Texto completoIn the preface to many Provençal doctrinal works from the end of the 18th century, their authors, such as Jean-Joseph JULIEN (1704-1789) or Marc-Antoine DE BARRIGUE DE MONTVALON (1714-1775), teach that Roman Law is the « Law of Provence » (territory of the South of France). From the 17th century, a Provençal legal literature emerged to study the use of the Corpus Iuris Civilis within royal justice. Among it is the « Code Buisson » (simplified title), an explanation of the Justinian Code by a lawyer from the Parlement d'Aix (French royal Court) named BUISSON. This work, which has never been printed by anyone, becomes a classic of Law in Provence of the Age of Enlightenment. Indeed, all jurists, both practitioners and magistrates, have a handwritten copy, sometimes supplemented by the new royal legislation and the new judgments of the Court of Aix. However, despite this celebrity, no one knows the true identity of this Aix lawyer. Our study is the first to look at the Code Buisson and its author. Its objective is to restore the letters of nobility to the learned lawyer of the Grand Siècle who is Honoré BUISSON (1624-1692), forgotten in the memories of the Provençals until now

Texto completoThe “vir bonus” is often mentioned in the sources. However, the “vir bonus” is not only an ethical ideal, but also a hermeneutic criterion that allows us to interpret and integrate the legal acts. This is the technical meaning given to it by the jurisconsults, at least starting from the II century a.C..The “vir bonus” should be replaced in the general context of Roman arbitration and distinguished from the “arbiter ex compromisso”. In particular, the “vir bonus” is used the field of obligation and inheritance rights. Therefore, it is used in bilateral as well as unilateral judiciary stores. At times, speaking of the “vir bonus” a third party is implied, called into question through the role and actions of a “vir bonus”; however, this third party often has an objective value. In this hypothesis, an honest man’s judgment (“arbitratus boni viri”) has an abstract value. Even though there is a link between the concepts of “vir bonus” and “bona fides”, the hermeneutic criterion of the “vir bonus” is also used in the actions that are “stricti iuris”. The use of the “arbitrates”“boni viri” allows judgment to be more flexible without questioning the “stricti iuris” nature of the action

Texto completoThe study of "Acceptance in contractual relationships" has led to the research of its notion, its constituent elements, its legal nature and its effects. The results of this research reveal that Acceptance is based on a material criterion that is objective, constant and irreducible : the transfer of a thing, coporeal, or incoproeal, from the sender to the consignee that generates a new material or legal situation. The attitude of consignee confronted with a material element, a more variable subjective criterion conditions two modes of Acceptance. The Passive Acceptance, stripped of any voluntary element and composed solely of a material element,has only exceptionnally legal implications. The Active Acceptance, on the contrary, is formulated with an additionnal criterion, a voluntary element, which leads the Acceptance towards a unity of nature and function. The Active Acceptance, a unilateral act, produces two essential effects; a creating effect and a liberating effect. In a context where there is a continuous development of the intangible, the answer to the question, "What is Acceptance ?" suggests favoring an active definition of the notion, synonymous with a shared will, the only answer susceptible of guaranteeing the respect of individual liberties, the balance and the security of transactions

Texto completoThis dissertation conducts a systematic examination of Jean-Jacques Rousseau 's representation of Antiquity and provides a new interpretation of its meaning. Rousseau's lifelong interest in ancient Greece and Rome has so far been interpreted mainly as a personal myth, rooted in his emotional identification with examples of civic virtue. Challenging this interpretation, I analyze Rousseau's vision of Antiquity as a carefully constructed representatio n that seeks to answer key questions of early modern political thought. As he constructs his political system, Rousseau considers ancient material through a complex web of mediations, which alter his representation of Antiquity . The admiration for great men inherited from his childhood reading of Plutarch quickly turns into the construction of dynamic political models. Rousseau draws on ancient historical examples, as weil as on Plato's and Aristotle's political philosophy, to articulate his own definition of key modern political concepts such as sovereignty and body politic. In Rousseau's view ancient cities were politically successful because they fully understood the fundamental connection between anthropology and politics, placing the moral education of the citizens at the core of political action. Studying examples of ancient cities thus becomes indispensable not only to define a truly legitimate political structure, but also to design methods and practices to make it last over ti me. In this respect, the Roman Republic, whose institutions more successfully faced the challenge of history, serves as a more significant political model than Sparta. Reassessing Rousseau's representation of Antiquity thus allows usto reevaluate the place of government in his political system

It permits us to have a better apprehension of the astonishing plasticity of portico, able to be at the origin of the hellenistic period, then to ? and support a political system corresponding largely to its vision of the word : the roman empire. Lastly it managed to survive this very system and to influence the great doctrine from christianity to modern times, as weel as contemporany political thinking in some respects. Indeed, as a political ideology the contribution of stoicism is certainly to have been able to concerve the whole, a universal monarchy in which all individuals can find a place. As a political moral doctrine, it is to have wanted and to have been able to safeguard the freedom of each of the individual in this whole. Almost officially adopted by rome and its emperors, stoicism went much further. Its notion of the individual resting upon the archetypal sage, its notion of a world that is one and universal, its philosophical notion of the harmony between these two poles : the individual and the universal, gave rise to the cult of an inner god renderer to the core of the individual

By the conceptualization of the acceptance of the work, he intends to mark the caesura with the neighboring legal concepts such as delivery, completion... Of the technical aspects of the acceptance of the work, the law foresees inter alia an amicable approval or, in its absence a court order, but in any case contradictory. Functionally, the unilateral act of acceptance of work is presented as the cornerstone of a plethora of legal effects. Faced with all of this legal data, law practitioners are interpreters or publishers. In the recording studio or in the publishing house, the interpreter or publisher appreciates the composition, the literary book elaborated for the purpose of approving, disapproving, proposing adjustments or filling gaps. In the context of construction law, as they wear a reversible coat, they act both as a lawyer and a prosecutor. The lawsuit of the acceptance of the work globally states of a legal perception marked with plasticity. According to the trial can be revealed a symmetry between the acceptance and the nearby notions. In reality, observation of the technicality of the acceptance of the work reveals new modalities such as the tacit shape of the legal notion. In practice, it does not still occur an inhibitor impact in the absence of acceptance. Often, the completion of the work acts as ersatz of the legal act of acceptance. It must therefore be concluded that it is in the synthesis of the dogmatic apprehension of the legislator and the pragmatic apprehension of law practitioners that the safety of the legal concept resides

Texto completoLiving at the precapitalist period and juridically supported by habits and customs as well as by muslim law, morocco has received from the french protectorate (in 1913), the capitalist way of production and its juridical consequence, the french labor law. At the begening, the law will be applied to the settlers living in morocco. After the independance time, it will be maintened and corrected, and finally extended to the moroccan in their labor relationships. Moreover, that law will be quite conformed to the line of international labor norms. That law, which corresponds to a democratic society, homogeneous and seculor, is facing up to the juridical and extra-juridical norms of moroccan society, due to its heterogeneous features. The moroccan society experiences, even a juridical and judicial pluralism which held up the accepted law to spread out, that its heterogeneous way of production reduces its own sphere of implementation. Besides those different oppositions towards the accepted law which are based, as well as on the law, that into the moroccan society, others have emerged from the practice of the judicial and administrative authorities. Trade unions which the main goal consists in the defense of economical and professionnal rights of its members experiences many difficulties to have this law respected by managers few involved in social problems. The intervention of public lawers in the field of the labor reduces the action of trade union to its simplest terms

Texto completoRoman patronage in court evolves from the archaic patronage of the clientes. The patroni quickly distance themselves from their general role as protectors of the weakest citizens, in order to become orators in court. Their relation to the litigants is not necessarily a client-type relationship and under the republic, this relation is deprived of a juridical nature. The service of assistance in court is initially accorded for free, but it is accompanied by several grants of a different nature. Progressively, it becomes a paid service. Fees or presents are given or demanded in exchange of the service of defence in court. This practice, which permits the intrusion of new subjects in the exclusive circle of lawyers, is not well seen by the aristocratic patrons. At the beginning of the empire, the new political, social and economic conditions finally legalise the fees. Nevertheless, roman legislation stays hostile for a long period to the concept of lawyers' fees, but finally accepts the principle of their remuneration and progressively creates a juridical context that fixes the details of its operation. The lawyers' activity is profoundly influenced by the fees' generalisation : the fees contribute to the formation of its professional character. Lawyers can now come from different social backgrounds and make a living, if not get rich, by the exercise of their paid services. The activity, accessible in monetary and social terms, continues to progress and specialise. However, the activity of orators of mediocre level, attracted by the possibility of enrichment, results in a certain degradation of the lawyers' activity. Finally, as fees become an integral part of the service of assistance in court, the advocate-litigant relation acquires a juridical nature. This relationship takes the form of an innominate contract, in which the service of defence in court and its fees are closely connected

Texto completoTraditionally, obligation is defined as the legal relationship whereby we are forced to others to give, to do or notto do something. This classical definition, conceded by everyone, would be right only because it directly comesfrom roman law.The historical argument doesn’t resist, yet, to a careful study. The roman obligation is not the obligation we areused to. Romans saw in the obligation a pure link of constraint, focused on the debtor, but they totally ignoredthe “personal right” aspect of the modern obligation. The notion we are using today proceeds from acontemporary meet (sixteenth century) between roman tradition and the subjective right idea. Excepted that, inthe nineteenth century, the doctrine decided to reduce these two historical elements, one normative, the othersubjective, to one thing. According to it, the debt (vinculum juris) and the claim (subjective right) are two sidesof the same object : the obligation.This presentation is not tenable. Debt and claim involve more than a difference of angle. There nature is deeplydifferent. The first one is a norm which belongs to objective right whereas the second one belongs to subjectiveright. In other words, the obligation is binary : it is made up of two indivisible elements and their nature cannotbe seen as one. In positive law, this neo-classic approach of obligation allows to ease the relationships betweenthe obligation and its sanction, and allows to simplify some juridical events such as assignment of claims,delegation, set-off, merger or remission of debt

Texto completoIslamic financial law has its source in the Shariah, composed of the Quran and the Sunna, but also in commercial practice and rulings of scholars. The thesis focuses on Islamic finance contracts, the system’s cornerstone. It intends to demonstrate their integration into French law requires no legislative reform. This implies studying the fundamental rules governing these contracts in order to first specify them, and then to identify their common purpose: contractual justice. Though they significantly differ from French law, they are neither completely foreign to – nor incompatible with – our own system, which multiplies the provisions protecting contractual balance. Starting from the observation that acceptance is possible, the question arises as to its modalities. French law’s liberalism leaves ample room for the integration of Islamic rules into the contract by their incorporation or by submission to a foreign law that enshrines them. Assuming the agreement is governed by French law, it is necessary to establish, on the basis of positive law, the legal framework of Islamic finance nominate contracts. Echoing the intention the French government has expressed in the wake of the financial crisis, this thesis highlights the possibility and the modalities of the integration of Islamic finance contracts into French law
