Resumen
The history of land dispossession in South Africa affected communities in the former homelands in multiple ways. The laws used to implement policies of segregation and dispossession undermined the rights to land held by black South Africans living in the countryside. Women living in these communities suffered under the dual burden of diminished status in the eyes of the law and landlessness. This history has shaped the current reality of women living on communal land in rural South Africa and has influenced the development and security of their land rights. In the context of a Constitutionally protected right to secure tenure, this dissertation discusses relevant literature, past legislative interventions and present-day laws, bills and policies in order to foreground the powerful role of framing in determining whose land rights are recognised and protected. Drawing on further literature and empirical research I discuss the interaction between top down approaches to framing laws and the assignment of status, an aspect that is crucial for black women. I discuss this alongside the lived experiences of women claiming residential land in a rural Eastern Cape community in order to foreground the inherent shortcomings of such top down approaches and their inability to fully recognise and protect the land rights of rural women.

This thesis analyses the use of law in the emergence and functioning of public enterprises in Bangladesh, which are viewed as a politico-economic and legal institution devised to implement public policy. According to a meeting of experts at Tangier (Morocco) from the 15-19 December 1980 on the "Concept, definition and classification of public enterprises", a public enterprise is an organisation which is: -owned by public authorities including central, state or local authorities, to the extent of fifty percent or more, -is under the top managerial control of the owning public authorities, such public control including, inter alia, the right to appoint management and to formulate critical policy decisions, -is established for the achievement of a defined set of public purposes, which may be multidimensional in character -and is consequently placed under a system of public accountability -is engaged in activities of a business character -involves the basic idea of investment and returns -and which markets its outputs in the shape of goods and services. Thus, public enterprises would include any commercial, financial, industrial, agricultural or promotional undertaking owned by a public authority, either wholly or through majority shareholding which is engaged in the production and sale of goods and services and whose affairs are capable of being recorded in the balance sheets and profit and loss accounts. In spite of the fact that many of the problems of public enterprises are a direct concern of lawyers, this thesis is the first attempt by a lawyer to study legal aspects of public enterprises in the context of Bangladesh. It aims to make an original contribution to the growing body of scholarship establishing links between public law and politics. It was undertaken at a time when the idea of privatisation is sweeping all over the world, necessitating a fresh discussion on the role of public enterprises and the practicality of significant privatisation in a poor country like Bangladesh. By its very nature, the thesis can only be both analytical as well as descriptive. The scheme of analysis involves reference to historical, political, social and economic factors that have contributed to the emergence of public enterprises in Bangladesh and the later privatisation of some of them The thesis is influenced by the recognition of the importance of contextual non-legal factors that have influenced the development process in Bangladesh. Like in many other developing countries, in Bangladesh the role of law in achieving developmental objectives has been over-emphasised. Of course problems of development have clearly influenced the perception of the predominant role of legislation. But law is only one factor interwoven with other factors in a wider social and economic fabric. This is not to de- emphasise the importance of formal legal provisions, but they should be seen as symbols of attempts to implement the law's underlying tasks, and, in the course of this, as providing political resources which individuals and groups can utilise to gain their ends. It is, therefore, important not to confuse the instruments of implementation with the underlying purposes themselves. Thus this thesis, instead of focusing only on the different kinds of legal rules, looks at the underlying power relationships in Bangladesh and the interests for which state power is being used which, in turn, influence the actual functioning of the public enterprises. The roles of the state and the bureaucracy in the functioning of public enterprises are included in this discussion. It explains the behaviour, performance and development of public enterprises in Bangladesh. It also, examines the political and socio-economic context in which public enterprises are embedded. The central hypothesis of the thesis is that the creation and operation of public enterprises are mostly determined by the character of the political coalition in power, and that political changes are reflected in intra-organisational dimensions. It recognizes that even though public enterprises are powerful socio-economic and legal entities, to understand their functioning it is necessary to analyse their external environment. Indeed, an adequate approach to public law should be to investigate public policy, and ask what demands government makes of the constitutional and legal systems in seeking to achieve its objectives, how those systems respond to those expectations, and the problems created by those responses for the government. Thus public law is a tool used to achieve public ends. The use of public law may occur directly either through the moulding of social processes by regulatory rules or through the establishment and definition of institutions. Thus the version of public law adopted in the thesis has for its main focus of interest the design of institutions through which public policy is implemented along with the relationship between those institutions and other parts of the constitutional structure. Therefore, a particular concern of this thesis will be institutional design for the operation of public enterprises in Bangladesh. Operational aspects include both organisation and management. Organisation is viewed as the structure of hierarchy in the functioning of public enterprises and management can be defined as the processes by which the work is accomplished including planning, financing, staffing, controlling various activities and ensuring accountability. The thesis concludes that, the legal forms and the law including measures of privatisation have not achieved what they had intended to. The benefit of the legal form can be achieved only when there is a full understanding and acceptance by the concerned parties viz., government, management and workers of what a legal form entails. Until public enterprise culture becomes more business-like, the changes in the legal form will be of little relevance. In order to improve the performance of public enterprises it is necessary to ensure true accountability of the government to the people. Without establishing real democracy in Bangladesh, which was mostly governed by martial law, framing rules and regulations to improve performance of public enterprises will largely be an exercise that will not ensure practical benefits to the country.

This study investigates the relationship between law and space by focusing on the role of the land-use planning system in producing the space of Australian urban regions. The primary aim of the project is to demonstrate the significance of the theoretical and sociological framework of Henri Lefebvre for an emerging field of socio-legal studies concerned with the relationship between law and geography. To this point very few contributions to this field have considered the theoretical connections between law and space in any depth. This thesis demonstrates how Lefebvre's sophisticated theory of the socially produced nature of space can broaden the scope of 'law and geography' research. It does so through a detailed survey of Lefebvre's work and a deployment of his ideas in a series of inquiries into the production of space in Australia. This endeavour is pursued in two stages. Part I of the thesis begins by examining how explanatory models within the social sciences have become increasingly concerned with the spatial dimensions of social life. This 'spatial turn' is reflected in a small, but growing literature within socio-legal studies which focuses on the interdisciplinary connections between law and geography. However the theoretical foundations of this field remain underdeveloped. Through an analysis of Lefebvre's writings, this thesis identifies an anti-reductionist methodological approach to space and its social production. This is used to establish a theoretical framework for the study of the spatial dimensions of law. Part II of the thesis uses this framework to address two questions about the law-space relationship. The first of these is concerned with how law is involved in the production of space. This is considered through three linked studies of the production, planning and legal regulation of space. The starting point for this investigation is the geographical site of suburbia. Lefebvrean categories are used to redescribe Australian suburbia as a form of abstract space - simultaneously fragmented, homogeneous and hierarchically organised. The thesis then argues that the land-use planning system in the post-war decades played a significant role in the development of this form of settlement space, by adhering to a form of bureaucratic thinking that Lefebvre characterises as the rationality of habitat. This rationality embodied technocratic functionalism, a visualised formalism and a structural imposition of expert authority in planning decision-making. With the shift to a neoliberal state form in the last two decades, there have been significant changes to spatial planning. Through an analysis and critique of the Integrated Planning Act 1997 (Qld), it is demonstrated that under neoliberalism there has been a reformulation of the rationality of habitat. In particular, the Integrated Planning Act relies on two new formal strategies, the exchange form and the integrative form, in instituting its changes to planning practice. The exchange form abolishes the technique of land-use 'zoning' and increases the use of market mechanisms in the designation of spatial uses. The integrative form restructures the relationships between local and State government agencies and attempts to channel most forms of public participation into the early stages of policy formation. This thesis argues that rather than changing the spatial outcomes of land-use planning, by commodifying space and restructuring the hierarchies of state decision-making, the Integrated Planning Act will continue to reproduce the social relations of abstract space. The second question in Part II deals with how Lefebvre's ideas can contribute to critical thinking about public law in general. It is argued that while law plays a significant role as a producer of space through the planning system, processes of spatial production also shape and structure state institutions. Two areas of research which could benefit from a Lefebvrean theoretical framework are identified. The first area concerns explanations of the effects on public law of the reterritorialised state form that has emerged under neoliberalism. The second is the renewal of critical theory in public law. In particular, the thesis makes the case that the spatial contradiction between the use and exchange values that are attached to space, challenges the normative orthodoxy within public law scholarship which relies on the values of participation and accountability. This thesis contributes to socio-legal research in three important ways. Firstly, it uses Lefebvre's theoretical approach to develop a critical planning law, linking state planning to the process of the production of space. Secondly, the thesis uses Lefebvrean categories to link the study of public law to political struggles which surround spatial production. It suggests a new way for critical legal scholarship to conceptualise public law in terms of the relationship between state power and the inhabitance of space. Lastly, these inquiries demonstrate the importance and relevance of Lefebvre's social theory for the discipline of socio-legal studies. By grounding the concept of 'space' in material processes of production, a Lefebvrean approach provides an alternative to existing theoretical accounts within law and geography research and will deepen our understanding of the relationships between legal and spatial relations.

ENGLISH ABSTRACT: This study explores public opinion on land reform in South Africa using data gathered by Ipsos-Markinor in nationally representative public opinion surveys conducted in 2004 and 2007, and by an elite survey conducted by Centre for International and Comparative Politics in 2007. This study explores whether public opinion on land reform reveals distinct trends that correlate with the selected socio-demographic variables of race, language, party affiliation and social status. It is hypothesised that there is an identifiable correlation between these independent variables and the opinions of respondents on land reform, with specific groups tending to support land reform whilst other groups tend to reject it. The data analyses yielded results that highlight distinct trends in public opinion on land reform. Responses are clustered around specific characteristics of the independent variables and point towards distinct groups having specific views on land reform. From this set of findings it is inferred that public opinion on land reform illustrates that certain groups of South Africans have contrasting views of how the rule of law and transformation should find expression in a democratic society. These fundamentally differing opinions on key elements of democracy illustrate that South Africans hold diverging opinions of what constitutes democracy, through adherence to either the liberal or the liberationist model of democracy. These models were previously identified as two distinct and diverging interpretations of democracy in South Africa and were labelled as such. These two models uphold sharply divergent normative prescriptions of democracy, as well as contrasting prescriptions for various policies of democratic consolidation, including that of land reform.
AFRIKAANSE OPSOMMING: Openbare mening oor grondhervorming in Suid-Afrika word in hierdie studie ondersoek. Die ondersoek maak gebruik van data ingewin deur Ipsos-Markinor in nasionaal verteenwoordigende openbare meningsopnames uitgevoer in 2004 en 2007, asook ‘n elite opname wat in 2007 uitgevoer is deur die Sentrum vir Internationale en Vergelykende Politiek (CICP). Hierdie studie ondersoek die moontlikheid dat openbare mening ten opsigte van grondhervorming met geselekteerde sosio-demografiese veranderlikes (ras, taal, politieke affiliasie en sosiale status) korreleer. Die hipotese is dat daar ‘n identifiseerbare korrelasie is tussen hierdie onafhanklike veranderlikes en die menings van die respondente ten opsigte van grondhervorming en dat daar spesifieke groepe is wat grondhervorming ondersteun en ander nie. Aspects of customary land tenure may survive even where formal rules in a society supersede custom. This thesis is about persisting custom for Maori Freehold land (MFL) in New Zealand, and the Communal Areas (CAs) of Zimbabwe. Three questions are addressed: what unwritten land tenure custom still persists for Ngai Tahu, Shona and Ndebele, what key historical processes and events in New Zealand and Zimbabwe shaped the relationship between people and land into the form it displays today, and how do we explain differences between surviving customary tenure practices in the two countries? The research was based on in-depth interviews. A key difference between the two countries was found to lie in the type and degree of security available over the years to Maori and Shona/Ndebele. Roots of security were found in the substance of the founding treaties and concessions, and thereafter in a variety of other factors including the help (or lack of it) offered by the law in redressing grievances, the level of intermarriage between settler and autochthon, the differing security of land rights offered in urban centres in the respective countries, demographic factors and the availability of state benefits. This research finds that greater security was offered to Maori than to Shona and Ndebele, and that this has reduced the centrality of customary practices with regard to land. The research found that, in Zimbabwe, tenure security in the CAs is still underwritten by communities and that significant investment is still made in both living and dead members of those communities. Another finding is that land custom has adapted dynamically to meet new challenges, such as urban land and CA land sales. In New Zealand, investment in groups that jointly hold rights in MFL has, to some extent been eclipsed by the payment of rates and the availability of services (e.g. state-maintained boundary records and law enforcement mechanisms) and of benefits (e.g. superannuation, disability and unemployment). Land and community are not as closely linked to survival as they were in the past and, for many, they have come to hold largely symbolic value and less practical significance. Overall, it is the pursuit of security and �belonging� that have been the greatest influences on customary land tenure practices in the long term.

This thesis also considers private company and NGO efforts towards sustainable development in the mining industry. The thesis concludes by recommending a public-private partnership for shared value in the mining industry with respect to sustainable development, meaning a partnership between industry, NGOs and public international institutions that generates economic value while simultaneously producing value to society by addressing societal and environmental problems.

ENGLISH ABSTRACT: South Africa's history led to an unequal distribution in land ownership, which is not conducive to democratic consolidation. Land refortn is the means to address this problem. However, land reform, part of the larger process of transformation, is a potentially dangerous process: it can have negative implications on the rule of law. The objective of this study is to provide an analysis of the dynamic relationship between land reform, the rule of law and transformation in South Africa, within the debate on democratic consolidation. One can distinguish two paradigms regarding democracy: the liberal paradigm and the liberationist paradigm. These two paradigms have divergent views on the way land reform and transformation should be implemented, and what the goal of these two processes is. The liberal paradigm would seem to be more favourable for democratic consolidation, while the liberationist paradigm is a breeding ground for populist transformation. Furthermore, the negotiated constitutional settlement has left land reform with an ambiguity. On the one hand the constitution forces the govemment to address land reform, but on the other hand it firmly entrenches the private property rights by enforcing the 'willing buyer, willing seller' principle, which makes the process more costly and time consuming. The main hypothesis of this study is: Demographic indicators (race, party affiliation and provincial setting) influence support or rejection of the land reform policies of the South African govemment. Tbe dependent variable is 'support or rejection of the government's land reform policies'. Support for the govemment's land reform policies is indicative of the liberal paradigm and rejection of the govemment's policies is indicative of the liberationist paradigm. It is found that the majority of South Africans reject the govemment's land reform policies. However, strong divisions are evident. Respondents differ along racial, party affiliation and provincial lines. Thus, the liberationist paradigm dominates, but the liberal paradigm has a strong presence, creating an ideologically divided society. This means that the legitimacy of South Africa's land reform project, as well as the legitimacy of the constitution, is under stress. This does not bode well for democratic consolidation, as the rule of law is under severe threat. Thus, one can conclude that land reform is not going to make a positive contribution to the consolidation of South Africa's democracy, if a substantial financial injection is not found to increase the efficiency of the process.
AFRIKAANSE OPSOMMING: Suid-Afrika se geskiedenis het aanleiding gegee tot 'n ongelyke verspreiding van grondeienaarskap. Dit is nie gunstig vir demokratiese konsolidasie nie. Grondhervorming IS die mamer waarmee die probleem aangespreek kan word. Grondhervorming, deel van die groter proses van transformasie, is egter 'n potensieel gevaarlike proses: dit kan negatiewe implikasies vir regsoewereiniteit hê. Die doel van hierdie tesis is om 'n analise van die dinamiese wisselwerking tussen grondhervorming, regsoewereiniteit en transformasie te verskaf, binne die debat oor demokratiese konsolidasie. Daar kan aangaande demokrasie tussen twee paradigmas onderskei word: die liberale paradigma en die bevrydings (liberationist) paradigma. Hierdie twee paradigmas het teenstrydige perspektiewe oor die manier waarop grondhervorming, sowel as transformasie, geïmplementeer behoort te word, sowel as wat die doel van hierdie twee prosesse is. Die liberale paradigma is meer geskik vir demokratiese konsolidasie, terwyl die bevrydings paradigma 'n teelaarde vir populistiese transformasie is. Aan die een kant vereis die grondwet dat die regering grondhervorming moet aanspreek, maar aan die anderkant bied dit 'n ferm onderskraging van private eiedomsreg deur op die 'gewillige koper, gewillige verkoper' beginsel aan te dring. Dit maak die grondhervormings proses langer en duurder. Die hoof hipotese van die studie is: Demografiese indikatore (ras, partyaffiliasie en provinsie) beïnvloed ondersteuning of verwerpmg van die regering se grondhervormingsbeleid. Die afhanklike veranderlike IS 'ondersteuning of verwerping van die regering se grondhervormingsbeleid '. Ondersteuning van die regering se grondhervormingsbeleid dui op die liberale paradigma, en die verwerping daarvan dui op die bevrydings paradigma. Daar word bevind dat die meerderheid Suid-Afrikaners die regenng se Respondente verskil volgens ras, partyaffiliasie en provinsie. Dus, die bevrydings paradigma domineer, maar die liberale paradigma het ook 'n sterk teenwoordigheid. Dit sorg vir 'n ideologies verdeelde samelewing. Dit beteken dat die legitimiteit van Suid-Afrika se grondhervormings projek, sowel as die legitimiteit van die grondwet, in gedrang is. Dit is nie 'n goeie teken vir demokratiese konsolidasie nie, aangesien dit regsoewereiniteit in die gedrang bring. Daarom kan daar tot die gevolg gekom word dat grondhervorming nie 'n positiewe bydrae ten opsigte van die konsolidasie van Suid-Afrikaanse demokrasie sal maak nie, tensy daar 'n beduidende finansiële inspuiting gevind kan word.

Cette thèse propose de simplifier et de moderniser le cadre juridique de l’occupation domaniale en ramenant la diversité des actes d’occupation à un régime contractuel commun, celui des contrats domaniaux, qu’elle définit comme des contrats de location des biens publics. Les contrats domaniaux, conclus sur le fondement du droit de propriété publique, portent sur tous les biens publics, qu’ils soient incorporés au domaine public ou au domaine privé, et établissent un rapport d’obligations entre les propriétaires publics et les occupants. Ce sont de véritables baux, qui octroient au cocontractant un droit de jouissance exclusive d’un bien public, pendant une certaine durée et en contrepartie d’un prix. Ils restent néanmoins soumis à un régime exorbitant du droit commun en raison de l’appropriation publique du bien loué. La thèse avance une typologie des contrats domaniaux à partir de leurs finalités d’habitation, d’exploitation économique et de construction. Sous l’effet de la politique de valorisation des biens publics, leur régime juridique s’harmonise et le droit des occupants se transforme. Il s’agit d’un droit de propriété locative, car l’occupant puise un droit de propriété de son titre, délimité par lui et cantonné à son existence. Pour poursuivre cette harmonisation et simplifier la gestion des biens publics, la thèse propose d’unifier législativement le régime juridique de la location publique
This thesis suggests to simplify and modernize the legal framework governing the use of public land by consolidating the variety of occupation acts into a common contractual regime, termed « contrats domaniaux ». These are defined as lease agreements for public properties. Based on the property right of public owners, they cover all public assets, whether incorporated into the public or private domain, and establish a set of obligations between public landlords and tenants. These contracts are, in effect, true leases granting the co-contractor an exclusive right to enjoy a public property for a specified period in return for a fee. However, they remain subject to special rules due to the public appropriation of the leased property. The thesis presents a typology of domain contracts based on their purposes: residential, economic exploitation, and construction. Under the influence of public asset valorization policies, their legal status is harmonizing, and the rights of occupants are evolving. Occupants have a « rental property right », as they derive their right from their contract, defined and limited by its terms. To further this harmonization and simplify the management of public assets, the thesis suggests that legislation be passed to unify the legal framework of public leases

Ideally, land use policies correct for negative externalities. However, the barriers they impose on individuals and communities have serious implications. Existing studies on this topic focus on singular, specific areas because land regulation is determined at the local level and varies extensively across the nation. Furthermore, current housing literature focuses on the “norm” of single family housing. This ignores the changing attitudes toward different types of dwellings. My study examines local regulatory environments across the nation by using Gyourko et al. 2008’s Wharton Residential Land Use Regulation Index, which develops a comparative scale for the otherwise impossibly varied regulatory environments. I also use micro data from the American Community Survey to see individual housing choices. Then, with a custom-made dataset from these two sources, I use empirical regression analysis to study the effects of land use regulation on people’s housing decisions, specifically the choice between a single-family house and a multi-family apartment complex. My results show that more restrictive regulation makes a person more likely to rent their home as well as occupy a multi-family apartment complex as opposed to a single-family home.

ENGLISH ABSTRACT: All agricultural subdivisions in the Republic of South Africa are regulated by the Subdivision of Agricultural Land Act 70 of 1970. The declared purpose of the Act is to prevent the creation of uneconomic farming units and this purpose is achieved through the requirement that the Minister of Agriculture, Forestry and Fisheries (“Minister of Agriculture”) must consent to the proposed subdivision. The Act was promulgated in the 1970s when the South African landscape was racially divided. The government of the time used law to provide benefits for the white minority. At this time the rights of non-whites were restricted. This is the social and political background of the Subdivision of Agricultural Land Act. The Act formed part of a legislative scheme that provided benefits for white farmers. More than a decade after democratisation and the end of apartheid the Subdivision of Agricultural Land Act is still in operation. The post-apartheid legislature drafted and enacted the Subdivision of Agricultural Land Act Repeal Act 64 of 1998, but it has not yet been brought into operation. During 2003 the legislature tabled the Draft Sustainable Utilisation of Agricultural Resources Bill which contains subdivision provisions that are identical to the provisions contained in the Subdivision Act. These legislative actions have created some uncertainty about the state of agricultural subdivisions. In 2008 the Constitutional Court decided that the Act continues to apply to all agricultural subdivisions and that this would be the position until the legislature chooses a definitive course of action. This constitutional analysis of the Subdivision of Agricultural Land Act examines the effect of the Act beyond the pre-constitutional legislative intention and framework under which it was enacted. If the Act cannot be saved from its apartheid context, the Repeal Act should become operational. This thesis concludes that the necessary and legitimate purpose of the Act, namely the regulation of subdivision of agricultural land, can be removed from its pre-constitutional setting in the apartheid era and may continue to justify the legitimate regulation of subdivision of land. Comparative sources, namely the United States of America, specifically the states of Oregon and Hawaii, Western Australia and the province of British Columbia, Canada indicate that the regulation of agricultural subdivisions is a valid means of protecting agricultural land. If the Act can continue to exist without its legacy of apartheid and still serves a legitimate and necessary purpose it will have to be constitutionally compliant. The purpose of the Act and the means used to realise it were tested against the Bill of Rights. The effect that the regulation has particularly on ownership entitlements was examined against section 25(1) of the 1996 Constitution. Similarly, the consequences of the regulation with regard to other rights in the Bill of Rights were investigated. The conclusion was that where the Subdivision of Agricultural Land Act is used for its purpose of preventing the uneconomic subdivision of agricultural land, in the national interest, it is a legitimate land-use regulation that can continue to justifiably operate in a constitutional dispensation.
AFRIKAANSE OPSOMMING: Alle onderverdelings van landbougrond in die Republiek van Suid-Afrika word gereguleer deur die Wet op die Onderverdeling van Landbougrond 70 van 1970. Die verklaarde doel van die Wet is om die totstandkoming van onekonomiese landboueenhede te voorkom, en hierdie doel word bereik deurdat die Minister van Landbou, Bosbou en Visserye (“Minister van Landbou”) toestemming moet verleen vir die voorgestelde onderverdeling van landbougrond. Die Wet is in die 1970s gepromulgeer toe grond in Suid-Afrika in terme van ras verdeel was. Die destydse apartheidsregering het die regstelsel gebruik om voordele vir die blanke minderheidsgroep te bewerkstellig, terwyl die regte van nie-blankes ingeperk was. Dit is die sosiale en politieke agtergrond waarteen die Wet op die Onderverdeling van Landbougrond tot stand gekom het. ENGLISH ABSTRACT: Section 25(2) of the 1996 Constitution states that property may only be expropriated for a public purpose or in the public interest and compensation must be paid. This dissertation analyses the public purpose and public interest requirement in light of recent court decisions, especially with regard to third party transfer of expropriated property for economic development purposes. The public purpose requirement is explained in terms of pre-constitutional case law to create a context in which to understand the public purpose and public interest in terms of the 1996 Constitution. This leads to a discussion of whether third party transfers for economic development purposes are generally for a public purpose or in the public interest. The legitimacy of the purpose of both the expropriation and the transfer of property to third parties in order to realise the purpose is considered. Conclusions from a discussion of foreign case law dealing with the same question are used to analyse the South African cases where third party transfers for economic development have been addressed. Based on the overview of foreign case law and the critical analysis of South African cases, the dissertation sets out guidelines that should be taken into account when this question comes up again in future. The dissertation also considers whether an expropriation can be set aside if alternative means, other than expropriating the property, are available that would also promote the purpose for which the property was expropriated. Recent decisions suggest that alternative and less invasive measures are irrelevant when the expropriation is clearly for a public purpose. However, the dissertation argues that less invasive means should be considered in cases where it is not immediately clear that the expropriation is for a valid public purpose or in the public interest, such as in the case of a third party transfer for economic development. The role of the public purpose post-expropriation is considered with reference to purposes that are not realised or are abandoned and subsequently changed. In this regard the dissertation considers whether the state is allowed to change the purpose for which the property was expropriated, and also under which circumstances the previous owner would be entitled to reclaim the expropriated property when the public purpose that justifies the expropriation falls away. It is contended that the purpose can be changed, but that the new purpose must also comply with the constitutional requirements.
AFRIKAANSE OPSOMMING: Artikel 25(2) van die Grondwet van 1996 vereis dat `n onteining slegs vir `n openbare doel of in die openbare belang mag plaasvind, en dat vergoeding betaalbaar is. In die proefskrif word die openbare doel en openbare belang geanaliseer in die lig van onlangse regspraak wat veral verband hou met die onteining van grond wat oorgedra word aan derde partye vir doeleindes van ekonomiese ontwikkeling. Die openbare doel vereiste word geanaliseer in die lig van respraak voor die aanvang van die grondwetlike bedeling om beide die openbare doel en openbare belang in terme van die Grondwet van 1996 te verstaan. Op grond van hierdie bespreking word die vraag ondersoek of die onteiening van grond vir ekonomiese ontwikkeling en die oordrag daarvan aan derde partye vir `n openbare doel of in die openbare belang is. Daar word hier aangevoer dat die beskikbaarheid van alternatiewe metodes in ag geneem behoort te word in gevalle waar dit onduidelik is of die onteining vir `n openbare doel of in die openbare belang geskied, soos in die geval van oordrag van grond aan derde partye vir ekonomiese ontwikkelingsdoeleindes. Ter aansluiting by die vraag of die onteining van grond vir oordrag aan derdes vir ekonomiese ontwikkeling geldig is, word die funksie van die openbare doel na onteiening ook ondersoek. Die vraag is of die staat geregtig is om die doel waarvoor die eiendom onteien is na afloop van die onteiening te verander. Die vraag in watter gevalle die vorige eienaar van die grond teruggawe van die grond kan eis word ook aangespreek. Daar word aangevoer dat die staat die doel waarvoor die eiendom benut word kan verander, maar dat die nuwe doel ook moet voldoen aan die grondwetlike vereistes.

In Canada and New Zealand there are increasing calls for recognition of aboriginal rights which previously were ignored or denied because of the application of English law to concepts of property rights and ownership. English legal principles are vitally important in Canadian and New Zealand society, but there has always been room for local adaptations which could have recognised the existing practices and rights of the indigenous peoples. The English law makes various assumptions about ownership of rivers, dividing them into bed, banks and water, and applying various tests of adjoining occupation, tidalness and navigability to determine rights. Aboriginal property rights have been guaranteed and protected by various mechanisms such as government policy, treaty, and the courts, but there is uncertainty about the status of rivers. The form of the survey definition of reserves and rivers is also fundamental to how property rights may be determined. This thesis examines the situation of rivers in Canada and New Zealand through common law, treaty provisions and through what is now, a developing body of applicable and recognised customary/Aboriginal law. From these three legal foundations, a case study approach focuses on the practical situation of the Siksika people on the Bow River in southern Alberta, and the Kai Tahu on the Taieri River in Otago. This investigation concludes that there are various legal mechanisms by which indigenous people may claim rights to the rivers with which they have a relationship; by resorting to English common law principles; by applying new and developing conceptualisations of customary and aboriginal rights doctrines; by appealing to tribunals examining treaty agreements; or by direct negotiation with the Crown. All of these processes require evidence of past and current relationships, use and occupation of rivers by the indigenous claimants. Current undisputed possession and control may be a satisfactory outcome, but ultimately an acknowledgement of ownership may depend on politically negotiated settlements.

Šiame magistrantūros studijų baigiamajame darbe nagrinėjama privačios žemės paėmimo visuomenės poreikiams procesas ir tvarka, aptariami charakteringi žemės paėmimo visuomenės poreikiams atvejai Kauno rajone. Tyrimo tikslas įvertinti žemės paėmimo visuomenės poreikiams procesą Kauno rajone, bei išanalizuoti teorines ir praktines problemas, susijusias su nuosavybės paėmimu visuomenės poreikiams. Galima teigti, jog nuosavybės teisė nėra priskiriama absoliučioms žmogaus teisėms, ji gali būti paimama visuomenės poreikiams. Nuosavybė iš jos savininko, nepriklausomai nuo jo valios, gali būti paimama tik Žemės įstatymo nustatyta tvarka, bei už paimamą nuosavybę yra privalomas teisingas atlyginimas. Viena iš pagrindinių žemės paėmimo visuomenės poreikiams problemų yra šio proceso trukmė, kuri gali užsitęsti nuo 3 iki 8 m., bei ginčai kylantys tarp paimamos žemės savininkų ir žemės paėmimu suinteresuotos institucijos. 2011 metais priėmus naują žemės įstatymo redakciją tikimasi nustatyti aiškesnę ir skaidresnę žemės paėmimo visuomenės poreikiams tvarką, leisiančią greičiau įgyvendinti visuomenei svarbius investicinius projektus. Iki šiol galiojusi žemės paėmimo visuomenės reikmėms tvarka nepakankamai tiksliai reglamentavo konkrečius šios procedūros terminus ir etapus. Įstatymo pataisomis įtvirtinama greitesnė, paprastesnė ir skaidresnė žemės paėmimo visuomenės poreikiams procedūra.

The study is aimed at revealing problems related to projects for taking the land for public needs in Kaunas region. Objectives of the research: 1. To analyse the law that deternines rules for taking the land for public needs. 2. To reveal the problems which arise when projects are prepared for taking the land for public needs. 3. To describe some objects which are needed for public in the Kaunas Region. 4. To analyse the most common cases of land taking in the Kaunas Region. 5. To analyze the processes that went when the land was taken for building the Vainatrakis cemetery. This work is a digital version of a dissertation that was first submitted in partial fulfillment of the Degree of Doctor of Philosophy at the Queensland University of Technology (QUT) in March 1994. The work was concerned with problems of self-organisation and organisation ranging from local to global levels of hierarchy. It considers organisations as living entities from local to global things that a living entity – more particularly, an individual, a body corporate or a body politic - must know and do to maintain an existence – that is to remain viable – or to be sustainable. The term ‘land management’ as used in 1994 was later subsumed into a more general concept of ‘natural resource management’ and then merged with ideas about sustainable socioeconomic and sustainable ecological development. The cybernetic approach contains many cognitive elements of human observation, language and learning that combine into production processes. The approach tends to highlight instances where systems (or organisations) can fail because they have very little chance of succeeding. Thus there are logical necessities as well as technical possibilities in designing, constructing, operating and maintaining production systems that function reliably over extended periods. Tiriamasis darbas atliekamas analizuojant teisės aktus, teritorijų planavimo dokumentus ir statistinius duomenis. Tyrimui įgyvendinti iškelti uždaviniai: 1. The work object is the land acquisition for public needs, i.e. for ”Via Baltica” road in Marijampolė district. The aim of the research is to define the plan preparation problems of land acquisition for public needs. Research work is conducted by analyzing legislation, territory planning documents and statistic data. The objectives for the implementation of the study are as follows: 1. To investigate the legislation governing land acquisition for public needs; 2. To identify the plan preparation problems of land acquisition for public needs; 3. To analyze the situation in relation to ”Via Baltica” road; 4. To analyze statistically the land acquisition for public needs near ”Via Baltica” road. The objective of this thesis is to develop a conceptual model for classification of real property rights and public regulations. The model is called the Legal Cadastral Domain Model. The model is intended to be a terminological framework for cross-border exchange of cadastral information. Parties exchanging cadastral information via the model do not require detailed knowledge of the legal system in which the right or regulation is created. The model is based on the principle that real property rights and public regulations influence real property ownership by being either beneficial or encumbering for the real property owner. The theoretical departure of the research presented in this thesis is in comparative legal theory and terminology. Real property rights and public regulations are important parts of real property legislation as they describe and secure the use and other exploitation of land, water and air. The research is conducted through studies in real property legislation and associated literature. The model has been developed through case studies on real property rights in Portugal, Germany, Ireland, the Netherlands and Sweden and public regulations in Portugal and Sweden. The generated results show that it seems possible to describe real property rights and public regulations regardless of their legal origin, at least in Western legal systems. The thesis also includes a discussion of terminological aspects concerning definitions of three-dimensional (3D) real property. The thesis consists of a summary and 6 papers.

This dissertation examines the application and effect of Article 1 of the First Protocol to the ECHR in relation to Scots land law reform. Chapter one will reflect on why existing rights to property have come to be challenged. Chapter two sets out the human rights paradigm and scrutinises what rights and whose rights are engaged. Chapter three traces the development of A1P1. Chapter four applies the human rights paradigm to contemporary reforms. Chapter five considers the broader effect A1P1 has had on domestic property law. This dissertation submits that the problem to be overcome is that, in many instances, Scots land law reform has been reduced into a simplistic struggle. A1P1 has been held up as either a citadel protecting landowners or as an ineffective and unjustified right to be ignored. At the core of this debate are competing claims between liberal individualist rights to property and socially democratic, egalitarian goals. This dissertation argues that it is important to move beyond this binary debate. This is not about finding some mysterious "red card" or eureka moment that conclusively shows compatibility or incompatibility. Instead, compatibility will be determined by following a rule-based approach that values rational decision-making and the best available evidence, as well as the importance of democratic institutions. As such, it will be illustrated how future challenges are likely to focus not on the underlying purpose of land law reform but on the macro or micro granularity of Ministerial discretion. In coming to this conclusion, it will be argued that A1P1 has a pervasive influence on the entire workings of all public bodies and, like a dye, permeates the legislative process.

The topic studied in this thesis is the right of public access as a legal institution. In that connection, several questions which are different from each other are raised. The thesis focuses to a great extent on the interaction between questions of a practical-legal nature and those whose character is more connected to legal theory. The point of departure of the discussion in the thesis is that some of the legal norms that are incorporated in the institution of the right of public access are customary law. Thus, the concept customary law is particularly considered, and the question of in what way the customary law can be filled with content raises special interest. A hypothesis is put forward in the thesis, which is that the right of public access constitutes part of those regulations whose purpose is that land should be used appropriately - seen from the societal perspective that land is a limited natural resource which should be used expediently, for the husbanding of resources. What is advocated in this thesis, is that in both the jurisprudential discussion about the right of public access and in the argumentation that is conducted in the practical legal application, the three subjects, the Actual User, the Canalizer and the Actual User in the Collective and their different use of the land, are separated. Further, it is advocated that the discussion as to which activities are allowed by the right of public access should be based on a consciousness that the activities can concern “everyday use” or “recreation” and that, depending on whether the activities are considered to concern the one or the other, different conclusions regarding the permissibility of the activities will be drawn. Furthermore, it is shown in the thesis that in conflicts between different means of using land, the courts seem to presume that all land is covered by the right of public access - a presumption that does not hold if the land is a part of somebody’s zone of home privacy, is needed for certain business or constitute biologically sensitive land.
I denna avhandling studeras allemansrätten som rättsinstitut. Därvid aktualiseras flera sinsemellan olikartade frågeställningar. Avhandlingen fokuserar i stor utsträckning på samspelet mellan frågor av praktisk-juridiskt slag och sådana av mer rättsteoretiskt slag. Diskussionen i avhandlingen utgår från att vissa av de i institutet allemansrätten ingående rättsliga normerna är sedvanerätt. Därför diskuteras sedvanerättsbegreppet särskilt, varvid frågan hur sedvanerätt kan fyllas med ett innehåll väcker särskilt intresse. I avhandlingen uppställs en hypotes om att allemansrätten är en del av en reglering syftande till lämplig markanvändning - sett ur den samhälleliga synvinkeln att mark är en begränsad naturresurs som bör nyttjas ändamålsenligt, för hushållning med resurser. I avhandlingen förespråkas att man i såväl den rättsvetenskapliga diskussionen om allemansrätten, som i den argumentation som förs i den praktiska rättstillämpningen, särskiljer de tre subjekten utövaren, kanalisatören och utövaren i kollektivet och deras skilda nyttjande. Vidare förespråkas att diskussionen, om vilka aktiviteter som är allemansrättsligt tillåtna, sker utifrån en medvetenhet om att aktiviteterna kan avse ”vardagsnytta” eller ”rekreation” och att, beroende av om aktiviteterna antas avse det ena eller det andra, olika slutsatser angående aktiviteternas tillåtlighet kommer att dras. Därtill visas i avhandlingen att domstolen, i konflikter mellan olika sätt att nyttja marken, tycks presumera att all mark är allemansrättsligt tillgänglig - en presumtion som bryts om marken ingår i någons hemfridszon, behövs för vissa näringar eller utgör biologiskt känslig mark.

Роботу присвячено системному аналізу ґенези змісту поняття «земельні відносини», його впливу на розвиток сучасних державотворчих процесів в Україні. У контексті аналізу напрацювань істориків права минулих поколінь та сучасної наукової думки досліджено еволюцію галузевої належності норм, що регулювали земельні відносини, на підставі чого визначено особливості правового режиму землі як об’єкту публічно-правових та приватноправових (майнових) відносин. В контексті сучасних уявлень та надбань загальної концепції правового становища охарактеризовано статус суб’єктів владних повноважень, які упорядковували земельні відносини на теренах України з часів формування Української козацької держави до розпаду Союзу РСР та відродження незалежної України. Показано в історико-правовій площині динаміку розвитку юридичного, соціального та іншого становища власників та користувачів земельної власності на теренах України протягом означеного в дослідженні періоду. Продемонстровано тенденції й особливості, а також виявлено відмінності у проведенні земельної політики та практики правового впливу на аграрні відносини в українських землях.
The thesis is focused on the system analysis of the genesis of the content of “land relations”, its impact on the development of the modern state and creative processes in Ukraine. In the context of the analysis of the developments of law historians of past generations and modern scientific thought the author has researched the evolution of branch belonging of the norms that regulated land relations, and on this basis the author has determined the peculiarities of the legal regime of the land as an object of public and legal, private and legal (property) relations. In the context of modern ideas and achievements of the general concept of the legal situation the author has characterized the legal status of the subjects of authoritative powers that regulated land relations in Ukraine since the formation of the Ukrainian Cossack state till the collapse of the USSR and the revival of the independent Ukraine. Within historical and legal scope, the author has demonstrated the dynamics of the development of legal, social and other status of owners and users of land ownership in Ukraine during the period stated in the research. The author has demonstrated the tendencies and characteristics, as well as he found out differences in the conduction of land policies and practices of legal impact on agrarian relations in the Ukrainian lands.
Диссертационное исследование посвящено системному анализу понятия «земельные отношения», его влияния на развитие процессов государственного строительства в Украине. В контексте юридической мысли прошлого и современных историко- правовых достижений исследована эволюция отраслевой принадлежности юридических норм, регулирующих земельные отношения, на основании чего определены особенности правового режима земли как объекта публично- правовых и частноправовых (имущественных) отношений. При этом обращено внимание на то, что с момента ликвидации Гетманщины и до средины ХІХ столетия юридическое упорядочение оборота земли в преимущественной мере происходило в рамках публичного права. Со второй половины ХІХ столетия правовое регулирование земельных отношений на территории Украины постепенно протекает в рамках частного права, что подстегнуло существенное развитие сельского хозяйства и укрепления института частной собственности на землю. Дана историко-правовая оценка поражения Украинской революции 1917- 1921 годов в контексте подходов субъектов украинского государствообразования к решению «земельного вопроса». Подчеркнуто, что одной из существенных причин ликвидации украинской государственности стали существенные просчеты правительства Директории в правовом понимании сущности земельной собственности, места и роли национальной буржуазии, а также недооценка угрозы со стороны российской социалистической идеологии, пропагандирующей социализацию земли. Учитывая существующие представления о правовом положении субъектов права, охарактеризованы юридический статус субъектов властных полномочий, которые регламентировали земельные отношения на территории Украины со времен формирования Украинского казацкого государства до момента распада СССР и возрождения независимой Украины. Показано в историко-правовой ретроспективе динамику развития юридического и социального положения собственников и пользователей земли на территории Украины в течение рассматриваемого в исследовании исторического периода. Обращено внимание на то, что базовым концептуальным отличием современного украинского земельного права от правового обеспечения земельных отношений со времен античности до ХХ столетия является то, что современная практика приобретения права собственности на землю никоим образом не обусловлена социально-политическим положением человека. В свою очередь, ретроспективный анализ правового регулирования земельных отношений в прошлом, а также исторический опыт в сфере землепользования говорят о том, что социальное и политическое неравенство прямо влияло на юридическую возможность приобретения права собственности на землю. Отмечено, что развитие земельных отношений в Украине в рассматриваемый период в целом можно считать поступательным. Вместе с тем, периодическое внешнее вмешательство иностранной юрисдикции приводило к спорадической деградации правового менталитета украинского народа, появления чувства бесперспективности борьбы за свои права, непонимания европейских подходов к решению вопросов в сфере реализации права собственности на землю, как одного из основных и системообразующих показателей отечественного государственного строительства. Результатами этого, а также несовершенства законодательства, на данный момент созданы условия, когда насильственные подходы к решению противоречий, в частности в аграрной сфере, превалируют над цивилизованными, гуманистическими и правовыми. В большинстве демократических государств мира правовое регулирование земельных отношений осуществляется на основании диспозитивного метода правового регулирования, т.е. равенства государственной формы собственности на землю наравне с другими (в первую очередь, с частною), равных правовых возможностей и одинакового правового статуса субъектов правоотношений; тогда как в недемократических, тоталитарных государствах, независимо от конкретного исторического периода, наблюдается правовое неравенство в земельных отношениях между государством и иными субъектами права.

Ces dernières années, les questions foncières constituent au Vietnam le premier sujet de saisine des juridictions étatiques. Entre expropriations abusives, opacités des attributions foncières et ententes avec le secteur privé, de vives contestations se sont élevées autour des modalités de gestion de la terre.C'est dans ce contexte qu'une nouvelle loi foncière entre en vigueur en juillet 2014. Cette réforme vise à créer les conditions d'une conciliation entre deux objectifs qui peuvent apparaître a priori contradictoires : apaiser les tensions liées à la terre, tout en intensifiant l'exploitation de la ressource foncière afin d'atteindre l'objectif d'industrialisation du pays à l’horizon 2020, tel que défini par le Parti Communiste Vietnamien.Pour autant, le véritable enjeu de la nouvelle loi n’est pas d’ordre juridique, mais politique. Les tensions foncières sont aujourd’hui d’une telle ampleur que l’absence de réaction de la classe dirigeante correspondrait à un aveu d’échec dans sa mission de gérer le foncier au nom du peuple. Toutefois, l’intervention de l’Assemblée nationale ne s’est pas manifestée à travers une nouvelle règlementation plus rigoureuse de la gestion foncière. La réponse donnée par les pouvoirs publics est celui de l’autorégulation des acteurs du foncier
In recent years, land issues in Vietnam are the main subject of complaints received by state institutions. Between abusive expropriation, vagueness of land allocation and agreement with the private sector, wide spread protests have arisen around land management procedures.In this context, a new land reform came into force in July 2014. This law aims to reconcile multiple objectives that may appear a priori contradictory: to ease tensions related to land, while intensifying the exploitation of land resources to achieve the goal of becoming an industrialized nation by 2020, as declared by the Vietnamese Communist Party.However, the real issue of the new law is not legal, but political. Land tensions today are of such magnitude that the lack of response by the ruling class would correspond to an admission of failure in its mission to manage land resources. The National Assembly’s intervention did not take a form of a more stringent regulation of land management. The response given by the authorities is the self-regulation of land stakeholders

This thesis deals with appropriate legislation concerning common utilities, such as infra-structural facilities and natural resources, which can regulate construction, maintenance, use and financing. Appropriate legislation can be viewed in the two main perspectives, effi-ciency and equity, and the thesis concerns primarily on efficiency. The purpose is to develop an analytical model, which can be used to facilitate structured assessments concerning the management of common utilities. The problem field concerned is of great complexity, and the model is therefore to be viewed as a support for decision-making, not as an instrument capable of delivering ready-made solutions. To structure the problem area it’s divided into three parts, the social, physical and institu-tional environments. The social environment is concerned with factors, such as group size and amount of trust and social capital, which can influence the feasibility of co-operation. The analysis leads to a classification of three social groups: Close-knit, loosely-knit and anonymous. The physical environment is concerned with characteristics of utilities, which influences need for, and feasibility of, co-operation. Rivalry of use and excludability are identified as important factors in this aspect. By combining them six types of goods can be identified: Private goods, club goods, common pool resources, toll goods, public goods and local pub-lic goods. The institutional environment is concerned with rules, which can control the use of com-mon utilities. Two concepts are identified as pivotal: property rights regimes and decision-making procedures. There are four property rights regimes: Individual rights, group rights, public rights (limited and unlimited) and no rights. Furthermore there are three decision-making procedures: Market regulation, group decision-making and public decision-making. A fourth possibility is no decision making-forum. By linking together social groups and types of goods a matrix is obtained in which each square represents a unique combination of social and physical environment. In this analyti-cal framework it is analysed which combinations of property rights regimes and decision-making procedures that are best suited to each square. In the end, Swedish legislation on roads, water and sewerage installations and aesthetic design of buildings is analysed with aid of the analytical model.

The Planning and Building Act regulates how municipalities plan the use of land and water. When deciding on the detailed development plan, the respective municipality is responsible for the parking standard in the space that will be allocated for parking and which is made in connection with land construction. The decision is followed up in the building permit process. One of the requirements for building permits being granted is that the parking solution is approved. A public parking lot lease is a solution that is approved by law regarding parking in another area beyond one's own property. The municipality can be a party in the agreement for leasing public parking lots in the role of land access provider and may be responsible for preparing the parking lot. In order to be valid, the lease shall guarantee a measure of permanence over time. The rights that accompany the parking lot agreement need to be monitored by authority decisions that cause a change in land use. The municipalities' responsibility to meet the policy's stated objective to increase housing may result in already built-up areas becoming denser. Surfaces such as parking lots may be used for this purpose. Increased density in municipalities requires new detailed development planning. Thirty of the country's municipalities with the highest number of completed buildings, specifically multi-family housing, were examined for the time period 2005-2016. The basis for the analysis was experiencing increased density where the land area has been affected in relation to objects for public parking leases. Current legislation is interpreted to find support for the validity of leasing public parking lots in cases of changes in land use. This study's research question relates to how the municipality should handle their role in decisions on changed land use, as a party to the civil parking lease agreement and as a public authority. The results highlight the validity of agreements to lease public parking lots despite civil authorities' decisions that change the use of land within the area in question. It is suggested that the municipality, as a civil party to the agreement, must monitor legal right by entering into the agreement. As an authority, the municipality has the responsibility to monitor and follow up the underlying decisions of the regulating authority and building permission decisions, the assessment of which may depend on the approval of the suggested solution for parking. Thus, the new decision regarding land use should not be in conflict with the underlying decisions which also continue to be valid. It is recommended that municipal administrations and companies cooperate closely in the early stages of the detailed development planning process. This is necessary to ensure that the legal right resulting from agreements to lease public parking lots is taken into consideration. The working documents in the form of geographical information may include demarcated areas which include leased public parking lots.
Plan- och bygglagen styr hur kommunerna planerar användningen av mark och vatten. Vid beslut om detaljplan ligger respektive kommuns normtal för parkering till grund för det utrymme som ska avsättas för parkering i samband med byggande av marken. Beslutet följs upp i bygglovsprocessen. Godkänd lösning för parkering är ett myndighetskrav för erhållet bygglov. Parkeringsköp är en lösning som godkänns av lagen som parkeringslösning utanför den egna fastigheten. Kommunen kan vara part i parkeringsköpsavtalet med rollen som markupplåtare och ansvarig för att iordningsställa parkeringen. Upplåtelsen ska för sin giltighet garantera viss stabilitet i tid. Rättigheten som följer med parkeringsavtalet behöver bevakas vid myndighetsbeslut som ändrar markanvändningen. Kommunernas ansvar för att möta politikiska mål om ökat bostadsbyggande kan få till följd att redan bebyggda områden förtätas. Ytor som exempelvis parkering kan tas i anspråk för syftet. Förtätning ställer krav på ny detaljplan. Trettio av landets kommuner med högst antal färdigställda bostäder i flerfamiljshus inom tidsintervallet 2005 – 2016 analyseras utifrån erfarenhet av förtätning, där markområde påverkas som är objekt för parkeringsköp. Tolkning av gällande lagstiftning görs för att hitta stöd för parkeringsköpets giltighet vid ändrad markanvändning. Studiens frågeställning gäller hur kommunen bör hantera sin roll vid beslut om ändrad markanvändning dels som part i det civilrättsliga parkeringsköpsavtalet, dels som myndighet. Resultatet framhåller parkeringsköpsavtalets giltighet trots myndighetsbeslut som ändrar markanvändningen inom aktuellt område. Kommunen som civilrättslig part i avtalet ska bevaka rättigheten förslagsvis genom inskrivning av avtalet. Som myndighet har kommunen ansvar för att bevaka och följa upp bakomliggande myndighetsbeslut, bygglovsbeslutet, vars bedömning kan vila på godkänd lösning för parkering. Det nya beslutet om annan markanvändning ska således inte stå i strid med bakomliggande beslut som fortsatt har giltighet. Tätt samarbete mellan kommunens förvaltningar och bolag i tidiga skeden av detaljplaneprocessen bör vara ett mönster som följs. Detta för att rättigheten som följer på parkeringsköpsavtalet ska uppmärksammas. Arbetsunderlaget i form av geografisk information kan innehålla markering av områden som omfattas av parkeringsköp.

Under senare tid har allt fler företag börjat utöva verksamhet där mark nyttjas för olika aktiviteter med stöd av allemansrätten. HD har bedömt att sådant nyttjande; kanalisering, är tillåtet med stöd av allemansrätten, men uttalade i NJA 1996 s. 495 (”Forsränningsmålet”) samtidigt att nyttjandet bara är tillåtet så länge marken inte skadas. Eftersom skadeståndsfrågan aldrig har prövats i samband med allemansrätten har föremålet för denna uppsats varit att utreda möjligheterna att utfå ersättning för skador via allmänna skadeståndsrättsliga regler, skadestånds- och avhjälpandeansvaret i miljöbalken samt för intrång i äganderätten via expropriationslagen och möjligheten att få ersättning ur en försäkring. Expropriationsalternativet kan inte användas idag, eftersom marknyttjande med stöd av allemansrätten är ett icke ersättningsgillt intrång i äganderätten. Möjligheterna till att betrakta en skada på marken som en sakskada är stora. Det finns emellertid omständigheter som skapar komplikationer för båda skadeståndsansvarsformerna. En allmän skadeståndstalan kräver att culpa hos skadevållaren kan bevisas, vilket kan vara svårt när många människor vistas på en plats samtidigt. Kanalisatören kan betraktas som culpös enligt principerna om kumulativ eller anonym culpa, enligt vilka en principal blir ansvarig, trots att de individer han ansvarar för inte, var och en för sig, varit culpösa. Det miljörättsliga skadeståndsansvaret bygger på ersättning för störningar som inte är orts- eller allmänvanliga. När det gäller allemansrättsligt nyttjande torde många störningar betraktas som just orts- eller allmänvanliga. Avhjälpandeansvaret i miljöbalken bygger på ersättning för miljöfarlig verksamhet, och det är tveksamt om det kan tillämpas på kanalisatörens verksamhet. Expropriationsersättning på grund av allemansrättsligt nyttjande tillerkänns inte markägaren enligt gällande rätt, vilket kan tyckas märkligt eftersom många nyttjandeformer som påminner om allemansrätten, t.ex. servitut, medför sådan ersättningsrätt. Det finns vissa möjligheter att ersätta markskador ur försäkringar. Dock är de flesta skador följden av invasionsproblematik, som är mycket svårt försäkra. Samtliga ersättningsformer har visat sig otillräckliga för att ersätta skador som är estetiska och ideella, eftersom sådana skador inte kan beräknas i pengar. Beroende på hur marknyttjande med stöd av allemansrätten betraktas har man olika åsikt om i vad mån kanalisatören borde ersätta markägaren för skador på marken. Om nyttjandet uppfattas som någonting som finns vid sidan av markäganderätten är endast konkreta skador ersättningsgilla. Om man anser att nyttjandet är ett intrång i äganderätten och en förmögenhetsöverföring från markägaren till kanalisatören bör emellertid redan rätten att nyttja marken föranleda ersättning. Den ersättningsform som bäst tillgodoser markägarens intresse av att få skador på marken åtgärdade och få ersättning för ekonomisk förlust är avhjälpandeansvaret. Endast det ansvaret reparerar till fullo skador på miljön. Det krävs emellertid ett domstolsavgörande för att slutligen klargöra avhjälpandeansvarets tillämplighet.
Recently, more and more companies have come to exercise activities under the right of public access on land that belongs to whomever. The High Court has assessed that such use of land; channeling, is permitted, but in NJA 1996 s. 495 (“The Rafting Case”) also announced that this use is only allowed as long as the land remains unharmed. Since the question of damages in the context of the right of public access has not yet been treated in jurisprudence, the object of this thesis has been to investigate the possibilities to obtain restitution for damages via tort law, liability under the environment act as well as for proprietary intrusions under the expropriation act and restitution via insurance. Expropriation, however, cannot currently be made use of, since the right of public access is an intrusion which does not entail restitution. There are extensive possibilities for considering damage to the land as damage to property. However, there are ramifications for both the legal options for damages: the tort law and the environmental act. The tort law requires tortuous behaviour from the tortfeasor to be established, which is difficult when several persons stay at one place simultaneously. The canalizer may be considered tortuous under the principle of vicarious liability and cumulative or anonymous tort. According to these principles, the canalizer is responsible for the actions of certain individuals, even though they have not, individually, been negligent. The environmental liability for damage is based on restitution for disturbances that are not common to the place nor to the general public. This fact is difficult to establish in the context of the right of public access. The remedial responsibility of the environmental act is constructed for operations that are harmful to the environment, which is why it is dubious whether the responsibility is applicable to the canalizer’s activities. Currently, compensation for expropriation cannot result of use of land under the right of public access. This is peculiar, since many usufructs reminiscent of the right of public access, i.e. the easement, result in such compensation. Some forms of damage to the land can be insured. Although, most damage in this context arise from invasion, a cause of damage which is nearly impossible to insure. All forms of restitution have proven insufficient for compensating damage that is esthetic or otherwise non-pecuniary. Depending on if the right of public access is regarded as proprietary intrusion or something that exists alongside the right to property, one comes to different conclusions about the extent of compensation for damage. In the former case, only substantial damage is compensable. In the latter case, even the right to use the land occasions compensation. The liability which best meets the needs of the proprietor: compensation and restoration of damage to his property, is the remedial responsibility of the environmental code. This responsibility alone fully restores harm to the environment. However, the applicability of the remedial responsibility needs to be established in jurisprudence.

Esta dissertação propõe que os Municípios tributem áreas urbanas de preservação permanente com parâmetros diferentes em relação às áreas urbanas comuns, com objetivo de incentivar os proprietários de áreas de preservação permanente. Diante disso, este trabalho analisou as condições para compensações de reserva legal que podem trazer benefícios reais para a natureza (implicações ambientais), enquanto reduz o impacto dessas medidas sobre a propriedade privada e/ou produção agrícola/comercial/industrial (implicações econômicas). Para efetivação desta pesquisa realizou-se com base em revisão bibliográfica, dados oficiais dos Municípios, teses publicadas e decisões judiciais que tenham discutido algum ponto relevante da pesquisa. Como resultado constatou-se a importância das ferramentas legislativas para que a propriedade abarque sua função socioambiental, assim como o Município que delibera o IPTU para uma função extrafiscal com o intuito de proteger a natureza está buscando, na verdade, estimular ou desestimular determinadas condutas relativas ao meio ambiente.

This dissertation proposes that the Municipalities tax urban areas of permanent preservation with different parameters in relation to the common urban areas, in order to encourage owners of permanent preservation areas. This paper analyzes the conditions for legal reserve compensation that can bring real benefits to nature (environmental implications), while reducing the impact of these measures on private property and / or agricultural / commercial / industrial production (economic implications). In order to carry out this research, it was carried out based on a bibliographical review, official data of the Municipalities, published theses and judicial decisions that have discussed some relevant point of the research. As a result, it was noted the importance of legislative tools for ownership to encompass its socio-environmental function, as well as the Municipality that deliberates the IPTU for an extra-fiscal function in order to protect nature is actually seeking to stimulate or discourage certain relative behaviors to the environment.

Hong Kong is considered to be the most economically free country in the world, but also has the highest amount of income inequality of any developed country. The Hong Kong government is able to sustain laissez faire policies due to its monopoly on land supply. Maintaining high property values allows the government to maximize revenue from property tax, which acts as a hidden tax. A major contributor to income inequality is the formation of oligopolies in Hong Kong that creates an anticompetitive environment. The interests of the government and oligarchs are aligned as both obtain significant portions of revenue from the property sector. As globalization makes Hong Kong even more vulnerable to external shocks, the government faces the challenges of increasing competition, diversifying its revenue streams, and closing the income gap while standing by its principles in order maintain regional competitiveness as an international business hub.

This research aims to examine the effects of the urban land acquisition and allocation programme by the government in Iran on the rate of increase of the prices of urban land and affordablity of housing prices for different income groups in the urban areas of the country during the period 1979 to 1988 which was on the basis of the enactment of three Urban Land Laws after the 1979 revolution. The implementation of these laws limited private ownership of vacant urban land in the country to about 1,000 to 1,500 square metres, depending on the size of the city, with the excess land being acquired by the government. In this respect the Urban Land Organisation under the Ministry of Housing and Urban Development was able to acquire 36,000 hectares through confiscation from the excess of private ownership, 8,258 hectares of private land in return for payment of compensation, and a further 41,272 hectares of land which already belonged to the various public organisations was transferred to its authority. Thereby a total of 85,557 hectares was assembled under the authority of the urban land organisation (ULO). As part of the land policy, the ULO then proceeded to allocate some 10,790 hectares or 12.6 percent of the total assembled land to eligible applicants including private households, housing cooperatives and public and private housing developers for housing construction. This was in addition to the 3,313 hectares or 3.9 percent of the total assembled land which was allocated for the purposes urban services and commercial buildings. In any case, while only 12.6 percent of the assembled land was allocated by the ULO it comprised about 32 percent of the number and 34 percent of the area of land plots for new starts of housing construction during the period 1979 to 1988. The hypothesis of the thesis with regard to the effect of government acquisition and allocation of urban land on the situation of urban land prices and housing in Iran is that between 1979 to 1988 this programme and the resultant activities has on the one hand led to a reduction of the rate of increase of the price of urban land in the market and, on the other, has contributed to the provision of affordable housing units for low and middle income households. The thesis has tested the first part of its hypothesis by collecting and analyzing the trend of development of urban land prices for a 15 year period between 1974 to 1988. The second part of the hypothesis has been tested by calculating the price of housing on ULO allocated and privately owned land and then comparing them with the effective demand of different income groups in the urban areas of the country. The evidence of the analysis for the first part of the hypothesis shows that during the period 1979 to 1988 the average price of one square metre of privately owned land was about 13 times higher than ULO allocated land. More importantly, however, is the trend of development of the price of privately owned land between 1974 to 1988 which shows that after the 1979 revolution average prices of privately owned land always kept below the 1976 figure prior to the revolution and from 1985 on wards the actual increase at constant prices was actually negative. Moreover, with the base year of 1974, the index of the average price of privately owned land for the period 1979 to 1988 was between 58.7 and 207.5 which was much lower than the consumer price index which was between 196.3 and 974.1 for the same period. The index of the average price of urban land for 1975 and 1976 prior to the 1979 revolution, however, is 125.3 and 170.5 which is higher than the consumer price index for the same period which was 109.9 and 128.1. consequently, it can be stated that the evidence from the analysis for the first part of the hypothesis supports its proposition in that the enactment and implementation of the aforementioned urban land policy after the 1979 revolution has led to a reduction of the rate of increase of urban land prices in the market between the period 1979 to 1988. The result of the analysis for the second part of the hypothesis on the other hand shows that on the basis of the recommended floor area of 75 square metre for housing units built on ULO allocated land, which was recommended by the Ministry of Housing and Urban Development, such units were in the main affordable to all income categories including all those in the low income groups. The units built on privately owned land were in the main only affordable to income groups 8-10 which comprised the high income groups and in 1987 and 1988 even income groups 8-9 of the high income groups were excluded from these units. More importantly, however, the analysis shows that even with bigger floor areas including the actual average floor area of urban housing units for the period 1979 to 1988, which ranged between 132 to 162 square metres during the stated period, the units built on ULO allocated land were still much more affordable to the low and middle income groups than the units built on privately owned land which would still be in the main unaf fordable to the low income groups. This difference in affordablity also applies to small units 50-75 square metres built on the two different categories of land. The result of the analysis for the second part of the hypothesis, therefore, also supports its proposition in that the enactment and implementation of the aforementioned urban land policy after the 1979 revolution has contributed to the provision of affordable housing units for low and middle income households in the period 1979 to 1988.

The article 19 of Law n. 8.629/93 dispose about the National Agricultural Land Reform Program beneficiaries’ list, without, however, establishing how the lists should be prepared. Currently, the Federal Special Prosecutor at the National Institute of Colonization and Agraricultural Land Reform (PFE/INCRA) believes that it is a legislation’s gap, leaving up to her discretion the list’s draw. The purpose of this paper is to demonstrate how the argument does not hold, based on Ronald Dworkin’s Law theory. As a social institution of political nature, Law’s correct interpretation should be that which best describes the social practices within an idea of integrity, and, in Brazil, the agrarian reform policy exists to mitigate the conservative modernization’s pernicious consequences. In the first chapter will be exposed Brazil’s agricultural land reform’s historical demand, as well as the transformations that the Brazilian’s agricultural process suffered during the twentieth century, since Law cannot be understood outside its historical context. In the second chapter the Union's position will be legally considered according to Dworkin's theory of law. It is proposed a qualitative approach on the subject’s avaliable literature.
O art. 19 da Lei nº 8.629/93 dispõe sobre o rol de beneficiários do Programa Nacional de Reforma Agrária sem, entretanto, dispor sobre a forma de elaboração destas listas. Atualmente, a Procuradoria Federal Especializada junto ao Instituto Nacional de Colonização e Reforma Agrária (PFE/INCRA) entende que se trata de uma “lacuna jurídica”, cabendo a ela elaborar as listas discricionariamente. A proposta deste trabalho é demonstrar como o argumento não se sustenta, tomando como base a teoria do direito elaborada por Ronald Dworkin. Sendo o Direito uma instituição social de natureza política, sua interpretação correta deverá ser aquela que melhor descrever as práticas sociais dentro de uma ideia de integridade, e, no Brasil, a política de reforma agrária existe para mitigar as consequências perniciosas da modernização conservadora. No primeiro capítulo será exposto o histórico da demanda por reforma agrária no Brasil, assim como as transformações que o processo de produção agrícola brasileiro sofreu durante o século XX, já que o direito não pode ser entendido fora de seu contexto histórico. No segundo capítulo será analisada juridicamente a posição da União de acordo com a teoria do direito de Dworkin. Para tanto, propõe-se uma abordagem qualitativa da bibliografia disponível a respeito do tema.

Este trabalho reflete sobre as políticas públicas no âmbito da regularização do parcelamento de interesse social nos municípios do interior do Estado de São Paulo, através da análise de cinco municípios do Vale do Paraíba inscritos no Programa Estadual de Regularização de Núcleos Habitacionais de Interesse Social - Pró-Lar Regularização e no Programa Estadual de Regularização de Núcleos Habitacionais - Cidade Legal. São esses: Ferraz de Vasconcelos, Mogi das Cruzes, Taubaté, Lavrinhas e Areias. Através da análise das irregularidades pesquisadas nos assentamentos de baixa renda desses municípios, avaliamos as metodologias cabíveis para diversas alçadas de competências públicas na questão. Discutimos sobre o papel dos municípios no encaminhamento dos processos, na condução dos programas de regularização e da instituição de planos de regularização locais. Discutimos também sobre o papel do Estado de São Paulo como ente consultivo e disciplinador na condução de um programa de regularização para todos os municípios do Estado de São Paulo. Para essa análise, retomamos a história territorial brasileira e a evolução da legislação do parcelamento do solo urbano até os dias de hoje; categorizamos os principais fatos geradores das irregularidades incidentes nas cidades do interior, classificamos as irregularidades, discutimos as principais metodologias empregadas e narramos o histórico dos principais programas de regularização implantados na cidade de São Paulo, tecendo comentários sobre programas recentes executados nas demais cidades do Estado. Através do estudo dos assentamentos irregulares dos 5 municípios escolhidos no eixo do Vale do Paraíba, reconhecemos as relações biunívocas entre as classes de irregularidades e as categorias dos fatos geradores com a funcionalidade e capacidade administrativa das Prefeituras Municipais, no sentido de realizar um diagnóstico sobre a condição de formação e solução nos procedimentos para regularização.
This work reflects on public policies in the regularization of split application of social interest in the municipalities of the interior of the State of Sao Paulo, through the analysis of five municipais do Vale do Paraiba entered in the Programa Estadual de Regularização de Núcleos de Interesse Social - Pro-Lar Regularization and in the Program Estadual Regularization of Nuclei - Housing Cidade Legal. These are: Ferraz de Vasconcelos, Mogi das Cruzes, Taubaté, Lavrinhas and Areias. Through the analysis of irregularities detected in low income settlements in these municipalities, we evaluated the methodologies for various levels of public tasks. We discussed the role of municipalities in the delivery of processes, in the conduct of the programs to regularize and the establishment of plans to regularize settlements. We discussed the role of the State of Sao Paulo as a consultative body and disciplinarian in conducting a program of regularization for all the municipalities of the State of Sao Paulo. For this analysis, we resume the territorial Brazilian history and the evolution of the legislation of the soil fragmentation urban until today; the main facts we categorize generators of irregularities incidents in the cities of the interior, we classify irregularities; We discussed the main methodologies and described the history of the main programs of regularization implanted in the city of Sao Paulo, making comments on recent programs implemented in other cities of the State. Through the study of irregular settlements of 5 municipalities chosen in the axis of Vale do Paraiba and other cities of the State, we recognize the biunivocus relations between the classes of irregularities and the categories of the facts generators with the functionality and administrative capacity of Municipal governments, to make a diagnosis of the condition of training and solution in the procedures for settlement.

Purpose: In Sweden, a municipal plan monopoly is used to regulate what, how and where you can or cannot build. How the plans, in the shape of comprehensive and detailed development plans, are formed is in turn regulated by the Planning and Building Act (PBL). Throughout history, Swedish building regulations have gone through many more or less extensive changes with the overall goal to improve our built environment and simplify or streamline the planning and building processes. From this comes the term small deviation, which in PBL is used to allow building permits that deviate from the detailed development plan, provided that the deviation is small. There is, however, no explanation in the law as to what this might mean in practice, and so there are large differences in terms of interpretation and application. The goal of this study is to analyse how the term small deviation according to PBL, chapter 9 § 31b is interpreted and applicated in building permit trials. Method: The methods used in this study are interviews (with building permit officers) and document analysis (of building permit decisions from quarter two, 2016, and court cases from the Land and Environment Court of Appeal). Findings: How deviations are interpreted does indeed vastly differ, and while the municipalities do work in a similar manner to determine whether a deviation could be considered small, there are significant differences. Only in the matter of built area on a property, the three studied municipalities all have different practices in what size of violation may be considered small, and the building permit officers in one of these municipalities still deviate from this. In eight out of 13 court cases, the Land and Environment Court of Appeal judged differently from the previous authorities. Only in one did all authorities agree. Implications: The findings implicate the following: There are remarkable differences in how small deviation is assessed. De biggest differences are between the local building permit officers and the Land and Environment Court of Appeal. The factors that affect the assessment on a municipal level the most are experience, precedent cases and discussion with colleagues. Limitations: A wider study containing more information from several municipalities and an analysis of the material accessible to the municipalities for guidance to assess deviations would provide a clearer answer as to what affects the interpretation. Syfte: I Sverige används ett kommunalt planmonopol som regleras av Plan- och bygglagen (PBL) 2010:900. Planerna i form av översikts- och detaljplaner reglerar vad, hur och var man får eller inte får bygga. Genom åren har PBL många gånger genomgått mer eller mindre omfattande förändringar med det övergripande syftet att förbättra svensk byggd miljö och förenkla eller effektivisera plan- och byggprocessen, därför har begreppet liten avvikelse tillkommit i PBL. I författningen framgår att det trots avvikelser från planbestämmelser är möjligt att bevilja bygglov, förutsatt att avvikelsen är liten. Det saknas dock förklaringar i PBL kring vad detta kan innebära, och stora skillnader i bedömningen kring vad som kan anses vara en liten avvikelse finns. Målet med arbetet är att analysera hur begreppet liten avvikelse enligt PBL, kap 9 § 31b tolkas och appliceras vid bygglovshandläggning. Metod: De metoder som använts i undersökningen är intervjuer (med bygglovshandläggare) och dokumentanalys (av bygglovsbeslut kvartal två, 2016, och rättsfall i Mark- och miljööverdomstolen från 2016). Resultat: Resultatet visar att det finns stora skillnader i hur liten avvikelse tolkas och appliceras, både mellan olika instanser och på kommunal nivå. Medan kommunerna använder dylika metoder för att avgöra om en avvikelse kan anses vara liten, finns det även avsevärda skillnader i bedömningen. Bara när det gäller byggrätt har kommunerna i undersökningen riktvärden det är stor skillnad på. I åtta av 13 fall bedömde Mark- och miljööverdomstolen olika från samtliga tidigare instanser, och bara i ett fall var samtliga överens om graden av avvikelse. Konsekvenser: De slutsatser som kan dras från resultatet är att: Det finns anmärkningsvärda skillnader i hur liten avvikelse bedöms. De största skillnaderna är mellan den lokala nämnden och Mark- och miljööverdomstolen. Det som främst påverkar bedömningen på kommunal nivå är erfarenhet, prejudicerande rättsfall och diskussion med kollegor. Begränsningar: En bredare undersökning med fler kommuner och bygglovsbeslut från en längre tidsperiod i kombination med en analys av det material som finns för att hjälpa bygglovshandläggare bedöma avvikelser hade kunnat ge ett tydligare svar på vad som påverkar tolkningen. Det hade också gett ett tydligare svar på hur skillnaderna huvudsakligen ser ut, vilket i sin tur gjort det möjligt att ta fram förslag till lösningar. Tendo sido apontada como responsável por 49% dos acessos à internet no país, em 2007, as lan houses assumiram importante papel no debate sobre inclusão digital no Brasil. Equipadas com computadores conectados à internet e cobrando por suas horas de uso, esses estabelecimentos espalharam-se rapidamente, sobretudo, nos espaços populares. Partindo do acompanhamento de duas lan houses situadas em favelas cariocas: Acari e Santa Marta, analisamos seus impactos sociais nos territórios em que estão inseridas. Elegendo três pontos analisadores: o Estado, os donos de lan house e seus frequentadores, refletimos acerca dos usos e mediações que observamos em nosso trabalho de campo. Nesse contexto, escolhemos a lan house como dispositivo para reflexão das Políticas Públicas no campo da segurança e da educação. Compartilhando dos referenciais da pesquisa-intervenção, recorremos à realização de oficinas que serviram como grupos focais, entrevistas semiestruturadas e observação participante. Com isso, buscamos tecer encontros entre uma pesquisa etnográfica e as concepções da cartografia na produção de uma análise histórica do tempo presente. Priorizando a dimensão qualitativa, o trabalho orienta-se pela valorização da experiência e do cotidiano, para compreender a cultura popular a partir de suas significações no seio dos embates da indústria cultural.
Having been singled out as responsible for 49% of the internet access in the country in 2007, lan houses have taken on an important role in the debate about digital inclusion in Brazil. Equipped with computers connected to the internet and charging for their hours of use, these establishments have spread rapidly, especially in popular spaces. Based on the monitoring of two lan houses located in favelas in Rio: Acari and Santa Marta, we analyzed their social impacts in the territoriesin which they operate. Three analyzing points were chosen: The State, the owners of lan houses and its regulars, we reflected about the uses and mediations which we had observed in our field work. In this context, we elected the lan house as a device for reflection of public policies in the field of security and education. Sharing of research-intervention reference, we used workshops which served as focus groups, semi-structured interviews and participants observation. This way, we tried to make meetings between an ethnographic research and concepts of cartography in the production of a historical analysis of the present time. Prioritizing the qualitative dimension, the work is guided by the appreciation of everyday experience to understand popular culture from their meanings within the cultural industry ties.

Studying the Law about urban land division - Law nº 6.766/79 - is essential to understand some aspects of the urban issues in modern society. As a matter of fact, it is clear that there is not enough research about the theme, which results in direct damage to the entire society once the urban rules are not respected. The fact that this law is more than thirty years old does not exclude the interest in deepening its analysis because, since then, a new Federal Constitution was promulgated and several other laws related to the theme became effective. In this context, a few important questions shall be posed: have the urban crimes determined by Law nº 6.766/79 been corroborated by the new constitutional order? Is there any interest in criminalizing actions referring to the illegal parceling of the urban land? What is the best way of criminalizing them? Which criminal legal interests do these crimes protect? This study aims to discuss such an important matter and therefore stimulating deeper research by legal experts about the theme. Hopefully, as a consequence of increased debate on illegal parceling of the land, a healthier and more sustainable urban development in a long term perspective will be fostered
O estudo da Lei do Parcelamento do Solo Urbano - Lei nº 6.766/79 - é essencial para aprofundar as questões que envolvem os problemas urbanísticos existentes na nossa sociedade. Percebe-se que há uma lacuna na doutrina na análise desse tema, o que gera prejuízo a toda coletividade diretamente afetada pelo desrespeito às diretrizes urbanísticas. O fato de essa legislação contar com mais de trinta anos não exauriu o interesse no seu exame, pois, após a sua entrada em vigor, foi promulgada uma nova Constituição Federal e passaram a viger diversas leis relacionadas à matéria. Nesse contexto colocam-se as seguintes questões: os crimes urbanísticos foram recepcionados pela nova ordem constitucional? Há interesse em incriminar as condutas de parcelamento ilegal do solo urbano? Qual é a melhor forma de criminalizá-las? Qual o bem jurídico protegido por tais delitos? Esse trabalho pretende discutir essas questões, a fim de contribuir para que o tema seja aprofundado na nossa doutrina. Isso porque, quiçá, com o debate sobre a melhor forma de tratamento das condutas de parcelamento ilegal se possa facilitar um desenvolvimento mais sadio e adequado das cidades, resguardando-se o ordenamento do território e o meio ambiente

The ‡Khomani San people received lands in 1999 under the ‘restitution’ arm of South Africa’s land reform programme. Restitution laws, contained in the Restitution of Land Rights Act and the Communal Property Associations (‘CPA’) Act, seek not only to return lands to peoples dispossessed after 1913, but also to inculcate the ideals of South Africa’s dominant agro-pastoral-based society into defined, cohesive land-recipient ‘communities’. These ideals include centralised, hierarchical, representative, democratic leadership and decision-making structures that the West takes for granted. However, these concepts of control are not typically found among foraging or post-foraging peoples, who tend to base their societies on decentralised, small-group, egalitarian social structures that strongly oppose hierarchies, representation, or accumulation. Such social organisation remains intact even after these groups become settled or adopt non-hunting-and-gathering livelihoods, and today’s ‡Khomani self-identify as San, ‘Bushmen’, hunters, and indigenous people, despite their settlement and their adoption of varied livelihood strategies, including stock-farming. Among such groups, externally imposed governance structures tend to be viewed as illegitimate, and instead of the cohesion and order these centrally legislated structures seek to create, they instead engender dissent, conflict, and non-compliance. The ‡Khomani, as both a formerly scattered group of apartheid-era labourers and a cultural group of San people, have struggled with little success to plan and implement ‘development’, infrastructure, and livelihood projects on their lands and have ‘failed’ to operate the Restitution and CPA Acts’ required ‘community’ land-ownership and decision-making structures successfully. Thus, restitution has failed to bring the socio-economic improvements that the new ‡Khomani lands seemed to promise. Since 2008, however, the government has temporarily taken governance and approval authority from the ‡Khomani, which has led to the creation of smaller, behind-the-scenes governing bodies, as the ‡Khomani have begun taking the reins of power in their own ways. Such bodies, including the ‡Khomani Farmers’ Association and the Bushman Raad, have begun achieving some successes on the ‡Khomani farms in part, it is argued, because they allow the ‡Khomani to reproduce the focused, non-hierarchical, small-group structures that are more suitable to them as a non-cohesive group and more culturally appropriate to them as San people. The South African government, with appropriate protections for abuse of power, should provide the space within land reform laws to allow land-recipient groups to make decisions, govern themselves, and manage their lands according to their own community realities and their own conceptions of leadership and social organisation.

What social practices are people involved when staying in a game café? What kind of social setting is the game café? What are the attitudes towards playing computer games at home and in public among parents? What are the media representations of co-located game playing in public? What are the sensory experiences of playing co-located game play in public? This dissertation gives a descriptive and analytical account of the contexts and meanings of playing co-located computer games in public settings such as game cafés and LAN parties. The overall aim with the dissertation is to describe and investigate the social and cultural meanings and contexts of playing computer games in a game café. The research questions have been investigated in four empirical studies. The dissertation shows that people are involved in various social practices and activities aimed at supporting and maintaining social relationships among friends and peers. The game café can be seen as a third place, as it used by players for recreation and an escape from the pressure of home and school, a place which feels like home, is familiar and welcoming. However the game café is a limited third place used by young men who likes to play online and network games. The dissertation also shows how the social environment provides for specific sensory experiences. These sensory experiences involve sitting together side by side slapping each other’s shoulders and legs, eating candies and drinking sodas, listening to music. The representations of co-located game playing in public reproduce traditional gender roles where professional gamers are represented by men and causal gamers are represented by women (and men) as well as construct youth as party lovers. The study also suggests that parents’ attitudes towards their children playing games in public draw on traditional values and ideas about children’s play and social relationships.

本論文では、日米両国の環境法における理論状況が法体系の性質からも大いに異なることを前提とした上で、米国において1970年代以降に制定された様々な環境法をめぐる議論を取り上げ、各種救済の態様について、事後救済、事前予防の両面から検証を行った。具体的には、我が国で検討の不十分な環境市民訴訟規定適用の根拠および要件と救済の機能、各種環境規制の導入において生じる収用をめぐる議論の検討を行った。
This research examined the remedies of U.S. environmental law after 1970s. While their legal systems are quite different, the argument in U.S. could be helpful that of Japanese. The focus point of research is on the ground of citizen suits provisions and on the case when the plaintiff made consent decree. Environmental land use regulations and taking clause matter were also examined in this context since the private property rights is a crucial factor for environmental regulations to protect environmental injury.

This dissertation analyzes the old quarantiner prescription on state lands, if indeed that legal institution was valid in Brazil, how and when it ceased to be accepted by the legal system, because even today it is eventually sought the recognition of such prescription, consummated before the outset of the legality of the Civil Code of 1916, and how all that affects the agrarian issue. This dissertation aims to scrutinize the original legal foundations of that old original prescription of forty years, on state assets, especially on vacant lands, without losing sight of some of its possible consequences for the agrarian issue. The hypothetical-deductive method is used for research and understanding of legal rules, alongside the historical investigation of events, processes, institutions and judgeship of the past, followed by the dialectical method to overcome points of divergence found in the bibliography search. Thus it is demonstrated how, in the late nineteenth and early twentieth century, a legal discourse on prescriptibility of certain state assets was built, including the vacant lands. It can also explains how the legal discourse was dismantled to build the current one, which preconizes the imprescriptibility of all public property, including of the vacant lands. The results make evident how exactly the understanding set out in Summula 340 of STF was built, and its limitations, which says little about the prescription of state assets before the Civil Code of 1916. Another result is the demonstration of the impossibility of state property being usucapted in Brazil before the Land Law of 1850, which made clear that only after that the conditions for both were signed, albeit with additional difficulties for vacant lands.
Esta dissertação analisa a antiga usucapião quarentenária sobre terras do Estado, se realmente houve tal possibilidade jurídica no Brasil, como e quando deixou de ser aceita pelo sistema jurídico, porque eventualmente, ainda hoje, se busca o reconhecimento desse tipo de usucapião, consumada antes do início da vigência do Código Civil de 1916, e como tudo isso repercute para a questão agrária brasileira. A dissertação tem por objetivo perquirir os fundamentos jurídicos originais dessa antiga usucapião, de quarenta anos, sobre bens do Estado, especialmente sobre terras devolutas, sem perder de vista algumas de suas possíveis implicações para a questão agrária. O método hipotético-dedutivo é utilizado para pesquisa e compreensão das normas jurídicas, ao lado da investigação histórica de acontecimentos, processos, instituições e julgados do passado, acompanhada do método dialético, para a superação dos pontos de divergência encontrados no material bibliográfico pesquisado. Consegue-se, assim, demonstrar como, no final do século XIX e início do século XX, se construiu um discurso jurídico sobre a prescritibilidade de certos bens do Estado, inclusive as terras devolutas. Consegue-se explicar também como esse discurso jurídico foi desmontado para se construir o atual, que preconiza a imprescritibilidade de todos os bens públicos, inclusive das terras devolutas. Os resultados evidenciam como exatamente se erigiu o entendimento exposto na Súmula 340 do STF e as limitações desta, que pouco diz sobre a usucapião de bens do Estado antes do Código Civil de 1916. Outro resultado é a demonstração da impossibilidade de se usucapir imóveis do Estado, no Brasil, antes da Lei de Terras de 1850, esclarecendo-se que somente depois dela se firmaram os pressupostos necessários para tanto, ainda que com dificuldades adicionais para as terras devolutas.

Com a introdução das tecnologias da informação e comunicação (TICs) em governos, em especial a internet, tornou-se possível ampliar não só a capacidade e níveis de qualidade dos serviços prestados, mas também o enfoque na transparência, provocando diversas mudanças no âmbito do controle social e participação cidadã. Esta nova perspectiva de uso das TICs em governos para fins de ampliação de canais de participação é conhecida como governança eletrônica (e-governança). O objetivo desta dissertação é identificar quais os impactos da participação cidadã nas consultas públicas para a produção de leis e os limites e os desafios das consultas públicas online do Poder Legislativo federal. Os instrumentos de coleta de dados foram a visita estruturada ao website da consulta pública online, o e-Democracia, e entrevistas semiestruturadas dos gestores responsáveis pela consulta pública, bem como deputados envolvidos na elaboração da Lei das Lan Houses e seus apensados. Também foram entrevistados participantes da consulta pública e a associação de lan houses do Brasil. Em segundo lugar, foi realizada uma análise documental das contribuições para verificar quais as principais mudanças do pré-projeto em relação ao projeto final afim de mensurar o impacto da participação cidadã através da contagem das 10 palavras mais utilizadas em cada área documental; Proposições Legislativas dos Deputados, Contribuições Cidadãs pelo e-Democracia e Projeto Final enviado ao Senado Federal. Foi constatado neste estudo que as consultas públicas online podem ser consideradas um ambiente em que a e-participation se realiza, contudo, ainda existem limites e desafios para que esta participação ocorra devido a problemas gerenciais destas ferramentas de participação cidadã online e de outros problemas externos os quais literatura específica aborda e são retratadas na revisão de literatura e ressaltados nas considerações finais deste trabalho. As conclusões indicam que há evidências de que a participação cidadã tem impactos na produção colaborativa de legislações no governo federal, contudo, elas estão condicionadas a uma série de processos e condutas das áreas política, cultural, de recursos e de tecnologia.
With the introduction of information and communication technologies (ICTs) in government, in particular the Internet, it became possible not only to expand the capacity and quality levels of services, but also focus on transparency, leading to several changes within the social control and citizen participation. This new perspective on ICT use in governments for the purpose of expanding participation channels is known as electronic governance (e-governance). The objective of this dissertation is to identify the impacts of citizen participation in public online consultations for the production of laws and limits and challenges of public online consultations of federal legislative power. The instruments of data collection were the structured visit website of the online public consultation, the e-Democracy, and semi-structured interviews of managers responsible for public consultation, as well as representatives involved in drafting the Law on Lan Houses and joined her. Also interviewed were participants of the public consultation and the association of Internet cafes in Brazil. Secondly, there will be a documentary analysis of contributions to see what the main changes from the pre-project in relation to the final design in order to measure the impact of citizen participation by counting the 10 most frequently used words in each document area; Legislative Proposals Members, Citizens Contributions on e-Democracy and Final Project sent to Federal Senate. It is believed that public consultations are an online environment that can be performed e-participation, however, there are still limits and challenges to which this participation occurs due to management problems of these tools for citizen participation online and other external problems which addresses the specific literature and are portrayed in the literature review. The findings indicate that there is evidence that citizen participation has impacts on collaborative production of laws in the federal government, however, it is believed that they are conditioned to a number of dimensions as politics, culture, resources and technology.

O presente trabalho propõe-se a analisar a efetividade das políticas públicas de criação de unidades de conservação sob a ótica dos mecanismos de regularização fundiária de que dispõe a Lei n 9.985/00, primordiais para o alcance dos objetivos preconizados pelo Sistema Nacional de Unidades de Conservação (SNUC), sobretudo no que diz respeito às unidades de conservação de proteção integral. Para tanto, inicia-se por situar a discussão, abordando como o meio ambiente, os espaços territoriais especialmente protegidos, a propriedade e a moradia são temas que se entrelaçam no ordenamento jurídico brasileiro. Em seguida, foca-se na análise da função socioambiental da propriedade enquanto fundamento das políticas públicas de criação de espaços territoriais especialmente protegidos. Continua com a abordagem de tais espaços segundo a legislação em vigor, em particular das unidades de conservação. Concluída tal exposição, o presente trabalho adentra seu cerne, dissecando aspectos relevantes dos mecanismos dispostos pela Lei n 9.985/00 para a regularização fundiária de unidades de conservação. Assim, com base no estudo do tema, almeja confirmar a hipótese de que tais mecanismos são imprescindíveis à efetividade das políticas públicas de criação de unidades de conservação, sugerindo, tanto quanto possível, alternativas à aplicação da norma para fins de contribuir com a efetividade do SNUC.
This paper intends to analyze the effectiveness of public policies involving the creation of conservation units in view of the land regularization mechanisms provided by Law no. 9,985/00, which are essential for fulfilling the objectives established by the National System of Conservation Units (SNUC), particularly in relation to full protection conservation units. For this endeavor, this paper begins by delineating the discussion, addressing how environment, specially protected areas, property and dwelling are intertwined themes in the Brazilian law framework. Then, it focuses on analyzing the socio-environmental function of property as the foundation of public policies involving the creation of specially protected areas, also addressing current laws and regulations governing these areas, specially the conservation units framework. One this explanation is concluded, this paper advances to its core, scrutinizing relevant aspects in connection with land regularization mechanisms provided for by Law no. 9985/00. Therefore, based on these aspects, this paper seeks to confirm that these mechanisms are indispensable to the effectiveness of public policies involving the creation of conservation units, suggesting, as far as possible, alternatives to the application of regulations for purposes of contributing to the SNUC effectiveness.

Este trabalho busca verificar, por meio da análise do processo de criação e implementação do Cadastro Ambiental Rural a partir da perspectiva da democracia deliberativa de Habermas, a possibilidade de tal instrumento se transformar em objeto de políticas públicas que proporcionem uma proteção ambiental efetiva. Tenciona também investigar as finalidades do CAR enquanto instrumento da Administração Pública em suas funções reativa e proativa, utilizando como abordagem a contextualização do referido instrumento, incluindo questões relativas ao Código Florestal de 2012, lei na qual está inserido, para posteriormente descrever seus diferentes aspectos. Estes compreendem o CAR como materialização do direito à informação ambiental, sua função de combate ao desmatamento e pressuposto do Programa de Regularização Ambiental, além de seu papel no zoneamento ambiental. Também é feita uma análise do processo de implementação do Cadastro Ambiental Rural em Caxias do Sul à luz da teoria de Habermas, da qual são explicitados elementos referentes ao procedimento, princípios e formas de aplicação. A metodologia adotada é a hipotético-dedutiva, utilizando as técnicas de pesquisa bibliográfica e documental. Como resultados da pesquisa, destacam-se a constatação acerca da multiplicidade de potencialidades do CAR, que pode servir de base para diferentes ações e políticas de proteção ambiental, assim como a real possibilidade e urgente necessidade de ampliar, aprimorar e consolidar mecanismos deliberativos na tomada de decisões públicas, bem como na implementação de políticas públicas de cunho ambiental no Brasil.
This work seeks to check, through the analysis of the process of creation and implementation of the Rural Environmental Registry from Habermas deliberative democracy perspective, the possibility of this tool to become an object of public policy, providing an effective environmental protection. It also aims to investigate the goals of the Rural Environmental Registry as a tool of Public Administration in its reactive and proactive functions, using as approach its context, including issues about the Forest Code of 2012, law in which the Rural Environmental Registry is envisaged, to later describe its main aspects. These include the Rural Environmental Registry as embodiment of the right to environmental information, its function in the fight against deforestation and as requisite for joining the Program for Environmental Regularization, besides its roll in the environmental zoning. It is also done an analysis of the process of implementation of the Rural Environmental Registry in Caxias do Sul under the perspective of Habermas theory. In this context, the work explains elements about the procedure, principles and forms of execution of this theory. It is adopted the hypothectical-deductive methodology, using bibliographic and documentary techniques. As results of this research, it is possible to highlight the conclusion about the multiplicity of potentialities of the Rural Environmental Registry that may become a basis for several actions and environmental protection policies, such as the real possibility and urgent necessity of expanding, improving and consolidating deliberative mechanisms in the taking of public decisions, as well as in the implementation of environmetal public policy in Brazil.

In recognition of the importance of public participation as a basis for good governance and democracy, Mr Kofi Annan, Secretary General to the United Nations, has noted that: "Good governance demands the consent and participation of the governed and the full participation and lasting involvement of all citizens in the future of their nation. The will of the people must be the basis of governmental authority. That is the foundation of democracy. That is the foundation of good governance Good governance will give every citizen, young or old, man or woman, a real and lasting stake in the future of his or her society". The above quotation encapsulates the essence of what this thesis has set out to do; to examine the concept of public participation and its application in environmental governance within the context of the participation of indigenous peoples in the conservation and management of protected areas in Australia and Uganda. The concept of public participation is of such intrinsic importance that it has emerged as one of the fundamental principles underpinning environmental governance and therefore forms the basis for this study. -- Environmental governance, as a concept that captures the ideal of public participation, is basically about decisions and the manner in which they are made. It is about who has 'a seat at the table' during deliberations and how the interests of affected communities and ecosystems are represented. It is also about how decision makers are held responsible for the integrity of the process and for the results of their decisions. It relates to business people, property owners, farmers and consumers. Environmental governance is also about the management of actions relating to the environment and sustainable development. It includes individual choices and actions like participating in public hearings or joining local watchdog groups or, as consumers, choosing to purchase environmentally friendly products. -- The basic principles behind good governance and good environmental decision making have been accepted for more than a decade. The 178 nations that attended the Rio Summit in 1992 all endorsed these nvironmental governance principles when they signed the Rio Declaration on Environment and Development (Rio Declaration) - a charter of 27 principles meant to guide the world community towards sustainable development. The international community re-emphasised the importance of these principles at the World Summit on Sustainable Development in 2002. -- The right to public participation in nvironmental decision making and natural resources management is one of the 27 principles endorsed by the nations of the world and is embodied in the provisions of Principle 10 of the Rio Declaration.
Environmental decisions occur in many contexts. They range from personal choices like whether to walk or drive to work, how much firewood to burn, or whether to have another child. They encompass the business decisions that communities or corporations make about where to locate their facilities, how much to emphasise eco-friendly product design and how much land to preserve. They include national laws enacted to conserve the environment, to regulate pollution, manage public land or regulate trade. They take into account international commitments made to regulate trade in endangered species or limit acid rain or C02 emissions. -- Environmental decisions also involve a wide range of actors: individuals; local, state and national governments; community and tribal authorities such as indigenous peoples; civic organisations; interested groups; labour unions; national and transactional corporations; scientists; and international bodies such as the United Nations, the European Union, and the World Trade Organisation. -- Each of the actors have different interests, different levels of authority and different information, making their actions complex and frequently putting their decisions at odds with each other and with ecological processes that sustain the natural systems we depend on. -- Accordingly, this thesis aims to examine participation in environmental decision making in a way that demonstrates these complexities and interdependencies. It will explore the theoretical and conceptual basis for public participation and how it is incorporated into international and domestic environmental and natural resources law and policy. -- It will examine public participation in the context of the legal and policy framework for the conservation and management of protected areas and will use case studies involving the participation of indigeneous peoples in Australia and Uganda to provide the basis for a comparative analysis. -- The thesis will also faces on a comparative analysis of the effectiveness and meaningfulness of the process for public participation in environmental decision making in Australia and Uganda. There is extensive literature on the purposes to which participation may be put; the stages in the project cycle at which it should be employed; the level and power with regard to the decision making process which should be afforded to the participants; the methods which may be appropriate under the different circumstances, as well as detailed descriptions of methods; approaches and forms or typologies of public participation; and the benefits and problems of such participation.
However, there is not much significant literature that examines and analyses the meaningfulness and effectiveness of the contextual processes of such participation. This is despite the widespread belief in the importance and value of public participation, particularly by local and indigenous communities, even in the face of disillusionment caused by deceit, manipulation and tokenism. Accordingly, the thesis will use case studies to demonstrate the meaningfulness and effectiveness or otherwise of public participation in environmental decision making in protected area management. -- Increasingly, the terminology of sustainable development is more appropriate to describe contemporary policy objectives in this area, with an emphasis on promoting local livelihood and poverty alleviation within the constraints of ecosystem management. However, the domestic legal frameworks, and institutional development, in Australia and Uganda tend to reflect earlier concepts of environmental and natural resources management (referred to as environmental management in this thesis). There are some significant differences between a North (developed) nation and a South (developing) nation, in terms of the emphasis on economic objectives, political stability, resources and legal and administrative capacity. The thesis intends to explore these differences for the comparative analysis and to draw on them to highlight the complexities and interdependencies of public participation by indigenous peoples in environmental decision making, natural resources and protected area management.

This paper has as objective to understand how the National Policy of Technical Assistance and Rural Extension (PNATE) comes to the farmers of the family farming. This policy was prepared in 2004 and was celebrated by the support sectors to the family farming, because it meant a disruption with the previous extensionist model, which enjoyed the land concentration on one side, and the producing inputs companies for agriculture on the other, with several damages to the family farming. In this paper, we adopt the case study methodology, in which we observed the Empresa Matogrossense de Pesquisa Assistência Técnica e Extensão Rural (EMPAER) and farmers from the settlement Antonio Conselheiro. 187 questionnaires were applied to the settlers, as a sample of the universe. The research concludes that, if from one hand, the policy advances in favor of the family farming, on the other hand it is far from the goal of making the family farming a dynamic component of household food production chain.
Este trabalho tem por objetivo entender como chega aos agricultores da agricultura familiar a Política Nacional de Assistência Técnica e Extensão Rural (PNATER). Essa política foi elaborada em 2004 e foi bastante festejada pelos setores de apoio à agricultura familiar, porque significava um rompimento com o modelo extensionista anterior, que beneficiava a concentração fundiária de um lado, e as empresas produtoras de insumos para agricultura de outro, com vários prejuízos à agricultura familiar. Neste trabalho, adotamos a metodologia de estudo de caso, no qual observamos a Empresa Matogrossense de Pesquisa Assistência Técnica e Extensão Rural (EMPAER) e os agricultores do Assentamento Antonio Conselheiro. Foram aplicados 187 questionários aos assentados, como amostra do universo. A pesquisa conclui que se de um lado, a política avança em favor da agricultura familiar, de outro encontra-se muito distante da meta de tornar a agricultura familiar num componente dinâmico da cadeia de produção alimentar.
