Resumen
This paper argues in favour of a conception of self-determination which involves the equal recognition of different national identities. It proceeds by, first, criticizing the dominant territorial (in contrast to national) conception of self-determination. It then addresses three main criticisms of a principle of national self-determination. These are (1) the argument from indeterminacy; (2) the argument from instability; (3) the problem of overlapping nationalities.

The principle of national self-determination has been haunting the world since the French Revolution. In Eastern Europe and the former Soviet Union alone 20 new “nation-states” were created in the 1990s—200 years after the French Revolution. They were all established on the basis of the principle of national self-determination. There may be no other term in modern political discourse which is used with more emotion and passion. Recent history has known many wars fueled by conflicting interpretations of self-determination. Woodrow Wilson thought that implementation of the principle of self-determination would lead to a better world, a world without wars and “safe for democracy.” His secretary of state, Robert Lansing, had doubts. He suspected the concept of self-determination to be “loaded with dynamite” and capable of causing even more bloodshed because it “will raise hopes which can never be realized.”

On the theatrical stage, the term “dénouement“ refers to the resolution of a dramatic complication. On the stage of world events, few historical periods can rival the present situation in the Soviet successor states for satisfying this definition more exactly. On December 21, 1991, eleven men—all, ironically, former communist party officials—signed an agreement in Alma-Ata, Kazakhastan, resolving that the Union of Soviet Socialist Republics “henceforth will cease to exist.” With this announcement, the “Soviet experiment” came to an end and a new world, inchoate and uncertain, began to emerge.

Resumen
Many liberal theorists misinterpret nationality and the demand for national self-determination. This paper asks what is the claim for national self-determination. Following this, it is asked which way of meeting the demand is the best one. While analysing the circumstances in which the demand is raised, it is argued that this claim is political rather than cultural, and that therefore some of the solutions which have been put forward in theory and in practice (especially autonomy) do not meet this claim. It is also argued that the failure of many Western politicians and political theorists to address the demand for national self-determination as a political demand derives from three reasons: methodological, moral and ideological.

Resumen
This work seeks to settle the doctrine of self-determination in international law. Drawing upon a selection of historical thinkers who have concentrated upon the value of freedom, a theory of political liberty, is developed. This is situated in relation to political history from the Age of Revolutions on. The development of the formal principle of self-determination is discussed. This reveals a doctrine lacking coherence. The philosophy of political liberty is proposed as a foundation for self-determination in law. The way this new approach manifests itself in practice, and its merits, are considered in relation to the politics of Crimea, with a focus on the immediate post-Soviet period of 1991-2002. In conclusion, a programme for implementation and refinement is offered. It is also noted that one could fashion a new approach to international law as a whole on the basis of the logic that is employed here to settle the doctrine of self-determination.

I conflitti internazionali restano per lo più irrisolti nel mondo moderno, nonostante le linee guida e le raccomandazioni che sono gli strumenti fondamentali del diritto internazionale. Le ragioni di questi conflitti sono ovviamente non solo l'elaborazione insufficiente della normativa in uno o in un altro settore specifico. Ci sono molti altri motivi, come quelli: politici, economici, etnici, socio-psicologici e socio-culturali, i quali alimentano i conflitti e non consentono il processo di pace per lo sviluppo. La revisione degli strumenti giuridici internazionali che regola l'autodeterminazione dei popoli deve dare un risultato positivo nella risoluzione dei conflitti etnici sorti negli ultimi decenni. Oggi, per risolvere tali conflitti vengono coinvolti non solamente due partiti che difendono posizioni opposte, ma anche partiti terzi - ovvero i cosiddetti "gruppi interessati". Chiare regole dei documenti fondamentali del diritto internazionale, vincolanti per entrambe le parti del conflitto, dovrebbero risolvere il conflitto senza l’influenza da parte dell'esterno e in conformità con i principi giuridici internazionali, in materia di obblighi in relazione con la Carta delle Nazioni Unite "non interferire negli affari che formano la competenza interna di uno stato ".

This thesis demonstrates that by redefining the notion of nationhood and by treating nations and national minorities equally with respect to self-determination, it is possible to formulate basic principles of the international legal system, which would promote territorial integrity and stability of multinational states better than the existing system. I demonstrate that theories dealing with self-determination based solely on human rights or cases of secession address the problem with inadequate tools. I also show that minority-rights approaches do not accommodate self-determination claims of national groups properly.
I offer a new idea of nationhood as a political culture of self-determination with which people self-identify. It includes beliefs about co-nationals' mutual membership in a political community, which is perceived by them as having a self-determining power. Definitions of nationhood which use the notion of culture, but not political culture, are both too inclusive---they fail to distinguish between national and ethnic groups, and too exclusive---they overlook multicultural nations.
Contested secession has received much attention in recent scholarship. Since, however, contested secession is based upon the disagreement of two or more national groups concerning their self-determination within particular boundaries, I consider secession within the scope of a systematic approach to the regulation of relations among national groups. I propose that international legal principles should be based upon the recognition of states and national groups as the two basic elements of the international system, and the equal recognition of nations as political cultures of self-determination. I interpret self-determination as a claim to equality within the boundaries a multinational state, and formulate a criterion of minimal justice for states. It requires that states respect equality of self-determination of national groups on their territory. National groups can secede from multinational states either by mutual agreement, or if their they are persistently denied a status with respect to self-determination equal to that of other national groups.

This dissertation examines the theoretical aspects of communication and coexistence among different and sometimes competing national cultures in contemporary liberal-democratic states. As its primary example, the study focuses on the quest for self-determination of Canada's indigenous peoples, but the theoretical significance of the project extends well beyond the bounds of this particular case. With this end in mind, the dissertation advances and defends a set of normative political principles which could, with certain necessary modifications, serve to guide just, equitable, and stable relations among different national cultures in a broad range of cases and contexts. The discussion opens with the development of a model of cross-cultural understanding and accommodation, which in turn is used to demonstrate the manner in which the theory and practice of liberal democracy often serves to legitimate the assertion of the authority of particular national cultures over their relatively smaller and weaker rivals.
In opposition to this more conventional liberal approach, the dissertation proposes a reformulation of the theoretical and institutional bases of liberal conceptions of national sovereignty and self-determination. This alternative approach bypasses any attempt to identify authentic or foundational liberal values which must frame and govern the principle of national self-determination, and which assert their categorical primacy over competing normative ideals and traditions. This approach to self-determination balances, on the one hand, the importance of more localized national ends, ideals, and institutions with a concern, on the other, for universal standards of democratic conduct, responsibility, and governance. What results is not a grand theory of national self-determination, but rather a set of flexible principles which can be attuned to different cultural contexts and circumstances, and which are subject to the democratic consent of the nations or peoples concerned.

The right of peoples to "self-determination” is influenced by varying motives in different times and geographies in its implementation, and is rarely operated according to its foundational ethic and legal bases dating back to the Kantian concept of free will and the international laws codified after the World War II. Particularly, political economy has always played an important but usually covered role in the application of this principle to national or international disputes. This paper aims to explain the dominance of political economy in international decision making processes about the people making a claim for their own state, and to highlight the changing nature of political economy supporting sometimes the sovereign states and sometimes the sub-state level ethnic groups. In this context, the theoretical development and the application of “self-determination” principle is assessed relatively by historical comparison method. Field research for the study comprises archival research of primary and secondary resources. This paper concludes that the political economy has usually greater influence on the application of “self-determination” to the national and international disputes than its ethic and legal content, and that the paradoxical content of this principle contributes to the redistribution of lands usually in compliance with the interests of great powers.

In this 2021 Nulungu Reconciliation lecture, Dr Robert Isaacs AM OAM will explore the meaning of reconciliation and the lessons of his personal journey in two worlds. As part of the Stolen Generation, and born at the dawn of the formal Aboriginal Rights Movement, this lecture outlines the changing social attitudes through the eyes of the lived experience and the evolving national policy framework that has sought to manage, then heal, the wounds that divided a nation. Aspirations of self-determination, assimilation and reconciliation are investigated to unpack the intent versus the outcome, and why the deep challenges not only still exist, but in some locations the divide is growing. The Kimberley is an Aboriginal rights location of global relevance with Noonkanbah at the beating heart. The Kimberley now has 93 percent of the land determined through Native Title yet the Kimberley is home to extreme disadvantage, abuse and hopelessness. Our government agencies are working “nine-to-five” but our youth, by their own declaration, are committing suicide out of official government hours. The theme of the Kimberley underpins this lecture. This is the journey of a man that was of two worlds but now walks with the story of five - the child of the Bibilmum Noongar language group and the boy that was stolen. The man that became a policy leader and the father of a Yawuru-Bibilmum-Noongar family and the proud great-grandson that finally saw the recognition of the courageous act of saving fifty shipwrecked survivors in 1876.

Resumen
After the Cold War, not only the economic discontent created by capitalism and globalization went to the extreme, leaving the environment at the mercy of multinational corporations, but also the perception that the sovereignty, autonomy and independence of nations, and with them, the right to self-determination was increased to a limited extent. In particular, as the global crises of 2008-2009 hit people’s lives hard, the sense of "being left behind" prepared the ground for the demand and supply of populist politics. However, populist governments not only failed to achieve any progress on the main problems complained about, rather the contrary, but primarily right-wing authoritarian-populist governments also worsened the situation by threatening multilateralism, democracy, human rights and the free market economy worldwide. Besides, the Covid-19 pandemic since 2020 posed quite mixed results for the future of populism. While the populists gained strength in the opposition, the right-wing populists in government began to lose power. Therefore, in such an environment, in Brazil, the rise of Lula’s left-wing (and to some extent populist) government to power after defeating a right-wing authoritarian government has potential implications for the future of democracy, human rights, the market economy, and multilateralism. If the Lula government takes a reformist, transformative, and progressive path, it can become a positive role model for other countries under populism threat. However, this article questions the possibility of that under local and global constraints.

Companies and investors in land-based sectors have a responsibility to respect human rights and the legitimate tenure rights of Indigenous Peoples, local communities, and Afro-descendant Peoples (IPs, LCs, and ADPs). These responsibilities are evident in international frameworks, national laws, emerging regulation, industry best practices, and the social and sustainability policies and commitments made by progressive companies and investors. As a result, comprehensive human rights and environmental due diligence (HREDD) processes are required for companies and investors to proactively assess the potential impacts of their enterprises on collective rightsholders and establish measures to prevent, mitigate, and remedy potential harms tied to their business operations, supply chains, and investments. Secure tenure and the effective engagement of local rightsholders are critical to the success of HREDD, and community monitoring provides a pathway to building reciprocal and rights-based relationships that bridge the divide between communities and companies/investors. Community monitoring (CM) refers to a process in which IPs, LCs, and ADPs assess and collect data on business operations that may affect their lands, territories, resources, rights, cultures, and livelihoods. Communities utilize this data to inform and shape business practices, prevent/address negative human rights and environmental impacts, and hold companies and investors accountable to crucial laws and standards. Where partnerships are developed, CM can help companies and investors improve their compliance with these laws and standards, including their internal policies and commitments, as well as reduce operational and reputational risks. Most importantly, CM supports more direct, balanced, and rights-based partnerships between communities and companies/investors, which are required to continually respect the legitimate tenure rights and self-determination of IPs, LCs, and ADPs—rights that are intrinsically tied to achieving global climate and biodiversity goals and associated corporate sustainability agendas. In response to this burgeoning opportunity, this document shares emerging ideas, principles, and good practices to socialize the concept of CM among companies and investors in land-based sectors, as well as outline steps they can take to meaningfully engage with IPs, LCs, and ADPs to monitor and respond to the potential environmental and human rights impacts of their operations, supply chains, or investments.
