Texto completoSexual assault has been an issue facing institutions of higher education for many years (Office of Civil Rights, 2011). Alcohol plays a role in both who have been victims of sexual assault and who have perpetrated the crime of sexual assault (Crawford, Wright, & Birchmeier, 2008). The purpose of this study was to look at sexual misconduct at institutions of higher education and to determine if substance use, such as alcohol or drugs, is a factor in the incidence of sexual misconduct happening to students on college campuses. The quantitative data section of the study reviewed three years of data from the Survey of College Health and Behavior. Baseline data were reviewed to show the rate of individuals experiencing nonconsensual sexual contact. Almost 6% of students reported they were taken advantage of sexually due to alcohol use. Over 16% reported they had engaged in risky sexual behavior due to alcohol use, and over 3% had been taken advantage of sexually due to alcohol use by others. Over 1% of students reported they had taken advantage of someone due to their alcohol use. More than 18% of students reported using alcohol or drugs to feel more comfortable with a sexual partner. Half of the 12 survey questions asked had an average of over 70% of respondents who had utilized protective factors. For the qualitative portion of the study, seven interviews were conducted with Title IX Coordinators at higher education institutions in the Midwest with experience ranging from one year to 15 years of working with sexual misconduct in the collegiate setting. Four themes emerged from the interviews: consent, communication, programming, and promotion. Based on the findings from this study, students need to be aware of the connection between substance use and sexual misconduct.

Texto completoThe purpose of this study on university handling of Campus Sexual Assault (CSA) was to understand the experiences of Title IX Coordinators as key administrators in this work. CSA continues to be a pervasive problem, and the dialogue on campuses and externally is highly contentious. Guidance from the federal government, combined with a recent surge in lawsuits against universities, have created a precarious legal context for CSA that is exceedingly difficult for universities to manage. How institutions handle the array of moving parts with CSA is largely absent from the current literature. This study interviewed university Title IX Coordinators, who are responsible for overseeing the institutional response to CSA and therefore are uniquely positioned to offer insight into how universities are handling the problem and the internal and external factors that are playing a role. Sixteen interviews were conducted of Title IX Coordinators responsible for overseeing student CSA matters at NCAA Division I institutions. The research questions guiding this study included: (a) how do Title IX Coordinators handle and carry out their responsibilities related to CSA; what shapes the ways in which Title IX Coordinators handle their responsibilities related to CSA, and (b) how does university culture influence Title IX Coordinators’ work related to CSA? The theory that emerged from the data indicates that Title IX Coordinators have an array of complexities to navigate in their CSA work, stemming from an interplay of both internal and external pressures and factors, that can lead to a range of outcomes that are most often negative. Using grounded theory methodological procedures, a theory and visual model were generated to explain the interactions among the following components: Title IX Coordinator values and priorities; processes involved in CSA work; university culture and structure; collaboration with and management of university partners; the legal landscape and external context; and case outcomes and Title IX Coordinator impact. The theory has implications for policy, for Title IX Coordinators and universities, and for future research

Texto completoThe Management of children, younger than twelve years of age, who pose a risk to other children, remains complex and confusing. When their behaviour includes sexual aggression towards other children, ignorance about how to manage them becomes even more challenging. Society has an expectation that any sexual aggressor should be punished, however, when the aggressor is younger than ten years old, different responses are necessary. The aim of this current study was to explore the management of learners with sexual behaviour problems, within the primary school setting. The main question underpinning this study was: How are children, aged five-to-nine-years, with sexual behaviour problems, managed by social workers and educators? A qualitative methodology, with focus group discussions and semi-structured interviews were used to conduct this study. Educators from primary schools, as well as social workers from the Western Cape Education Department, were purposively selected to form the sample for this study. Focus group discussions were conducted with the educators, while semi-structured interviews were conducted with the social workers.

This thesis examines sexual abuse and violence against women by priests. Using public complaints made in Brazil between 1994 and 2000 as an empirical base, it details 203 articles related to 21 cases of sexual misconduct by clergymen, including sexual abuse, rape, and the violation of vows of celibacy. These articles were grouped to create a dossier on each of the cases and numbered sequentially. Brazil´s most important media sources were consulted, including online news sites and non-governmental organizations (NGOs) across the country. Two representative cases were chosen and studied in depth. Interviews were conducted with plaintiffs, witnesses, members of the Church hierarchy, and attorneys involved in the cases, preserving the anonymity of all interviewees. Utilizing a sociological perspective, the analysis explores the mechanisms by which the Catholic Church attempts to cover up such cases. Showing the specificities of the violence perpetrated against women by priests, the study points toward the existence of structural causes of this violence and their different manifestations, examining them through the lens of feminist theory. The study suggests that a specific analytic category should be developed in order to better comprehend this particular type of violence against women. The term clerical violence is proposed for describing this type of violence, whose structural aspects include gender asymmetries, the separation between clergy and lay members, patriarchal discourse, the sexualization of ministerial relations and the force of symbolic violence. The work of Pierre Bourdieu is useful in understanding religion as a symbolic system that endows the priest with sacred power. Given that the causes of clerical violence are mainly structural, likewise, structural solutions are needed in addressing the issue
Esta tese tem por objeto, relações de abuso e violência sexual de padres contra mulheres. O campo empírico delimita-se às denúncias públicas feitas no Brasil entre os anos 1994 e 2002. Foram mapeadas 203 matérias sobre 21 casos de má conduta sexual de religiosos, abuso sexual, estupro e infração dos votos de celibato. Essas matérias foram agrupadas de modo a compor um dossiê de cada um dos casos noticiados, numerados sequencialmente. Para realizar esta pesquisa foram consultados os veículos de mídia mais significativos do país, sítios de agências de notícias e ongs atuantes em todo o território nacional. Dois casos paradigmáticos foram selecionados e estudados em profundidade. Realizou-se entrevistas com denunciantes, testemunhas, membros da hierarquia, e advogados/as envolvidos/as no caso. Preservou-se o anonimato de todos/as os/as entrevistados/as. A análise feita, desde uma perspectiva sociológica, evidencia os mecanismos existentes na Igreja Católica para o ocultamento dos casos denunciados, estuda as especificidades da violência perpetrada por padres contra mulheres e aponta as causas estruturais dessa violência. Recorrendo às teorias feministas, são abordados os fatores causais da violência contra as mulheres e suas diferentes manifestações. O contato com essa bibliografia e o tratamento dos dados sugere a necessidade da elaboração de uma categoria específica que ofereça elementos para a análise da violência praticada por autoridades eclesiásticas contra mulheres. Trabalha-se os aspectos estruturais que constituem essa categoria, denominando-a violência clerical. Tais aspectos referem-se às assimetrias de gênero, à separação entre clero e laicato, ao discurso religioso patriarcal, à sexualização das relações ministeriais e à força da violência simbólica. O pensamento de Bourdieu ajuda na compreensão da religião enquanto sistema simbólico que reveste a figura do padre de um poder sagrado. Uma vez que as causas da violência clerical são principalmente de origem estrutural, entende-se a necessidade de buscar soluções estruturais no enfrentamento da questão

Texto completoThis doctoral thesis aims at shedding light on the processes by which individuals and organizations negotiate their structure, position, and evaluation, within the context of creative and cultural fields. It contains three chapters that represent three research studies. The empirical analyses undertaken throughout the research pieces are focused on the fields of cinema (first chapter), quality television, and independent music (second and third chapter) in the United States. For all of them, longitudinal databases are employed, and both quantitative and qualitative methodologies are utilized. In the first chapter, the role of personal (sexual and non-sexual) scandals for peer recognition is investigated. The research focuses on how scandals, gender stereotypes, and engagement in diversity-valuing behaviors (female solidarity) affect peer recognition for Hollywood actors (nomination of actors for an Oscar), in the time frame 2003-2018. In the second chapter, the process of emergence and consolidation of an interstitial issue field is theorized, by exploring the case of the field that emerged between indie music and the quality television in the United States from 2003 to 2018. In the analysis, the features of the institutional infrastructure of the emerged field, with the role of institutional actors and of interstitial spaces, are taken into consideration. In the third chapter, the fields of independent music and quality television in the US are further examined, between 2013 and 2018, by focusing on the patterns of evaluation of one field’s products (independent music, independent albums) when this field interacts with the other (quality television) – that is, when independent albums are featured in quality television episodes.

Abuse of Authority in Sexual Misconduct purpose is protect sexual autonomy and the minority in society. The interpretation of Art. 228 of the criminal code rules a person who takes advantage of his authority over another who is subject to his supervision because of family, guardian, tutor, benefactor,official, or occupational relationship and who has carnal relations with or commits an indecent. However, ever since the amendment to our national Criminal Code in 1999, the differentiation between Article 221 in the Criminal Code and Article 228 in the Criminal Code are unapparent. Through the literature of the domestic scholars, practical case study analysis Article 228 in the Criminal Code. By gather the judicial case and make a detailed analysis the Article 228 in the Criminal Code. Hope it can protect the sexual autonomy and the minority in society.
