Texto completoLa thèse est née de la possibilité qui nous a été donnée d’analyser en exclusivité une partie des travaux inédits du critique italien et théoricien de la littérature, Francesco Orlando (1934- 2010), qui portent sur le thème de l’invention littéraire. Les perspectives contenues dans ces inédits, dûment contextualisées, sont autant de contributions au débat sur les instruments et les méthodes de recherche dans le domaine critico-thématique. Cette matière première, qui se compose de fiches de notes et d’un corpus consistant de leçons et d’interventions intégralement enregistrés à l’aide d’un appareil audio, permet de grands développements interprétatifs; elle se prête parfaitement à une recherche qui a pour point de départ le cadre de la proposition théorique et s’ouvre ensuite, dans une seconde phase de notre travail, à l’application des résultats à l’analyse comparée des œuvres de deux auteurs de la littérature italienne, Walter Siti, et française, Michel Houellebecq, que rapprochent d’importantes convergences aussi bien thématiques, formelles que du point de vue des figures utilisées.

Texto completoThe thesis considers previously unpublished works by Italian literary critic and theoretician Francesco Orlando (1934-2010) concerning the subject of literary invention. The ideas expressed in these works, with due contextualization, provide interesting contributions in the debate about methodologies and tools of research in the field of thematic criticism. The material I consider consists in notes and in the audio tapes of a consistent corpus of lectures and conferences, and leaves room for further interpretative developments. My research considers Orlando’s material as a theoretical frame for an analysis of Italian author Walter Siti and French author Michel Houellebecq, who share important common features both thematically and stylistically

Texto completoThe evolution of the Italian system of sanctions, on the one hand, has contributed to shifting attention from the criminal "fact" to evaluating the "person" to be punished, and on the other has also led to a profound change in the very concept of a prison institution. Without any doubt, in fact, the historical-social evolution has influenced both the function of the sentence and the techniques used to punish the perpetrator. The transition from corporal punishment to prison sentences up to alternative punishments, has accelerated the historical process that saw the torture of the prisoner, physical suffering, the punishment no longer at the center of condemnation, but replaced by the humanization of punishment. However, it took years to embrace the awareness that making a condemnation human does not only mean avoiding corporal punishment, but above all reasoning on the limits and consequences that can lead to forced institutionalization without any purpose of social reintegration. In this regard I propose a modern analysis - critical and social - of the current contexts of detention, therefore, I evaluate the state of the penitentiary institutions, analyze the social function of the sentence and above all I question the actual usefulness of the prison. To this I add a detailed ethnographic study - lasted four years - on the House of Benevento and an equally meticulous comparison with the aforementioned reality and the prisons of Salerno, Eboli and Pozzuoli. I conclude the research with ample results and interesting ideas that could be resumed in the future for further analysis and comparison. The purposes of the sentence today revolve around three principles - retribution, prevention, re-socialization - and the combination of these perspectives, or the prevalence of one over the other, reflects both an internal logic of the penal system and the tendencies of the social political context. and cultural reference. With the prison reform of '75 what is highlighted is the re-educational character of the sentence, so the whole prison machine had to adapt to this logic. But was it really like that? In light of this question, I propose a reinterpretation of the 1975 reform. [edited by author]

Texto completoTo understand the advantages that the 3D models bring to Humanities, but also the risks connected to their use, we need to analyze the communication rules that supervise the transmission of information and, subsequently, investigate how the theory has been translated into practice, in some of the most significant international case studies. A wide debate has led to the preparation of increasingly detailed documents regarding the correct use of 3D models. This process has culminated with the London Charter, a milestone for Computer Graphics users, whose specificities will be analyzed in relation to their application in the considered case studies. We will then investigate the area in which the Computer Graphics products for Humanities are used, the museums, to which are associated those places that have similar purposes: study, conservation, exposure and communication, places that more and more often host multimedia installations. A specific section is dedicated to virtual museums that, in some cases, have become a real social phenomenon, even if ephemeral. The technological reception by the "museums" will then be outlined, and so the satisfaction that derives from people’s expectations. Finally, will be analyzed the ministerial programs that attempted to incorporate European trends and indications about the importance of technology for the growth of citizens' awareness. Finally, an attempt was made to extend the analysis to possible future developments: how is it possible to improve multimedia? What are the possible progress related to its creation and use? Finally, what are the new professional profiles to which these two aspects will have to be entrusted?

Texto completoThis thesis aims to carry out a critical analysis of the philosophical debate on the problem of solidarity. The first section of the thesis is dedicated to the historical-conceptual analysis of the concept of solidarity. The first chapter develops a genealogical reconstruction of the concept, focusing on the crucial shift from the idea of fraternité to solidarité; on the role of the first social theory and the main “solidaristic” ethical-political traditions. In the second chapter, the genealogy is followed by a conceptual analysis, starting from solidarity’s main forms and functions and a rational reconstruction that distinguishes it from other related practices: charity, care, and loyalty. The analysis interprets solidarity as a symmetrical relationship of mutual support and risk sharing based on the recognition of a common cause. The second section focuses on the problem of normativity of solidarity and its relationship with the idea of justice. Given the difference between the two spheres and their apparent incompatibility, the third chapter explores a wide range of theories that may exemplify possible standpoints on this complex relation. In the fourth chapter, this literature review also leads a critical interpretation that aims at integrating Jürgen Habermas’ compatibilist thesis of solidarity as the “reverse side of justice” with Axel Honneth’s concept of social freedom. The third section is devoted to the institutional, political and cultural context of the European reality. The fifth chapter discusses the relationship between the spontaneous character and the institutional-legal aspect of solidarity in the European Union, with particular attention to the reasons for its institutionalisation. However, the chapter also defends a balanced and multilevel conception of solidarity: interpersonal, collective, institutional. Finally, the aim of the sixth chapter is twofold: first, it highlights the role of solidarity in his writings on Europe, from the ’90s to the coronavirus pandemic, and emphasizes its different semantic employments; second, it critically reads the recent Habermasian partial revision of the basis of solidarity. The concluding remarks include a quick overview of some theoretical perspectives on the global nature of solidarity and present some main practical challenges that the philosophical debate on the topic will face in the future. The normative premises and potentialities of an “applied” study can lay the foundations of a critical theory of solidaristic relations.

An increasing interest in intangible heritage has been arising in the world in these last years, especially since 2003, when UNESCO drew up the Convention for the Safeguarding of Intangible Cultural Heritage. A detailed historical review shows the steps which brought to this attainment; a formal and theoretical parallelism between intangible heritage and contemporary art is outlined too. A study on the very recent history of museums allows to underline the difficulties museum encounters in collecting intangible heritage. It’s possible to think about new museological solutions thanks to the contribution of aesthetics: the thought of phenomenology helps in finding ways to respect the collection and to involve the publics. The dissertation also deals with the contemporary architecture of museums, with museum education and with the use of new technologies in museums: some uses are bad, others are good and useful for the communication of intangible cultural heritage.

Texto completoThe doctoral thesis deals with the key topic of the limits of criminal law and, in particular, of the legal limits that can be enforced by means of constitutional litigation in front of constitutional or human rights courts. In doing so, the work explores the proportionality test as developed by many important constitutional and human rights courts around the globe. After having introduced this test in its general aspects, the first part of the work tries to elaborate the structure of this test when applied to criminal offences, taking into account the peculiarities of criminal law. In order to do so, a vast overview of the relevant case–law of different constitutional and human rights courts is undertaken. The thesis identifies first of all the different fundamental rights limited by criminal offences, then an autonomous test for each of these fundamental rights is sketched out. By analysing the different steps of the proportionality test a clear distinction is made between them and similar concepts developed by the criminal law scholarship (e.g. Rechtsgut, ultima ratio, harm principle, etc.). In the second part of the work are analysed the peculiarities of the proportionality test in each legal order considering the different models of judicial review of legislation adopted. In particular the work tries to analyse the different kinds of decision available for the constitutional or human rights courts in cases of an unconstitutional criminal offence. In the conclusion of the work the proportionality test is then compared with the already mentioned concepts developed by the criminal law scholarship, in order to asses which of these two conflicting approaches best serves the identification of legal limits to the criminal power of the state.

According to art. 27 d.P.R. 30 June 2000, n. 230, it consists in a dialogical reflection on the wrongdoings they committed, their motivations, the consequences that follow on for the offenders themselves, and the possible reparations during the post-sentencing phase. The study is divided into five chapters. The first chapter focuses on the research for a constitutional basis of the “critical rethinking” and for a renewed understanding of the “finalismo rieducativo” (equivalent to the rehabilitative goal). The second chapter highlights the points of intersection between the “critical rethinking” and the “general theory of crime”. The third chapter summarizes the obstacles and the operative problems that hamper the implementation of this dialogical reflection and describes hints for a possible reform of the criminal justice system, particularly with regard to the post-sentencing phase. The fourth chapter proposes an in-depth analysis of some of the basic key-concepts for the introduction of a dialogical-restorative model of justice. Finally, the fifth chapter investigates the relationship between “rehabilitation” and “restorative justice” and takes into consideration a justice model that is inspired by “responsivity” [John Braithwaite] and “restorative justice dialogue” [Mark S. Umbreit]. By means of that, the study aims at providing a framework for an active assumption of responsibility in a more dialogical and inclusive culture.

Texto completoThe hunger for energy is hitting across every economic sector and civil society, it marked the end of the twentieth century and the beginning of the new millennium, bringing together issues relating to the existence of our generation with the survival of future generations. This need can hardly be satisfied with the current level of world energy production, but rather increases further with the improvement of economic and social policies of the countries in the developing world. This acceleration energy consumption will be consolidated in the future and with an intensity that is unlikely to be mutable. The world energy demand cannot be sustained simply on conventional energy sources and nuclear sources, but it must also be integrated with alternative energy sources. The development of renewable energy sources contribute to the creation of a model of "energy" democracy, meaning by this the synthesis of an economic, political and social, where accessibility to the power of each individual without prohibitive costs would be synonymous of economic, social and environmental. Today the economic crisis has shown that financial incentives for renewable energy have not been able to achieve a balance of renewable energy in a competitive market. Access costs for companies in this sector are still too high and not competitive. In the event that the states should suspend support schemes, the market, already incapable of self support themselves, become firm and unproductive with devastating consequences. The objective of this study is the analysis of incentives for renewable energy in Italy, considering the sector as the key point for the national economy, at a time in history when the use of fossil fuels must be accompanied by integration of other forms of energy. The analysis was carried out in a comparative and taking the example of two other jurisdictions, Spain and France, analyzed the relationship because they are both negative and positive analysis study. Spain has launched with great success energy policy renewable energy program in 2007 without the financial resources collected, which subsequently became insufficient to sustain the entire system and resulting in the suspension of the schemes in the time of economic crisis.

Texto completoIn these current times of labour transformation and worldwide changes, one of the most significant discussions in work and organisational psychology centres on the ways in which individuals can satisfy their wish for meaning. In respect to this, the phenomenon of meaningful work, which refers to the individual experi-ence and perception of work as holding significant value individually, socially, and/or independently, gains momentum. As such, meaningful work represents a positive phenomenon that people wish to have and organisations wish to provide. In the last decades, scholars devoted to the study of the individual, work, and or-ganisations have witnessed the growing interest and efforts into its exploration. As a result, multiple perspectives have been raised from within various disci-plines. While this demonstrates the importance of meaningful work, it also ren-ders meaningful work a contested topic that raises more questions than it an-swers. In particular, three main paradoxes on the nature and process of meaning-ful work lie at the heart of the current gaps in the literature on the phenomenon of meaningful work. The aim of this dissertation is the advancement of theory and evidence about the nature and processes of meaningful work via a psychological critical perspective in order for the value of people and work to be recognised. To reach these aims, the present dissertation consists of four main chapters reporting the four studies conducted. Each of these will be presented in the general introduc-tion chapter, where we will explain the imperatives that led to the realisation of the dissertation and the rationale for a psychological critical perspective within the context of valuing people and work. Chapter 1 presents a literature review covering the conceptual uncertainty represented in Paradox 1, that is, on the nature of meaningful work through its temporal view. Here, we conducted a broad literature review in order to answer questions on how to define meaningful work. We tried to understand to what ex-tent meaningful work can be considered as a subjective stable/permanent or an episodic/state experience of meaningfulness. Chapters 2 and 3 represent the empirical part of the dissertation and will cover Paradoxes 1 and 2. The uncertainty around meaningful work in work and organisational psychology regards the tension between (a) meaningful work as a purely subjective evaluation and (b) the impact of contextual features. This un-answered question is mainly due to the lack of empirical knowledge capable of offering indications on the distinctions between the two contraposing elements. Chapter 2 will present the cross-sectional study for the validation of a novel in-ventory aimed at the assessment of meaningful work and its facets, the MEaning in Work Inventory (ME-Work). The study presents the psychometrical properties of the scale and advances knowledge on the contextual features of meaningful work. Chapter 3 will extend this knowledge by investigating what makes a work-day meaningful given the exploration of the variations and fluctuations of mean-ingful work on a daily basis. A Daily Diary Study has been conducted with the aim to comprehend the role of daily work and the psychological conditions for the episodic experience of meaningful work. Moreover, cross-level analysis has been applied to investigate the role of subjective meaningful work. Chapter 4 will cover the intricate knot regarding the proposition of a normative and emancipatory ideal of what is work in the context of work and or-ganisational psychology (i.e. Paradox 3). The study of meaningful work occurs in a context that lacks the comprehension of what it is and what represents work that could be considered as a source of meaning. Given these questions, a literary analysis of a fictional narrative has been conducted. The chapter will shed light on what work means from a subjective stance by presenting the conditions for meaningful work and linked experience. The last part of the dissertation will present the narrative results. Given the interdisciplinary and pluralistic nature of the research, the dissertation will narratively propose an initial understanding of what is meaningful work through a critical work and organisational perspective.
