The implementation of criminal liability for an unfinished crime, interrupted at the stage of preparation, is not consistent with the basic criminal law requirements, since the act committed at the stage of preparation, clearly does not contain any signs of a crime or its composition. At the same time, the imposition of punishment is carried out in accordance with the sanction of the norms of the Special part of the criminal code, which indicates the existence of an act not actually committed by the convicted person. This allows us to raise questions about the legality and necessity of bringing a person to criminal responsibility for an act recognized as preparation for the Commission of an intentional crime. The analysis of provisions of the current criminal legislation, sources of scientific literature, and also materials of judicial practice on criminal cases about incrimination of preparatory actions, allowed to draw a conclusion according to which attraction of the person to responsibility for Commission of the act characterized as preparation for Commission of crime, contradicts the principle of legality and justice. In this regard, it is proposed to change the current criminal legislation, eliminating the rules on the preparation of the Institute of unfinished crime.

6500 Background: Cancer patients (pts) have knowledge and attitudinal barriers to participation in clinical trials (CT). We developed PRE-ACT (Preparatory Education About Clinical Trials), a tailored, interactive, web-based intervention to address these barriers and improve preparation for consideration of CT as a treatment option. Methods: We conducted a prospective, randomized, multicenter, phase III clinical trial of PRE-ACT vs. control (general text about CT excerpted from NCI materials). All assessments and interventions were conducted online. Cancer pts >18 years old were enrolled before initial oncologist consultation. Pts completed a baseline assessment including CT knowledge (19-item); CT attitudes (28-item); preparation for decision making (10-item); and validated measures of preferences for shared decision making and quality/length of life. PRE-ACT pts received a summary of their preferences and a list of their top CT barriers. Based on ranking of individual barriers, pts were presented with a video library of 30-90 second clips addressing their top barriers (10 maximum). After the educational intervention a follow up survey reassessed CT barriers and preparation. Results: 1255 pts were randomized; median age 59 (range 20-88); 58% female; 12% non-white / 2% Hispanic; 76.4% some college education. 1081 pts completed baseline and post-intervention assessments. The control and PRE-ACT groups both had improved knowledge, reduced attitudinal barriers, and improved preparation (p<.0001 for all comparisons). PRE-ACT was more effective than control in improving knowledge (p=.0006) and attitudes (p<.0001). Furthermore, pts in the PRE-ACT arm were more satisfied with the amount (p=.002) and format (<.0001) of information, and felt more prepared to consider CT (p=.0003). Conclusions: This large-scale randomized trial of a tailored, web-based, video intervention demonstrates that educational information delivered online before the oncologist visit can significantly reduce knowledge barriers and attitudinal barriers and improve preparation for consideration of clinical trials. Both text and PRE-ACT are effective, with greater improvements and satisfaction in the PRE-ACT group. Clinical trial information: NCT00750009.

By submitting a draft amandment to the Act, Czech republic will fulfill the task of the European Commision. Minor adjustments may be made to the legislative process. Resumen

In recent years, there has been an interest in the effectiveness of college assessment preparation, which has prompted many studies. The majority of these studies researched instruction/coaching on the Scholastic Assessment Tool (SAT). Notably, the college entrance exam has become a growing concern for minorities, particularly African American students. Prior research by ACT, Inc. (2012, p. 2) has shown African American students rank the lowest in American College Test (ACT) scores of all racial groups. Between 2006 and 2011 the average ACT composite scores increased for White, Asian, American Indian/Alaska Native, and American/Pacific Islanders. Hispanic scores remained unchanged and the scores of African Americans students declined by an average of two scale points. The focus of this research investigated whether instruction/coaching for the ACT would increase the scores of African American students. The participants of this study were African American high school students who attended a suburban high school in the Midwest. These students took a pre-test (PLAN) and a post-test (ACT) and were provided with reflective journals to document comments and attitudes of this six-week program. The average increase in the ACT scores after taking the ACT Preparation Course was 2.00 points. Considering other variables, it appeared that the increase in these scores could be attributed to the instruction they received taking the ACT Preparation Course and prior to taking the ACT. This research compared both scores of African American students over four semesters, analyzed questionnaire data, and reflective journaling data to examine if student attitudes and scores could be affected as a result of taking a preparation course. The resulting data suggest there was not only an improvement in ACT scores, but also an improvement in student attitudes after completion of the ACT Preparation Course. Student attitudes were positively impacted towards taking the ACT in that the majority of students felt more confident when taking the test as well as acquiring a new perspective in testing skills and study strategies.

Souvent étudiée plus largement au sein des infractions préventives, l’incrimination du projet criminel justifie une étude à elle seule pour deux raisons. D’une part, elle est le seul mode d’incrimination qui procède à la fois d’une dénaturation de la théorie de la tentative et de la théorie de la complicité. Partant, les incriminations de projet criminel possèdent une structure identifiable qui leur est propre en ce qu’elles répriment l’intention de voir un acte criminel réalisé et de concevoir les moyens nécessaires à cette fin. Elles sont donc l’incrimination de la préparation d’une infraction (qui peut notamment prendre la forme d’une aide ou d’une instigation) en vue d’empêcher la survenance de celle-ci. D’autre part, parce que les incriminations de projet criminel sont destinées à empêcher que celui-ci ne soit mis à exécution, elles permettent une répression anticipée. Or, en anticipant la répression d’une infraction, le législateur a permis que sa suspicion soit également anticipée. En effet, incriminer tôt permet de suspecter tôt, ce qui permet d’enquêter tôt – favorisant alors le risque d’un détournement de la procédure pénale. Ce faisant, l’incrimination du projet criminel entraîne une mutation des outils procéduraux ainsi que des fonctions assignées au droit pénal. S’inscrivant dans une politique de standardisation tant de l’anticipation substantielle que procédurale, l’étude de l’incrimination du projet criminel appelle à la conclusion suivante : elle doit retrouver un caractère exceptionnel
Often studied more broadly within preventive offences, the criminalisation of the criminal project warrants a study on its own for two reasons. On the one hand, it is the only mode of incrimination that simultaneously distorts the theory of attempt and the theory of complicity. As a result, the criminalisation of criminal intent has a unique identifiable structure as it punishes the intention to see a criminal act carried out and to devise the necessary means to that end. It is thus the incrimination of the preparation of an offence (which may for instance take the form of aiding or abetting) to prevent it from being committed. On the other hand, since the criminalisation of a criminal project is aimed at preventing its execution, it enables early repression. By anticipating the repression of an offence, the legislator has made it possible for suspicion to be anticipated. Indeed, early criminalisation leads to early suspicion, which in turn leads to early investigation – thereby increasing the risk of misuse of criminal proceedings. In doing so, the criminalisation of the criminal project transforms procedural tools and the functions assigned to criminal law. As part of a policy of standardising both substantive and procedural anticipation, the study of the criminalisation of the criminal project leads to the following conclusion: it must regain an exceptional nature

The objective of this study is to test whether the Affordable Care Act will have an effect on the professional tax preparation industry of Kingsport, Tennessee. To accomplish this objective, the researcher collected surveys concerning taxpayers’ initial reaction to the realization that the law affects their 1040. A two proportion test for equality was performed and failed to reject the idea that the ACA will have an effect on the tax preparation industry of Kingsport. Because this study failed to prove that the change in legislation causes a jump in clientele for the professional tax preparation market, the fight for market share falls to marketers. They will decide who will benefit from this landmark piece of legislation.

Cette these presente la synthese et la reactivite de triflates du germanium en tant qu'agents de germylation et catalyseur acide de lewis. Le premier chapitre decrit plusieurs voies de synthese de mono- et ditriflates du germanium par action de l'acide triflique sur differents composes organomettaliques. Le deuxieme chapitre est consacre a la germylation de nombreuses fonctions organiques a partir des triflates du germanium ou de chlorogermanes. Pour ces deux voies de synthese, une etude mecanistique est menee afin d'interpreter la regiochimie et la stereochimie de la germylation. Le troisieme chapitre met en evidence l'activite catalytique des triflates germanies en tant qu'acide de lewis dans la reaction d'aldolisation croisee entre les enols o- et c- germanies et un aldehyde, un acetal ou une imine. La diastereoselectivite observee pour ces reactions a pu etre interpretee a partir d'un mecanisme d'approche a interactions steriques et electrostatiques minimales faisant intervenir des etats de transitions ouverts ou cycliques. La reaction de friedel et crafts, sous catalyse par le triflate de trimethylgermanium, fait l'objet du dernier chapitre.

AbstractHSCT is a complex procedure, which involves a long and complicated pathway for the patient and the intervention of many health professionals. Within this multidisciplinary team, the transplant coordinator, usually a nurse, is the ‘essential marrow’, the heart and the vital backbone of this procedure; they are an essential transplant ingredient facilitating a fluidity of the pathway and a good transmission of information. Written information about the procedure is beneficial for patients either prior to clinic visit or during clinic to allow the patients and relatives to reflect on conversations. Transplantation carries a significant risk of morbidity and mortality, and these should be considered regarding the ‘need’ to transplant, based upon risk of disease, versus risk of the transplant. Pre-transplant assessments must also be undertaken, and the results of these along with suitable donor medical clearance and cell availability are essential to ascertain that transplant is a valid option and can proceed safely. Dealing with fertility preservation upon diagnosis of cancer is often challenging; this issue is even more complex for paediatric patients. PDWP recommends that counselling about fertility preservation opportunities should be offered to each patient receiving HSCT.This chapter also focuses on vascular access for optimal treatment of haematology patients because stem cell treatment cannot be performed without it. Constant advances in haematology have raised challenging ethical dilemmas concerning end of life, palliative care, patient information, donor concerns and impartiality and issues related to the risk we run to our patients. Nurses provide a key role in patient education, providing pre- and post-transplant advocacy and counselling, plan hospitalisations and consultations. They also act as educators and role models to nursing students and share knowledge in accordance with local policies and JACIE guidelines.

By sharing examples from B-Club, we suggest possibilities for re-imaging teacher education and reconceptualizing what learning can look like for both children and adults. We unpack examples of creative play and joyful human connection that took place in this multilingual, cross-age program, showing how children and university students worked and played as they moved across activities in a free-flowing, indoor-outdoor space. We describe the learning that happened for children and adult students alike, and call for creating more such learning spaces that integrate mind, heart, and activity by approaching learning as a playful and creative act. We also underscore the importance of connection and the ways in which relationships can nurture buds of development, promote agency, produce powerful forms of learning, and support the wellbeing of body, mind, and spirit.

Chapter 3 highlights important ethical principles that school psychologists often abide by, including confidentiality and mandated reporting. Next, Chapter 3 introduces basic counseling skills that all practitioners can benefit from. These micro skills, like how to build a strong therapeutic alliance and how to listen, observe, and ask questions, are essential to maximizing CBT’s effectiveness.

Abstract The last chapter has taken us as far as 1870 in the history of secret patents, when Parliament was clearly preparing for a change in the patent system. This occurred in 1883, and will be dealt with in this chapter, which will then consider a closely related Act, the Official Secrets Act of 1889. The Public Record Office holds papers concerning the preparation of both Acts, and some of the papers concern discussions and decisions that took place back in the 1870s. This is in great contrast to the situation surrounding the Acts of 1852 and 1859, which were discussed in Chapters 2 and 3: no records survive that might tell us about the confidential discussions that preceded the preparation of these bills.

This chapter examines the fiscal and monetary achievements of the period between 1948 and 1967. These two decades were without panic, crisis, depression or more than minor recession. It was during these years that the term “Gross National Product” (GNP) was coined for the first time. Unemployment was low, there was no appreciable inflation, and the wholesale price index rose from 82.8 in 1948 to 100 in 1967. The chapter considers one idea and two institutions that were cited as the major factors for the achievements of these years: Keynesian fiscal policy, the Bretton Woods agreements, and the Employment Act (1946). It also discusses further influence that now became decisive for the advance of John Maynard Keynes's ideas: the calculations of national income, national product, and their components.

This paper reports results from a study, conducted in a fixed-base helicopter simulator, to investigate the handling qualities of possible future Personal Aerial Vehicles (PAV) that are supposed to have VTOL capabilities like helicopters. A PAV simula-tion developed in the European project myCopter is used as baseline configuration. In preparation for actual flight tests on DLR's in-flight simulator ACT/FHS an adapted version of the baseline configuration has been integrated into the model-based control environment of the ACT/FHS and evaluated on the ground-based ACT/FHS simulator. The results indicate acceptable to good model following. Finally, a third configuration with a novel steering wheel control concept is evaluated. The steering wheel replaces the conventional center stick. The other control axes are also redefined to resemble a carlike control concept for rotorcraft. The participating pilots gave better usability ratings for the conventional inceptor arrangement. Nevertheless, the detailed pilot ratings show that when the steering wheel is used the overall handling qualities can be im-proved while the subjective workload is reduced.

Since the introduction of the fi rst Public Procurement Act in 2002, the public procurement market has accounted for a signifi cant share of total premiums earned by insurance companies. In that sense, the author in this paper presents the impact of the public procurement legal framework on the insurance sector in the light of the most signifi cant innovations contained in the Public Procurement Act, which entered into force on 1 January 2020. Furthermore, the paper emphasizes the importance of adequate preparation of tender documentation and additional conditions for participation in the procurement of insurance services. Finally, the author analyzes the practice of the Republic Commission for the Protection of Rights in Public Procurement Procedures, which reveals the most common mistakes of contracting authorities in compiling additional conditions of fi nancial and business capacity.

Safe driving behaviour during lane change is the function of selecting and processing task relevant cues from the ongoing driving environment; enabling the goal-directed preparatory process. Such preparatory information typically facilitates reaction time to the anticipated event. However, it is unclear how the additional information other than task specific cues from the driving environment act on preparatory processes while driving a car. We implemented a pre-cue paradigm in a simulated lane change task (LCT) to answer this question. In contrast to the standard paradigm, additional information was presented either just before the preparatory stimulus (pre-cue) or the target stimulus (pre-target) that was either congruent, incongruent, or neutral to the lane change direction. Reaction time and amplitudes of steering out and in angles (A1 and A2) were measured as dependent variables. Results showed that reaction time and steering in amplitude A2 were increased when the additional information was presented before the final target for intended action and similarly when the additional information presented in the same lane changed direction (congruent). Later one accounts for contingent attentional capture. To accommodate the entire pattern of results observed in the study, we tentatively suggest that any information which is not relevant for the intended action have considerable influence on attention and action preparation on the basis of the temporal and visuo-spatial positioning. A strong effect is found especially at the time of the final determination of the upcoming driving manoeuvre.

Lifelong vocational learning in a digital context frequently falters due to a lack of motivation, structure, time management, and attention to adult students’ work-life balance. In remote settings, students have further little contact with peers and feel disconnected. This paper answers how a Virtual Learning Companion (VLC) can be designed to address these challenges and fulfill the specific needs of vocational students. Following a Design Science Research (DSR) approach, a meta-requirement mapping process combines insights from a literature review and ten semi-structured interviews with vocational students. A focus group with experts from the field of vocational training, online learning, chatbot design, and DSR evaluated the results. As a result, five Design Principles are presented: (1) Motivational Goal Setting, (2) Context and Learner Adaptation, (3) Focus and Control, (4) Promoting Resilience, and (5) Enabling Social Interactions and Feedback. Exemplary Design Features further illustrate the VLC development.

Environmental Impact Assessment Act has been in force in the Slovak Republic since 1994. Evaluation of potential environmental impact of nuclear facilities/activities was enforced in the cases of newly sited constructions containing nuclear facilities much earlier: the civil construction legislation required the preparation of initial safety report with the same purposes. The cardinal change constituted by the EIA Act was the legal requirement of the public involvement in the assessment process, such as participation of municipalities, civil initiatives or public hearings. Another aspect was the most complex evaluation of impact, i.e. not only inside the nuclear safety framework but including, for instance, also non-nuclear, social, and economical aspects. All nuclear activities judged by the environmental impact assessment processes in the last eight years have been related to radioactive waste and spent fuel management facilities or activities and to the decommissioning of nuclear power plants. The particular cases are briefly described and the positive and negative implications from particular environmental impact assessment processes are discussed and generalized. Special attention is given to the use of EIA approaches in the strategy decision-making processes on various levels. There are the main difficulties and drawbacks in application of the EIA legal provisions in Slovakia at the present time.

This work evaluates the bond durability for adhesive tubular lap-joints (TLJs) between titanium and CFRP using static tensile tests. Five different treatment methods are introduced to prepare the surface of the CFRP: (1) sanding, (2) air atmospheric pressure plasma treatment (APPT), (3) as-received, (4) Frekote 710NC to act as contamination, and (5) Frekote 700NC plus air APPT to understand the APPT ability to remove contamination. Characterization of the treated surface is done using X-ray Photoelectron Spectroscopy (XPS), Scanning Electron Microscope (SEM), and Water Contact Angle (WCA) to examine surface energy. Results show that air APPT produces the lowest WCA compared to the other treatment methods, indicating high surface energy and wettability. When the CFRP surface is prepared by sanding, it causes breakage to the underlying fibers, exposing them to the environment. As a result, asreceived CFRP has better bond strength than when prepared with sanding. This study evaluates the durability of adhesive TLJ and builds a relationship between surface characteristics and performance, providing insight into their behavior and knowledge of optimal surface preparation principles.

Exercise performed in swimming events can be systematized depending on the supply of oxygen in the aerobic effort (1,500m Freestyle, 10,000m Freestyle), anaerobic effort (50m Freestyle, 100m Freestyle, 200m Freestyle) and mixed effort, where the energy source is provided by both anti-oxidative reactions and oxybiotic reactions, their ratio varying according to exercise intensity and duration (400m Freestyle, 800m Freestyle). One cannot approach exercise capacity without referring to its psychological dimension, with implications on the psychomotor sphere of the athlete. A major challenge faced by performance swimming is early dropout and mental wear, in connection with different forms of motivation. Through the H-902 Waterproof Bone Conduction System, the coach can communicate directly with the athletes during training, encouraging them and influencing a change in the activation level of their positive emotional feelings. Direct communication allows transposing/ strengthening the principles of active and conscious participation and of intuition during training, removes monotony and develops the self-control ability. Examples of technical and tactical components: DAC (distance covered per arm cycle/rate, stroking length and swimming speed), correction of swimming technique, the start and turns, all of them are effectively improved. The device also allows understanding and learning the key-elements of the motor act, and enhances psychomotricity (by the correct representation of body schema and balance), in close connection with the coordination abilities.

In this paper, we address a specific tool—InnoMix—that is implemented to overcome the lack of university–industry interaction in a selected region facing structural change with its corresponding impact on the economy and society. InnoMix is facilitated and implemented by university-based transfer scouts who act as mediators and translators between the players of the regional innovation system. These transfer scouts are part of the Innovation Hub 13, in which the region’s partners and stakeholders, infrastructures and competencies are systematically networked with each other to set new impulses for knowledge and technology transfer. These new impulses are brought into the region through new transfer approaches ranging from people and tools to infrastructure. InnoMix can be considered to be a highly interactive tool to overcome the weak, direct interaction between researchers and potential corporate partners in the region to foster strong collaboration between academia and industry. InnoMix especially aims to strengthen interdisciplinary exchange to shed light on cross-disciplinary perspectives. For that reason, transfer scouts focusing on transfer activities related to the life sciences, digitalisation and lightweight construction are involved in the implementation of InnoMix. Based on 11 InnoMix running since 2019, we provide insights into the planning and preparation phase of InnoMix and the selection of relevant topics and requirements for matching participants. Furthermore, we clearly indicate which formats of InnoMix work best and in which way university–industry interactions could be curated after InnoMix is implemented.

Infant formula is a breastmilk substitute fed to babies when mums are unable or do not want to breastfeed. In the UK, almost three quarters of babies will have consumed infant formula by six weeks of age, and almost all will have by six months (McAndrew et al., 2012). Formula fed babies are at greater risk of gastrointestinal infections than breastfed babies because breastfeeding is protective against infections as it helps babies’ immune systems develop, and because bottles of formula are at risk of bacterial contamination. Bacterial contamination is thought to occur in two ways; first, powdered infant formula (PIF) is not sterile and can contain harmful bacteria, including Salmonella and Cronobacter if not prepared properly (Crawley, Westland & Sibson, 2022), and second, bottles and teats are vulnerable to contamination during preparation (Redmond et al., 2009; Cho et al., 2019). It is estimated that in the UK over 3,000 babies end up in hospital each year, and a further 10,000 are reviewed by GPs, due to gastrointestinal infections which may be attributed to formula feeding (Renfrew et al., 2012). NHS (2019) guidance states that PIF must be mixed with water at a temperature of 70o Celsius (oC) or greater, to kill any bacteria which may be present in the PIF. The use of boiled water from a kettle cooled to at least 70oC is recommended, which is then mixed with the PIF before allowing it to cool further before feeding. This should be repeated every time a bottle is needed to ensure the formula is safe. Bacteria can survive and multiply in formula, even if it is stored in a fridge. NHS guidance also contains steps to minimise contamination of baby feeding equipment, including washing hands, disinfecting preparation surfaces, and washing and sterilising all baby feeding equipment. However, research shows many parents do not carry out all these steps, and a third of parents do not feel confident about preparing PIF (Brown, Jones and Evans, 2020). Furthermore, there has been an increase in UK parents using formula preparation machines and their efficacy has not yet been sufficiently investigated.

It is important for the coach to teach the athlete the techniques of psychological protection, including restoring the stability control system, reducing feelings of anxiety and countering it. It is important to carry out special psychological training. Including effective preparation for competition, based on: social values; formation of mental "internal support"; overcoming psychological barriers. Every day the degree of development and influence of sports reaches a new level. Also, the requirements for athletes in technical, physical and tactical readiness are increasing, respectively, the result of competitive activity will already be determined by readiness and psychological attitude. Psychological preparation is a process aimed at creating a state of mental readiness for competition in athletes. This should be considered the subject of psychological preparation for competitions in sports.

Analysis of scientific literature and own practical experience of the use of augmented reality technologies application in educational practices allowed to state next: augmented reality technologies have a great potential for application in education; there are some cases of augmented reality use for school education; positive aspects of augmented reality technologies application in higher education institutions are confirmed by experiments (isolated cases); only few universities in Ukraine apply augmented reality technologies to educate students; only few universities in Ukraine have special subjects or modules in schedule to teach students to develop augmented reality technologies; various scientific events, mass events, competitions are held in Ukraine, and specialized training on the augmentation of augmented reality technologies is carried out, but this is non-systematic and does not have special state orientation and support. Features of introduction of virtual and augmented reality technologies at Sumy State University (Ukraine) are identified: “e-learning ecosystems” was created; in 2019, augmented and virtual reality research laboratory was established. Advantages and disadvantages of project activity in education are described: project activity is one of the most important components of educational process; it promotes creative self-development and self-realization of project implementers and forms various life competencies. It is determined that augmented reality application for implementation of educational projects will help: to increase students’ interest for educational material; formation of new competences; increase of students’ motivation for independent educational and cognitive activity; activation of educational activities; formation of positive motivation for personal and professional growth; conditions creation for development of personal qualities (creativity, teamwork, etc.). Current trends in implementation of educational projects were identified: most of the winner projects were implemented using augmented reality technology; augmented reality technologies were used in projects to teach different disciplines in higher education institutions. Augmented reality technology application for project activity has positive impact on learning outcomes and competitiveness of the national workforce; it will enhance the country’s position in the global economic space.

Resumen
This paper uses machine learning methods to identify key predictors of teacher effectiveness, proxied by student learning gains linked to a teacher over an academic year. Conditional inference forests and the least absolute shrinkage and selection operator are applied to matched student-teacher data for Math and Kiswahili from Grades 2 and 3 in 392 schools across Tanzania. These two machine learning methods produce consistent results and outperform standard ordinary least squares in out-of-sample prediction by 14-24 percent. As in previous research, commonly used teacher covariates like teacher gender, education, experience, and so forth are not good predictors of teacher effectiveness. Instead, teacher practice (what teachers do, measured through classroom observations and student surveys) and teacher beliefs (measured through teacher surveys) emerge as much more important. Overall, teacher covariates are stronger predictors of teacher effectiveness in Math than in Kiswahili. Teacher beliefs that they can help disadvantaged and struggling students learn (for Math) and they have good relationships within schools (for Kiswahili), teacher practice of providing written feedback and reviewing key concepts at the end of class (for Math), and spending extra time with struggling students (for Kiswahili) are highly predictive of teacher effectiveness, as is teacher preparation on how to teach foundational topics (for both Math and Kiswahili). These results demonstrate the need to pay more systematic attention to teacher preparation, practice, and beliefs in teacher research and policy.
