The study analyses the Hungarian and Austrian adoption laws that inspired lawmakers of the Czechoslovak Act No. 56 of 1928 Coll. As the Hungarian and Austrian laws, the Czechoslovak Act of 1928 on Adoption recognised adoption as a contract to ensure an heir. It advocated compliance with the principle adoptio naturam imitatur. Therefore, it helped to improve the social and legal position of abandoned and neglected children. For lawmakers, the primary inspiration source was the Austrian General Civil Code (ABGB). Nonetheless, several provisions of the ABGB were identical with the Hungarian customary law, court practice, and office practice. Adopters had to be childless, older than forty years of age, and a minimum of eighteen years older than the adoptees. Married persons could adopt only with the consent of their spouses (in this, the influence of the ABGB was the strongest). Contrary to ABGB, but under the Hungarian court practice, was the possibility for a man to adopt his illegitimate biological child. It was possible to adopt majors as a limitation to the principle adoptio naturam imitatur. Adoption was a contractual relationship. It established a relation only between the adopter and adoptee, while the relationships of the adoptee with the birth family continued. For instance, if the adopter failed in his duty to aliment the adoptee, the biological father had a supportive legal obligation to pay alimony. The main goal of the adoption process was to produce an heir. For this reason, we can conclude that the interests of adopters prevailed over the interests of adoptees. It changed radically after 1949, and the most important in the adoption process has become the best interest of the child.

This article analyzes the substantive law and conflict of laws law of such countries as Austria, Venezuela, Germany, Dominican Republic, Iceland, Spain, Canada (Quebec), Norway, Poland, Portugal, Switzerland, as well as bilateral agreements on legal aid, case law of the European Court of Human Rights, which demonstrates the presence general principles of law, as well as the principle of protecting the weaker party to the legal relationship, the principle of observance of best interests of a child established by the universal multilateral international agreements: Convention on Human Rights of 1950, Convention on the Rights of the Child of 1989, Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption. The author examines the relevant issues of the conflict of laws regarding the manifestation of the conflict of jurisdictions, plurality of connecting factors in regulation of a set of private law relations associated with international adoption. The result of the conducted research consists in formulation of a special statute of adoption (lex adoptio), analysis of its legal nature and scope. In the context of examination of the procedure for establishing international adoption, the author identifies the problem of dépeçage (different issues within a single case are governed by the laws of different jurisdictions). A classification is provided to the combinations of plurality of connecting factors established by the legislation of foreign countries, as well as multilateral international agreement – the Inter-American Convention on Conflict of Laws Concerning the Adoption of Minors of 1984).

Este estudo foca-se na biografia de Britânico, filho de Cláudio e Valéria Messalina, analisando em particular as informações transmitidas por Tácito nos Annales. Esta obra é também a única fonte que dá conta de que Britânico teria sido sexualmente violado por Nero, seu irmão por adoptio, cunhado e concorrente ao poder. Pretendemos, assim, analisar também a referência ao stuprum do jovem príncipe e o seu significado na historiografia de Tácito.AbstractThis essay focuses on the biography of Britannicus, son of Claudius and Valeria Messalina, considering particularly the information transmitted by Tacitus in the Annales. Tacitus’ work is also the only source that realizes that Britannicus would have been sexually assaulted by Nero, his brother by adoption, brother-in-law and rival as far as power was concerned. Thus, we also intend to analyse the reference to the stuprum of the young prince and its meaning within the historiography of Tacitus.

Intercountry and interracial adoptions are forms of international adoption that imply the difference between adopter and adoptee in geographical, racial, and ethnic terms, which makes the adoption process very complex. The recent case of intercountry adoption of children from DR Congo by Croatian citizens confirmed the globally recognized controversy, questionability, and complexity of the intercountry adoption process. The key or additional problem in this case of intercountry adoption is the fact that DR Congo is not a party to the 1993 Convention on the Protection of Children and Co-operation in Respect of Intercountry Adoption. The case of intercountry adoption of children from DR Congo encouraged the authors to research and analyze international and national regulations and practices relevant to intercountry adoption. In this paper, the authors specifically analyze open issues related to intercountry adoptions in Croatian legislation, more precisely the recognition of foreign court decisions on adoption, minimum standards related to the establishment and recognition of intercountry adoptions, the possibility of termination of adoption, the citizenship status of adopted children, and the children's right to access information about adoption. In conclusion, the authors propose de lege ferenda solutions for the future regulation of intercountry adoptions.

The process of adoption in the U.S. is incredibly hard to navigate as an adoptive parent. Each primary type of adoption (international, foster, private domestic) comes with its own challenges and costs. One of the hardest challenges for both adopted children and adoptive families forming a secure and satisfactory attachment. Examining what goes into a child’s ability to attach to caregiver will help the analysis of the attachment issues that all adoptive families undergo. The adoptive parent must also start to form an attachment to their child as well as help the child transition into their new placement. Adoptive parents however, often find themselves questioning the legitimacy of their parenthood with their new child. This is further hindered if the child has problems forming secure attachments to others. A greater breadth of resources are needed to counteract these common issues so that adoptive families can get more specific help for their unique situations. As adoption becomes more socially acceptable and prevalent, stronger pushes towards data collection and research will help future adoptive families to form secure attachments more quickly and easily.

Children who age out of foster care face adjustments and mental health issues at higher rates than their peers, but those who are adopted have the opportunity to heal from previous trauma and experience better outcomes. To create healthy family systems for adopted children, adoptive parents need support and guidance as they personally adjust and help their children adjust to a new family system. Previous research has focused on child identifiers rather than on the broader family system in efforts to understand adoption success and failure. In this transcendental phenomenological study, adoptive parents provided their lived experiences of support during the adoption process. The results were analyzed using Giorgi, Giorgi, and Morley's descriptive phenomenological psychological method and the results were framed using an adapted version of Bronfenbrenner's ecological model. The results offered experiences of support at all 4 levels of the ecological model and provided a framework to use for future research to understand the influences of the sources of support and a guideline for agencies and counselors to use when serving adoptive families. The results can aid in the proactive development of training and support services for adoptive families and provide information for professionals by offering insight into the nontraditional structure of adoptive families. This information may also be used to inform counseling programs accredited by the Council for Accreditation of Counseling and Related Educational Programs that offer the marriage, couples, and families specialization.

Adoption is a common occurrence within the field of social work, yet adoptees and their adoptive parents grapple with a multitude of challenges unique to this population. The needs of these children and families are continually scrutinized by social service professionals prior to adoption, but less is known of the needs and services available to this population after adoption is finalized. This study addressed the question: Does adoptive families’ use of post-adoptive resources increase positive adoption outcomes? Ten adoptive parents participated in semi-structured interviews as part of this study. Most participants felt they had access to adequate services, and struggled with issues common to all types of parenthood, adoptive or biological. Two issues which parents identified as needs, and which provide direction for social work practice, were: normalizing their families’ experiences; and navigating conversations regarding adoption and birth families with their children.

AbstractThe industrial sector has been a major adopter of new technologies for decades, driving economic and societal progress. The path by which industry embraces new techniques has a significant impact on the environment and society and thus must be guided by principles of sustainability and trustworthiness. In this chapter, we explore the current paradigm in which Industry 4.0 is evolving towards Industry 5.0, where artificial intelligence (AI) and other advance technologies are being used to build services from a sustainable, human-centric, and resilient perspective. We examine how AI can be applied in industry while respecting trustworthy principles and collect information to define how well these principles are adopted. Furthermore, it is presented a perspective on the industry’s approach towards adopting trustworthy AI (TAI), and we propose steps to foster its adoption in an appropriate manner. We also examine the challenges and risks associated with the adoption of AI in industry and propose strategies to mitigate them. This chapter intends to serve researchers, practitioners, and policymakers interested in the intersection of AI, industry, and sustainability. It provides an overview of the latest developments in this field and offers practical guidance for those seeking to promote the adoption of TAI.

AbstractThe chapter draws on case file data and papers presented to the court at the time of the adoption order. The 210 adoptees were placed in 138 adoptive homes. The adoptive parents were on average ten years older than birth parents and had more stable relationships. They were also better educated. Most lived in owner-occupied homes and the secondary carer was generally in full-time work. Attempts to match children with families of the same ethnicity and culture and to place siblings together were mostly successful: 77% of children with siblings were placed in intact groups; only 8% were placed alone. Almost half (44%) the parents adopted more than one child; 9% adopted three or more; many also had biological children still living with them. While adoptive parents had considerable resources, they also faced challenges including helping children overcome the sequelae of early adverse experiences and parenting several children with diverse needs.

Aspects relating to adoption have not been much in focus of psychology research in Latvia. The aim of the study was to investigate associations between parenting practices, attitude and communication about adoption and child behavior problems in adoptive families raising school-age children, as well as to investigate to what extent parenting practices, attitude and communication about adoption, as well as parent’s perception of adopted child’s adverse childhood experiences explains the internalized and externalized child behavior problems. Participants were 130 adoptive parents (94.6% women and 5.4% men) who are currently raising at least one adopted child between the ages of 7 and 18 (50.8% girls, 49.2% boys). Alabama Parenting Questionnaire, psychological control scale from Block’s Child Rearing Practices Report, parent report form of the Child Behavior Checklist were used in the study, as well as Kirk’s Adoption Questionnaire, which was adapted as part of the study. Results of the study revealed that adverse childhood experience, empathy for the child’s understanding and feelings about adoption, maladaptive parenting practices – inconsistent discipline and low involvement predict internalized behavior problems. On the other hand, poor monitoring/ supervision, psychological control, as well as adverse childhood experience and acknowledgement of differences related to adoption by adoptive parents predict externalized behavior problems. Implications for practice include recommendation to empathize the importance of positive parenting practices during pre and post-adoption trainings for adoptive parents.

SWEBOK is a guideline that provides information about Software Engineering (SE) knowledge, including a list of Best Practices (BPs) for adopting. However, small companies have restrictions such as, limited budget, reduced schedule, and, small staff that can hinder the advantages of these BPs adoption. Thus, this paper investigated the last decade of BPs adoption reported by small companies’ environment. A quasi-systematic mapping was conducted for assessing studies that addressed this issue, and it was possible to observe that the most prominent BPs adopted are “test application” and “software process model adoption”. On the other hand, “limited budget” and “staff size” were found as causes for non-adoption of SWEBOK’s BPs.

The COVID-19 pandemic has elevated the need for ‘building resilience’ to be a core part of the planning and management of future education systems. Resilience primarily implies the capacity to adapt and adjust to new environmental conditions subject to retaining the basic tenets and identity of the educational system. While the pandemic has caused severe disruption across the higher education sector, it also changed the complete outlook on teaching and learning in higher educational institutions. In general, adoption of E-learning platforms surged during this crisis period and MOOCs, in particular, were increasingly encouraged and offered by institutions for continuing education. Studies have shown that learners enrolled in MOOC courses for many different reasons (Crues et al, 2018). One such indicated that self-regulation was seen as the most significant predictor of MOOC adoption and female learners showed a high inclination to adopt them (Ma & Lee, 2019). Among Indian students, building skill-sets was seen as one of the key factors of intention to adopt MOOCs (Mohan et al, 2020). However, it is significant to study why learners adopted MOOCs, especially during the pandemic since this can serve as an ideal case for studying and gaining insights on resilience built against an emergency situation. This paper has been visualized against this background to investigate and compare how MOOCs were adopted by higher education learners, prior to and during the pandemic period. The case study is based on a selected MOOC wherein an attempt would be made to study learner orientations and adoptions to MOOCs in normal and pandemic settings and to assess if there has been any difference in their access, with a special focus on girls and marginalized communities. It is important to understand the learner characteristics, reasons why they enrolled and learner practices from the two selected situations. The parameters chosen to examine the learners are; demographic profile; MOOC experience, access to the course, perceived usefulness, self-learning strategies, learning preferences, purpose and motivation. Empirical analysis of both qualitative and quantitative data would be adopted to interpret the data. The study findings would have implications while investing and building disaster resilience in higher educational institutions and creating a robust and quality infrastructural governance for MOOCs.

The construction industry activities contribute to and impact the environment; hence the industry continuously strives to adopt sustainable principles into its process and products. Another critical aspect to achieving this in the current technological revolution is the adoption of technology for achieving sustainable construction. Various technologies are available and have been explored to achieve sustainable construction. However, there is a dearth of studies on adopting technology for sustainable construction by construction SMEs and from the perspective of developing countries. This study investigates the adoption of technology for sustainable construction by SMEs in the South African construction industry. A total of eighty responses were collected through well-structured questionnaires administered randomly. It was observed that all barriers are significant, but the most significant barrier is the high cost of adopting technologies. The study recommends the provision of financial incentives and support for SMEs. Also, SMEs must not resist change birthed by the adoption of technology for sustainable construction.

With the COVID-19 pandemic, universities had to close their campuses. The need to continue teaching in these circumstances has led to the adoption of an Emergency Remote Learning (ERL) model by many universities. Computer Science related courses needed to adapt to this model, adopting strategies and tools to keep teaching. Thus, this article presents an analysis of the impact of ERL adoption on the students’ learning outcomes in an object-oriented programming discipline. An Explanatory Case Study is carried out involving six classes, three from before and three after the ERL. The results indicate that there were no statistically significant impacts on the students’ learning outcomes, raising initial evidence that the adaptation strategies adopted may have been effective to minimize the impacts.

Previous work has shown that the implementation of advanced compressor unit control routines have not been readily or consistently adopted by the industry. There are several barriers to the consistent adoption of advanced control methods: - Some of the control methods are complicated which makes them difficult to describe in a research report and also difficult to extract from the report and put into a software format that can be used in engine control systems; - The development of software code is performed independently by each adopter which can be time consuming and expensive; and - The recognized benefits of adopting the advanced methods were not perceived as being sufficient to justify the effort to adopt them. This effort attempts to lower the barrier of entry into the industry by providing the source code for a core set of advanced control routines. Examples of their usage are also provided.

In the state-based insurance regulatory system, the National Association of Insurance Commissioners (NAIC) develops model laws that create a framework for uniform standards. This uniformity among states is beneficial to insurers, especially those operating in multiple states. Since the first NAIC meeting in 1871, the NAIC has issued over 200 model laws. Though NAIC model laws have existed for decades, little attention has been paid to understanding how they spread from the NAIC to states and from states to states. This spread is a policy diffusion process, which refers to the external factors that impact states’ policy adoption. In this project, we study the general pattern in the diffusion process and key factors that affect states’ decisions to implement NAIC model laws. We aim to answer the following questions: Do the NAIC or early-adopting states exert greater influence on leading states to adopt model laws? Are there common factors that may explain state legislatures’ adoption of model laws?

This paper examines the factors associated with the adoption of cloud computing and artificial intelligence/machine learning, two emerging digital general-purpose technologies (GPT), as well as firms' post-adoption outcomes. To do so we identify adoption of GPT based on references to these technologies in listed company reports, and merge this with data on their Board of Directors, their hiring activities and their financial performance. We find that firms that have directors with relevant technological backgrounds, or female representation on their Board, are more likely to profitably adopt GPT, with the former being particularly important. Worker skills also appear important, with firms that adopt GPT, particularly those that do so profitably, being more likely to hire skilled staff following adoption. Finally, while early adopters of GPT experience a dip in profitability following adoption, this is not evident for more recent adopters. This suggests that GPT may have become easier to adopt over time, potentially due to changes in the technologies or the availability of relevant skills, which is encouraging in terms of future productivity outcomes.

The use of drone technology in capital projects is an emerging area that holds promise for growth. Drones are becoming more widely available, and regulatory bodies are gradually allowing their use on a larger scale. With the development of software solutions that can effectively utilize data, drones are increasingly being used throughout the entire lifecycle of capital projects, including smaller infrastructure projects. The benefits of using drones in construction projects are numerous and include providing an unparalleled record of all activities, reducing planning and survey costs, increasing productivity, improving the accuracy of volumetric measurements, and mitigating disputes over the project's status. In the future, drone data will be integrated with CAD and BIM models and artificial intelligence (AI) to track construction progress and adherence to design automatically. While the construction industry has been slower in adopting new digital technologies than other sectors, leading global companies have widely adopted drones for capital project monitoring. In Latin America, drone adoption in the infrastructure sector is still limited, but early adopters have validated and are utilizing the technology. This report provides an examination of the current state of drone use in the Latin American region, including the benefits, barriers, early adopters, and what is required to promote its adoption.

Like other crop improvement programs, a key prerequisite for the CGIAR Research Program on Grain Legumes and Dryland Cereals (CRP GLDC) to generate large-scale impact is large-scale adoption. Hence, evidencing the breadth and depth of such adoption is both of intrinsic interest and important for estimating downstream impacts, such as improved food and nutritional security, income, resilience, and soil health. While various GLDC adoption studies have been undertaken, a recent effort to systematically review these studies and synthesize the results is lacking. We undertook such a review, identifying 69 studies and 35 independent country crop combinations (CCCs). To generate aggregated and updated estimates of GLDC improved varietal adoption, we devised and applied a procedure to estimate national cropping areas under such varieties and, in turn, the number of adopting households. Estimates derived from household surveys and expert opinion solicitation are treated with higher and lower levels of confidence, respectively. As of 2019, we estimate from higher confidence studies that improved GLDC crops were cultivated on 15.37 million hectares of land by 17.64 million households in CRP GLDC’s 13 priority countries. With the inclusion of lower confidence studies, these numbers increase to 32 and 44.64 million, respectively. We are further confident that the program exceeded its adoption target of 8.9 million newly adopting households from 2011, particularly when likely spillovers vis-à-vis non-surveyed areas, non-priority countries, and non-priority crops in priority countries are considered.

Among the key tools that states that export arms and military equipment can adopt to help to prevent and mitigate the diversion of military materiel are post-shipment on-site inspections. These inspections involve the exporting state requiring and conducting physical checks on previously authorized and transferred military materiel on the territory of the importing state. In the past decade a growing number of states have adopted and implemented this policy tool. In addition, some multilateral bodies and instruments—including forums connected to the 2013 Arms Trade Treaty, the European Union and the United Nations—have been used to exchange views on the use of post-shipment on-site inspections and to develop related good practice guidelines. The wider use of post-shipment on-site inspections could help to prevent diversion of military materiel and reduce the human suffering that this generates, but several barriers and challenges appear to be blocking their broader adoption. This SIPRI Policy Paper reviews these barriers and challenges, and summarizes the steps that have been taken at the national level to address them. The paper then examines the steps that have been taken and that could be taken at the multilateral level to expand discussion about post-shipment on-site inspections and help to support those states that are considering adopting this policy tool. For each step, the policy paper presents a series of recommendations that could be taken forward by states, research institutes, or the executives or secretariats of relevant multilateral instruments or bodies.
