Texto completoThe concept of procedural burden emerged with the New Code of Civil Procedure, integrated into Chapter I dedicated to "guiding principles," under the terms "burdens" or "burden to" perform. The objective is to frame the freedom of action of the parties engaged in litigation, moving away from the traditional liberal view that considers civil proceedings as "the affair of the parties." Civil procedure indeed imposes a series of procedural formalities on the parties, understood here as the burdens of the trial. In this sense, the procedural burden encompasses all the necessary formalities for the implementation and maintenance of the parties' right to act, constituting procedural constraints that weigh upon them throughout the process. Thus, the concept appears as a fundamental notion of civil trial, fitting into a balanced distribution of roles between the parties and the judge. These burdens present themselves as genuine requirements of civil procedure, which can lead to unfavorable outcomes for litigants in case of non-compliance.The ambition to adapt procedural burdens to the productivity of the trial has intensified over the course of reforms, seeking to improve procedural efficiency at the expense of the right of access to justice for litigants. The increasing constraints, complicating procedures, as well as the strengthening of sanctions and the powers of the judge, jeopardize the outcomes of disputes for litigants who do not meet their obligations. The responsibility of the lawyer, particularly in procedures requiring mandatory representation, is also targeted and heavily engaged.A thorough study of this concept within civil proceedings has become essential, especially in light of the impacts on all stakeholders involved and on the trial itself. This study has determined its meaning, nature, and legal regime, its requirements, as well as its application across all procedures and throughout the trial. It has also become necessary to establish the means of recognition and regulation of the concept to prevent its abusive uses

Texto completoEurope of law is a reality. From economic liberties, freedoms of movement and human rights, now Europe is also developing in the field of civil law. Within the movement of Europeanization of Member States civil law, European judicial integration contributes to the construction of a European civil area. This observation leads to wonder about the structure of such area. While the actual trend is to promote a substantive structure, the procedural approach could also be explored, and even preferred. Classically, due to methodological issues, the European civil area construction is studied through approximation of substantive laws. However, the structure may not be entirely based on substance, especially since the area is constituted of different aggregated elements, which interact altogether. This study aims to analyse the European civil area also through European Union civil procedural law. Being in constant consolidation, the latter seems to be able to reveal the civil area as it allows to fulfil and to coordinate civil laws within the European judicial area

Texto completoThis research questions the functionality of violent acting out from the complex and circular assembly of the internal aspects (comprehended with regard to the concept of mental vulnerability) and the external aspects (from the concept of event) in the processual dynamics of violent acting out. This work concerns 36 male subjects, placed in the hands of justice. The modelling of the research subject is based on a review of multidisciplinary literature. Methodology is elaborated from the theoretical concepts developed, and made operational using the structure of a battery of tools : Rorschach, KAPP, MORS, EVE and EEDyPC. In accordance with our complex modelling, differents levels of results are explored : mental vulnerability and its assembly with events, and the processual dynamics of acting out by the highligting of five differential categories and the functionality of behaviour. The latter are declined in the form of discharge anti-depressive, sadized trophic narcissistic functionalities which correspond, on an internal mental homeostasis level, to the functions of imbalance avoidance and the restoring of intra mental balance. The limits and the theoretical and pragmatic contributions of this research are discussed. New research perspectives and concrete applications in clinical situation are envisaged

Texto completoBacksourcing is not a mainstream research field because it is closely linked with vertical integration and outsourcing. Indeed it means putting an end to outsourcing contracts and returning to vertical integration. Studying backsourcing is worth of interest because it allows adopting a process approach of the classical make-or-buy dilemma. The objectives of the thesis are to study the reasons for deciding backsourcing and the processes followed by firms to implement backsourcing. Several theoretical approaches were used for that. Backsourcing can be viewed as a strategic withdrawal decision or as a strategic change process that brings flexibility to the firm. This process must also be able to deal with organizational inertia. In order to answer to our research questions, we have conceived a conceptual backsourcing process model. We have carried out two longitudinal and retrospective case studies on IT activity backsourcing. Results indicate the role of internal crises for backsourcing initialization and the impact of the first backsourcing decision on the following operations. The backsourcing process development is influenced by different strategic, organizational and people factors. The thesis results underline the fact that backsourcing and outsourcing are intertwined and that backsourcing development relies on learning processes

Texto completoInternational corporate social responsibility (CSR) is an emerging field of research and little empirical research has been carried out to date. The aim of this research is to study the process of CSR strategy construction and to expand the headquarters-subsidiary relationships field of research. The research method is qualitative. The thesis rests on the Danone and Lafarge case studies including their respective Poland and South African subsidiaries. Monographs relate different phases in the construction of the CSR strategies and three main processes emerge. These processes are : led by the headquarters, initiated by the subsidiary, and interactive. Three peripheral cases (Renault, Total and Suez) feed the results of the two central cases and build up the process analysis. One result of this research is the role of four key actors, which are: the ‘leader’ and the ‘sponsor’ at the headquarters, the ‘champion’ at the level of the branch or the zone, and the ‘responsible entrepreneur’ in the subsidiary. The role of the ‘champion’ is emphasized as he holds the decision making power: the champion turns the CSR strategy into an ordinary management issue

Texto completoTo understand why and how the company outsources its accounting activities is the object of our research. This issue will be discussed in two parts: - Part I: The decision of outsourcing the accounting function (why); - Part II: Management of outsourcing the accounting function (how). In the first part, we propose a framework for analyzing the decision of outsourcing. This framework is based on the complementarity of the three theories of organization such as the theory of transaction costs, the resource-based view and the neo-institutional theory. We explain the factors that lead a company to outsource their accounting function: strategy for reducing costs, refocusing on the core of business and the search for legitimacy. We provide the criteria for selecting outsourceable activities: strategic importance, cost, quality and compatibility. We note the impact of the phase before the decision (the prior knowledge, culture), the role of hierarchy and the desire of the leader. In the second part, we propose a framework for management the post decision-making process. This framework is based on the dominant theories of inter organizational relationship: the transactional approach, the relational exchange approach and the dependence approach. We believe that the key to a successful outsourcing of the accounting function depends on the balancing management of different interfaces, the development of trust, the learning and the strategy of interdependence. The aim is to build analytical frameworks helping the company make the decision on the organization's accounting function and manage its outsourcing. We use process approach and case studies to observe and analyze all the processes of outsourcing the accounting function (decision making, implementation, monitoring and end of contract)
