konsep kandungan mata pelajaran dengan difokuskan kepada beberapa teori KBAT khususnya taksonomi Bloom dan Taksnomi Marzano. Namun begitu, bagi mata pelajaran Pendidikan Islam yang berteraskan kepada Al-Quran dan As-Sunnah, pelaksanaan elemen KBAT ini perlu diterjemahkan menerusi asas Falsafah Pendidikan Islam yang meletakkan kesempurnaan pendidikan akal sebagai teras utama di dalam memacu pembudayaan kemahiran berfikir ini. Dapatan kajian ini menghasilkan empat konsep asas di dalam keperluan penerapan KBAT iaitu menerusi Malakah yang dikombinasikan dengan penggunaan aql tamyizi, aql tajribi, aqal nazori dan hakikat insaniyah. Secara keseluruhannya, pelaksanaan PdP pendidikan Islam yang menerapkan KBAT seharusnya menitikberatkan proses dan falsafah pengajaran yang telah dibentuk oleh Ibn Khaldun bagi memastikan nilaian kefahaman, penghayatan dan pengamalan oleh pelajar menepati kehendak yang ditetapkan berasaskan acuan Falsafah Pendidikan Islam.

This study aims to determine the role of the Pondok pesantren Mukmin Mandiri towards the community within the maqashid syariah framework. The research method used is a descriptive qualitative approach. The data used in this study are primary data obtained from the Pondok pesantren Mukmin Mandiri Sidoarjo and the community around the pesantren. This study revealed that pesantren have the potential to develop an Islamic perspective. The focus of economic development does not lie in mere material development. Still, it must place man as his main subject and object in relation to the Khalifah of Allah on Earth. This study uses maqashid syariah as a fundamental theory. Classifying the activities of the pesantren Mukmin Mandiri activities into the sharia maqashid dimensions, namely religion (din), soul (nafs), reason (aqal), descent (nasl) and treasure (maal). Intelligence and personality are gifts from Allah that share both similarities and differences, viewed from the perspective of Islamic Education Psychology. This research aims to explore the distinctions between the two. It is a systematic review conducted with a qualitative approach, drawing materials from various sources such as books, theses, journals, and reputable electronic resources. The findings reveal that there are commonalities and disparities between intelligence and personality according to Islamic Education Psychology. The similarities can be observed in the fundamental meanings of both terms and the aspects associated with them. In terms of their definitions, both have the root word 'aqal', which means acquiring knowledge for intelligence, while for personality, it serves as the foundation for behavior. As for their aspects, the difference lies in the fact that intellectual intelligence is utilized to develop one's intellect, while in personality, intellectuality determines behavioral patterns. Spiritual intelligence is employed to cultivate norms or values within oneself, whereas personality encompasses a person's inclination towards specific norms or values.

The contemporary urban functioning of cities requires adaptability and progressive development guided by the Sustainable Development Goals (SDG) that can be adjusted to local circumstances and needs. Currently, the small border towns in the Republic of North Macedonia (RNM) are facing numerous problems on social, economic and ecological levels (e.g., economic inequality, the unemployment and social isolation of citizens, the insufficient implementation of planning documents, the inadequate physical and functional structure of public spaces, the lack of environmental plans, improper waste management, etc.), which have influenced the efficiency and sustainability of their systems. Therefore, urban transformations are necessary due to the alarming reduction in the working-age population and the general stagnation which these towns experience. The aim of this article is to define possible solutions and recommendations for the ongoing urban challenges and transformations based on the performed analysis of the primary data sources, especially targeting the psychological and behavioral levels of identified problems, the culture of living and the management policies of local governments. The main research method used in the study was the AQAL method (all quadrants, all levels), which provided a comprehensive perspective of the current urban problems and conditions combined with a comparative analysis within an integrated framework. The application of these methods enabled the identification of the specific problems in the border towns, as well as the means and capacities for solving them, while simultaneously addressing the shortcomings and opportunities for urban renewal. By understanding the different viewpoints provided by the AQAL method, local governments, planners and policymakers can create adaptable urban models that can accommodate and overcome future changes and obstacles generated by contextual limitations. The obtained research results represent a starting point for the development and improvement of local sustainability through the advancement of economic innovations, environmental practices and social relations. Furthermore, specific recommendations are provided, directly and indirectly targeting the specificities of the selected towns, their urban development and management, as well as their future environmental and social sustainability.

The purpose of education is a component that we must know and understand in life. This has been discussed by scholars, including Imam al-Ghazali. For this reason, this study discusses the goals of Islamic education according to al-Ghazali from the perspective of Hadith. This research is a library research, namely research that uses data sources from library searches in the form of books and articles, namely the books of Hadith and their syarah, as well as the Nabawiyah sirah. The approach used is, by using qualitative data analysis methods. While the data collection technique in this study is a documentation technique, namely by collecting hadiths related to the theme, using several key words. The result of this research is that the purpose of education according to Al-Ghazali emphasizes religious and moral education. According to him, the meaning and purpose of Islamic education is education that seeks and aims in the process of forming a complete human being. As for making a curriculum, Al Ghazali has two tendencies, namely a tendency towards religion and a pragmatic tendency. As for the material aspects of Islamic education according to Al Ghazali's thoughts include: faith, morals, reason, social and physical education. The purpose of education according to the hadith of the Prophet Muhammad is to create humans who have noble character, to create humans who have a balanced life between the world and the hereafter, to create people who are useful and efficient for themselves, their families, communities and nations and even benefit the world. who are trustworthy and responsible, Realizing humans who are integrated with the progress of the world without leaving the noble values ​​contained in Islamic morals. According to him, a good teacher, apart from being intelligent and perfect in mind, must also have commendable qualities. The characteristics that must be possessed by a student are humility, purify oneself from all evil, obey and istiqamah. Meanwhile, the evaluation of education is all forms of activities related to their respective responsibilities in the educational process. The Alfiyyah book is a book of naḥwu used in various institutions in Indonesia, from Islamic boarding schools to universities. This book is recommended by many scholars, one of which is the book of Syarh Ibn Aqil. This book contains an explanation of Alfiyyah's naẓams in great detail. In addition to explaining the material in naẓams, Ibn Aqil also reviewed various opinions of naḥwu experts. The two significant schools of thought in the development of naḥwu science are often used as a benchmark for comparison, namely the Basrah and Kuffah schools. This study aims to discover the different opinions between these two schools in the book of Syarh Ibn Aqil and the factors that cause the differences. The method used in this research is descriptive qualitative through a literature study using documentation. The results of this study state that these two schools have different views in determining the rules of naḥwu, such as amil who recites multiday, taqdῑmul khabar, taqdῑmul fā‘il, etc. This is based on the different methods used in determining the rules. With the sima‘i method, the Basrah School is more selective in retrieving data. At the same time, Kuffah is more flexible and often uses the qiyas method to determine the rules.The purpose of learning naḥwu in the context of learning Arabic in Indonesia is as a wasῑlah (language learning tool), not as a gayah (final goal). Therefore learning naḥwu in the context of teaching Arabic needs to be done tajdid by looking at the importance of facilitating, simplifying, and reforming naḥwu material. Learning naḥwu should avoid philosophical analysis such as that developed by Basrah and accommodate all Arabic languages as developed by Kufah. AbstrakKitab Alfiyyah merupakan kitab naḥwu yang digunakan berbagai lembaga di Indonesia, mulai dari pesantren hingga perguruan tinggi. Buku ini direkomendasikan oleh banyak ulama, salah satunya adalah kitab Syarh Ibnu Aqil. Buku ini memuat penjelasan tentang nama-nama Alfiyyah dengan sangat detail. Selain menjelaskan materi naẓams, Ibnu Aqil juga mengulas berbagai pendapat dari para ahli naḥwu. Dua mazhab penting dalam perkembangan ilmu naḥwu yang sering dijadikan tolok ukur pembanding, yaitu mazhab Basrah dan Kuffah. Kajian ini bertujuan untuk mengetahui perbedaan pendapat antara kedua mazhab tersebut dalam kitab Syarh Ibnu Aqil dan faktor-faktor yang menyebabkan perbedaan tersebut. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif melalui studi pustaka dengan menggunakan dokumentasi. Hasil penelitian ini menyatakan bahwa kedua mazhab ini memiliki pandangan yang berbeda dalam menentukan aturan naḥwu, seperti amil yang membaca multiday, taqdῑmul khabar, taqdῑmul fā'il, dll. Hal ini didasarkan pada perbedaan metode yang digunakan untuk menentukan aturan. Dengan metode sima'i, Mazhab Basrah lebih selektif dalam pengambilan data. Sedangkan Kuffah lebih fleksibel dan sering menggunakan metode qiyas untuk menentukan aturannya. Tujuan pembelajaran naḥwu dalam konteks pembelajaran bahasa Arab di Indonesia adalah sebagai wasῑlah (alat pembelajaran bahasa), bukan sebagai gayah (tujuan akhir). ). Oleh karena itu pembelajaran naḥwu dalam konteks pengajaran bahasa Arab perlu dilakukan secara tajdid dengan melihat pentingnya kemudahan, penyederhanaan, dan pembenahan materi naḥwu. Pembelajaran naḥwu harus menghindari analisis filosofis seperti yang dikembangkan oleh Basrah dan mengakomodasi semua bahasa Arab seperti yang dikembangkan oleh Kufah. The results of this study construct this resource management with maqāṣid al-syarī'ah which consists of five perspectives, namely: ḥifẓ al-dīn (optimization of religiosity), ḥifẓ al-nafs (optimization of psychic and physical), ḥifẓ al-aql (optimization of reason), ḥifẓ al-māl (optimization of wealth) and ḥifẓ al-'irdh (optimization of honor / self-esteem), from this perspective the theory of human resource management maqashidi is built with five main components, namely: Mutadayyin (religion), ḏaki (intelligent), munazzam (manejerial) matīn al-khuluq (morality) mutamayyiz (performance/achievement).

With the development of the German higher education certification system, its certification standards and procedures are also improving day by day. In this context, a large number of institutions have emerged that provide certification services for higher education. This article mainly focuses on two cross-disciplinary certification bodies, the Professional Accreditation and Quality Assurance Agency (AQAS) and the Certification and Quality Assurance Institute (ACQUIN), to analyze the commonalities and differences between the two certification bodies from the perspectives of standard formulation and expert review. The results indicate that in terms of standard formulation, ACQUIN emphasizes the improvement of the quality system of the profession itself, while AQAS focuses on the positioning and characteristics of a certain profession in relevant industry fields. In terms of expert evaluation, ACQUIN and AQAS have different focuses on ensuring program fairness and expert selection. ACQUIN values the evaluation ability of experts, while AQAS places greater emphasis on their academic background.

Most of the books of Islamic Creed found in Islamic heritage are characterized by their presentation of theology from the perspective of a particular sect out of the major Islamic sects. This methodology has given rise to serious and detrimental problems that affect the ummah (Muslim nation) up until this day, and from it stems the issues that divide the ummah. It is thus apparent that it is incapable of presenting the issues of theology from the perspective of that unites the Muslims. It is true that this methodology had been sound at one point during which it had to be applied; it had been the means of expression in dialogues and the way to answer questions related to pertinent matters of the time, as well as to address urgent new issues at that particular time. However, the goal of teaching Islamic Creed in this time of ours academically in specific is not based upon the instabilities and issues that it had once driven it. Hence, it is necessary to change the approach, methodology, and discourse to suit the change in impetus to and the goal of authoring such books, as well as the change in the general way of living of the people and their way of thinking. It is also worth noting that the universal moral principles associated with such changes do not necessarily contradict religion. This review undertakes a new book attempting to respond to a challenge resulted out of the classical discourses and arguments in presenting Islamic worldviews, and hence the reality of so-called Ahl Sunnah Wal Jama’ah

Minimizar os riscos relacionados aos fenômenos climáticos e identificar a melhor época de plantio, nos diferentes tipos de solo e ciclos de cultivares, é cada vez mais importante. Neste contexto os estudos de estimativas de rendimento agroclimático são muito relevantes. Nesta perspectiva, objetivou-se neste trabalho analisar indicadores que influenciam na produção da soja e do milho safrinha, em comparação aos parâmetros utilizados para zoneamento agrícola, nas áreas que abrangem as estações meteorológicas dos municípios de cinco munícipios de Mato Grosso. Adaptando a metodologia da FAO (1978), foram estimados o rendimento potencial e o rendimento agroclimático para as culturas, formada pela interpolação das séries existentes de cinco estações meteorológicas, referentes ao período de 2007 a 2011, localizadas nos municípios de Cuiabá, Jaciara, Poxoréu, Rondonópolis e Santo Antônio do Leverger. Com auxílio do software ArcGis 9.2/ArcMap gerou-se os mapas digitais e realizou-se o cruzamento dos dados, possibilitando a visualização, exploração e análise de informações espaciais. As manchas de Latossolo Vermelho-Escuro distrófico e Latossolo Vermelho-Amarelo distrófico ofereceram as condições mais adequadas para a produção de Soja e Milho, sendo estas áreas consideradas plenamente aptas para a produção das duas culturas. Já as manchas de Argissolo Vermelho eutrófico (PVe11) e Neossolo Quartzarênico (AQa3, AQa8 e AQa22) foram consideradas marginalmente aptas para o cultivo das culturas, sendo as demais consideradas inaptas. O modelo da FAO adaptado para a estimativa do rendimento agroclimático apresentou desempenho satisfatório, mostrando, portanto, ser uma ferramenta útil para a previsão de safras da soja e do milho safrinha.

Zakat is one of the essential instruments in sustainable development, and its implementation is considered relevant to the concept of Maqāṣid al-Sharī'ah, which aims to achieve benefit. The purpose of this study is to analyze the realization of Zakat on the achievement of SDGs from the perspective of Maqāṣid al-Sharī'ah, which includes hifẓ al-din, hifẓ al-nafs, hifẓ al-māl, hifẓ al-naṣl and hifẓ al-aql. This research is descriptive quantitative research with horizontal analysis and comparative analysis. The sampling technique in this study is purposive sampling. The research samples are BAZNAS, LAZ Rumah Zakat, LAZ Dompet Dhuafa, LAZ Inisiatif Zakat Indonesia, LAZ Yatim Mandiri, LAZ The Panti Yatim Indonesia Foundation, LAZ Baitulmal Muamalat and LAZ Mizan Amanah. The data collected in this study were from the Annual Report and the financial reports of zakat institutions from 2016-2019. The results show that all zakat institutions have realized Zakat on the achievement of SDGs from the Maqāṣid al-Sharī'ah perspective, which includes hifẓ al-dīn, hifẓ al-nafs, hifẓ al-māl, hifẓ al-naṣl and hifẓ al-aql. Zakat institutions have realized Zakat on the achievement of SDGs from a Maqāṣid al-Sharī'ah perspective which includes hifẓ al-dīn, hifẓ al-nafs, hifẓ al-māl, hifẓ al-naṣl, and hifẓ al-aql. Overall, the realization of Zakat on SDGs from the perspective of Maqāṣid al-Sharī'ah is most significant in the hifẓ al-māl dimension. The most dominant LAZ Rumah Zakat is the realization of Zakat from the hifẓ al-māl perspective on the SDGs. Meanwhile, from the standpoint of hifẓ al-naṣl, hifẓ al-nafs, and hifẓ al-aql towards SDGs is greatest at Laz Dompet Dhuafa. As for the realization of Zakat on the hifẓ al-din dimension, the highest is BAZNAS. Thus, the Zakat is allocated more to the SDGs to end poverty. This research implies that zakat institutions remain consistent in realizing their funds towards sustainable development goals from the perspective of Maqāṣid al-Sharī'ah and increasing their performance to make a significant contribution to welfare.

This article aims to examine the concept of ‘aql based on the neuroscience and the Qur’an perspective, the implications to the scientific approach in the Islamic education as well. This article is a literature review with a descriptive qualitative approach. The technique of data collection was done by analytic descriptive by using the related themes as the data. The results of the study indicate that reasoning function is equivalent to brain function. Brain optimization not only makes students smart rationally but also emotionally and spiritually. The equality of ‘aql and brain functions will produce the students who have a good skill of life. These skills include specific skills and the three pillars of students' success such as knowledge, skills, and motivation. These three pillars form a superior personality, which called as ulil albab in the Qur’an perspective.

The originality of this research is where previous studies only discussed waste banks from the green economy perspective of maqashid sharia, or discussed economic empowerment only, but in this study it combines all aspects of previous research. This study aims to describe the role of the Sumringah waste bank in improving people's welfare, where the indicator used is Maqashid Syariah. This research uses qualitative research methods, with a case study approach. The waste management system at the Sumringah Waste Bank applies the 3R principle (reduce, reuse, recycle), this aims to motivate the community and increase awareness about managing waste independently from the source, as well as implementing a people's economy. The results of the analysis obtained indicate that there is prosperity in terms of: 1) Spirituality, namely by increasing alms Jariyah (hifz ad-din), 2) fulfilling mental needs (hifz an-nafs), 3) understanding about waste management and environmental hygiene (hifz al-nafs). aql), 4) maintenance of offspring (hifz al-aql), 5) income (hifz al-maal). The implication is as a behavior changer for the community, economic empowerment and quality of life of its members.

Both intelligence and personality are the Allah’ (S) grace that the two of them have similarities and differences, which are seen according to Islamic educational psychology. This study aimed to examine the differences between them. This research was a literature review with qualitative design by taking material sources from literature studies in books, theses, journals, and other electronic sources that can be scientifically justified. This research showed that there are similarities and differences between intelligence and personalities according to Islamic educational psychology. Both the meaning and the aspects seem good on them. Among those meanings, there is the word “Aqal” which in the context of intelligence it was used to obtain the acquaintance, while in the context of personality it was used as the base of the attitude. In these aspects, the intelligence and personality have the differences; intellectual intelligence is used to grow the intellectual aspects, intellectual rational personality is used behavioral base, as well as while it appears the differences between spiritual-moral intelligence and idealistic personality, spiritual-moral intelligence is used to apply norms or values and idealistic personality is to love norms or values.

This study aims to analyze the hajj services of the Ministry of Religious Affairs of the Republic of Indonesia and the Malaysian Hajj Savings Institute from the maqâshid al-syarî`ah aspect. This study used a qualitative method with a phenomenological approach. The data was obtained through interviews and documents. The data was analyzed through a process of extension of observation and triangulation of sources as well as techniques between interview data and documents. This data was then discussed and analyzed using the maqâshid al-syarî`ah approach. Aspects of the Hajj service of the Ministry of Religious Affairs of the Republic of Indonesia and the Malaysian Hajj Savings Institute here include aspects of the intensity of the guidance of the hajj rituals that have been in accordance with the maqâshid al-syarî`ah in the aspects of hifdz al-dîn and hifdz al-`irdh. Hotel accommodation services are in accordance with the aspects of hifdz al-`aql, hifdz al-ruh, and hifdz al-`irdh. Consumption services are in accordance with the aspects of hifdz al-nafs and hifdz al-`aql. Meanwhile, health services are in accordance with the aspects of hifdz al-nafs. Penelitian ini bertujuan untuk menganalisis pelayanan haji Kementerian Agama Republik Indonesia dan Lembaga Tabung Haji Malaysia dari aspek maqashid syari’ah. Penelitian ini menggunakan metode kualitatif dengan pendekatan fenomenologis. Data diperoleh melalui wawancara dan dokumen. Data dianalisis melalui proses perpanjangan pengamatan dan triangulasi sumber maupun teknik antara data wawancara dan dokumen. Data ini kemudian dibahas dan dianalisis dengan pendekatan maqashid syari’ah. Aspek pelayanan haji kementerian Agama RI dan Lembaga Tabung Haji Malaysia meliputi aspek intensitas pembimbingan manasik haji telah bersesuaian dengan maqasid syari’ah pada aspek hifdz al-din dan hifdz al-‘irdh. Pelayanan akomodasi perhotelan bersesuaian dengan aspek hifdz al-‘aql, hifdz al-ruh, dan hifdz al-‘irdh. Pelayanan konsumsi bersesuaian dengan aspek hifdz al-nafs dan hifdz al-‘aql. Sedangkan pelayanan kesehatan bersesuaian dengan aspek hifdz al-nafs.

The purpose of this paper is to analyze Abu al-Su'ud Al-'Imadi's exegetical manual, Irsyad al-'Aql al-Salim ila Mazaya al-Kitab al-Karim, focusing on the manual's sources of interpretation (mashdar), techniques of interpretation (manhaj), and interpretation orientation (ittijah). The mufassir's life story, his scientific discoveries, and the context of the commentary's composition are all briefly covered. This method of research is qualitative and takes a literature-based approach. From the perspective of the source, Abu al-Su'ud Al-'Imadi's commentary Irsyad al-'Aql al-Salim ila Mazaya al-Kitab al-Karim falls into the category of interpretation bi al-Ra'yi; from the perspective of the method, it employs the tahlili; and from the perspective of the orientation, it includes the lughawi. Abu al-Su'ud al-'Imadi was a scholar who lived during the Ottoman Empire's golden age, when the population enjoyed economic success, political stability, and scientific advancement. This seems to be the driving force behind Abu al-interpretation Su'ud's from a linguistic perspective. His ardor for the Arabic language and literature, which has elevated him to the level of an expert in the field, is another important factor in the linguistic focus of his interpretations (lughawi).

Background: The performance assessment of tests that express qualitative results in the medical laboratory is of primary importance in characterization, diagnosis, follow-up, and screening. An important contribution to this type of assessment may be the publication of the Eurachem AQA 2021 guide. The text intends to principally discuss the consistency of the subclauses of this guide with ISO 15189 and CLSI EP12-A2. Methods: The study involves a literature review within the scope of qualitative tests. Results: Tables are used for crossing AQA. with ISO 15189 and CLSI EP12-A2. Conclusions: Consistency with ISO 15189 and CLSI EP12-A2 is demonstrated in the study. Introducing “uncertainty of proportion” reflects the necessity of assessing uncertainties when dealing with qualitative results.

The purpose of this study is to describe human resource management from the perspective of LPI Al Maqasid Al Šar'iyyah, namely the perspective of hifzud din, difzun nafs/haya/al 'Ir?, hifzul 'aql, hifzun nasal, hifzul mal. Method: The writing method is a literature study with primary data from journals and books. Result: The result of this paper is that the perspective of Al Maqasid Al Šar'iyyah (Hifzud Din, Hifzun Nafs/hayat/Al 'Ird, Hifzul 'Aql, Hifzun Nasl, Hifzul Mal) can provide a holistic formula regarding the management of human resource management in Islamic educational institutions so that creating superior human resources that will have a positive impact on the progress and quality of Islamic educational institutions. Conclusion: Human resource management from an Islamic perspective must be based on the principles and functions of Islamic management. Al Maqasid Al Šar'iyyat's perspective on HRM in order to achieve a big goal, namely Al Falah (good in this world and the hereafter). Implementation from the perspective of Al Maqasid Al Šar'iyyat's on HRM at LPI is a management formulation to realize credible, professional, and quality HR towards an advanced, quality, and competitive LPI.

Kyai Said Aqil Siroj's typology of thought is an inclusive (open) religious typology and the Ahl al-Sunnah Wa al-Jama'ah perspective of Kiai Said can be said of the inclusiveness of Ahl al-Sunnah Wa al-Jama'ah. So Ahl al-Sunnah Wa al-Jama'ah must contain tawasut, tasamuh, tawazun and i'tidal in acting or thinking. So as to respond to new things in modern life such as human rights. Abstract: Women have always been an interesting conversation in life, whether it's about fighting for their rights or about rules for women to Islamic views on the position of women in the family and society. The perception that occurs in this community illustrates that each religion and its adherents and society differentiate between men and women are very different. So that these rules are indicated based on religious rules, community rules, and cultural values in society. This study aims to find out about women in the perspective of Uthman bin Abdullah bin Aqil bin Yahya. The method used is qualitative through literature study based on the book of Uthman bin Abdullah bin Aqil bin Yahya and various other literature. It can be concluded that some of Uthaman's views are in line with Islamic teachings regarding rules for women. However, there are several things that are contradictory if these rules are related to the current era. Abstrak: Perempuan selalu menjadi perbincangan yang menarik di kehidupan, baik itu tentang memperjuangkan hak-hak nya maupun mengenai aturan-aturan bagi kaum perempuan hingga pandangan Islam terhadap kedudukan perempuan di keluarga maupun masyarakat. Adanya persepsi yang terjadi pada masyarakat tersebut menggambarkan bahwa setiap agama maupun penganutnya dan masyarakat dalam membedakan laki-laki dan perempuan sangat berbeda. Sehingga aturan-atuaran tersebut di indikasikan berdasarkan aturan agama, aturan masyarakat, serta nilai-nilai budaya dimasyarakat. Penelitian ini bertujuan untuk mengetahui mengenai perempuan dalam perspektif Utsman bin Abdullah bin Aqil bin Yahya. Metode yang digunakan, yaitu kualitatif melalui studi pustaka berdasarkan pada kitab Utsman bin Abdullah bin Aqil bin Yahya dan berbagai literatur lainnya. Dapat disimpulkan bahwa Beberapa pandangan utsaman sejalan dengan ajaran Islam mengenai aturan-atuaran bagi perempuan. Akan tetapi terdapat beberapa hal yang bertentangan jika aturan-aturan tersebut dikaitkan di zaman saat ini.

This paper asserts that education is an important instrument in life. Specifically, this article describes the rationale for Muslim’s obligation to participate actively in education, and the roles they play in the implementation of a quality education. All will be assessed from the perspective of Islamic teachings, particularly the Qur’an and Hadith. In addition, to strengthen and complement this paper, the perspective of the International Covenant on Economic, Social and Cultural Rights (ICESCR), which confirms that the Islamic community is a unified living entity when it comes to fulfilling education (kiyan hayy wahid). Therefore, the cooperation of various parties in the administration of education in accordance with the principles of maqasid shariah and the ICESCR is part of the Qur’anic command to do good deeds and piety (ta’awun ‘ala al-birr wa at -taqwa). Cooperation should embodied in an effort to develop a culture of reading and writing, preparing facilities and infrastructure, to increase educational human resources and create an environment conducive to education. Contribution of the Muslim community in educational issues should be the expectation of all parties.

Acceptance sampling plans are divided into attributes and variables, which are used to evaluate the mechanism for determining lot quality. Traditional attribute sampling plans usually choose the Acceptable Quality Level (AQL) for each stage based on experience but need practical guidelines to follow. Previous research endeavors have predominantly centered around statistical perspectives and emphasized the reduction of sample size or sampling frequency while allocating lesser consideration to cost factors and practical applications when formulating sampling decisions. This study proposes a dynamic sampling strategy to minimize costs and estimate AQL values and sample sizes for each stage based on product quality performance to establish a more effective and flexible sampling strategy. The study verifies the scenario in an integrated circuit (IC) testing factory, considering multiple combinations of between-batch quality conditions, within-batch quality conditions, sampling method, and cost ratio, and conducts sampling inspection simulations. When quality changes, the dynamic strategy is activated to adjust AQL. Finally, based on the sampling errors and costs in the inspection results, a comparison is made with the traditional MIL-STD-105E sampling plan, confirming that the dynamic AQL sampling plan has significantly improved performance.

The research aim is to analyze human development based on the Islamic Human Development Index (IHDI) perspective in the Special Region of Jakarta. The measuring instrument used by IHDI in this research is Maqashid Sharia which has five fundamental elements such as, Hifdzud Dien, Hifdzun Nafs, Hifdzul Maal, Hifdzul 'Aql, and Hifdzun Nashl. The five elements of this Maqashid Sharia are then measured with determining indicators and 13 indicators being analyzed. The method used in this research is the Fixed Effect Model regression method. For data processing, this research utilizes E-Views 10 software. The data used in this research is secondary data obtained from Statistic Indonesia, Ministry of Religious Affairs Indonesia, and Baznas DKI year 2010-2019. The outcome of this research is that based on Fixed Effect Model regression testing there are impacts between Hifdzud Dien, Hifdzun Nafs, Hifdzul 'Aql, Hifdzun Nashl, and Hifdzu Maal with human development index (HDI) in DKI Jakarta in 2010-2019. The implication from this research is that the five variables with 13 indicators analyzed, generally has significant implication towards HDI, especially Hifdzu Aql variable which is represented by the average length of school and the portion of the education budget. For that reason, the government should be able to encourage human development with an IHDI perspective. The most important things are improving the quality of education and education budget for citizens, besides encourage the citizen to obey religious values, such as doing zakat, avoiding criminal things and e.tc, which significantly affect human development in DKI Jakarta.

This paper aims to see the extent of the problems faced by humans, especially educators in overseeing the Religion-Science dichotomy. Here the researcher uses Mehdi Golshani's thinking. This is because Gholsani is one of the modern physicists who offers "ingredients" for theology-science in facing the 5.0 era. This is the reason for the researcher to reflect on his thoughts in observing the religion-science dichotomy for the present and future eras. The approach used in this paper is qualitative by describing articles related to the research title. However, the author also added the results of a questionnaire given to 203 students regarding science and religion. This is done to support more convincing data regarding religion-science. The results of the study provide an answer that Mehdi Golshani considers that modern science only relies on sensory reality, science has limitations in being able to talk about all aspects. The Golshani offer refers to the basis of the Quran, Sunnah and Muslim scholars. Golshani refers to the Quran so as not to mention that science is true, he also explains that the Koran does not regard it as the only source of knowledge about nature, because there are other sources such as reason. Meanwhile, for Golshani's reasoning and understanding, he uses 2 sciences, namely Aqaly and Sama'i Sciences. The meaning of aqaly knowledge is knowledge obtained through research, for example biology, chemistry and so on and sama'i knowledge is knowledge obtained through hearing such as linguistics and literature. Then the field of understanding the objects of science in Islam can be used in three ways, namely through the senses, mind and heart.

To date, research has focused on developing a resilient leadership model for entrepreneurs. Given the current economic and competitive business landscape, small and medium-sized enterprise (SME) leaders are expected to become more resilient to ensure organizational survival and to remain sustainable and relevant in the marketplace. Recent scholars have incorporated the element of spiritual intelligence as a dimension of a resilient leadership construct. Therefore, the purpose of this paper is to discuss the importance of resilient leadership and spiritual intelligence by taking on the contemporary and Islamic perspectives. The final score of the four items measuring spiritual intelligence indicated a good level of consistency and reliability (α = 0.846). The themes that remained are self-consciousness, purpose-driven, self-determination, and devotional inclusivity. A review from an Islamic perspective indicated that quality leaders need to possess physical strength (al-qawiyy) and moral strength (al-amin). The development of these strengths would allow them to endure challenges, instill good values and be accountable as they understand that they are the guardians of their subjects (businesses and people). In addition, spiritual intelligence from an Islamic perspective also highlights four main components that include the heart (al-qalb), the spirit (al-ruh), the soul (al-nafs) and the intellect (a;-‘aql). The development and combination of all these four components would help leaders reach the level of “Qudwah Hasanah,” a true leader with the utmost awareness of his responsibility of leadership in his organization.

Studying the field of psychology in combination with religion has become a significant trend. Traditionally, Muslim philosophers, theologians, and mystics had been studying Psychology from an Islamic perspective under the label of ‘al-ilm-un-nafs’ i.e. knowledge of the soul. Their understanding of ‘nafs’ is mostly related to ‘soul’ or ‘spirit’. Recent Muslim scholars have re-invented the same wheel and have tried to merely promote the prominent Muslim philosophers instead of converting their work into modern understandings. Sticking with the translation of ‘nafs’ as soul or spirit has made several verses of Quran difficult to understand in modern psychological perspective. Since the subjects of psyche and intellect are within the domain of psychology in our times, this current study analyzed the content, context, and the psychological themes of the Quranic terms ‘nafs’, ‘rooh’, ‘aql’, ‘qalb’, and ‘foaad’ in 420 verses. This study established that the term ‘nafs’ in Quran is mostly used for ‘psyche’ i.e. mind and self. The terms ‘qalb’, ‘aql’, and ‘foaad’ are all used to relate to‘intelligence’. The current study is highly significant in its scope as none of the earlier or later Muslim scholars translated the word ‘nafs’ as ‘mind’, which is the best suited alternative in our times and can allow Muslims to understand Quran in a more convenient and updated way.

Equine Facilitated Psychiatry and Psychology (EFPP) is a supportive non-pharmacological treatment program used in the treatment of patients with substance use disorder. The aim of this study was to evaluate a possible change in patient’s health and health-related quality of life between the first and fourth session of the EFPP program using the Assessment of Quality of Life (AQoL) and the Health of the Nation Outcome Scales (HoNOS). The Human-Animal Interaction Scale (HAIS) and a 5-point Likert-type scale was used for an assessment of patient’s mood in the experimental group. The study sample included 57 patients (39 in experimental group with EFPP and 18 without EFPP program) with substance use disorders hospitalized in the psychiatric hospital. Comparing the initial and final patients scores in the experimental group, there was a significant positive shift in three of the four domains of the HoNOS scale and in seven of the eight dimensions of the AQoL scale. HAIS significantly increased (p <0.001) in time as well as patient´s mood after every session and in long time perspective. Based on these results, we can assume that the EFPP might be one of the successful programs which may improve patient´s mood and social interactions in substance use disorders.

The purpose of this study is to clarify Islamic perspectives on human rights and democracy. The research method employed is a literature study with a qualitative approach that is examined using content analysis. The results of the research show that, within certain limits, Islam upholds the implementation of human rights that must be obtained by everyone. In Islam, there are concepts of al-usia al-daruriyah (human needs) and al-usia al-hajjiyah (human interests) that humans must fulfill and defend, such as the right to life (hifz al-nafs), the right to religious freedom (hifz al-din), the right to free thought (hifz al-'aql), property rights (hifz al-mal), and the right to have offspring (hifz al-nasl). Likewise, with democracy, Islam upholds democratic principles such as al-musawah (egalitarianism), al-hurriyah (independence), al-ukhuwwah (brotherhood), al-Jadi (justice), and al-syura (deliberation). Even these principles are in line with the basic concepts of Islamic teachings to a certain extent, even though in practice, not all such democracies are justified. The parameters of democracy (including the concept of human rights) are that it is accepted by Islam as long as it does not contradict the essential principles of Islam.

This study aims to provide an overview of the nature of infotainment, the view of Islamic law on media and information products, and the view of Islamic law on infotainment. This research is a qualitative, descriptive study with library research techniques using philosophical, historical, and sociological approaches. The results show two main findings. First, infotainment is basically an information product containing entertainment elements, news, and information about celebrities. It is dominated by celebrity news that is not required by society and potentially provides negative impacts on people's social lives. Second, in the perspective of Islamic law, the media of information in all its forms is something of a neutral nature and hence the legal status depends on the usage purpose. By looking at the elements contained in an infotainment show (gibah, namīmah, and al-jahr bi al-fahisyah) coupled with the violation of at least two main objectives of Islamic Sharia (hifz al-a'rad and hifz al -'aql), infotainment with its present reality is something that is forbidden. The implication of this conclusion is that all attempts to produce, distribute, and consume them are unlawful (haram).

This research is based on the benchmark Human Development Index (HDI) is not comprehensive and has not been by Maqashid al Syariah. This research aims to find out the Islamic Human Development Index (Islamic HDI) based on the perspective of Maqashid al Syariah, along with its dimensions and indicators. The research method used is the study of literature in-depth, by comparing some literature related to research themes. Theories used include Maqashid al Syariah and Human Development Index. The results showed the Islamic HDI consisted of five-dimensional indices, namely Faith (ad-din), Life (an-nafs), Intellect (al-aql), Offspring (an-nasl), and Wealth (al-mal). As for indicators per dimension, among others, the Faith Dimension consists of two indicators, namely obedience, and integrity. The dimensions of the Life include life expectancy and multidimensional poverty. The dimensions of Intellect include the level of education and literacy. The Offspring Dimension consists of birth rate indicators and infant mortality rates, and the Wealth Dimension includes purchasing power ability (per capita income indicator) and Gini ratio indicator.

This paper sheds light on the reasons for performing corrective surgery for intersex person to get married. The data were collected through the examination of works on intersex. The results of this study reveal that Islamic law, following the maqāṣid syarīah approach, allows the intersex person to perform corrective surgery with/without the intention of marriage. The choice to conduct corrective surgery does not violate the five principles of maqāṣid syarīa: the principle of religion (ḥifẓ ad-dīn), the principle of the soul (ḥifẓ an-nafs), the principle of mind (ḥifẓ al-‘aql), the principle of descent (ḥifẓ an-nasl), and the principle of property (ḥifẓ al-māl). However, corrective surgery is limited to the people who biologically have sexual disorders and the surgery must be safe according to medical science.Artikel ini menjelaskan alasan melakukan operasi kelamin bagi orang interseks untuk menikah. Data dalam penelitian ini dikumpulkan dengan cara menelaah berbagai literatur yang membahas interseks. Hasil penelitian ini mengungkapkan bahwa berdasarkan pendekatan maqāṣid syarīah, hukum Islam membolehkan orang interseks melakukan operasi penyempurnaan kelamin, baik disertai niat untuk menikah maupun tidak terlebih dahulu. Pilihan untuk melakukan operasi penyempurnaan kelamin tidak melanggar kelima prinsip maqāṣid syarīah, yakni prinsip agama (ḥifẓ ad-dīn), prinsip jiwa (ḥifẓ an-nafs), prinsip akal (ḥifẓ al-‘aql), prinsip keturunan (ḥifẓ an-nasl), dan prinsip harta (ḥifẓ al-māl).Namun, operasi penyempurnaan kelamin hanya dapat dilakukan bagi orang yang memang benar-benar secara biologis mengalami kelainan seksual. Dan operasi yang dilakukan harus memenuhi standar ilmu kedokteran.

<p><em>This research motivated by Islamic Microfinance performance measurement which still adopting on the performance measurement of microfinance in general that limited to the measurement of material. Therefore, efforts urgently needed to introduce more holistic measurement in assessing the performance of Islamic Microfinance based on tawheed principle. Thus, this study aims to measure the performance of Islamic Microfinance institutions based on Maqashid Al-Sharia. This research method uses quantitative approach with descriptive quantitative research design, which measures variables based on certain indicators. The location of the research is KOPMU-DT as one of the Islamic Microfinance institutions located in Bandung. The population of the study was the members KOPMU-DT wide-spread, among thousand people, but the withdrawal sample technique uses non-probability sampling with a sample of 100 members, based on the criteria that have been determined. Based on the research result, generally the members of KOPMU-DT increased living standards of the family economy and the performance of running micro-businesses. In Maqashid Al-Sharia perspective, the members experience a change in the principles of Ad-Din Al-Aql, A-nafs, An-Nasl and Al-Maal. However, among five principles, Al-Aql increases lower than other principles. In the future, to improve the performance of Islamic Microfinance, especially in KOPMU-DT, needs technical effort / business of accompaniment improvement to develop entrepreneurship from members. In addition, needs to give appreciation to the consistent members and disciplined in order to refund to add its financing to stimulate the operating business, without losing spiritual accompaniment to strengthen the achievement of Maqashid Al-Sharia of the empowerment members of Islamic Microfinance institution.</em></p><strong><em>Keywords: </em></strong><em>Islamic Microfinance, Maqashid Al-Sharia, Performance</em>

In the history of the development of Islamic law, the existence of fiqh is one of the sciences that has given birth to a variety of methodologies in Islamic legal studies. Broadly speaking, the existence of fiqh proposals can be represented by the presence of Sunni and Shi'a fiqh proposals. As a theological group in Islam, Shi'ah has a different concept of fiqh from Sunni. This research is descriptive in nature, providing an explanation of the history of the development of shia fiqh, law in the perspective of shia, the propositions of shia fikh, and Istinbat in the perspective of shia. The conclusions from this study, that the Shi'a fiqh proposal is divided into two groups, namely Akhbariyyun and Uṣuliyyun. In the process of determining the law, the Akhbariyyun group returned the matter to the Qur'an and Sunnah based on the determination of their Imams. The Akhbariyyun group holds that only their imams have the authority of ijtihad to establish laws based on the Qur'an and Sunnah. As is known, scholars' Shi'ah call Dalil al-Qur'an, Sunnah, Ijma, and ‘Aql as the proposition Ijtihadi. Thus it can be said that Uṣul Shi’ah Akhbariyyun is; Al-Kitab, namely al-Qur'an, Sunnah and words, deeds, and taqrir of the Imam. The Uul Uṣuliyyun group, namely; Al-Kitab, Sunnah, and the words, deeds, and taqrir of the Ulema and Ijtihad which in their terms are called the proposition ‘Aql.

I-HDI stands for Islamic Human Development Index which is used as a measuring tool for human development in an Islamic perspective. In formulating the I-HDI, the guidelines for the objectives of sharia or maqashid sharia are used as an indicator of human needs both materially and spiritually. The purpose of this study is to describe the budget for health, education and economics from the perspective of the Islamic Human Development Index in the Bogor City in 2021 . The research method used is descriptive quantitative. Based on the regional government program of the Bogor City, the results show that the health, education and economic budgets are in line with the objectives of the I-HDI. The highest budget is occupied by the education budget of Rp 492.984.200.958, health budget of Rp. 289.239.714.720 and an economic budget of Rp. 82.369.922.609. Then for the results of the I-HDI calculation, each index gets an average value for five years. The ad Dien index is 0,778 the an Nafs index is 0.828, the al 'aql index is 0,642 the Nasl index is 2.815 and the al Maal index is 4.29. From these results, there are several aspects in the execution of the program that have not been carried out optimally. This article aims to analyze the management of Rindu Hati Tourism Village from the perspective of Maqashid Syari’ah. The economic aspect of Islam is focused on the analysis of Maqashid Syari’ah, namely Hifdz Din (maintaining religion), Hifdz Aql (guarding reason), Hifdz Nasl (keeping offspring), Hifdz Nafs (guarding the soul), Hifdz Maal (keeping property). This study uses a qualitative descriptive method with the type of field research. The data used in this study are primary and secondary data analyzed by looking at the Maqashid Syari’ah aspect. The research results show that the management of Rindu Hati Tourism Village, from the perspective of Maqashid Syari’ah, has not met the five criteria of Maqashid Syari’ah as a whole. Still, only a few activities have been seen that lead to the maintenance of Maqashid Syari’ah.

This article attempts to explore Qur’anic notion on soul and its influence on human personality as Quraish Shihab constructed in his Tafsi>r al-Mishba>h. Using psychological and semantical approaches, it parallelizes psychological with Qur’anic perspectives on the concept of soul. Then, it examines how the soul influences human personality. This paper concludes the following. First, Quraish Shihab’s view of the concept of soul can be understood by explaining his thought on the basic concept of human, psychical structure, and human behavioral motivation. Quraish Shihab said that humans’ basic character is kindness. The psychical structure consists of al-fit}rah, al-nafs, al-qalb, al-ru>h, al-‘aql. Then, human behavioral motivation is to complete their physical/biological needs and/or spiritual needs. The data analysis technique used in this study is interpretive hermeneutics. Qur'anic verses about neuroscience can be traced through key terms that refer to brain activity. The results showed that the interpretation of neuroscience verses can be traced through the concepts of tafakur, tadabur, ta'aqul, and so on. The interpretation of the concept of ‘Aql in the perspective of neuroscience can be a theological normative foundation in the development of critical, creative and innovative thinking in Islamic education. the results of this study will have implications for the paradigm of Islamic education which was originally only oriented to developing dichotomic qolb-based morals into the development of the critical thinking potential of students who are more holistic with a more scientific approach.

Development of reason or innovative creative thinking in Islamic education so far has been seen as not having a normative and theological foundation in the Koran so that it is clashed with the development of morals that already have a normative basis in the Koran, namely qolb. This study analyzes the concept of ‘Aql in the Koran as a normative-theological foundation for critical, creative and innovative thinking in Islamic education. The approach in this study is a qualitative type of library research. The data source in this study is the interpretation of the Qur'anic verses about the activities of thinking or berpikir ‘Aql, such as thinking (fikr), pondering (taddabur), understanding (tabashshur), understanding and so forth. This article is the result of a qualitative field research with a legal sociology approach. This article discusses the tradition of intermarrying with the eyes of Islamic law and positive law. The researcher uses the maqasid shariah theory in explaining the legal position of capture marriage. The maqasid shariah theory has a flexible and adaptive character in determining the legal status of localistic matters. The location of this research is in Pekalongan village, Sampang district, Madura. This study concludes that marriage arrests in the village of Pekalongan are legal, even obligatory, seeing that the implementation of the marriage arrest law cannot be separated from the main purpose of implementing Islamic laws. Capture marriage fulfills the maqashid al-sharī'ah element. Capture marriages function as hifd al din, namely tradition as religious social control, as a social protection system that fulfills the elements of hifdh an-nafs (avoiding cases of violence and vigilantism), hifdh an-nasl (avoiding offspring from illicit relationships), hifdh al-mal (avoiding the use of money in vain), hifdh al-aql (maintaining a healthy mindset and avoiding depression). Capture marriages are marriages that have no legal force because they are not registered.. Keywords: kawin tangkap tradition, maqasid shariah, law Abstrak Artikel ini adalah hasil penelitian kualitatif lapangan dengan pendekatan sosiologi hukum. Artikel ini mendiskusikan tradisi kawin tangkap dengan kacamata hukum islam dan hukum positif. Peneliti menggunakan teori maqasid shariah dalam menjelaskan posisi hukum kawin tangkap. Teori maqasid shariah mempunyai karakter fleksibel dan adaptif dalam menentukan status hukum hal yang bersifat lokalistik. Lokasi penelitian ini berada di desa Pekalongan Kecamatan Sampang Madura. Penelitian ini menyimpulkan bahwa kawin Tangkap di desa Pekalongan hukumnya boleh, bahkan wajib, melihat pemberlakuan hukum kawin tangkap tidak lepas dari tujuan pokok pemberlakuan hukum-hukum Islam. Kawin tangkap memenuhi unsur maqashid al-sharī’ah. Kawin tangkap berfungsi sebagai hifd al dīn yaitu tradisi sebagai kontrol sosial keagamaan, sebagai sistem perlindungan social yang memenuhi unsur hifdh an-nafs (menghindari terjadinya kasus kekerasan dan main hakim sendiri), hifdh an-nasl (menghindari adanya keturunan dari hubungan yang terlarang), hifdh al-mal (menghindari penggunaan uang dengan sia-sia ), hifdh al-aql (menjaga pola pikir sehat dan menghindari kedepresian ). Kawin tangkap merupakan nikah yang tidak memiliki kekuatan hukum karena tidak dicatatkan. Kata Kunci: tradisi kawin tangkap, maqasid shariah, undang-undang positif.

This article adds to the existing literature exploring the complexities of the human mind, as depicted through the characters of a famous novel, Raja Gidh (1981), written by Bano Qudsia. With the theoretical framework of Ghazali, the legendary intellectual of the 11th century in the Muslim world, the researchers have carried out a detailed study of nafs e ammara, nafs e lawwamma, nafs e mutmainna and aql. The research design is based on a thematic analysis of the selected novel. The study has adapted Attride Sterling’s (2001) model of textual data analysis, which is divided into three stages data reduction, exploration and data complication or interpretation. The analysis of Raja Gidh in post-positivist tradition inside the parameter of the selected theory provides an insight into the relevance of the psychological issues in the modern world, accordingly consolidating our belief in the similar mechanisms of the human mind, irrespective of the variances in the time and space. Furthermore, it has also been discovered that the incorporation of Eastern insight for exploring the human psyche has the potential to become an effective critical approach for psychological analysis in the realm of literature.

Islam is a religion that respects and upholds human values. Trafficking in persons is a form of modern slavery that is not following the nature of humanity given by God. This paper examines how trafficking in persons is in the perspective of maqashid al-sharia which aims to place humans in their human dignity.This paper uses a literature review by utilizing primary sources, whether in the form of books, research results, or journal works that have relevance to the focus of the study. Human trafficking is an act that is not relevant to the objectives of Islamic law, namely to create a life based on equality, independence, respect for fellow human beings, and worthiness in life. Islam forbids the behavior of trafficking in persons because Islam respects humans.In the conception of Islam, there are five main things called al-daruriyat al-khamsah (five main things that must be maintained). Namely protection of religion (hifzh al-din), soul (hifzh al-nafs), reason (hifzh al-'aql), offspring (hifzh al-nasl), property (hifzh al-mal). These five main things which are referred to as maqashid al-sharia are a specialty in Islamic teachings so that anything that contradicts them is considered as behavior that is not in accordance with the aims and objectives of the revelation of Islamic teachings.

Marriage law in Islamic countries is still considered gender-biased. Indonesia, as the majority Muslim country, is not exception. Marriage Law No. 1/1974 and the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) are two examples of Muslim family law where discrimination against women persist. This paper will discuss the problem of gender biases in the Islamic marriage law in Indonesia, the imperative of gender-sensitive law reform, and the implementation of the principle of maslaha as solution. It sheds lights on such biases and offer alternative perspectives, as these are advocated by Muslim reformers. This study argues that it is necessary to reform the Islamic marriage laws, which are gender sensitives, by removing discriminatory clauses. The reform is meant to realize maslaha (well-being/welfare) and is based on the implementation of the highest objective of Islamic law, formulated as maqāshid al-sharī‘a. These include preservation of religion (ḥifẓ al-dīn), mind (ḥifẓ al-‘aql), soul (ḥifẓ al-nafs), wealth (ḥifẓ al-mal), and descendants (ḥifẓ al-nasl).

This study examines the implementation of learning system during covid-19 pandemic at Pesantren of Maslakul Huda Pati based on maqashid as-syar'ah view. The aim is to find out the implementation of maqashid as-syari'ah values ??in the curriculum used and in the learning system implemented at the pesantren of Maslakul Huda Pati. The research method used was descriptive qualitative. The subjects of this study were curriculum and learning system at the pesantren. The data collected using observation, interviews, and documentation, the data then analyzed by interactive analysis with steps of data reduction, data presentation, and drawing conclusions. The results of the study showed that the values ??of maqasid as-syari'ah have been applied in the learning system during the covid-19 pandemic. It can be seen from the implementation of the value of hif? and the realization of the attitude of trust (faith), make ikhtiyar and surrender (tawakal). The value of hif? an-nafs is realized from preventive actions to minimize and break the chain of Covid-19 spread. The value of hif? al-'aql is realized from efforts to maintain learning in the pesantren even in a pandemic situation.
