La valutazione street level dei servizi sociali č un approccio particolare nello studio e nella valutazione dei servizi pubblici, che sta guadagnando sempre piů apprezzamento nelle comunitŕ professionali. Essa si basa sul presupposto che i burocrati street level, hanno un ruolo cruciale nella realizzazione di servizi sociali/progetti/politiche e stabilisce che tale ruolo, lungi dall'essere un ostacolo, č creativo e attivo. La formula della Street Level Evaluation comprende una tecnica di osservazione diretta, di un processo partecipativo di valutazione e una particolare attenzione per le strategie del professionista, in base al presupposto che le politiche sono qualcosa che la gente fa. Ci sono diversi fattori che siamo stati in grado di cogliere, grazie a questo approccio, e che riguardano essenzialmente quegli aspetti del lavoro sociale che non possono essere trovati nei documenti e nelle dichiarazioni. Prima di tutto, gli aspetti organizzativi per la divisione del lavoro informale che influenzano molto la qualitŕ del servizio. Inoltre, le strategie degli operatori sociali messe in atto per sostenere le richieste dei clienti evidenziano spesso l'uso di potere discrezionale da parte di tali lavoratori. Abbiamo considerato questa discrezionalitŕ come un "neutro" componente della politica e siamo stati in grado di chiarire come questo potrebbe contribuire a costruire un migliore disegno di valutazione.

I servizi che arricchiscono il funzionamento del sistema economico e sociale di un territorio traggono a loro volta efficienza e qualitŕ dall'esistenza di specifiche reti infrastrutturali, di norma interconnesse a livello internazionale e spesso al servizio l'una delle altre. Delle innumerevoli questioni - tecnologiche, tecniche, gestionali - che riguardano lo sviluppo delle reti si esamina qui l'aspetto delle valutazioni tecniche ed economiche delle infrastrutture di trasporto. Ciň perché i territori necessitano di sempre maggiore accessibilitŕ per le persone e per le merci, ma anche perché spesso le infrastrutture esistenti non sono adeguatamente sfruttate e una loro duplicazione č in genere assai costosa, in termini economici e ambientali. Dopo un sintetico richiamo alle categorie teoriche piů importanti per giudicare il ruolo delle reti infrastrutturali nell'economia di un territorio, il saggio introduttivo presenta i sette contributi esperti, organizzandoli secondo la loro natura scientifica e la finalitŕ valutativa.

<p>Le linee guida comunitarie per monitorare lo stato di conservazione delle specie e degli habitat richiedono che gli Stati membri forniscano un’indicazione del “<em>Favourable</em> <em>Reference</em> <em>Value</em>” (FRV), o “Valore di Riferimento Favorevole”. Il FRV rappresenta un obiettivo di conservazione a lungo termine, tale da rappresentare una situazione indubbiamente favorevole per una data specie, in grado di garantirle ottime possibilità di persistenza nel lungo periodo. La disponibilità di FRV consente una valutazione più oggettiva e trasparente dello stato di conservazione di una specie. Il presente lavoro ha valutato lo stato di conservazione delle specie ornitiche nidificanti in Italia, sviluppando un metodo basato sui requisiti delle direttive comunitarie che integra al suo interno la definizione dei valori di riferimento. Attualmente, è stato proposto un metodo per la definizione dei FRV per popolazione, range e habitat per ciascuna specie, ma è stato possibile procedere ad una identificazione su base quantitativa del solo FRV relativo alla popolazione per le specie di uccelli regolarmente nidificanti in Italia e non attualmente in fase di espansione demografica in seguito a recente colonizzazione (ultimi 30 anni). L’approccio sviluppato per definire il FRV di popolazione ha previsto l’utilizzo di tecniche di <em>Population Viability Analysis</em> o, in alternativa, valutazioni basate sulla densità riproduttiva, secondo le caratteristiche di abbondanza e distribuzione delle specie nidificanti (popolazioni maggiori o minori di 2500 coppie, coloniali o non). Sono state prese in considerazione 250 specie nidificanti in Italia, di cui 88 (che comprendono due sottospecie) incluse nell’Allegato I della Direttiva Uccelli (147/2009CE). Complessivamente, per 46 popolazioni appartenenti a 20 specie inserite nell’Allegato I e per 10 popolazioni di 6 specie non incluse, è stato possibile calcolare un valore di FRV attraverso tecniche di PVA. Per 15 specie inserite nell’Allegato e per 92 specie non inserite è stato formulato un FRV in termini di densità riproduttiva a una o due scale spaziali; per le specie con popolazioni superiori a 2500 coppie esigenze spaziali elevate (territori o <em>home ranges</em> di decine di ettari o più) non è stato formulato il FRV a scala locale. Per valutare lo stato di conservazione è stato utilizzato un adattamento della classificazione a “semaforo” proposta dalla Commissione Europea per la Direttiva Habitat, attribuendo a ciascuna delle tre voci considerate (popolazione, range e habitat), un giudizio sintetico: <br />- favorevole: semaforo VERDE. Tutti favorevoli oppure due favorevoli ed uno sconosciuto;<br />- inadeguato: semaforo GIALLO. Uno o più inadeguato/i ma nessuno cattivo; <br />- cattivo: semaforo ROSSO. Uno o più cattivo/i; <br />- sconosciuto semaforo BIANCO. Tre sconosciuti oppure due sconosciuti ed un favorevole.</p><p>Prima di poter attribuire il giudizio a ciascuna voce, è necessario verificare se vi sono fattori che possono portare almeno uno dei tre valori di riferimento favorevole a non essere raggiunto, mantenuto o raggiungibile nel futuro prossimo (<em>warning</em> <em>lights</em>). Complessivamente, 42 specie incluse nell’Allegato I della Direttiva Uccelli hanno stato di conservazione cattivo, 39 inadeguato, 6 favorevole e 1 sconosciuto; tra le specie non inserite, 35 hanno stato di conservazione cattivo, 44 inadeguato, 67 favorevole e 16 sconosciuto Per alcune specie è stato possibile valutare lo stato di conservazione per singole bioregioni e sono state prodotte classificazioni “a semaforo” per ciascuna bioregione ospitante la specie in oggetto. Per essere in stato di conservazione favorevole, una specie non deve essere semplicemente al riparo dal rischio di estinzione, ma deve avere un ruolo “significativo” nel proprio habitat di riferimento, rinvenendosi con frequenze e densità soddisfacenti e ricoprendo le funzioni ecologiche che le sono proprie. Le forti pressioni cui molte specie e popolazioni sono sottoposte (cambiamenti climatici, continuo degrado ambientale, variazioni ad ampia scala nella dinamica di popolazione), rendono necessario valutare accuratamente le minacce e pressioni cui la specie/popolazione sono soggette o potranno esserlo nel prossimo futuro, anche in caso di popolazioni superiori al FRV. Risulta, infine, evidente come i FRV dovranno essere sottoposti a periodica rivalutazione e aggiornamento, sulla base soprattutto dei nuovi dati che ogni sei anni vengono forniti dal Reporting sull’applicazione della Direttiva Uccelli.</p>

Nel ricorso alle tecniche di fecondazione artificiale extracorporea, la produzione di un numero elevato di embrioni e la crioconservazione dell’“eccedenza” è divenuta oramai una prassi. A prescindere dalle discutibili soluzioni adottate nei confronti degli embrioni “in eccedenza” per i quali non vi è più un progetto parentale, le stesse procedure di crioconservazione possono ridurre in modo drammatico le possibilità di sopravvivenza degli embrioni e rappresentare, quindi, un rischio per la vita dell’essere umano. Questa rassegna desidera esporre quanto si conosce, allo stato attuale, sul “rischio” per l’embrione crioconservato e documentarne l’entità attraverso le valutazioni statistiche offerte dai singoli autori. A tal fine vengono riportate: le principali metodiche; i limiti delle procedure di crioconservazione; la fase di sviluppo in cui la crioconservazione viene eseguita; i criteri utilizzati per valutare la qualità degli embrioni dopo lo scongelamento; i dati sulla sopravvivenza degli embrioni, sulle gravidanze e sulle nascite in alcuni centri di fecondazione artificiale. ---------- Production and cryopreservation of spare embryos has already become a routine in the practice of extra-corporal artificial fertilization techniques. Leaving out of considerations ethical problems of the questionable solutions which were taken regarding the “orphan” surplus embryos, who’s parents have no any more projects for pregnancy, it is necessary to underline that cryopreservation itself may dramatically decrease survival rate of embryos, which means create vital risk for human being. In the present review we attend to determine the eventual risks for embryo undergone cryopreservation examining the recent statistical data, published by different groups of authors. For this purpose we describe principal methods and critical points of cryopreservation, age of embryos in which cryopreservation occurs, criterions of evaluation of the quality of embryos after thawing, survival rate, pregnancy rate and life birth rate after cryopreservation in different centers in the world.

Riassunto. – 1) Si considera, in primo luogo, il procedimento di misura di una grandezza in ambito tecnologico nel quale è possibile accertare il valore vero della grandezza a meno di un errore aleatorio trascurabile rispetto a detto valore e quindi acquisire, ad un certo istante, in modo sostanzialmente esatto, lo stato di funzionamento di un processo. Per le grandezze economiche, tipicamente di natura monetaria, si tratta di accertare, per un determinato periodo, l’ammontare totale o quello medio di una popolazione e si devono utilizzare, per la loro stima, il risultato di indagini campionarie. L’errore medio di misura risulta quindi incrementato a causa della variabilità dovuta al campionamento. L’utilizzazione di schemi di campionamento efficienti assicura, però, che l’errore di misura di un totale o di una media aritmetica, rimane in pratica trascurabile rispetto al valore vero che può localizzarsi con sufficiente accuratezza. Viene illustrato questo aspetto con riferimento alla spesa famigliare annua media.2) L’obiettivo diviene diverso se si è interessati non ad accertare una situazione in un determinato periodo di tempo, ma si vogliono delle previsioni per periodi futuri in base ad un modello economico e/o econometrico. In questo caso l’errore di misura e di campionamento può risultare incrementato in modo non direttamente valutabile a causa della non esatta conoscenza del modello interpretativo o anche per l’impossibilità di realizzare gli interventi correttivi sul sistema economico suggeriti dal modello. Un caso tipico viene ravvisato nella previsione della misura dell’inflazione.3) Si osserva che la condizione di equilibrio di una economia di mercato può collegarsi alle scelte dei soggetti economici, cioè, in definitiva, alle scelte di individui che operano in accordo ad un’entità difficilmente definibile in termini generali e pertanto difficilmente “misurabile” indicata, come Utilità. Sorge il quesito, suggerito ad esempio dalla teoria cinetica dei gas, che, come per un gas ha scarso interesse, ad esempio, la velocità di una singola molecola ma lo ha invece il valore medio dell’energia cinetica delle molecole, espresso dalla temperatura, così può avere scarso interesse generale la misura dell’utilità percepita da un singolo consumatore, e si può invece pensare che abbia interesse qualche indicatore globale, che, − argomento da approfondire−, si ritiene possa collegarsi ai prezzi di mercato.4) Di fronte ad una pluralità di alternative soggette ad incertezza, che è una situazione tipica del “decisore” in ambito finanziario e d’impresa, la teoria di von Neumann-Morgenstern-Savage − che è stata soggetta a valutazioni critiche, revisioni e complementi − può essere utile per orientare verso le scelte che massimizzano l’utilità media, rispetto alle distribuzioni di probabilità ipotizzate, per le possibili conseguenze delle decisioni.Nelle ricerche di mercato, poi, la formulazione della nozione di utilità diviene più concreta e le tecniche psicometriche spesso utilizzate, consentono di individuare il “prodotto” più utile. Si è infine ricordato come è disponibile una metodologia statistico-probabilistica per la quantizzazione dei concetti, della quale si deve ancora approfondire l’impiego per la valutazione dell’utilità.***Abstract. − 1) As starting point the measurement procedure of a given quantity – representing a typical problem in the technological area – is considered allowing one to ascertain the true value of the quantity except for a zero mean random error which in practice often may be assumed to have a unessential root mean squared error or repeatability standard deviation. As for the quantities used in economic and social sciences – e. g..the economic quantities are often of monetary nature – with regard to a given finite population of elements, in general of human beings, a typical problem is of establishing the total amount of a chosen quantitative characteristic and /or the arithmetic mean, which have to be estimated on the basis of a sample survey. It follows that, in general, the random component of a single observation has a standard deviation greater than the one caused by repeatability owing to the presence of sampling variability. The use of efficient sample designs and a large sample size, however, ensure that the random errors of the estimates of the total amount and of the corresponding arithmetic mean may become unimportant with respect to their true values located through pertinent confidence intervals. An illustration is presented regarding the yearly mean expenditure of an Italian family.2) The investigation purpose becomes more complex when we not only want to know the real situation in a given span of time but also when we want to forecast future trends according to an economic or an econometric model. In this case the global random error, due to measurement and sampling variability, may be affected by a systematic bias, which is not easy to be evaluated because of the lack of a complete and exact knowledge of the model. As an example the econometric models of inflation is quoted.3) One can note that the equilibrium of a market economic system is connected to people’s preferences and choices according to an abstract entity named Utility, which is difficult to be defined in general terms and thus to be measured. Correspondingly, as in the gas kinetic theory the velocity of a single molecule can have no direct interest while on the contrary it does the mean value of the molecular kinetic energy expressed by temperature, likewise we can say that, in general, the Utility perceived by a single individual has little theoretical interest while a global Utility indicator of goods − which seems naturally linked to the market prices and deserves further investigation − could have a certain interest, e.g. for the aim of comparison4) In the area of finance and enterprise management a decision maker is typically confronted with preference between decisions in the face of uncertainty. In this context the theory of von Neumann - Morgenstern - Savage − which has been the subject of some criticism, revision and completion − may at times appear to be useful. More precisely, assuming a set of possible monetary consequences and some alternative probability distributions on it, the theory directs a decision maker towards the choice which maximizes the expected value or mean Utility within the values corresponding to the alternative probability distributions.In marketing research the notion of Utility assumes a more concrete character and the psychometric techniques, which are often used, allow one to point out the more useful product.. Finally the available statistical – probabilistic theory is mentioned which permits the quantization of abstract notions or concepts and whose appropriateness and use, with respect to economic utility evaluation, have still to be examined attentively.

Despite significant efforts have been directed toward reducing waste generation and encouraging alternative waste management strategies, landfills still remain the main option for Municipal Solid Waste (MSW) disposal in many countries. Hence, landfills and related impacts on the surroundings are still current issues throughout the world. Actually, the major concerns are related to the potential emissions of leachate and landfill gas into the environment, that pose a threat to public health, surface and groundwater pollution, soil contamination and global warming effects. To ensure environmental protection and enhance landfill sustainability, modern sanitary landfills are equipped with several engineered systems with different functions. For instance, the installation of containment systems, such as bottom liner and multi-layers capping systems, is aimed at reducing leachate seepage and water infiltration into the landfill body as well as gas migration, while eventually mitigating methane emissions through the placement of active oxidation layers (biocovers). Leachate collection and removal systems are designed to minimize water head forming on the bottom section of the landfill and consequent seepages through the liner system. Finally, gas extraction and utilization systems, allow to recover energy from landfill gas while reducing explosion and fire risks associated with methane accumulation, even though much depends on gas collection efficiency achieved in the field (range: 60-90% Spokas et al., 2006; Huitric and Kong, 2006). Hence, impacts on the surrounding environment caused by the polluting substances released from the deposited waste through liquid and gas emissions can be potentially mitigated by a proper design of technical barriers and collection/extraction systems at the landfill site. Nevertheless, the long-term performance of containment systems to limit the landfill emissions is highly uncertain and is strongly dependent on site-specific conditions such as climate, vegetative covers, containment systems, leachate quality and applied stress. Furthermore, the design and operation of leachate collection and treatment systems, of landfill gas extraction and utilization projects, as well as the assessment of appropriate methane reduction strategies (biocovers), require reliable emission forecasts for the assessment of system feasibility and to ensure environmental compliance. To this end, landfill simulation models can represent an useful supporting tool for a better design of leachate/gas collection and treatment systems and can provide valuable information for the evaluation of best options for containment systems depending on their performances under the site-specific conditions. The capability in predicting future emissions levels at a landfill site can also be improved by combining simulation models with field observations at full-scale landfills and/or with experimental studies resembling landfill conditions. Indeed, this kind of data may allow to identify the main parameters and processes governing leachate and gas generation and can provide useful information for model refinement. In view of such need, the present research study was initially addressed to develop a new landfill screening model that, based on simplified mathematical and empirical equations, provides quantitative estimation of leachate and gas production over time, taking into account for site-specific conditions, waste properties and main landfill characteristics and processes. In order to evaluate the applicability of the developed model and the accuracy of emissions forecast, several simulations on four full-scale landfills, currently in operative management stage, were carried out. The results of these case studies showed a good correspondence of leachate estimations with monthly trend observed in the field and revealed that the reliability of model predictions is strongly influenced by the quality of input data. In particular, the initial waste moisture content and the waste compression index, which are usually data not available from a standard characterisation, were identified as the key unknown parameters affecting leachate production. Furthermore, the applicability of the model to closed landfills was evaluated by simulating different alternative capping systems and by comparing the results with those returned by the Hydrological Evaluation of Landfill Performance (HELP), which is the most worldwide used model for comparative analysis of composite liner systems. Despite the simplified approach of the developed model, simulated values of infiltration and leakage rates through the analysed cover systems were in line with those of HELP. However, it should be highlighted that the developed model provides an assessment of leachate and biogas production only from a quantitative point of view. The leachate and biogas composition was indeed not included in the forecast model, as strongly linked to the type of waste that makes the prediction in a screening phase poorly representative of what could be expected in the field. Hence, for a qualitative analysis of leachate and gas emissions over time, a laboratory methodology including different type of lab-scale tests was applied to a particular waste material. Specifically, the research was focused on mechanically biologically treated (MBT) wastes which, after the introduction of the European Landfill Directive 1999/31/EC (European Commission, 1999) that imposes member states to dispose of in landfills only wastes that have been preliminary subjected to treatment, are becoming the main flow waste landfilled in new Italian facilities. However, due to the relatively recent introduction of the MBT plants within the waste management system, very few data on leachate and gas emissions from MBT waste in landfills are available and, hence, the current knowledge mainly results from laboratory studies. Nevertheless, the assessment of the leaching characteristics of MBT materials and the evaluation of how the environmental conditions may affect the heavy metals mobility are still poorly investigated in literature. To gain deeper insight on the fundamental mechanisms governing the constituents release from MBT wastes, several leaching experiments were performed on MBT samples collected from an Italian MBT plant and the experimental results were modelled to obtain information on the long-term leachate emissions. Namely, a combination of experimental leaching tests were performed on fully-characterized MBT waste samples and the effect of different parameters, mainly pH and liquid to solid ratio (L/S,) on the compounds release was investigated by combining pH static-batch test, pH dependent tests and dynamic up-flow column percolation experiments. The obtained results showed that, even though MBT wastes were characterized by relatively high heavy metals content, only a limited amount was actually soluble and thus bioavailable. Furthermore, the information provided by the different tests highlighted the existence of a strong linear correlation between the release pattern of dissolved organic carbon (DOC) and several metals (Co, Cr, Cu, Ni, V, Zn), suggesting that complexation to DOC is the leaching controlling mechanism of these elements. Thus, combining the results of batch and up-flow column percolation tests, partition coefficients between DOC and metals concentration were derived. These data, coupled with a simplified screening model for DOC release, allowed to get a very good prediction of metal release during the experiments and may provide useful indications for the evaluation of long-term emissions from this type of waste in a landfill disposal scenario. In order to complete the study on the MBT waste environmental behaviour, gas emissions from MBT waste were examined by performing different anaerobic tests. The main purpose of this study was to evaluate the potential gas generation capacity of wastes and to assess possible implications on gas generation resulting from the different environmental conditions expected in the field. To this end, anaerobic batch tests were performed at a wide range of water contents (26-43 %w/w up to 75 %w/w on wet weight) and temperatures (from 20-25 °C up to 55 °C) in order to simulate different landfill management options (dry tomb or bioreactor landfills). In nearly all test conditions, a quite long lag-phase was observed (several months) due to the inhibition effects resulting from high concentrations of volatile fatty acids (VFAs) and ammonia that highlighted a poor stability degree of the analysed material. Furthermore, experimental results showed that the initial waste water content is the key factor limiting the anaerobic biological process. Indeed, when the waste moisture was lower than 32 %w/w the methanogenic microbial activity was completely inhibited. Overall, the obtained results indicated that the operative conditions drastically affect the gas generation from MBT waste, in terms of both gas yield and generation rate. This suggests that particular caution should be paid when using the results of lab-scale tests for the evaluation of long-term behaviour expected in the field, where the boundary conditions change continuously and vary significantly depending on the climate, the landfill operative management strategies in place (e.g. leachate recirculation, waste disposal methods), the hydraulic characteristics of buried waste, the presence and type of temporary and final cover systems.

La presente indagine ha ad oggetto lo studio dell’ampiezza e dell’intensità del sindacato del giudice amministrativo sulle valutazioni tecnico-discrezionali esercitate dalla pubblica amministrazione nei giudizi espressi in materia di offerte anomale, ai sensi dell'art. 88 del D.lgs. 163/2006. In particolare, si è trattato di verificare se l’organo giurisdizionale debba limitarsi al controllo esterno sull’iter logico seguito dalla stazione appaltante nell’emissione del provvedimento di esclusione dell’offerta ovvero se possa, come si è cercato di dimostrare, spingersi sino alla verifica diretta dell’attendibilità delle operazioni tecniche, sotto il profilo della loro correttezza quanto a criterio tecnico utilizzato ed a procedimento applicativo, secondo il metodo del sindacato intrinseco. Nella prima parte del lavoro, ci si è dedicati ad un approfondimento circa lo sviluppo della nozione di discrezionalità tecnica rispetto a quella amministrativa, anche alla luce dell’evoluzione degli strumenti istruttori nel giudizio amministrativo. E proprio in ordine allo sviluppo dell’istruzione probatoria, particolare attenzione è stata dedicata all’introduzione della consulenza tecnica d’ufficio nel processo amministrativo di legittimità (recentemente confermata, seppur non senza alcune perplessità, nel nuovo Codice del processo amministrativo). Invero, proprio l’inserimento della consulenza tecnica tra i mezzi istruttori è parso essere, da un lato, punto di approdo delle ricostruzioni dottrinali in materia di discrezionalità tecnica ma anche, dall’altro, punto di partenza per un nuovo ruolo del giudice amministrativo. Venuta meno, infatti, una delle tradizionali giustificazioni all’esercizio di un sindacato secondo il modello estrinseco, il giudice potrà ora accedere direttamente al fatto controverso, nel pieno rispetto del giusto processo e del principio di effettività della tutela giurisdizionale, che lo porta a divenire giudice del rapporto controverso, oltre che arbitro della legittimità del provvedimento. Nella seconda parte, invece, è stata analizzata la disciplina delle offerte anomale nei procedimenti ad evidenza pubblica, con particolare attenzione alle posizioni giurisprudenziali che si sono espresse in materia. Prendendo le mosse, infatti, dall’articolazione del sub-procedimento di anomalia delle offerte, si sono vagliate le oscillazioni giurisprudenziali, tra posizioni di retroguardia ed indirizzi innovatori, proprio al fine ultimo di verificare quello che è stato il tipo di sindacato esercitato sugli apprezzamenti tecnici espressi dalla stazione appaltante nei giudizi di cui all’art. 88, comma 7 del D.lgs. 163/2006. E’ emerso, in esito alla ricerca, come la strada per compiere un sindacato intrinseco ed effettivo sulle valutazioni tecniche amministrative, stia, come efficacemente espresso dalla dottrina, nella visione dell’eccesso di potere come travalicamento, nell’esercizio del potere discrezionale, dei limiti di accettabilità delle decisioni dell’amministrazione alla luce di criteri di valutazione, logicità e ragionevolezza. Un vaglio che, pur rimanendo nell’ambito del controllo di legittimità (non trattandosi di valutare la “condivisibilità” della stessa sulla base di una nuova valutazione degli interessi coinvolti), volgerà alla verifica dell’accettabilità della valutazione tecnico-amministrativa, eventualmente alla luce del parametro tecnico fornito dal consulente, senza che ciò determini di per sé uno sconfinamento nel merito amministrativo e la violazione del fondamentale principio di separazione dei poteri.
This research concerns the wideness and the intensity of the control of the administrative judge over the technical – discretional valuations of the Public Administration in the contest of the judgment about “anomalous offers”, pursuant to par. 88 of the D.lgs. 163/2006. In particular, the research wants to verify if the judge has to restrict his judgment about the logic iter adopted by the contracting administration in case of exclusion of the offer, within the limits of the external control; or if he can also, and this is the aim of this work, directly verify the reliability of the technical operations with regard to the technical standard utilized and its application, in line with the method of the intrinsic control. In the first part of the work, the research starts with a necessary widening pursuant to the development of the notion of “technical discretion”, in comparison with the notion of “administrative discretion”, also considering the development of the pre-trial instruments in the administrative trial. With reference to the development of the pre-trial investigation, a special attention is paid to the introduction of the technical advice ex officio in the administrative trial of legitimacy (lately confirmed, although with some hesitation underlined in this work, by the new Code of the Administrative Trial). The introduction of the technical advice indeed, seemed to represent, on one hand, the landing place of the doctrinal reconstructions in technical valuations matter, but also, on the other hand, the starting point for a new rule of the administrative judge. In fact, fallen down one of the greatest justifications to the use of a mere extrinsic control, the judge will be now able to directly approach the controversial fact, fully respecting the principles of the fair trial and of the effectiveness of the jurisdictional protection. This new situation leads him not only to be judge of the controversial relation, but also arbiter of the legitimacy of the administrative provision. The second part is dedicated to the study of the “anomalous offers” in the public contractual proceedings and to the analysis of the relative jurisprudential positions. Starting from the articulation of the “anomalous offers sub-proceeding”, in this work are analyzed the jurisprudential oscillations between positions of rearguard and innovative trends, in order to verify the kind of control used by the administrative judge over the technical – discretional valuations of the Public Administration in the contest of the judgment ex par. 88 of the D.lgs. 163/2006. From the outcome of the research, emerges that the way to develop an intrinsic and effective judgment on the administrative technical valuations lies, as effectively expressed by the scholars, in the consideration of the action ultra vires as a crossing over, in the exercise of the discretional power, of the limits in the acceptability of the decisions of the public administration, by the light of the criteria of valuation, logicality and reasonableness. It is a sifting that, even remaining within the control of legitimacy (in fact the problem is not to valuate whether the choice is “shareable” in consideration of a new valuation of the interests involved) will move toward the verification of the acceptability of the technical-administrative valuation, in case by the light of the technical criteria provided by the adviser, excluding that this could neither overrun in the administrative merits nor break the basic “division of powers” principle.
