AbstractPublic reason liberals typically defend an accessibility requirement for reasons offered in public political dialog. The accessibility requirement holds that public reasons must be amenable to criticism, evaluable by reasonable persons, and the like. Public reason liberals are therefore hostile to the public use of reasons that appear inaccessible, especially religious reasons. This hostility has provoked strong reactions from public reason liberalism's religion-friendly critics. But public reason liberals and their religion-friendly critics need not be at odds because the accessibility requirement is implausible. In fact, the accessibility requirement is ambiguous between two interpretations, one of which is too stringent and the other too loose. Depending upon the interpretation, accessibility either restricts the use of too many secular reasons or permits appeal to a wide range of religious reasons. The accessibility requirement should therefore be rejected.

As the evidence is of special importance in different courts, including primary, appeals and appeals، the legal requirements governing the evidence in the appeal stage in legal claims is one of the important topics of the appeal, therefore, in this article, which is prepared and arranged in a descriptive and analytical method, the basic question is which legal requirements govern. The results of the research show that legal laws such as civil procedure have a special order for presenting and proving evidence in the appeal stage. Also, in the appeal stage, the failure to express the reason in the initial stage and the lack of evaluation of the reason in the initial stage should be observed. It is worth it. It should be noted that in the presentation of evidence at the appeal stage, requirements such as the principle of effectiveness, the principle of relevance, the principle of citation and the power of proof must be observed

The article presents selected changes in the functioning of the conditional release institution as well as conditional release appeal. This paper aims to discuss the effectiveness of applying conditional release in the context of reasons, which cause its negative ending, that is its appeal. Application of the so-called electronic surveillance has been seen to influence the number of conditional releases and decrease the number of positively considered applications for conditional release. It was concluded that the scope of reasons resulting in conditional release appeal has changed, because as far as in 2013 a court decision of this sort would most often result from violation of legal order by the convicted, this has changed since 2014 and the main reason for appeal was the convict’s evasion of surveillance, duties, penal measures or other reasons of similar nature. The article ends with conclusions.

Judicial systems often wrestle with whether to sacrifice always presenting thorough judicial reasoning for the sake of an effective leave-to-appeal system. The paper outlines issues of reference to the Luxembourg Court, particularly with regard to Estonian circumstances in light of the ECtHR judgment in Baydar v. the Netherlands. The interplay between EU law and the European Convention on Human Rights in this regard is considered first, along with the importance of giving reasons, courts’ authority, the different roles of domestic and European courts, the duty of referring questions to the CJEU and exemption, consequences of non-referral in EU law, the Strasbourg Court’s role in dialogue between national courts and the CJEU, etc. Examined next are such matters as influences on preliminary references in European Union law, summary reasoning and limits to the reasoning duty (especially with regard to the Ullens de Schooten case of the ECtHR), associated division of competencies between the Strasbourg and Luxembourg courts, and finally the reasoning of the ECtHR itself as good or bad example. The author then considers the Supreme Court of Estonia’s leave-to-appeal system and the national courts’ practice in relation to Baydar, concluding that, while reasoned judgments are important and a right, no right exists for the applicant’s case to be referred by a domestic judge to the Luxembourg Court, though it is vital that summary judgment not be arbitrary / manifestly unreasonable; that Estonian courts have made reasonable use of the preliminary reference procedure before the Luxembourg Court thus far; and that they should articulate well the reasoning for referral/non-referral for litigants. The author proposes that the Estonian Supreme Court explain, exceptionally in one refusal of leave to appeal (cf. the Netherlands), that the general requirements for granting leave to appeal cover also the situation of preliminary questions to the CJEU and C.I.L.F.I.T. arguments of the CJEU. Above all, neither the interplay between EU law and the European Convention on Human Rights nor the role of national courts finding their way in complex legal surroundings should be neglected.

This thesis addresses the conflict traditionally found within moral philosophy between deontological and utilitarian schools of thought. Using the example of the serious moral ambivalence experienced by individuals who are deciding whether to end or continue a difficult pregnancy, it is argued that this ambivalence is the result of both absolute principles (such as the intrinsic value of human life) and outcome based considerations (such as the desire to avoid causing pain and suffering) appearing to be morally reasonable, while also being fundamentally opposed: Each course of action is at once morally defensible on the basis of its own reasonableness, and, conversely, reprehensible due to the reasonableness of the other. This lived experience of moral ambivalence is directly reflected by the tension between deontology and utilitarianism as it occurs at the moral philosophic level, where the deontological emphasis on the unconditional rightness of certain principles is seen to be at irreconcilable odds with the utilitarian emphasis on the attainment of certain ends. The thesis’ central claim is that such ambivalence strongly indicates that human morality is neither exclusively one type or the other, and that both types of moral property are in fact reasonable, and thus have moral value. It is theorised that accounting for this dual reasonableness would lead to the most accurate and helpful representation of the human moral experience – but that the philosophic ‘divide’ between the two types of principle has led to an either/or situation, which has largely prevented this sort of understanding from being developed. The thesis argues that Victorian philosopher Henry Sidgwick developed a view in which neither deontological nor utilitarian principles can be fully realised without reference to the other, precisely on the basis that both can be found to be ultimately rational. This thesis aims to revitalise that theory – represented by the term ‘Rational Benevolence’ - to show that Sidgwick reconciled the divide between absolute and end based principles in such a way that the relationship between them becomes a ‘synthesis’. In this synthesis, deontological and utilitarian concepts are both seen as essential components of morality, that combine to form a dynamic whole in which the value of each principle is both indicated and naturally limited by the value of the other, on account of their respective rationalities. It is argued that this provides a more comprehensive understanding of the reality of the human moral experience, and better moral justification for either course of action in situations of complex and sensitive ethical decision making.

Uppsatsen baseras på designexperiment av undervisning med syftet att uppmuntra till kreativa resonemang. Studien genomfördes som ett antal undervisningstillfällen då närvarande elever presenterades för ett problem eller en frågeställning som inte var formulerad eller kunde lösas på samma sätt som typuppgifterna i läroboken. Observationer och transkript från dessa tillfällen används som underlag för en analys som bygger på interventionens syfte och möjligheter utifrån teorin om didaktiska situationer med viss påverkan från kategorisering av resonemang. Omfattningen av studien gör att få generella slutsatser kan dras, men det åskådliggörs i några exempel hur viktig lärarens lyhördhet kan vara för att fånga upp embryon till självständigt resonemang och hur rådande normer påverkar debattklimatet. I diskussionen nämns hur försök till didaktiska situationer kan användas för att få en bättre bild av elevers proximala zoner.

This study advances a theoretical model of appeal, the framework readers’ advisory (RA) librarians use to make book suggestions. Taking an interdisciplinary approach, it combines elements of media studies, literary theory, and library science to posit new elements of appeal and new models for understanding its dynamics. This dissertation argues that, because appeal as currently practiced relies heavily on reductive binaries, it fails to account for a number of features that play a crucial role in a reader’s experience of a work. Through a historically informed explication of the existing appeal framework, it posits a new formulation: appeal is a tripartite construct involving the sensibility of a text, the content of a work, and the interest of a reader, where reader is understood in its broadest sense. The new framework demonstrates explicitly that appeal is both textual and readerly and advances a number of additional concepts that are possible only in a more nuanced, tripartite structure. The dissertation illustrates its findings through three application chapters, considering in depth Jane Austen’s Persuasion, Charlotte Brontë’s Jane Eyre, and Mary Shelley’s Frankenstein. The study further provides a new theory/practice model of appeal, strongly urging that, if RA service is to continue to advance, its provision and an understanding of its critical concepts be undertaken with depth and rigor.

This collection of short stories features characters who face unexpected situations arising from ordinary circumstances. Most of the characters find themselves compelled to react in ways that may even surprise themselves. A young woman finds her first feeling of joy in a long time in the face of her mother's possible death. Best friends recall their years spent doing drugs and ignoring responsibility. When a woman confronts her fear of sex, she finds herself literally in another world. Rather than sticking with one form, several stories depart from traditional structures. One flash fiction piece is told in the first-person collective voice; another story evolves into magical realism; two are linked, and one story is told as an elegy. What matters are the characters, their struggles, and their relationships with one another.

This dissertation looks at the linked issues of justification and public reason – under what conditions do political authorities count as legitimate, and what is the appropriate mode of reasoning together in the public sphere? The main contender in the field currently is Rawls’s political liberalism. His conception of justification gives a key role to the justifiability of political power to each citizen, based on shared (because mutually acceptable) reasons. This approach to justification affects how we reason in the public sphere – in discussing certain fundamental issues, Rawlsian public reason requires limiting our reasons to public ones (viz., those which others could reasonably endorse), and bracketing those based on disputed conceptions of the good. How we think about justification thus has concrete implications for how we live together in political society. Rawls’s political liberalism is commonly pitted against comprehensive liberalism. The disagreement tends to be cast as being about comprehensive liberals rejecting the need for justifiability. I argue that this is mistaken, and that Rawls shares more than we might think with the comprehensive liberal. Taking Raz as the modern champion of comprehensive liberalism, I show that both Rawls and Raz are deeply committed to justifiability, and trace the disagreement between the two to a metaphysical dispute about how to conceive of the project of justifying the implementation of political principles. In light of their shared commitment to justifiability, the question becomes whether justifiability requires shared reasons. I propose a heuristic reading of Rawls’s requirement of mutually acceptable reasons, which explains how Rawls’s and Raz’s views on justification can be brought together without needing to bracket the truth of the principles of justice. This proposed reconciliation leads to a mode of reasoning in the public sphere that does not require setting aside non-public reasons in order to proceed.

This is a review of what the currently dominant theories of moral decision-making are and where they derive from. While the introduction serves as a common ground to explain what moral decision-making is, the earlier parts of the thesis describe older traditionalist theories within the field,  theories of emotional decision-making, in the form of the somatic marker hypothesis, as well as critique of the older traditionalist theories through the social intuitionist model. Both of these two theories are explained as the foundation of the current theories of moral decision-making and after establishing a clear basis on what the currently dominant theories of moral decision-making are built on, said theories are introduced in the form of the dual-processing theory and the event-feature-emotion complexes which are thoroughly reviewed, explained in detail and serves as the core of the text. This is afterward followed by criticism as well as arguments in favor of both theories as well as criticisms from other researchers who disagree with the methodology which the theories of moral decision-making are conducted on. The essay reviews the current state of the field of moral decision-making which has been split up into two different approaches, the locationist approach and the constructionist approach. The essay concludes that there are terms which needs to be clarified in order for the field to move forward and studies to be made regarding the social implications of gut reactions in moral decision-making.

In the formation of a marine resort, the extraction of the various appeal points of marine space is an important issue. For this reason, this research project targeted Kumejima in Okinawa Prefecture, Japan, and considering tourists who visit the resort as the target of the study, a decision was taken to evaluate the quality of the appeal points that comprise the resort. As a result, the appeal points of marine space were found to be comprised of three main resource elements and 13 categories related to these elements. The accurate number of tourists who visit a resort, be it marine resort or otherwise, must be grasped in order to plan the promotion of the resort and reactivation of the community. For this reason, this research project proposed a method of grasping such trends utilizing tobacco tax that is a unique system of taxation in Japan. As a result, time and cost were conserved compared to past methods and it was possible to grasp the annual number of tourists with high precision. Based on these results, it is believed that materials that indicate the direction of the formation of marine resort in Kumejima in the future have been provided.

The aesthetic appeal of composite-resin restoratives promotes their use, however their functional life is significantly shorter when compared to their metal counterparts.1 One possible reason is the effect of polymerization stress on marginal integrity. Shrinkage of the composite, and its associated stress, has been found to cause gap formation and stress interactions between the restorative and the adhesive. These gaps offer an ideal niche for bacteria, and, when compounded by the mechanical strain of chewing, can lead to premature failure of the restorative.2,3 Additionally, it is well known that incomplete conversion of the double bonds occurs during methacrylate polymerizations.4–7 A high degree of conversion is needed to prevent the presence of potentially hazardous monomers.8

Despite differences in the principles by which they operate between the participation (Islamic) and conventional banks, there is no huge difference between the products and the services provided by these banks. The distinctive features of the participation banks, compliance with the Islamic precepts, are not the only way for these banks to appeal to the customers. For this reason, customer satisfaction is an important element in the banking sector. The major goal of this study is to analyze the level of awareness and satisfaction among the customers of the participation banks. This study which uses the data compiled through the surveys held in Eskişehir with the participation of 500 Islamic bank customers reveals findings that suggest that most of the customers are satisfied with the products and services by the participation banks and that they have high level of awareness on the Islamic banking products.

The right of remorse is not only the voluntary guarantee of the case of pleading guilty and accepting punishment, but also the source of the accused’s appeal. Protest is a confrontation between the right of remorse and the court of first instance’s failure to adopt the sentencing recommendation of the prosecution, and this confrontational contradiction always exists, which stems from the failure to put the characteristics of guilty plea and punishment admitting into the second instance procedure. Standardizing the right of remorse, establishing the system of cause appeal, classifying the reasons for protest and adjusting the scope of the second trial are helpful to resolve the conflicts in the system of admitting punishment and adjudication, and use intersubjectivity to break through the tension between litigation justice and litigation efficiency.

Based on data from the multimedia subcorpus of the Russian National Corpus, the paper addresses syntactic, pragmatic and prosodic features of insubordinated adverbial clauses introduced by the adverbial subordinator potomu čto ‘because’. The quantitative analysis showed that more than 30% of reason clauses in spoken discourse appear to be insubordinated. Qualitatively, we observed symptoms of insubordination at various levels. (1) Prosodically, insubordinated clauses are placed after discourse fragments that are articulated with falling pitch projecting no continuation and are separated from them by the prosodic break. (2) Pragmatically, they can have independent illocutionary force and can form separate turns in dialogues. (3) Grammatically, they allow right dislocation of the adverbial subordinator – otherwise blocked in adverbial clauses.

Impingement syndrome occurs most commonly in the dominant arm. Shoulder injuries are difficult to treat for several reasons. The first would be the stress on the shoulder, with repetitive movements, a situation that involves accentuating the pain and aggravating the injury. The second reason would be individual variations in shoulder anatomy. The shoulder sacrifices stability in favor of mobility, being frequently prone to injury. It is indicated that as soon as the pain appears, to see an orthopedic doctor.
