Grand Duke Konstantin Nikolaevich (1827–1892) was the governor of the Kingdom of Poland from June 1862 to October 1863, that is, on the eve and during the Polish uprising. Despite the high degree of knowledge of this crisis period in the history of Russian-Polish relations, the Warsaw Grand Duke’s court remained outside the research focus of historians. The court of the Grand Duke-viceroy was a unique space where symbolic relations between the dynasty and the subjects were built. In Warsaw Konstantin Nikolaevich implemented his own «scenario of power». The key ceremonial mode was the image of the unity of the empire. The viceroy faced difficulties in finding Polish courtiers loyal to the empire and widely involved his subordinates from the Naval Ministry. Based on a wide range of documents from the GA RF, OR RGB, OR RNB, RGIA, RGA VMF and sources of personal origin, the genesis and functioning of the court of the Grand Duke, as well as the everyday life of the august family in several Warsaw residences are considered. The introduction of new sources into scientific circulation made it possible to establish the circle of courtiers, the financial support of the court and practices peculiar for the court. Despite the long absence of the emperor’s brother in the northern capital, the main function of maintaining his state activity continued to be executed by the staff of the Marble Palace.

Abstract The will of Richard of Elmham, canon of St. Martin‐le‐Grand London and a clerk active on the fringes of the royal court, throws light on Richard's family circle, his comparative degree of wealth and his relations with such leading courtiers as the justiciars, Geoffrey fitz Peter and Peter des Roches. It is possible that Richard was one of the chancery scribes of King Henry III. Certainly, he enjoyed close relations with the king's chancellor Richard Marsh and with the family of chancellor Ralph de Neville.

Purpose of Study: The compensation for running a job is to get wages. There is one form of wage protection through minimum wage. The fact is, there are still workers who have not earned a minimum wage of minimum wage after they run their jobs. One of them is the court palace of Yogyakarta Palace. This study aims to analyze the validity of the court servants in getting wages below the minimum wage. Methodology: This legal research uses a socio-legal approach. The result of this research is Abdi Dalem get wages in the form of “kecuca” which amount is less than the minimum wage of Yogyakarta Province. Sultan Hamengkubuana X should be prosecuted for violation of Article 90 paragraph (2) jo. Article 187 of Law Number 13 Year 2003. The right to prosecute of the courtiers has never been implemented because the working relationship between the courtiers and the Sultan is devotion. The sense of service is the soul of the agreement on which the working relationship is based. What has been agreed upon by the parties binding as the law for the party making it (Article 1338 B.W. Burgerlijkwetboek). Results: The significance of this research is that the principle of local wisdom which is the basis of working relations can be unleashed. Implications/Applications: The contribution of this research is the emergence of an understanding that the employment relationship is not solely aimed at earning wages. A sense of tranquility after work becomes the choice of the destination of the courtiers to serve the Sultanate of Yogyakarta.

Abstract This article situates the court of the Tungkhungia kings of Brahmaputra Valley (1680–1830), in present day Assam, in the space of courtly convergence and response in eighteenth-century South Asia. It studies a particular moment in the Tungkhungia royal court (1714–44) when a unique political arrangement (“two kings”) was expressed by courtiers, chroniclers, and poets in the language of a stylized fiction of love. The article tries to make meaning of the “two kings” problem by looking at a set of textual and visual materials and situates them within a context of “multilayered cultural semiotics” at work in borderland courts in eighteenth-century South Asia, loosely held within the crumbling edifice of Mughal Hindustan. Toward this end, the article uses its research findings to add fresh insights on the ongoing discussion on courtly culture in early eighteenth-century South Asia and highlights the importance of studying emotions towards understanding political practice.

Resumen
Images created on Maya ceramics represent an interesting source for the research on Maya royal court. Many scenes shows life of the Maya nobles, their activities in the court and intimate rituals of the rulers. In this work I focused on one aspect of the interactions between king and his courtiers and subjects, that is on gestures they perform. I studied all the gestures that appears on the vases to understand the patterns of their usage and their possible meaning. I tried to discover their importance in communication, their significance in iconography and analyze a body language hidden behind them. I also compared twenty classified gestures to ones depicted on monumental sculpture, figurines and epigraphy. My research revealed the great complexity of the subject but it also helped to shed some light on the relations prevailing at the royal court.

Abstract The turn of the eighth century witnessed, for the first time in Chinese history, a concentration of poems written by exiled courtiers. In an era when mobility was limited by curfews, passes, and vehicular technologies, banishment to faraway places, accomplished by a decreed use of exclusionary post-station horses, ironically became a sanctioned and expedited means of traversing new territories. Through the poetic texts circulated via the highly developed post-station system, the empire’s center in the north became more connected to its distant margins than ever before. This article argues that these poems, characterized by centripetalism and constituting a petitionary genre, contributed to a new way of envisioning the empire as a whole and in its totality, and if we define “court” as a field of dynamic power relations, then these poems are court poetry, whose definition must be expanded to reflect the catholic nature of the term “court” itself.

This study is concerned with preliminary presentation about the organization of the court of Marie Casimire d’Arquien, wife of voievod of Sandomierz – Jan Zamoyski, called „Sobiepan”between 1658–1665. The article touched on topics related to personal details and functions performed by officials and officers. Issues related to the clerical and administrative level, officials, who performed their functions in an ad hoc manner and the existence and organization of the women’s court, were discussed. The main emphasis was put on issues of remuneration and further careers of courtiers and their attitude towards their lord. Problems, connected to client and patron relations, were also examined. The research showed a weak relationship between the wife of the ordinate and officials who were fully subservient to Zamoyski’s will. Their full devotion and dependence on landings and salary payments meant, that Maria Kazimiera often fell into conflict with her subordinates. As a foreigner, she did not understand the relationship – specific to Polish political culture –between the patron and his clients.

As John Adamson outlined in his voluminous comparative analysis of European court culture, „in the period between 1500 and 1750 a „Versailles model” of a court as a self-sufficient, situated in a free space, architectonically harmonious city-residency remote from the capital city, where the king’s household and administration was located, was an exception.” The Versailles conception and „model” both architectonically and in terms of practical functioning of the court was spread and secured in the 18th century, developing into a model of absolutism which was imitated to different extents. The spectrum of the adoption of the court of Louis XIV by material and intellectual culture reached from the grand ensembles of palaces of Carskoye Selo in Peterhof, Russia, Drottningholm in Sweden and Sanssouci in Germany to several small residences of the German princes’ realms in Weimar, Hanover, and elsewhere in Europe. Analyzing the works of several researchers about the transformation of the French aristocracy into court society, a common conclusion is the assurance of the symbolic autocratic power by Louis XIV to the detriment of the economic and political independence of the aristocracy. In this context, A. de Tocqueville points at the forfeiture of the power of the French aristocracy and its influence and a simultaneous self-isolation of the group, which he defines as a „caste with ideas, habits and barriers that they created in the nation.” Modern research, when revisiting the methods of the resarch on the aristocracy and when expanding the choice of sources, is still occupied with the problem defined in the beginning of the 19th century by A. de Tocqueville: The aristocracy lost its power and influence, and by the end of the 18th century also its economic basis for its dominance in French society. John Levron defines courtiers as functional mediators between the governor and society, calling them a „screen”.1 In turn, Ellery Schalk stated that in the time of Louis XIV the aristocracy was going through an elite identity crisis, when alongside the old aristocracy involved in military professions (noblesse d’épée), the governor allowed a new, so-called administrative aristocracy (noblesse de robe) to hold major positions and titles of honour. Along with the transformation of the traditional aristocratic hierarchy formed in the early Middle Ages, which John Lough described as an anachronism already back in the 17th century, also the status of governor and its symbolic place in the aristocratic hierarchy changed. It shall be noted that it is the question of a governor’s role in the political culture of absolutism by which the ideas of many researches can be distinguished. Norbert Elias thinks that an absolute monarch was a head of a family, which included the whole state and thereby turned into a governor’s „household”. Timothy Blanning, on the other hand, thinks that the court culture of Louis XIV was the expression of the governor’s insecurity and fears. This is a view which the researcher seems to derive from the traumatic experience of the Fronde (the aristocrats’ uprising against the mother of Louis XIV, regent Anna of Austria), which the culturologist K. Hofmane interpreted from a psychoanalytical point of view and defined Louis XIV as a conqueror of chaos and a despotic governor. In the wide spectrum of opinions, it is not the governor’s political principles which are postulated as a unifying element, but scenarios of the representation of power, their aims and various tools that are combined in the concept of court culture. N. Elias names symbolic activities in the court etiquette as the manifestation of power relations, whereas M. Yampolsky identifies a symbolic withdrawal of a governor’s body from the „circulation in society”, when a governor starts to represent himself, thereby alienating himself from society. George Gooch in this way reprimanded Louis XV as he thought this development would deprive the royal representation from the sacred. In turn, Jonathan Dewald in his famous work „European Aristocracy” noted that Louis XIV was not the first to use the phenomenon of the court for securing the personal authority of a governor, and refers to the courts during the late period of the Italian Renaissance as predecessors of French court culture. What role did the monarch’s closest „viewers” – the courtiers – play in this? K. Hofmane by means of comparison with the ancient Greek mythical monster Gorgon comes to conclusion that the court had to provide prey for the Gorgon (the king), who is both scared and fascinated by the terrific sight (of power and glory). The perception of the court as a collective observer implies the presence of the observed and worshiped object, the king. The public life of Louis XIV, which was subjected to the complicated etiquette, provided for the hierarchical access to the king’s public body. Let’s remember the „Memoirs” of Duc de Saint-Simon that gives a detailed description of the symbolic privileges granted to the courtiers, which along the material gifts (pensions, concessions and land plots) were tools for the formation of the identity and the status of a new aristocrat/courtier – along with the right to touch the king’s belongings, his attire, etc. The basis for securing the structure of the court’s hierarchy was provided by the governor’s body along the lines mentioned above, which according to the understanding of representation by M. Yampolsky was withdrawn from society and placed within the borders of the ensemble of the Versailles palace. There, by means of several tools, including dramatic works of art, the governor’s body was separated from its symbolic content and hidden behind the algorithms of ritualized activities. Blanning also speaks about a practice of hiding from the surrounding environment, thereby defining court culture as a hiding-place that a governor created around himself. It was possible to look at a governor and thereby be observed by him not only on particular festivals, when a governor was available mostly for court society, but also in different works of visual art, for example, on triumphal archs, in engravings, or during horse-racings.

In the first third of the eighteenth century, relations between Russia and Britain remained strained. Although Russia, under Empress Anna Ioannovna (1730–1740), welcomed Britain, restoring the diplomatic relations it had severed under Peter I and concluding a trade treaty favourable to the British in 1734, official London continued to pursue a policy far from friendly towards the Russian Empire. The intelligence activities of the British official diplomats at the Imperial Court were a vivid illustration of this. King George II of Great Britain, when he sent his ambassadors to their destination, urged them to gather information on everything they would see in Russia. He specifically listed those the diplomats were to focus on: the Russian Empress, her ministers and other high-ranking officials, as well as courtiers and favourites. The British authorities were particularly interested in the state of the nation's armed forces. On their return home, the ambassadors were expected to give a detailed account of everything they had seen and heard at Court. Drawing on an analysis of the ambassadors' diplomatic correspondence with the British Secretary of State, as well as some of their essays, the author examines the problem of British ambassadors' intelligence activities at the court of Anna Ioannovna. As it turns out, the ambassadors collected information on the high-ranking dignitaries close to the Tsarina, their predilections and weaknesses; on the alignment of political powers at court, as well as on the state of the army and navy. Attention is drawn to the fact that the informants of diplomats were often not only Britons in Russian service, but more often high-ranking officials themselves, ready to defend British interests for the sake of monetary rewards or gifts. Few of them realised that by revealing secret information to British ambassadors, they were committing a high crime and harming their homeland. The history of British espionage in Russia in the first third of the eighteenth century, which has not previously been the subject of a special study in historical scholarship, reveals the real purpose of British diplomacy, namely to study the potential enemy, as it viewed the Russian Empire at that time.

François-Henri de Montmorency-Bouteville, marshal-duke of Luxembourg (1628-1695), followed a long career of general officer, from the end of the Thirty Years’ War till the Nine Years’ War, and had a contrasted life marked by the inconstancies of the favour and the fortune of war. Committed in the Fronde with his relative, the prince of Condé, who obtained for him in 1661 the hand of the heiress of the “pairie” of Luxembourg, he returned to the service during the War of Devolution. Having acquired the protection of Louvois, he commanded in Holland in 1672, then became captain of a company of “gardes du corps”, before becoming marshal of France in 1675. Involved in the Affair of the Poisons, he was pushed aside from commands and had to wait for the campaign of 1690 to find back the direction of the army of Flanders, which he commanded until 1694. His victories, although not totally exploited, were worth to him an unequalled glory at that time, and the nickname of “The Tapissier de Notre-Dame” ; they also made him one of the most powerful generals in the court of Louis XIV, which favored the rise of his family. The study of his career contributes remarkably to the history of the interested collaboration between the high nobility and the absolutist monarchy, and of the place of the generals in the State and the kingdom’s government. This thesis examines the culture and practice of dance in Denmark in the seventeenth century, focussing on the performance practice within festivals, the pervading French influence and philosophical discourse of dance. The repertoire of staged court dance in Denmark comprises ballets and plays performed in conjunction with festival events such as coronations, weddings, and christenings. Typical is the 1634 festival in honour of Prince-Elect Christian and Magdalena Sibylla�s wedding in Copenhagen, a celebration of international significance. Subsequent celebrations during the reigns of Frederik III and Christian V followed similar models. The festival of 1655 in homage of Prince Christian, for example, gave rise to performances of the ballet Unterschiedliche Oracula, and the German-language opera Arion. The programmes from these performances, along with other contemporary descriptions, provide evidence of aspects of the ballet genre, stage construction, machinery, characters, allegory and political themes. The Danish productions, which also include an equestrian ballet, are in many respects comparable to French court ballets produced from the beginning of the century. Evidence that French choreographies were known in Denmark is clearly provided by choreographies in the publication Maître de Danse (Glückstadt 1705) and the Danish manuscript of violin dance tunes Additamenta 396 4�. Evidence that the Danish aristocracy actively sought and coveted French culture can be found as early as the wedding festival in 1634 and well into the eighteenth century. French acculturation is evident elsewhere too, such as in Ludvig Holberg�s comedy Jean de France (1722), in a translation of French dance etiquette for youth, in contemporary accounts of French clothing and language, and by the employment of French musicians and dancing masters at the Danish court. Included is an examination of Andreas Schroder�s treatise De Saltatoribus (Flensburg 1622) and Thomas Bartholin�s dance chapter in his book Qu�stiones Nuptialis (Copenhagen 1670) as significant Danish primary sources. These sources are placed in contrast with contemporary European dance manuals such as Arbeau, De Lauze, Esquivel de Navarro, Caroso and Negri. Danish and other European authors differ in their views on the morality of dance, although they cite many of the same Ancient and Biblical sources for their persuasive arguments. Just as Denmark was connected to other countries of northern Europe in a complex political web, so too did these courts share artistic and cultural traditions, which are reflected in the sources related to dance. Danish dance practices can especially be demonstrated to be akin to those of neighbouring German courts, which, like Denmark, imitated the dance fashions of France.

Committed in the Fronde with his relative, the prince of Condé, who obtained for him in 1661 the hand of the heiress of the “pairie” of Luxembourg, he returned to the service during the War of Devolution. Having acquired the protection of Louvois, he commanded in Holland in 1672, then became captain of a company of “gardes du corps”, before becoming marshal of France in 1675. Involved in the Affair of the Poisons, he was pushed aside from commands and had to wait for the campaign of 1690 to find back the direction of the army of Flanders, which he commanded until 1694. His victories, although not totally exploited, were worth to him an unequalled glory at that time, and the nickname of “The Tapissier de Notre-Dame” ; they also made him one of the most powerful generals in the court of Louis XIV, which favored the rise of his family. The study of his career contributes remarkably to the history of the interested collaboration between the high nobility and the absolutist monarchy, and of the place of the generals in the State and the kingdom’s government. The analysis of his campaigns and his experience of command reveals the evolution of warfare, in the time of the “stratégie de cabinet” and the limited conflicts, as well as the progressive transformations of the practice of war and fighting

The dissertation records changes in the Kano palace landscape between 1500 and 1990. Patriarchal practices that shaped the initial palace layout at vernacular domestic and state levels are outlined. Royal women were secluded and male slaves occupied public household domains, state strongholds. Later increases in eunuchs' and slave women's powers and spaces are also recorded. The demise of slave women's political realms and the rise of an autocratic and militaristic male state structure following the Fulani jihad of 1807 are then detailed. Lastly, the impact of British imperialism on the landscape of male and female slavery is presented. Because male slaves were placed publicly, they were the main receivers and negotiators of colonial change, and their spaces underwent the most forceful change.
Throughout the analyses, landscapes are seen as politically created and communicative material structures. Examination of epistemological relations used in landscape analyses demonstrates important linkages between how field research is structured and relations of power.

Cette thèse propose une analyse de la « cour royale » égyptienne sous la XXVIème dynastie saïte (664-525 av. J.-C.) à partir des sources majoritairement textuelles (privées et royales) et historiques. Le volume de synthèse se développe autour de trois axes principaux traitant la « cour » dans son acception sociale, telle qu’on l’entend dans la sociologie historique. La première partie est ainsi consacrée à l’étude de la cour comme la Maison du souverain afin d’éclairer l’ensemble des activités qui caractérisent la « vie de cour » et son organisation domestique et qui rendent l’espace curial « privé » ou « officiel ». La deuxième partie examine la cour dans son agencement social et en tant qu’outil de représentation et de communication : ce sont alors le protocole du palais royal et son rôle-clef dans le maintien de l’équilibre social entre les souverains saïtes et leurs sujets (système des faveurs–ḥswt) qui sont analysés. La troisième partie se concentre sur les acteurs sociaux de la Résidence du roi (les courtisans et l’entourage royal) et tente de démontrer les différentes catégories auxquelles appartiennent ces élites et de déceler les modalités de leurs accès au palais et au rang de « courtisan modèle » dans la hiérarchie de la cour. Enfin, l’enquête diachronique suivie tout au long de la synthèse permet de mieux connaître l’impact des emprunts archaïsants dans le système palatin saïte, et par conséquent, d’évaluer la continuité et/ou le changement de ce système par rapport aux modèles traditionnels de la cour pharaonique. This thesis offers an analysis of the Egyptian "royal court" under the XXVIth Saite Dynasty (664-525 BC) based on textual (private and official records) and historical sources. The synthesis develops around three main axes and deals with the "Court" in its social meaning as defined by the historical sociology. The first part, then, concentrates on the study of the court as the House of the sovereign and attempts to identify the activities which characterize the "court life", its domestic organization and which make the curial space "private" or "official". The second part examines the court as a symbol of social order and the outil of representation and communication of the monarchic authority: the protocol of the Royal palace and its key role to maintain the social balance between the Saite kings and their subjects (system of the favours ḥswt) are analyzed here. The third part focuses on the social actors of the Residence (courtiers and royal entourage) and tends to demonstrate the various categories of these elites and to reveal the modalities of their accesses to the palace and to the position of "model courtier" within the hierarchical order of the court. Finally, the diachronic study followed throughout the synthesis allows to better comprehend the impact of the Archaism on the Saite palace institution and consequently to estimate the continuity and/or the changes of this system compared to the traditional models of the Pharaonic court. This study of the cultural activities of the Scottish court in the adult reign of King James V reveals a vibrant, sophisticated and confident outlook, which was more closely integrated with the developments of the northern-European Renaissance than has been apparent hitherto. James V utilised the limited resources at his disposal to good effect, and his cultural patronage propagated multi-layered images of royal power. Continuity with the traditions established by his Stewart forbears, especially his father, James IV, was stressed, particularly in the early years of his reign. However, the chivalric, imperial and humanist themes which were fashionable at the Valois, Habsburg and Tudor courts of the period, were also important and became more prominent at the Scottish court as the reign progressed. An initial examination of the daily life of the court focuses on the personnel, structure and organisation of the royal household and considers the itinerary and routine activities of the king, his family and his entourage. This allows the cultural patronage of the court to be placed in a social context, in which the role and status of women at the court are particularly highlighted. Subsequent chapters consider developments in the visual arts, music and religious observance, learning and literature, military technology, and pageantry and ceremonial. The architectural patronage of the court was particularly rich and encompassed buildings in the ornate High-Gothic style, which was pioneered in the Burgundian Netherlands, and a more restrained Italianate Classicism borrowed from the French court. Music also flourished at the Scottish court, where the French chanson and the Italian consort of viols could be heard alongside the florid, Anglo-Flemish, sacred polyphony of the chapel royal. Likewise, the literary life of the court included vivid (and sometimes bawdy) vernacular verse, scholarly translations of classical texts, neo-Latin humanist treatises, and one of the earliest known examples of a Scottish play. The king also spent heavily on developing an embryonic royal navy, royal artillery and a network of coastal and border fortifications, which incorporated the latest advances in military technology. The ceremonial highlights of the reign included two royal weddings, the lavish funerals of Queens Madeleine de Valois and Margaret Tudor, the coronation of Queen Mary of Lorraine as well as tournaments and rituals connected with the chivalric orders of the Garter, the Golden Fleece and St. Michael. In all of these areas the inspiration of the court of Francis I was particularly strong, since James V spent several years of his minority under the authority of a French Governor, married two French princesses and made a personal visit to the French court in 1536-37. However, men of English, Flemish and Italian origins served the king or visited his court and their influence can also be detected operating alongside the tastes and customs of the Scottish realm. Emerging defiantly from a long and turbulent minority, the adult James V managed to create an exuberant and cosmopolitan court in only fourteen years. His patronage was, of necessity, on a smaller scale than that of the Tudor and Valois kings but a detailed examination of the Scottish court at this period nevertheless reveals a cultural achievement of remarkable quality and diversity.

This thesis examines Alexander�s conception of kingship, his relationship with royal traditions in the three great kingdoms of the Near East, and the concomitant transformation of the king�s court by which Alexander created a distinctive royal insignia and introduced new court personnel and protocol. Section I ("Alexander and Near Eastern Kingship") contains Chapters I, II, and III. Section II ("The Transformation") comprises Chapters IV to VI. In Chapter I, I examine the Macedonian background of Alexander�s court and his native conception of kingship. Chapter II is a study of the kingship of Egypt. Chapter III deals with the kingship of Babylon and Persia. I then turn to an analysis of Alexander�s policies towards the Persians and the concept of the "kingship of Asia," as this was understood by Alexander. This crucial concept is to be distinguished from the kingship of Persia, a position which Alexander supplanted and replaced with his personal kingship of Asia. In Section II, three chapters are devoted to an analysis of the transformation of Alexander�s court. Chapter IV covers the origin and significance of Alexander�s royal insignia. Chapter V examines the introduction of, and the role played by, Persians and easterners in the king�s court; and Chapter VI the significance of other Persian court offices.

L'objectif de cette thèse est d'analyser les déterminants de l'intervention d'intermédiaires de type courtier dans les relations d'échange interorganisationnelles. Cette recherche est appliquée au cas des échanges de vins en vrac entre producteurs et négociants en France. Les courtiers, qui interviennent dans toutes les phases de l'échange (recherche et collecte de l'information, négociation et contrôle de la performance) sont des matchmakers (il ne prennent pas possession des biens) non mandataires. Dans ce travail, le recours au courtier est considéré comme un mode de gouvernance des transactions. L'analyse des déterminants de leur intervention est faite à la lumière de la théorie des coûts de transaction. L'hypothèse centrale est celle de l'efficacité du courtage en termes de réduction des coûts de transaction. Trois hypothèses de recherche sont avancées. Plus les coûts de collecte de l'information (H1), les coûts de négociation (H2) et les coûts de contrôle de la performance (H3) sont élevés, plus la probabilité d'intervention d'un courtier dans l'échange est forte. Ces hypothèses sont testées au moyen d'une régression logistique grâce une base de données de l'ONIVINS regroupant les échanges de vins de table et de pays du Languedoc-Roussillon réalisés entre les campagnes 1987/88 et 2002/2003. Nous montrons que le recours au courtier permet une réduction des coûts associés à la dispersion de l'offre, des coûts de négociation liés à une divergence d'intérêt des co-contractants et apporte une garantie de réalisation de la transaction.

Abstract The trope whereby the lover serves his lady the way a feudal vassal does his lord is something Petrarchism inherits from the troubadours at the courts of southern France in the twelfth and thirteenth centuries. For most of its literary life the trope relies on its metaphorical sense, but in the court of Elizabeth I the metaphor takes on serious political reality for the ambitious male courtiers seeking her favor. A number of them write poetry, and that poetry naturally gravitates to Petrarchan themes and language which in this context take on new meaning. The court poems of Edward Dyer, Arthur Gorges, the Earl of Oxford, and the Earl of Essex remain indifferent productions, but Walter Ralegh, a writer of considerable power, left a striking if spotty poetic record of his fraught relations with his queen. We have one actual exchange of poems between them at a tense moment; it offers our closest look at what the intimacy between them might have been like. We also have reports and some fragments of an epic sequence called “The Ocean’s Love to Cynthia,” which seems to have centered on a vision of Petrarchan love as the driving force of European imperialism.

The article deals with the problems of determining the legal nature of the decisions of the plenum of the Supreme Court of the Russian Federation and their place in the legal system of the Russian Federation. It is pointed out that it is necessary to specify at the legislative level the meaning of the judicial precedent. It is concluded that the resolutions of the Plenum of the Supreme Court of the Russian Federation clarify the meaning of legal norms, taking into account their most optimal, subsequent application in the process of implementing justice. The resolution of the Plenum of the Supreme Court of the Russian Federation, first of all, is a judicial, not a legislative act. He generalizes the practice, sets the vector of its development, but does not create anything. The specification of legal norms and elements of the legal system is only a form of interpretation of legal norms, but does not create new legal relations.

The article is devoted to the classification of subjects of arbitration process. Author analyses several traditional approaches to the structure of arbitration procedural legal relations and examine one of its basic elements — the participants of the legal relationship. In Turkish bank practice a great variety of bank credits are extended. Banks take or convey by mortgage such as real security or surety as personal guarantee to secure loans. In the surety regulated in the Turkish Code of Obligations in essence, very strict requirements have been arranged for the purpose of protecting the guarantor. Bank credit relations are continued over a long period of time. In this process, new contracts of surety are signed or credit restructurings are in question. Here are the changes in this relation the situation of guarantor was tried to be legally disclosed in the light of Supreme Court’ s decisions.

Les répercussions de la pandémie de Covid-19 s’étendent au-delà de la crise sanitaire dans les domaines économiques, sociaux et politiques. Mais elles n’ont pas touché tout le monde de façon uniforme. Les inégalités sociétales existantes sont exacerbées ainsi que la marginalisation. Les travailleurs informels et migrants, et ceux qui vivent dans des établissements informels, sont touchés de manière disproportionnée par les effets sanitaires et secondaires de la pandémie. Cela a eu un impact supplémentaire sur leurs moyens de subsistance et leur capacité à répondre aux besoins fondamentaux, et a aussi limité leur capacité à se rétablir en raison des stratégies d’adaptation qu’ils ont dû adopter. Dans le même temps, le succès de la réduction des risques de catastrophe (RRC) dépend souvent d’acteurs et de réseaux informels. Les limites des systèmes formels de gouvernance des catastrophes ont fait l’objet de nombreuses discussions. Les lacunes sont largement associées au manque de connaissances (locales), de compréhension contextuelle, d’incitations, de systèmes de coordination ou de flexibilité. De plus, l’accent est souvent mis sur les solutions infrastructurelles et technocratiques plutôt que sur l’établissement de relations avec les ressources locales existantes. Malgré cela, les approches de gestion des catastrophes à court terme et à risque unique continuent de dominer.

Bilateral disputes between European Union member states and candidate countries are one of the key obstacles to EU enlargement. They have been plaguing the EU accession process ever since the breakup of Yugoslavia and the subsequent border dispute between EU member Slovenia and candidate country Croatia which then ensued. More recently we have the case of North Macedonia. It became a candidate country in 2005 but ever since, its accession negotiations have been bogged down by endless bilateral disputes. While the case of North Macedonia and its decades long conflicts with Greece and Bulgaria are the most well-known of such cases, they are not the only ones. In a seminal 2018 publication the Balkans in Europe Policy Advisory Group (BIEPAG) outlined the most prominent “open” or “latent” disputes between EU member states and candidate countries in the Western Balkans. Ranging from border to territorial disputes, or ones concerning the status of national minorities, four out of five candidate countries in the region – Albania, Bosnia and Herzegovina, North Macedonia or Serbia, has a bilateral dispute with one or more EU member states. If you look at new candidates Ukraine and Moldova and potential candidate Georgia however, the list of active or potential bilateral disputes is even longer. Even when a candidate country meets the criteria to progress in EU accession talks, bilateral disputes can delay it for years or even decades as in the case of North Macedonia. In this way such disputes present a serious challenge to the credibility of the EU enlargement process. In the context of the war in Ukraine, as we have seen with regard to the policies of Viktor Orbán’s Hungary towards Ukraine, invoking bilateral disputes can seriously challenge the geopolitical orientation and the security of the entire Union. On the legal side, since most of these issues fall outside the scope of the EU law and are not covered by the accession criteria, there is a need to think of an institutional mechanism to deal with bilateral disputes. Enlargement policy does not offer an appropriate platform for settlement of bilateral disputes, especially for those that fall outside the EU law. Hence, these issues should be addressed via the international legal dispute resolution toolbox and thus be subjects of separate processes. The EU’s role however cannot be passive. It should invest efforts in these processes in order for them to be mutually reinforcing and so that the accession process has a mollifying rather than tension amplifying effect on the issue. In its policy brief, published at the end of 2023, the European Council on Foreign Relations (ECFR) proposed updating the Copenhagen criteria such that they should include a stipulation to resolve bilateral issues between member states and candidate countries through external dispute resolution mechanisms: Territorial disputes should be referred to arbitration or the International Court of Justice, while those on minority rights should be dealt with by the European Court of Human Rights and other appropriate dispute settlement mechanisms. In this policy brief we suggest ways how to operationalise this proposal. First, we describe different types of vertical bilateral disputes (the ones that include asymmetrical relations) between EU members and Western Balkan candidate countries, then we outline international mechanisms to resolve them, and finally we propose an institutional architecture to remove bilateral disputes that fall outside of the scope of the Copenhagen criteria and the EU acquis from the purview of EU accession talks.

Cette étude a tiré parti d’une infrastructure d’encadrement et de collecte de données et de relations préalables légué par le projet Feed the Future Sénégal Naatal Mbay (« agriculture florissante »), financé par l’Agence des États-Unis pour le développement international (USAID) et mis en œuvre par RTI International entre 2015 et 2019. Réalisée en 2020, la recherche a intégré des organisations de producteurs pour qu’elles puissent suivre les ménages ruraux membres de leurs réseaux alors qu’ils faisaient face à la pandémie de COVID-19 et tentaient de réagir à ce choc. Les organisations de producteurs, avec le soutien de RTI et de la société-conseil locale STATINFO, ont réalisé une enquête sur un échantillon de 800 ménages agricoles membres de quatre organisations de producteurs soutenus par Naatal Mbay, réalisée en deux passages successifs, en août et octobre 2020. Des groupes de discussion ont été menés avec les responsables des réseaux, ainsi qu’une collecte de données a posteriori ont permis de contextualiser l’expérience face au choc de la COVID-19 et de valider les conclusions. Les conclusions ont montré que les producteurs étaient déjà aux prises des effets des faibles précipitations de la saison de production de 2019 et que la COVID-19 a aggravé ce premier choc du fait des perturbations des communications et des interdictions de déplacements entre les régions, créant ainsi des pénuries alimentaires et exerçant ainsi une pression sur l’utilisation des stocks de semences à des fins alimentaires. Les effets de l’insécurité alimentaire, mesurés par le biais de l’échelle d’accès d’insécurité alimentaire des ménages, se sont avérés être plus importants pour les ménages de Casamance que pour ceux des régions de Kaolack et de Kaffrine. Les conclusions ont également indiqué que les réseaux de producteurs ont déployé une intervention coordonnée incluant aide alimentaire et accès à des équipements de protection individuelle, distribution de semences de légumes et de céréales à cycle court (par exemple, le niébé et le maïs) et des semences adaptées au jardinage, mesures de protection pour les semences de céréales de l’année suivante et innovations financières avec les banques pour sécuriser les crédits. On s’attend à ce que les stocks d’alimentation soient reconstitués au début de la récolte en octobre 2020 et les réseaux prévoient d’accélérer la multiplication des semences, de diversifier les cultures au-delà des céréales, d’améliorer la communication au sein des réseaux et de généraliser l’accès aux instruments financiers au cours de la saison 2021. Les études ont indiqué que le projet antérieur financé par l’USAID est susceptible d'avoir contribué aux capacités de résilience des réseaux en renforçant le capital social et en encourageant le recours à des technologies et outils nouveaux au cours de ses années de fonctionnement.

Abstract. The article deals with the concept of "electronic justice" and features of the use of electronic justice for the consideration of economic disputes. In the digital economy e-justice is one of the legal constructions that provide a comfortable legal environment for economic activity. This is a complex of legal relations and technological solutions that provides individuals and legal entities with the opportunity to use digital technologies at all stages of the judicial process, to obtain information about the activities of courts through electronic access. The e-justice mechanism includes video and audio recording of court sessions, electronic document management with the use of an electronic signature, an electronic archive for storing electronic documents, the use of cloud technologies, as well as the use of electronic documents as evidence. Improving the legal regulation of e-justice in the digital economy, along with reforming procedural legislation, should include the development of a Federal law on electronic documents.
