This book brings together studies produced during the implementation of the MIUR-PRIN 2005/2007 inter-university project on 'The individual in domestic and community legislation: new models for protection and management of environmental and genotoxic risks'. The managers of the working groups organised itinerant study days in Messina, Florence and Rome, also with a view to in-the-field verification of different experiences and realities. Within the framework of interdisciplinary liaison, the important contributions made by eminent scholars have enabled the in-depth study at legal and medical level of the most appropriate tools for guaranteeing preventive and restrictive mechanisms in relation to protection from the damage of potentially genotoxic environmental, occupational or individual factors. This is the most recent approach to the new code of the environment, utilising the principle of precaution which is intended to induce the jurist and the medical scientist to discern profiles of continuity and discontinuity in the promotion and protection of individual values.

Resumen
Issues of continuity, survival, and identity have generated apparently unending debates throughout the Jewish world for centuries. While similar issues arise in all Jewish communities, there are significant differences between them. This collection was designed to highlight differences as well as similarities by devoting a chapter to each of seven countries: Argentina, Australia, Canada, France, South Africa, the United Kingdom, and the United States. In four communities-those in Australia, Canada, the United Kingdom, and the United States-debates about continuity are mainly concerned with the loss of Jewish identity through assimilation. In Argentina and South Africa, the main issue is with physical survival in the face of chaotic social conditions. In France, although the situation is less dire, the community feels threatened by the rise of xenophobic political movements and the hostility of Arab groups. Apart from external factors, all the contributors review debates over the relative importance of religion and ethnic identity, and the contrasting positions taken by religious leaders and secularists. While the study offers no clear-cut answers, it does aim to broaden the debate by exposing national differences.

This chapter reviews the 1964–79 period, during which the social tensions accumulated over the previous decades erupted, a wave of political violence without parallel in Europe shook the country, and the steep rise of labour’s bargaining power caused a persistent wage shock. Political consensus was sustained by spending policies aimed at particularistic inclusion, leading to both a fragmented welfare system and growing budget deficits, which were largely monetized. Driven also by a challenging international environment, macroeconomic disequilibria accumulated. Although the country’s institutions were increasingly inappropriate, TFP growth and Italy’s convergence to the productivity frontier nonetheless continued, sustained also by the rise of industrial districts. Several mutually reinforcing vicious circles set in, however: the collusion between political and economic elites intensified, clientelism and corruption rose, organized crime strengthened, and after two decades of convergence the South resumed its decline relative to the rest of the country.

This chapter critiques the binary dichotomy between the concepts of “continuity” and “rupture” within theoretical conceptualizations of the law. Whereas legal theories such as Kelsen’s emphasize rupture, theories such as Dworkin’s emphasize continuity. These theories fail to account for legal continuity and rupture because the law is neither a gapless system nor a coherent whole. Building on the comparative study of the role of law during revolutions, the chapter shows that a revolution maintains varying levels of legal rupture and continuity with the pre-existing legal order. Building on critical legal theory and social theory, it argues that the relation between revolution and legality cannot be represented systematically because law—whether prior to or after the revolution—is incoherent and thus generates a plurality of voices.

This chapter aims to guide practitioners and managers in setting up and reviewing community outreach services for people with severe mental illness from a non-technical service planning perspective. Examples of different service configurations within a comprehensive local system are given, with some observations on their relative merits and drawbacks from evaluations. Service models and structures are important for providing a framework for delivering quality care, yet from the perspective of the service user, many of these service details—integrated care, specialization, caseload size, staffing mix, ownership of beds, and degree of shared caseload—are invisible. For people with severe mental health problems, patients and carers value the principles of good community-based care, such as access, responsiveness, consistency, and continuity.

David Sellar (1941-2019) was a pioneering historian of Scots law who convincingly and conclusively rejected previous interpretations of the subject as a series of false starts and rejected experiments. He emphasised instead the continuity of legal development in Scotland, with change a process of integration of external influences with indigenous customs from very early times on. Thus down to the present Scots law embraces Celtic and other customary elements reaching far back into its past, while also having been open to innovation from the developing Canon, Civil, Feudal and English Common law since the middle ages. This too has left deep marks upon the law’s character as a “mixed legal system”. Sellar’s approach, articulated mainly through essays published in diverse places over four decades, had significant influence upon general understanding of legal history in Scotland as well as leading to appreciation elsewhere of its comparative significance. The major essays gathered together in this single collection demonstrate the scope and reach of Sellar’s overall contribution. Its distinguishing mark is the perspective that Sellar himself brought to bear, which was one no other previous writer in the field could achieve, especially in relation to Celtic and Canon law.

This chapter treats various issues concerning Leibniz’s accounts of force and of corporeal substance: the status of passive force, given that substance is a thing that acts, how extension is founded in force, and the issue of substantial bonds. It is argued that Leibniz’s position is that an entelechy can never act in isolation: its action must always take into consideration the actions of the other created substances with which it coexists. Extension arises from the resistance to penetration resulting from the diffusion of entelechies and passive forces throughout matter, while the unity and continuity of body is relative to the observer. Leibniz does not propose substantial bonds out of dissatisfaction with this standard account, but in an attempt to satisfy the Jesuits’ demand for the real union of body and soul, which ultimately conflicts with the actuality of subordinate forms implicit in his own position.

This Conclusion is intended as a straightforward recapitulation of the principal arguments of this study: that Aquinas’s thought on the composition of human nature and the body in particular cannot be understood apart from the theological and social context that informed it; that Aquinas’s account of matter is far more subtle than is conventionally supposed; that Aquinas presents a clear account of the autonomy of the body relative to the soul, and that this revolves around the body’s accidental structural form, dimensive quantity; and that Aquinas’s thought on the postmortem continuity of the matter particular to individual bodies is muddled, and that this should not lower but if anything raise our opinion of him as a thinker, especially given his innovative exploitation of Averroes’ theory of matter and the doctrinal consequences of his thought on the body more generally, in the late thirteenth century and beyond.

This chapter examines constitutional developments in Yemen. It covers Yemeni constitutional history before unification, the fate of the 1991 Constitution, and the Constitution of 2001. It argues that despite the relative political continuity (in the sense that there have not been successful military coups or significant elite changes in decades), constitutionalism in the country may be characterized as being two-fold. First, numerous constitutional articles are ambiguous and amenable to adverse interpretations because they leave too much of the constitutional rights to be defined by laws, thereby undermining the effectiveness of the said articles. The same applies to ordinary parliamentary laws, for they refer many important details to executive regulations, by-laws, ministerial resolutions, or Islamic jurisprudence. Second, while there has been a tradition of constitutionalist thinking at least since the 1940s, central elements of constitutionalism are missing. Checks and balances are weak, and the rule of law is far from being reality. Separation of powers is not even constitutionally fully guaranteed, much less applied in practice.

Lu Xun was claimed and canonized as a Marxist by the Chinese Communist Party, while Japanese and Western critics frequently read his work as a critique of modernity. Whereas the latter approach tends to trace the continuity in his writings, the Marxist approach largely brackets his earlier work. This chapter attempts to bring Marxist theory in dialogue with Lu Xun’s work in a different way, by focusing on his early writings and reading them in relation to various theorists. Through a close reading of two of Lu Xun’s early essays, “On the Destruction of Malevolent Voices” and “Imbalanced Cultural Development,” this chapter examines debates within the Marxist tradition, especially about issues related to global capitalism and the possibilities of a socialist future in countries on the periphery of the world-system. In this way, Lu Xun and Marxist theory can illuminate one another.

This chapter analyzes concrete Egyptian and Tunisian cases that showcase the interplay between continuity and rupture. These cases illustrate the lack of a systemic relation between law and revolution. On the one hand, the judiciary that interprets and applies the law is part of the very social and political conflicts it is supposed to resolve. On the other hand, the law is incoherent and there are often resources within the legal materials to play it both ways. Thus, the different forces at work use both continuity and rupture to advance their positions. Furthermore, legitimacy discourse mediates the contradictions between law and revolution in the experience of different legal and political actors. This mediation serves an ideological role because it presupposes a binary dichotomy between continuity and rupture, papers over law’s incoherence by reducing it to a singular voice, and reduces revolution to an event rather than a process.

This article examines the concept of cognitive environment in relation to ecocriticism. It discusses Gaston Bachelard’s analysis, in his The Poetics of Space, of historian Jules Michelet’s work depicting the building of a bird’s nest. It suggests that the corporeal act of nest-building may then be argued to imply the continuity of an organism and its environment and that the notion of enclosure is built into any ecology or Thoreavian economy.

This chapter examines John Locke's notion of psychological connectedness. It suggests that Locke is interested in the (nontransitive) relation of psychological connectedness, and not interested in the (transitive) relation of memory-link-based psychological continuity that has drawn the attention of many of the “neo-Lockeans.” It also suggests the psychological connectedness that matters to Locke is narrower—more fine-grained—than psychological connectedness as ordinarily understood; and this is not simply because consciousness is not the same as memory. The chapter concludes by considering Locke's theory of personal identity as a theory of moral responsibility—given the assumption that the notion of moral responsibility is a coherent one at all.

This chapter examines debates on intellectual property (IP) and development in the wider context of issues relating to IP and the public interest. It also considers how calls for greater attention to development in the global IP system relate to campaigns for “access to knowledge” (A2K). After reviewing the longstanding debates on IP and public policy issues as well as the substance of debates on IP, development, and A2K, the article discusses the engagement of developing countries in the international IP system up until the end of the World Trade Organization’s Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) negotiations. It proceeds with a review of post-TRIPS debates on the Agreement itself, before concluding with an analysis of the continuing challenges of addressing public interest and development concerns in the increasingly complex global IP system.

This volume seeks to redress a gap in the study of Orthodox Christianity, which has largely remained gender blind. It engages women’s lifeworlds, practices, and experiences in relation to Orthodox Christianity in multiple, varied localities, discussing both contemporary and pre-1989 developments. The contributions in the volume critically engage the pluralist and changing character of Orthodox forms of institutional and social life in relation to gender by using feminist epistemologies and drawing on original ethnographic research to account for previously ignored themes, perspectives, knowledges, and experiences of women in Orthodox Christian contexts. The volume pushes out the understanding of Orthodox Christianity in new directions by looking at Orthodox women of diverse backgrounds in different settings: parishes, monasteries, the secular spaces of everyday life, and under shifting historical conditions and political regimes—and by offering new theoretical insights. The volume combines the depth of ethnographic analysis with geographical breadth. Employing various research approaches and methodologies, the contributions engage two major intertwined lines of analysis—continuity and transformation—in social practices, demographic trends, and larger material contexts at the intersection between gender, Orthodoxy, and locality. To be sure, continuity contains the seeds of change, and transformation emerges within seemingly rigid structures and practices, in defiance to claims—coming both from within and without Orthodox Christianity—that Orthodox Christianity is immutable and fixed in time.

A comprehensive, case study portrait of the childrearing context of a predominantly Eskimo village in the remote Northwest Arctic, designed to look for evidence of reinvention, transformation, or conscious choice as process features of change in the mix of traditional childrearing beliefs and practices with infusions from the dominant culture. The rearing environment and child well-being were studied during 18 months of anthropological fieldwork in an Alaskan Inupiaq village in the Northwest Arctic. Volunteers for the sample consisted of 44 adults from 16 extended families who were raising a child between the ages of three and six years. Results from guided interviews, card sorts, standardized family and home assessments, and review of the children's medical records revealed a complex portrait of culture continuity and change and included the following trends: • many traditions had been retained, even though villagers perceived few differences in their rearing style compared to that of mainstream culture • despite the presence of other households with extended family members in the village and touting of the value of kinship, 25% of core families reared their children in relative isolation • growth measurements, immunization status, and general health of the children were good, but children evidenced diets high in sugar and many suffered severe dental problems • present-day caregivers were engaged in dialogue about problem parenting behaviors that had developed a generation earlier during a time of massive acculturation stress and population growth—namely, the overuse of scolding of children without attached explanations and overt favoring of specific children over others in the family. The study presents present-day rearing strategies and ideas as summarized from interviews and data from more formal instruments, and frames changes in the system within the broader historical/social context.

This chapter presents a critical analysis of the case law of the European Court of Justice and of the General Court relating to the application of the international law of treaties. It covers the some forty cases in which the Courts have referred explicitly to the Vienna Convention on the Law of Treaties 1969, and a few more where this happened implicitly, during the period 1998–2010. Inevitably the emphasis falls on the application of the rules of treaty interpretation to the international agreements concluded by the European Union (EU), but also to the founding treaties of the EU itself. The Courts have been confronted with great regularity with questions relating to the law of treaties and thus have become increasingly sophisticated in their use of it. The recent accusation that the Court is adverse to international law seems to be based on a few dramatic cases, not on the steady stream of smaller cases in which the law of treaties plays a role.

This chapter traces the history of intentionality in the phenomenological tradition, from Brentano and Husserl through Heidegger and Merleau-Ponty to Iris Marion Young, emphasizing the continuity and deepening of the concept through the tradition. Brentano’s conceptions of the intentional relation and the intentional inexistence of the object were taken up and transformed in Husserl’s expansive conception of intentionality as the sense-apprehension and sense-making that runs through the whole of experiential and cognitive life. Intentionality, moreover, encompasses not just consciousness’s explicit relation to objects, but also the vaguer awareness of horizons and habitualities (“horizon-intentionality”). Heidegger radicalizes Husserlian intentionality by reframing it in terms of the transcendence of existence. Merleau-Ponty further expands Husserl’s conceptions of embodied and practical intentionality as ambiguous transcendence. Iris Marion Young adds an interesting new dimension through her concept of the socially constituted, inhibited intentionality of women’s bodies.

Plans for further expansion came to a halt due to a high-intensity nuclear energy debate and the Chernobyl accident. After a short resurgence in the early 2000s, political parties and voters shifted towards the anti-nuclear position after the Fukushima disaster. The chapter underlines the importance of path dependency in energy policy and concludes that government policies in consensus democracies with many political parties and coalition government are relatively unresponsive to public opinion and changes in the electoral performance of parties, because there is continuity in parts of the government’s composition in most cases.

In this chapter a method is shown for applying the linear momentum equation, together with the continuity equation and either Bernoulli’s equation or some other information about static pressure, to the analysis of a diverse range of practical problems. A key aim is to demonstrate that it is possible to establish a relatively simple theoretical basis which can give quite accurate and useful information about the performance of such complex machines as jet and rocket engines, the jet pump, and the Pelton turbine. Other examples include flow through a sudden enlargement, a convergent nozzle, a pipe bend, a pipe junction, and a cascade of guidevanes. For each example it is shown how to define a suitable control volume.

The inhabitants of most urban and rural communities in both Britain and Ireland during the later medieval period would have lived a relatively short distance from either a watermill or windmill. This chapter examines the most recent archaeological evidence for water- and wind-powered mills in later medieval Britain. The use of water power, in particular, was widespread in the later medieval period for a wide range of industrial activities. However, during this same period nearly all of the grain harvest was processed in either wind- or water-powered mills. The archaeological record also demonstrates a large degree of continuity, from the late Roman and early medieval periods, in the design of waterwheels and the mechanisms they actuated.

Stephen R. C. Nichols explores the principles of interpretation at play in Jonathan Edwards’ exegesis. He argues that the underlying principle of his exegesis was harmony. This principle carried several implications for interpreting Scripture: that Scripture is the best interpreter of Scripture (that is, Scripture is harmonious with itself); that the Bible exhibits doctrinal harmony; and that Scripture achieves a harmony with the regenerate reader. Despite this view of harmony and Edwards’ continuity with the Reformed and Puritan traditions of interpretation, Nichols also holds that he was willing to experiment with that tradition, particularly in relation to typology, sometimes blurring the line between typology and allegory. Nichols concludes that Edwards both functioned within the boundaries of his tradition and explored creative innovations.

In this chapter it is shown how Bernoulli’s equation can be applied to practical fluid-flow problems. In the case of internal flows, such as that through a Venturi tube, it is also necessary to use the continuity equation to relate changes in cross-sectional area to changes in flow velocity. For liquid flows it is shown that for sufficiently high flowspeeds the static pressure could fall below the saturated vapour pressure and lead to cavitation. The designs of various flow-measuring devices, including the orifice-plate flowmeter, the Venturi-tube flowmeter, and the Pitot tube, are based on Bernoulli’s equation. The changes in flow velocity occurring in flow through a wind-tunnel contraction are explained by Bernoulli’s equation.

Prior to the progressive development of the law of armed conflict (LOAC) heralded by the 1949 Geneva conventions—most particularly in relation to the concepts of international and non-international armed conflict—the customary doctrine on recognition of belligerency functioned for almost 200 years as the definitive legal scheme for differentiating internal conflict from ‘civil wars’ in which the law of war as applicable between states applied de jure. Employing a legal historical approach, this book describes the thematic and schematic fundamentals of the doctrine, and analyses some of the more significant challenges to its application. In doing so, the book assesses whether, how, and why the doctrine on recognition of belligerency was considered ‘fit for purpose’, and seeks to inform debate as to its continuity and utility within the modern scheme of LOAC.

The Italian poet Dante Alighieri (1265–1321) is invoked several times in the work of Giorgio Agamben, often in passing to stress a point, as when discussing the political relevance of désoeuvrement (KG 246); to develop a thought, as in the articulation of the medieval idea of imagination as the medium between body and soul (S, especially 127–9); or to explain an idea, as in the case of the artistic process understood as the meeting of contradictory forces such as inspiration and critical control (FR, especially 48–50). So while Agamben does not engage with Dante systematically, he refers to him constantly, treating the Florentine poet as an auctoritas whose presence adds critical rigour and credibility. Identifying and relating the instances of these encounters is useful since they highlight central aspects of Agamben’s thought and its development over the years, from the first writings, such as Stanzas, to more recent texts, such as Il fuoco e il racconto and The Use of Bodies. The significance of Agamben’s reliance on Dante can be divided into two categories: the aesthetic and the political. The following discussion will address each of these categories separately, but will also emphasise the philosophical continuity that links the discussion of the aesthetic with that of the political. While in the first instance Dante is offered as an example of poetic innovation, especially in relation to the use of language and imagination, in the second he is invoked as a forerunner of new forms of life. Mediality and potentiality are the two pivots connecting the aesthetic and the political.

This chapter will first introduce some of the core tenets of polarity theory and practice tools (the Polarity Map®, the five-step “Small” process, and the Polarity Approach for Continuity and Transformation (PACT) assessment) and then relate them contextually in the unfolding of Charleston’s story, which includes a broad range of challenges, which involved a devastating tragedy and its aftermath. The conclusion calls for leaders and organizational systems to broaden competency to supplement “or” thinking with “and” thinking to increase resilience, reduce polarization, and enhance the quality of life for all.
