Abstract Most discourse related to refugees has been and continues to be related to humanitarian issues. Yet, humanitarianism as a theoretical framing is no longer sufficient for understanding refugee-fuelled migration. The politics of such migration currently dominate policy discourse and Hong Kong is no exception. Asylum seekers continue to seek refuge in a city that neither wants them, nor is sympathetic towards them. The study reported here seeks to understand this context from the point of view of asylum seekers and their supporters in the community and offers an alternative theoretical framework that reflects Hong Kong asylum seekers’ experiences. A qualitative methodology was employed to understand the contexts and asylum seeker experiences. Results indicated that extraordinary institutional pressure is exerted on asylum seekers who cannot settle in Hong Kong but who, in the meantime, are forced to rely on inadequate social protection to survive.

The movement of population was only a domestic issue of a country, but along with the number of countries that paid attention to Asylum Seekers and Refugee so that these issues become worldwide problem. In International law the existence of these refugee protected by the 1951 Refugee Convention and 1967 Refugee Protocol about Refugee. The Indonesian state did not ratify the Protocol so that Indonesia was not obliged to accept the asylum seekers and refugee. However, Indonesia’s strategic position makes Indonesia become a transit country for those who want to continue into the destination country. Therefore, the Government of Indonesia issued a Presidential Decree Number 125 of 2016 concerning Handling of Foreign Refugees. The problem research is how to handling asylum seekers and refugee after the publication of Presidential Decree Number 125 of 2016 concerning Handling of Foreign Refugees. This research is used empirical-normative research methods. Thus, the Government of Indonesia already has a legal basis to handle these asylum seekers and refugees. Indonesia is expected can be more instrumental in addressing the problem of asylum seekers and refugees internationally even thought Indonesia has not ratified the 1951 Convention and the 1967 Protocol. However, in its implementation Presidential Decree Number 125 of 2016 concerning Handling of Foreign Refugees did not run smoothly. It’s because a lot of their handling has not yet referred to the Presidential Regulation.

The moment asylum seekers arrive in Greece, they are often denied access to justice on different levels. At the same time international volunteer field advocates or Backpack Refugee Rights Advocates have the goal of assisting asylum seekers to master the difficulties of the complex European asylum process. More importantly they can play an important role in the process of legally empowering asylum seekers. This paper will first analyze the different forms of access to justice that are denied to asylum seekers in Greece. Then then paper will proceed with the concept of legal empowerment of asylum seekers and it is argued that the main purpose of Backpack Refugee Rights Lawyers should be enabling asylum seekers and refugees to know and enforce their own rights. At the same time the paper identifies and addresses several problems of the work of Backpack Refugee Rights Lawyers. Overall, it is hoped that this paper will provide field advocates with information about how they can play an integral part in the legal empowerment of asylum seekers and refugees if they act according to certain guidelines.

Following a rise in the number of irregular maritime arrivals seeking refugee protection in Australia, and two successful legal challenges to their refugee processing policies, the Labor Government has resuscitated notorious aspects of the ‘Pacific Solution’ as part of a ‘no advantage’ policy. This strategy seeks to deter ‘irregular’ asylum seekers by treating them no more favourably than refugees seeking protection from overseas awaiting entry to Australia through regular refugee/humanitarian channels. In furtherance of this ‘no advantage’ policy, extra-territorial processing on Nauru and Papua New Guinea has been re-introduced and ‘excision’ provisions are to be extended to mainland Australia placing the continent outside of its ‘migration zone’ and, therefore, asylum seekers beyond the regular laws and processes for protection seekers. This article analyses the seismic shifts in asylum seeker policy that have occurred in Australia over the recent past and the politics underpinning them.

AbstractThis study follows on from previous work (Pedersen et al., 2008) that examined the situation of the stateless asylum seeker, Wasim. In the present study, a blog discussion stemming from an editorial about Wasim (Adams, 2008) was analysed. Participants were identified as ‘Do-Gooders’ and ‘Do-Badders’; categories that indicate their orientation to asylum seeker debates (labels originated from the blog itself). We identified several features of the blog discussion. While similar themes and discursive devices were used by the two groups, they were used very differently. The Do-Gooders were more likely to offer accurate information about asylum seekers or Wasim and to show humanitarian concerns for Wasim and others like him. The Do-Badders were more likely to display emotion, show the ‘Phillip Adams Effect’ (addressing the author of the editorial, Phillip Adams, in their submissions) and name-call. However, there was no significant difference with respect to whether participants addressed Wasim's situation specifically rather than focusing on the general issue of asylum seekers. The blog demonstrates, in microcosm, the divided orientation of Australians regarding asylum seekers.

This paper discusses that Indonesia which is not a contracting state to the 1951 Refugee Convention and 1967 Protocol, but still respect human rights of asylum seekers and international refugees on the principle of non-refoulement. By being unable to refuse the asylum seekers, it will result in the accumulation of those who have the potential to disturb the security and order of the Indonesian people. This paper aims to identify conditions, problems, and provide solutions for asylum seekers and refugees in Indonesian territory from the perspective of national law and international law. This writing uses a normative research method with a juridical-normative approach, which refers to the prevailing laws and regulations. The solution that can be provided is the establish regulations regarding the handling of asylum seekers and refugees, improving communication with the main destination countries, conduct training for officer in dealing with asylum seekers and refugees, and optimally applying the Global Compact on Refugee concept. The results of this paper indicate that national law and international law can provide protection for asylum seekers and refugees.

Poetry provides valuable and insightful ways to explore and record social and political experiences and engagements. The plight of refugees and people seeking asylum in Australia is well known. Community groups such as the Ballina Region for Refugees provide support to refugees and asylum seekers both in Australia and offshore. To help raise awareness and validate the experience of refugees and asylum seekers, the Ballina Region for Refugees runs an annual Poetry Prize. The 2020 Ballina Region for Refugees Poetry Prize theme was Seeking Asylum—Holding Patterns. This article presents the winning and highly commended poems, along with poems by refugee and asylum seeker poets. Poems from both insider witnesses – refugees and asylum seekers – and outsider witnesses – poets who seek to express an empathy with the plight of refugees and asylum seekers – have contributed to this collection. From haunting statements of human dissolution that should strike fear into anyone’s heart, through glimpses of hope, the poems explore the trails of asylum seeking and the dysfunctionality of the aftermath.

Abstract This article examines the effects of the refugee crisis on perceptions of asylum seekers. Previous research has demonstrated that asylum seekers are perceived in terms of deservingness—either as deserving refugees in need of help or as undeserving and unwelcome exploiters. The article uses unique panel data from a representative sample drawn directly from the Norwegian population registry. Through Structural Topic Modelling (STM) of open-ended survey responses fielded before and after the refugee crisis, this article analyses, first, how ordinary citizens perceive asylum seekers and, second, the article documents that these perceptions of asylum seekers changed. They did, however, not change from perceiving asylum seekers as deserving to perceiving them as undeserving. The change was more subtle. Responses that characterize asylum seekers as deserving prior to the crisis tended to reflect a sense of responsibility to help—of involvement. Responses after the crisis were more distanced, even as they characterized the asylum seekers as deserving. All in all, these findings improve our knowledge about how the refugee crisis affected public opinion in recipient populations.

BackgroundThe numbers of asylum seekers and refugees in Wales have recently increased sharply, but we know little of their health experiences.AimTo investigate asylum seekers’ and refugees’ experiences of health care, especially what helped or hindered.MethodEight volunteer peer researchers were recruited from asylum-seeking and refugee communities; and trained to run the quantitative survey. They worked in small groups with support from team members. The Statistical Package for Social Sciences (SPSS) was used to describe, analyse, and present results.ResultsThe 210 responders included 90 known refugees, 89 known asylum seekers, and 11 known to have been refused asylum. Although 79% of responders reported attending an initial health assessment on arriving in Wales, and 94% reported that they were currently registered with a GP, only 36% found it easy or very easy to make an appointment with their GPs. Awareness of services was mixed: best known was the 999 service, with 77% reporting that they knew how to access it. Sixty-six per cent reported using health care in working hours, and 28% reported use out of hours. Key influences on these statistics included knowledge of the NHS and how to navigate it, language barriers, and cultural factors.ConclusionThis study provides valuable insight into asylum seekers’ and refugees’ experiences of health care. Together with our complementary qualitative study it suggests that a compassionate approach to providing care, building on existing good practice, and with additional resources for training and support services, can reduce healthcare inequalities for asylum seekers and refugees.

Unaccompanied minor asylum seekers and refugees are a unique population, who have experienced multiple traumas and loss. A summary of trauma and risk factors faced by these youngsters during pre-migration, flight and resettlement periods is presented. The potential impact of such experiences is evaluated in relation to psychological well-being. Social support is widely accepted as playing a protective role in psychological well-being following stress and trauma (Joseph, 1997). The potential benefits of social support for unaccompanied youngsters seeking asylum in the UK are considered in relation to the stress buffering model and main effect model. Challenges to accessing and utilising social support, such as insecure attachment relationships are discussed in relation to this population. Implications for service providers and future research are also explored.

Large numbers of migrants enter South Africa legally and illegally in search of a better life, personal safety and security (Pretorius, 2004:1). The research study explored and described experiences of refugees and asylum seekers in the host country, the challenges they encountered in the process of integration regarding families in their country of origin and their “new” families in the host country, the strategies they employed to get recognition even if it led to being involved in fraudulent activities. The research has also explored the impact of laws in the lives of refugees and asylum seekers for example the Refugee Act (Act 130 of 1998), the Immigration Act (Act 13 of 2002), the 1969 OAU Convention and the 1951 United Nations Convention. A qualitative research approach was used to frame the study, which employed an exploratory, descriptive and contextual research design so as to understand challenges experienced by refugees and asylum seekers. The sample for the study was a purposively selected sample recruited using the snowball sampling technique. As a means of collecting data semi-structured interviews were utilized. The eight steps as stipulated by Tesch (in Creswell, 1994) were used to analyse data. To ensure trustworthiness the four criteria as suggested by Guba (in Krefting, 1991) were applied, namely truth-value, applicability, consistency and neutrality. The findings and recommendations are made available by means of a research report The research findings were centered on the following themes: (1) Refugees and asylum seekers articulate a range of reasons behind the decision to leave their home country. (2) Refugees and asylum seekers express negative experiences regarding leaving their country of origin. (3) Refugees and asylum seekers experience a range of feelings as they enter the host country (4) Refugees and asylum seekers report that they and their families experience a number of challenges as a result of relocation (5) Refugees and asylum seekers employ negative and positive strategies to cope with challenges of relocation (6) Suggestions made by refugees and asylum seekers concerning the involvement of Social Workers (7) Suggestions made by refugees/asylum seekers to Home Affairs in terms of improving services to refugees and asylum seekers Substance findings: the results emerged from the data collected through the themes and sub-themes identified during data analysis. Conclusions and recommendations: Based on the findings conclusions were drawn and recommendations proposed from the findings.

Although the United Kingdom is committed to the protection of refugees and the integration of migrants into society, many aspects of the asylum system actually prevent access to refuge or create barriers to integration. Extant research on this topic has often paid little attention to the role of discourse in legitimising particular asylum policies and notions of integration or has otherwise neglected the social functions of asylum seeker and refugee discourse. This thesis addressed these gaps by exploring the discourse of majority group members and asylum seekers / refugees, paying attention to the relationship between place and identity and the ways that notions of intercultural contact were constructed. Semi-structured interviews were undertaken with seventeen people who work to support asylum seekers and refugees, fifteen asylum seekers / refugees and thirteen Scottish locals who reside in the areas where asylum seekers are housed. The data were analysed using discourse analysis, focusing on the ways that particular narratives and descriptions function to justify or criticise certain policies or sets of social relations. The analysis illustrated that the presence of asylum seekers could be justified through portraying their countries of origin as dangerous and the host society as problem-free, whereas the presence of asylum seekers was resisted through portraying the host society as ‘full’. When discussing antagonism towards asylum seekers, interviewees constructed this as stemming from ‘ignorance’, which functioned to portray the behaviour as unwarranted while emphasising the potential for positive social change. Similarly, asylum seekers’ and refugees’ accounts of violence tended to deny or downplay racial motivation, or produce accusations of racism in a tentative or reluctant manner, implying that a ‘taboo’ on racial accusations exists even in cases of violence. The analysis also illustrated how constructions of ‘integration’ perform social actions, such as highlighting the responsibility of asylum seekers or the host society. The analysis showed how the refugee status determination process could be criticised through references to a ‘culture of disbelief’, claims that it was racist or portrayals of cultural differences that undermine the process. The right of asylum seekers to work was advocated through portraying it as consistent with the national interest. Aspects of the asylum system related to destitution, detention and deportation were criticised through portraying them as ‘tools’ that treated asylum seekers inhumanely and by constructing asylum seekers in humane ways such as ‘families’ or as ‘human’. Overall the results illustrated that, in the context of asylum seekers, notions of identity and place are linked so that constructions of place constitute identity, in the sense of portraying people as legitimately in need of refuge, and these constructions can work to justify or criticise asylum policies. Results also illustrated that victims of seemingly racist violence may construct their accounts in ways that deny or downplay racial motivations, making racist behaviour difficult to identify and challenge. The analyses suggested that ‘two-way’ constructions of integration may function to overcome the view that asylum seekers have ‘special privileges’ over other members of the community and emphasise the responsibilities of the host society. Portraying punitive asylum policies as ‘inhumane’, and constructing asylum seekers in humane ways, provides a potential strategy for reforming aspects of the asylum system.

Using a qualitative approach, this study looks into the experiences of refugees during settlement in Britain, their perceptions and expectations of community associations and refugee agencies and the services these provide. Focused on the Colombian and the Somali refugee communities in London, the research is based on eight in depth interviews with personnel from refugee organisations and 31 with refugees themselves: 16 with Colombians and 15 Somalis. One mixed-sex group discussion with Colombian refugees and two, one male and one female, with Somalis were also conducted. This was complemented with direct observation and an extensive review of the existing literature. The research shows that English language skills, transferability of previous skills and employment experience, circumstances of flight, racism and discrimination, cultural differences between the country of origin and the UK, and availability of adequate health-care services and accommodation are key factors affecting refugee settlement. The findings also show that word of mouth was the most common medium of gaining awareness of refugee organisations for both the Colombian and the Somali refugees, followed by printed material. Whilst the Somali refugees were generally satisfied with the organisations they had approached, the Colombians expressed a high level of dissatisfaction. The findings lead to the conclusion that refugees' socio-cultural background and the reasons behind their flight are likely to shape both their settlement and their attitudes towards refugee organisations in the country of exile. Whilst the research suggests that there is a long way to go before refugee organisations can satisfactorily meet the needs of refugees in Britain, it also shows a pervasive lack of feed-back systems in those organisations. The study concludes with a number of recommendations to facilitate settlement, arguing that unless the available resources are used more efficiently, the effects of current legislation will be disastrous for the refugee population.

The purpose of this thesis is to describe the asylum seekers that reside in Turkey temporarily, from their own standpoint and from the viewpoint of workers and representatives working in the agencies and institutes involved in the field. This work focuses on the inconveniences experienced by asylum seekers and refugees during their stay in Turkey and the reasons of these inconveniences, in the context of social exclusion. The research for this thesis is based on the analysis of the in-depth interviews that were done with the asylum seekers, representatives and workers in UNHCR, government and in several NGOs. Relevant report by the UNHCR, and the scholarly literatures on migration and asylum and on transit migration and asylum seeking through Turkey was examined. The results of the study can be sorted as follows: Firstly, there is an increasing and visible reluctance to accept refugees in the world. Secondly, it is seen that Turkey does not have an effective asylum policy and legal arrangements on this issue. Thirdly, not only the asylum seekers but also the officers who are dealing with them face some problems. Lastly, it had been observed during the interviews asylum seekers are being excluded different ways during the period of living in Turkey.

Since the time of their arrival beginning around 2005, there remain approximately 46,000 African asylum seekers in Israel. The following paper reviews the foundations and implications of Israel’s political discourse in reference to the presence of this community. I situate the treatment of the asylum seekers in their relationship to the Jewish State, Zionist ideology, international refugee law, and Israel’s human rights community. I argue: 1) that the discourse surrounding the asylum seekers reflects larger changes within the ethos of the Jewish State and models of Israeli personhood; 2) that notions of “security” and “threat” in relation to the asylum seekers take on new meanings shaped by Israel’s ongoing demographic concerns; and 3) that the political response to the African asylum seekers sheds light on irreconcilable goals of the Zionist nation-building project seeking to both maintain a Jewish majority and liberate world Jewry from life segregated and isolated in the Diaspora.

Resumen
2013 marks another year wrought with debate on asylum seekers and whether they are in fact refugees, fuelled by a growing number of boat arrivals and significant cost to the Australian government. The major political parties in Australia have been focused on how to ‘stop the boats’ and finding alternative ways to process claims for refugee status. Media reports since August 2012 have referred to an enhanced screening process whereby asylum seekers arriving by boat have not been given access to Australia’s refugee status determination procedures, returned to their country without sufficient assessment of any claim for asylum. The Liberal-National Coalition indicated that they will introduce expedited processing of asylum seekers, modelled on the Detained Fast Track Processes in the United Kingdom. The expedited processing of asylum seekers is one alternative to standard refugee status determination procedures. This thesis examines whether Australia can meet its international protection obligations under the Convention relating to the Status of Refugees and the Protocol Relating to the Status of Refugees if expedited processing procedures are introduced with the appropriate procedural safeguards. An over view of the expedited procedures in practice in the UK and the US is followed by a comparative analysis and assessment of whether procedures in the US and the UK meet international protection obligations and contain the appropriate procedural safeguards. Finally I have developed recommendations for Australia based on my analysis of the expedited procedures in the US and the UK. If expedited processing is to be implemented in Australia it should complement our current system, not replace it, and any proposal must contain comprehensive procedural safeguards.

AbstractThis chapter engages the policy practices of the South African state in handling refugees and asylum seekers. The primary focus is on the articulation of migration policy concerning refugees and asylum seekers into physical infrastructure and the lived experiences of refugees in the urban context of Johannesburg. The research considers the decisionmaking timeline involved in developing the policy landscape and resulting migration infrastructure (or lack thereof) for refugees and asylum seekers. We explore policy as hard and soft infrastructure and note that, the refugee and asylum seeker policies in South Africa have at times been shaped to align to migration patterns retrospectively but in recent years - have taken a more restrictive position towards mobility more generally. In engaging these issues, the research draws on the existing literature and insights from key informant interviews with representatives of refugee protection NGOs, the City of Johannesburg migration unit and academic researchers.

Restrictions on freedom of movement, in particular the detention of asylum seekers as the most severe form of such restrictions, constitute an interference with fundamental human rights and must be approached with particular care. In view of the migration and refugee crisis, the Republic of Hungary has begun to amend its asylum legislation, thus tightening the conditions for the detention of asylum seekers. The introduction of the provision establishing that asylum may be sought only in transit zones has also led to the gradual detention of asylum seekers in transit zones, which Hungary did not consider as detention. This issue was brought before the Court of Justice of the European Union (hereinafter: CJEU), which drastically changed the path taken by the Hungarian government when it comes to detaining asylum seekers. What the CJEU has found is that leaving people in transit zones without the right to free movement is to be considered detention, even though they are not specialized detention facilities. The CJEU ordered that such a practice must cease immediately. Therefore, this paper will examine the Hungarian practice following the judgment of the CJEU. The CJEU has taken a major step towards protecting the rights of asylum seekers as regards detention, and the EU recently adopted amendments as part of the new Pact on Migration and Asylum aimed at improving the existing asylum system. The second part of the paper analyzes the provisions of the new Pact on Migration and Asylum related to detention in order to determine whether the proposed amendments contribute to the Common European Asylum System and the protection of the human rights of asylum seekers or represent a step backwards.

The refugee streams of 2015 had a tremendous impact on European societies. In context of the influx of refugees, civil society showed large solidarity. Universities did so as well, organizing programs to accommodate asylum seekers and refugees on campus. As solidarity is necessary for social relationships and coordinating life chances in a just way, the effectiveness of such programs can only be understood, taking insights from refugee students’ experiences into account. In this article the case example of the Austrian MORE Initiative is used to tackle the question what kind of bonds refugee students see between themselves, the universities and the goal to become part of the new (host) society. Results show that refugee students are in danger of not being recognized, either because of their legal status or lack of opportunities and migrant sceptic surroundings. Programs like MORE – and universities in general – may contribute to lessen these effects.

The Syrian crisis is the most complex crisis (political, social, humanitarian, security) in the world, since World War II. In regards to the 1951 „Geneva Convention on the Status of Refugees”, states have an obligation to provide refugees with a form of primary protection, which is not intended to replace asylum, but rather to provide an intermediate and immediate protection measure. At European level, for asylum seekers and refugees, there are several programs (developed by international institutions such as "UN for refugees" and "UNHCR") for integration into the host country during the temporary stay and return to the country of origin, when there are safety conditions. If this solution is not viable, they can opt for relocation to a third country. Effective management of the crisis created by the refugees flow requires the adoption of a common political agenda for European states to eliminate inequalities between states and focus on building viable economic strategies. Therefore, it is necessary to develop policies or strategies designed to provide refugees with a sense of security in the host country and their social assimilation, without being forced to give up their cultural identities. This article aims to analyse the strategies of the European states involved in this phenomenon, applied in the "Syrian refugee crisis". At the moment, the biggest part of the effort of counter-terrorism is focused on the criminal justice system. This means focusing almost exclusively on those who already intend to commit a crime and not on prevention. The legal repercussions can further encourage radicalization, which can degenerate later.

Social media plays an important role in the lives of refugees. In this study, we explored social media usage among Turkish refugees and asylum seekers settled in Norway. The relationship between social media usage and demographic variables has been examined. An online survey was used for data collection. The most commonly used social media platforms among participants are WhatsApp, YouTube, and Facebook. Among demographic variables, only age was found to have a significant relationship with social media use among participants. A significant negative correlation was detected between age and social media use.

More than a million migrants and refugees crossed into Europe in 2015. The number of asylum applications received in 2014 in EU Member States has risen by 25 per cent compared to the same period in 2013 and it is still increasing (The UN Refugee Agency). The current migrant crisis in Europe is described as the most serious since the Second World War. Reception Centers that provide homes for asylum-seekers and refugees, both as individuals and families, in most EU countries are overcrowded. Due to a growing problem of the luck of infrastructural facilities, the topic of modular construction is more and more relevant in european context. The article deals with the problematic of increasing demand for modular buildings as an answer (time, and cost effective) for European migrant crisis that requires delivery of the housing infrustructes in a very short time frame. The author asking the question about the near future of the modular social housing. How would it reflect on urban-space, living-space and whole attitude to modular construction issues? What is the role of the architect during the process of design-build? Is it possible to make references to “beauty” in the context of modular construction? The focus will be placed on the project based on permanent modular construction (PMC) - the modular social housing complex, implemented in July 2015 in Munich (scientific partner of the project is the Faculty of Architecture, Cracow University of Technology).

How do refugees and asylum seekers experience wellbeing and placemaking in urban contexts? The Displacement, Placemaking and Wellbeing in the City (DWELL) project explored this question through interviews with people working for non-governmental and community organisations in southeast England. It found that the current asylum system negatively impacts wellbeing and placemaking for asylum seekers, and that access to urban spaces is key to building community connections. Non-governmental organisations and faith groups play an important role in sustaining a sense of wellbeing and place for refugees and asylum seekers.

Most refugees and other migrants have limited opportunities to participate in politics to inform and influence the policies that affect them daily; they have limited voting rights and generally lack effective alternative forms of representation such as consultative bodies (Solano & Huddleston, 2020a, p. 33). Political participation is ‘absent (or almost absent) from integration strategies’ in Eastern European countries, while refugees and other migrants in Western Europe do enjoy significant local voting rights, stronger consultative bodies, more funding for immigrant organisations and greater support from mainstream organisations (Solano & Huddleston, 2020a, p. 33).This rapid review seeks to find out what lessons have been learned about political inclusion of refugees, particularly in European countries.In general, there appears to be limited evidence about the effectiveness of attempts to support the political participation of migrants/refugees. ‘The engagement of refugees and asylum-seekers in the political activities of their host countries is highly understudied’ (Jacobi, 2021, p. 3) and ‘the effects that integration policies have on immigrants’ representation remains an under-explored field’ (Petrarca, 2015, p. 9). The evidence that is available often comes from sources that cover the entire population or ethnic minorities without specifically targeting refugees or migrants, are biased towards samples of immigrants who are long-established in the host country and may not be representative of immigrant populations, or focus only on voting behaviour and neglect other forms of political participation (Bilodeau, 2016, pp. 30–31). Statistical data on refugees and integration policy areas and indicators is often weak or absent (Hopkins, 2013, pp. 9, 28–32, 60). Data may not distinguish clearly among refugees and other types of migrants by immigration status, origin country, or length of stay in the host country; may not allow correlating data collected during different time periods with policies in place during those periods and preceding periods; and may fail to collect a range of relevant migrant-specific social and demographic characteristics (Bilgili et al., 2015, pp. 22–23; Hopkins, 2013, p. 28).

In 2018, a team of University of Sussex undergraduate law students working under the supervision of academic staff, conducted the Migration Law Clinic Pilot Study. This was in response to growing and grave concerns about the lack of availability of legal support and services for those seeking asylum and other forms of leave to remain in the UK. These concerns have only heightened in the intervening period: most recently, in response to the government’s publication of a draft Bill of Rights to repeal and replace the Human Rights Act 1998, which would make it much more difficult for potential deportees to rely on Article 8 of the European Convention on Human Rights (ECHR) to prevent removal and might have a wider impact on the rights and status of vulnerable groups of migrants in the UK; and, among other initiatives, the government’s intention to involuntarily relocate asylum seekers to Rwanda, which will then be responsible for processing the asylum claim and for providing asylum in successful cases. The purposes of the study were: i) To better understand some of the challenges faced by asylum seekers and vulnerable migrants living in Brighton and Hove when applying for asylum, and other forms of leave to remain and leave to enter. ii) To identify the extent and reasons for any shortfall in cost-free immigration and asylum law advice and representation in Brighton and Hove. iii) To gauge whether there was demand for additional free legal advice in the form of a university law clinic, specialising in immigration and asylum law. The team undertook a review of the legal framework that governs the provision of legal aid for immigration and asylum law matters and of relevant academic commentary on its impact. The team also gathered new empirical data based on interviews with a range of local stakeholders. This report sets out the team’s findings, describes how it informed the development of the clinic, and makes recommendations both for the further development of the Clinic and for changes to the provision of legal aid. Finally, it offers advice to other universities contemplating setting up their own clinic in this area.

The Annual Report on Migration and Asylum 2016 provides an overview of trends, policy developments and significant debates in the area of asylum and migration during 2016 in Ireland. Some important developments in 2016 included: The International Protection Act 2015 was commenced throughout 2016. The single application procedure under the Act came into operation from 31 December 2016. The International Protection Office (IPO) replaced the Office of the Refugee Applications Commissioner (ORAC) from 31 December 2016. The first instance appeals body, the International Protection Appeals Tribunal (IPAT), replacing the Refugee Appeals Tribunal (RAT), was established on 31 December 2016. An online appointments system for all registrations at the Registration Office in Dublin was introduced. An electronic Employment Permits Online System (EPOS) was introduced. The Irish Short Stay Visa Waiver Programme was extended for a further five years to October 2021. The Second National Action Plan to Prevent and Combat Human Trafficking was published. 2016 was the first full year of implementation of the Irish Refugee Protection Programme (IRPP). A total of 240 persons were relocated to Ireland from Greece under the relocation strand of the programme and 356 persons were resettled to Ireland. Following an Oireachtas motion, the Government agreed to allocate up to 200 places to unaccompanied minors who had been living in the former migrant camp in Calais and who expressed a wish to come to Ireland. This figure is included in the overall total under the IRPP. Ireland and Jordan were appointed as co-facilitators in February 2016 to conduct preparatory negotiations for the UN high level Summit for Refugees and Migrants. The New York Declaration, of September 2016, sets out plans to start negotiations for a global compact for safe, orderly and regular migration and a global compact for refugees to be adopted in 2018. Key figures for 2016: There were approximately 115,000 non-EEA nationals with permission to remain in Ireland in 2016 compared to 114,000 at the end of 2015. Net inward migration for non-EU nationals is estimated to be 15,700. The number of newly arriving immigrants increased year-on-year to 84,600 at April 2017 from 82,300 at end April 2016. Non-EU nationals represented 34.8 per cent of this total at end April 2017. A total of 104,572 visas, both long stay and short stay, were issued in 2016. Approximately 4,127 persons were refused entry to Ireland at the external borders. Of these, 396 were subsequently admitted to pursue a protection application. 428 persons were returned from Ireland as part of forced return measures, with 187 availing of voluntary return, of which 143 were assisted by the International Organization for Migration Assisted Voluntary Return Programme. There were 532 permissions of leave to remain granted under section 3 of the Immigration Act 1999 during 2016. A total of 2,244 applications for refugee status were received in 2016, a drop of 32 per cent from 2015 (3,276). 641 subsidiary protection cases were processed and 431 new applications for subsidiary protection were submitted. 358 applications for family reunification in respect of recognised refugees were received. A total of 95 alleged trafficking victims were identified, compared with 78 in 2015.
