Texto completoThe issue of the legal definition of grant has long been blotted out and constrained. Nowadays, in a context of confusion between this notion with the closely related notion of public procurement, it is more than necessary to tackle it. A single distinctive feature seems efficient to isolate itself from this nearby type: its very nature of public gift or, to employ the French “civil law” terminology, its quality of “gratuitous act”. The research for the two elements used in French private law to identify such an act proves to be conclusive. Furthermore, it reveals the specificity of this item in public law. Animus donandi can originally be combined with general interest, and this raises grant as a real gift with charges of public law. Public gift, as specific as it is, fashions the rules applied to grants. It provides this notion with a genuine legal status, which turns out to be consistent and intelligible. The funding mechanism is ruled by the concept of general interest, and its implementation is governed by its conditional quality. Grants proves to be a public gift, and it is ruled as such. This conclusion couldn’t have been reached without meeting with the heuristic value of the concept of public gift

Texto completoThis doctoral dissertation explores the ramifications of a specific European research funding initiative, namely the European Research Council (ERC), within the broader context of the sociology of scientific professions, science, and public action. Focused on researchers in the realms of universe sciences and history within the academic landscape of French universities, this study systematically examines the transformative impact induced by the ERC's project-based funding paradigm on the dynamics of research. Scrutinizing alterations in the identities of researchers and the intricate fabric of both individual and collective scientific relationships, the thesis closely examines the distinct call for projects put forth by the ERC. By analyzing the selection processes leading to the identification of "excellent" individuals and projects, the investigation dissects the intricate interplay between institutional incentives for project submissions, national and international configurations of the university market, operational logics, and a diverse array of epistemic cultures.The socio-technical framework of the European Research Council (ERC) at the European level and the incentive policies at the national level are strategically devised to enhance the support for exploratory, individual, and "excellent" research endeavors. In this context, an inquiry arises: How do the recipients of ERC grants perceive their application process to the ERC and evaluate the success of their respective projects? The narrative meticulously traces the trajectories of laureates throughout the lifecycle of their projects. This involves a close scrutiny of the rationales underpinning their decision to seek ERC funding, the intricacies of candidacy construction, and an exploration of the identities of laureates tasked with orchestrating personalized collectives within the project mode. The dissertation culminates in a thorough analysis of the broader implications of ERC funding on the careers of scientists in the observed disciplines, as articulated by the interviewees

Texto completoThe results of a query, carried out under university professors in France and Germany, led to improvement potential not only for decisions in politics and administration but also for the management of science, especially the management of co-operations in research. The query results confirmed that there are still national distinctions in France and Germany and the experience at the universities in Strasbourg (France) and in Offenburg (Germany) wasn't made by coincidence. Furthermore the query data have shown a lot of differences in behaviour between scientists in "traditional" and "modern" technologies. However, very often the results didn't reflect the desire of the political research programmes, to improve the co-operation between universities and industries in applied research, especially in the sectors of key technologies

Texto completoOur research aims at analyzing the economic feasibility of approaches for product diversification and quality characteristics improvement by firms, in a context where these modifications are subject to technical constraints that induce high costs not necessarily valued by the market. In this context, we try to understand how it is possible for public authorities to intervene in order to encourage firms to make sufficient efforts (in terms of upstream investment) and facilitate the marketing of products in response to the needs of society. We apply these research perspectives to two important issues, namely the GM/non-GM coexistence and the health and nutrition issue through the development of product lines which are more acceptable from a nutritional point of view (for example, less sugar, fat, salt…). These two research issues are developed by mobilizing the tools of the Theory of Industrial Organization. The results show that the spontaneous choice of product lines by firms is not always socially satisfactory, which implies that in certain conditions, public intervention is desirable. In the case of GM/non-GM coexistence, non-GM products may not have the desired characteristics in the absence of regulation. In terms of health issues, companies in the market do not offer high nutritional value foods in the absence of public intervention. Overall, this thesis concludes that it is often necessary to combine several public instruments. In the first study, we show that the public authorities can effectively manage the GM/non-GM coexistence by acting simultaneously through the labelling threshold definition, the quality tests and controls, and the level of the penalty cost in case of non compliance. In the second study, we show that an intervention through Research and Development (R&D) subsidies has some weaknesses such as the risk of manipulation of the grant by firms, or the possibility of triggering distortions to the detriment of public health. This suggests combining the R&D subsidies with another instrument such as taxation

Texto completoIn the context of setting up clusters and the latest laws on decentralization (2004 and 2013), the regions saw their skills for economic development and innovation increased. That’s why they are more involved in the conduct of science and technology policies. Thus, this study aims to examine the effectiveness of science and technology policies (S&T) at the regional level. Indeed, the legitimacy of this level in the S&T policy could be challenged since the production of technology tend to be more and more globalized. Moreover, this regional legitimacy can be approached from the perspective of regional innovation systems (RIS), which constitute a theoretical framework suitable for the treatment of this issue. Considering the importance of regional level, especially in economic and technological policies, SRI is a framework which aims to analyze the links between science, industry and local governance. Faced to these challenges, the Aquitaine Region asks itself questions. Indeed, it has increased its S&T budget since the last ten years and today is the French region with the highest S&T budget per capita. Now the Aquitaine Region wants to know how effective its S&T policy is. Is this effort in terms of S&T necessary or justified? What is the consistency of regional policy over time? What is the result of such a policy a socio-economic point of view? These issues will be studied using of evaluation’s tools. Furthermore, we offer to synthetize the objectives of S&T and the means used by the Region and we develop a comparative approach to other regional experiences on differents dimensions of innovation

Texto completoToday, innovation is one of the essential variables of the growth of the economy and employment. However, its financing is complex. This justifies the intervention of public authorities. In France, the public powers therefore have two main tools for encouraging companies to increase their R&D expenses, direct aids (and similar) and tax incentives. However, the main mechanism in support of innovation in France is a fiscal aid measure, namely the research tax credit. A powerful instrument for encouraging R&D since 1983, it has become, since its last major reform in 2008, the preferred incentive measure of companies and, at the same time, the State's second leading expenditure. A departure from anonymity followed by a step into controversy, since due to its increasing weight within the French economy, the research tax credit is prompting many questions. The most widely-shared question naturally relates to the reality of its efficiency, with supporters and detractors in equal measure. But this mechanism also elicits other questions and other observations. Since while it seems to be agreed that this credit offers many advantages for its beneficiaries, the fiscal security of the latter nevertheless appears to be fragile. Moreover, the very choice of a fiscal expenditure as a support measure is of concern, both with regard to its actual advisability within the internal order and in terms of its linkage with the European regulations relative to State aid. This could justify an adaptation of the mechanism on the basis of the provisions of another system used in another sector, but that does not currently have the same deficiencies as the research tax credit
