Texto completoThe thesis aims to reconstruct, enhancing the historical-legal context of the time, the contribution of Agostino Gemelli to the development of criminal law. In this respect, the research begins from the end of the nineteenth century, following Gemelli during his “positivist” training at the University of Pavia and, simultaneously, the evolution of coeval criminal law scolarship, committed to face the demands for change initially conveyed by criminal anthropology, and later collected by the Positive School of Enrico Ferri. Moving from the stalemate arisen at the beginning of the last century between the latter and the forces “of tradition”, the investigation deals with Gemelli’s critique of the positivists’ theories, carried out on both the anthropological and the legal field. The analysis of this pars destruens is followed by an evaluation of Gemelli’s pars costruens – the program for a Catholic criminal law presented at the Social Weeks of 1924 – and of its match to the principles informing the criminal law reform developed by the Technical-juridical School. Particular attention is devoted to the considerations expressed by the author, in light of the notion of “personality of the criminal”, on the provisions of the Rocco Code, both during its preparation process and when it came into force.

Texto completoInternational criminal justice before domestic courts. Proposals for the implementation of Italian provisions on crimina iuris gentium. The thesis aims at proposing solutions for the incorporation into the Italian legal system of International Criminal Court (ICC) Statute’s substantive provisions, whose domestic implementation is, at the moment, still lacking. The research develops, in particular, along three main sections. The first part sketches the main features of the indirect implementation of international criminal law by domestic legal systems. It deals, first of all, with the complex system of sources of international criminal law, as well as with the role of customs, in light of its tensions with the (international and constitutional) principle of legality. The analysis of international courts’ shortcomings leads to shift the scope of enquiry to the indirect implementation of international criminal law, in order to shape effective solutions for an integrated system of international criminal justice, under the complementarity principle (articles 1 and 17 ICC Statute). Within this framework, the extent of positive obligations to adopt domestic provisions on international crimes effects, in a comparative perspective, different solutions implemented by national legislators, considering the wide margin of discretion granted them by the ICC Statute. The second part outlines the extension of national jurisdictions to international crimes committed beyond their traditional territorial borders. The research focuses, firstly, on the notion and the structural shortcomings that characterize the principle of universal jurisdiction in the enforcement of international criminal justice since the Second World War. The section further sets out to verify the controversial 'tendential universality' of Italian criminal law, according to the interpretation of articles 7 - 10 Italian Criminal Code favored by the Italian jurisprudence, regarding in particular cases amounting to international crimes. The third section represents the heart of the research, dedicated to the evaluation of the compliance of provisions currently in force in the Italian criminal system and international criminal law. The research further proposes the introduction of a specific discipline, whenever gaps and shortcomings with respect to the ICC Statute are found. The analysis moves from the special part of criminal law, in order to investigate the conformity of criminal provisions already in place with the definition of international crimes contained in articles 5 et seq. ICC Statute (genocide, crimes against humanity, war crimes and aggression). The general part is examined with the aim to investigate, on the one hand, the adequacy of ordinary criteria for the attribution of criminal responsibility and, on the other hand, the need to introduce an ad hoc discipline where required by specific instances of international criminal law. The reference is, in particular, to the hypotheses of command and superior responsibility, legal entities liability, irrelevance of functional immunities, as well as statutes of limitations. The research ultimately seeks to ascertain whether the adoption of substantive provisions on international crimes enables the Italian legal order to adhere to an integrated system of international criminal justice and, in a broader sense, to contribute to the development of international criminal law. Indeed, the late implementation of the ICC Statute into the domestic legal system constitutes, according to the conclusions reached by the analysis, an opportunity to expand its provisions in order to overcome its possible shortcomings and to comply with the most recent developments of international criminal justice. Such conclusion would enable to relaunch the role of the Italian legal system in the international criminal justice system and make its legislative intervention, as well as its future jurisprudential applications, a model on the international scene.

Texto completoThe dissertation examines how offenders deal with “critical rethinking” on their crimes. According to art. 27 d.P.R. 30 June 2000, n. 230, it consists in a dialogical reflection on the wrongdoings they committed, their motivations, the consequences that follow on for the offenders themselves, and the possible reparations during the post-sentencing phase. The study is divided into five chapters. The first chapter focuses on the research for a constitutional basis of the “critical rethinking” and for a renewed understanding of the “finalismo rieducativo” (equivalent to the rehabilitative goal). The second chapter highlights the points of intersection between the “critical rethinking” and the “general theory of crime”. The third chapter summarizes the obstacles and the operative problems that hamper the implementation of this dialogical reflection and describes hints for a possible reform of the criminal justice system, particularly with regard to the post-sentencing phase. The fourth chapter proposes an in-depth analysis of some of the basic key-concepts for the introduction of a dialogical-restorative model of justice. Finally, the fifth chapter investigates the relationship between “rehabilitation” and “restorative justice” and takes into consideration a justice model that is inspired by “responsivity” [John Braithwaite] and “restorative justice dialogue” [Mark S. Umbreit]. By means of that, the study aims at providing a framework for an active assumption of responsibility in a more dialogical and inclusive culture.

Texto completoThe present research examines the European Directive on the right to information in criminal proceedings (Directive 2012/13/EU, hereinafter ‘the Directive’), assessing the impact that it is likely to have on the Italian legal system. Before analyzing the legislation, the thesis provides an historical overview of the status of human rights safeguards in the EU and a description of its multi-layered system of protection. Starting from the early ECJ case law setting out a ‘human rights theory’, the research moves on to consider the Charter of Nice and the development of a European Area of Criminal Justice, until the Stockholm Program and the entry into force of the Lisbon Treaty. In addition, it addresses the question as to whether and to what extent the directives ‘of new generation’ based on art. 82 par. 2 TFEU bring an added value to the aforementioned human rights protection system. Chapters 2 and 3 of the research focus on the analysis of the legislation and on the three meanings that the Directive attaches to the right to information in criminal proceedings, namely, the right to information about rights, the right to information about accusation, and the right to information about case file. The effort is shedding some light on the most innovative prescriptions, while at the same time highlighting how much the EU legislation owes to the ECtHR case law, which is used as a yardstick for the evaluation and interpretation of the Directive. Finally, Chapter 4 addresses the Italian implementing legislation (d. lgs. 101/2014) and the impact of the Directive on our legal system. It finds that the NIM is highly unsatisfactory, as the Italian legislator has failed to comply with the most innovative EU standards. In this regard, the research illustrates the impact of EU prescriptions on the jurisdiction of national judges, in particular, the impact of the ‘new’ right to information about accusation. It concludes that Italian judges can (in)directly apply ECtHR case law standards due the direct effect of the Directive (which can be regarded as an ‘ECtHR case-law codification’).
