As a serious field of academic study for approximately forty years, Discussions in Dispute Resolution: The Foundational Articles constitutes both a celebration of the dispute resolution field’s most influential commentaries in its first few decades and a reflection of what makes these pieces so important. In this book, the editors have identified sixteen foundational writings published before the year 2000. They consist of four pieces from each of the field’s primary subfields—negotiation, mediation, and arbitration—as well as four pieces that are more public policy focused and do not neatly fit in one of those three categories. In each section, the works appear in chronological order, and each has four commenters who are answering the question: Why is this work a foundational piece in the dispute resolution field? The purpose in asking this simple question is fourfold: to hail the field’s foundational generation and their work, to bring a fresh look at these articles, to engage the articles’ original authors where possible, and to challenge the articles with the benefit of hindsight. And, where possible, we give authors of the original pieces the opportunity either to reflect on the piece itself or to respond to the other commenters.

This chapter discusses Wilder's first professional successes in the 1930s and 1940s. Wilder's first big impact on the music of his time, a series of short pieces with unusual instrumentation that he wrote between 1938 and 1940, came about through the support and persistence of his Eastman friend Mitchell Miller—one of the premiere oboists in New York. Wilder and Miller eventually formed the Alec Wilder Octet, along with harpsichordist Yella Pessl and the CBS Orchestra, releasing records in 1939 and 1940 on Brunswick and Columbia. As the 1940s progressed, Wilder solidified his standing in popular music with new arranging projects and original songs. He then continued to explore stylistic boundaries in a new series of octet recordings and he revived his theatrical ambitions in scores for three musicals with new collaborators.

Reflecting on the “silence that enshrouds” the latter, Bourdieu sketches the broad outlines for a study of the division of scientific objects into categories like “noble or vulgar, serious or futile, interesting or trivial.” Underpinning this discussion is his unwavering commitment to the goal of scientific autonomy, which demands that scientists choose their objects based on scientific considerations alone, without regard for commercial, political, or cultural pressures, disciplinary fads and fashions, professional considerations, or other solicitations originating outside the scientific field.

Is ‘process’ necessarily more important than ‘outcome’, and is there too much emphasis on ‘we’ and ‘others’ in the debate rather than on the created work at the end of the process? Lin Zhaohua’s Coriolanus serves as the case study in the chapter but other modern spoken drama productions and traditional song-dance theatre adaptations are also mentioned to offer readers a broader understanding of Shakespeare on the Chinese stage.

Bradbury articulated his feelings in “A Flight of Ravens,” his highly autobiographical story of the final days of his New York trip.

This chapter examines a collection of Bach chorale harmonizations copied in Dresden sometime during the 1730s, with the goal of clarifying both its likely provenance and purpose. “Sebastian Bach’s Choral-Buch” is a collection of chorales—melodies with figured bass, intended to accompany singing—given in a sequence similar to that found in many hymnals. The mid-eighteenth-century manuscript was purchased from Hans P. Kraus, Vienna, in September 1936 by the Sibley Library at the Eastman School of Music. This chapter first describes the Sibley Choralbuch before reviewing its provenance and content. It then considers the manuscript’s significance as a possible source of evidence for the practices of the circle of organists who studied with Johann Sebastian Bach in the 1730s and 1740s. It argues that Choralbuch served as a workbook for learning how to create four-part settings but had a double usefulness: Bach could assign particular chorale melodies for the pupil to work on as test pieces, while the anthology could serve to accompany chorale singing at services.

Martin Roth was a student and later cantor at the Pforta school near Leipzig. His sixteen surviving motets are contained in the anthology Florilegium Portense, issued in two volumes in 1618 and 1621. Consisting largely of double-choir motets, this collection is a retrospective of late Renaissance style, intersecting with seventeenth-century usage in Lutheran churches. The collection consists of 165 pieces by about ninety composers and was used widely in schools and churches throughout central Germany. These motets were performed on a weekly basis as late as 1770 for services at the main churches in Leipzig; J. S. Bach purchased new copies in use at the St. Thomas School in 1729, mentioning that the old copies had been sung to pieces (zersungen). The fact that such late-Renaissance motets were performed in rotation for some 150 years in Leipzig lends depth to our understanding of baroque performance practice.

This chapter focuses on Marga Richter's works during the 2000s, a period that saw her compose emotionally charged music. Since the year 2000, Richter has composed music of a more intimate nature, employing a simpler harmonic and melodic language but still embodying her distinctive voice. These works include several song cycles, some of a humorous nature, a variety of chamber music, a return to solo piano music, and two unaccompanied woodwind pieces (clarinet and oboe). Almost all of them were commissioned, and all have been performed. Richter has also learned to use a computer music-notation program (Sibelius), and in 2011 she established her own Web page, margarichter.com. This chapter first considers Richter's humorous works, including Erin Odyssey and Bye-Bye Bake Shoppe, before discussing her serious songs such as Testament and Dew-drops on a Lotus Leaf. It also examines her chamber and solo pieces, along with her compositions after moving to a new house.

This chapter marks another threshold in Wolff's musical career: Burdocks. Drawing performative techniques from the improvisatory Scratch Orchestra and heterophonic textures inspired by an African field recording, Burdocks was Wolff's first work intended for a large ensemble. It was his first multimovement work in which each movement had distinctly different instructions on how and what to play. And it was his longest in actual (not just conceptual) performance. In addition, Wolff also had to contend with competing political ideologies between his two mentors, John Cage and Cornelius Cardew, the founder of the Scratch Orchestra. Yet the chapter argues that Wolff's musical “transitional point” came not so much in Burdocks or political intent, but in a new approach to melody that began with a series of piano pieces he wrote in 1969–1970.

The Eclogues, Georgics, and Aeneid abound with plants, yet much Vergilian criticism underestimates their significance beyond attractive background detail or the occasional symbolic set-piece. This work joins the growing field of nature-centred studies of literature, looking head-on at Vergil’s plants and trees to reveal how fundamental they are to an understanding of the poet’s outlook on religion, culture, and mankind’s place within the world. The first half of the book explores the religious and more diffusely numinous aspects of Vergil’s plants, from awe–inspiring sacred groves to divinely promoted fields of corn, showing how both cultivated and uncultivated plants fit within and help to shape the complex landscape of Vergilian (and, more broadly, Roman) religious thought. In the second half, the focus moves to human interactions with plants from the perspectives of both cultivation and relaxation, exploring the love–hate relationship with vegetation which sometimes supports and sometimes contests the human self-image as the world’s dominant species. Combining a series of close readings of a wide range of passages with the identification of broader patterns of association, this book reveals and celebrates the complexity and variety of Vergilian flora.

Spiritual sickness troubles American medicine. Through a death-denying culture, medicine has gained enormous power—an influence it maintains by distancing itself from religion and spirituality, which too often remind us of our mortality. As a result of this separation of medicine from spiritual traditions, patients facing serious illness infrequently receive adequate spiritual care despite the large body of empirical data demonstrating its import to patient meaning-making, quality of life, and medical utilization. This secular–sacred divide also unleashes depersonalizing social forces through the market, technology, and legal-bureaucratic powers that reduce clinicians to tiny cogs in an unstoppable machine. Hostility to Hospitality is one of the first books of its kind to explore these hostilities threatening medicine and offer a path forward for the partnership of modern medicine and spirituality. This book is a supplementary aid to coursework preparation and particularly to revision for examinations and coursework. It does not present model answers to be slavishly imitated but, rather, examples to help the student understand the topic and see how it might be approached. The examinee’s objective is to accumulate in the time allowed as many marks as possible, a goal that needs to be broken down into three stages: namely, planning, execution and review. These days law examinations can take different forms, including seen questions, open book exams and so on.
