Texto completo"Liberalizzazione delle attività economiche e governo del territorio: lo «statuto» urbanistico delle attività produttive" (“Liberalisation of economic activities and the administration of the territory: the town planning "status" of the productive activities"): the starting point of this research is the reconstruction of the concept of town planning and its evolution under both the domestic and regional legislation; then, the analysis focuses on the statutes of productive activities. The attention is mainly devoted to their planning and forecasting in the territory, taking into account the (growing) deregulation forces, also emanating from the EU, and the consequences at the economic and social levels. It follows a first main issue, namely whether it is up to local governmental instruments to deal with (and, consequently, to promote) the economic development in the relevant territory; and, if so, where the cause and the consequence lie: that is, whether it is the land-use planning, as provided by the competent local administrations, to create the economic and productive system within a territory or, conversely, whether the relevant territorial system is affected by overarching economic boosts. This explains the deeper analysis of the process of the Single Desk for Productive Activities (‘Sportello Unico Attività Produttive ‘(SUAP)), with particular reference to the proceedings in the so-called town-planning variant, which allows the establishment, expansion and transfer of productive facilities in the relevant area. This is possible from its establishment by d.p.r. 447/1998 until the most recent and current reforms. The research then looks at the application of this instrument under regional laws and judicial interpretations. Also the issue of the so-called business town planning is considered, starting from its (problematic) classification within the framework of productive activities.
