Texto completoIn one sense the adjective systemic means what is “relating to or involving a whole system”. With this definition as reference, this study concerns the (dys)functioning of domestic legal systems from an international perspective. The word systematic refers also, in human rights matters, to what is practiced “on a large scale” revealing the absence of care and the absence of rationality in the legal sense, and which can be measured in terms of procedures and legal obligations. These two definitions of the word systemic represent two principal aspects of our research, as they are linked to eachother. In studying international jurisprudence related to human rights matters, our research aims, on one hand, to build a category of violations that we designate as systemic and to demonstrate the particularity of their legal treatment. On the other hand, we will demonstrate the manner in which human rights jurisdictions adapt to this type of violations. Finally, there is the aim of illustrating the specificity of international liability of the state arising from systemic violations

Texto completoSpecial sessions are one of the major innovations of the reform that established the Human Rights Council in 2006 as a subsidiary body of the United Nations General Assembly. While the Council holds three regular sessions each year, a special session allows States to respond to an urgent situation by organizing a debate, to assess and qualify violations and also to establish investigative mechanisms. The systematic analysis of the twenty-six special sessions held in nearly a period of twelve years illuminates, not only the balance of power between the actors involved, but also a new dynamic of international law, integrating international humanitarian law and international criminal law into the field of competence of the Human Rights Council

s Truth and Reconciliation Commission. The aim of the analysis is to explore the ways in which the testifiers perform their identities, construe their experiences of life under apartheid, and position themselves and their audiences in relation to these experiences.
