AbstractPublic reason liberals typically defend an accessibility requirement for reasons offered in public political dialog. The accessibility requirement holds that public reasons must be amenable to criticism, evaluable by reasonable persons, and the like. Public reason liberals are therefore hostile to the public use of reasons that appear inaccessible, especially religious reasons. This hostility has provoked strong reactions from public reason liberalism's religion-friendly critics. But public reason liberals and their religion-friendly critics need not be at odds because the accessibility requirement is implausible. In fact, the accessibility requirement is ambiguous between two interpretations, one of which is too stringent and the other too loose. Depending upon the interpretation, accessibility either restricts the use of too many secular reasons or permits appeal to a wide range of religious reasons. The accessibility requirement should therefore be rejected.

As the evidence is of special importance in different courts, including primary, appeals and appeals، the legal requirements governing the evidence in the appeal stage in legal claims is one of the important topics of the appeal, therefore, in this article, which is prepared and arranged in a descriptive and analytical method, the basic question is which legal requirements govern. The results of the research show that legal laws such as civil procedure have a special order for presenting and proving evidence in the appeal stage. Also, in the appeal stage, the failure to express the reason in the initial stage and the lack of evaluation of the reason in the initial stage should be observed. It is worth it. It should be noted that in the presentation of evidence at the appeal stage, requirements such as the principle of effectiveness, the principle of relevance, the principle of citation and the power of proof must be observed

The article presents selected changes in the functioning of the conditional release institution as well as conditional release appeal. This paper aims to discuss the effectiveness of applying conditional release in the context of reasons, which cause its negative ending, that is its appeal. Application of the so-called electronic surveillance has been seen to influence the number of conditional releases and decrease the number of positively considered applications for conditional release. It was concluded that the scope of reasons resulting in conditional release appeal has changed, because as far as in 2013 a court decision of this sort would most often result from violation of legal order by the convicted, this has changed since 2014 and the main reason for appeal was the convict’s evasion of surveillance, duties, penal measures or other reasons of similar nature. The article ends with conclusions.

Judicial systems often wrestle with whether to sacrifice always presenting thorough judicial reasoning for the sake of an effective leave-to-appeal system. The paper outlines issues of reference to the Luxembourg Court, particularly with regard to Estonian circumstances in light of the ECtHR judgment in Baydar v. the Netherlands. The interplay between EU law and the European Convention on Human Rights in this regard is considered first, along with the importance of giving reasons, courts’ authority, the different roles of domestic and European courts, the duty of referring questions to the CJEU and exemption, consequences of non-referral in EU law, the Strasbourg Court’s role in dialogue between national courts and the CJEU, etc. Examined next are such matters as influences on preliminary references in European Union law, summary reasoning and limits to the reasoning duty (especially with regard to the Ullens de Schooten case of the ECtHR), associated division of competencies between the Strasbourg and Luxembourg courts, and finally the reasoning of the ECtHR itself as good or bad example. The author then considers the Supreme Court of Estonia’s leave-to-appeal system and the national courts’ practice in relation to Baydar, concluding that, while reasoned judgments are important and a right, no right exists for the applicant’s case to be referred by a domestic judge to the Luxembourg Court, though it is vital that summary judgment not be arbitrary / manifestly unreasonable; that Estonian courts have made reasonable use of the preliminary reference procedure before the Luxembourg Court thus far; and that they should articulate well the reasoning for referral/non-referral for litigants. The author proposes that the Estonian Supreme Court explain, exceptionally in one refusal of leave to appeal (cf. the Netherlands), that the general requirements for granting leave to appeal cover also the situation of preliminary questions to the CJEU and C.I.L.F.I.T. arguments of the CJEU. Above all, neither the interplay between EU law and the European Convention on Human Rights nor the role of national courts finding their way in complex legal surroundings should be neglected.

Public reason liberals appeal to public deliberation to ensure that a legal order can be publicly justified to its citizens. I argue that thisvoicemechanism should be supplemented byexitmechanisms. By allowing citizens to exit legal orders they believe cannot be publicly justified, citizens can pressure states to change their laws. This exit pressure is sometimes more effective than deliberation. I explore federalism as an exit mechanism that can help public deliberation establish a publicly justified polity.

Is pornography within the coverage of the First Amendment? A familiar argument claims that it is not. This argument reasons that (1) the free speech principle protects the communication of ideas, which appeal to the reason (the major premise); (2) pornography communicates no ideas and appeals to the passions rather than the reason (the minor premise); (3) therefore pornography is not protected by the free speech principle. This argument has been specified in different ways by different writers. The most prominent and careful of these are Frederick Schauer and John Finnis. Both founder on the attempt to distinguish pornography from art, which both would protect. If art, film, and literature should be protected, then this protection should extend to the pornographic subsets of these genres.

Almost without exception, those in the West who think that homosexual behavior is morally wrong are Christians (the belief that all homosexual behavior is wrong is also common among the devotees of other Abrahamic religions, e.g. Islam, and perhaps among other cultural groups elsewhere in the world). But is it true that, assuming a traditional Christian worldview, there are strong reasons to think that all homosexual behavior is morally wrong? Traditionally, Christians have appealed to three independent sources to justify any given belief: church tradition, scripture, and reason. If a Christian is justified in believing that homosexual behavior is morally wrong, his reasons must appeal one of these three sources. As it turns out, however, this is a difficult trick to turn. None of these sources provides a clear reason to think that homosexual behavior is morally wrong, and at least one of them provides a clear reason for thinking that, in at least some cases, it is morally permissible.

Liberalism is often identified with the claim that individuals should have a large space for decisionmaking into which the state is not morally justified to intrude. On this “negative liberty” conception of liberalism, the boundaries of that space are or should be set by a package of rights against the majority. Individuals can appeal to such rights to override majority decisions that seek to intrude into the space of negative liberty. If this space of negative liberty is preserved, for example, through courts empowered to strike down infringing laws, such liberals suppose that a fundamental interest of all individuals is served. This is the interest in autonomy, in being able to make, revise and carry out decisions about how to live in accordance with one’s own preferences.

AbstractSidgwick's seminal text The Methods of Ethics left off with an unresolved problem that Sidgwick referred to as the dualism of practical reason. The problem is that employing Sidgwick's methodology of rational intuitionism appears to show that there are reasons to favour both egoism and utilitarianism. Katarzyna de Lazari-Radek and Peter Singer offer a solution in the form of an evolutionary debunking argument: the appeal of egoism is explainable in terms of evolutionary theory. I argue that like rational prudence, rational benevolence is subject to debunking arguments and so problematic, but also – and more importantly – that debunking arguments are irrelevant in the debate over the dualism of practical reason on the view of reason and rational intuitionism that Lazari-Radek and Singer embrace. Either both egoism and utilitarianism are debunked, or neither are. If I am right, Sidgwick's dualism is left standing.

Objectives: Effective regulations that reduce nicotine vaping among young adult dual (combustible and e-cigarette) users may differ depending on whether e-cigarettes are used for helping with smoking cessation. This laboratory experiment examined flavor and nicotine effects on e-cigarette product appeal among young adult dual users, stratified by reported use of e-cigarettes to quit smoking. Methods: Dual users aged 18-35 years that did (N = 31) or did not (N = 22) report vaping for the purpose of quitting smoking puffed e-cigarette solutions varied by a flavor (fruit, menthol, tobacco) and nicotine (nicotine-containing [6 mg/mL], nicotine-free) with-in-participant design. After puffing each solution, participants rated appeal. Results: In main effect analyses, non-tobacco (vs tobacco) flavors increased appeal and nicotine-containing (vs nicotine free) solutions reduced appeal similarly in dual users who did and did not vape to quit smoking. Interaction analyses found non-significant trend evidence that fruit and menthol flavors suppressed nicotine's appeal-reducing effects more powerfully in those that did not vape to quit smoking (flavor × nicotine × vape to quit smoking, ps = .05-.06). Conclusions: Non-tobacco flavors might increase e-cigarette product appeal in young adult dual users overall and disproportionately suppress nicotine's appeal-reducing effects in those that vape for purposes other than assisting with smoking cessation.

AbstractAnnulment under the ICSID Convention offers a limited remedy on the basis of a few carefully circumscribed grounds. Recently, losing parties have attacked awards for a wide array of reasons. Some ad hoc committees deciding these requests for annulment have taken a broad view of their powers. They have given some grounds for annulment an extremely wide interpretation thereby blurring the line between annulment and appeal. For instance, a perceived mistake in the interpretation of a rule of law has been regarded as an excess of powers for failure to apply the proper law. One ad hoc committee went beyond the reasons for annulment put forward by the applicant. It actively searched for additional grounds and eventually annulled the award for a reason not relied upon by the applicant. Some ad hoc committees have gone beyond the task given to them by the ICSID Convention, offering general criticism and advice to tribunals. The risk that an ICSID award will be annulled is now higher than that a non-ICSID award will be set aside by a competent domestic court.

Justification is often explained in terms of the having of appropriate reasons, and a variety of epistemological distinctions are most naturally explained, it seems, by adverting to reasons. This paper examines the extent to which we may, instead, make do without appeal to such a notion. It is argued that the extent to which the notion of a reason should play an important role in epistemological theorizing will depend on how our psychological theories of belief acquisition and belief change are best conceptualized.

Thomas Aquinas expounded a theory of delayed hominization that has greatly influenced debates about abortion. Although many have robustly criticized this theory, its continuing appeal to supporters of abortion necessitates a reexamination. This essay will revisit Aquinas’s problematic view about the place of the rational soul in embryological development and show that he confuses the ability to reason with the capacity for reason. In a time when abortion rights debates are common and vitriolic, this essay attempts to provide clear reasons for reaffirming the moral status of the embryo from conception.

A reason is “constructed” if it does not appeal to a natural or normative authority that stands apart from human action, but is instead created by contingent social forces. The idea of constructed reason coexists uneasily with the rule of law. A bedrock rule-of-law principle requires that government action be nonarbitrary or reasoned, “reason unaffected by desire,” as Aristotle said. Yet, if the reasons judges invoke to justify judicial decisions are part of variable social and historical contexts in which the judges themselves are embedded, how can judicial decisions uphold the rule-of-law requirement of reasoned decision making untainted by the decision maker’s desires? This essay gives a philosophical account of the social construction of legal reasons, relying on Kant, Heidegger, and Gadamer as the decisive figures. It applies this account to current U.S. controversies over same-sex marriage, and suggests how constructed reasons might coexist with still-powerful rule-of-law myths.

Abstract: Lev Shestov considers all discourse rhetorical. His work denounces rationalist discourse as an imposture that denies its own appeal to irrational impulses. Fondane’s poetry betrays the same consciousness of rhetoric: while it does not have a persuasive function per se, it involves circuits of address and oratorical concerns. In Fondane, there is a subjectivist tendency at work: selfhood can never be set aside. Fondane locates the self and the passions at the heart of all speech, denouncing philosophy’s pretensions to dispassionate, objective, “rational” discourse.

Populism usually appears when there is dissatisfaction towards the system, and creates two different camps seen as polarization, “the elite” versus “the people.” Those camps are a result of the appeal of anti-elite. Indonesian populist leader also uses the strategy to appeal a large support of citizens, but the strategy must be understood as a part of pragmatist leadership. This paper argues that the utilization of populism in Indonesia is more motivated by pragmatic reasons rather than fundamental reasons. This pragmatic reason can be seen through inconsistent statement in the leadership which, at first, supports populist claim but tends to be different in reality. Political leaders in Indonesia try to strive for a progress as well as to seek a compromise and a support from various groups, including those labeled as elite by the populists themselves. Through an observation of secondary documents from journals and news articles during the latest presidential campaign between Jokowi and Prabowo in 2019, it is concluded that all characteristics of populist strategy have been used pragmatically by both leaders. It is applied to attract more supports in order to respect the political constraints and to work with the system.

Some philosophers argue that, because it is subject to twinning and fusion, the early human embryo cannot hold strong moral standing. Supposedly, the fact that an early human embryo can twin or fuse with another embryo entails that it is not a distinct individual, thus precluding it from holding any level of moral standing. I argue that appeals to twinning and fusion fail to show that the early human embryo is not a distinct individual and that these appeals do not provide us with plausible reasons for denying the strong moral standing of the early human embryo. I recognize one possible exception to this general assessment, a particular version of the appeal to fusion. Embryo fusion that results in tetragametic chimerism provides some reason for doubting the early human embryo's moral standing. But twinning and fusion are otherwise irrelevant in this context.

Abstract Hume argues that whenever we seem to be motivated by reason, there are unnoticed calm passions that play this role instead, a move that is often criticised as ad hoc (e. g. Stroud 1977 and Cohon 2008). In response, some commentators propose a conceptual rather than empirical reading of Hume’s conativist thesis, either as a departure from Hume (Stroud 1977), or as an interpretation or rational reconstruction (Bricke 1996). I argue that conceptual accounts face a dilemma: either they render the conativist thesis trivial, or they violate Hume’s thesis that ‘a priori, any thing may produce any thing’ (THN 1.4.5.30). I defend an empirical construal of Hume’s conativist thesis. I provide two theoretical frameworks within which Hume’s appeal to the calm passions may be justified: first, by the framework of theoretical virtues, and secondly, by lights of his own “rules by which to judge of causes and effects” (THN 1.3.15).

ABSTRACT: Effective enforcement of arbitral awards, when needed, is one essential element for a successful arbitration. The effective enforcement of an arbitral award is of even greater importance in cases where the losing party refuses to execute in good faith the arbitral award. In effect, the losing party may file a motion to delay the execution of the arbitral award. In France, the action to set aside an arbitral award (recours en annulation) as well as the appeal seeking to overturn the judgment that orders the enforcement of an arbitral award made in a foreign country, have the effect of suspending the execution of the award. As a result and as a general rule, in case of action to set aside or an appeal, arbitral awards cannot be executed unless a provisional enforcement of the decision is sought and granted. Two reasons justify the study of the provisional enforcement of international arbitral awards in France. The first reason is the great complexity presented at the moment of transposing the French rules on provisional enforcement of judgments into international arbitration. The second reason is the ultimate means to overcome the suspensive effect of the action to set aside or the appeal, preventing the prospective recourse from becoming an element that impairs the effectiveness of the arbitral award and the arbitration as a whole.

One of the main reasons why parties choose arbitration is the principle of finality, that international arbitral awards cannot be appealed on the merits. While the vast majority of national arbitration legislation and the rules of major arbitral institutions provide for the finality of arbitral awards, there are some exceptions to the rule. This article seeks to review the various appeal mechanisms that exist in international arbitration and to assess, both theoretically and practically, their impact on the principle of finality. It begins by examining the right of appeal to the courts on a question of law under section 69 of the English Arbitration Act 1996. It then explores the emerging trend amongst some international arbitration service providers to amend their rules to provide internal appeal mechanisms in their arbitral procedure, reflecting the perceived need by some users for an alternative to the strict finality provided for in the rules of major institutions. Outside the realm of international commercial arbitration, the International Centre for the Settlement of Investment Disputes (ICSID) annulment regime and the Appeals Division of the Court of Arbitration for Sport (CAS) both provide internal review structures but with contrasting approaches to the finality of awards. It appears that the attraction of any appeal mechanism lies in the way it balances the competing notions of fairness and finality. Ultimately, the author argues that, consistent with party autonomy, appeal mechanisms should not be considered controversial as long as the parties agree on the procedure of any such appeal. Where parties agree to prioritize correctness or fairness over finality, this does not necessarily detract from the principle of finality, but rather conforms with the spirit of arbitration.

Arocha’s scientific realism (2021) puts at the center of psychology the individual and their variability in behavior: the individual appears to be irreducible to what emerges from the analysis of aggregate data. According to this position, psychology’s aim is to uncover the mechanisms underlying the observable world. This entails adopting the cause-based approach of the natural sciences. Arocha’s article also refers to final causes and intentions and thus to the reason-based approach of the human sciences in contrast to that of the natural sciences. Thus, it is not clear whether the article aims to reduce the final causes to mechanical causes or supports the irreducibility of the former. Starting from these remarks, this comment will argue that the reason-based approach is preferable to the cause-based approach in order to have a scientific psychology. Adopting the reason-based approach also avoids the appeal to aggregate data by focusing upon the single case.

Some recent researches in experimental philosophy have posed a problem for philosophers’ appeal to intuition (hereinafter referred to as PAI); the aim of this paper is to offer an answer to this challenge. The thesis against PAI implies that, given some experimental results, intuition does not seem to be a reliable epistemic source, and —more importantly— given the actual state of knowledge about its operation, we do not have sufficient resources to mitigate its errors and thus establish its reliability. That is why PAI is hopeless. Throughout this paper I will defend my own conception of PAI, which I have called the Deliberative Conception, and consequently, I will defend intersubjective agreement as a means to mitigate PAI errors, offering empirical evidence from recent studies on the Argumentative Theory of Reason that favor the conception I defend here. Finally, I will reply to some objections that might arise against the Deliberative Conception, which will lead me to discuss some metaphilosophical issues that are significantly relevant for the future of the dispute about the appeal to intuition.

English common law is often understood to provide for the resolution of social disputes predominantly by resort to legal rules. Whilst there may be initially reasons for a rule which do not constitute legal reasons, once the rule becomes promulgated in a statute or is embodied in a judgment of a higher court then the application of the rule in future cases is justified by that very promulgation or embodiment. No further appeal to the social reasons originally behind the rule, what might be referred to as the ‘primary reason’ for a rule, is necessary. According to the theory any subsequent dispute to which the rule is addressed will be resolved one way or the other because there exists a distinctly legal reason for reaching that decision which is independent of the content of law and independent of, for example, social or moral considerations.

Abstract Since John Rawls, public reason theorists have attempted to show how liberal political norms could be acceptable to people with diverse religious and ethical viewpoints. However, these theories overlook the importance of the distinction between acceptability to realistic people and acceptability to viewpoints, which matters because public reason theories are committed to the former, but only deliver the latter, thereby failing to justify liberal norms. Public reason theories therefore face a dilemma: abandon realistic people and lose normative appeal, or retain realism and find a new way to justify liberalism.

In contrast with the Evidential Approach concerning faith and reason, which affirms experiences and reason as starting points, Presuppositionalists assume the truth of scripture as starting point in their assessment of the truth-claims of Christianity. They appeal to Christians by emphasizing the authority of scripture, by criticizing autonomous human reason, and by highlighting the noetic effects of sin. I address these considerations, show that Frame’s approach is self-defeating and unacceptably circular, and answer his objections to the Evidential Approach.

AbstractActions receive teleological descriptions and reason explanations. In some circumstances, these descriptions and explanations might appeal not just to the agent’s own purposes and reasons, but also to the purposes and reasons of others in her social surroundings. Some actions have a social teleology. I illustrate this phenomenon and I propose a concept of vicarious action to account for it. An agent acts vicariously when she acts in response to the demand of another agent who knew that her demand was likely to succeed. I argue that vicariousness grounds the social teleology of the resulting actions.

AbstractThe aims of this study to analyse the types and the reason of used code switching found in My Bastard Prince novel. This study used the theory proposed by Appel and Muysken (1987:118) to analysed the types of code switching and three types of code switching that occurs namely: tag switching, inter-sentential switching, and intra-sentential switching. meanwhile to analysed the reason of used code switching used the theory proposed by Hoffman (1991) and seven reasons are found namely: talking about particular topic, expressing feeling about something, expressing group identity, interjection, repetition used for clarification, quoting somebody else, and intention of clarifying the speech content for interlocutor. The most dominant type appear is inter-sentential switching and the less dominant is intra-sentential switching and descriptive qualitative method. Meanwhile for the dominant reason of the reason of code switching appear is expressing feeling about something, and for the less reason appear is repetition used for clarification.

The article is dedicated to the explanation of such legislative defects as gaps in the criminal procedural legislation during court decisions appeal. Within the framework of the study the attention focuses on the fact that regulatory rulemaking of the court decisions appeal in criminal proceeding contains multiple gaps that affect negatively at its practical implementation. Detailed analysis of the gaps in the criminal procedure legislation has been carried out. By reference to specific aspects of the judicial review implementation, the gaps classification according to their subject is proposed. More specifically the following gaps in the rulemaking of the court decisions appeal in criminal proceedings are identified: 1) concerning the object of appeal; 2) concerning the appealer; 3) concerning the subject of appeal; 4) concerning the appeal procedure, etc. It is pointed out that number of legal regulation gaps regarding the identification of the object of appeal is quite significant. Such gaps arise in response to the determining a list of court decisions by the legislator that are subject to appeal consequently making impossible reviewing those court decisions that are not directly enlisted. Such matter is illustrated by the example of the establishment of restrictions on the ability to appeal the investigating magistrate decisions. Considering the gaps concerning the appealer it is pointed out that in some cases the legislation does not provide the right of relevant parties for court decisions appeal or does not provide them with sufficient legal opportunities which limits a person’s constitutional privilege for court decision appeal review and his/her access to judicial proceedings. The analysis of gaps concerning the subject of appeal was also carried out. It is concluded with reason that such gaps arise due to the disadvantageous legislative determining of the issues which are allowed to appeal procedure. In the course of the research attention is drawn to the fact that the criminal procedural legislature furthermore contains other gaps in the rulemaking of court decisions appeal. In particular they concern the appeal procedure itself, implementation of the rights of its participants and some other issues. By way of illustration of the given type of gap it is indicated that the opportunity of implementation of the right to appeal for those persons who are directly granted with it by the law may be complicated due to the shortage of the actual opportunity to appeal against the judgment, in light of the high requirements for its content and format, advanced by the domestic lawmaking body. In the article motions considering eliminating and overcoming the enlisted legislative defects are formulated.

Each of these reasons can appeal to particular agendas of policy-makers, professionals and other influential adults, to provide room and support for participation. But inevitably each reason has certain advantages and disadvantages, acted out in current trends and accompanying dilemmas in children and young people's participation activities.

International relations suffer from a plethora of pseudo-theoretical approaches. Some of these approaches claim the right not only to explain but also to shape the international reality. These will quite often become instrumental in the legitimization of a given state’s policies. Nuances, caveats, and an awareness of limitations give way to simplicity, unambiguity and self-confidence. The aim of this article is to critically deconstruct certain ways of thinking about inter-state relations and international policy that are usually attributed to advocates of geopolitics and naïve realism. What makes vague but attractive geopolitical jargon, belief in determinism, enchantment with maps and admiration for the ‘concert of powers’ so popular, and what consequences might the adoption of geopolitical assumptions have for contemporary political practice? The popular mono-causal approaches that are full of hasty but firm generalizations about the laws of history have the upper hand over pluralist ones that look for a multitude of usually inconclusive explanations. The reason for this might not simply be analytical laziness; the fact is that the aforementioned popular, simplistic, even trivial observations dressed in quasi-scientific costume serve as a convenient source of legitimacy for revisionist leaders who wish to be seen as defenders of the status quo.
