The legal situation of migrant workers in the Federal Republic of Germany was basically regulated by the Aliens Act of 1965, which was replaced by a new Act in 1990. The original Aliens Act gave considerable amount of discretionary power to the administration. The High Court practice, by using the basic principles of the German Constitution regarding basic rights, as well as the rules of some international agreements, recognized the stable conditions of those migrant workers who had been staying in the country for a long time. As a result their legal situation came closer to the international level. The new Act safeguards these established rights to some extent, but brings restrictive provisions for the newcomers, emphasizing that Germany is not an immigration country. As a result of rising hatred against foreign workers within the country, there is, at the moment, a possibility that existing rights will be limited through a narrow and restrictive way of interpretation of the laws.

The article analyses the peculiarities of social adaptation of Ukrainian prisoners of war in Germany, particularly its legal, political and social aspects. The problem of repatriation of POWs was discussed at the international conferences and was regulated by various armistices and treaties (the Armistice of Compiègne, the Treaty of Brest-Litovsk, the Treaty of Versailles). After German surrender in the war and the demise of its empire, POWs of all nationalities acquired the status of interned persons, which notably improved their condition. At the same time, former POWs faced difficult social and economic life conditions in Germany, particularly food shortages. Besides, late 1918 and early 1919 saw repatriation commissions of various states starting their activity in Germany. They included the Ukrainian repatriation commission, which helped return several tens of thousands of people to Ukraine. Therefore, within the dichotomy faced by Ukrainian soldiers in Germany (repatriation against a decision to stay in Germany as political emigrants with subsequent adaptation to life conditions in this country), most long-term captives decided to return. In the wake of dramatic geopolitical changes in Europe and the world, repatriation to the homeland was regarded by most as the best option. On the other hand, some Ukrainians decided to stay in Germany for a longer period. They became witnesses to considerable changes in German political, economic and civil life. The Germans were suspicious of former POWs staying in the country, regarding them as competitors on the job market and as “aliens” in general. However, despite all obstacles some “brave men” managed to successfully adapt in Germany and even create families, becoming a part of their new country’s society.

In the aftermath of the November pogrom of 1938, thirty thousand Jewish men were arrested and sent to concentration camps. After being released, around one hundred rabbis were able to leave Germany for Great Britain. But escaping Germany was not the end of their personal hardship. Once respected community leaders, rabbis arrived destitute and depended on charitable organisations for their livelihoods. Some would be classified as enemy aliens and faced with internment once again. The refugee rabbis would not to be discouraged, however, and they began, at first just a small circle, to reclaim their place in Jewish life once again. In a new country, a new context, and in the midst of around eighty thousand refugees, the rabbis were able to reignite their work and embarked on a great number of initiatives and projects. They were able to place the German Jewish heritage into Anglo-Jewry, where it continues to live on today.

В зависимости от участия в международном социалистическом движении, места внутри Социал-демократической партии Германии, положения в Заграничной Делегации берлинских меньшевиков можно поделить на интернационалистов, «изоляционистов» и «интеграционистов». Политику Заграничной Делегации в 1920-е гг. определяли интернационалисты Ю.О. Мартов, Ф.И. Дан и Р.А. Абрамович. Полноценная адаптация политэмигрантов в Германии была бы невозможна без содействия меньшевиков-«интеграционистов», имевших хорошие связи в немецкой социал-демократии. Один из старых лидеров меньшевиков А.Н. Потресов находился в берлинской эмиграции в изоляции. Он контактировал с «интеграционистами», но из-за политических разногласий не взаимодействовал с Заграничной Делегацией. The article is devoted to a history of Menshevism in German exile in the 1920s. The author studies three strategies of political adaptation in Weimar Republic: Internationalism, Integration, and Isolation. A chosen strategy depended on the participation in the international socialist movement, a position either within the Social Democratic Party of Germany, or the position adopted in the Foreign Delegation, a governing body of Mensheviks’ party abroad. The Foreign Delegation Policy in the 1920s was led by the internationalists Martov, Dan, and Abramovich. The adaptation of Mensheviks-internationalists in Germany would not have been possible without the assistance of “integrationists” who worked as the specialists and experts in German Social Democracy Party. One of the leaders of the Mensheviks A.N. Potresov found himself in isolation in German exile. He maintained contacts with some "integrationists", but because of acute political differences with Dan, Potresov stayed away from the Foreign Delegation. This division came to an end after the collapse of the Weimar Republic in 1933, when Mensheviks moved to the other states.

DIALECTICS “WE”–“ALIENS” IN RIGHT-WING POLITICAL PHILOSOPHY 1789–1945. PART IIThe aim of the author of this text is to polemicize with the stereotype according to which nationalism is a synonym of the “extreme right.” For this purpose the method of historical exemplification was used. In Part II we discuss examples of nationalisms in various European states between the years 1890 and 1945: France, Germany, Spain, Portugal and Italy. This is the epoch when nationalism denies its initial close relationship with the political and revolutionary left. Now it is in close relations with the right. During the Boulanger and Dreyfus affaires in France, the nationalists are on the political right. Their ideology is not only right-wing but also anti-Semitic. Sometimes openly racist Maurice Barrès. In general, however, French and Italian nationalists preach “state nationalism,” similar to the classic doctrine of raison d’état. In Spain and Portugal the right is strictly Catholic. This is the imperial right. We have here the dream of restoration of the Spanish Siglo de Oro. This project is antithetic to nationalism because it is universalist and supranational. It is different in Germany, where at the turn of the 19th and 20th centuries the whole right is lit up by the vision of conquests, German empire, struggle of races. First, the Protestant, then also the German Catholic right is chauvinistic, racist and anti-Semitic. The article ends with reflections upon the relations between political right and the idea of nationalism.

The essay enquires into the nature of the ‘colonial laws’ that colonial powers (Spain, France, Britain, Germany, Italy) enacted to govern the populations of their overseas territories. The focus is on the hybrid character of that law between (public) international law and domestic (administrative) law. Hybridity served to protect colonial rule from being critiqued by international criteria while enabling treating colonial populations by standards different from those applied to citizens. The essay asks the question to what extent today’s new laws in Europe that seek to deal with aliens might seek a similar hybridity.

The article is devoted to one of the greatest German poets of the Baroque era, Martin Opitz. Although during his lifetime he became one of the most honoured writers, poetry seldom brought him financial stability and independence, which he achieved thanks to his diplomatic service under various influential rulers of the Holy Roman Empire. M. Opitz never had a high diplomatic rank, usually holding the positions of an agent or a secretary, which, however, did not prevent him from often being in the thick of political events. Opitz's life spanned the years of the Thirty Years' War, which turned his life upside down. The article focuses on the problem of the influence of M. Opitz's diplomatic activity on the formation of his patriotic views and the development of the German national idea in his poetic works, thanks to which he became widely known. During his diplomatic trips, Opitz, by virtue of his pronounced artistic emotional perception of the events of the Thirty Years' War, tragic for the German lands, divided the world around him into “friends”, “Germans”, and “aliens”, i.e. enemies who sought, as the poet argued, “to enslave Germany.” The article evaluates the role of diplomatic activity in the life of Opitz in the formation of the specific phenomenon of German nationalism. The article is based on rare, only partially introduced into academic circulation historiography, where a special place is occupied by biographical materials, namely the private correspondence of M. Opitz, his first biography, compiled by a close friend Ch. Koeler, and the funeral sermon by the poet Jh. Rist.

This thesis aims to analyse the normative rationales behind non-citizens' legal standing in two liberal nation-states. The thesis takes the cosmopolitan and communitarian rationales as its theoretical starting point. Specific attention is given to the possibility of coherently combining the cosmopolitan and the communitarian rationales. The thesis analyses the actual legal standing of non-citizens in the U.S. and Germany and so links the political theoretical discourse to alienage jurisprudence. The conclusions drawn are that both the cosmopolitan and the communitarian rationales underlie non-citizens' legal standing. The treatment of noncitizens is fairly normatively coherent and in line with a weak cosmopolitan perspective. The thesis, however, identifies limited but important normative contradictions in the treatment of non-citizens and outlines, on a practical level, what is required to remedy this situation.

The thesis examines the policy and practice of literary translation into German during the Nazi regime. It is shown that translation survived, albeit in a constrained form, throughout the period and that heavy official intervention was itself grounded in contradictory attitudes to translation. A consideration of the state regulation and reception of translation demonstrates that translated literature was regarded with suspicion as a potentially harmful invasion of the foreign. Terms used - such as the 'alien within' and the danger of miscegenation - clearly participate in the surrounding discourse of anti-Semitism. However, a database of translations published in the period shows that while such views certainly shaped the selection of genre and source language, there was no simple suppression and numbers remained stable or even rose until 1940. This is accounted for on the one hand by the regime's promotion of certain translations, selected on criteria that draw on notions of literature's cultural specificity as an expression of the Volk soul. An approved translation is compared with its source, showing that consonance with this literary ideology has been enhanced by the detail of translation choices; official reviews further position the text within the boundaries of acceptability. On the other hand, the single largest translated genre of the pre-war period, the Anglo-American detective novel, was not promoted but reviled by the literary bureaucracy. An examination of the source texts and translations of ten detective novels demonstrates that the ideologically marginalised genre adapted itself to the receiving culture by heightening the rule-boundness, strict gender roles and portrayals of authority present in the source texts. The glamorisation of foreign settings remains unaffected, suggesting the persistence of a pre-1933 fascination with Anglo-American culture. The thesis concludes that while the foreignness of foreign literature was fiercely attacked by literary policymakers, it was also promoted in certain, politically acceptable forms and in other cases persisted on its own commercial trajectory despite official disapproval. The study thus contributes to the understanding both of an under-researched area of literary policy in Nazi Germany and of the ideological, institutional and commercial contexts of translation.

This study examines the dynamics of German Turks' practices and life-styles and their relationship with Turkey in the context of the possibilities brought into their lives by their particular type of dislocation. Turkish migrants' "culture" and life-styles are explored in the context of their complex social space, rather than within a framework encapsulated in a reified ethnicity and/or immutable "Turkish culture".
Chapter I discusses concepts of ethnicity, culture and identity and presents a critical account of the literature on German Turks in this respect. Chapter II focuses on the ambiguities and insecurities of German Turks' legal, political and social status in both Turkey and Germany, and traces the consequences of these conditions on Turkish migrants' complex sense of place. The discussion of German Turks' "myths of return" in the context of their liminality and the impact these have on their self-image and their visions about their lives constitute the focus of chapters III and IV respectively. Chapter V explores the changing nature of Turkish migrants' interpersonal relationships. Chapter VI concentrates on the anomalies of the social space occupied by German Turks in German society and discusses their life-styles, practices and emergent cultural forms in the context of social mobility.

During the last several decades, many people, fleeing from disasters or political threats, have applied for asylum in the European countries. Council Directive 2003/9/EC, laying down minimum standards for the reception of asylum-seekers, as well as several other directives, have been developed in the EU in order to ensure fair treatment of the asylum-seekers in all the European countries. However, there are huge differences in the national asylum laws of countries and consequently, the way they treat the asylum-seekers. In this research, the national asylum laws of Germany and the Netherlands are studied and compared, showing that though following the Council Directive, fair or equal treatment of asylum-seekers cannot be guaranteed. In the Netherlands asylum-seekers are granted with a great extent of benefits while in Germany, they are greatly discriminated against. Based on the Social Determinants of Health Model, developed by Dahlgren and Whitehead in 1991, the hypothesis is that the asylum seekers in the Netherlands enjoy better health status than the ones in Germany, because based on the Dutch asylum laws, they have better living and working conditions. In order to confirm or negate this hypothesis, a meta-study of available literature on the health status of asylum-seekers has been done. However, the hypothesis could not be confirmed/ negated due to extreme lack of availability of data in this area. By discussing the relationship between life conditions and health of individuals, reviewing current legal instruments regulating asylum in the EU and analyzing the available data on the health status of asylum-seekers, this paper draws the attention to the importance of data and research on these topics and the need for development of practices for collection of such information. Availability of such information can affect future decision and policy makings regarding asylum-seekers and their health and might result in comprehensive reformations in the current national or international legal instruments.

Cette thèse mène une réflexion historique et épistémologique sur la façon dont les altérations de la parole ont été étudiées en médecine mentale. Retraçant les étapes de l’attention accordée aux paroles des patients dans l’aliénisme de la première moitié du XIXe siècle jusque dans la clinique psychiatrique du début du XXe siècle, elle tente de comprendre avec quelles motivations et dans quels buts les médecins ont observé ces phénomènes. L’analyse précise la manière dont certaines modifications de la parole sont devenues fondamentales pour le diagnostic des maladies mentales et indique la place que les spécialistes leur ont attribuée dans leur sémiologie de la folie. L’interrogation porte ainsi sur les ressources pratiques et théoriques avec lesquelles les médecins ont observé et analysé ces troubles du langage. Les méthodes et les procédures mises en place pour récolter les paroles des patients et les outils conceptuels permettant de les appréhender sont examinés. L’enquête fait en outre ressortir les partages disciplinaires qui s’opèrent à cette époque dans le champ des sciences médico-psychologiques, en tenant compte de la façon dont les auteurs nomment, définissent et classent ces désordres langagiers, tout en soulignant les liens explicites ou implicites qu’ils établissent avec des domaines ne relevant pas directement de la médecine, tels que la philosophie, l’anthropologie, la psychologie et la linguistique
This doctoral thesis offers a historical and epistemological reflection on the way in which mental medicine has studied speech alterations.Tracing the various stages of the interest given to patients’ speech in alienist medicine and in psychiatry from the 19th century to the early 20th century, this work attempts to understand the goals and motivations of medical doctors observing these phenomena. The analysis helps clarify how speech modifications have become fundamental in diagnosing mental illness and how specialists have attributed a special place to them in their semiology of madness. It also questions the practical and theoretical resources with which medical doctors have observed and analysed language disorders. It examines the methods and processes used to gather patients’ speech and the conceptual tools that enable its apprehension. Moreover, this survey emphasizes the partition of the medico-psychological disciplines occurring at the time, by observing the ways in which the authors name, define and classify these speech and language disorders, and considering the links implicitly or explicitly made with other non-medical fields such as philosophy, anthropology, psychology and linguistics

AbstractWe present the case of a 29-year-old single Bulgarian woman, Alice, who lived and worked alone in Germany at the time she presented with signs of acute psychosis, more specifically work-related paranoid ideation. She was diagnosed with Brief Psychotic Disorder and treated successfully with Perphenazine. A return to her home town in Bulgaria with concurrent discontinuation of antipsychotic treatment brought about a change in delusional content. She was now excessively preoccupied with religious themes, ancient rituals, and local traditions, and responded well to treatment with Olanzapine. Alice reluctantly returned to Germany but every time she started a new job she experienced depressive and paranoid exacerbations in spite of strict medication adherence. In the last 3 years, she has lived in Bulgaria and has been medication and episode free. We discuss the complex interaction between the experiences of expatriation, premorbid personality, and cultural values (of the patient and her family) in the etiology, course and outcome of brief psychotic disorder. We raise the possibility that contemporary Bulgarian cultural values (as described in a recent comparative international study) were important in Alice’s recovery and, as such, may have wider significance as protective factors for those at risk of mental disorder.

This chapter talks about “enemy alien” internees that arrived in Australia in 1940, who would be enlisted as soldiers in an Australian Army labor corps and work as noncombatants to do their part in the war against the Axis powers. It considers the story of the enemy aliens from Germany and Austria as one of the most remarkable episodes in the immigration history of twentieth-century Australia. It also highlights the account of the enemy aliens in relation to the manpower management in a country that was manpower poor. The chapter recounts the so-called Phoney War that ended on 10 May with the German invasion of the Low Countries and France, while Britain stood alone awaiting a German invasion. It refers to Sir John Anderson, who declared that the British government would draw a clear distinction between enemy aliens and refugees from Germany and Austria.

There were over 28.000 kidney tumor incidences in Germany in 2010. Minimally invasive (laparoscopic) removal of these tumors has become more and more popular. Intraoperative imaging during these procedures is mainly performed with videolaparoscopes. However, they provide only superficial images of the operating field increasing the challenge to remove the tumor. Conventional sonographic approaches may overcome this problem but require an additional assistant to guide the probe. To eliminate the need for an additional assistant, we developed a new robot with four degrees of freedom to motorize a sonographic probe. The robot can be installed in the operating room table and is directly controlled by the surgeon with telemanipulation. In experiments we showed that the accuracy of the kinematic is above the resolution of the sonographic probe.

With the implementation of the new steering model (NSM), universities should align themselves more closely with management principles. Especially, the heads of faculties must cope with higher demands of management tasks. As a result, more management positions are established and organizational structures are changed. To shed light on how structures change, we investigate the faculties of one comprehensive and one technical university within Germany – which are similar in many factors – using the contingency approach. Information about context factors and the number and type of established positions is gained from a systematic analysis of their homepages. Dimensions of the organizational structure are used to interpret the results. Our comparison shows that the technical university, which has established itself as an entrepreneurial university, orients its organizational structure more towards the NSM than the comprehensive university, which is reflected by more support positions in faculty management. Thus, the profile and type of the university seem to be crucial context factors, while our study revealed that the number of students of the faculties and the number or type of degree programs are less crucial context factors.

In this present Globalized World, Science and Technology is the benchmark on which national progress and development is measured. This scientific research work clearly reveals that no Nation can be competitive in the modern world without properly harnessing and developing its Science and Technology potentials. The research work shows that Nigeria’s current ranking in the world makes Nigerian Vision (NV) 20:2020 look bleak or totally impossible hence we extend the horizon of targeted socio-economic might to match the Global Sustainable Development Goal (SDG) 2030 to which many countries currently align. The research emphasizes that Central Intelligence Agency (CIA) World Fact book ranked Nigerian as the 41st on the list of development economies based on Gross Domestic Product (GDP) for 2007. For the same year, World Bank ranked Nigeria 40th on the Group Description of Knowledge Index. Nigeria ranked 66th among the Lagging Followers Group. On Global Competitiveness ranking, Nigeria ranked 95th. This research dwells extensively and specifically on the way forward (Science Governance) through Project Ogodometirics International (POI) WSSD +22 in Songhai-Delta, Amukpe-Sapele, Delta State, Nigeria by investing in Advanced Manufacturing Technologies (AMT) which made the Chinese to become the fourth growth zone along with the U.S, Japan and Germany. The research expresses the beliefs that though it took Britain 58 years to double its Per Capital Output, China has been doing it every 7 years in the last 2 decades by thinking and doing things differently. The research concludes that Science and Technology can diversify the Nation Economy through one strategy of Emerging Technologies Project Ogodometrics International (POI) WSSD +22 in Songhai-Delta, Amukpe-Sapele, Delta State, Nigeria. The research recommends that a Scientific/Technical Adviser under the Presidency is the only option for Nigeria using Science Governance of Project Ogodometrics International (POI) WSSD +22 in Songhai-Delta, Amukpe- Sapele, Delta State, Nigeria in order to facilitate the required synergy to realize the nexus between Science and the National economy to bring 154 International Standards Organization (ISO) Countries to Songhai-Delta, Amukpe- Sapele, Delta State, Nigeria to sign a MOU with the Nigerian Government via Final Investment Decision (FID) of Technology Transfer Agreement (TTA) of Ogodo Intellectual Property Rights (OIPR).
