Resumen
Understanding Victim (victim) and logi (science), Latin "victima" victims of "logos" science. Means knowledge about victims of crime. In a criminal trial the parties that play a role are the public prosecutor, judge, defendant, and legal counsel and witnesses. The victim was represented by the public prosecutor and to corroborate the usual evidence he was made a witness (victim). Often the public prosecutor acts at will by not representing the interests of the victim and ignoring the victim's protection rights. The victim was ignored because: The problem of crime cannot be understood in proportion The problem is not based on the prevailing theory Understanding the problem is not seen from the human side

Resumen
Throughout the last three decades, victims and victim advocates have significantly advanced victim's rights and services and have altered the fabric of police-victim interactions from viewing victims as necessary witnesses (Laszlo and Burgess, 1979; Waller, 1990) to engaging victims and victim organizations as collaborative partners in developing victim-oriented criminal justice services. As criminal justice agencies seek to engage stakeholders in problem-solving strategies, victims and victim organizations are becoming active partners in prevention, intervention, and restitution initiatives, and have been instrumental in tailoring criminal justice systems services to the needs of special populations. This paper describes four ongoing efforts to effect prevention, intervention, and restitution activities for special populations of victims and, in particular, to advancing community policing and community government in or for special populations. Within the historical contexts of the victim's movement, these efforts manifest the expanding role of victims as collaborative partners of police (including tribal police), prosecutors, and the courts.

This article aims to identify the symptoms of psychological distress according to the typology of sexual violence identified from individual interviews with victims and their relatives as well as data from the medicalpsychological care of the Alwaleed health center. The study was based on a grounded theory framework and used as sources the files and accounts of the victims of sexual violence at the Alwaleed center as well as individual interviews conducted at home with the victims and their relatives. Therefore, it was observed that whatever the typical situation in which the victim finds herself, she expresses the trauma she has suffered on a physical, psychological and behavioral level. The trauma suffered by the subjects of type II and III situations comes from the reactions of the family and the community. The trauma suffered by a victim affects the members close to the victim in the same way.

Resumen
The current criminal justice system has limitations in providing victim protection services before stalking victims actively request intervention. Therefore, this study aims to report to investigative agencies such as the police and propose measures to diagnose the risk on their own and prevent additional serious criminal damage to potential victims before protection is made. This study proposes the development of a victim's risk self-diagnosis tool from a stalking risk assessment tool through a review of previous studies. Specifically, it was suggested to consider the relationship between the perpetrator and the victim, and to select and utilize common risk factors from existing risk assessment tools. In addition, a procedure is required to objectively confirm the victim's subjective risk perception. As a result of self-diagnosis of stalking victims, it was proposed to provide customized crime victim safety measures according to the risk level of stalking victims, secure the effectiveness of access restriction orders through the introduction of two-way electronic supervision.

Resumen
The legal terms used by the Constitution and laws should have legal effect that distinguishes them from other concepts. However, various terms are used in various systems for the protection of crime victims and the laws on which they are based. Examples include crime victims, criminal victims, a victims of a crime, non-victims, and victim . Here is tried to examine how these concepts are used in cases decided by the Constitutional Court in relation to crime victims so far, and whether legal concepts can be distinguished based on this. First of all, it was premised that the characteristics of the Crime Victim Protection Act and the Criminal Procedure Act were different to guarantee the basic rights of crime victims. In other words, the Criminal Victim Protection Act believes that even if various systems are reorganized for crime victims to be involved in criminal procedures, it cannot be a direct criminal victim's right to participate in criminal procedures. Therefore, the Crime Victim Protection Act is a protection-oriented law in which the state intervenes in the entire process of recovering damage from the occurrence of criminal damage, including criminal procedures, and the Criminal Procedure Act is the basis for the rights of criminal victims. Next, the summary of the terms is as follows. First of all, criminal victims, defined by the Constitution as the subject of the right to state trial procedures, are limited to the subject of rights and obligations in criminal procedures and direct victims of crimes. As a result, the term victim under the Criminal Procedure Act was deleted and a plan was proposed to unify it by replacing it with a victim of a crime. In addition, crime victims were considered to include not only direct victims of crime (criminal victims) and spouses, immediate relatives and siblings, but also those affected by crime damage prevention and crime victim rescue activities according to the definition of the Crime Victim Protection Act. In addition, I would like to propose that all victims, including those other than the term non-victim as a complainant under the Criminal Procedure Act and those other than criminal victims (defined as victims of crimes under the current law), be unified as non-victims. As a result, in the Criminal Procedure Act, victims, etc. will be able to organize legal statements by simply listing them as “criminal victims and not-victims” without any additional regulations or explanations.

This study investigated the effect of the victim’s gender and the perpetrator’s attractiveness on the observer’s blame on the male and female victims of coercive sexual contact. Two hundred and ninety-six participants (184 females) were enrolled in an experiment in which the victim’s gender and the offender’s attractiveness were manipulated using vignettes depicting cross-gender sexual assault. Participants rated emotions that the victims experienced in being assaulted and attributed victim blame. The results indicate that the male victim was blamed more than the female victim, especially when the female perpetrator was described as attractive. The female victim was perceived as having experienced more negative emotions and fewer positive emotions than the male victim. The effect of the victim’s gender on victim blaming was mediated by both positive and negative emotions.

Victims are an important element in the continuation of legal evidence as a victim witness or reporter. As is the case with the problem of human trafficking crime. Victimology with its various kinds of views extends the criminal etiological theories needed to understand the existence of crime as a better structural and non-structural victimization. besides the views in viktimology encourage people to pay attention and serve each party who can be victims of mental, physical, and social. From the explanation of the victim's typology and the factors that led to the crime of trafficking in persons, it was concluded that there were three types of victims of trafficking in persons, namely Latend or Prodisposed Victims who were economic contributors. Participating Victims were victims who because the cause is a low education factor, and False Victims which is being a victim because the cause is a consumptive behavior factor.

Historically, victims of crimes were key participants in the prosecution of crimes around the globe. Over the centuries, however, as public police and prosecution service took over the prosecution of criminal acts, the importance of victims in criminal justice systems decreased in common law and civil law countries alike. The victim was sidelined and the victim's role was reduced to that of a witness for the prosecution. As one of the first scholars to comment on the absence of victims from the criminal justice system, William Frank McDonald referred to the victim as “the forgotten man” in criminal procedure.

Victim advocates help victims of intimate partner violence to plan for their safety and encourage them to find social support. In New Zealand, however, victims often bring supportive allies with them to safety planning meetings, and those allies help to plan for the victim’s safety. Interviews were conducted with representatives from 24 refuges in New Zealand, and from their perspective, the inclusion of allies in safety planning meetings is beneficial not only for social support but also for enhancing the safety of the victim. The benefits and implications of enlisting informal community members to help keep victims safe are discussed.

Resumen
This paper draws attention to the interests of the victim in the criminal justice system in relation to the use of charge bargaining and the sentence discount in UK law. The paper argues that debate in this area tends to assume that these practices, particularly use of the graded sentence discount, are in harmony with the needs of crime control and with the interests of victims, but that they may infringe due process rights. Debate tends to concentrate on the due process implications of such practices, while the ready association of victims' interests with those of crime control tends to preclude consideration of a distinctive victim's perspective. This paper therefore seeks to identify the impact of charge bargaining and the sentence discount on victims in order to identify a particular victim's perspective. It goes on to evaluate measures which would afford it expression including the introduction of victim consultation and participation in charge bargains and discount decisions as proposed under the 1996 Victim's Charter. It will be argued, however, that while this possibility has value, victims' interests might be more clearly served by limiting or abandoning the use of these practices.

Resumen
The non-victimized siblings in incestuous families have often been ignored in research, literature, and treatment. This study explored these siblings' 1) relationship to the victim, 2) attribution of blame, and 3) adjustment. Participants were 30 non-victimized siblings of incest victims, between the ages of 8 and 14. They completed the Sibling Relationship Questionnaire, the Revised Children's Manifest Anxiety Scale, the Self-perception Profile for Children, the Children's Depression Inventory, and a questionnaire developed for this research. Participants' scores were compared with the normative sample scores on several measures. Siblings perceived little warmth and closeness in their relationships to their victimized sisters. Rivalry and conflict were within normal limits. Siblings blamed victims and other family members less than expected, with the greatest amount of blame attributed to perpetrators. Adjustment was impaired. Males demonstrated less athletic competence, less global self-worth, more worry and oversensitivity than normative samples. Females showed a tendency toward less global self-worth and heightened general anxiety. Siblings' overall level of emotional distress was higher than most of the normative samples.

Resumen
Children belong to one of the most vulnerable population groups to crime. Child victims of crime have to overcome the difficulties emerging from their victimization as well as those resulting from their participation in the adversarial criminal justice process. Child victims are typically treated by legal systems as either mere witnesses -- prosecutorial instruments -- or as objects of protection. Children's human rights and their needs beyond immediate protection are typically ignored. ¶ This thesis combines an examination of children's human rights (articulated largely in the UN Convention on the Rights of the Child) with a review of psycho-social literature on children's needs. It integrates the two disciplines thus creating a `needs-rights' model regarding child victims. This model is then used to evaluate the criminal justice process and its successes (and failures) in meeting the needs and rights of child victims. Such an integrated needs-rights evaluation identifies not only the difficulties associated with testifying in court and being interviewed multiple times. It goes beyond these topical issues, and uncovers other shortcomings of the current legal system such as the lack of true participation of child victims in the decision-making process, the neglect of rehabilitative and developmental interests of victimized children, and the inherent inability of the adversarial process to seek proactively the best interests of child victims. ¶ The thesis further explores an alternative to the criminal justice process -- that of restorative justice -- and examines its applicability to child victims. Unlike the criminal justice paradigm, restorative justice fosters the equal participation of the stakeholders (in particular victims, offenders and their communities), and focuses on their emotional and social rehabilitation while respecting their human rights. To explore the suitability of restorative justice for child victims, five restorative justice schemes from New Zealand, Australia and Canada and their evaluation studies are reviewed. Each of these schemes has included child victims, and most of them have dealt with either sexual assaults of children or family violence and abuse. Yet each of the evaluated schemes illuminates different concerns and proposes varying strategies for meeting the needs-rights of child victims. ¶ While these schemes demonstrate the significant potential of restorative justice to better address the full scope of the needs and rights of child victims, they uncover emerging concerns as well. Therefore, in the last part of the thesis, the needs-rights model is used once again to derive subsidiary principles for action, to maximize the benefits of restorative justice for child victims and minimize the related risks. A complex set of needs and rights is managed by a method of grouping them into needs-rights clusters and deriving from them simple heuristics for practitioners to follow. This clustering method of needs-rights-heuristics is a methodological contribution of the research to the psychology of law.

Resumen

Using data from the Minnesota Student Survey of over 120,000 eighth, ninth, and eleventh grade students across the state, this study examined the characteristics of students who identified themselves as engaging in bullying behavior (bully only), being the target of bullying (victim only), or both engaging in and being the target of bullying (bully-victims). Scores for these three bully/victim groups were compared to the general student population on fourteen characteristics: perception of safety, perceived fairness, perception of care, family communication, family inclusiveness, internalizing behavior, externalizing behavior, inattentiveness, coping skills, positive self-evaluation, positive feelings toward others, parent abuse, sexual abuse, and family substance abuse. All categories of bullies and victims reported adverse scores on these measures, scoring on average about one-half standard deviation below the mean of all Minnesota students. Bullies and victims were similar on eight of the fourteen measures. Bully-victims consistently reported lower scores compared to the bully only and victim only groups. Gender differences were found with female students reporting more hardship on half of the investigated characteristics; however, gender did not interact with bully/victim status. These findings have important implications for understanding the psychological, behavioral, and physical space which both bullies and victims occupy.

The adequate protection and support of hate crime victims can be linked to the issues related to the state’s efforts to develop comprehensive victim support systems. Besides this general issue, hate crime victim support and protection implies certain distinct features. This article aims to highlight international standards and guidelines that are relevant for providing support and protection for victims of hate crimes, focusing on their differentiating qualities. The main problem associated with hate crimes is the inability to recognize such acts, which is an essential prerequisite for providing victims with additional protection. In addition, there is an increased susceptibility of these victims to secondary victimization and fear regarding the potential reoccurrence of hate-motivated incidents. Victim assistance service providers must possess an understanding of the distinct needs of hate crime victims. Increasing awareness regarding the rights of hate crime victims and fostering confidence in the criminal justice system are additional imperatives.

One of the basic principles judicial authorities should adhere to when dealing with human trafficking victims is refraining from secondary victimization. Considering that secondary victimization is an exacerbation of primary victimization through inadequate or even erroneous reaction by law enforcement agencies, analysis of the degree of secondary victimization of human trafficking victims in court proceedings is of great importance when evaluating the sensitivity of the actions of judicial authorities. The research conducts both quantitative and qualitative analysis of all twelve final judgments in criminal proceedings in the Republic of North Macedonia in the period from 2015 to 2020. The quantitative analysis provides data on the frequency of victims and number of times the victim was heard in these court proceedings. It further analyses the victim’s distributions by gender, ethnicity and age. The qualitative research focuses on the written explanations of the verdicts. More specifically, it analyzes whether the change of the procedural law and the level of expertise and professionalism of the judges, prosecutors and lawyers in the application of special measures for procedural protection of victims has an impact on secondary victimization in court proceedings. The paper concludes that the main reason for the existence of secondary victimization is the insufficient expertise, professionalism and education of judges, prosecutors and lawyers, which is reflected in the lack of legal provisions practice of special protective measures for the victims. Key words: secondary victimization, victims of human trafficking, criminal proceedings, special protective measures.

Resumen
An estimated 75 million people in the European Union fall victim to crime every year reflects the significant impact of criminal activities on considerable portion of the population. Crime victims may experience a range of physical, emotional, and financial consequences, underscoring the importance of effective legal frameworks, support services, and policies to address their needs. The protection of victims’ rights is a crucial aspect of the criminal justice system in the EU. The EU has taken steps to enhance the right and protection of victims through initiatives such as the Victims’ Rights Directive and the EU Strategy on Victims’ Rights. The Victims’ Rights Directive, adopted in 2012, establishes minimum standards for the rights, support, and protection of victims of crime across the EU. The Directive aims to ensure that victims are recognized, treated with respect, and have access to information, support services, and fair treatment throughout the criminal justice process. In June 2022, the European Commission conducted and evaluation of the Victims’ Rights Directive as part of its commitment outlined in the EU Strategy on Victims’ Rights 2020-2025. The Strategy focuses on enhancing victims’ rights, ensuring their effective implementation, and addressing emerging challenges in this area. Following the evaluation, on July 12, 2023, the European Commission proposed amendments to the Victims’ Rights Directive. The objective of the revision is to contribute to a well-functioning area of freedom, security, and justice, emphasizing efficient recognition of judgements, improved crime reporting, and victim-centered justice, including the improved access to compensation from the offender. In the article the evolution of victim protection in European Union law, the impact of the Victims’ Rights Directive, as well as proposed amendments to the Directive will be assessed. Since, Serbia is in the EU accession process and aligning of the national framework with the EU acquis, the article will focus on implications of proposed amendments on Serbian policy and legislation. The proposed amendments will be analyzed against National Strategy on the Rights of Victims and Witnesses of Crime in the Republic of Serbia and accompanying Action plan for 2023-2025 and its implementation results, highlighting some criticisms of the new directive’s proposal also raised by some Member States.

Resumen
In conclusion, it can be concluded that both legal regulations regarding the rights of crime victims in Slovakia and the Czech Republic lead to the strengthening and improvement of their rights. The legislation in question has many common features, but it is also possible to find certain differences. Both laws clearly define terms such as victim, particularly vulnerable victim, as well as the principles of victim protection and support. On the other hand, the law on victims of crimes in the Czech Republic is more extensive in terms of the scope of regulation of the rights of victims of crimes, as it regulates six rights of victims and five of them are regulated in the Slovak law. The advantage of the longer period of validity of the Czech legislation is obvious, that is, it entered into force in 2013 and reflected on several suggestions from practice. Slovak legislation has been effective since 2018 and is still evolving. It would be beneficial if, in the part of the regulation of the rights of victims of crimes, it was inspired to a greater extent by the Czech legal regulation, in particular the right of the victim of a crime to protection against secondary harm and the right of the victim of a crime to the protection of privacy.

"The Impact of Basic Victimological Conceptions and the Idea of Restorative Justice on the Position of the Injured Party in Criminal Procedure: A Review of International Standards". En The Position of Victims in the Republic of Serbia. Institute of Criminological and Sociological Research, 2024. http://dx.doi.org/10.47152/palic2024.1.

Resumen
In this paper, the basic elements of the position of the injured party in criminal proceedings are explained, as well as the ratio legis for introducing appropriate criminal legal instruments for the protection of victims of crimes. A relevant victimological approach is important in both substantive and procedural criminal law. Modern criminal procedures include an appropriate restorative component, as a characteristic of so-called restorative justice. It is particularly important in criminal proceedings to ensure an adequate position for the injured party and to enable effective protection of victims who belong to the category of especially vulnerable persons. The authors highlight the basic normative solutions contained in EU Directive 2012/29, as well as in the UN Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power, aimed at improving the position of victims in the criminal justice system. Special attention is paid to analyzing the position of the injured party in Serbian criminal procedure. The aim of the paper is to explain possible problems arising from certain rules of the Criminal Procedure Code of Serbia, as well as recommendations in the de lege ferenda sense, through which it is possible to relatively easily align Serbia’s criminal procedural system with the requirements of the relevant EU Directive 2012/29. The three main requirements regarding the position of the victim in criminal proceedings arising from international and European standards are the removal of identified barriers to victim access to justice, protection of the victim in criminal proceedings, and the need to find a careful balance between the rights of victims and the defendant.

Resumen
In 2012, the European Union Directive (2012/29 EU) was adopted establishing minimum standards on the rights, support and protection of the victims of crime replacing the Council Framework Decision 2001/220/JHA on the standing of victims in criminal proceedings. Both documents are legally binding of the general kind, the first of that kind, when it comes to victims of crime and EU legislation. The purpose of this paper is to introduce the importance of this Directive for promotion of the position and rights of the victim of crime and the necessity for its implementation in national legislation. Moreover, the Republic of North Macedonia, as a country that has already started the accession negotiations for EU membership, must take into account the minimum standards on the rights, support and protection of victims of crime as one of the conditions for gaining this status in the EU in the framework of harmonization of national with European legislation. In this regard, we can point the implementation of the Victims’ Rights Directive as one of the priorities of Serbia in the negotiations for its accession to the EU (specifically foreseen in the Action Plan for Chapter 23 - Judiciary and Human Rights). The main method used in this paper will be the content analysis of the Victims' Rights Directive and of domestic legislation regarding the (non) existence of provisions which imply its consistent application. Keywords: EU Victims’ Rights Directive of Crime (2012), minimum standards, national legislation, harmonization of legislation

Resumen
About 29 percent of teenagers are bullied at school in the Caribbean. Victims of bullying are more lonely, sleep less, and have fewer friends than do their nonbullied peers. Although victims of bullying eat more frequently at fast food restaurants, they also experience more periods of hunger than do nonbullied children. Acting out with the goal of being considered a "cool" teenager does not work; even if adolescents frequently smoke cigarettes, bullies may still intimidate and harass them. The opposite is true for virgins. Good parenting can, however, make a difference in preventing a child from being a victim of bullying. Growing international evidence has shown that school-based programs can reduce the prevalence of bullying and that bullying has long-term negative consequences into adult life (for both bullies and victims).

Resumen
Efforts to support help-seeking by victims of partner violence in couples affected by incarceration represent a key part of larger efforts in the fields of domestic violence and victim services to improve the accessibility of services in marginalized communities and better meet complex victim needs. Qualitative data from 167 Multi-site Family Study participants suggest that involvement with the criminal justice system (whether directly or through a family member) introduces unique individual, interpersonal, and sociocultural barriers to defining one’s experiences as a problem, deciding to seek help, and selecting sources of help. Opportunities exist not only to tailor service delivery approaches in ways that overcome the individual and interpersonal obstacles that affect victims but also to pursue longer-range shifts in public policy and community infrastructure that will address broader and more-entrenched barriers to help-seeking.

Texto completo
Resumen
While victims of terrorism undergo significant harm, there is currently no specific legal framework addressing their right to reparation. Certain regional provisions focus on establishing compensation funds under national law but do not explicitly acknowledge an existing right to reparation which includes restitution, compensation, rehabilitation, satisfaction, and guarantees of non repetition. To fill this gap, this Policy Brief argues that the UN Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law (UN Basic Principles and Guidelines) should be applicable to terrorism victims. The brief initially explores the absence of an internationally proclaimed right to reparation for this category of victims. Subsequently, it illustrates that considering the shared characteristics between victims of terrorism and those of international crimes, gross violations of International Human Rights Law, or serious violations of International Humanitarian Law as well as the common elements between terrorism and international crimes, gross violations of human rights and humanitarian law, the UN Basic Principles and Guidelines should extend to victims of terrorism. This application is seen as a recognition of their right to reparation, fulfilling states’ responsibility to provide a comprehensive framework for the harm suffered by victims and consequently enhancing the international protection of terrorism victims.
