Negli anni più recenti, fattori come l’evoluzione del mercato dell’arte in un mercato internazionale di libero scambio, la più numerosa quantità di individui con un’elevata disponibilità a pagare per le opere d’arte e lo sviluppo di nuove tecnologie hanno permesso ai falsi di proliferare. Questo lavoro di tesi espone innanzitutto una definizione di ‘falso d’arte’, individuando poi le motivazioni che ne causano l’apparizione, mettendo in luce la persistenza del fenomeno nella storia e sottolineandone le differenze con altre operazioni di mimesi. Si propone in seguito di analizzare i fattori che permettono la circolazione dei falsi all’interno del mercato, mostrando poi gli sforzi per limitare il fenomeno ad opera della legislazione italiana, la difficoltà di controllare questo crimine a livello internazionale e i tentativi dei collezionisti di superare le incertezze affidandosi alle case d’asta, istituzioni dove le opere sono ufficialmente certificate. Quindi il lavoro si concentra sui metodi di autenticazione, approfondendone i tre ‘strumenti’ tradizionali, ossia la connoisseurship, lo studio della provenienza e gli esami diagnostici, e riportando poi le nuove possibilità dell’avanzamento tecnologico in materia di individuazione dei falsi e di certificazione della provenienza. La tesi si conclude proponendo alcuni aspetti positivi che i falsi potrebbero avere, una volta individuati, attraverso l’analisi di alcuni articoli economici riguardanti l’impatto delle falsificazioni sul mercato dell’arte e dei tentativi di determinare un prezzo per i falsi, l’esame dei casi studio di Elmyr de Hory e Han van Meegeren e l’osservazione del fenomeno della proliferazione di mostre ed esposizioni sulle falsificazioni.

I bisfosfonati (BP) sono la classe di farmaci maggiormente utilizzata per il contrasto dell’osteoporosi; tra questi gli ammino-bisfosfonati hanno dimostrato maggiore attività nel trattamento delle patologie legate al metabolismo osseo. In questo lavoro di Tesi sono stati sintetizzati pirrolidin-bisfosfonati attraverso reazioni di ciclo addizione.
Si sono inoltre sintetizzati BP funzionalizzati con isatina che sono stati successivamente impiegati per reazioni di condensazione asimmetriche organocatalizzate da basi chirali.

Ce document traite de la production sonore dans les instruments de musique à anche simple. Ceux-ci forment, en association avec le musicien, un système dynamique complexe qui peut rentrer en auto-oscillation sous des conditions bien déterminées liées à l'instrument et à son contrôle par le musicien. Le présent travail s'attache plus spécifiquement à la question de la participation de l'anche dans le processus d'établissement de l'onde acoustique au travers de sa résonance et de sa capacité à générer un débit qui vient s'additionner au flux entrant créé par le souffle du musicien. L'influence de ce débit d'anche est étudiée en examinant comme le problème acoustique est modifié par la condition aux limites associée à ce débit à l'extrémité de la colonne d'air située du côté du bec. La déviation des fréquences de résonances de la colonne d'air et l'apparition d'un pôle supplémentaire sont les manifestations de ce débit d'anche. Après l'étude du résonateur augmenté, les seuils d'oscillations du système couplé sont investigués par analyse linéaire de stabilité. La contribution de chaque phénomène est mise en évidence. Des mesures des seuils d'oscillation sont effectuées sur bouche artificielle et sont comparées aux valeurs obtenues numériquement. Finalement un outil numérique d'étude des auto-oscillations des instruments de musique à anche simple est proposé. Il permet la simulation temporelle du champ de pression dans le résonateur à partir d'une description modale de la colonne d'air et pour des paramètres de contrôle variables au cours du temps.

Cette thèse est consacrée à l'étude des instruments de musique à vent à anche simple (saxophone, clarinette) vus comme des systèmes dynamiques auto-oscillants. Ces instruments sont modélisés sous la forme d'un système bouclé associant un élément linéaire (le résonateur) et un élément constitué du bec et de l'anche (agissant comme une valve) caractérisé par une relation non linéaire reliant le débit entrant à la différence de pression de part et d'autre de l'anche. L'intérêt est porté ici sur la caractérisation de cette relation non linéaire et son influence sur les oscillations.<br /><br />Une étude essentiellement bibliographique a montré que les modèles simplifiés d'instrument à anche simple conique ou cylindrique sont formellement analogues aux modèles élémentaires de corde frottée. En effet, grâce à de nouvelles correspondances, il est mis en évidence que pour chaque paramètre ou variable il existe un analogue.<br />Une étude théorique exploite ensuite cette analogie : des travaux antérieurs sur la stabilité des solutions périodiques pour la pression dans les instruments à vent sont prolongés et complétés en s'inspirant de travaux traitant de la corde frottée. L'intérêt est porté sur l'influence de la relation non linéaire. Faisant usage de calcul analytique et de simulations numériques dans le domaine temporel, des conditions sur la relation non linéaire pour obtenir des solutions périodiques stables sont données dans le cas d'instruments à vent de type conique dont le résonateur est modélisé comme une ligne à deux retards.<br /><br />La stabilité des solutions dépendant très fortement de la relation pression-débit à l'entrée de l'instrument, une méthode de mesure de cette caractéristique en régime statique a été mise au point pour les instruments à anche. Celle-ci a permis de valider un modèle élémentaire usuel basé sur la relation de Bernoulli et une modélisation de l'anche comme une raideur pure. Cette mesure permet en outre de mesurer précisément et simplement les paramètres de ce modèle, quasiment inaccessibles auparavant.<br /><br />Néanmoins, lorsque la différence de pression de part et d'autre de l'anche est importante, le modèle élémentaire et la caractéristique pression-débit mesurée diffèrent. Ceci est lié à la façon dont l'anche se déforme lorsqu'elle se plaque sur la table du bec (surface courbe). Afin d'obtenir des données sur cet aspect, un dispositif expérimental original permettant de mesurer la surface de contact entre la table et l'anche en mouvement a été conçu. Celui-ci a permis de tester expérimentalement pour la première fois la validité d'hypothèses formulées dans différentes publications. <br /><br />Une comparaison théorie/expérience de l'évolution du spectre des oscillations d'une clarinette est finalement proposée. Grâce à la mesure de la relation pression-débit et à la possibilité d'évaluer les paramètres du modèle élémentaire équivalent, la comparaison est ici quantitative tandis que les travaux similaires antérieurs sont essentiellement qualitatifs. Cette étude expérimentale, qui complète des travaux théoriques, permet de mettre en évidence les qualités et les lacunes du modèle élémentaire. Le protocole expérimental défini fournit de plus une méthode qui permettra de tester la validité des modifications ultérieures de ce modèle.

Questo lavoro propone la Data Envelopment Analysis (DEA) come uno strumento alternativo ai classici modelli di credit scoring. Il metodo, dal punto di vista teorico, presenta una serie di vantaggi rispetto ai convenzionali modelli di previsione, tali da renderlo uno strumento facile e veloce per la valutazione del merito creditizio. Per quanto riguarda l'evidenza empirica, questa metodologia è stata applicata ad un campione di piccole e medie imprese italiane non quotate, estratte casualmente dal database AIDA Bureau Van Dijk. Tramite l'impiego di alcuni indicatori finanziari, si è cercato di dimostrare come il modello permetta di giungere a dei risultati classificatori soddisfacenti e costituisca quindi, per gli istituti di credito, un valido meccanismo per la valutazione del merito creditizio della porzione di clientela più ampia, ovvero quella costituita dalle piccole e medie imprese.

In questo elaborato prenderemo in esame la questione della progettazione di un sistema software atto a gestire alcuni dei problemi legati alla raccolta dei dati in ambito medico. Da tempo infatti si è capita l'importanza di una speciale tecnica di raccolta dei dati clinici, nota in letteratura col nome di "patient-reported outcome", che prevede che siano i pazienti stessi a fornire le informazioni circa l'andamento di una cura, di un test clinico o, più semplicemente, informazioni sul loro stato di salute fisica o mentale. Vedremo in questa trattazione come ciò sia possibile e, soprattutto, come le tecniche e le tecnologie informatiche possano dare un grande contributo ai problemi di questo ambito. Mostreremo non solo come sia conveniente l'uso, in campo clinico, di tecniche automatiche di raccolta dei dati, della loro manipolazione, aggregazione e condivisione, ma anche come sia possibile realizzare un sistema moderno che risolva tutti questi problemi attraverso l'utilizzo di tecnologie esistenti, tecniche di modellazione dei dati strutturati e un approccio che, mediante un processo di generalizzazione, aiuti a semplificare lo sviluppo del software stesso.

Nel presente lavoro vengono delineati la storia ed il percorso riguardanti la candidatura alla Lista del Patrimonio Mondiale del bene seriale naturale Dolomiti alla luce della Convenzione UNESCO sul Patrimonio culturale e naturale mondiale del 1972. La tesi identifica ed evidenzia i complessi meccanismi necessari per conseguire il riconoscimento UNESCO sulla base delle indicazioni fornite dalle Linee Guida Operative alla Convenzione sul Patrimonio Mondiale. La ricerca si è sviluppata ulteriormente facendo emergere un interessante capitolo della storia dolomitica antecedente al percorso di candidatura ufficiale. Sulla base di
questo significativo contributo si è ragionato sulla valenza culturale del bene Dolomiti e sui possibili sviluppi in termini di tutela dei valori
culturali inclusi nel territorio dolomitico. Per raggiungere tale risultato fondamentale è stato lo studio della normativa vigente in materia di tutela ambientale, presentata nella prima parte dell' elaborato. Successivamente è stata affrontata la regolamentazione fornita dall' UNESCO utile per presentare una candidatura alla Lista del Patrimonio Mondiale, tenendo conto che dalla prima versione delle Linee Guida Operative ad oggi sono state redatte ben 25 versioni con relativi ampliamenti e modificazioni. L'indagine si è sviluppata nell'analisi del caso "Dolomiti" per poi provare a darne una lettura organica e complessiva fornendo degli spunti di riflessone per delle possibili evoluzioni.

Scopo di questa ricerca è tracciare la storia dei sistemi di accoglienza e protezione di richiedenti e titolari di protezione internazionale in Italia. L’excursus storico si avvale dell’analisi di dati e statistiche relative alle richieste di asilo, della normativa in materia, di materiale bibliografico di varia natura ed anche di testimonianze orali raccolte durante la ricerca sul campo. Il punto di vista privilegiato è quello dell’operatore direttamente impegnato nella gestione dell’accoglienza, una figura che è evoluta fino a diventare un vero e proprio mestiere.
Il sistema italiano di accoglienza e protezione di richiedenti e titolari di protezione internazionale e umanitaria è stato formalmente istituito nel 2002 con il nome di Sistema di Protezione per Richiedenti Asilo e Rifugiati, SPRAR. Esso trae origine da esperienze spontanee e volontarie di accoglienza a favore degli sfollati della ex Jugoslavia che si realizzarono dal 1992-93, ispirate ai principi del pacifismo concreto. Dal 2011 oltre al modello SPRAR le istituzioni italiane hanno creato un sistema parallelo, ispirato da principi securitari ed emergenziali, che, pur nato come straordinario, accoglie oggi circa il 70% dei richiedenti asilo presenti in Italia. In questo “sistema rovesciato” reso incerto da un quadro normativo e giuridico frammentato, si incontrano e scontrano due generazioni di professionisti, motivati da ideali comuni, ma orientati da approcci metodologici talvolta divergenti

The main theoretical framework of this research is the new sociology of childhood: it adopts, therefore, the analytical perspective which assumes that children are actors who are capable of acting coherently within their social worlds.
Through an 8 months’ ethnography in the wards of the Paediatric Clinic of the Hospital of Padua, which was conducted in a dialogical style – proposing, thus, to consider the Other as a subject involved in an interaction, even in the process which leads to scientific knowledge, and not as an object from which the researcher can gain experience and gather information – I investigated the relationship hospitalized children establish with adults, within their peer group and the hospital environment, with reference to the illness and to the processes of treatment.
The research explores several themes: the symbolic meanings given by the actors to the space and the places where the interactions come to life; the doctor-patient communication in the paediatric context, paying particular attention to the situations in which this communication takes on characteristics which conflict with the demands and the wishes of the children, who act by putting into action different tactics to collect information about themselves; the relation with the bodies, often considered by adults as objects of the medical practice, bodies which become instead the means children have to exercise their own autonomy and their self-recognition; the issue of competence and agency, developed from the idea that children always possess a situational and relational knowledge, which is specific for the social worlds where they act, but always according to different styles of intervening on the world, which adults sometimes notice with difficulty; the role of the game in the hospital environment, as a particular frame of the action and as a source of sense and meanings.
The main conclusions show how children are always subjects, and are always able to act coherently within their social words, even in a context, such as the hospital one, which seems rigidly binding; how children constantly exercise autonomy and self-recognition, through different tactics, although the medical practice appears to limit their spaces of action, and independently of the manner adults relate to them. The research points out, moreover, how a lack of attention among the adults to the subjectivity of children, to the symbolical meanings in the interactions, can become a strong limit to the effectiveness of the therapeutic relations themselves, to the success of treatment processes which take into account the specificities of children, considered as people and not as objects of the medical practice.<br>La presente ricerca si colloca all’interno della cornice teorica della nuova sociologia dell’infanzia: adotta quindi una prospettiva analitica che parte dal presupposto che i bambini siano attori capaci di agire coerentemente all’interno dei propri mondi sociali.
Attraverso un’etnografia durata 8 mesi all’interno dei reparti della Clinica Pediatrica dell’Azienda Ospedaliera di Padova, condotta in stile dialogico – che si propone, quindi, di considerare l’Altro come soggetto in interazione, anche nel processo che porta alla conoscenza scientifica, e non un oggetto sul quale fare esperienza, da cui raccogliere informazioni – ho indagato la relazione che i bambini ricoverati sviluppano con gli adulti, all’interno del gruppo dei pari e con il contesto ospedaliero, in riferimento alla malattia e ai processi di cura.
La ricerca approfondisce numerosi temi: i significati simbolici che gli attori attribuiscono agli spazi e ai luoghi in cui prendono vita le interazioni; la comunicazione medico-paziente in ambito pediatrico, con particolare attenzione alle situazioni in cui la comunicazione assume caratteristiche che discordano con le richieste e i desideri dei bambini, che agiscono mettendo in gioco differenti tattiche per la raccolta delle informazioni che riguardano loro stessi; il rapporto con i corpi, spesso intesi dagli adulti come oggetti della pratica medica, che diventano invece strumento attraverso cui i bambini praticano la propria autonomia e il riconoscimento di loro stessi; il tema della competenza e dell’agency, sviluppato a partire dall’idea che i bambini siano sempre portatori di saperi situazionali e relazionali specifici per i mondi sociali in cui agiscono, e che lo facciano secondo differenti stili di intervento sul mondo, dei quali a volte gli adulti faticano ad accorgersi; il gioco in ambito ospedaliero, come particolare cornice all’azione e matrice di senso e significati.
Le principali conclusioni mostrano come i bambini siano sempre soggetti, e siano sempre capaci di agire coerentemente all’interno dei propri mondi sociali, anche in un contesto che appare rigidamente vincolante come quello ospedaliero; come i bambini pratichino costantemente autonomia e autoriconoscimento, attraverso molteplici tattiche, anche quando le pratiche mediche sembrano limitare i loro spazi di azione, e indipendentemente dal modo in cui gli adulti si relazionano con loro. La ricerca mostra, inoltre, come una scarsa attenzione da parte degli adulti verso la soggettività dei bambini, verso i significati simbolici che entrano in gioco nelle interazioni, possa diventare un forte limite per l’efficacia delle relazioni terapeutiche stesse, per la riuscita di processi di cura che tengano conto delle specificità dei bambini, intesi come persone e non come oggetti della pratica medica.

A ventuno anni dalla riforma che ha riguardato i reati sessuali è opportuno chiedersi se la normativa vigente, sostanzialmente da allora rimasta immutata, sia tuttora (e se lo sia mai stata) efficace a contrastare il fenomeno della violenza sessuale nelle sue forme di manifestazione.
Seppur si avverta la necessità di un cambiamento (ne è espressione anche l’approvazione della recente legge 69/2019), tuttavia non si è ancora posto mente ad una rivisitazione complessiva della disciplina.
La legge n. 69 del 19 luglio 2019, nota come “Codice Rosso”, infatti, pur contenendo rilevanti modifiche in tema di reati contro la persona, sia sotto il profilo sostanziale che processuale, non impatta sulla struttura base del reato di violenza sessuale.
Sollecitazioni in merito ad un mutamento della disciplina provengono anche dalla giurisprudenza di merito. Ciò è quanto emerge dall’indagine empirica condotta su procedimenti penali, con imputazione ex art. 609 bis c.p., definiti dal Tribunale di Milano nell’arco del triennio 2015 – 2017.
L’analisi dei casi giurisprudenziali permette di cogliere come gli interpreti, già da tempo, si spingano a letture evolutive del dato teorico, con argomentazioni capaci di offrire nuove prospettive applicative delle fattispecie incriminatrici dei reati sessuali.
Riforme in materia sono state peraltro adottate in vari Paesi stranieri. La rilevanza di uno studio comparato si traduce nella possibilità, che il raffronto tra differenti sistemi giuridici offre, di individuare quali profili della normativa di altri ordinamenti siano maggiormente apprezzabili e quali, invece, più criticabili. Il comune denominatore delle riforme succedutesi negli ordinamenti di civil law diversi dal nostro e nei principali sistemi di common law si rinviene nella necessità di realizzare una tutela più pregnante contro i reati sessuali, condividendo principi ispiratori incentrati sull’importanza di valorizzare la libertà di autodeterminazione della persona nella sfera della propria sessualità e di costruire fattispecie di reato incentrate sul requisito della mancanza del consenso della vittima.
Significative le modifiche apportate alla disciplina dei reati sessuali in Germania, Spagna e Svezia.
Nell’area del common law spiccano l’ordinamento giuridico inglese, nonché quello statunitense. Proprio con riferimento a quest’ultimo, spinte riformistiche negli Stati Uniti d’America si sono diffuse già dalla metà degli anni ‘60 e sono proseguite fino alla metà degli anni ’70 del secolo scorso, anni in cui le rilevazioni statistiche relative al reato di violenza carnale hanno registrato picchi allarmanti tanto da far parlare di “rape epidemic”. Già si insisteva sulla necessità di abbandonare il requisito della resistance come elemento necessario per la sussistenza del reato e sull’opportunità di individuare parametri univoci da cui inferire il non consenso della vittima.
In tale ottica, di assoluto rilievo è la modifica compiuta dallo Stato della California, che ha emanato il 28 settembre 2014 una legge dal titolo “Yes means Yes” secondo cui è richiesto “an affirmative consent standard in the determination of wether consent was given by both parties to sexual activity”. Definita dalle testate giornalistiche come “la nuova legge anti-stupro”, è una misura approvata per arginare la piaga delle violenze sessuali commesse nei campus universitari: il silenzio o la mancanza di resistenza da parte della vittima non sono sufficienti a integrare il consenso al rapporto sessuale. L’attenzione posta dall’ordinamento californiano sulla valorizzazione della mancanza del consenso della persona offesa offre spunti di riflessione in un’ottica di riforma del diritto interno in materia di violenza sessuale.<br>Generally, sexual assault is defined as an unwanted sexual contact. In the Italian penal code the regulation of sexual crimes is the result of a reform that is now twenty years old. The aim of the work is to focus on the controversial issues related to this topic. In particular, the author believes that a new reform is needed. For example, it could be appropriate to diversify the criminal behaviors, by distinguishing sexual harassment from sexual abuse and rape. Then, it could be interesting ad useful to focus on the lack of consent of the victim, in order to punish these kind of crimes. From this point of view it’s really important to make a comparison with the U. S. system.
In the U.S.A. a relevant issue concerning the way criminal laws punish sexual assaults is linked to the debate if it should be better focused on the defendant’s use of force or violence, or on the victim’s lack of consent (in this case, it’s important to define which is the best consent standard to use). Some legislations require proof of both: either lack of consent or force by itself isn’t enough to constitute the crime. An interesting food for thought might be found by considering the way in which some U.S. legislations deal with the problem.
On September 28, 2014 the State of California, with the goal of addressing the phenomenon of sexual assaults campus colleges, adopted the “Yes means Yes” bill, to amend Section 67386 of the Education code, relating to student safety. This law requires colleges and universities in California to adopt specific policies regarding sexual assault, including the introduction of a new affirmative consent standard in the determination of whether consent was given by a complainant. The law requires colleges and universities to adopt these policies in order to receive state funds for student financial assistance. This new legislation was followed - on July 7, 2015 - by another similar one, adopted in the State of New York, titled “Enough is Enough”, which requires all colleges to adopt a set of comprehensive procedures and guidelines, including a uniform definition of affirmative consent.
Affirmative consent is a relatively new concept in the law. In effect, it requires a university student accused of sexual misconduct to establish that the accuser affirmatively consented to the sexual contact. These changes in California and New York do not alter the criminal definition of sexual assault, which continues to require the state to prove the lack of consent. However, the laws also require colleges to create and implement methods for educating students about affirmative consent. Such educational programs likely include clear and frank discussions about sex and about sexual dignity and autonomy. Therefore, it is important to understand whether this new standard could be a significant step towards reforming criminal rape laws and creating a more sensible, compassionate view of sex in society generally.

Il tema di questa tesi nasce proprio dalle difficoltà che in questo momento si stanno diffondendo nel campo dell'edilizia in Italia, o più nello specifico nei cantieri. Il problema attuale legato alla scarsità e al rincaro dei materiali con il conseguente ritardo dei lavori e della disponibilità dei ponteggi in acciaio, ha condotto a valutare l’ipotesi di adottare il bambù come alternativa al materiale metallico. L’idea è infatti partita dagli ingegneri Elisa Lancellotti e Luca Cristiani, titolari dello studio LANCRI, che hanno avuto modo di constatare in prima persona le suddette problematiche.
Nella prima parte dell’elaborato, sono state analizzate le soluzioni adottate a Hong Kong, sia in termini di dimensionamento e pratiche costruttive, sia di sicurezza nell’ambito lavorativo considerandone i pregi e i difetti. In parallelo, è stato anche riportato un quadro generale della normativa attualmente utilizzata per i ponteggi in Italia e in Europa, in modo da avere un’idea chiara di quali possano essere i limiti e i punti di incontro tra i modelli di impalcatura in bambù utilizzati in Asia e quelli normati in acciaio che sono d’uso comune.
Con le conoscenze acquisite nella prima parte della tesi si è arrivati alla definizione di due prototipi di ponteggio in bambù ideati nel rispetto delle linee guida della normativa UNI EN 12811 impiegata nella progettazione delle impalcature. È stata quindi eseguita una prima analisi statica lineare, con annesse verifiche, in modo da constatare che possa realmente esservi la possibilità di utilizzare i culmi di bambù per sostituire i classici tubi in acciaio. Nel proseguo dell’elaborato sono stati messi in luce i punti di forza e i problemi che caratterizzano il materiale di origine naturale e le varie soluzioni che possono essere adottate. Infine, nella parte conclusiva, si riportano i primi studi condotti sugli elementi di connessione che rappresentano certamente un punto cruciale.

L’Église italienne, que le présent travail a l’intention d’assumer en qualité de point de référence particulier, en est également intéressée: contrairement au passé, même le plus récent, la foi chrétienne n’est plus un patrimoine «de tous». La question se pose puisque, au nom de l’évangile, l’action de l’Église ne peut pas disperser, pourtant, le caractère universel de la foi en soi même (son être «pour tous»). Dans un tel scénario, s’enclenche le but que cette thèse se pose de poursuivre sur le plan de la pensée théologique-pastorale: elle veut accompagner l’Église en son être à l’intérieur de cette tension entre l’instance théologique d’une foi qui est «pour tous» et le donné sociologique dont il émerge qu’elle n’est plus «de tous». Beaucoup de projets contemporaines de réforme pastorale ont l’intention de faire face aux transformations de la culture afin d’empêcher tout injustifiée domestication. Cependant, comme cette thèse essaie à le prouver, ils risquent souvent de suggérer une rupture avec le passé récent du corps ecclésial. Pour eux la référence polémique est représentée par cette figure de «catholicisme populaire» avec qui, dans le contexte de la «civilisation paroissiale», l’expérience chrétienne est réussie à s’enraciner dans le tissu social. Dans ces projets, il est – en effet – assimilé d’une manière restrictive à une sorte de «catholicisme de masse», basé seulement sur des processus religieux de socialisation et d’uniformisation de l’expérience. Au contraire, le but de ce travail consiste en un essai de compréhension renouvelée de cette figure de vie chrétienne. Elle n’est retenue seulement selon la particulière forme historique qu’elle a adoptée dans le demain passé, marqué par une situation d’homogénéité culturelle, d’une Église de peuple, mais aussi comme principe opératoire qui désigne la capacité du christianisme de se réaliser en tant qu’élévation et transfiguration des formes anthropologiques de base. Cette perspective dynamique permet de trouver dans le «catholicisme populaire» un principe écclesio-génétique qui exalte l’interaction entre l’initiative ecclésiale et la sensibilité des croyants, et qui, tout en défendant la qualité théologale de l’expérience chrétienne, ne méprise pas la valeur pédagogique de son enracinement religieux. La dynamique qui préside au «catholicisme populaire», grâce à la confrontation avec une étude sur le terrain, conduit à l’individuation de certaines provocations à propos de la structure du corps ecclésial, en ce qui concerne les représentations, les actions, les sujets et les limites qui le caractérisent. Elles sont transposées de manière à envisager une réforme de l’Église qui s’avère applicable pour le présent et qui cherche à garder le caractère universel-non formel de la foi, c’est à dire son «pour tous».<br>The current radical cultural change causes a crisis of the forma ecclesiae and introduces a question about what type of Church could be more relevant for the announcement of the Gospel. Italian Church, which is the main point of view for this work, is affected too: actually, Christian faith is no longer a heritage “of everyone”. The question arises because, in the name of the Gospel, the ecclesial action has to be universal (it’s “for everyone”). The theological and pastoral aim of this thesis is to reflect about the tension between the theological objective of a faith “for everyone” and the sociological fact that this faith is no longer “of everyone”. Many contemporary projects of pastoral reforms aims to consider these cultural transformations, avoiding a possible improper domestication. However, as this thesis would like to pursue, there could be the risk of provoking a gap with the past of the Church. Actually, these projects attack the “popular Catholicism”, that is the figure through which Christianity has been rooted inside the fabric of society at the time of the “parish system”. It is reduced as a sort of impure “mass Catholicism”. Whereas, the aim of this work is to suggest a resumption of this “popular Catholicism”. This figure is not considered in a static way (its form at the time of christianitas) but in a dynamic one. “Popular Catholicism” reminds us that Christianity comes from the comparison, the assumption, and the transformation of shared and daily ways of life. Moreover, this dynamics is successful when it comes from the interaction between power initiative and believers’ common sensibility. The dynamics so discovered, also by means of a study in the field, leads to find some challenges, able to change the current ecclesial body. They concern: descriptions, actions, subjects, and boundaries. These challenges are considered as special directions for a Church reform able to answer current needs, without forgetting the fact that it is in service of a faith “for everyone”.

Ce travail a deux objectifs principaux, et pour cette raison il est divisé en deux parties : leur objet est l'utilisation des systèmes d'automatisation pour la prise de décision par l'administration publique. La première partie est consacrée à la conceptualisation et à l'identification du cadre normatif et systématique de la matière. Il est nécessaire, avant de dédier à la numérisation de la procédure administrative, de cerner tout d'abord et de définir les caractéristiques essentielles de la numérisation de l'administration publique. Ensuite on analyse l'automatisation de la prise de décision, qui est le principal objet de l'investigation. Il est essentiel de considérer les sources normatives qui gouvernant l'automatisation des décisions publiques, et aussi de comprendre la nature juridique des instruments permettant l'automatisation. La deuxième partie, en revanche, met l'accent sur les principaux problèmes juridiques posés par l'introduction de décisions administratives publiques automatisées : une première hypothèse est que l'automatisation n'est pas compatible avec les principes et les normes européennes sur l'administration publique, ainsi qu'avec les sources nationales (italiennes) de la procédure administrative. Après avoir abandonné cette première hypothèse, l'accent est mis sur la manière de concilier les principes et les instituts procéduraux traditionnels (obligation de motivation, participation) avec les décisions automatisées. In particolare vengono analizzate le dinamiche di coppia in presenza di conflitto e le conseguenze sui figli. La prospettiva adottata è di tipo multidimensionale, particolare rilievo assumono la prospettiva sistemica e la teoria dei legami. Filo conduttore della tesi è l’affermazione dell’importanza dei legami familiari per la costruzione dell’identità dell’individuo e la loro componente transgenerazionale. Secondo questa prospettiva la separazione si configura come attacco al legame. Viene individuato nella mediazione familiare uno strumento efficace per la gestione del conflitto coniugale e la messa in salvo dei legami familiari, fondamentale per il benessere della coppia e dei figli della separazione.

«As long as I am an artist, I will also be an actress». A study of Adelaide Ristori’s stage practice
This dissertation investigates the stage practice of nineteenth-century star actress Adelaide Ristori: it aims at reconstructing both her working method and her acting style and at identifying, as a final and “open” conclusion, those features of her practice as a stock company stage manager that can be considered as signs of a progress towards modern stage direction.
Several sources have been employed; the archival research took place mainly at Museo Biblioteca dell’Attore in Genova, holding a precious and considerable collection devoted to Adelaide Ristori (Fondo Ristori).
Starting from some considerations about the little documented beginnings of Adelaide Ristori’s career in her artistic family, the first part of this dissertation reconstructs the working method the actress accurately practised in the years of her artistic maturity.
Adelaide Ristori was an innovative actress. Every performance of hers was founded on the study of many sources – dramatic, literary, figurative – and on a double approach to the character, i.e. a rational and cognitive and an empathic approach. The artist then built her part upon two scores she worked out from such premises, that is to say a vocal and a physical score. These were the basis of the precise reconstruction of the emotional journey of the character she was to interpret, and of the connection between the actress’ body and the psychological motivation of the character. The actress worked out this complex construction of the part thanks to her constant concentration and the power of her stage presence. Every detail in the performance was carefully selected and built in an actorial work whose cornerstones were verisimilitude, formal restraint, a refined explication of the dialectic relation between the inner and outer self, the respect for the playwright’s intents and the individuation of the core motifs in the play allowing for the communication of ethical and poetical values.
The ethical and educative value of the theatre was of primary importance in Adelaide Ristori’s theatrical history: through her artistic work she meant to embody a model enhancing the cultural and social re-evaluation of the theatre. She also wanted to represent and advertise a new image of the actor and above all of the actress as a virtuous being, an emblem of a profession worthy of being appreciated both on a human and on an artistic level.
To promote these values on the stage, Adelaide Ristori included metatheatrical pieces in her repertoire; the leading characters of these plays are actresses whose parts – true manifestos of her poetics – voice her very idea of the theatre and art. The French plays we analyse in the second part of this dissertation are emblematic examples: Adriana Lecouvreur by Eugène Scribe and Ernest Legouvé and Béatrix ou La Madone de l’Art by Ernest Legouvé. In both cases we delineate the history of the play and we try to reconstruct – as far as possible – Ristori’s performance, mainly referring to the relevant promptbooks and the plentiful articles held in the Ristori Fund.
As a conclusion, we offer some considerations on Ristori’s ensemble work with her company, the Compagnia Drammatica Italiana. An actress who fixed both her individual interpretation and the whole performance that she directed in a definite form, Adelaide Ristori appears as the emblem of an innovative conception of theatrical performance as a consistent and composite artistic event; in such work she played the role of an actress-manager who could guarantee aesthetic and poetical consistency, foreshadowing in some aspects the art of modern stage direction in Italy.<br>«Fino a che farò l’artista, sarò anche attrice». La ricerca è incentrata sullo studio della prassi scenica della Grande Attrice ottocentesca Adelaide Ristori e si propone di definire concretamente il metodo di lavoro e lo stile attorale dell’interprete e di enucleare, quale ipotesi conclusiva e “aperta”, gli aspetti della sua pratica capocomicale come presagi di un approccio preregistico allo spettacolo teatrale.
Le fonti utilizzate sono state molteplici e le ricerche d’archivio si sono svolte principalmente al Museo Biblioteca dell’Attore di Genova dove è conservato il ricchissimo Fondo Adelaide Ristori.
Nella prima parte del lavoro, partendo da alcune riflessioni sulle origini assai poco documentate della carriera di Adelaide Ristori figlia d’arte, si è giunti alla delineazione del metodo di lavoro praticato, con precisione e minuzia, negli anni della maturità artistica.
Attrice innovativa rispetto al passato, Adelaide Ristori basa ogni sua interpretazione sullo studio del testo e di svariate fonti (teatrali, letterarie, figurative) e su un doppio percorso di avvicinamento al personaggio, razionale-conoscitivo ed empatico. L’artista giunge poi ad un’elaborazione scenica dell’interpretazione fondata sulla definizione di una duplice partitura vocale e fisica, sulla quale si innesta una ricostruzione precisa del percorso emotivo del personaggio basato sull’organicità fra corpo e motivazioni psicologiche e sorretto – al momento dell’esecuzione – dalla costanza della concentrazione e dalla forza della presenza scenica. Tutto è scelto e costruito entro un lavoro attorico che deve rispondere ai criteri di verosimiglianza, misura formale, raffinata esplicazione della dialettica interno-esterno, adesione alla voce del drammaturgo, individuazione dei motivi d’interesse del testo per la comunicazione di valori etici e poetici personali.
La valenza etica ed educativa del teatro è parte integrante della storia di Adelaide Ristori, tesa ad incarnare con il proprio operato artistico un esempio di rivalutazione culturale e sociale del teatro stesso. A ciò si accompagna il desiderio di proporre una nuova immagine dell’attore, e soprattutto dell’attrice, quale figura portatrice di valori morali, emblema di un mestiere degno di riconoscimento umano e artistico.
Per affermare tali istanze ideali, Adelaide Ristori inserisce nel suo repertorio testi metateatrali con al centro parti di attrici che possono essere considerate “manifesti” della sua visione del teatro e dell’arte. Tra i casi più emblematici, vi sono due opere francesi, analizzate nella seconda parte di questo lavoro: Adriana Lecouvreur di Eugène Scribe ed Ernest Legouvé e Béatrix ou La Madone de l’Art di Ernest Legouvé. Per entrambi, si è delineata la storia dello spettacolo e si è tentato di ricostruire l’interpretazione del personaggio, in particolare mediante l’analisi dei copioni e dei ritagli stampa del Fondo Ristori.
In conclusione, si sono proposte alcune riflessioni sul lavoro della Grande Attrice all’interno dell’ensemble della sua Compagnia Drammatica Italiana.
Attrice che formalizza la propria performance individuale e analogamente l’intero spettacolo di cui è responsabile e “direttrice artistica”, Adelaide Ristori sembra infatti essere l’emblema di una innovativa concezione dello spettacolo come evento artistico coerente e composito, per la creazione del quale emerge la necessità di una guida capace di garantire uniformità estetica e poetica alla rappresentazione teatrale e tale da essere l’espressione di una interessante tensione preregistica.

Deux méthodes de caractérisation des qualités d' émission) des instruments de musique à anche validées. Ces méthodes consistent, d' une part à simuler les auto-oscillations résultant du couplage acoustiques (justesse, timbre, facilité simple sont développées et partiellement étudier le résonateur seul, d' autre part à entre le résonateur (supposé linéaire) et l' excitateur (non-linéarité supposée localisée à l' entrée du bec). Nous nous limitons à évaluer la fréquence fondamentale et le spectre de la pression interne au bec des instruments étudiés. Dans tout le document, nous supposons ces grandeurs représentatives de la justesse et du timbre. Pour la validation, nous comparons, pour des instruments réels, ces grandeurs aux grandeurs mesurées sur l' instrument en situation de jeu. Pour obtenir de telles conditions, nous avons réalisé une bouche artificielle, reproduisant l' embouchure du musicien avec stabilité et reproductibilité. Nous présentons une revue bibliographique et isolons un modèle physique élémentaire. Par analyse de ses solutions, on vérifie que la fréquence fondamentale de l' oscillation se déduit des fréquences de résonances au seuil linéaire grâce à un terme correctif. Celui-ci est la correction de longueur. Il est représentatif de l' embouchure et indépendant du doigté. Nous calculons les solutions discrètes du modèle à l' aide de l' impédance d' entrée mesurée ainsi que des paramètres équivalents à l' embouchure. La valeur de la fréquence d' échantillonnage est fixée par les caractéristiques de l' impédance d' entrée du résonateur. Ceci permet de minimiser les erreurs numériques de la fonction de réflexion "discrète". Les valeurs de la fréquence d' échantillonnage s' avèrent faibles vis à vis de la fréquence propre de l' anche. La transformation bilinéaire corrigée est choisie pour obtenir une anche "discrète" aux caractéristiques proches celles de l' anche "analogique". Les impédances d' entrées et les fréquences fondamentales de la pression dans le bec sont mesurées pour tous les doigtés des deux premiers registres de la clarinette et du saxophone alto. Les fréquences de résonance et les fréquences fondamentales sont comparées pour chacun des doigtés, une correction de longueur caractéristique de l' embouchure est estimée pour chaque registre. La comparaison des pressions simulées et mesurées dans le bec montre que la simulation permet de détecter les "notes difficiles" pour les doigtés de gorge de la clarinette. Cette détection est satisfaisante si on applique de faibles pressions d' alimentation au modèle. Le phénomène d' enroulement de l' anche sur la table du bec, omis dans le modèle physique, serait ici une des causes principales de ce désaccord. Une première approche théorique de ce phénomène est proposée à l' annexe A.

Ce travail porte sur la caractérisation d'anches simples utilisées pour la clarinette ou le saxophone. Sachant que les musiciens perçoivent des différences importantes dans la qualité des anches de caractéristiques identiques (même marque, coupe et force), cette thèse propose des nouveaux outils pour la caractérisation des anches en situation de jeu.Un bec instrumenté utilisant des capteurs embarqués est développé de façon à mesurer le déplacement de l'anche et la différence de pression de part et d’autre de l'anche. À partir de ces signaux, il est possible d'estimer des paramètres d'anche associés à différents modèles physiques. Les résultats obtenus montrent que la complexité du modèle décrivant le comportement de l'anche doit augmenter avec la nuance de jeu. Le bec instrumenté est utilisé dans une campagne de mesures comportant 7 musiciens et 20 anches, et permet de quantifier la variabilité des résultats due aux musiciens. Des tests subjectifs sont réalisés avec ces mêmes musiciens, et montrent que les différences entre les anches se réduisent à une seule dimension (facilité de jeu ou timbre). Les corrélations entre les descripteurs subjectifs et les paramètres objectifs mesurés sont étudiées afin de mieux comprendre les différences perçues entre les anches, permettant le développement d'un modèle prédictif de la qualité des anches.De façon à éviter la variabilité produite par le musicien, une bouche artificielle aspirante est développée. La comparaison des mesures réalisées par la bouche artificielle et par un musicien permet d'identifier la plage de fonctionnement optimale où la bouche artificielle imite au mieux le jeu du musicien<br>This work deals with the characterisation of single cane reeds used for clarinet or saxophone. Musicians perceive important differences of quality between reeds of the same brand, cut and strength. This thesis proposes new tools for reed characterisation in playing conditions.An instrumented mouthpiece is developed to enable the measurement of reed displacement and pressure difference on both sides of the reed using embedded sensors. From these signals, it is possible to estimate reed parameters of different physical models. Results reveal that the complexity of the physical model describing the reed behaviour must increase with the dynamic level.The instrumented mouthpiece is used in a measurement campaign involving 7 players and 20 reeds, quantifying the variability of the results due the musicians. Subjective tests conducted with these musicians show that reeds can be mainly described by one dimension (ease of playing or timbre). The correlations between the subjective descriptors and the measured objective parameters are studied to better understand the perceived differences between reeds, developing a predictive model of reed quality.In order to avoid the variability of the musician, an aspirating artificial mouth is developed. It uses the instrumented mouthpiece and it can be played by a musician or artificially. The comparison of the measurements made in both cases allows for the identification of the optimal working range in which the artificial mouth best reproduces the musician's playing according to intonation and playing level

L'objectif est de développer un modèle global d'instrument à vent à anche simple qui inclut les actions de l'instrumentiste, en vue de simulations dans le domaine temporel. L'élaboration de ces modèles à temps continu et à temps discret nécessite la mise en oeuvre de méthodes liées à l'acoustique, au traitement du signal et aux mathématiques appliquées. Le premier chapitre donne une description des postulats et principes de modélisation utilisés, compatibles avec une démarche informatique "orientée objet". L'instrument est vu comme un assemblage d'éléments localisés reliés entre eux par des portions de tube. Sont détaillés les modèles d'embouchures à anche simple et d'obturateur de trou latéral. Des exemples sonores illustrent le potentiel de ce type de modélisation de l'instrument en situation de jeu. Au cours de la discussion, il apparaît que certains points néscessitent un développement plus poussé. Les trois points jugés les plus importants donnent les chapitres suivants. Dans le deuxième chapitre, est décrit un modèle à temps continu de tube acoustique de forme quelconque, en supposant une propagation unidimensionnelle et une section continûment et lentement variable. Une portion de tube est représentée par un bi-porte dont les ondes entrantes et sortantes sont localement progressives. Ce modèle se distingue du modèle usuel en ondes progressives, lequel présente l'inconvénient d'engendrer artificiellement des instabilités pour certaines configurations de tube. Le troisième chapitre tente de faire le point sur la modélisation mécanique de l'anche simple et de mettre au point la conception d'un modèle à constantes localisées et à paramètres variables. Sont discutés en outre l'enroulement de l'anche sur la table et la validation d'un modèle de poutre. Le quatrième chapitre essaie d'établir des principes de passage du temps continu au temps discret au travers de méthodes de conception de filtres numériques. Both continuous and discrete time contexts need the design of methods linked to acoustics, signal processing and applied mathematics. The first chapter describes postulates and principles chosen for object-oriented modeling. The instrument is seen as lumped elements linked by pieces of tube. Some details are given on the modeling of a single reed mouthpiece and a key-pad system. Sound examples illustrate the potential of this kind of modeling in playing situation. In this introducing chapter, three important points are highlighted and developed in the three following chapters. The second chapter describes a two-port model of bore appropriate to cylinders, cones, and any other shapes without discontinuities in cross-section. This two-port uses locally-travelling waves as input, output, and state variables in preference to the usual travelling waves which can sometimes generate instabilities. The third chapter is about the mechanical modeling of a single reed. A lumped model with varying parameters is discussed, including questions about the rolling up of the reed on the lay of the mouthpiece and validity of a beam model. Au XXe siècle, aux moyens traditionnels de transmission du langage verbal que constituent le parlé et l’écrit, s’est ajouté un troisième moyen, le transmis. Si, dans un premier temps, il s’est surtout agi d’un « parlé à distance » (téléphone, radio, cinéma, télévision), on est ensuite passé à « l’écrit à distance » (sites Internet, courrier électronique, chats, SMS). Les progrès technologiques ont été suivis d’une transformation linguistique : le code s’est adapté aux différents supports qui l’ont véhiculé. Les technologies électroniques de la parole, comme le note Spina (2001 : 31), ont donné une nouvelle impulsion au mode de communication orale. À la fin du XIXe siècle, en effet, l’invention du téléphone a représenté une véritable révolution. Aujourd’hui, après plus d’un siècle, le téléphone a dépassé ses limitations traditionnelles, il s’est fait petit et discret et, à la transmission du son, il a ajouté la possibilité de faire circuler de brefs messages de texte et même des e-mails.La diffusion de la communication SMS a transformé un instrument dévolu à l’échange oral en technologie d’écriture, mais l’originalité du support permet à l’écriture SMS de reproduire les structures morphologiques de l’interaction orale, malgré sa nature d’écrit. Ainsi, la vitesse de composition du message n’est pas la seule propriété qui permette à l’écriture SMS de s’approcher de l’oralité : la syntaxe y apparaît souvent comme plutôt élémentaire, avec une prédominance de parataxes et de constructions elliptiques de la phrase plutôt que d’hypotaxes, traits typiques du discours oral. Mais le SMS joue aussi sur les finalités communicatives en abaissant le registre formel de la langue et en favorisant ainsi un nouveau langage. Notre thèse, si elle n’est pas la première à analyser un corpus de SMS, est sûrement en revanche l’une des premières à comparer la typologie des processus observés dans deux langues, l’italien et le français, pour en définir mécanismes parallèles et diversités<br>Verbal language has traditionally been communicated by two means: speech and writing. In the twentieth century, however, a third means came into existence: transmitted language. Initially this consisted mostly of language “spoken at a distance” (telephone, radio, cinema, television), but it then extended to include language “written at a distance” (Internet sites, electronic mail, online chat, SMS). Technological progress was followed by a transformation of the language, and the code has been adapted to the different media used to convey it. Electronic technologies of the word, as Spina notes (2001: 31), have given a new impetus to the oral mode of communication, based on the spoken word.At the end of the 19th century, the invention of the telephone was a real breakthrough, allowing the creation of new, and previously unavailable, forms of communication. Today, little more than a century later, the phone has exceeded even its traditional limitations and to the transmission of sound has been added the ability to write short text messages, and even to send e-mail. The spread of SMS communication has transformed an instrument devoted to oral exchange into a technology of writing: in fact, the originality of the support allows text messaging, despite its written nature, to reproduce the morphological structures of oral interaction. Thus, the speed of composing the message is not the only property that allows texting to approach orality: the syntax is often seen as rather basic, with a predominance of parataxis and elliptical constructions rather than hypotaxis, features that are typical of spoken discourse. But texting also plays on communicative purpose by adopting a more informal register and thus fostering a new language. The present thesis, while not the first study to analyze a corpus of SMS, is surely one of the first to compare the types of processes found in both languages, French and Italian, in order to define parallel mechanisms and differences

Les instruments a vent a anche simple (clarinette, saxophone) comme plus generalement les instruments de musique a son entretenu sont des systemes physiques dits autooscillant. Afin de determiner leurs solutions en regime permanent, nous avons adapte la methode d'equilibrage harmonique a ces systemes physiques, par la convergence simultanee des harmoniques du signal suppose periodique et de la frequence fondamentale. En mettant au point un systeme micro-intervalle quart de ton sur le saxophone alto, nous avons ete confrontes a des difficultes d'emission sur certaines notes du registre grave de l'instrument. La resolution de ce probleme nous a amene a preciser les roles respectifs du resonateur et du systeme excitateur sur les caracteristiques de l'oscillation. Il est utile de connaitre les frequences de resonance du systeme caracterise par l'impedance d'entree du resonateur en parallele avec l'impedance d'anche, frequences qui correspondent aux frequences de jeu du systeme autooscillant. En etudiant le cas extreme d'oscillations quasi-periodiques (les notes qui roulent), nous avons relie leur inharmonicite avec la facilite d'emission. Pour finir, nous avons propose une description critique d'une bouche artificielle munie de capteurs donnant acces aux grandeurs d'entree du systeme excitateur (bec et anche de clarinette) couple a un resonateur de forme simple. Des mesures en regime stationnaire et en regime dynamique nous ont permis de verifier l'hypothese quasi-stationnaire et de mettre en evidence le debit pulse par l'anche

innanzitutto è stato necessario studiare Bologna e lo stato attuale dei servizi di raccolta dei rifiuti. È incrociando questi componenti che in questi ultimi tre anni sono state effettuate modifiche nel settore della gestione dei rifiuti.
I capitoli seguenti sono inerenti le applicazioni informatiche a sostegno di tali attività: Siget e Optit. Siget è il programma di gestione del servizio, che attualmente viene utilizzato per tutte le attività connesse alla raccolta di rifiuti. È un programma costituito da moduli diversi, ma di sola la gestione dati. la sperimentazione con Optit ha aggiunto alla gestione dei dati la possibilità di avere tali dati in cartografia e di associare un algoritmo di routing. I dati archiviati in Siget hanno rappresentato il punto di partenza, l'input, e il raggiungimento di tutti punti raccolta l'obiettivo finale. L'ultimo capitolo è relativo allo studio dell'impatto ambientale di questi percorsi di raccolta dei rifiuti. Tale analisi, basata sulla valutazione empirica e sull'implementazione in Excel delle formule del Corinair mostra la fotografia del servizio nel 2010. Il presente lavoro ha ad oggetto le eccezioni in senso lato e, in particolare, il controverso problema dei criteri distintivi tra eccezione in senso stretto, riservata alla parte, ed eccezione in senso ampio o lato, rilevabile anche d’ufficio, con particolare riguardo alle eccezioni di merito.
La norma di riferimento è l’art. 112, seconda parte, c.p.c., in virtù del quale il giudice «non può pronunciare d’ufficio su eccezioni che possono essere proposte soltanto dalle parti».
All’interprete si pone la seguente alternativa: o l’art. 112 c.p.c. è una norma di rinvio alle disposizioni che prevedono caso per caso l’indispensabile iniziativa della parte, senza che sia necessario o possibile la ricerca di un principio unitario; oppure la norma richiama un principio generale di distinzione che resta in essa inespresso e che dovrebbe desumersi da altra norma o dall’intero sistema.
La giurisprudenza di legittimità sembra aver accolto la prima opzione interpretativa, secondo cui l’art. 112 c.p.c. non stabilisce soltanto che sulle eccezioni riservate alla parte il giudice non può pronunciare d’ufficio, ma stabilisce un principio generale ed una deroga: la regola è che i fatti estintivi, modificativi e impeditivi sono rilevabili di ufficio, laddove assumono carattere eccezionale le ipotesi in cui il loro rilievo è subordinato all’iniziativa di parte.
In particolare, ricorre eccezione in senso stretto (in deroga al principio generale) nei casi previsti dalla legge e allorquando l’eccezione si coordina con una fattispecie che potrebbe dar luogo all’esercizio di un’azione costitutiva.
Resta aperta, tuttavia, la questione dell’individuazione delle eccezioni riservate alla parte e delle eccezioni rimesse al rilievo anche officioso del giudice, in tutti quei casi in cui la legge nulla prevede in proposito.
A tal fine, si è, pertanto, ipotizzato che l’art. 112 c.p.c. non costituisca una norma in bianco, ma rimandi ad un principio di distinzione che deve essere cercato in altre norme o nei principi generali dell’ordinamento.
A tal fine, è apparso opportuno prendere le mosse dal dato positivo ed esaminare i casi in cui la legge prevede eccezioni riservate alla parte, al fine di verificare se esista un elemento comune, poiché, ove vi fosse un’unica ratio, sarebbe lecito estenderla ad altre ipotesi.
In sede di analisi si è riscontrato che la negazione della rilevabilità di ufficio dei fatti impeditivi, estintivi, modificativi trova una corrispondenza in una peculiarità strutturale (non della fattispecie, ma) dell’effetto dell’eccezione, e cioè nella sua disponibilità per atto unilaterale del soggetto interessato e tale disponibilità è stata posta in relazione con la circostanza che il soggetto passivo del rapporto è portatore esclusivo dell’interesse tipico alla stabilità dell’effetto medesimo.
Può dirsi, quindi, che le eccezioni in senso stretto corrispondono ai casi in cui l’effetto impeditivo, estintivo, modificativo è unilateralmente disponibile da parte del debitore e non esclude la possibilità di una valida attuazione spontanea del debito. Ne consegue che, di fronte ad un fatto impeditivo, estintivo, modificativo occorre innanzitutto interrogarsi intorno al modo in cui la legge sostanziale conforma gli interessi in gioco. Solo se questi appaiono conformati in modo tale che l’effetto impeditivo, estintivo, modificativo sia unilateralmente disponibile da parte del soggetto interessato, può allora concludersi nel senso che l’ipotesi integra un’eccezione in senso stretto. Il limite al potere del giudice, quindi, non è che un riflesso di quella particolare disponibilità per atto unilaterale che caratterizza l’effetto sul piano sostanziale.
Tale impostazione è stata utilizzata per analizzare le ipotesi disciplinate dal legislatore, e si è trovata conferma, nel dato normativo, dell’ipotesi formulata.<br>The aim of the thesis is to investigate the objections and defenses that can be raised of the court’s own motion, and also the distinguishing criteria between the defenses for which is necessary the defendant’s motion and the defenses that are also raisable of the court’s own motion.
Particular attention has been paid to the defenses on the substance.
The reference point is the article 112 of the Italian civil procedure code, who states that the court cannot raise of its own motion the defenses for which is necessary the defendant’s motion.
The jurist can assume that the article 112 simply sends to the provisions that require, case by case, the defendant’s motion, without any possibility to find a specific criterion to identify when is necessary the defendant’s motion, and when it’ not. Or he can believe that the reference rule of the article 112 implies a general principle, able to distinguish one case to the others, according to other rules or to the general legal system.
The courts seem to accept the first option, saying that the article 112 lays down a general principle and, at the same time, an exception: the rule is that the defenses are normally raisable of the court’s own motion, while the defendant’s motion is the exception, that become necessary not only in the cases provided by law, but also when the defenses are linked to circumstances that give rise to certain kind of actions, called “azioni constitutive”.
However, the problem remains unsolved when there is no provision in law to that end.
For this purpose, we tried to analyze the issue of the clear distinction between defenses raisable of the court’s own motion and defenses that cannot be raised of the court’s own motion, under the assumption that the article 112 implies a general principle, according to the general legal system.
It was possible to observe that the court’s inability to raise the defenses of its own motion is related to a structural feature of the single effect on which it is based the defense that has to be raised on trial, and that is its unilateral disposal by the defendant – who can renounce it – who is the only person interested in the stability of that effect.
The boundaries on the court’s power to raise the defenses of its own motion is the reflection of that particular disposal that characterizes the effect, from the point of view of the substantive law.

Il seguente elaborato ha lo scopo di caratterizzare l'attrezzatura 'Hip Thrust Pure Strength', sviluppata da Technogym SPA per eseguire l’esercizio di hip thrust, spinta dell’anca, in modo innovativo e versatile. La caratterizzazione è stata effettuata tramite un’analisi quantitativa e statistica dei dati raccolti su nove soggetti arruolati nello studio. Nello specifico, un sistema optoelettronico è stato utilizzato per riscostruire il movimento dei segmenti corporei ed un set di elettrodi bipolari è stato utilizzato per rilevare l’attività elettromiografica di superficie dei principali muscoli coinvolti nell’esercizio. Ogni soggetto ha eseguito un totale di sei prove, le quali si differenziavano per Cadenza nel movimento eseguito e Posizione dei piedi adottata sull’attrezzatura. L' elaborato ha lo scopo di investigare come Cadenza e Posizione dei piedi modulino cinematica articolare, forza, potenza ed attività elettromiografica dei muscoli indagati.
I risultati riscontrati mostrano come livelli di forza e potenza più elevati possono essere generati eseguendo l’esercizio in cadenza libera, ovvero effettuando il movimento alla massima velocità e con il massimo sforzo muscolare. D’altra parte, la cadenza controllata, con un ritmo imposto da rispettare, sembrerebbe riflettersi in un maggiore lavoro muscolare. In aggiunta, i risultati evidenziano come una posizione dei piedi più estesa dalla regione del bacino massimizzi l’attività dei muscoli posteriori della coscia a scapito della muscolatura del quadricipite. Inoltre, una posizione dei piedi più avanzata comporta un maggiore affaticamento in tutti i muscoli indagati, il quale causerebbe una riduzione del ROM e del numero di ripetizioni effettuate durante la serie.
In conclusione, questo studio suggerisce come l’utilizzo di una cadenza esplosiva durante il movimento aumenterebbe lo sviluppo di forza e potenza; mentre, una cadenza controllata sembrerebbe essere efficace per lo sviluppo di ipertrofia muscolare.

The issue concerning the relationship between civil liability and social insurance against accidents at work and occupational diseases has been debated for over a century as an outstanding jurisprudence focus.
A heated debated, indeed, due to an underlying equivocation never solved, born in that constituent period of social and labour law represented by the liberal policies at the end of 19th century, looking for remedies against the dramatic burden of injuries at work during industrial revolutions without theoretical tools to understand the real meaning of the rising welfare provisions.
An underlying equivocation able to repeat itself affecting a large part of theoretical debate even under the new constitutional order, withstanding tenaciously over the ride of living law.
Moving from the analysis of that period, the A. investigates in depth the current conditions and limits of the INAIL regressive action, also considering the actual theorical structure of the traditional idea of the regressive actions as an original and autonomous right of INAIL.
This thesis, starting from the various positions of the past and present debate, overcomes the many inconsistencies of the traditional thesis, recognizing to the INAIL regressive action a specific constitutional value, and according to these assumptions, investigates both the actuality of the distinction between the special action of art. 11 T.U. and the subrogation action of art. 1916 c.c., and the actual relationship between civil liability and social insurance, in the context of new conceptions of personal injury.

L’automazione procedimentale non è certo una materia di indagine nuova per gli studiosi di diritto amministrativo: è affrontata in dottrina – e praticata dalle amministrazioni – a partire dagli anni ’80. Ciò che rende però questa ricerca attuale è il fatto che l’evoluzione delle tecnologie che consentono l’automazione (con l’avvento dell’Intelligenza Artificiale e di tecnologie di Machine Learning) hanno stravolto e esponenzialmente ampliato i settori dove questa può essere messa in pratica. Se fino a dieci o quindici anni fa il tipo di attività amministrativa in cui il funzionario poteva essere sostituito da un software era ridotta e routinaria (nonché necessariamente vincolata, dato il fatto che venivano utilizzati solo algoritmi di tipo deterministico), l’ingente numero di dati in possesso delle amministrazioni, il modo in cui possono essere conservati e soprattutto analizzati ha comportato il moltiplicarsi delle attività in cui vi si può far ricorso e i vantaggi che ne possono conseguire. Nel corso di questo lavoro si è cercato quindi di identificare la giusta collocazione sistematica delle decisioni amministrative automatizzate (e di tutti gli elementi che le costituiscono), i problemi che in generale il ricorso a esse può comportare, trattandole unitariamente, indipendentemente quindi dal livello di complessità della tecnologia utilizzata. La prima parte è dedicata alla concettualizzazione e all’inquadramento normativo e sistematico della materia. È necessario, in primo luogo, identificare e definire i tratti essenziali della digitalizzazione della Pubblica Amministrazione. In un secondo momento ci si concentra invece sulla digitalizzazione del procedimento amministrativo, luogo di indagine privilegiato perché prodromico all’adozione della decisione. Si analizza quindi dove essa possa intervenire nel corso del procedimento, per arrivare poi al cuore del lavoro, ossia l’automazione decisionale. devono non solo essere individuate le fonti normative che consentono (e in alcuni casi limitano) il ricorso alle decisioni automatizzate da parte dell’amministrazione, ma si deve anche condurre una ulteriore indagine sulla natura giuridica dei strumenti che consentono l’automazione, perché ne derivano importanti conseguenze sul piano della legittimità degli atti e della responsabilità dei funzionari. La seconda parte, invece, si concentra sui principali problemi giuridici posti dall’introduzione di decisioni amministrative pubbliche automatizzate. Una prima ipotesi è che l’automazione non sia compatibile con i principi e le norme europee in materia di amministrazione pubblica, nonché con le fonti nazionali sul procedimento: secondo questa ricostruzione – poi esclusa – l’automazione decisionale non sarebbe ammissibile. Esclusa questa prima ipotesi, ci si concentra su come conciliare principi e istituti procedimentali tradizionali (l’obbligo di motivazione, la partecipazione) con l’automazione decisionale. La parte finale del lavoro indaga il complesso rapporto fra trasparenza dell’attività amministrativa e intellegibilità della decisione automatizzata, analizzando istituti classici come il diritto d’accesso – e il modo in cui vengono interpretati nei casi di specie dalla giurisprudenza – e nuovi strumenti di tutela previsti ad hoc dal Legislatore. La ricerca è stata condotta portando avanti una comparazione fra il sistema italiano e quello francese. Questo per due ordini di ragioni: il primo luogo perché l’ambito di indagine, vale a dire le decisioni amministrative automatizzate e il loro regime giuridico, è un piuttosto inesplorato; l’intervento del Legislatore e le pronunce della giurisprudenza in materia hanno appena cominciato ad addentrarvisi. Per questo limitarsi all’esperienza italiana sarebbe parso probabilmente non sufficiente per una completa ricognizione. In più, come si vedrà nel corso del lavoro, l’intervento dell’Unione Europea in materia di digitalizzazione della Pubblica Amministrazione e di decisioni algoritmiche è piuttosto esteso: in quest’ottica il confronto sulle conseguenze che le politiche europee hanno avuto in due diversi Stati Membri appare piuttosto significativo. La scelta della Francia non è però casuale: in primo luogo il Legislatore francese si è mostrato molto recettivo a fronte delle necessità di intervento richiesto dai nuovi strumenti informatici – e lo studio della normativa di riferimento si è rivelato di conseguenza molto importante – ma inoltre le molteplici affinità fra i due sistemi giuridici hanno reso l’analisi della tenuta di istituti classici del diritto amministrativo come l’obbligo di motivazione, o il diritto di accesso (a fronte dell’automazione) assai più agile.<br>Procedural automation is certainly not a new topic of investigation for scholars working on administrative law. It has been studied by doctrine, and practiced by administrations, since the 1980s. Within this long-standing debate, the relevance of the present dissertation lies in the fact that the exponential development of technologies for automation (with the advent of Artificial Intelligence) has substantially expanded the areas where automated decision-making can be successfully implemented. Until ten or fifteen years ago the type of administrative activities in which officials could be replaced by a software were limited (and necessarily bound, considering that only deterministic algorithms were used). Nowadays, the large number of data in possession of the administrations, as well as the way in which they can be stored and above all analyzed, has led to the multiplication of the activities in which they can be used and the advantages that can be derived from them. In this work, an attempt is made to identify the correct systematic collocation of automated administrative decisions and of all the elements that constitute them, and to highlight the problems that recourse to such decisions can entail. In doing so, a unified treatment of these decisions is advocated, hence independently from the level of complexity of the technology used. The first part of the dissertation is dedicated to conceptualizing and to elaborating the normative and systematic framework of the matter. In the first place, it is necessary to identify and define the essential features of the digitalization of the Public Administration. The focus then shifts to the digitalization of the administrative procedure, which is a privileged place of investigation. In this respect, two are the main points of relevance. Firstly, one should identify those regulatory sources that allow (and in some cases limit) the recourse to automated decisions by the administration. Secondly, further investigation must also be conducted into the legal nature of the tools that allow automation, because this has important consequences in terms of the legitimacy of acts and the liability of officials. The second part of the dissertation focuses on the main legal problems posed by the introduction of automated public administrative decisions. A first hypothesis is that automation is not compatible with European principles and rules on public administration and with national sources on the administrative procedure. As will be extensively discussed, this preliminary hypothesis proves unwarranted. Instead, it is proposed that a more viable solution is to reconcile traditional procedural principles and legal tools (duty to give state reasons, participation) with decision-making automation. The final part of the work investigates the complex relationship between the transparency of the administrative activity and the intelligibility of automated decision-making. Here, a new analysis is proposed of both classical legal tools such as the right of access, and the way in which they are interpreted in those cases by case law, and of new instruments of protection provided ad hoc by the Legislator. The research takes a comparative view between the Italian and French systems. The comparative perspective is required by the scope of the investigation. The automated administrative decisions and their legal status remains rather unexplored. The intervention of the Legislator and the pronouncements of the jurisprudence on the subject have just begun to acknowledge the problem. For this reason, limiting oneself to the Italian experience would probably not have been sufficient for a complete understanding of the issue. In addition, as will be seen in the course of the work, the intervention of the European Union in the field of the digitalization of the Public Administration and algorithmic decisions is quite pervasive. Here, the comparison of the role that the EU had in two different Member States seems rather significant. The choice of France, however, is not accidental. First of all, the French Legislator has proved very sensitive to the need for intervention with regards to the new IT tools. It follows, that the study of new legislative instruments developed in this context is of paramount importance. In addition, the multiple affinities between the Italian and the French legal systems have eased the comparison of the performance of classical legal tools of administrative law, such as participation and the right of access (in the face of automation).

Tesis para optar al grado de Magíster en Marketing<br>La Industria de Telecomunicaciones en Chile, se caracteriza por los altos costos de inversión que se requieren para entrar, considerando las políticas regulatorias del país que permite ser un mercado altamente competitivo, con cuatro operadores relevantes que mantienen altos los niveles de competitividad.
Los niveles de actividad económica se caracterizan por ser sanos y estables dentro de la región, lo que se apoya en ciertos pilares fundamentales como lo es la solidez del sistema financiero.
La Industria de las Telecomunicaciones es un sector sujeto a rápidos e importantes avances tecnológicos y a la introducción de nuevos productos y servicios. El mercado de Banda Ancha, está representado por dos grandes participantes, cuyas tecnologías de acceso Banda Ancha son, ADSL para el caso de Telefónica Chile y Cable-Modem para VTR.
El mercado de Banda Ancha, se caracteriza por disponer de siete participantes: Telefónica Chile, VTR, ENTEL, Manquehue-GTD, Telmex, Telsur, y CMET, los cuales cuentan con ofertas muy agresivas en precios y concentradas en paquetizaciones (Internet, telefonía y Televisión de pago). Los actores con mayor relevancia dentro de la categoría Banda Ancha en hogares son: Telefónica con una participación cercana al 50%, VTR con alrededor de un 40% y Telefónica del sur con un 5%. Por otro lado, pese a la cantidad de participantes, la cobertura de los servicios juega un rol muy importante, especialmente en regiones.
El uso que le entregan los consumidores a Internet es muy variado y pasa desde una mera fuente de información hasta un medio de unión de “jugadores virtuales”, por lo que no existe un sustituto completo del producto, sino que productos que remplazan una parte de sus funcionalidades.
Dentro de los factores de éxito de la empresa Telefónica, se puede nombrar el excelente nivel de cobertura geográfica que permite tener una cantidad de clientes potenciales mayor que otras empresas, un importante mix de productos y servicios que permiten desarrollar interesantes ofertas paquetizadas y el respaldo de un grupo transnacional, líder mundial en la Industria de las Telecomunicaciones.
Telefónica no posee una marca bien posicionada dentro de los consumidores, especialmente en los grupos socioeconómicos ABC1, debido principalmente a los procesos de atención de cara al cliente, sin embargo se están realizando constantes esfuerzos en mejorarlos para, al menos, igualar los niveles de la competencia.
El desafío de la empresa es saber capturar oportunamente, los grupos de menores ingresos, donde geográficamente la competencia no ha logrado entrar y potenciar las paquetizaciones con nuevos productos orientados a sus necesidades. Sin embargo, se debe considerar la agresividad comercial de VTR, el potencial de Telmex como nuevo entrante a la categoría y los peligros de una telefonía móvil que se acerca rápidamente a tener un servicio de Internet estable y veloz.

Ce mémoire traite de l'acoustique de la clarinette et du rôle de l'anche, résumant des travaux menés entre 2001 et 2018 sur divers sujets :I) Étude de modèles analytiques élémentaire focalisée sur : 1) le rôle des pertes. 2) les cartes itérées, mettant en évidence divers régimes de fonctionnement, utiles aussi pour la pédagogie instrumentale. II) Étude de caractérisation des anches : 1) Étude dynamique des résonances de l'anche réalisée par holographie. Elle conduit à un modèle de matériau viscoélastique expliquant certaines différences observées dans les fréquences des 15 premiers modes de l'anche. 2) Étude statique des caractéristiques mécaniques et aérauliques de l'excitateur (anche+bec+lèvre). La méthode mesure précisément la quantité d'air entrant dans l'instrument en fonction de la pression de lèvre et d'air. III) Synthèse sonore par modèle physique en temps réel : 1) Modélisation mécanique et aéraulique de l'anche, d'après mesure. Le modèle de ressort raidissant non linéaire proposé autorise une simulation dynamique efficace. 2) Estimation modale de l'impédance d'entrée (mesurée) des instruments à vent. On montre les techniques de conception de filtres numériques précis et passifs à toute fréquence. 3) Modélisation et simulation instruments à vent au moyen de guide-ondes, par estimation modale, implémentée dans un logiciel en C++. IV) Une étude de jouabilité d'un panel de 40 anches par analyse canonique des corrélations révèle des liens statistiquement solides entre mesures physiques, évaluations subjectives et synthèse sonore. Elle autorise une caractérisation des anches pouvant être réalisé par le fabricant, selon au moins 4 facteurs indépendants<br>This thesis deals with the acoustics of the clarinet and the role of the reed, summarizing studies carried out between 2001 and 2018 on various topics : I) Study of elementary analytical models, focused on 1) role of losses. 2) iterated maps, highlighting various operating regimes, which are also useful for the instrumental pedagogy. II) Reed characterization study : 1) Dynamic study of the reed resonances, by holography. It leads to a model of viscoelastic material explaining some differences observed in the frequencies of the first 15 modes of the reed. 2) Static study of the mechanical and aeraulic characteristics of the exciter (reed + mouthpiece + lip). The method accurately measures the airflow entering the instrument as a function of lip and air pressure. III) Sound synthesis by physical model in real time : 1) Mechanical and aeraulic modeling of the reed, according to measurements. The proposed nonlinear stiffening spring model allows for an efficient dynamic simulation. 2) Modal estimation of the (measured) input impedance of wind instruments. Design techniques for accurate digital filters, passive at any frequency, are described. 3) Modal estimation and simulation of wind instruments by waveguides, implemented in C ++ software. IV) A playability study of a panel of 40 reeds by canonical correlation analysis reveals statistically strong links between physical measurements, subjective evaluations and sound synthesis. It allows a characterization of the reeds that can be made by the manufacturer, according to at least 4 independent factors

Il lavoro è volto all’approfondimento, anche in chiave comparatistica, della vigente normativa riguardante la tutela e la valorizzazione dei beni archeologici. Nell’ambito della disciplina predisposta nell’ordinamento italiano si sono prese le mosse dal regime delle scoperte e dei ritrovamenti, per passare successivamente all’approfondimento della tutela approntata nella legislazione nazionale anche con riferimento alle limitazioni alla libera disponibilità e circolazione. Una particolare attenzione è stata dedicata alla tutela del territorio in cui i beni archeologici sono inseriti e quindi alla tutela indiretta, ai vincoli ope legis e alla pianificazione paesaggistica, mentre una specifica trattazione ha riguardato il regime dell’archeologia preventiva e la valorizzazione e fruizione di aree e parchi archeologici nel reciproco interfacciarsi delle legislazioni regionali e delle linee guida emanate con il d.m. MiBAC 18 aprile 2012. Un’indagine articolata ha avuto per oggetto la tutela del patrimonio archeologico subacqueo e in particolare la Convenzione dell’UNESCO adottata a Parigi nel 2001, nonché la tutela sovranazionale dei beni culturali, con riferimento alla disciplina dell’Unione europea e a quella della Convenzione europea per la protezione del patrimonio archeologico del 16 gennaio 1992 e della Convenzione UNIDROIT del 24 giugno 1995 sui beni culturali rubati o esportati illegalmente. Hanno infine fatto seguito due specifiche indagini sulla tutela del patrimonio archeologico in Spagna e in Francia. Quanto alla prima si è esaminato l’attuale quadro costituzionale in cui si inserisce la tutela del patrimonio culturale con particolare attenzione alle disposizioni della Ley 16/1985 del 25 giugno 1985 e alla legislazione delle Comunidades autónomas. Per quanto riguarda la seconda una particolare attenzione è stata dedicata alla Legge 27 settembre 1941 che ha introdotto in Francia la prima disciplina organica relativa agli scavi e ai ritrovamenti archeologici. Nel quadro normativo vigente un’analisi particolareggiata è stata dedicata al Code du Patrimoine, il cui quinto libro è interamente dedicato all’archeologia.<br>This work aims to examine the legislation in force on the protection and valorisation of archaeological heritage, also from a comparative perspective. Within in the framework of the Italian legal system, were considered the regulations concerning finds and discoveries and the limitations of free availability and circulation, in order to analyse in depth the protection created in the national legislation. Particular attention was paid to the protection of territory into which archaeological goods are transferred and therefore to the indirect protection, as well as the ope legis constraints and landscape planning. Furthermore, this study investigated the regime of preventative archaeology and the valorisation and usage of archaeological areas and parks in the reciprocal interfacing of regional legislation and the guidelines issued by the Ministerial Decree of 18 April 2012. A comprehensive investigation was undertaken on the protection of underwater archaeological heritage and in particular the UNESCO Convention adopted in Paris in 2001, as well as the supranational protection of cultural assets, with reference to the regulations of the European Union, the European Convention for the Protection of Archaeological Heritage of 16 January 1992 and the UNIDROIT Convention of 24 June 1995 on stolen or illegally exported cultural assets. This investigation was followed by two case studies on the protection of archaeological heritage in Spain and France. Regarding the former, the current constitutional framework was examined, with reference to the protection of cultural heritage provided by Ley 16/1985 of 25 June 1985 and the legislation of the Comunidades autónomas. With respect to the latter, particular attention was dedicated to the Law of 27 September 1941 which introduced in France the first organic regulation on excavations and archaeological finds. An extensive analysis was dedicated to the contemporary legal provisions afforded by the Code du Patrimoine, whose fifth book entirely provides for archaeology.

La presente investigación tiene como objetivo establecer la correlación entre el ancho transpalatino (Medida dental) y los anchos maxilar y facial (Medidas esqueléticas), en niños de 8 a 10 años de edad,de raza mestiza, de ambos sexos, clínicamente simétricos en vista frontal y que no fueron sometidos a tratamiento quirúrgico u ortodóncico previo. Todos los padres estuvieron de acuerdo en la participación de sus niños en la investigación, manifestando esta posición por medio de una consentimiento escrito.
El ancho transpalatino fue determinado clínicamente y los anchos maxilar y facial fueros obtenidos a partir de 55 telerradiografías en norma frontal , las cuales fueros estudiadas mediante el Análisis Cefalométrico Frontal de Ricketts.
Se determinó que existe una correlación altamente significativa al 99% entre al ancho transpalatino y el ancho maxilar ; Así mismo, entre el ancho Transpalatino y el ancho Facial. También se determinó que los niños del sexo masculino presentan medidas superiores que los de sexo femenino; Sin embargo, la diferencia encontrada entre ambos grupos no fue significativa.<br>The objective of this research is to set up a correlation between transpalatal width (Dental measure) and Maxillar and Facial Widths ( Skeletal measures) , in children from 8 to 10 years of both sexes , Mestizo race ,clinically symmetrical in frontal view and without previous orthodontic or surgical treatments. Parents agreed on the participation of their children in the investigation, manifesting this position by a written consent.
Transpalatal width was clinically determined , Maxillar and Facial widths were gotten from 55 Posteroanterior Cephalometric Radiographies.
It was determined the existence of a highly significant correlation between the Transpalatal width and the Maxillar width. It was also determined the existence of a highly significant correlation between the Transpalatal width and the facial width . Ingeniero Civil Eléctrico<br>El objetivo general de este trabajo es la simulación de un nodo de acceso DSLAM para realizar proyecciones de tráfico para diferentes aplicaciones. Esta problemática surge por parte de la empresa Movistar Chile S.A. que tiene la necesidad de realizar estudios para evaluar sus sistemas de banda ancha fija y como se enfrentan éstos a diversos servicios como lo son IPTV y VoIP. Por esto se requiere de una herramienta capaz de generar tráfico similar al que hay en Internet y con la flexibilidad suficiente para representar estos sistemas y servicios, además de requerimientos como la cuantificación de los clientes que superen un retardo mínimo o el poder generar tráfico temporalmente distribuido siguiendo alguna distribución estadística. También se agregan características como configuración de retardos, tamaños de las colas en la red, división de clientes en grupos para asignarles factores de multiplicación de tráfico y/o velocidad, etc., de forma tal de tener más parámetros posibles de configurar en la red. Por otro lado para hacer más sencilla la utilización del código resultante del trabajo se genera una interfaz gráfica que permite configurar la simulación.
El proceso de desarrollo consiste en modelar la red y cada parte que la integra, definiendo las nuevas funcionalidades, los parámetros configurables y mediciones que se esperan simular. Luego se pasa a la etapa de implementación de los modelos en el simulador OMNeT++, el cual utiliza el lenguaje C++ y el lenguaje NED para la descripción de las redes. Para esta etapa se utilizan las librerías Inet y ReaSE donde la primera contiene los protocolos base utilizados en Internet y la segunda contiene utilidades para el manejo de los flujos de tráfico. Los modelos de red se rehacen para poder satisfacer las necesidades requeridas por Movistar o por parte del código cuando necesita la creación de nuevos módulos de red. Simultáneamente se trabaja en la construcción de la interfaz gráfica la cual debe ser compatible con todos los cambios de la red y con todos los parámetros configurables pudiendo generar los archivos necesarios para ejecutar las simulaciones.
Finalmente se logra un modelo estable de la red, que permite configurar todas las funcionalidades y parámetros que se plantearon como requisitos del simulador y además se crea una interfaz gráfica que permite crear nuevas simulaciones de manera sencilla y rápida, además de una máquina virtual con todos los programas necesarios ya instalados. Los datos proyectados de tráfico son útiles para generar valiosos análisis como se observa en la sección de resultados y son coherentes con los tráficos reales de verificación.

The availability of adequate and reliable water supplies has always been a critical concern in central Arizona since prehistoric times. The early European settlers in 1868 initially utilized the ancient Hohokam Indian canal system which drew water from the Salt River. However, the river fluctuated with periods of drought and periods of high flows which destroyed the diversion structures. The settlers proposed a dam to store water and to regulate flows. In 1903, the Salt River Water Users Association was formed and an agreement was reached with the U.S. Government for the construction of a dam on the Salt River at its junction with Tonto Creek. The Salt River drains more than 4,306 square miles (mi2) from the White Mountains of eastern Arizona to the confluence with Tonto Creek. Tonto Creek drains a 1,000-mi2 watershed above the confluence. The agreement was authorized under the Reclamation Act of 1902. The Theodore Roosevelt Dam was started in 1905, completed in 1911, and dedicated in 1911 (Salt River Project 2002). The dam has the capacity to store 2.9 million acre-feet (af) of water. However, between 1909 and 1925, 101,000 af of sediment were accumulated behind Roosevelt Dam (Rich 1961). Much of it came from erosion on the granitic soils from the chaparral lands above the reservoir, and much of the erosion was blamed on overgrazing by domestic livestock. Water users were concerned that accelerated sedimentation would eventually compromise the capacity of the dam to hold sufficient water for downstream demands. The Tonto National Forest was originally created to manage the watershed above Roosevelt Dam and to prevent siltation. The Summit Plots, located between Globe, Arizona, and Lake Roosevelt were established in 1925 by the U.S. Department of Agriculture to study the effects of vegetation recovery, mechanical stabilization, and plant cover changes on stormflows and sediment yields from the lower chaparral zone (Rich 1961). The area initially was part of the Crook National Forest which was later added to the Tonto National Forest. The Summit Watersheds consisted of nine small watersheds ranging in size from 0.37 to 1.23 acres (ac). Elevations are between 3,636 and 3,905 feet (ft). The treatments included: exclusion of livestock and seeding grasses, winter grazing, hardware cloth check dams, grubbing brush, sloping gullies and grass seeding. Protection from grazing did not pro
duce changes in runoff or sedimentation. Treatments that reduced surface runoff also reduced erosion. Hardware cloth check dams reduce total erosion, and mulch plus grass treatments checked erosion and sediment movement. Runoff was reduced by the combined treatments (Rich 1961). The Summit Watersheds were integrated into the Parker Creek Erosion-Streamflow Station in 1932.

El servicio de banda ancha móvil es uno de los de más alto crecimiento tanto en
telefonía móvil como en telecomunicaciones en general. Acceso inalámbrico móvil a
Internet con alta disponibilidad y presente en todas las zonas urbanas e incluso con una
amplia cobertura rural, sumado a su bajo precio, ha sido la clave para este crecimiento.
Esto ha significado que los operadores móviles han consolidado su ingreso al
mundo de los ISP, pero con los exigentes usuarios de telefonía móvil y el competitivo
mercado es necesario entregar un servicio de alta calidad.
De este modo, se introduce el concepto de calidad de experiencia (QoE, Quality
of Experience), que muestra la percepción extremo a extremo que tiene el usuario del
servicio, y surge como necesidad establecer los parámetros de medición apropiados
(KQI, Key Quality Indicator) que sirven de puntos de control para que ésta se cumpla y
además se puedan incorporar tareas que mejoren la experiencia de servicio de los
abonados.
Se estudia la tecnología y arquitectura del operador móvil, su evolución y el
comportamiento de los abonados, lo que permite modelar el servicio para luego
introducir puntos de control y mejoras en el sistema, con el objetivo de entregar una
calidad de experiencia satisfactoria y altamente diferenciadora.
Adicionalmente se analiza el comportamiento de los abonados, determinando el
tipo de contenido que éstos prefieren, los protocolos que utilizan y cómo éstos afectan a
las redes. Se describe la tecnología utilizada por los operadores móviles para brindar el
servicio e indican los puntos críticos para el diseño y planificación de la red.
Finalmente, se define un indicador de control para la calidad de experiencia del
servicio y se estudian diversas tareas en la red que determinan niveles de mejora del
servicio.
Este trabajo explora las diferentes alternativas que tienen los operadores para
incorporar y mejorar la calidad de experiencia que ofrecen a sus usuarios, entregando
una metodología de modelamiento que sirve de punto de partida para esta tarea.
Del mismo modo, es posible a partir de este trabajo profundizar en los
mecanismos y facilidades que puede proporcionar una tecnología específica, como es
el caso específico de LTE o LTE advance con mira a ofrecer servicios de nuevas
generaciones.

Art History<br>Ph.D.<br>This dissertation reframes the Danish artist Anna Ancher (1859-1935) by expanding the context in which the artist has been considered, to position her as a Symbolist, modernist and independent artist. A revered and familiar artist in Denmark, most scholars discuss her paintings in association with the development of the art colony in Skagen, an important site of Denmark's Modern Breakthrough in the 1880s. The represented image of Ancher in paintings by male colonists during this period indicated her centrality within the group, depicted her as a fashionable bourgeois wife and respectable mother, but simultaneously neglected to reference the development of her professional practice. By 1889, Ancher had sold major paintings and gained national and international recognition. Michael Ancher's portrait of his wife in reform dress in Coming Home from Market (1902) signifies her freedom from conventional gender roles. Despite her affiliation with the Skagen colony, Ancher matured as a painter during the 1890s after its heyday. At this time Danish Symbolism and Vitalism came to eclipse the Naturalist orientation of the prior decade. The painter's study in Paris in 1889 and her contacts in cosmopolitan Copenhagen forged an avant-garde network that in many ways referenced, but also resisted, movements from the urban French center. An aesthetic that draws from the ostensibly contradictory and divergent ideas of Charles Baudelaire, Hans Christian Andersen and Friedrich Nietzsche can be found in Ancher's painting, positioning her alongside other Danish Symbolists. Ancher was also a native of the Jutland peninsula, which experienced the growth of pietist movements and major shifts impacting agricultural labor. Ancher's paintings of religion and harvest at the beginning of the twentieth century challenged contemporary French primitivist images of Breton peasants, especially those of Paul Gauguin. After 1900, Ancher's increasingly abstract paintings of unoccupied interiors reflect the complex modernist shift in valuation of the dwelling and a new emphasis on minimal decoration and strong planar surfaces in the home as conducive to physical and psychological health. In her paintings of her own studio, Ancher challenged normative gendered divisions in the organization of the home and asserted her identity as an autonomous artist.<br>Temple University--Theses
