Texto completoSince the end of the Second World War, legal thought has been marked by the resurgence of a search for the legitimacy of positive law. Jurists are concerned with ensuring the “correctness” of the law, and are keen to discover the justifications for the content of legal rules. This is reflected in the invocation of values to justify the existence, meaning and scope of fundamental rights. The quest for legitimacy in the content of positive legal rules is not new in itself. However, the specific project of justifying fundamental rights through values is quite original in its expression. First of all, what is at stake in these rights is nothing less than the protection of liberal ideals against the threats to which they may be subject. Understanding the project of an axiological justification of law is thus situated within the framework of the presuppositions of the liberal state. Secondly, the notions of value and fundamental rights are part of intellectual modernity, characterized by pluralism and the difficulty of finding solid justifications for political and legal organization. As a result, the search for legitimacy in the law has taken on a new meaning. The aim of this study is to understand the significance of this project, and to consider the difficulties it encounters. These prove insurmountable when justification is understood as a foundation. On the other hand, when the foundation is abandoned in favor of argumentation, these difficulties appear, not as definitive obstacles, but as expressions of the equilibrium on which the liberal state rests

Texto completo" If god is dead, everything is allowed ", as Dostoïevski once put it. Now, divine knowledge does not exist in law system : no godlike arbitration, no supernatural proofs. Giving the power of judging to reason alone proves chaotic and does not solve any problem : after ordeals came torture, and yet these remain uncertainty. Even worse, a reasonable use of legal ordeals is quite possible and their disappearing is but a condiiton which is neither sufficient nor necessary to the triumph of truth and reason. However judging has been devolved upon reason. Now, the law is neither rational, nor conceived as a rational system. At the root it remains reasonable, even if reasonable probability and reasonable grounds are unable to allow a positive definition. It may happen that the judge has to discard a reasonable solution. Consequently only a negative definition of the law can be thought of : the law rejects contradiction and, therefore, the irrational. But this rejection can only be conceived from a synchronic point of view : from a diachronic point of view only the unreasonable permits to define which is outside the law. Moreover, the irrational being rejected only because it is deemed as unreasonable, this latter is the basis of the true criterium of the absence of law. Supposing the signifiant is known - i. E. The unreasonable - the signified (the contents) can vary. The judiciary existentialism that results of it makes us collectively and individually responsible for our law, concerning its present reality and its future : acknowledging this distressing freedom thus becomes the necessary condition to face the problem of the meaning and the aims of the law

Texto completoThe housing policy in Algeria, long overlooked in legal studies despite its importance, is brought to light. Its historical evolution, marked by discriminatory colonial practices, as well as post-independence reforms aimed at addressing these inequalities with a particular focus on social housing, are highlighted. Since the 1980s, the private sector has been gradually integrated into housing policy, under the influence of international institutions. The study focuses on the Algerian legal framework without comparing it to other systems, and adopts an interdisciplinary approach to analyze the legal and socio-economic dimensions. However, challenges arise due to the lack of doctrinal research and reliable data.This research questions the coherence and effectiveness of housing laws in Algeria, which are often costly for the state, and explores alternatives such as public-private partnerships. It highlights the ambiguity of the legal framework, where the right to housing, although enshrined in the Constitution, remains largely symbolic. The study is structured in two parts: an analysis of the legal framework and a critical evaluation of housing policies, with reform proposals to improve their coherence and effectiveness.The evolution of housing policy in Algeria has been marked by the diversity of strategies adopted, dominated by a central actor: the state. After independence, the state exclusively controlled housing policy, a situation justified by the post-colonial context. However, over time, this state dominance has shown its limits, making the involvement of other actors necessary. The state's gradual withdrawal aimed to establish cooperation with the private sector, but the latter was not sufficiently prepared to take over, complicating the implementation of policies and housing legislation.This policy shift is also influenced by budgetary concerns. Massive investments in housing construction have led to exorbitant financial costs, necessitating reforms. It is increasingly recognized that the state can no longer be the sole provider of housing. A more diversified and cooperative approach is being advocated, although attempts at change are marked by ambiguities and resistance.The housing policy in Algeria, despite considerable investments and a clear intent to meet housing needs, shows limitations in terms of efficiency and financial sustainability. While efforts have been made to address the housing deficit, the results have not met expectations, and the policy is often perceived as costly and poorly adapted, persisting despite recurring obstacles.Unlike the global trend towards neoliberal policies, Algeria has chosen to maintain a strong social policy, particularly in the housing sector. Although this approach is recognized by some international organizations, it is becoming increasingly difficult to sustain financially and to make truly effective. This persistence has drawn criticism, with some arguing that the housing policy serves political interests more than those of the citizens.Administrative complexity, multiple regulations, and the lack of significant contribution from Algerian legal scholars also hinder progress. Housing law in Algeria is underdeveloped, making it urgent to rethink the policy in depth. It is essential to integrate new economic actors and to better structure the legal framework of the sector to ensure a more sustainable and effective future

Texto completoSociété Civile Immobilière (SCI) is a French legal technique intended to purchase and manage different kinds of real estates. Since the beginning of the 1980’s this concept has been very successful. The béneficiaries range from individuals (with various degrees of wealth) to legal advisers, lawyers, chartered accountants and bankers in charge of theirs client’s investments. The first are referred to as “users”, whilst the latter ones are referred to as “inventors”. This phenomenon represents an important economic, legal, urban and social phenomenon which has not yet been analysed by social science specialists. Therefore the main challenge of this analysis is to convert a legal and financial topic to a sociological one. Our methodology is based upon the main economic, legal, scientific and technological sociologies. The shareholders in a SCI, i. E. Owners of an intangible estate investment, have a particular social-legal identity. They have a hybrid status, at the junction between the home owner and the investor. This positions them more or less consciously in the middle of a contemporary rationalisation process of investment and estate management practices. This system illustrates the growing business-awareness of the home owner. He is defined as a project manager, more or less innovative who evolves in an ever-changing environment and is capable of formulating various scenarios. He follows a career path. However he can be helped in defining his projects both on a strategic and tactical level by experts in property ownership. The use or even the over-use of this technique means there is an increasing diversification in the property ownership counselling jobs. These growing trends are occurring in a growing market and in an inter-professional system where material and intellectual issues rival with collaborations, co-operations and synergies. The hinges of a relationship with unite professionals and shareholders are, amongst others: interactivity, performance, trust and honesty. The diffusion of company information and its materialistic repercussions go through diverse and various socialising instances. SCI practices and techniques used lead towards a legal acculturation. Shareholders assimilate and juggle with SCI norms leading sometimes to confrontation with social, cultural, family, contractual, ethical or moral ones. Syncretism has been more or less successful. The second main objective of this analysis is to observe what place the law takes in an individual/collective system, i. E. To look at the inter-normalisation phenomenon. SCI rules can be considered as contractual rules which help build a dynamic collective action, or can feed the illusion. They can just easily structure or disorganise groups of shareholders
