This contribution deals with the co-ordination of minimum subsistence benefits in EU law. It is argued that the distinction between social assistance schemes and non-contributory benefits in EU social security law is becoming increasingly redundant. This is recognised in the case law of the CJEU, although paradoxically not in a way that strengthens the rights of mobile citizens, but in an adverse manner that undermines the co-ordination efforts of non-contributory benefits under Regulation 883/2004. In order to overcome this problem, it is argued that social assistance should be included in the material scope of application of Regulation 883/2004. This regulation should abandon the concept of special non-contributory benefits and introduce a new category of minimum subsistence benefits, which would also include social assistance schemes. Such a change could be accompanied by a single, coherent principle to govern the relationship between the right to benefits (Regulation 883/2004) and residence rights (Directive 2004/38), if necessary supported by a cost sharing mechanism for minimum substance benefits under Regulation 883/2004 and, preferably, by a recognition of minimum protection standards for economically non-active EU citizens without a legal right of residence.

Abstract This article analyses the Brey judgment of the eu Court of Justice, in which the cj had to rule on a claim for a social assistance benefit in a host Member State by an economically inactive migrant person. The legal context within which the Court had to deal with these questions differs from other cases regarding the politically highly sensitive question of the right to access to social benefits for economically inactive migrant Union citizens. It had to deal with the interpretation of the provisions in Social Security Coordination Regulation 883/2004 on the so-called ‘special non-contributory cash benefits’. This article examines the judgment in the light of previous political compromises and agreements on the relationship between Regulation 883/2004 and Citizens Directive 2004/38. It also looks into the consequences of the judgment for the concept of ‘social assistance’ in both these instruments and for the concept of ‘conflict rule’ in Regulation 883/2004. The issue of what claim should be considered as an ‘unreasonable burden’ on the host State’s social assistance system under Directive 2004/38 is assessed in more detail. The conclusion of the article is that this judgment has not only overruled previous political compromises but has also created more confusion than ever on the entitlement to social minimum benefits for economically inactive eu migrants.

The introduction provides an overview of the negotiation of the Commission’s proposal and outlines the aims and the structure of the Special Issue.

The concept of ‘working time’ for a period of stand-by time according to a stand-by system applicable to firefighters was interpreted by the Court in MG (C-214/20). In the Y case (C-636/19), the Court interpreted the concept of ‘insured person’ for the purpose of reimbursement of healthcare costs under Directive 2011/24. In the TS case (C-538/19), the Court dealt with another cross-border healthcare case. This time the question was whether a Member State can require an authorisation for cross-border healthcare to be subject to the submission of a medical report drawn up by a doctor from its national public health insurance system in light of Article 20 of Regulation 883/2004 and Article 56 TFEU. In ASGI and APN (C-462/20), the exclusion of third-country nationals from the eligibility to the Italian family card was under scrutiny. In SC (C-866/19), the Court clarified that the principle of aggregation applies to the calculation of the theoretical amount of benefit but not to the calculation of the actual amount of benefit under Article 52(1)(b) of Regulation 883/2004. In K (C-285/20), the Court held that being on sick leave and receiving sickness benefits can be considered as equivalent to the pursuit of an economic activity for the purpose of applying the rules on unemployment benefits for wholly unemployed frontier workers under Article 65(2) and (5) of Regulation 883/2004.

Nationella socialförsäkringssystem är inte anpassade för internationella situationer. Problem beträffande socialförsäkringstillhörighet kan därför uppstå när en person arbetar i flera länder samtidigt. EU har skapat ett samordningssystem för att nationella regler ska passa ihop i internationella situationer. Samordningssystemet uppdaterades nyligen genom införandet av förordning nr 883/2004 samt tillhörande tillämpningsförordning som ersatte förordning nr 1408/71 och dess tillämpningsförordning. Samordningssystemet innehåller lagvalsregler som pekar ut vilket stats lagstiftning som är tillämplig på en person i en gränsöverskridande situation. Endast ett lands lagstiftning kan tillämpas på en viss situation. Huvudregeln, när en person arbetar i flera medlemsstater, är att personen ska omfattas av arbetsstatens lagstiftning. I undantagsfall kan person istället omfattas av bosättningslandets lagstiftning. I förordning nr 1408/71 fanns begrepp som saknade uttryckliga definitioner vilket medförde att det var oklart vad som krävdes för att uppfylla förutsättningarna för att omfattas av undantagsregeln. Begreppsproblematiken i förordning nr 1408/71 har till viss del eliminerats i och med införandet av förordning nr 883/2004, eftersom tidigare oklara begrepp helt tagits bort. Lagstiftaren har även valt att behålla ett tidigare oklart begrepp men utvecklat begreppets innebörd. Det kan också konstateras att ny begreppsproblematik har tillkommit i och med införandet av förordning nr 883/2004. Författaren anser att trots att lagstiftaren i nuvarande lagstiftning mer utförligt förklarar begrepp som kan bli föremål för tolkningsproblem är förklaringarna inte tillräckligt utförliga. Det kvarstår väsentliga brister i förklaringarna som ger upphov till nationella tolkningar som äventyrar en konform tolkning av begreppen och tillämpning av lagvalsregeln.
National social security systems are not adapted to international situations which can cause problems when a person is working in two or more Member States. EU has therefore created a coordination system which makes the national systems fit better together in international sitautions. The coordination system has recently been updated and regulation no 1408/71 and regulation no 574/72 have been replaced by regulation no 883/2004 and regulation no 987/2009. The main rule for determining the legislation applicable provides that the legislation of the Member State in which a person is working is applicable. When a person works in several Member States problems occur when trying to determine the applicable legislation, therefore the legislation in the State och residence can be applied instead. In order for the legislation in the State of residence to be applicable several critera in regulation no 1408/71 had to be fulfilled. These criteria contained words which missed explicit defintions. The lack of clarity made it unclear what was required to meet the criteria to be subject to the exemption rule. The problems concerning the lack of clarity regarding the criteria has partly been eliminated with the introduction of the new regulation. The legislature have taken away some of the unclear words but also kept some of them. It may also be noted that some new unclear words have been added. The author finds the explantions to the vague words in the new regulation more detailed than before but is still concerned with the fact that the explanations are not detailed enough. The opinion of the author is that the explanations have significant weaknesses which give rise to national interpretations. These national interpretaions will in turn endanger a consistent interpretation of the words and application of the rules of conflict

This thesis aims to provide an insight into the stereotypical imagery of journalists on the screen and its changes in popular culture, namely in film. Much research has been done on categorising different filmic characters and on journalist in popular culture as well as in real life, but from my knowledge no comparative approach focussing on the changes in the filmic stereotypes has been undertaken yet. Therefore my literature review covers existing research on journalists in film and the various categories scholar do put these characters in. Using qualitative content analysis, namely by watching and opposing sixteen selected movies, this study aims to give some in-depth view into the question if and how filmic stereotypes have changed over the approximately seventy years that lie between the films from the first (1930-1949) and second (1990-2004) period of analysis. In eight comparative chapters this study argues that some stereotypes have changed while others remain the same. Influential factors for these changes as found in the thesis are for example history, culture and audience expectation. The reason some stereotypes do not change is that they are deeply embedded in American myth that is even harder to change than stereotypes. The thesis concludes that most journalistic figures underwent considerable changes or even disappeared with only the crusading journalist, as a mythical heroic figure, hardly changed at all.

L’analyse du droit européen et international montre que le droit à la sécurité sociale est un droit fondamental de l’homme. Pourtant, l’hypermobilité des travailleurs soulève de nombreuses questions relatives à la protection de ce droit dans l’UE qui sont révélées à la lumière du cas des artistes du spectacle vivant. La reconnaissance et la protection de ce droit au sein de l’ordre juridique de l’UE sont tout d’abord étudiées dans les mécanismes de protection des droits de l’homme, ainsi qu’à travers les enjeux de la liberté de circulation et de la citoyenneté sociale, qui encadrent la mobilité intra-UE des travailleurs. La thèse explore ensuite ces enjeux au prisme de l’européanisation de la sécurité sociale. En mettant en évidence la place prépondérante de la coordination en droit de l’UE de la sécurité sociale, la recherche interroge la contribution de cette approche à l’effectivité de la protection du droit à la sécurité sociale. Face aux insuffisances observées, nous proposons enfin des pistes d’amélioration qui pourraient être appliquées sur le fondement du droit en vigueur
The analysis of the EU and international legal orders shows that the right to social security is a fundamental human right. However, the high mobility of workers raises several questions about the protection of this right within the EU. These issues are analysed through the relevant example of performing artists. The recognition and protection of this right within the EU is examined in the light of human rights mechanisms, and in the context of the challenges arising from workers’ (hyper)mobility within the EU, which is determined by the freedom of movement and social citizenship. These challenges are then further explored through the prism of the Europeanisation of social security. Given the predominant role of coordination in EU social security law, the research questions whether this approach contributes to the effectiveness of the protection of the right to social security. Finally, in view of the shortcomings observed, we propose improvements that could be applied on the basis of current legislation

Depuis 1995, les risques sanitaires liés à la téléphonie mobile ont progressivement mené à une controverse politique et sociale en France. La nature des désaccords et la complexité de l'émergence et le degré de stabilité des accords éventuels entre les acteurs engagés dans cette controverse posent question. La sociologie des controverses et des réseaux socio-techniques et la sociologie de la justification ont été mobilisées afin de caractériser les compétences des acteurs engagés dans la controverse publique, c'est-à-dire leur capacité à légitimer leurs positions et leurs actions en faisant appel à des principes de justification différents. Les dénonciations publiques portent sur le scepticisme entourant la validité de recherches scientifiques suggérant l'existence de risques, l'indépendance des experts et de l'expertise scientifique, l'attentisme des opérateurs et des pouvoirs publics, et enfin l'attitude de ces derniers à l'egard des craintes exprimées par les riverains de stations de base et les consommateurs. Cette thèse souligne la difficulté de l'emergence de preuves scientifiques en situation d'incertitudes sociales autant que techniques justifiant l'application du principe de précaution. Elle met en avant, également, la difficulté de l'affirmation, par les groupes d'acteurs, d'arguments qui seraient suffisamment convaincants pour emporter la conviction de leurs détracteurs. Nous n'avons pas pu observer de consensus publics en raison de la pluralité des logiques argumentatives, de la divergence des intérêts représentés, et de rapports de force entre acteurs se traduisant parfois par la persistance du régime de la violence. Les accords ont pris essentiellement la forme d'arrangements locaux et contingents (chartes de bonne conduite, arrêtés municipaux ou encore mise en place d'instances de concertation et de débat public dans certaines municipalités). Ces derniers ont une portée limitée, et leur généralisation et leur stabilisation semblent compromises.

Coordination of social security by bilateral agreements on social security is a specific area of international law that is essential to pay attention to. Czech Republic has up to now signed 16 bilateral agreements that are valid in their entirety. This thesis focuses on these 16 bilateral agreements and compares them with Regulation (EC) 883/2004 which became valid as the Czech Republic became member of European Union and which replaced bilateral agreements that were concluded with member states of European Union. The aim of this thesis is to perform a detailed analysis and to answer on following questions that are directly related to this issue. Firstly the thesis focuses on personal scale and answers a question of who is covered by bilateral agreements. Secondly the thesis focuses on material scale and answers a question of what subsystems are covered by agreements and compares them with the principles applied by Regulation (EC) 883/2004. Finally the thesis deals with a question of a future possible approach to coordination of social security in a global scale. It can be concluded that bilateral agreements concluded by the Czech Republic are each unique legal instruments. Therefore it is essential to study each agreement separately and not to make conclusions based on general knowledge of the issue.

The aim of this master thesis is to analyse practical impacts of special rules for determination of applicable legislation in accordance with the Regulation No. 883/2004 and its implementing Regulation No. 987/2009. Further the thesis seeks to identify potential negative effects connected to application of the single insurance principle as well as deficiencies arising out of practical performance of European coordination and to discuss the eventual solutions to undesirable effects caused by weak sides of coordination regulations. The thesis is divided into four chapters: an introduction is followed by a chapter about general principles of European coordination of social security systems and about current developments in this field. The topic of a second part is an institute of posting according to Art. 12 of the Regulation No. 883/2004, a distinction here is made between employees and self-employed persons. This chapter further contains procedural rules and an overview of issued portable documents A1 (E 101 forms) during the years 2009 - 2011. Third chapter deals with pursuit of activities in two or more Member States in accordance to Art. 13 of the Regulation No. 883/2004. Special attention is paid to a fine line between posting and pursuit of activities. A problem with retroactive determination of applicable legislation is discussed in the last subchapter of the thesis. This problem is being recently solved by Czech institutions and employers. They are trying to find a solution preventing negative consequences of such a retroactive determination. Exception governed in Art. 16 of the Regulation No. 883/2004 is a subject of the fourth chapter. Situations where an exception is a possible and suitable solution are presented here as well as statistics about requests for exemption from Czech resp. foreign laws.

The statutory health care systems of EU member states show a lot of differences, e.g. in financing, reimbursing, availability, form of membership, etc. The European health insurance card gives EU citizens the possibility to see a doctor while abroad, extending their right from receiving emergency treatment to receiving full necessary treatment under the laws of the member state.  The scope of the insurance claim abroad is governed by the respective national law. This can result in a significantly higher cost sharing compared to the domestic situation. Depending on the country, this can include both fixed amounts (additional payments) and percentage shares of up to more than half of the costs.[1] While exercising the right to free movement EU citizens might need way more than emergency care, especially in relation to the rise of chronic diseases like diabetes etc. But quality treatment of patients residing abroad requires a seamless coordination of the member states’ health insurance systems. The access to member states health care systems is not seldomly tricky, in some cases it is even denied to nationals of the state. This thesis seeks to spot access difficulties in different member states asking for the question whether or not this might impede the EU’s free movement provisions.

130 Abstrakt v anglickém jazyce We comprehend the coordination of social security systems as an interconnection of social security systems of Member States therefore the free movement of persons can be carried out. The aim of Coordinating Regulations is to ensure that a migrant does not loose his/her claims on social rights due to his/her enjoyment of free movement. Concerning the large extent of this topic the thesis is focusing only on old-age and survivors' pensions according to valid Regulations (EC) No 883/2004 and No 987/2009 of the European Parliament and of the Council which entered into force on 1 May 2010. The preliminary chapter out of five at total generally presents the nature of the Coordinating Regulations. It clears up their development and aims. It further introduces other sources of coordination law and explains their relations with other sources of EU law and international law. The determination of personal and material scope of Coordinating Regulations is the indispensable part of this chapter as well. AbstractFrom a Swiss perspective, migration and transnational social protection is a subject of great importance because more than 30% of all the people working in Switzerland are migrants. This chapter shows that the Swiss social security provides protection for nationals and non-nationals, by granting access to health care and compensating the loss of income due to old age, disability, accidents, unemployment and other social risks. In some areas, the Swiss law contains rules that require domicile in Switzerland or Swiss citizenship, but for a majority of migrants, international agreements as well as EU Regulation n° 883/2004 waive such rules.

Nowadays, most human resources (HR) managers are confronted with cost pressure, the demand for offering “high-quality-HR services” and the necessity for strategic contributions (Hewitt, 2004). Human resource management (HRM) with its current structures and tools is often unable to completely fulfill these requirements. Therefore, a strong need for reorganization of HR as a function is obvious. In the last few years, many efforts have been undertaken by HRM practitioners to re-structure HRM at the level of organizations as reflected in surveys or case studies from leading firms. Examples can be found in Som (2003) and Fairbain (2005). Moreover, the restructuring of the HR function has been the subject of a broad discussion among scientists and researchers in the field of management (Becker & Huselid, 1999; Caldwell, 2003, 2004; Truss, Gratton, Hope-Hailey, Stiles, & Zaleska, 2002). It is remarkable that this discussion has mainly focused on the strategic role of HRM (Lawler III, 2005), and consultants in the practical field have particularly given advice to improve the quality of HR services (Hewitt, 2004; Towers Perrin, 2005). A more complex view on the restructuring of HRM is rarely to be found.

Human resource management (HRM) can influence an organization’s human and organizational resources and provide organizational competitive advantage. E-HRM, defined as a “way of implementing HR strategies, policies, and practices in organizations through a conscious and directed support of and/or with the full use of Web-technology-based channels” (Ruël, Bondarouk, & Looise, 2004, p. 365) offers great possibilities for more successful HRM work. The group of stakeholders affected by e-HRM initiatives is frequently broader than the HR staff itself: it includes anyone who can receive updates of organizational dynamics, participate in online discussions, or choose career paths. Research shows that the most important challenge in e-HRM implementation is the required change in the mindsets of the involved HR personnel, line managers, and employees that makes such projects successful (Ruël et al., 2004). In this chapter we study how such mindsets emerge and evolve through the social relationships of the prospective users of the HRIS.

MEMS accelerometers have found applications in harsh environments with pressure, temperatures above ambient conditions, high g shock and vibrations. The complex structure of these MEMS devices has made it difficult to understand the failure modes and failure mechanisms of present day MEMS accelerometers. Little work has been done by the researchers in investigating the high g reliability of the MEMS accelerometers by continuous high g drops and quantifying the failure modes. There is little literature addressing the multiphysics finite element modelling of MEMS accelerometers subjected to high g shocks. In defense applications, where these devices are integrated with several other compactly assembled subsystems, lack of knowledge on the physics of failure for the MEMS sensor in harsh environment operation, can be detrimental to the success of the system on the whole. Being able to successfully model inside of an accelerometer, enables the user to better understand the change in parameters like time delay induced in response of successive drops, change in pulse width that indicate failure, reduction in sensed g levels. Some researchers have subjected various accelerometers to repeated drops at their maximum sensing g(not high g) level, and used optical microscopy to detect damaged sensing elements [Beliveau, 1999]. Few researchers have modeled the internal structure of the MEMS device, along with the device packaging under the stresses of operation [Fang 2004, Ghisi 2008, Xiong 2008]. In this paper, a multiphysics model of capacitive and the moving elements of the accelerometer has been developed to model the change in capacitance with respect to stroke and understand the correlation with g-levels, in addition to the transient dynamic response of the accelerometer under high-g shock. This has not been much explored in the past. The accelerometer studied in the paper is the ADXL193, and subjected to repeated drops of 3000g in each 3 axes as per 2002.4 of MIL-STD-883 without preconditioning. A characteristic graph of capacitance vs accelerometer stroke has been obtained from a series of electrostatic simulations and is then used to relate g levels, capacitance, stroke deflection and voltage change using electromechanical transducer elements. The drift in the performance characteristics of the accelerometer have been measured versus the number of shock events. In addition, an attempt has been made to investigate the failure mode in the accelerometer.
